spent the past several months waging a campaign against the Hilton’s current expansion plans. In Wanda’s latest attack against Measure HH, the No on HH campaign this week alleged voter fraud. A complaint filed with the Los Angeles County (see ‘WANDA’ page 15)

DOUBLE SPEAK– Mayor John Mirisch has made several appearances on Farsi-language television this week, paid for by the Wanda Group, to speak out against Measure HH. Mirisch had his City Hall phone number, where taxpayer paid employees answer phones, displayed for people to call directly. Beverly Hills School Leaders Mull Earlier School Year Start By Laura Coleman If the early bird truly does get the worm, then Beverly Hills students should soon corner the market. Next year school is slated to start Aug. 7, 2017. That summer date is more than a week earlier than this year’s start date for Beverly Hills students. Los Angeles Unified School District students are slated to start school on Aug. 22, 2017. Board of Education President Howard Goldstein said that the start date might shift back to Aug. 14, depending on how current negotiations between the district and the teachers’ union shape up. “We’re working to finalize an MOU to all of this,” he said, underscoring that both sides truly do want a later start date. For the past three school years, students have been starting school increasingly early in order to allow first semester instruction to end before winter break. However, parents and teach-

ers are increasingly speaking up against next year’s early start date. In response to a petition to change the 2017-18 BHUSD school calendar to start later, Beverly Hills Education Association President Telly Tse sent a mass e-email advocating his support for a later start date. “Like you, the parents and members of our community, we want...to start later,” he wrote. Tse alleged that even though both the school district and the union want school to start Aug. 14, the district’s contract negotiations team is holding that later start date “hostage” in order to not agree to the BHEA’s demand that the new contract state that class sizes for grades K-3 cannot exceed 21 students. Negotiations are scheduled to resume Monday. Other issues on the table include the rights of substitute teachers and allowing children of employees to attend BHUSD schools.

Beverly Hills Unified’s First District-Wide Science Fair Inspires Young Minds In STEM Endeavors By Laura Coleman What do a NASA scientist, an ex-mayor with 13 patents, a cardiac electrophysiologist and a molecular biologist all have in common? Answer: They were all judges at this year’s Beverly Hills Science Fair. Held Saturday at Beverly Hills High School, around 450 people came out to see the innovative projects of 162 students ranging from transitional kindergarten to seniors at Beverly Hills Unified’s first district-wide science fair. The event was funded through a $10,000 grant from the Beverly Hills Education Foundation and built upon last year’s pilot science fair at Beverly Vista, which also

included Horace Mann students. “The inaugural districtwide Science Fair promotes student involvement in STEM learning, for which BHEF has been instrumental,” said BHEF President Monique Gibbons. “We look forward to continuing our support in future years to come.” Former Horace Mann PTA President Tina Wiener, who helped organize the fair, said the goal is to establish “a longterm, annual event which will help establish a culture of science and hands on learning in our community.” In addition to the student projects, attendees enjoyed interactive science demonstra-

tions from local companies including Professor Egghead, Rolling Robots, Ucode, Star Ecostation, Sylvan and Mathnasium. Superintendent Steve Kessler, who served as a judge, said he was encouraged that the science fair had grown to include all five schools. Said Nathan Kruger, who co-founded the science fair: “The Beverly Hills Science Fair sets up our middle school and high school students to compete and win at the LA County and California State Science Fairs. Not only does this strengthen their college resume, it helps build BHUSD’s reputation as a leader in STEM education.”

Rotary Club Of Beverly Hills Raises More Than $1,000/Minute On Its Inaugural Project Day By Victoria Talbot In one hour, the Rotary Club of Beverly Hills raised enough money to send four orphans with Corazon de Vida to school all the way through a university education. The funds will also send 175 kids to visit their imprisoned parents in the Get on the Bus program with money left over to purchase “rain catchers” to capture much-needed rain water in Entebbe, Uganda and even more to provide financial support locally for the Maple Counseling Center. The event was “Project Day,” the brainstorm of Rotary Club President Adam Heller,

concentrating all the club’s efforts into one big day of signing up and donating funds for the club’s preferred charities. More than $100,000 was raised at the club’s Oct. 17 meeting. “I created the idea of Project Day to provide an opportunity for the members of the club to demonstrate their ability and willingness to serve those in need in a huge way,” he said. “Their kindness greatly exceeded my expectations.” Heller said. City Regulates Halloween Parking By Matt Lopez Don’t be spooked, but the City of Beverly Hills will be instituting Halloween parking regulations on Monday in anticipation of heavy traffic from the annual West Hollywood Halloween Carnival. The City is establishing “no parking, except by permit” tow-away zones all Halloween on Monday in residential areas impacted by the WeHo Carnival.

BHEF Launches No Excuses November Fundraiser By Laura Coleman In an effort to capture yearend donations from Beverly Hills public school parents, the Beverly Hills Education Foundation is launching “No Excuses November.” According to BHEF President Monique Gibbons, the new campaign seeks to inspire half of all parents to

contribute to the foundation. She estimated that less than 30 percent of all of Beverly Hills Unified School District parents now donate to the foundation. “The idea is really to increase parent participation. We need people to ante up,” she said. Last year, the BHEF raised approximately $500,000,

which was used to fund multiple after school programs at the K-8 schools, extracurricular programs at the high school, 13 walk-on coaches for the athletics program, and recently, two teachers on special assignment to help K-8 teachers integrate technology into student learning. String Of Westwood Street Robberies Has West L.A. Residents On Edge By Matt Lopez Be alert when in and around Westwood, as the area was hit with several street robberies on Wednesday, according to Los Angeles Police. Between 7:30-9 p.m., a string of street robberies occurred in the Westwood neighborhoods on Westwood Boulevard, Rochester and Manning Avenues, and Bentley and Malcolm Avenues. The suspect, described as a black male, 20-to-30 years old in dark clothing, approached the victims on foot displaying a handgun and took their cell phones. In most cases, the suspect fled to a waiting vehicle described as a black 4-door sedan with a getaway driver inside. The robberies occurred at the following times and places: 10/26/16, 7:30 PM 1800 block Westwood Blvd. 10/26/16, 8:10 PM Rochester Ave/Manning Ave. 10/26/16, 8:25 PM 2300 block Bentley Avenue. 10/26/16, 8:30 PM 1700 block Malcolm Avenue.

Construction Tragedies Highlight Local Safety Concerns By Matt Lopez Two construction incidents this week highlighted safety concerns surrounding West L.A. development. First, a construction worker at a Bel-Air home died last Friday after falling 50 feet into a well. Days later, on Wednesday, delivery truck driver was rescued after falling into a 50-foot deep excavation at a construction site in Beverly Crest, just outside of Beverly Hills. Wednesday’s incident came in at about 8:40 a.m. in the 1600 block of San Ysidro

Drive, the Los Angeles Fire Department said. According to CBS Los Angeles, a 30-year-old delivery driver was pulled to safety at around 9:35 a.m. and treated for cuts. LAFD Spokesman Brian Humphrey told CBS that the man “apparently stepped on plywood covering one of several deep holes on the property... he fell as many as 50 feet down the 24-inch diameter hole, landing feet first on compacted soil.” Reports came in late Friday (see ‘CONSTRUCTION’ page 16)

The proposed project consists of revisions that would allow up to 193 residential condominiums and a luxury hotel with up to 134 rooms and ancillary facilities, ballroom/meeting rooms, and restaurant/bar uses. The proposed project also includes a new motor court access along Santa Monica Boulevard. To allow these changes in use, amendments are required to the 9900 Wilshire Specific Plan. The previously approved project also included adoption of a Development Agreement. Revisions are being proposed to the Development Agreement in conjunction with the proposed project.

Beverly Hills Police Warn Of More Phone Scammers

By Matt Lopez Beverly Hills residents are once again being targeted with another phone scam, according to a release from the Beverly Hills Police Department. The scammers claim to be representatives from either the Los Angeles Police Department of L.A. County Sheriff’s Department, calling to tell the resident that either there’s a warrant out for their arrest, or they’re subject to a federal investigation regarding a failure to appear for jury duty.

This project has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the environmental regulations of the City. The City of Beverly Hills has prepared a Final Supplemental Environmental Impact Report (Final SEIR) to analyze potential environmental impacts associated with development of the project. Specifically, the Final SEIR analyzes the following potential environmental effects of the project: • • • •

Greenhouse Gas Emission Land Use Planning Transportation/Traffic Utilities and Service Systems

• Air Quality • Noise • Mandatory Findings of Significance

The City Council will consider the Final SEIR, and may adopt a resolution certifying the Final SEIR, adopting a Mitigation Monitoring and Reporting Program, and adopting a Statement of Overriding Considerations. The City Council will also consider whether to conditionally approve the Specific Plan Amendments and proposed Development Agreement. At a Special Meeting on October 19, 2016, the Planning Commission of the City of Beverly Hills adopted a resolution recommending that the City Council adopt amendments to the 9900 Wilshire Specific Plan (also known as the One Beverly Hills Project) and associated development agreement between the City and Wanda Beverly Hills Properties, LLC to allow luxury residential condominiums, a luxury boutique hotel, public gardens, and ancillary commercial uses, at 9900 Wilshire Boulevard and made a recommendation to certify the Final SEIR under CEQA. At the public hearing, the City Council will hear and consider all comments. All interested persons are invited to attend and speak on this matter. Written comments may also be submitted and should be addressed to the City Council, c/o City Clerk, 455 N. Rexford Drive, Beverly Hills, CA 90210. The comments should be received prior to the hearing date. Registrar-Recorder states: “Numerous individuals in Beverly Hills have fraudulently registered to vote from an address that is not their true domicile.” The allegation singles out three individuals who registered in 2007, 2012 and 2014. The complaint attempts to connect these individuals with the Yes on HH campaign even though all three registered long before there was a proposal to change the City Council and voter-approved 2008 Beverly Hilton Specific Plan. It also provides a list of over 300 others who have no direct connection, admits One Beverly Hills spokesperson Adam Englander, who sent out a press release on the allegations last week. Englander does not know the 331 individuals, who or what they support, where they live, or if they are voting or have voted in Beverly Hills, he further admits. The 331 names are voters who have used post office boxes to register, many of them women. Now, their phone numbers have been made public solely in an attempt to discredit the Yes on HH campaign. Englander has accused Hilton representatives of organized voter registration at Yes on HH events. According to Hilton spokesperson Marie Garvey, no organized registration occurred. He further criticized the Yes on HH campaign for providing election-related material, such as vote-bymail applications. The Courier has confirmed that the Wanda Group purchased time on Farsi-language television and radio stations during which Planning Commission Chair Joe Shooshani translates the English spoken by Beverly Hills Mayor John Mirisch into Farsi during multiple 30-minute interview spots for No on HH. However, bilingual English-Farsi-speaking residents say the translations are filled with inaccuracies to discredit the Hilton Initiative. In addition to Mirisch’s paid television spots attacking Measure HH, Mirisch has taken to openly arguing with HH supporters via social media. In one Facebook discussion that took place on the Beverly Hills High School Alumni page over a three-day period, Mirisch became increasingly testy as he repeatedly engaged Nicole and Dani Nism, 20 and 23-year old sisters who support the initiative. At one point Mirisch curiously likened their support to Donald Trump’s campaign for president. “Feel free to call me a ‘Christ killer’ and a dirty Jew,” he wrote in one exchange verified by the Courier. Notwithstanding the sisters’ Israeli nationality, Mirisch writes that the sisters’ comments, “Are a reflection of you and your upbringing. I’m proud not to represent the likes of you.” “Seems. . . you’ve gotten confused from all the free food and drink at the Hilton’s events,” he taunts. When the sisters fail to engage, Mirisch repeatedly asks: “So you haven’t eaten any of the Hilton’s free food or drunk any of the Hilton’s free beverages?” Nicole Nism eventually responds: “Wait, didn’t Wanda take you out to dinner just last week??” She is referring to Mirisch joining Wanda Chairman Wang Jianlin on his trip to Hollywood last week where he attempted to lure American film production to his facilities in China with a 40percent rebate. Mirisch cancelled his City-duties to be with the chairman’s entourage. The Facebook conversation is available in screenshots on the Courier website. Recently, Measure HH supports hosted a neighborhood event at a private home on Roxbury Drive where around 65 friends listened intently as Hilton owner Beny Alagem addressed the crowd. At a question and answer that followed Alagem’s presentation, the first question asked was, ”Why is Wanda so opposed to the Hilton?” “I don’t know,” replied Alagem.

Tomorrow’s Friendly House Luncheon To Raise Funds, Awareness For Alcoholism By Laura Coleman For centuries, the intoxicating effects of alcohol have robbed the very souls of men and women who simply cannot get a handle on their addiction. But it wasn’t until too long ago that society actually acknowledged that women could also fall victim to the disease of alcoholism. To that end, in 1951 Bea Jorgensen founded Friendly House in Los Angeles, the nation’s first alcohol treatment center for women. Tomorrow, the Peggy Albrecht Friendly House (recently renamed for its eponymous director of the past 33 years), will hold its 27th annual awards luncheon at The Beverly Hilton. The event will honor Linell and Robert Shapiro with the “Humanitarian Award” and Katey Sagal with the “Woman of the Year Award.”

The program, which boasts a 78percent successful recovery rate, is relatively simple in theory, explained Friendly House director Peggy Albrecht. Attendees were a part of Aviva’s Platinum Associates, a dynamic group of people who are dedicated to making a difference in the lives of local at-risk youth. Since its inception in 2001, the Platinum Associates have raised more than $1 million in support of Aviva’s Wallis Annenberg Residential Treatment Program while increasing awareness of Aviva’s work. For the last three years, Aviva Family and Children’s Services has worked jointly with the Youth in action Film Collaboration (YAFC). Started by nonprofit entrepreneur Jason Lesner, YAFC is a unique and creative collaboration between at-risk teens and film industry professionals that inspires and engages foster youth. For many young people who have faced adversity, possibilities can seem limited. YAFC is a grassroots community service project focused on creating an opportunity for at-risk youth to experience anything that is possible through filmmaking. Film and television professionals from shows like Modern Family, The Mindy Project, New Girl, Chasing Life, and Robot Chicken came together this summer for an all-new production: helping at-risk foster youth create script and direct their own original film shorts. The Contractor and all subcontractors shall furnish certified payroll records as required pursuant Labor Code section 1776 directly to the Labor Commissioner in accordance with Labor Code section 1771.4 on at least on a monthly basis (or more frequently if required by the District or the Labor Commissioner) and in a format prescribed by the Labor Commissioner. LETTERS TO THE EDITOR Feeling very blessed, some 45 years ago, my family and I chose to settle in Beverly Hills because of its quality of life, low rise buildings, and benign traffic. Beverly Hills’ long established zoning laws restrict our City’s buildings to 3-stories, with a maximum height of 45 feet. However, for the past decade, developers with distinctive access and influence have received special favors from our City Council to build much taller buildings. We were told the 9-story Montage would be a one-off exception. Subsequently, the City Council approved a 16-story hotel, along with two condominium towers of 18 and 8-stories on the Hilton site. The City also approved two condo towers of 16 and 13-stories on the Robinsons-May site. The wanton disregard of our 45 foot height limit will change our City’s landscape and quality of life forever. It will also undermine our confidence in the institution of our City Council and elected officials. It has put into question their judgement, if not, their integrity. The former City Councilmembers responsible, had essentially created two sets of rules: one for those developers who had the ability to hire former councilmember lobbyists with access to our City officials, and a second for the people who didn’t have such access or influence. This is cronyism–at its worst! Spot zoning results in poor City planning, and sets a bad precedent. Since the 9-story Montage building was approved, the flood gates have opened, with a slew of developers seeking hi-rises. Developers argue they need the extra height to “pencil out” their projects. I’m sorry, but nobody put a gun to their heads to buy the property, nor did anyone force them to over-pay for their property! They knew full well what the zoning allows, and overpaying for a property should not be the City’s concern. Developers have figured out that spending money on lobbyists with ties to the City Council (or seeking a hi-rise zone change through a voter initiative) is infinitely more advantageous and lucrative than abiding by our 45 foot height limit. This puts all law abiding people at a significant disadvantage. A height advantage substantially increases a project’s value by allowing better positioning and views. This is not about competition. I personally relish the competition as long as the playing field is level for everyone. Cronyism and spot zoning are unfair and short-sighted to the detriment of the community. It is time for the “Manhattanization” of Beverly Hills to be put on hold, as we try to bring some sanity to the hi-rise train wreck! Skyscraper plans must be set aside until the community, as a whole, decides whether or not hi-rises are the direction we want to pursue for our future generations. And, should the community prefer hi-rise buildings, then let us study this matter methodically, receive all stakeholders’ input, and amend our City’s General Plan to reflect the peoples’ will. Some say the City will receive much needed revenues from the new hi-rise projects. If hirises are so beneficial, why not up-zone all of the City’s commercial zones to say, 8, 18, or 26 stories? Of course, I don’t think anyone wants that, because our infrastructure is unable to handle such burden. It is only right that the City provide zoning clarity for developers, but let’s not have a checkerboard of hi-rises in the City, without proper planning. To the best of my knowledge, none of the current owners/developers of the proposed hirises projects live in Beverly Hills; they simply don’t have the same kind of stake in our community, or appreciation for our way of life. Allowing spot zoning and enrichment by carpetbaggerdevelopers to shape our City’s future is reckless, and could eventually reduce our property values. Let us be grateful for the blessings we have in our City’s beautiful tree-lined streets, and for our quality of life. Let us have clarity of mind, and not forget that we are stewards of our community for the benefit of future generations. Robert Zarnegin ****** The Los Angeles Times wrote a recent article about the intentional inaccuracy of Metro’s traffic reduction predictions. Metro again is making false promises (just as it told our City that the new subway route would traverse Santa Monica Boulevard, omitting until the last minute that it would instead go under our City’s only high school). Now with their proposed “Measure M” (a sales tax increase that would last forever and is dubbed “the forever tax”), Metro intentionally hides the ball from the voters that their 15 percent projected traffic reduction won't occur, if at all, until 2057! Still again, Metro spent $1.5 billion on the Expo line with the promise of a significant reduction of traffic on the 10, and it clearly hasn't materialized. Metro is wasting $200-$300 million of our tax money to move its proposed station in Century City one block to cater to local developers. Metro is also spending billions to build numerous stations throughout LA with no parking at all (including two stops in Beverly Hills with zero parking). We are talking about handing this agency billions of our sales tax dollars when they haven't delivered on past promises, mislead us on their future results and waste precious resources on ill-conceived planning. Measure M is misleading and misguided. Vote “no.” Ken Goldman ****** Who needs Circ du Soleil when the Beverly Hills Land Company is in town. Though it was a matinee performance, the room was filled to capacity with its loyal fans. And when one of the two talking magpies dressed in their black attorney’s costume waved one of his wings, all the fans stood up and began singing the BHLC theme song. It brought a tear to my eye to witness such love, devotion and botox. Then the magpies began their act, performing some of the most incredible feats of magic and illusion. I gasped at how real it appeared. There was a brief intermission, wherein a panel of experts attempted to determine if one narrative plus a fact equals an opinion-or was it one opinion plus a narrative minus a fact is half a narrative--or one fact plus an opinion minus half a narrative equals a plot reversal. By this time I could feel my Twilight Zone allergy aroused and thought it best to leave. I was told that the grand finale had everyone out of their seats with some shouting “it’s me,” others “it’s my fault,” and still others “no it's my fault,” --until they all shouted “it‘s everyone's fault” or “it’s no one’s fault.” The city manager was instructed to remove the word “fault” from all of the dictionaries in the City. I think it is very important our friends and neighbors have a complete understanding of the initiative. Regardless of whether residents vote “yes” or “no,” there will be future development on The Beverly Hilton site. The question is, will there be two condominium buildings? Or just one building and a “forever” park at Wilshire Boulevard and Merv Griffin Way? As you know, in 2008, after almost 20 hearings with our various commissions and the City Council, the original proposal was placed on the ballot to let the residents of Beverly Hills decide its future. The vote was positive, allowing construction of the Waldorf Astoria and two condominium buildings. Many of our neighbors in Southwest Beverly Hills have expressed concern about the new project, saying that the proposed 26 story tower is “too big.” However, I believe the updated 2016 plan is so much better because of the creation of the “forever” park. A covenant has been executed and recorded with the county requiring that the new park remain just that, with never any building upon it. Plus, the new building will be situated on Santa Monica Boulevard, across the street from the recently completed 40 story tower which is located about one foot outside Beverly Hills. I would understand the concern about height had the new tower not been erected already – but it has. I believe that much of the opposition to HH comes from paid lobbyists, our commissioners and council members who feel that the 2016 proposal circumvented their ability to approve or disapprove the changes. Our mayor certainly has expressed “hurt feelings.” But we must keep in mind that after much deliberation in 2008, the proposal still went to Beverly Hills residents, who approved it. Similarly, if the 2016 proposal went through the traditional method, it could be delayed until 2020 or later – and still end up on our ballot. Having lived in Beverly Hills most of my life, I appeal to all our voters to consider what I have expressed. I thank you, and – with your “yes” vote – I look forward to HH becoming a reality in the very near future. Roger W. Behrstock
