Courier Supports Measure HH By Courier staff The Courier urges a ‘yes’ vote on Measure HH for the following reasons: Project review • The opposition’s arguments, largely paid for by the Wanda Group, claim the project is bypassing the City’s traditional review process, but the original 2008 plan went through extensive environmental review, including 19 public hearings and approval from City leaders before it was passed by voters. All 109 conditions and 32 pages of mitigation that were included in the project’s 2008 approval remain in effect. • The new proposal, according to the City’s own report, contains no additional impacts such

as traffic, square footage or any additional uses from the approved plan. Additionally, the City’s report shows Measure HH would reduce the project’s construction time and traffic impacts by 11 months. Green space • The national average for publicly-accessible open space is 43 acres per 1,000 residents. Based on those numbers, Beverly Hills has around 40 percent less open space than the national standard. It’s sorely needed in town. • Bound by a covenant filed with L.A. County that prohibits anything from being built on it in the future, the park will be open to the public every day of the year. (see ‘MEASURE HH’ page 12)

Beverly Hills School District Bond Refinancing Will Save Taxpayers $6.2M By Laura Coleman Financial advisors to the Beverly Hills Unified School District successfully navigated a savings of over $6.2 million for local taxpayers by refinancing two previously issued sets of Measure E bonds this week. By refinancing portions of the $72 million 2009 series

and $45 million 2013 series issued from 2008’s voter approved $334 million Measure E bond, BHUSD Chief Administrative Officer La Tanya Kirk-Carter confirmed the community would realize the savings in the form of a reduced tax bill. In April 2012, the district

completed a similar bond refinancing that saved district property owners over $2.6 million. “I am pleased that our Finance Committee and staff continue to work with our bond advisors to find ways to save this community money,” (see ‘BOND’ page 12)

By Victoria Talbot A Beverly Hills City press release sent at 10:41 p.m. Friday evening extols an “Unmatched Agreement with the Wanda Group” that promises “an additional $550 million in payments to the City over 30 years.” The proposed development agreement includes $60 million in upfront fees. The press release claims that the project will bring in $820 million dollars in 30 years. The agreement, negotiated by Mirisch and councilmember Lili Bosse, was touted as a major achievement. By contrast, The Beverly Hilton will bring in $1.1 billion over the next 30 years. The Wanda project has not yet received final approval; there are major issues with the entrances and the loading dock which could have an affect on the final project. Publicizing the agreement in advance of a confirmed project is highly unusual according

The proposed Zone Text Amendment would establish criteria for pet boarding facilities that are ancillary to a retail space and, among other things, do not occupy more than 30% of the floor area of the retail establishment. The City previously issued a public notice regarding the Planning Commission’s consideration of the Zone Text Amendment and the proposed pet boarding facility located at 9388 South Santa Monica Boulevard. At its October 13, 2016 meeting, the Planning Commission adopted a resolution recommending that the City Council approve the requested Zone Text Amendment, and adopted a resolution approving the requested Conditional Use Permit. At the City Council hearing on November 15, 2016 the subject Ordinance will be considered. The City Council may adopt the Ordinance at a subsequent meeting, and the Ordinance would take effect on the 31st day thereafter. This project has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the environmental regulations of the City. Staff believes the project qualifies for Class 1 and Class 5 Categorical Exemptions pursuant to Sections 15301 and 15305 of Title 14 of the California Code of Regulations for minor additions and operational changes to an existing building, as well as minor changes in land use limitations. The proposed Zone Text Amendment would allow pet boarding as an ancillary activity in retail establishments located in certain commercial zones in the City. The City Council will consider finding that the Amendments will not have a significant environmental impact and are exempt from the provisions of CEQA. Mayor Mirisch Gets Cease and Desist Letter For Inappropriate Use Of City Shield On Farsi TV

Beverly Hills Teachers Union, District Reach Tentative Agreement To Cap Class Size At 23, Raise Substitute Teacher Pay, Start School Later By Matt Lopez The Beverly Hills teachers union and the school district reached a tentative agreement this week that will maintain the current cap for K-3 class sizes at 23-to-one and give the district’s substitute teachers a pay increase. Also, the agreement cemented a start date of Aug. 14 for the 2017-18 school year, and Aug. 13 for the 2018-19 school year. Last week, before the agreement was signed off on, there was talk that next school year could begin Aug. 7. One of the big sticking points in the agreement between the Beverly Hills Unified School District and the Beverly Hills Education Association (BHEA) was class

sizes. The new tentative agreement, signed on Oct. 31, caps K-3 class sizes at 23 students, effective through Dec. 31, 2018. There is growing concern among parents that the number, which the board originally approved in March, could go even higher in the future. The contract also serves to further compensate teachers who handle greater numbers of students. If the district exceeds 21 students in any class, the teacher of that class is to be compensated at a 4.76 percent increase of their annual salary, prorated monthly. If the cap is exceeded by two students, the teacher gets paid a 9.52 salary increase, prorated monthly. “BHEA is pleased that we

have finally reached a tentative agreement with the district and Board of Education,” BHEA President Telly Tse said. “Despite everything it took to reach this point, we never doubted that everyone’s heart was in the right place.” Under the tentative agreement, substitute teachers in the district will see a pay increase from $145.36 per day to $183, which Tse said is more aligned with neighboring districts. Long-term substitutes can make up to $237 per day. The agreement has been sent to the Los Angeles County Office of Education. Board President Howard Goldstein said he hopes to have the agreement returned to the district in time to ratify it at a special meeting on Nov. 9.

By Victoria Talbot Beverly Hills City officials moved late Friday to correct an apparent mistake made by Major John Mirisch and his office. Following several appearances on Farsi-language TV and radio to promote the “no on HH” campaign, where Mirisch spoke out against Measure HH with the City’s trademarked Beverly Hills Shield design on the screen next to his name. The Cease and Desist letter from a City attorney to the TV station states: “Please provide your written assurances that you will not use the Shield in your website and in any and all advertising and media and agree not to use the shield in the future.” The shield appears at the bottom of the screen on the paid media spots where Mirisch and Planning Commission Chair Joe Shooshani speak out against the Hilton’s expansion plan. Also on the screen is the City's phone number to the mayor's office, which is answered by various taxpayer salaried employees. City Attorney Larry Wiener confirmed that the City sent out the Cease and Desist letter. Seeking clarification regarding the use of City staff

to answer the phones at City Hall on behalf of the mayor's political position, the Courier asked Wiener if it was legal for the City’s phone number to be used in a political endorsement by the mayor, calling on City staff to answer the phone at taxpayer expense. Wiener responded that he did not believe that City staff would answer questions on Measure HH. Though it was pointed out that the question was not whether staff would answer questions, but whether it was legal to use staff to answer the phones, Wiener repeated his answer – several times. The “no on HH” ads are part of an aggressive media blitz sponsored by Wanda Beverly Hills Properties, LLC with Major Funding from Lakeshore East Parcel P, LLC, a Wanda development in Chicago. The campaign has made several media buys on radio and TV targeting Farsispeaking residents leading up to the Nov. 8 election.

Alzheimer’s Caregivers Forum Comes To Beverly Hills Library By Matt Lopez A free, three-part series to help caregivers deal with loved

ones and patients suffering from Alzheimers and related dementia is being hosted at the Beverly Hills Public Library this month. Presented by the Alzheimer’s Association of California’s Southland Chapter, the first seminar took place yesterday. The forum will continue over the following two Thursdays; Nov. 10 and Nov. 17. Topics include: “The Basics: Memory Loss, Dementia And Alzheimer’s Disease;” “Effective Communication Strategies;” and “Understanding and Responding to DementiaRelated Behaviors.” The seminar is in conjunction with November being recognized as National Alzheimer’s Disease Awareness Month, which was designated in 1983 by President Ronald Reagan. Local Singer, BHHS Graduate Raye Zaragoza To Perform At Vampire Lounge By Laura Coleman Local chanteuse Raye Zaragoza is set to perform Thursday night at the Vampire Lounge for an evening of songs and wine tasting. Just a stone’s throw from where Raye graduated Beverly Hills High School in 2011, the Beverly Hills wine bar provides an intimate setting in which to sample intriguing reds while listening to Raye’s folksy tunes. “I really feel like music can change the world and that’s what I want to do with it,” she recently told the Courier. “There’s a lot you can do with your music for social change and social awareness.” Recently, Raye’s original music has gone viral following her poignant composition about the Dakota Access Pipeline, which she wrote in solidarity with the Standing Rock Sioux. Lines like, “we’re standing up for our water; don’t

poison the future away,” are haunting and powerful, particularly when crooned in Raye’s folksy style with her guitar. Her voice, she said, blossomed during her years as a singer with the BHHS Madrigals and Minnesingers under the instruction of Joel Pressman. “I was always singing,” she recalled, adding that her parents would offer her and her siblings pocket change to perform as children if they ever hesitated to sing when asked. Originally from New York–the Zaragoza family moved to Beverly Hills in 2007 so Raye could start BHHS as a freshman–Raye moved back to her birthplace after graduating high school with dreams of launching a career in music. After forming a band, (all the other members are still in New York) and traveling throughout the U.S. and in

GOOD LUCK GETTING TO WORK— Residents on Cecina Way in Bel-Air were shocked on Wednesday morning to leave their homes and find their street completely blocked by a construction truck. Residents report the narrow cul de sac has been regularly blocked with trucks unloading and workers cars parked all along the road, reducing access most days to one very narrow and extremely chewed up "lane." It has limited deliveries, visitors and general vehicular movement. Even after alerting LADBS inspectors, the truck was still blocking the street a day later. 434 N. Rodeo Drive (Hermes of Paris) Architect: Rena Dumas Architecture Interieure The recently-renovated 12,000-square-foot flagship is recognizable by its distinctive white marble facade — looking something like an ice cube

tray — which fits in nicely with the neighboring retail edifices along the luxury shopping strip. The store was designed by Paris-based firm Rena Dumas Architecture Interieure, which was founded by Pierre-Alexis Dumas' late mother Rena (who designed all the Hermès boutiques, beginning with Beverly Hills in 1972). The interior is airy and light, with a white marble spiral staircase reminiscent of a giant seashell, leading to a skylight that brings to mind a Skyspace by artist James Turrell. Dumas gave the space his personal touch by curating all the artwork, beginning with the store windows. He tapped Paris-based artists Lucie Thomas and Thibault Zimmermann (known as Zim & Zou) to create a colorful paper art wonderland reflecting the flora and fauna of Southern California, as well as its skyline, including a miniature Staples Center.

The building serves the City as well as the public and includes the City’s cable TV facilities and open office and retail space for lease. The building features several energy saving techniques, including an extensive photovoltaic system of both panels and thin film, water efficiency measures reducing water usage by 30 percent, and a stormwater management system. The project’s architect Steven Ehrlich’s Yanai Rhee Chaney Architects is a 2015 American Institute of Architects Firm Award winner.

unusual timing of the release of the financial agreement before the details of the final plan are approved by the City Council. The full City Council does not yet know the details of the project, the impacts, or the details of the Development Agreement and do not even begin their review until next week. “It is completely premature and highly unusual for the City and Wanda to jointly announce and publicize a Development Agreement making it seem that the Wanda project is a done deal when it hasn’t even been reviewed or approved by City Council,” said Hilton spokesperson Marie Garvey. The announcement of a pending agreement comes amidst a fog of controversy over Mayor John Mirisch's ex parte communications with Chairman Wang Jianlin and Wanda Group associates. Mirisch, who has accused the Hilton of trying to buy an election with its HH Initiative, appears to have created a conflict of interest for failing to disclose his secret meeting with Wanda Chairman Wang Jianlin while he was in China. Nor has he disclosed who paid for his plane trip to Beijing or his hotel stay while there. Before he departed for China, the Courier requested that Mirisch provide a copy of his meeting schedule, which was never provided.

Mirisch appears to be selling Beverly Hills to Wanda in a deal that concluded late Friday, a week before the One Beverly Hills project is even scheduled to appear on the City Council agenda. Considering that th City Council members have not had their own chance to examine the project, it is unusually hasty to push the project through like this. Mirisch has scheduled three consecutive hearing dates, Nov. 78-9 (which includes Election Day), and four more just before and after Thanksgiving in what appears to be his personal attempt at fast-tracking the approval so as to avoid public scrutiny. Vice Mayor Nancy Krasne objected to the fast-track schedule. The Wanda project, originally approved for residential only, is proposing 200,000 square feet of commercial space, including five restaurants, bars and lounges, meeting rooms, and ballrooms. The project would include one of the largest commercial spaces in the City. The $60 million proposal is the highest priced “buy-in” in City history. At the encouragement of Mirisch, the City bureaucracy is on track to quickly approve the 901,514 square foot project. The mysterious haste to approve the project so quickly is reminiscent of the City's still unresolved lack of transparency in matters surrounding Lots 12 & 13.

Two to three months more will not make or break this project . . . We will have this forever. Let’s do it right. 2. Notification of council members by email of impending critically important meetings and assuming their approval is not acceptable. Noticing it in the newspaper prior to a response is a bullying tactic that is not acceptable. 3. I am concerned about discussing the 9900 plan before the council has seen and confirmed the development agreement. . . It is our responsibility as a council to approve the agreement. The attorneys do not act instead of the council . . . Is Wanda trying to buy our approval

Do not assume that I have been notified. . . unless you. . . hear my voice. . . If it is critical, call me! 5. I have previously scheduled meetings and appointments on those days. . . I have never missed a meeting. . . I plan all my appointments around City Council meetings so that I will not miss one. I would have preferred to do it the following week but that is not convenient for Mayor Mirisch because he’s traveling to Israel on the City’s dime. . . 6. It is unprecedented to have any kind of City Council meeting on a presidential election day. (Editor’s Note – the last time was in 2006). 7. My preference would be to have these meetings spread out over some time to give the community an opportunity to give their input on a project of this magnitude. 8. When I voted on the Hilton and 9900 projects in 2008 I never saw the development agreement. . . that was because they were scru-

tinized and viewed by all the council prior to my getting on the council. I’m not letting that happen again, because the buck stops with me and I am accountable. I accepted that responsibility when I sat in this chair. 9. If Mayor Mirisch approved the development agreement I feel that is a total conflict of interest considering his relationship with the Wanda group. Personally, I feel he should recuse himself from this entire project. 10. Mayor Mirisch’s relationship with the principals at the Wanda group give me pause to wonder why this is being pushed through so quickly and in three consecutive days. I will not be a party to ramming this down anyone’s throat. 11. The public hearing has to be open for someone so that people, during the approaching holidays, will not miss this chance to give their input. 12. The Hilton campaign will be over; give the people a chance to digest all this new information before pushing another major project at them. No comment was made following the Mayor’s response and Krasne’s comments were ignored.

The Board of Education voted unanimously over two weeks ago to move forward with the opportunity, instructing district staff to refund up to $62 million from those two previously issued series. However, it wasn’t until this week that the district was able to take advantage of the low interest rate environment following last week’s market fluctuation. Resolution No. 2016-2017-010 states: “All benefits from the refunding will be delivered to the property owners in the district.” The resolution further authorizes the issuance of both current interest bonds and capital appreciation bonds and states that the final maturity of the

About Those 331 PO Boxes That ‘No On HH’ Allege Are Fraudulent… By Victoria Talbot I moved to Beverly Hills a few months ago and opened a post office box at a private postal service business and changed my address from my former residence for myself and my 94-year old mother, who suffers from dementia. Last week, I received a vote by mail ballot for her, which I thought was odd. Election materials are not forwarded. Knowing she was not able to vote, I discarded the ballot. Tuesday morning, I received a letter from the County Registrar-Recorder for my mom, explaining that to vote, she needed to fill out the enclosed registration with a physical address because postal boxes are not legal addresses. Since she did not (could not) register at my new address, I wondered how she had been re-registered at the PO Box in the first place? It took several hours, but Executive Assistant Aaron Nevarez of the RegistrarRecorder/County Clerk’s office explained. The original ballot sent to the old address was not forwarded. It returned to the County Clerk with a forwarding address. The voter information was automatically updated because my mom is a permanent vote-bymail voter. The new ballot was

then sent out. Then, when the Beverly Hills city clerk filed a complaint with the County RegistrarRecorder regarding the 331 voters registered at PO Boxes, a letter was sent to all of those without a physical address on their registration. The matter was on the agenda at Tuesday’s City Council study session. The county clerk reports that several of the 331 voters have responded to their inquiries, all with Beverly Hills addresses, by Wednesday afternoon. My mom was not yet on that list. But now, though I called the County and the City of Beverly Hills, unless I am her conservator, it appears I cannot stop them from sending election materials to her PO Box. At Tuesday’s Study Session, Mayor John Mirisch was questioning resident Larry Larson about alleged voter fraud in the last Hilton election in 2008. Larson recounted how he determined homes where he felt “too many” voters were registered and knocked on those doors. When the resident was intimidated by his questioning about how many people lived in the home and voted from the address, he would then fan out to neighbors to ask them for more information.

In that way, Larson says over 500 fraudulent voters were found that did not live in Beverly Hills - but never prosecuted by the district attorney. To combat voter fraud in this election before they voted, Mirisch explored the possibility of the City employing people to read the voter rolls and to knock on doors at homes with “too many” people registered. Aaron Nevarez and Beverly Hills Assistant City Clerk Lourdes Sy-Rodriguez, advised against it. “To be very clear, intimidation of voters is something we discourage,” said Nevarez. “It is illegal to check IDs at polling locations. Every person has a unique story and a unique record. To blanket this all as malfeasance is not correct.” That is certainly true in my case. The County Clerk re-registered my mother at a PO box. The City’s complaint resulted in the 331 voters being “pended,” meaning that their votes will be held pending the confirmation of their residence. “It is a process. We make every attempt not to disenfranchise the voters. We are taking a very methodical approach and responding fully to the complaint,” said Nevarez. The election will be on Tuesday, Nov. 8.

Robert Ackerman’s Blood—‘Political Thriller With Music’—Returns At The Complex The inspiration for Robert Allan Ackerman’s play Blood is a story that had to be told—a little known or remembered incident in the early ‘80s when U.S. companies knowingly sold AIDS-tainted blood to Japan with the collusion of the Japanese government—resulting in the deaths of more than 2,000 hemophilacs. The impetus for the play is mysterious and worthy of a film in itself, as the 15-year resident, working in Tokyo with a Japanese theatre troupe at the time, was approached by a Japanese film company for a film adaption of the story and presented with reams of research and videotapes. The film version didn’t pan out, so Ackerman wrote a play, encouraged by his friend actress Glenne Headly (Dirty Rotten Scoundrels, Dick Tracy), who stars in the current production running Robert Alan through Sunday Ackerman Dec. 18 at the Complex, 6476 Santa Monica Blvd. (A run in Hollywood earlier this year drew rave reviews, but had to close due to theater availability.) Headly stars as an American Jewish reporter who uncovers the conspiracy and teams with a Korean-Japanese lawyer who heads up the investigation that leads to a suit against the government. Ackerman has directed both productions—”I wouldn’t want anyone else to do it and it was written in a specific way to get through 60 scenes. I envisioned it

as a ‘theatrical opus’ incorporating kabuki and other Asian theatre traditions, vaudeville elements and music. “Writing it as a theatre piece, it was really dark,” says Ackerman, and I was doing it for my own amusement, so I thought it would be fun to make the villainous government ministers into buffoonish clowns. And it would be fun if they sang.” Dressed as Charlie Chaplin in The Great Dictator they sing music from The Mikado with re-written lyrics. Original music is by his son, The Virgins bassist Nick Ackerman and Jet drummer/vocalist Chris Cester. “The music is terrific and it’s a fun production,” Ackerman says. “It’s about something horrific, but its fun to watch and moving and upsetting. ackie Kassorla, an Emmy-award winning TV producer has optioned the book, Miracle at Springfield Hospital, by world-renowned psychologist, best-selling author and on-air personality, Dr. Irene Kassorla. The screenplay of the currently unpublished biography focuses on two well-loved genres—that of a woman relentlessly fighting against all odds and an unbelievable miracle cure story. Making the decision with his wife, also a physician, Dr. Ungar stayed at the hospital on his son’s second birthday three days after Avitan’s initial evaluation (the mother and son came to the hospital to celebrate after the surgery) to go into a complicated surgery. “It was very exciting to see her again,” said Ungar. Help is required for everything we do and all the money raised goes to research and patient care; and Heni is a good example. The John Wayne Cancer Institute Auxiliary held its Annual Membership Luncheon in The Beverly Wilshire, where more than 300 enjoyed a boutique featuring fine and costume jewelry, clothing, accessories and other items. Vendors donated a portion of their proceeds to fund life-saving research at the JWCI. Event chairs and auxiliary board members Marisol Zarco and Katie Lewis welcomed guests and introduced Sister Maureen Craig, Saint John’s Health Center Foundation chaplain, who offered the invocation. For the fourth year, actor/writer and currently president/co-owner of Amplus Real Estate Investment Company Gerard DiNome, served as emcee. In saluting the auxiliary’s 34 years, he noted: “We cannot begin to count the number of lives that have been and will be saved, thanks in no small measure to the dollars you’ve raised to support cancer research.” Auxiliary President Anita Swift said: “I know how proud my grandfather would be that we remain one of the most successful cancer research centers in the world. Patrick Wayne gave the “Public Service Award” to Jason Jeralds, who is a longtime supporter of the institute. As the owner of Tustin Brewing Company, he stages a yearly golf tournament to raise funds for cancer research at JWCI. The range of the celebration varied from placing food at a gravesite to full-fledged block parties where whole neighborhoods come to party; and, participants’ faces are often artfully painted with whimsical symbols. The Coachella Valley is arguably the most dogfriendly place on the planet, and if they want to participate in Halloween, so be it. At least that’s what more than 100 costumed dogs and their companions did last week when they gathered in La Q u i n t a ’s Pioneer Park for ‘Dog-O-Ween.’ The twohour event saw costumed pups compete for treats awarded by a panel of human judges to the best owner and four-legged duo to best trick; or what about best ghoulish howl? We don’t know what treats were available for the human. This event may not be how you would have spent your Saturday morning, but if you love dogs, it was irresistible.

Charles Lee The Saban Theatre (formerly The Fox Wilshire Theatre) has been significant as both a cultural and an architectural landmark in Beverly Hills since its opening in 1930. Mr. Brown made few alterations to the house, including the addition of a screening room in 1934, and some decorative casework in about 1935. The house had two subsequent owners, who made no known alterations, until Maxwell and Marcie Greenberg purchased the house in 1958. The Greenbergs updated the kitchen in 1958 (but not the butler’s pantry) and repaired the roof in 2000. The house retains a high level of integrity. 1000 N. YOU BE THE JUDGE or is it ‘BEVERLYGEDDON’? I sat down with a judge, who after 25 years on the bench now spends her time mediating. “Money,” she said, “is more important to people than life.” She further explained that people would do anything for (more) money, whereas, in her past life, there were people who faced the death sentence and were not fighting as hard. I laughed as I related the story of what is occurring. “If you look across the street at Beverly Hills, you will see the location of the battle of Beverlygeddon: the Hilton owner on one side, the Wanda Group on the other.” I began with a short history. “It started about a decade ago, two projects were considered by the City of Beverly Hills as stand-alone projects. It was a mistake then, for a City that knows regional problems require regional solutions not to have considered the two mega-projects in conjunction. “On one side is the iconic Beverly Hilton, where so much City history has taken place. Beny Alagem bought the hotel and spent a fortune, in excess of $100 million, to renovate it and maintain, perhaps surpass, its past glory. “After a long process, the residents approved three projects for the Hilton property: A hotel at its tip, at the intersection of Wilshire and Santa Monica boulevards, and two condominium projects, one eight stories in height on the Wilshire side and another, 18 stories tall, on the Santa Monica side. “On the other side, across Merv Griffin Way (a shortcut to Century City that used to connect north and south), stood the Robinson-May department store. Once a popular Robinson’s Department Store, it became accessible to the multitudes when May Company was combined into the chain. “New Pacific Realty Corporation bought the property for approximately $35 million and sold it to the Candy and Candy brothers from the UK for $500 million. It was the most expensive lot sold in the City. “An internationally renowned architect (Richard Meier) designed an ‘environmentally sustainable’ (the new buzzword that developers like to tag onto each new project proposal, alongside numerous ‘awards’ to increase the salability of their projects) condominium complex alongside the entire length of the property, from Wilshire to Santa Monica boulevards. “We were told that these condos will be sold for $20-$50 million, primarily to foreign investors who may visit us for a short time each year, spending money in the City. “Each developer, the owner of the Hilton who along with his wife, Adele, have been long and very respected members of the community, and the UK Candy & Candy brothers (Jewish boys whose $500 milion purchase was the constant source of speculation that Arab money was behind them), presented their project completely ignoring the fact that another massive project was being planned and proposed just across Merv Griffin Way. “Alas, it was not their fault, but the City, her planners and decision makers. Rather than stand at the helm and take charge, they took the back seat. “Let us summarize the history: two projects were approved. The residents allowed Beny Alagem to build a hotel at the tip of his property and two condominium projects at the base. The City also approved a major condominium project stretching across, creating a ‘wall’ separating the City and Los Angeles. “It was 2008, and the economy faltered. The Candy brothers lost the property, but the entitlements remained. Similarly, Alagem kept the rights he gained, although the future looked bleak. “Much has changed since 2008. Primarily we are now at the peak of real estate performance. Houses in Beverly Hills doubled, tripled and quadrupled in value, generating immense wealth to the uber rich. “The move from a multi-million dollar mansion into a ‘smaller’ dwelling is something many Beverly Hills residents will experience as they grow older and their kids move out. Many may prefer a condominium at a luxury complex rather than the hassle of a private home. TIME TO BUILD “It is now time to build. Alagem is completing construction of the Waldorf Astoria that will open in 2017 and is asking the City one change to the alreadyapproved plan of the two condominiums. “Alagem wants to place both buildings one on top of the other, i.e. the eight stories on top of the 18. This will result in substantial construction savings and will translate to an enormous windfall – as each story above the already approved 18 stories will have a 360 degree

view of the entire area and will therefore fetch higher prices. “To a person standing at street level or stranded in her car in the stand-still traffic looking up at the building, telling the difference between the approved 18 stories to a 26 stories will not be possible. “Attacking Beny Alagem is wrong strategy for another reason: The City is the base for the Alagems. Their friends are here. Their 700 employees depend on them – in good times and bad. And we all know that ‘Beny is a go to at a time of need or celebration.’ Desiring the most grandiose gateway may be understandable, but achieving one’s goals in a positive manner is always preferable in such a small community. AN ADDED TWIST “Judge, it only becomes more interesting!” “Tell me more,” she said, “do tell how it becomes even more interesting.” “Instead of building the condominiums, the Wanda owners want to take five stories and convert them into a hotel.” The judge looks at the drawing I made of the two developments. I added the Peninsula and the Montage, and in her mind’s eye she added The Beverly Wilshire and The Beverly Hills Hotel. “More hotels?” She asks. “Adding a hotel will completely change the character of the development. It will increase the traffic. Remember, the project was originally approved based on a supposition that families will live in enormous condos, thus generate very little traffic; moreover, most were not expected to be here most of the year. “Clearly, any change of this nature requires reconsideration by the City, a brand new examination, right from scratch. Maybe the Wanda owner is afraid that once the Hilton is constructed and overlooking its property, it might be more difficult to achieve its own plans? I keep thinking of the judge’s opening remark, how people (and companies) hold money dearer than life at times. Is it not what we are seeing here? And why is all this negativity necessary? “The issue is mired in many more details, but I have seen extraordinary things happening. The community has been engaged to take part in the new look and usage of the open space that will be left instead of Alagem’s eight- story building. Former mayors, including a once most vocal opponent of the project, now stands by Beny Alagem.” “Judge,” I say, “I have presented the gist of what is taking place. The projects will be built. Alagem’s two condominium structures will be built, but building them one of top of the other may truly become a gift to the City after all is said and done. “Developers build all around us, and we get the traffic with no benefits. Two examples are The Century on Avenue of the Stars and a new tower adjacent to the Four Seasons across from Beverly Hills (with condos pre- sold for $20-$50 million). Both are outside the City. “The location of Alagem’s new project is so much at the edge of the City, far removed from anything else, and will serve one as a welcoming icon to those approaching the City, a new landmark. “Alagem had a vision before. He took Merv Griffin’s Hilton, updated and upgraded it, while safeguarding its essence and former glory. “He is now adding the world-renowned Waldorf Astoria, with rooms at a level of top hotels internationally. “He knows that to survive and continue to lead in the new competitive L.A. hotel market for the next 20 to 30 years, he must do something unique. “If past performance is any indication of future success, we must trust his business instincts and allow him to put the two buildings one on top of the other. “And we must send a signal to those who come here and attack any of us: ‘Do not do that. You attack one of us, you attack us all!’” I raise my head and look at the Judge. She absorbed all that I have said and took notes. I am looking at her expectantly, awaiting her opinion. I suppose I will have to wait until another time. The voters will be the judges. It is not a vote about a ‘park.’ It is not about marketing. It is not about bad-neighbors. It truly is about our City’s future. You be the judge. Fear not, I am not one of those people paid to call and solicit a vote. They know nothing about our City and read a script. LETTERS TO THE EDITOR Without any doubt, especially now, we need to pass Measure Y. As a qualitative economist and former chair of the COC for Measure E, there is a need to complete what was started. We all want the Beverly Hills Unified School District to continue to rise back in its ranking for a school district. Under the current bond funds and staff that is happening now. All of the four elementary/middle elementary schools and our high school need these funds to complete what was started. There were problems initially with Measure E that we got resolved: a district plan was done and approved; competent construction companies were hired; key knowledgeable and competent staff were hired and both on-site and objective third party audits were done. To stop these buildings being completed now would see the need for another bond in the near future; additional per year construction costs of over $10 million; a lapse of time that would result from the $20 million of matching fund for the State Seismic Mitigation Program and more. In short, the time to act is next week. Vote “yes” for Measure Y. Or not, everything is put on hold; the escalation of costs along with redoing the plans, hiring contractors, and building supplies rises; and in the end the value of everyone’s property decreases. Vote now for Measure Y and save our schools – and our City. Woodrow W. Clark II ****** Beverly Hills Mayor John Mirisch loves to use baseball analogies. To use a baseball term, the Beverly Hills City Council “wiffed” on two important issues this week. The first “strike-out” concerned irregularities in the County Registrar’s voters list. The council was “mortified” to learn that Wanda’s law firm had identified 330* “illegal” voters. In fact, such voters use “private mail boxes” to receive their absentee ballots – a perfectly legal option, providing such voters provide proof of permanent residence. Wanda’s law firm chose only a handful of private mail box centers in the City, but in the press release chose to include the phone numbers of such voters, a clear violation of privacy. In 2008, a group of local residents led by Larry Larson clearly identified questionable voting on Measure H, and eloquently raised the issue to the council on Tuesday, but missed the main point by not recognizing that Wanda’s law firm had failed to do the hard work that his group had performed close to 10 years ago. Instead, Wanda’s law firm had chosen to use patrons of private mail boxes as a stalking horse. It was another bold attempt by Wanda (an alleged Chinese government affiliate) to influence a local election, by indirect voter intimidation. While the City Council properly directed the city clerk to examine the County Registrar’s list, such direction could have, and should have, been done months ago … not a week before the election. The second “strike-out” occurred when council was not informed the Hilton was prevented from filing an appeal of the Planning Commission Oct. 19 decision regarding Wanda’s “One Beverly Hills” project. The city attorney informed the Hilton that it could not file an appeal. though the Municipal Code (title 1, chapter 4) clearly states that any commission decision may be appealed to the City Council. The city attorney should not favor one developer over another. It’s like an umpire favoring one player over another. It is wrong in baseball, and it is wrong in Beverly Hills.
