NOTICE OF PUBLIC HEARING DATE:

November 19, 2012

TIME:

1:30 PM, or as soon thereafter as the matter may be heard

LOCATION: Commission Meeting Room 280A Beverly Hills City Hall 455 North Rexford Drive Beverly Hills, CA 90210 The Planning Commission of the City of Beverly Hills, at its SPECIAL meeting on Monday, November 19, 2012, will hold a public hearing beginning at 1:30 PM, or as soon thereafter as the matter may be heard to consider: A request for a Conditional Use Permit, Extended Hours Permit and revision to an existing Variance for the Thompson Hotel located at 9360 Wilshire Boulevard. The entitlements being requested in conjunction with proposed modifications to the hotel are as follows: A request for a Conditional Use Permit to allow an increase in the number of guest rooms within the hotel. Pursuant to Beverly Hills Municipal Code (BHMC) §10-3-2862, any modification of a hotel use which results in an increase in the number of guest rooms requires the approval of a Conditional Use Permit. The proposed project requests to increase the number of hotel guest rooms from 114 to 119.

NOTICE OF PUBLIC HEARING The Council of the City of Beverly Hills, at its regular meeting to be held on Tuesday, November 20, 2012, at 7:00 p.m., or as soon thereafter as the matter may be heard, in the Council Chambers of the City Hall, 455 N. Rexford Drive, Beverly Hills, CA 90210, will hold a public hearing to consider: AN ORDINANCE OF THE CITY OF BEVERLY HILLS AMENDING THE BEVERLY HILLS MUNICIPAL CODE TO ESTABLISH PROCEDURES FOR DISABLED PERSONS TO REQUEST A REASONABLE ACCOMMODATION FROM THE CITY’S ZONING AND LAND USE REGULATIONS The proposed Ordinance would amend the Beverly Hills Municipal Code to establish procedures by which disabled persons and their representatives may request a reasonable accommodation from the City’s zoning code requirements, building codes, and land use rules and regulations in situations where the strict application of those rules and regulations would prevent one or more disabled persons from using and enjoying housing. This Ordinance has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the environmental regulations of the City. It can be seen with certainty that there is no possibility that the adoption and implementation of this Ordinance may have a significant effect on the environment. This Ordinance is therefore exempt from the environmental review requirements of the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) of Title 14 of the California Code of Regulations. All interested persons are invited to attend and speak on this matter. Written comments may be submitted, c/o Planning Services, 455 N. Rexford Drive, 1st Floor, Beverly Hills, CA 90210 and should be received prior to 5:00 p.m. on November 13, 2012 to be included with the City Council’s agenda packet. Written materials may also be submitted during the public hearing. Please note that if you challenge the City’s action in court, you may be limited to raising only those issues you or someone else raised at a public hearing or in written correspondence delivered to the City, either at or prior to the end of the public comment period. If there are any questions regarding this notice, please contact Peter Noonan, AICP CEP, Senior Planner, Community Development Department, Planning, at 310.285.1127 or pnoonan@beverlyhills.org. The case file, including a copy of the proposed Ordinance, is available for review in the Community Development Department/Planning Services Section, 1st Floor, 455 N. Rexford Drive, Beverly Hills, California. BYRON POPE, CMC City Clerk

A request for a revision to an existing Variance to allow for new hotel guest rooms. The existing Variance, approved by City Council on February 7, 1961, limits the total number of hotel guest rooms to 114. The applicant is requesting to amend this Variance to allow for a total of 119 hotel guest rooms. The new rooms would be located within the existing building envelope. A Conditional Use Permit to allow a reduction in the number of parking spaces required for the hotel. Pursuant to BHMC §10-3-2866 (I), a Conditional Use Permit may be granted to allow up to a 15% reduction in the total number of parking spaces required for the hotel. The proposed project would require a total of 123 parking spaces. A total of 114 parking spaces are proposed, which is 7% less than the total required spaces, thus a Conditional Use Permit has been requested. An Extended Hours Permit to allow rooftop uses until 1:00 AM Sunday through Thursday. An Extended Hours Permit previously granted by the Planning Commission allows for rooftop uses until 12:00 AM. A request to renew a Conditional Use Permit and Extended Hours Permit previously approved by the Planning Commission. On January 12, 2012, the Planning Commission conditionally approved Resolution #1628, which allows for rooftop activities and extended hours of operation until 2:00 AM on Fridays and Saturdays. As conditioned, the applicant may request an extension of these approvals prior to their expiration on January 12, 2013. Therefore the applicant is seeking an extension of the previously approved Conditional Use Permit and Extended Hours Permit. This project has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the environmental regulations of the City. The project qualifies for a Class 1 Categorical Exemption for an addition to an existing commercial structure and minor operation changes, and the project has been determined not to have a significant environmental impact and is exempt from the provisions of CEQA. Any interested person may attend the meeting and be heard or present written comments to the Commission. According to Government Code Section 65009, if you challenge the Commission's action in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the City, either at or prior to the public hearing. If there are any questions regarding this notice, please contact Shena Rojemann, Associate Planner in the Planning Division at 310.285.1192, or by email at srojemann@beverlyhills.org. Copies of the applications, plans, and Categorical Exemption are on file in the Community Development Department, and can be reviewed by any interested person at 455 North Rexford Drive, Beverly Hills, CA 90210. La Provence To Open At LAX Popular Beverly Hills eatery La Provence Patisserie & Cafe beat out several other big-name restaurants from all over L.A. County in the running, and next year will open a new branch in LAX’s Terminal 4. The 10-year contract comes after a two-year process that started with an unexpected call to La Provence FounderOwner Farshid Hakim from the L.A. Airport Commission saying, “You’re in the running for an LAX outlet. Are you still interested?” Of course, he was. Terminal 4, the busiest, serves American Airlines, American Eagle, Cathay Pacific and Qantas and five million passengers a year. “It’s s coveted space,” admits Hakim. The process involved a secret visit to La Provence from the commission to see the food’s consistency, French influence and innovation; and several chart- graphand rendering-filled presentations by Hakim before the commission in airport conference rooms. Hakim fielded questions like: “Why would La Provence be a good fit for the airport?” He cited the loyal following of the Olympic Boulevard original; and the fact that his concept of fine pastries and comfort food like sandwiches, salads, soup and chili, fit the ”cafe/bakery” idea the commission was looking for. Also the famed French macaroons— which he introduced to the area in 2000—sold in upscale packaging make a unique souvenir. Trained in France and Monte Carlo, Hakim opened his flagship location on Olympic in 1996 (the Brentwood location is shuttering so he can focus on LAX). Visiting France several times a year to see family and tour, he decided to intro-

duce the pastel treats to Beverly Hills. “People would walk in astounded,” recounts Hakim “‘You have these,’ they’d say, ‘I’ve never seen them in the U.S. before.’ They got a great reception.” He now has full-time staff making the cookies in 12 flavors of which the salted caramel is the most popular. Eggnog flavor will be added for the holiday season. Kira & Jason Powell Noah & Ellie Gabayan Hakim still doesn’t know who nominated him, but after the L.A. City Council meeting for final approval, a member he Ryan, Robert & Juliann didn’t recognize whispered “‘I love your Finkelstein place.” “It could have been him,” Farshid laughs. Winning the contract “feels like quite a coup,” says Hakim. Especially over much larger players like La Brea Bakery. “It’s great to win; very flattering. Our customers are happy for us; and our landlord is thrilled.” The LAX version—set now to open in April—with a limited menu, will be open Lauren Stein & Ellie Walder Aidan Yoo, Lucas Lee & Omer Cohen from 5 a.m.-midnight serving breakfast, lunch and dinner. Retaining the charm of the original, it will keep the familiar green-and-white stripes, also part of the restaurant’s produce packaging, with pink accents. All the food will be made at the airport, except the multi-flavored macaroons, which will still be made in Beverly Hills. The addition of a La Provence satel- Ida Goldstein and Sawyer Josh, Rachel, Dina & Jack Metzger & Carolyn Grijalva lite is part of the Airport Commission’s effort to improve airport food and make the Terminal 4 food court more upscale. La Provence will be the first space facing the walkway, and be joined by Campanile, Real Food Daily, 8 Oz. The Planning Commission of the City of Beverly Hills, at its SPECIAL meeting on Monday, November 19, 2012, will hold a public hearing beginning at 1:30 PM, or as soon thereafter as the matter may be heard to consider: A request for a Zoning Amendment to allow the City’s Transportation Overlay Zone (T-O Zone) to be applied to the property located at 9848 North Santa Monica Boulevard. The subject property is situated at the southeast corner of Wilshire and North Santa Monica Boulevards and is currently zoned T-1, which only allows for railway transportation uses to be conducted on the property. If approved, the T-O Zone would allow for the subject property to request approvals to be used as a surface parking lot; and A request for a Development Plan Review to allow the establishment of a new parking lot on a portion of the subject property. Although the T-O Zone discussed above would authorize the subject property to be used for parking purposes, the Development Plan Review would set forth the specific standards for the construction of the parking lot, including size, configuration, access, setbacks, and landscaping.

SKATING

(continued from page 1)

Skating Liaisons, councilmembers Lili Bosse and Barry Brucker, will announce their recommendation to locate the rink on Crescent Drive in front of City Hall, Bosse confirmed Thursday to The Courier. The liaisons and City staff are scheduled to meet with residents Thursday at 5 p.m. at the Beverly Hills Sign in Beverly Gardens Park, after The Courier’s press time. That location had long been the desired spot for the rink, but it was long thought not possible because of a fire lane issue, as well as concerns about closures due to construction of the Annenberg Center across the street. Residents in the neighborhoods surrounding Beverly Gardens Park were furious last month when the City Council approved locating the rink at Beverly Gardens Park, under the assumption that residents

had already been notified. It was then revealed that City Staff had only notified the residents after, but not before, the council approved the location. Bosse said the liaisons recently spoke with Annenberg President Dick Rosenzweig and Executive Director Lou Moore, both of whom gave the City their blessing to move ahead with the rink. Bosse and Brucker both told The Courier that the location was always the City’s first choice. ”This was everyone’s first choice in the beginning, but we were told we couldn’t close the street because of fire lane issues,” Bosse said. “Having an ice rink in front of City Hall and the new Annenberg is a wonderful backdrop of branding for our City.” Bosse said the new location shouldn’t change plans to have the rink up by Thanksgiving weekend.

The Best Gift Ever W By Marcy D. hat would you give to hear your mother or father’s voice again… sharing their private and authentic selves…..stepping outside their roles as parents, and disclosing unvarnished truths about themselves. I got that chance three months after my Mother died when I found a small recorder among her things. As I settled in to listen, I was totally unprepared for what I was about to hear. Mom was answering questions—offering fact-filled memories about various events—childhood birthday parties, first kisses, weddings, funerals. A biography of sorts…or so I thought. But as Mom’s voice became softer and slower, I realized something else was happening. She was being asked to re-call what those events felt like, and how those events and feelings affected her life as a wife, mother, friend, woman. As the initially superficial answers turned introspective, I realized I was listening to my dear Mother reviewing her private life…being gently and patiently guided toward revealing her authentic self. There were many revelations—some answering questions I was never able to ask; some exposing harsh realities I never knew existed. Each added a color stroke to the new portrait that was emerging. An example… Somewhere in the second hour, Mom changed her initial characterization of her lifelong marriage from “pretty good” to “troubled;” and her description of herself from “pretty average” to “sad.” The interviewer then asked about her sadness; and after a long pause, and in a near-whisper, my mother said that before I was born, she’d had a baby boy. “He was retarded,” she said, “so we put him ‘someplace.’ We never went to see him. Nine years later we got a letter saying he died. No one ever knew about him”.

I was dumbfounded, and could feel my heart swell with emotion. Learning about my brother explained so much...the omnipresent cloud that made our home feel different from my friends’ homes, my mother’s smothering over-protectiveness, my father’s drinking. Learning what my mother had lived through instantly transformed my painfully lingering resentments into compassion and sympathy. Mom said the tremendous guilt she carried about that decision was made worse as she watched the treatment of retarded children change over the years. But by being guided to re-call conditions as they existed when her son was born---- the lack of family or community support, the terrible stigma attached to mental retardation, and the “experts” saying her son could never have a meaningful life—she was able to re-call, and re-feel, the rightness of her decision. By sharing her secret with a skillful and compassionate guide, my Mother was given a new perspective on herself. When she finished talking about this sad episode in her life, she said the guilt and shame she’d carried for so long now felt more like “sympathy for that young woman.” “I’ll die better now,” she said. The gift she intended for me turned out to be a gift for herself too. It wasn’t until after she died that I realized the person I knew as “Mom” was but a single aspect of a larger person I knew not at all. I think she might have had the same realization when her mother died because the last thing she said on the recording was: “Sweet daughter, I think you need to know me. I hope you still love me.” Yes, Mom, I do still love you, and I thank you for letting me know you...that’s the best gift of all. What is the Difference Between A Large Assisted Living Facility And A Smaller Board & Care Home? ost people do not know the difference between a large assisted-living facility that may house 150 or more residents and a smaller board-and-care home. Larger facilities are usually for more active residents able to enjoy all the community activities offered; and for those who can manage getting to and from the building’s dining room and common areas on their own. These large facilities carry the same license as the smaller boardand-care homes. In California in the early 1970s, the residential care system was established to provide non-skilled nursing-based services to the elderly. These homes are referred to as “Board & Care” or “Residential Care Homes for the Elderly (RCFE’s).” The governing body is the State of California, Depar tment of Social Services, Community Care Licensing. These homes are not allowed to provide medical services. They can, however, provide assistance with all activities of daily living (ADL’s). Board & care homes are smaller residential homes that afford a safe home-like atmosphere and comfortable and dignified care where residents can enjoy the living room, backyard, kitchen/dining services, homemade meals, personal attention and social interaction. For those elderly who suffer from

M

dementia, the small residential home can be an ideal setting because of the consistency in staff and constant supervision. Residents adjust faster and often do better than in the larger Assisted Living Facilities. Such a place is Raya's Paradise, a residential care facility with five locations in L.A. and West Hollywood with 6-11 residents each. “We make sure your loved one feels at home away from home,” says Moti Michael Gamburd, executive director. “Our caring staff—many of which have been with the company for more than 18 years—provides personalized attention to each individual,” says Gamburd adding that the caregiver to patient ratio is 1:3. While all are welcome at Raya's Paradise, the company is known for its care of those with Alzheimer’s, other memory disorders and those who’ve suffered strokes. “We offer a new approach to dementia and Alzheimer’s care,” says Gamburd “Our environment is designed especially for our resident’s to thrive. “The activities they do together create opportunities to experience and feel accomplishment and satisfaction for completion of a job,” adds Gamburd. “This team approach gives the security of knowing there is always a helping hand ready when

they need it.” The daily routine has residents up for showers in easily accessible bathrooms, followed by breakfast and a morning activity. Since some of the homes are near parks there are visits for those wanting to go by foot or wheelchair. Afternoons often see musical entertainment, like an accordion player and all holidays and birthdays are celebrated. “We try to keep it as homey as possible,” Gamburd says. “There’s always something to do,” Gamburd adds, “like cards, puzzles, reminiscing, big band music or bingo.” More alert residents often help set the table or help with the home’s laundry to keep them engaged. For an RCFE to accept a resident with dementia it must have a “waiver” from Community Care Licensing, as the Raya's facilities do. The waiver means a variance to a specific regulation based on a facility-wide need or circumstances which is not typically tied to a specific resident or staff person. Raya's Paradise also has waivers to care for bedridden residents—”the building has to meet certain licensing criteria,” Gamburd reports. Gamburd advises those seeking a board-and care home for their loved one to ask questions: • If you are placing your loved one

with dementia into an RCFE, you should be asking the administrator for a copy of their waiver for dementia care. This will give you peace of mind knowing that this RCFE has the proper staffing, wander guards or other means to keep residents from wandering; and knowledge of how to manage their residents with dementia. • Does this RCFE provide 24 hour “awake” staff? Falls usually occur in the evening; and it is important that staff is awake and ready to help residents get to and from the restroom at night. Many small board-and-care homes or RCFE’s, do not have a 24-hour awake staff. They may have a husband and wife who live in the home and are working 24/7. Working that many hours is a daunting job and it is important that staffing is “fresh” and that they are going home to rest before returning to work. Night staff should not be working somewhere else during the day and then coming to work at night at your RCFE. Raya's homes have separate day and night staffs to provide compassionate, committed care. Raya's also caters to those not yet ready to move with its CARE (Caring, Assisting, Respecting Elder) program that provides in-home caregivers.

Managing Marriage & Mild Cognitive Impairment ost couples would say they were firm in their commitment when they took their marriage vows. Time and circumstances pull many apart, but those who make it 30, 40, 50, even 60+ years probably consider themselves on solid ground. However, it’s not uncommon for couples who have spent most of their lives together to face the threat of separation in later years because of varying health needs. Cognitive issues such as Mild Cognitive Impairment (MCI) are particularly challenging, especially as one partner steps into the caregiving role. Often the affected partner still functions well in other ways, but needs a higher level of support than even they may realize. This creates stress for both partners that can make time together difficult and time apart worrisome. “One of the hidden benefits we’ve seen with our Circle of Friends program is that it gives our couples back their personal space in a way that alleviates guilt, fear, and ver y real physical and emotional strain, allowing them to better enjoy their time together,” said Beverly Sanborn, Belmont Village’s VP of Program Development. “Belmont’s tiered approach allows both partners to interact with their peers socially and maintain their own mental and physical fitness, nutrition, spirituality and creativity in ways that are appropriate to each partner’s needs.” In 2005, Belmont Village launched Circle of Friends for residents who didn’t need dementia care, but needed a higher level of support than typically offered in assisted living. “Signs of MCI include short-term memory loss, inability to focus, social discomfort, and, occasionally, a loss of sense of place,” said Sanborn.

M

“Changes are more noticeable than what’s typical in normal aging—friends and family will see the difference—but they aren’t as severe as in Alzheimer’s and other dementias.” Residents with MCI remain in their assisted living apar tments, conveniently located near activity centers. They can still perform activities of daily living and lead purposeful lives through the daily calendar of research-based group activities led by a specially trained staff. The activities are ability-centered and designed to enhance function, promote socialization and build confidence. In 2011, the company received a George Mason University Healthcare Quality Improvement Award for Circle of Friends. Belmont Village is a premier provider of independent living, assisted living and memory care. Enrichment programs include MBA Club, for more active residents, Circle of Friends for Mild Cognitive Impairment and Person-Centered Living for Alzheimer’s care. Each Belmont Village has a professionally managed fitness center, chef-prepared meals and daily transportation. A licensed nurse is on-site 24/7. For more information, visit www.belmontvillage.com.

week to take part in the Farsi broadcast panel of BBC America’s live election night coverage. Delshad said BBC has more viewers in Iran than all other news agencies combined, including major names like CNN or Fox News. Delshad said a big topic of discussion for the panel was the effect of Tuesday’s election results on Iran and what President Barack Obama should do going forward.

Delshad helped provide perspective to the panel on how Iranians in Beverly Hills feel about Obama’s stance on Iran. “I said that I think they were disappointed in his lack of action, or lack of involvement during the 2009 election in Iran,” Delshad told The Courier. “The Iranian people wanted to know that somebody was listening and hearing us and I think the lack of him getting involved was very disappointing.” Delshad said the panel discussed how America should

approach its relationship with Iran over the next four years. Delshad told the panel that he hoped the president would learn from his first term. “I thought his first term, he did a lot of trial and error,” Delshad said. “Maybe this time he can take a more positive position and make sure Iran does not gain nuclear weapons.” Tuesday’s election coverage was hardly Delshad’'s first broadcast experience. Delshad said he’s also appeared on BBC before and said he’s also appeared on Al Jazeera.

Segal wasn’t the only BHHS runner to have a big day, as DaEun Lee, Tina Youabian and Marissa Rothman finished in fourth, fifth and sixth place respectively and each earned allOcean League honors for their performances. On the boys side, Flesch had a record-setting day of his

own, setting the boys course and school records to win the boys individual Ocean League championship in his three mile run. Flesch’s performance helped spearhead the boys team to its second straight Ocean League championship. Chanan Batra (second place), Aaron Wolfe (fourth) and Sebestian Vericella (sixth) also earned All-League honors. Both teams will compete in this weekend’s CIF prelims at Mt. SAC.

portion of the 4,155-square feet currently occupied by Pioneer. The subleasing of the space would be the favored option for Pioneer, which resides at 315 N. Crescent Dr. Provided, of course, that the City does not allow the store to keep its current footprint at its current rent. “It's not my first choice, but this gives me an opportunity to continue my business,” Jeff told The Courier. “There would be absolutely no change in Pioneer Hardware except less square footage.” Pioneer has been a Beverly Hills fixture for more than 80 years, but has recently run into rent trouble with the City. Pioneer had been paying $9,858 per month until construction of the Annenberg Center, as well as the Crescent parking garage, caused street closures and other construction obstructions that Jeff says caused a 30 per-

cent drop in business that his store never recovered from. To offset the construction obstacles, Pioneer began receiving rent reductions and in June 2010, Pioneer's rent was reduced to its current number, $7,299.72. Starting on Jan. 1, 2013, the rent will jump back up to the previous number with inflation included; a 24 percent rent increase. Subleasing would give the City the amount of rent money it's looking for, while hopefully adding another business to the City that Jeff hopes can complement Pioneer. Jeff said one possibility would be a shoemaker. Jeff said he also requested the City restrict a portion of the lease that prevents his store from selling high-priced items. That was in his original lease because the store was originally opened as “convenience commercial,” meaning it was a store that would accommodate residents’ needs at an afford-

able price. City spokesperson Therese Kosterman has told The Courier that the City would be open to changing it. One reason for that clause in the lease of Pioneer and other stores on that block was because of federal funding that helped Beverly Hills build senior housing in that area decades ago. According to Joe Tilem, Pioneer made its home on Crescent Drive because of former Mayor Donna Ellman Garber, who was instrumental in getting the low-rent housing built on Crescent and Dayton Drives. Garber traveled to

Washington D.C. to lobby for money for what is now the Menorah Housing, which accommodates more than 150 Beverly Hills seniors. To get the funding, the City had to demonstrate that Beverly Hills had not just the land, but also the resources to provide a place where future occupants of the housing, including the elderly and disabled, could shop and get necessary services. To do that, the City promised to build stores within easy walking distance of the senior housing project. These stores

November 9, 2012 | Page 25 were to be referred to as “service commercial” facilities. A handful of shops were designated as necessary for this area, with a hardware store being one of them. That was where Joe and his brother entered into the picture and agreed to open the hardware store after federal funding was obtained. The City Council is expected to take up discussion on Pioneer Hardware and the possibility of allowing to sublease space at its closed session council meeting on Nov. 13.

MEASURE J

(continued from page 1)

half-cent sales tax needed a 2/3 majority to win and instead got 64.7 percent of the votes. “Four years ago…voters approved Measure R,” Goodmon said. “We were fooled… they told us they were going to improve transit service, they cut one million bus hours. They told us it was going to improve communities and they provided destructive plans for our communities.” Bus Riders Union Spokesperson Sunyoung Yang said the defeat of Measure J was not a mark against transit or the progress of transit. Rather, an opportunity for Metro to go back to the communities and create beneficial projects. “They took us for granted and decided that their multi-million corporate… backed campaign could basically push this measure through,” Yang said. “This group, more than any group in Los Angeles County, believes in public transit and believes the communities that need it most should be served with affordable 24/7 first class bus system and transit system.” Metro Chief Executive Officer Art Leahy said Metro will continue to work on transportation projects for Los Angeles County. “While the ballot effort to extend the Measure R transit sales tax by another 30 years fell short

Richard Bloom

of the necessary two thirds voter approval, Metro remains focused on delivering a dozen new transit projects and 15 highway improvement projects that voters approved four years ago in passing Measure R,” Leahy said in a statement released on Metro’s news website The Source. “In fact, within two years Metro should be overseeing simultaneous construction of five major rail projects. Also, the Measure R transit sales tax for transit—approved in 2008 by more than two million voters—continues until 2039, so Metro directors have the option of asking voters in the future if they wish to extend the program.” Metro would not comment beyond that statement. Measure J did not get 2/3 of the Beverly Hills’ votes, with 5,871 residents voting in favor and 4,342 voting against. In 2008, 8,505 of Beverly Hills residents voted in favor of Measure R while only 2,872 vote against the measure. Goodmon said the No on Measure J campaign was outspent $100 to $1 yet was effective enough to reduce the number of votes in favor of the measure. The Courier, along with sister paper the San Marino Tribune, are the only major newspapers in Southern California to oppose Measure J. “The fact is it seems unfortunately like they aren’t listening

Joe Shooshani & Nancy Krasne

and we will make sure time and time again that they listen to us,” Beverly Hills Vice Mayor John Mirisch said. “We all deserve transit that serves all of us, that is done in a fair and equitable manner and that is done in a manner that gives us good value for money. They need to listen to us and not their crony capitalist friends.” Beverly Hills Board of Education President Brian Goldberg said the failing of Measure J was bittersweet. “We do support mass transit in Los Angeles,” Goldberg said. “But, hopefully MTA is going to start listening to the people and the residents of LA County instead of out of town developers and wealthy construction companies who are the ones who stand to profit from MTA’s rush to judgment on the route for the subway to the sea.” Proponents of Measure J include The Los Angeles Times, Anschutz Entertainment Group, Cedars Sinai Health System, Teamsters Joint Council No. 42 and County Supervisor Zev Yaroslavsky. Opponents of Measure J include the Bus Riders Union, the Los Angeles Community Action Network, Crenshaw Subway Coalition, County Supervisor Mike Antonovich, Beverly Hills Councilwoman Lili Bosse and Assemblymember Mike Davis.

pass on Tuesday. To stave off $6 billion in trigger cuts in K-12 education in California, the proposition triggers a four-year quarter-cent sales tax increase and a seven-year income tax increase on annual earnings over $250,000. “The people of California have given our schools a well earned vote of confidence,” Superintendent Gary Woods said of the 53.9 percent of state voters who supported Proposition 30. “Now we go to work on trying to restore the $3.5 million that is still on that list.” While parents, students and teachers across the state can breathe a collective sigh of relief, Woods said the district is exploring various options, in addition to fundrais-

“Dollars for Disaster” – a relief fund with proceeds going to The American Red Cross-Greater New York Region. October’s “superstorm” is the largest Atlantic hurricane on record and caused widespread flooding, power outages, human casualties and over $1 billion in dam-

ing efforts. Such options include reducing programs and staff, increasing classroom sizes and asking voters to support a “small” six-year parcel tax increase. Prop 30’s passage may prove to be a double-edged sword for Beverly Hills. On the one hand, it means the school district will submit a 2013/14 budget to the Los Angeles County Office of Education in December that reflects $3.5 million in cuts, as opposed to $6.2 million in cuts if Prop 30 had failed. But on the other hand, as board VP Jake Manaster noted, the most philanthropic people in the district’s education system have been hit the hardest. “This is people’s livelihood that we’re taking, and we need to put it to good use,” he said. age. As the East Coast continues to get pummeled with snow, Liberator asked students to donate gloves, hats and blankets. “I think this whole thing is really catching steam,” Academic Excellence & Technology Director Chris Hertz told The Courier. “The country as a whole is starting to realize how grave this is.”

THIS IS GOING TO HAPPEN Congrats to all who believe in government. Tuesday’s election will cause these to occur irrespective of your good intentions: California will not balance its budget. The failure of state pension funds to generate any income will eat up whatever new money may or may not come in from Proposition 30. The net result from Proposition 30 will be to reduce government revenues and destroy jobs, increasing the demand for unemployment compensation, welfare and free healthcare. Schools will not get anywhere near the amount of money promised. The unions will demand their cut and the schools will get shorted again. For Beverly Hills, as a “basic aid” district, we are not getting one penny from Prop 30. Instead, we will simply be allowed to keep more of our own money. Nationally, President Obama and Senate Majority Leader Harry Reid will continue to wage war on the private sector. Reid has already said that he’s going for “the kill” against the opposition Republicans. So much for “bipartisanship.” Our military will be stripped. We will not match China’s buildup. The Obama Administration will continue to assist the Muslim Brotherhood in ringing Israel with hostile Sharia-based Islamic regimes. Iran will complete the bomb. Russia will get really pushy like it was this week, sending its nuclear attack submarines to lurk off our coasts like they did before Ronald Reagan. Financially, pent-up inflation will hit us like Hurricane Sandy, destroying savings and making the lives of those on fixed incomes worse. Obama will counter with even more giveaways which he must borrow from someone to give out. The cycle of financial destruction will accelerate. Our children will still not find jobs. Two truths remain that none of President Obama, Sen. Reid, or the mainstream media can disprove: “Socialism is doomed to fail because sooner or later you run out of other people’s money” (Margaret Thatcher) and “Our problem is the government is too big and it spends too much.” (Ronald Reagan). When this happens, we will take no delight in saying: “We told you so.”

BEVERLY HILLS REJECTS METRO By John Mirisch

Vice Mayor, City of Beverly Hills

The suggestion has been made that Measure J “won” in Beverly Hills and that the local efforts to oppose it somehow made B. H. look “weak.” Nothing, of course, could be further from the truth. Losing is the opposite of winning, and the only thing that lost was Measure J itself, which failed to gain the 2/3 majority required by law, despite millions of dollars of special interest funding. The “No on J” activists were outspent by about 100 to 1 margin. Those who would try to portray the Measure J vote results in B.H. as anything other than a stinging rebuke towards Metro need to explain why they feel that Citizens United special interest dollars have no impact on elections before they attempt any further analysis. The breakdown in here indicates we played a real role in the defeat of this misguided blank check, crony capitalist scheme. Here are the facts: In 2008, B.H. voted in favor of Measure R, Measure J’s predecessor by a margin of 75 to 25 percent. This percentage was some 8 percent higher than the overall county average. In contrast, Measure J only garnered 57.5 percent “yes” votes in B.H., well below the required 2/3 threshold and some 7 percent below the county average. In other words, B.H. went from being one of the top supporters of Measure R to one of the biggest opponents. Moving the needle this significantly, especially in the face of millions of dollars of opposing special interest propaganda, is a major achievement. In fact, when one compares the Measure R percentages with the Measure J percentages, B.H.–by far–experienced the highest percentage drop with an 18 percent plunge from R to J. The only other cities in the county (with 1,000 or more votes) to drop more than 10 percent were Malibu (12.9 percent) and Manhattan Beach (10.5 percent) from Measure R to Measure J. Neighboring cities which voted in favor of Measure J were more than 10 percentage points higher than B.H. For instance: L.A. had 69.4 percent in favor of Measure J; Culver City 71.5 percent; Santa Monica 73.5 percent; and West Hollywood 81.4 percent. Compare this with B.H.’s 57.5 percent. While people may have diverse opinions, our opposition to Measure J had absolutely nothing to do with uniting or dividing our City. It had everything to do with sending a message to Metro, an organization which has consistently and arrogantly refused to take the concerns of our school board and City seriously, not to mention the concerns of a diverse variety of groups which depend upon good, affordable public transportation. The figures above prove it beyond a doubt and that message has been sent. Let’s hope Metro now does something it has shown itself incapable of doing to date: let’s hope they actually listen.

LETTERS For years I have been complaining about our inadequate utilities in this City, so much so that when the SoCal Edison people see me coming, they cross the street. After having two major voltage surges last night the power outages began, as there were multiple ones. 140 homes were affected. Recently, The Beverly Hills Hotel lost power and last year it was The Peninsula for 3 days along with all the medical buildings on Linden, Roxbury and parts of Bedford. Grids throughout the City are losing power on a regular basis. Enough excuses from Edison, we are paying premium rates for infrastructure that went in starting after the turn of the century. We are on a patch and repair plan, not updated nor super sized for the homes we have with all the electrical appliances that a modern home uses. It is time for Edison to upgrade our entire utility grid in Beverly Hills. If another City wants electrical service, let the developers help pay for it, I'm tired of replacing light bulbs after the voltage surges. Nancy Krasne Former Mayor of Beverly Hills ****** Kudos to all those fought the “Goliath” (aka Metro) and its ill-conceived Measure J and actually won when it went down to defeat Tuesday in spite of overwhelming odds. The school board, certain councilmembers, and The Courier continue to lead the way in doing whatever “David” can do to stave off “Goliath.” In this case, the ballot was our slingshot. Those who spoke up and were active can be proud. Maybe it will show Metro that you can’t simply dismiss and try to run over (or, in this case, under) residents with legitimate concerns and not even have a dialogue with them. On the other hand, shame on the Chamber of Commerce which actually voted to support Measure J despite the overwhelming majority of our City’s residents who rightly refused to pay taxes so Metro could tunnel under our only high school. What were they thinking? We need to keep on fighting—all of us. Ken Goldman ****** Your recent article: “Council Majority ‘Retreats’ on ‘Hostile' City Conduct Issues” cogently addresses and answers the problems, divisions, and conflicts this City has been facing–namely, the council majority of Brucker, Brien, and Gold have their allegiance not to the residents who elected them, but to employed staff members. This City's distinctive quality of life was (no longer present tense as it has substantially diminished) the product of wise founders who envisioned a community that had residential wellbeing at its core. The council majority was elected by the residents to represent and protect their welfare. However, the majority give priority to the welfare of employed staff! something is wrong with this picture. Mr. Brucker, a selfemployed businessman, would

Rabbi Jacob Pressman OUR HOUSE IS DIVIDED When I was a pre-teen in Philadelphia my father took me for a ride on the monster rollercoaster in Woodside Park. I remember the slow, anxious ride up to the top and the tightening of my stomach as we hurtled downward. I have been experiencing something akin to the above in the roller-coaster emotional life you and I have led in just the past few weeks. Only a week ago I had written about devastating Hurricane Sandy which had literally ripped up so much of the East. Then this past Tuesday in many make-shift polling places we ended a close and bitter Republican-Democrat political battle with the reelection of Barack Obama and Joe Biden for four more years for a country sharply divided. Only those citizens who care little about national politics can detach themselves from it all and observe from a distance a house divided. Somewhere I read: “A house divided against itself cannot stand.” This negative appraisal of division presents us now with a challenge. We must demand of those we elected that they use their wits and their wisdom to make sure our “house,” our beloved republic does stand, and resolves differences amicably. We must admonish our representatives that they do not stall, as they did in the past sessions, and address themselves to resolve problems, and make progress for the good of all the citizenry. We must accept no less from them or we shall sweep them out in our next elections for Congress and Senate. The roller coaster ride is over. Someone once said: “Democracy is imperfect but it is the best thing we have going for us.” Let those whom we trusted with out votes prove it. not coddle employees not performing to the betterment of his business. Certainly not, he would fire them and hire more appropriate personnel as every employee is expendable. The majority has forgotten who is “boss.” It is residents who elect the council and pay the salaries and benefits of employed staff. If council and staff cannot or will not do their job, then each should be replaced. Christine Skirmuntt Ford ****** It is my firm belief that when it comes to issues affecting an entire city, officials should be held responsible to answer questions from the residents of that city. However, it appears the triumvirate (Brien, Gold, and Brucker) have voted together to deny the people the right to request answers from anyone that works in our City. Seeing as these individuals are surely intelligent and educated, one would hope each could make his or her own decision despite that two of them have been managed by the same person. The City Council should not dwell on the degree of happiness of our City employees. instead, it should place greater

emphasis and concern on how well these employees do their job. First, they are certainly very well paid, and secondly have the best pension of most anyone in any other city. My encounters with most of these employees have typically been very positive. These City employees have always been amenable to criticism. They may disagree on the request or matter at hand, but, nonetheless, do not seem to have a problem with it. We must remember the council represents us. Thankfully for Bosse and Mirisch. Though Mr. Brucker is not running again, Dr. Brien is–but why would anyone vote for him? Pablo Nankin, MD ****** The inmates are now allowed to run the institution. Since when are the people supposed to cater to the staff to keep it happy– and also to the City Council for some unknown reason. The staff should already be happy. Its members have jobs, good salaries, and probably excellent benefits. The council was elected to serve the people not the staff. Therefore its relationship with the staff needs to be clarified.
