CHLA Again Ranks Among Safest Hospitals In Nation By Steve Simmons For the fourth consecutive year, Children’s Hospital Los Angeles (CHLA) has earned the “Top Hospital”` designation from The Leapfrog Group, which annually recognizes the best hospitals in the nation for providing the safest and highest quality health-care services to patients. CHLA is one of only 12 children’s hospitals nationally to receive this honor and was the only children’s hospital in California to earn the top award. “This has been a tremendous year for Children’s Hospital,” says CHLA President/CEO

Rexford Drive, Beverly Hills, CA 90210, will hold a public hearing to consider: AN ORDINANCE OF THE CITY OF BEVERLY HILLS AUTHORIZING A ZONING AMENDMENT THAT WOULD APPLY THE CITY’S TRANSPORTATION OVERLAY ZONE TO THE PROPERTY LOCATED AT 9848 SANTA MONICA BOULEVARD The proposed ordinance would apply the City’s Transportation Overlay Zone to the subject property, which would allow the property to be used as a surface parking lot. The Planning Commission reviewed the request on November 19, 2012, and the Planning Commission has forwarded a recommendation to the City Council that the ordinance be approved. A diagram of the subject property, and the portion of the property proposed for use as a parking lot, is provided below for reference.

This ordinance has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the environmental regulations of the City. The City has determined that the ordinance will not have a significant environmental impact and is exempt from CEQA pursuant to Section 15305 of Title 14 of the California Code of Regulations. The proposed ordinance would clarify Subsection C.11 of Section 105-316 of Article 3 of Chapter 5 of Title 10 of the Beverly Hills Municipal Code so that regulation of above surface equipment and extraction activities associated with any oil and gas or gas well drilled pursuant to any Council permit shall be located at least five hundred feet (500') from any school or park site located in the City of Beverly Hills. In addition, the proposed ordinance would clarify Section 10-5321 of Article 3 of Chapter 5 of Title 10 of the Beverly Hills Municipal Code to provide that the City Engineer shall inspect for subsidence from oil wells at least once every two years. This Ordinance has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the environmental regulations of the City, and is categorically exempt pursuant to CEQA Guidelines Section 15301.

Ashley Aviram Breaks Beverly Hills High Girls Soccer All-Time Scoring Record By Matt Lopez Beverly Hills High School soccer standout Ashley Aviram has used a fast start this season to propel herself to the top of the school’s career record books. With five goals in her team’s first two matches, Aviram notched 56 career goals, good for most alltime in school history.

She surpassed Emily Litvak’s record of 55, set in 2009. BHHS tied Notre Dame Academy 1-1 in its season opener, then beat Leuzinger High 9-0. “I actually didn’t think I would score that many,” Aivram told The Courier. “I just move around a lot, wherever the Ashley Aviram ball is, is where I try to be.”

Bosse, CVB Rally to Help Crescent Merchants Who Say City Staff Failed To Warn Of Holiday Ice Rink By Matt Lopez As most of Beverly Hills enjoys the City’s Holiday Ice Rink in front of City Hall, a group of small business owners on Crescent Drive are worried the rink might send their business into a deep freeze. Councilwoman Lili Bosse, along with representatives from the Conference & Visitors Bureau, have come together in the last week to help make sure that doesn’t happen.

The issue centers around the closure of Crescent Drive for the rink. It was originally supposed to go in Beverly Gardens Park, until nearby residents complained that City staff didn’t give them any advance notification regarding placing the rink there. The problem appears to have arisen with staff’s communication on Crescent where a group of small business owners (see ‘CRESCENT’ page 12)

Later, at Metromedia, the indefatigable Chuck Fries produced and supervised 26 movies for television and 13 television series, including the acclaimed The Undersea World Of Jacques Cousteau. He’s authored books and plays, and lives in Beverly Hills with wife Ava, who’s raised millions for the Center Theatre Group.

peers christened Chuck as the Godfather of the Television Movie, and he heads Charles Fries Productions. In addition to innumerable charitable endeavors, he’s chaired the Caucus for Producers, Writers and Directors these past years. Every December his Caucus of Champions, which acknowledges and supports young talents, hosts a Beverly Hills Hotel dinner that Chuck created, and this time around for its annual 30th fundraiser Valerie Harper served as an enthusiastic emcee.

Block has made a living as a land use real estate attorney, experience that should serve him well with the Planning Commission. He worked for the Los Angeles Bureau of Engineering and Attorney General’s office. He eventually became lead attorney for the California Coastal Commission, where he says many applications came before the group and he was present to give advice at hearings.

staff only reached out to Joe Tilem, whose son Jeff owns Pioneer Hardware. Shawn Saeedian of the Beverly Hills Market learned of the plans after Joe Tilem told him what he had heard. When Bosse found out that was in fact not the case, she reached out to Saeedian, then fired off an e-mail to City staffers urging them to get the local merchants involved. CVB Executive Director Julie Wagner told The Courier she has been in contact with the merchants and plans call for signage around the Ice Rink for Beverly Hills Market, Pioneer Hardware and Pascal’s by early next week. Wagner Holiday lights will also be provided for eight sidewalk palm trees on Crescent and “Joy to the Hills” banners will be placed on light poles from Little Santa Monica to Wilshire. The signage is expected to be in place on the rink as early as today.

Motivated by what he saw as an opportunity to influence change, Manaster eventu-

ally joined the Facilities Planning Committee and later the School Site Facilities Committee. “I am intent on making sure that buildings that have been around for 80-plus years are not looking like buildings that have been around for 80plus years,” he said. “The schools desperately need our attention.” Manaster credited previous boardmembers Steven Fenton and Myra Lurie with having motivated him to join the board. “[Lurie] said, ‘You need to pay it forward, and run.’ And I said, I’m really not into that,” Manaster said. “It took me nearly 11 years. It’s a longtime waiting.” 2013 will be his final year on the board, he said.

It has become one of the more iconic buildings in Beverly Hills. The facility underwent massive renovations in 1982. The only fiscal impact associated with the plan, outside of staff administration costs, is approximately $5,000 needed from the General Fund to cover the cost of a historic survey for the building. on the wording of the petition, enlisting the help of fellow parent and activist Alma Ordaz. “There is a unique opportunity for our community to make a powerful impact on our schools right now just by signing the petition urging our City Council to allocate a portion of the $10 million city surplus to our schools,” Saleh said “This would be an investment in our public school district to help offset drastic cuts that are imminent despite the passage of Proposition 30.” While Sarraf was traveling to Houston to tend to her ill mother, she and Ordaz went back and forth via e-mail and phone, sending revisions of the text back to each other before

Residents To Share Sugar Plum Fairy Role In Marat Daukayev’s Nutcracker It’s that time of year. Productions of Tchaikovsky’s Nutcracker abound. When the Marat Daukayev Ballet Theatre’s production takes the stage later this month at Cal StateLA’s Luckman Theatre, three Beverly Hills residents will share the coveted role of The Sugar Plum Fairy along with two other dancers from their midWilshire school Matisse Love and Alexandra and Elizabeth Del Rosario will perform the the prima ballerina role, accompanied by that famous celesta music. Best friends in and out of the studio, the girls, who enjoy occasional sleepovers, say there’s no competition. They plan to be backstage lending support at each other’s performance and for and the other two students dancing the part. • Love, an eighth-grade honor student at Horace Mann, has been studying at the Marat Daukayev Ballet School since she was 7. “Every little girl wants to be a ballerina,” says Love, so she asked her mother if she could take lessons. After competing in the Youth America Grand Prix in 2010, Love “saw all these incredible dancers and that inspired me to work harder and push myself.” She placed in the top 12 that first year, and the following two in L.A. and was invited to the world finals in New York City all three years.

When the producer and writers of the new ABC Family Show Bunheads visited Marat Daukayev looking for dancers and extras, Love read some lines. She now plays the recurring role of “Matisse” a student at the fictional Paradise Dance Academy. The Del Rosario sisters also dance on the show as extras. • 15-year-old Alexandra Del Rosario, a BHHS sophomore, has been dancing at the Marat Daukayev School of Ballet for nine years. She has performed several roles in the school’s Nutcracker from Teddy Bear to the solo roles. She was also part of other Nutcracker productions— Universal Ballet of Korea at the Shrine Auditorium and with All American Ballet. She is excited to be selected as one of the Sugarplum fairies, “knowing this experience will bring priceless memories I will treasure—it’s a dream come true.” • 14 year-old Elizabeth Del Rosario (Alexandra’s younger sister), a BHHS freshman, has also been a ballet student for nine years. She also competed in the Youth America Grand Prix as a soloist and also as part of an ensemble that qualified in the finals in New York City, and was awarded a scholarship by a ballet school in Pennsylvania. MENORAHS AND CHRISTMAS TREES FOR THE HOLIDAYS How many of us will sit through another rerun of It’s A Wonderful Life? Will we attend “Christmas parties” – called that even though most of the attendees are not of that faith? What about seeing the beautiful menorahs and Christmas trees? Even if we call the season the “Winter Solstice,” that brings in the religion of the Druids and who-knows-who-else. “Holiday Season” itself recognizes that the holidays exist, which to some means “violating the separation between church and state.” (The trees originally were German tradition from their former pagan faith, so it’s certainly ironic that they are now lightning rods for atheists.) Granted, “Nativity scenes” can be over the top, but why is allowing a display recognizing a major holiday celebrated by most our people a Constitutional violation? Maybe it’s a wise decision in order to avoid needless controversy; maybe its taking the “separation of Church and State” argument to extremes. Whatever. We seldom seem to trace where this comes from. Usually, it’s attributed to Thomas Jefferson. That would be incorrect if one studies Jefferson’s actions. On nearly the same day as he wrote his “wall of separation” letter, he commended a pastor officially and recognized his church. Few read that Jefferson’s “separation” letter was in reply to a demand for free land in the District of Columbia to build a church. Other churches had to buy their land, so was Jefferson setting Constitutional precedent or was he just turning down a churchman with his hand out? You decide. Constitutionally, there was never anything deemed “unconstitutional” about public prayers, prayers in schools, Christmas and Easter pageants in public schools, posting the Jewish Ten Commandments, or federal holidays timed to allow observance of religious holidays. It all began when the Supreme Court decided that prayer in school somehow was an “establishment of religion” in violation of the First Amendment. That amendment reads, “Congress shall make no law respecting an establishment of religion.” Those words had specific meanings: “Establishment of religion” meant an exclusive, state-supported church complete with bureaucracy and hierarchy. It never meant a public prayer. Jefferson had authored a law in the state of Virginia (ex-colony) to “disestablish” the Anglican Church (the Church of England) as the only

allowable and state taxpayer supported church in the colony/state. If you worshiped otherwise, you could go to jail. Was there a practical reason for the “disestablishment”? Yes. Because most of the soldiers in Washington’s army from Virginia were Baptists. The returning soldiers faced jail by worshipping as Baptists, not Anglicans. Anglicans were often Tories who supported the British in the American Revolution. So, Virginia would be jailing its successful soldiers to benefit the turncoat Tories for not turning on England. Long after the First Amendment was adopted, the New England states had their own “established” churches – the Puritans, or as they became, the Congregationalists. New Hampshire continued official state support of its church until the 1820s or later. By then, so many other denominations existed that the Congregationalists just couldn’t keep their monopoly. The demands on the state treasury from so many other religionists grew so large, that the legislature – not wanting to raise taxes – said “no more ‘established’ church.” That ended the debate until Chief Justice Warren decided that any sort of acknowledgement of religious faith somehow transgressed the Constitution. Since then, in one case after another that corruption of the Constitution has become an article of faith – faith promoted by schools and government and media that faith is prohibited from public display or acknowledgement. Ask anyone about the “separation of church and state” and they’ll tell you “no prayer in school.” Ask them what “establishment of religion” means (which is how the Constitution actually reads), and you will get blank stares. This history won’t matter, we’re sure. Public displays of faith are gone and the courts make sure of it. That was not what was intended, but that’s why we don’t have them. This may be a wise outcome. It certainly can eliminate a handful of hurt feelings, but it deprives the vast majority of the people of recognition of their faiths. This doctrine only became “constitutional” because of a corruption of that document, but that’s where it came from. To the extent that truth matters, this is the truth. Sorry. Merry Christmas. Rabbi Jacob Pressman OPEN YOUR DRAWERS Yes, I suggest you open your drawers, or closets, or crowded garages, and you shall find there the long forgotten treasures of years of saving stuff. Not all garages are the same, however. I find they take many different formations. Noblest among storage places are the garages with absolutely nothing within them but the family auto or autos. They take on the pristine beauty of the original showrooms in which they were first offered for purchase. All that seems missing are some pictures on the walls, a fine mirror and some floral bouquets. Such garages, rare as they may be, deserve to be reserved for guests. The second category may not only house the family cars but also some closets, or a woodshop table, or golf bags, skis, tennis racquets and other large pieces of sports equipment, even some small pieces of furniture one might want to use again some day. There still may be room for the cars. It may still be possible to open the doors of the auto and still be able to squeeze in or out. The final stage is that there is no longer any room for automobiles and the family vehicles are parked just in front of the garage doors and in time everyone has forgotten what is inside since they rarely peek into it. Ask yourself if you fall into class A, B, or C. If it is C, then take comfort in the realization that someday you may move, and the husky movers will open those doors and pull out that stuff, and you will experience some delightful surprises and sweet memories. You may be forced to decide what may now be discarded and beg your children, grandchildren or other relatives to give them a new home and a fresh start. Or, just stay where you are and sell the contents of your garage sight unseen to your friendly liquidator and move the autos back in again.
