Cultural Heritage, Rec & Parks Commissions To Recommend Doheny Fountain Restoration

By Victoria Talbot At a liaison meeting that included Mayor Lili Bosse, Councilmember John Mirisch, Recreation and Parks Commission Chair Howard Rosoff and Commissioner Simone Friedman and Cultural Heritage Commission Chair Noah Furie, plans to add paths and to drain or only partially restore the historic Doheny Fountain were rejected in favor of fully restoring the fountain and maintaining the historic integrity of the park as part of the ongoing restoration of Beverly Gardens Park.

The fountain was built in 1931 when the City hired Beverly

Hills architect W. Asa Hudson to build a fountain that would mark the eastern entry to the City as part of the second phase that completed the 23-blocks of Beverly Gardens Park.

By Laura Coleman While the 90210 zip code may evoke illusions of mansions for all, the reality for the Beverly Hills Unified School District (BHUSD) is much more dire.

On Monday, four days before the deadline set by the Los Angeles County Office of Education (LACOE) for public school districts to submit their 2017-18 First Interim Report, the Board of Education voted 5-0 for BHUSD to adopt and submit its report to the county for approval. The report, which has a positive certification, makes changes to the district’s previously adopted budget, which was approved last June.

The district’s latest budget calls for $5 million in staff reductions for the 2018-19 fiscal year. Previous board discussions use the assumption that the average employee costs the district $100,000 annually. In layman’s terms, that means the district is currently assuming that 50 people will be receiving pink slips in March.

“It is currently out of certificated salaries, but reductions can be made anywhere,” clarified BHUSD Assistant Superintendent LaTanya KirkCarter Latham. “It is there to show LACOE that we acknowledge we are over-staffed.” (see ‘BHUSD BUDGET CUTS’ page 15)

#MeToo In Beverly Hills: Former Student Details Sexual Harassment While Attending BHUSD School

By Laura Coleman The inappropriate behavior started after school in fall 2016, just as she was starting her eighth grade year in Beverly Hills Unified School District.

The girl, now 14, recalls clearly the day her friend’s behavior crossed a line, and in fact she wasn’t alone when it happened: she was waiting with friends outside the Beverly Hills K-8 school to be picked up by their parents.

A friend called the boy, who was also in the eighth grade at the same school, to join them outside. Soon, he was playfully hugging the girl.

“All of a sudden, out of nowhere, he comes up behind, he puts his hands behind me and touched my breasts and mimicked a humping motion,” the girl recalled of that one day over a year ago now. “I felt dis-

“I was pushing him off me, telling him, ‘Stop. What are you doing?’”

At the urging of a friend, the girl ended up reporting the incident to the administration.

Reports were taken by school officials.

“I was told [the administration] would try to find out why he did this and get him to stop,” the girl recalled. “It didn’t stop.”

For a while, there was just verbal harassment, she said; no more touching. Then he crossed the line once again and touched her on the bottom while they were on the PE field in February. Once again, there were witnesses and once again reports were taken by school officials.

El Rodeo Renovation Gets New Timeline: Construction To Begin Q1 2019

By Laura Coleman On Monday, the Board of Education unanimously voted 5-0 to pass a resolution allowing the Beverly Hills Unified School District to extricate itself from a time-consuming, and likely unfruitful, process to access approximately $2 million in State Seismic Mitigation Program (SSMP) funds.

“This resolution puts us back on track,” stated Boardmember Isabel Hacker.

As a result of delays, district officials now anticipate that El Rodeo students will remain in portable classrooms for at least another four years, with construction on the school’s new seismically sound campus likely to begin in early 2019.

According to Terry Tao, facilities counsel for the district, construction on the new El Rodeo campus is anticipated to take 32 months to complete once it gets underway.

The delay, which officials say was unforeseen, resulted from the March 31, 2015 deci-

sion by the school board to immediately close portions of the campus after it became known that the building’s historic cupola was threatening the safety of the school.

As a result of that information, as well as structural evaluations and seismic review data showing that El Rodeo’s auditorium and cupola structure were deemed seismically unsafe, the district closed the school and moved students to temporary housing in order that a full seismic upgrade for safety could be designed and implemented.

Following El Rodeo’s closure, the school district embarked on the process of accessing a portion of the SSMP funds for El Rodeo, subsequently submitted designs for a full code compliant upgrade to the Division of State Architect (DSA). Tao estimated that the district has already spent around $2 million related to preparing those plans.

The application stalled, however, once the district was

required to provide significant data on past upgrades, test data, pull tests and other unavailable information in order to process the construction documents submitted to DSA. Tao emphasized that given the time and difficulty for undertaking a full code compliance upgrade, lack of funds for the SSMP and at least a $10 million savings, changing from a fully code compliant set of plans to a voluntary structural upgrade for safety would be in the best interests of the district.

“You’ll save a considerable amount of time,” he said.

Following Monday’s vote, this school district can now begin crafting a plan to address the school’s potentially unsafe seismic conditions and ensure safety without having the burden of having to provide a prohibitive amount of information to the DSA. “It’s all about making sure El Rodeo is not only safe, but on the fastest possible path,” Tao said.

By Laura Coleman Following months of contentious negotiations, the City of Beverly Hills and Beverly Hills Unified School District are on the precipice of having a new $10.5 million Joint Powers Agreement (JPA). On Tuesday, Dec. 19, the City Council is expected to vote on the new JPA, the final hurdle to ensure the continuance of this vital contract.

The new three-year JPA, which the Board of Education unanimously approved at its meeting on Monday, codifies how the City and school district make use of BHUSD properties during non-school hours.

“The City Council at their meeting on Dec 19th will consider a recommendation to accept the new JPA agreement that the Board unanimously approved on their Dec 11 meeting,” confirmed City Manager Mahdi Aluzri. “The new agreement increases the funding level, establishes a higher level of accountability, and ensures that the City and the District continue to maintain a successful partnership in serving the community.”

In existence since 1978, the agreement stipulates how the district is compensated for

use of its facilities, although it is clearly intended to be more than just a rental agreement.

Indeed, more than 10 percent of Beverly Hills’ population are students at one of the district’s five local public schools. In addition, the turfs and fields conveniently located throughout the City – are essential to community programs and groups, such as Beverly Hills American Youth Soccer Organization.

“I am thrilled that the JPA will be on our council meeting agenda this Tuesday,” said Mayor Lili Bosse. “The schools are part of the fiber of my being and truly are the foundation of what makes our City great.”

Tuesday’s vote is expected to mark the end of a contentious negotiation process between the City and the school district to reimagine its current $9.7 million JPA. Before the Monday’s vote by the Board, BHUSD Superintendent Michael Bregy told his five bosses that the three-year agreement looked “really solid.”

By Victoria Talbot Walk with the Mayor will have its final walk for the year on Monday, visiting Cheryl Saban Designs, Paradigm Talent Agency and Platinum Equity, with a sneak peek at the offerings at 260 LA, a very New York City pop-up that has just expanded to the West Coast, featuring premier sample sales.

Cheryl Saban, whose atelier of gemstone jewelry and hand-blown glass is carefully crafted with her own hands, is well-known in Beverly Hills, where her children attended school. The Saban family is recognized for their outstanding philanthropy to many organizations, such as Children’s Hospital Los Angeles, and their name graces the beautifully restored Saban Theatre, one of the City’s most beloved historic landmarks.

Platinum Equity and Paradigm Talent Agency are in another historic building by Master Architect Paul R. Williams, built in 1939. The English Georgian Revival was designed for Jules Stein’s headquarters for Music Corporation of America (MCA). The building was sold in 1964 to Tex Thornton, president of Litton Industries, and Williams was again hired to expand the campus. It was acquired by Platinum Equity in 2003 and, with its majestic design, occupies a prominent space in the City landscape.

By Matt Lopez The Beverly Hills Police arrested a Beverly Hills anesthesiologist this week on murder charges.

According to a media release, Dr. Stephen Kyo-Sung Kim was arrested after the death of a patient that occurred at Rodeo Plastic Surgery on 421 N. Rodeo Dr. After a patient died at the clinic on Sept. 26, detectives investigating concluded that the death was caused by a lethal dose of Demerol injected into the patient during recovery. After a three-month investigation, police believe the deadly dose was injected

by Kim, an anesthesiologist who police say was under the influence of narcotics during the surgery.

Kim was scheduled to appear at the Foltz Criminal Justice Center for arraignment Thursday. His bail is set at $1,000,000.

Carjacking The Beverly Hills Police last Friday arrested a man on charges of carjacking near the intersection of Canon Drive and Dayton Way. The incident occurred shortly after noon, when the man allegedly carjacked, at gunpoint, a woman driving a small white hatchback vehicle in an alley near Canon/Dayton.

Kit Kirill Kipnis, 47, of Beverly Hills was arrested on charges of carjacking and transferred to the LAX Airport courthouse on Dec. 12.

Planning Commission To Consider Comments On 100 Crescent Draft EIR

By Victoria Talbot The Beverly Hills Planning Commission is considering public comments on the Draft Environmental Impact Report (EIR) prepared for the proposed overlay zone at 100 N. Crescent Drive for the comment period Nov. 13, 2017 – Jan. 5, 2018. The normally 45-day period was extended, taking into consideration the holidays, so that comments can be accepted after the holidays have ended.

The building is the proposed Beverly Hills Media Center, and will include a major screening room component, a ground-floor restaurant and rooftop amenities.

The applicant is asking the City to allow two additional stories (five total stories), which the Draft EIR shade and shadow analysis identifies as having “a significant impact,” meaning that

homes to the northeast of the project site on Rexford Drive will be impacted for more than three hours between 9 a.m. and 3 p.m. during the winter months.

At their meeting Thursday, the Planning Commission listened to public comments on the project. The documents are available at City Hall and online at www.beverlyhills.org.

The meeting, “is simply one venue during the 54-day comment period in which people can provide comments,” said Assistant Director of Community Development Ryan Gohlich. “No decisions would be made as to whether the project should be approved or denied.”

Approval or denial will not be considered until later in 2018, he said. All public comments will be considered in the Final EIR. (see ‘100 CRESCENT’ page 15)

Beverly Hills High School Has Less Stress During Finals Thanks To NormanAid

By Laura Coleman Amidst the anxiety-riddled time that occurs around finals, Beverly Hills High School students have spent this very week stressing less thanks to the NormanAid Student Support Center.

Monday’s “Puppy Bunny Day” for example, which saw 350 students pass through the BHHS student help center to cuddle with a puppy or bunny was likely NormanAid’s most successful event ever, remarked BHHS 11th grade student Alexa Khorshad, a Peer Counselor.

Throughout the week, in partnership with the Matthew Silverman Memorial Foundation, the center has hosted a multitude of inventive activities, all designed to help BHHS students manage their stress and anxiety and build coping skills during Finals Week.

From serving more than 300 cups of tea, mostly green, in the first few days, to having students practice yoga and mindful meditation, not to mention playing with puppies and bunnies, the center continues to work to make itself accessible to the student body.

“I’m hoping that it’s helping to normalize that it’s a helpful place for kids to come,” said BHHS Intervention

Counselor Ali Norman-Franks. “Stress affects our mood. Ultimately, if stress gets out of hand it can lead them to other mental health issues.”

Keys to de-stress include: practicing mindfulness, being in the moment, doing meditation, performing any type of physical activity; getting enough sleep; and eating healthful, balanced meals.

“There’s a lot of stress at school,” Alexa said, noting the during finals stress levels are always higher. “I had someone say, with the puppy thing, ‘These are like the best two minutes of my life.’”

That’s what Bel-Air neighbors are beginning to wonder as grading and other work continues at megamansion developer Mohamed Hadid’s muchmaligned 901 Strada Vecchia, despite having its permits revoked and a stop work order put into place more than two years ago.

According to one neighbor, Bibi Horacek, the lack of permits hasn’t stopped work on the site from continuing and she claims the Los Angeles Department of Building and Safety (LADBS) has sat idly by and let it happen.

LADBS chief Frank Bush agreed in an April 5 meeting

with neighbors that he would keep them updated to the status of any applications for new permits made by Hadid for the Strada Vecchia project, Horacek said in a letter she wrote Monday to Bush that was obtained by the Courier.

Such a plan would allow neighbors most affected by the project – such as Bibi and her husband Joe, who live directly below the property – to be kept in the loop on any matters related to construction at the site.

Despite that agreement, Bush’s LADBS inspectors have apparently allowed a significant amount of grading to take place at the site, “under the auspices of an ‘erosion control plan’ without requiring grading permits,” writes Horacek.

“I am extremely disappointed that you have failed in keeping your word of honor and are allowing all sort of activity to take place at the property without even providing the community an opportunity to review the plans.”

Neighbors report that grading has been occurring at the property since the week of Nov. 13, with bobcats shaving the hill, creating paths and hauling away dirt – all being done without any permits or CEQA review.

Horacek noted that as part of the alleged “erosion control,” workers have apparently moved trees to the illegal floor beneath the properties pool level and installed plywood, which could be used to hide work being done at that level.

“Last Friday I learned through LADBS that it is ‘trying to avoid a haul route approval’ and that LADBS is looking for ways to ‘make things work’ for all the grading and export totals. All the grading quantities are currently being stockpiled in the basement. These cannot remain there, the basement has been previously ordered demolished by LADBS. It is clear that games are being played with the grading quantities in an effort to assist a convicted criminal.

Where is LADBS transparency?” Horacek wrote.

The “erosion control” is just the latest in a string of work that is apparently being done at the site without permit, under the not-so-watchful eye of LADBS.

In October, LADBS officials confirmed that – after it was brought to their attention by residents – they had ordered Hadid to remove furniture, track lighting and wood finishing that had been installed inside the megamansion.

Bush wrote in an e-mail to residents at that time that LADBS inspectors “have been and will continue to make regular inspections” at the property, but it appears that these incidents continue to keep cropping up under the noses of LADBS inspectors, going unnoticed until brought to their attention by those in the community.

Bush did not return a request for comment from the Courier.

Board Loneliness Can Be Harmful To Seniors Alzheimer’s Greater Los Angeles (ALZGLA) has announced the appointments of Jeffrey Glassman and Ingrid Graham, to the ALZGLA board of directors, effective last month.

• For many years, L.A. attorney Jeffrey Glassman specialized Jeffrey Glassman in estate planning, probate and trusts, and he now serves as the CEO for Covington Capital Management.

Glassman has a history of philanthropy and public service, particularly in support of the L.A. aging community. He served on the Board of Councilors for the USC School of Gerontology and is a member of the board of directors for the LA Jewish Home, most recently serving as chairman.

Glassman has experienced Alzheimer’s disease and related dementias within his family, and has been a donor to ALZGLA over many years.

• Ingrid Graham is a professional dancer, model and choreographer. She has performed and choreographed for the Edinburgh Music Festival, Merce Cunningham Dance Company, California African American Music, and

the Brooklyn Academy of Music, among others.

Her commercial dance clients include Victoria’s Secret, Pharrell Williams, Latin Grammy Awards, Nike, and Saks Fifth Avenue, and she has produced and choreographed several Ingrid Graham award-winning dance films.

A teacher and mentor, Graham councils and coaches for the NAACP’s Afro-Academic, Cultural, Technological and Scientific Olympics. The holidays are supposed to be a happy time, but many isolated seniors often are left feeling lonely — which can be harmful to their health.

Loneliness is linked to serious medical conditions, including Alzheimer’s disease, stroke and heart disease as well as a higher risk of premature death. But loneliness can be easily overlooked as a health risk because healthcare providers can neglect asking their older patients about their social lives, and many older adults are too proud or embarrassed to ask for help, experts say.

When Cedars-Sinai physicians and nurses who specialize in caring for older adults screen their patients for isolation during geriatric physical exams, they find that more than one-third are lonely.

“Loneliness is a significant issue among older adults, robbing them of their ability to live vibrant, independent lives as they age,” said Sonja Rosen, MD, associate medical director, Geriatric Care Programs and chief of Geriatric Medicine for Cedars-Sinai Medical Group. “But it doesn’t have to be this way.”

To tackle loneliness over the holidays, Rosen and her colleagues at Cedars-Sinai suggest the following: • Search online listings. Throughout the holiday season, recreation centers, libraries, museums, places of worship and local colleges host free and lowcost community events.

• Reach out. The holidays are a good excuse for seniors to call and catch up with friends and family.

Younger family members and friends can make a point of stopping by a senior’s house for a quick visit.

• Explore both new and familiar hobbies.

• Seek medical advice. A geriatrician can connect seniors to other resources and potential treatments.

As part of its ongoing work with seniors, in January, Cedars-Sinai will offer new, free exercise and health-management classes. Cedars-Sinai has partnered with Jewish Family Service to host classes at local community organizations for patients and other seniors in need.

The class, developed by the Arthritis Foundation, features a workout with weightlifting, stretching and balance exercises that can be adaptable to any level of fitness. The program has been proven to decrease their risk of falling, according to the Centers for Disease Control and Prevention.

“Fear of falling is a big reason older people don’t leave the house,” said geriatrician Allison Mays, MD, MAS. The chronic disease self-management classes will cover topics such as how to manage medications and communicate with one’s doctor.

By Victoria Talbot Finding homes for shelter dogs is the main focus of most animal welfare groups; but Marley's Mutts works hard to treat the problem before it begins with an extensive spay & neuter program to control the population of dogs that need homes or become euthanized by preventing them from breeding, as well as rescue, foster, adoption and health care.

Zach Skow is the face behind Marley's Mutts, which was born out of the desperation he felt in the midst of alcoholism, when he was dying of liver failure. Marley saved him, and he saved Marley, a Rottweiler/Pit mix rescued from the Mojave shelter when he was an 8-week old pup. Diagnosed with end-stage liver failure, Marley gave Zach a reason to get up in the morning.

His dog's love showed him the way; he recovered, and Marley lived to be 15.

His legacy is Marley's Mutts.

Hooch, a French Mastiff who nearly lost his life at the shelter, just won Hero Dog for 2017. When they adopted him, he was severely underweight. The shelter people did not know why he would only thrash around in his food and water bowls. Skow discovered that Hooch has no tongue - it was cut out.

Today, Hooch has learned, through patience and love, to slurp up water and eat moistened kibble fed lovingly by hand. He now works as a therapy dog for children with special needs.

Marley’s Mutts takes these dogs with special needs, provides complicated health care and finds permanent fosters.

The "Mutt Militia", organized through Marley's Mutts Dog Rescue, is a group of volunteers who join Skow to wage a war against abuse, exploitation and needless euthanasia. Donors fight with funds, social media, time and effort, fostering, training, health care professionals and people who help abused dogs learn to trust again.

The organization’s Pawsitive Change program teaches inmates in prisons dog training - so they have a valuable skill when they leave prison, pairing inmates with death-row dogs.

Inmates live with the dogs, so over time, both dogs and humans have time to build a relationship and heal.

Though many of the dogs are rescued in the Kern County area - that is also one of the worst areas for shelter dogs. Marley’s Mutts Mutt Militia comes to some of the worst L.A. County shelters to rescue dogs in need, and cats.

Bowling, who previously served as served as the managing director of the One&Only Palmilla resort in Cabo San Lucas, will be responsible for the overall operations of the property.

Officials confirmed to the Courier that the City has not paid the school district since June 30, when the original contract’s one-year extension ended.

Since then, the JPA has been extended four additional times so that it now expires Dec. 31.

The terms as to what the City will pay the district to make use of its school facilities are as follows: $10.5 million for FY 2017-18; $11 million for FY 2018-19; and $11.5 million for FY 2019-20. In addition, the City will also do the following: increase payment for crossing guards from $125,000 to half of

The Draft EIR has assessed the property in accordance with the California Environmental Quality Act (CEQA) and prepared this initial study of the impacts.

The most significant elements of the proposed project include the height increase from three to five stories, the 2.75 FAR and the parking, said Gohlich.

The applicant is seeking an overlay zone, General Plan Amendment, Zone Text Amendment and Planned Development for a commercial office building. The proposed project would add an additional two stories to the existing building to become 72 feet, five stories. The allowed height is 45 feet, three stories. The increased height impacts adjacent residences with shade and shadow. The current FAR is 1.81; the proposed FAR is 2.75; allowable FAR is 2.0.

Currently, the building has 377 total subterranean parking spaces, with 317 of them standard for parking. The applicant proposes 465 total parking spaces, with 268 standard spaces. The proposal is to allow 45 compact, 8 compact tandems, 9 mechanical lift stack spaces,

the operative contract; deposit $100,000 into an escrow account established to pay for repairs caused during JPA use; fund an additional $20,000 peryear increase for police and fire services; provide ambassador supervision up to 39 hours per week at all district sites; install Closed Circuit (CCTV) cameras at district sites at an estimated cost of $1.5 million.

Vice Mayor Julian Gold, who sits on the City-BHUSD JPA liaison along with Councilmember John Mirisch, Board President Lisa Korbatov and Board member Howard Goldstein, previously told the Courier that he was optimistic that the City Council would approve the new three-year agreement.

Boardmember Mel Spitz, who previously served as head of the district’s Finance Committee just a few years before joining the board, clarified: “That gives us approximately two months to determine who gets the pink slips.”

If not done, he emphasized, approximately half of the district’s fledgling $10 million rainy day “endowment” Fund 17 would be wiped out.

“I just want to point out how important an issue this is,” Spitz said during the Board discussion.

The good news is, General Fund revenue is projected to increase by $1.8 million in this current fiscal year. Further, property taxes, an unknown at this point,

The bad news is that the fund balance is expecting a net decrease of $4.1 million. Part of that comes from the disparity between just how much the district takes in as revenue ($66 million) and spends on education and programs ($70.1 million). Further, the budget has the school district dipping into its reserves. And while the recent money the school district captured in dealing with the fall out from the Beverly Hills Oil Well has helped the district’s position, it really only addresses an unfortunate new circumstance.

According to the historic assessment and evaluation report, “worries that these lots would be used for private schools, public buildings, income-producing residences—that is, apartment buildings—or that the commercial uses south of the Boulevard would spill over to the north led an association of north of Santa Monica Boulevard property owners to petition the City Council to condemn the land for use as a City park.”

The residents formed an improvement district bonded for $720,000 and hired Ralph Cornell to design the parks.

With the Electric Fountain on the west end, Hudson designed the Doheny Fountain to be the focal point of the east.

The importance of retaining the historic integrity of the fountain and the park was described in the Landmark Assessment: “Character-defining aspects of the fountain include: the Moorish star shape; terra cotta paving; concrete construction; shallow stairs; polychromatic tile stair risers; blue and turquoise mosaic tiled surface of lower basin; two-tiered fountain consisting of a circular shaft with two ornamented splash basins; and cast concrete sculptural decoration featuring nymphs.”

Beverly Gardens Park marked a turning point in city planning when completed. It marks one of the City’s most characteristic features that has a cherished function separating residential from the business uses, and offering passive recreation opportunities.

The historical value is described in the Landmark Assessment: “Beverly Gardens appears to be part of the first application of the concepts of the City Beautiful Movement in Southern California and is one of, if not the first, applications of these principles to a residential subdivision in the State of California. It is, thus, the pioneer in a design and method of planning that influenced many subsequent developments in the State.”

City Urban Designer Mark Odell, who manages the City’s historic designations, agreed that adding a pathway would be inappropriate for the park’s historical integrity.

Director of Community Services Nancy Hunt Coffey explained that to restore the fountain could be costly. Other options included patching leaks and using the basin without the splash feature or removing the water component entirely, which were rejected by the liaisons in favor of authentic restoration.

The project will come back to the City Council in the future.

Skirball Fire Prompts Koretz Homeless Encampment Investigation

By Matt Lopez L.A. City Councilman Paul Koretz on Wednesday introduced an emergency motion asking various city departments to report on the problem of hillside homeless encampments, one of which was determined to be the source of the recent Skirball Fire in the Sepulveda Pass.

The fire, which scorched 422 acres since it broke out shortly before 5 a.m. on Dec. 6, was caused by an “illegal cooking fire” at a homeless encampment in a brush area, the Los Angeles Fire Department reported Tuesday.

The fire occurred near where Sepulveda Boulevard crosses under the 405 freeway,

authorities said.

The flames destroyed six homes and damaged 12 others, and at one time prompted the evacuation of about 700 homes and an apartment building in Bel-Air. Koretz’s motion, which was approved on an 11-0 vote, calls for reports from the city's fire and police departments, as

well as the Los Angeles Homeless Services Authority and Caltrans.

Koretz said he wanted the departments to report on the specific encampment connected to the Skirball Fire to determine if homeless people were trespassing on land not open to the public when they set an illegal cooking fire.

The transition from BHUSD hasn’t been easy. The girl’s mom noted how her once boisterous daughter has drawn inward, no longer trusting adults. The girl has even started thinking that girls are inferior to boys.

“It’s like, I haven’t forgotten about what happened to me.

And I think a part for me will never get over this,” the girl said. “I want to go to school with my friends. But I worry.”

In the wake of recent celebrity sexual abuse revelations in the news, the girl said that she has increasingly felt compelled to speak up about what happened to her.

“I want my voice to be heard,” she said. “After women and people in general are going through this right now and speaking about it, if I don’t speak out, he could [do something worse.]”

A certified four-page letter from BHUSD, dated May 8, 2017, sent by the district’s former Human Resources Officer Yolanda Mendoza to the girl’s mother on official BHUSD letterhead succinctly documents the results of an investigation into the alleged incidents.

The letter, which is based on interviews conducted by non-BHUSD attorney Kimberly Ludwin with the firm of Atkinson, Andelson, Loya, Ruud & Romo, states: “This shall serve as a report of the Investigator’s findings and conclusions.

In sum, the Investigator did make a finding that [the boy] engaged in sexual harassment on multiple occasions against [the girl] in violation of District Policy 5145.7.”

The report further states: “All of the above incidents reported by [the girl] involved

unwelcome touching and hugging and had the effect of creating an intimidating, hostile or offensive educational environment as defined in Board Policy 5145.7.”

While the girl and her mother remain convinced that the boy has never been sufficiently disciplined, if at all – something that BHUSD officials are unable to comment on due to laws intended to protect minors, the letter states that the boy had been disciplined prior to the incident where he touched her on the behind.

However, the letter notes that “despite this discipline and a directive not to touch or hug [the girl], the evidence supports a finding that he continued engaging in this conduct.”

Further, the letter, authored

by Mendoza, tells the girl’s mother to “rest assured that an appropriate response will be made with respect to each of the above findings and no further harassment will be tolerated.”

Superintendent Michael Bregy said that while he was unable to speak on one specific case, “Every single case has follow-up with some support of counseling.”

In conversations with the Courier, the girl said that she believed that the boy’s inappropriate behavior was not limited to just her, an allegation that the district investigation appears to support.

The report concludes with one additional finding, specifically: “The preponderance of the evidence supports a finding that [the boy] has made several offensive and derogatory comments to female students in violation of Board [Policy] 5145.7 which prohibits ‘unwelcome sexual slurs, epithets, threats, verbal abuse,

derogatory comments or sexually degrading descriptions.’”

Despite the finding, the sexual harassment incidents involving the boy were never reported to the Beverly Hills Police Department. Multiple officials have told the Courier that school employees are mandated to report similar issues to police in order to ensure that there is proper documentation should a similar incident happen again. BHPD confirmed to the Courier that no reports on the incident appeared to have been filed with the police.

Last week, BHHS student newspaper Highlights published an article detailing how sexual assault is happening everywhere–including at the high school. According to a BHHS student poll of 202 students surveyed, 15.3 percent of students at the high school have been sexually assaulted.

BHHS Assistant Principal Christopher Regan is quoted in the article as saying: “I don’t know if we necessarily treat [investigating sexual misconduct] different than [investigating] bullying other than the fact that, if it were sexual battery, we are more likely to get the police involved.”

BHHS Intervention Counselor Ali Norman-Franks said the school is planning to help educate kids on what constitutes inappropriate behavior, such as slapping another student’s behind or touching girls’ breasts, in February when the Norman Aid Center spearheads Forming Healthy Relationships Month. As part of that month, there will also be a focus on teen violence.

“It’s so important that we teach them what’s right, and also what their rights are,” she said.

“I tried to forgive him because my mom taught me not to hold grudges,” she said.

But then there was another incident just a few days after the harassment on the PE field, this time in the hallway, where there were no witnesses, and she said she began to feel truly frightened.

“He came up and said he was going to rape me,” she said.

When she once again went to the adminstration to make a report, she said that this time she was not asked to document her statement in writing, although she did observe one administrator write something down about the incident. “[The administrator] said, ‘There will be consequences, but they’ll be the consequences that I want to happen,’” the girl recalled. The meaning of that was clear to the girl, she added: “He won’t be kicked out. He won’t be expelled or suspended.”

“I kind of just gave up hope of reporting,” she said. “The third time it happened, nobody did anything. It was just like a slap on the wrist.”

The boy is now a freshman at Beverly Hills High School.

The girl, on the other hand, now attends high school outside the district, a decision she said she made together with her mother in order to keep herself safe from the boy’s continued harassment.

“All the chit chats, all the meetings, no one did anything,” the girl’s mom said.

“She didn’t go on any graduation trips because she was

LETTERS TO THE EDITOR When we first met, the volunteer members of the Future Focused Schools Team were a disparate group, many of whom had never met. Brought together with the clear purpose of exploring and analyzing options for our beloved Beverly Hills Unified School District, we are parents of current and former students, community members, alumni, City employees, current and former teachers and administrative staff. With such a large and diverse group, and coming from a myriad different BHUSD experiences – both positive and negative–we often engage in spirited debates with one another, yet remain open minded with each other, and with the community at large. Over these past weeks, one thing remains clear: we share a driving common passion for our public schools.

We continue to work together with that passion for our district. Our goal has two primary components: to maximize educational and enrichment opportunities for our students and ensure fiscal responsibility and sustainability for the district. We are striving to find paths toward creating a 21st century version of the “lighthouse district” we had once been, a focus of pride for our community that matriculates students who have achieved their potential, broadened their horizons, enriched their knowledge and fulfilled their dreams.

If you’ve talked to any one of us, you’ll know that we all feel we’ve had a crash course in “BHUSD 101,” and now we’re in sort of an “AP BHUSD.” All of the materials that form the basis of our education and our growing knowledge of the district are available online to the entire community, albeit without the extremely helpful tutelage from the administrators who support our back and forth conversations.

And that’s just what this has been: a conversation.

Your FFST is not locked into any single position.

We may find more than one solution in this process.

We are not tasked with a Board of Education or administrative agenda. We are not burdened by budgetary expectations, and operate under no cloud of a systemic bias. We are in conversation with each other and the community. Our meetings and homework involve analysis of the facts: finances, enrollment, delivery of education at the primary, middle school and high school levels, enrichment programs, counseling, intervention, transitions, special ed, athletics, facilities, and more. We are looking at the history of our district, listening to the hopes and dreams of current parents, students and teachers, as well as researching the systems utilized by competitive districts and private schools in our area. With that in mind, we are diving deeply into a look at the current/future BHUSD TK-8 model (or some version of that), and options for a BHUSD version of the TK-5/68 model.

We have asked our district administrators to put together the financial, educational, enrichment, and facility information needed so we can examine all of the options that have been floated by our team and by many members of our community. We are focused on recommendations that will optimize and deliver the best education to our students, not one merely economically viable or systemically efficient. We want schools that are exceptional, dynamic and filled with potential for even more growth.

As of our Dec. 6 evening meeting, we continued the conversation. We are still that disparate group with myriad experiences who share a passion for our City’s schools. We hope to present to our community and to the Board of Eduaction an educated and real- world view of the options available.

The mere thought of change may feel uncomfortable to many in our community, but we are tasked with working toward securing a sustainable, vibrant, world-class 21st century education system–one that is consistent with our current budget and provides for all of the children and families in our community.

As our work is still in progress and far from done, we would welcome hearing any ideas, solutions, fears, hopes and dreams from members of the community. Please join us in this ongoing conversation.

One comment in the article says the height is similar to that of other

buildings in the area. According to the assessor map, however, the building next to it only has about a 20,000 square foot footprint. This has joined six others in what used to be a residential parcel but is now one parcel of about 60,000 square feet. You can begin to see the scale of such a massive building if developed based on this current proposal next to other residential properties.

Aside from the latest Environmental Impact Report on this project which shows a lot of “serious impact boxes” checked, the developer is not adding any square footage to the current parking, but just restriping existing spaces as well as requesting for a higher density bonus to go from 317 to 461 spaces, or 144 less than required by the current zoning standards..

The core issue, as I see it, is this Entertainment Overlay Zoning (E-O-PD) Ordinance which this project is using as precedence After removing all its fluff, what you see is a clear spot zoning and favoritism by providing big developers a backdoor route to use their clout and networking to circumvent our City zoning laws by allowing the developer to build 80 percent above its zoning law to attract an entertainment and media tenant. (Current FAR is 2.0 while Ordinance FAR allows 3.6 which is 80 percent more). There was absolutely no required financial study done to prove that the City needs or benefits from attracting media tenants and there is absolutely no guideline what kind of blighted area properties should be targeted for this kind of over-developmental use?

What is particularly bothersome is the City being so complacent as to allow this project to get this far next to a residential area. Why Beverly Hills is giving preferential treatment to one kind of land use against another is beyond me. A quick google search looking for talent agencies in Beverly Hills gives you over 20 matches (more than we as residents need). If the City wants more of this business, why not give the incentives to the tenants of such buildings–not the owners to overbuild beyond zoning standards. Can anyone tell the residents the logic behind the members of the City Council’s decision to pass this ordinance ?

Compare the development on 8767 Wilshire Blvd. The developer followed all zoning laws and provided more than 50 public parking spaces, plus other slots for self parking with two hours free and free parking for all employees. Yet when they wanted a higher ratio of medical use, they had to take the City to court.

With this developer, he gets the freebie right from start if bringing in a media or entertainment tenant. One needs to just remember what a disaster it was to allow L'Ermitage hotel to build next to the residential properties by exceeding height and zoning standards.

Wiseman Dawoody ****** At the recent school board organization meeting when a new president Lisa Korbatov and VP Noah Margo were elected, Mel Spitz and Isabel Hacker cited board policy when objecting to Margo’s election.

Spitz went so far as to say that electing Margo is a “violation of the by-laws” since in his view Hacker was the rightful successor.

Contrary to the Spitz’ assertion, BHUSD Board Bylaw 9100 states: “Selection of the vice president shall be determined by rotation based on how long each member has served on the board.” Since Margo has served for six years and Hacker for only two, making Margo’s selection was clearly the correct action to take.

But Spitz and Hacker abstained from the vote, breaking another bylaw. BHUSD Board Bylaw 9323 states: “The board believes that when no conflict-ofinterest requires abstention, its members have a duty to vote on issues before them.”

When I served on the school board, I frequently read the BHUSD Board Bylaws, finding it helpful to do so. The bylaws are there for a purpose, enabling the board to work harmoniously and efficiently and to focus on Board Bylaw 9271: “In all actions… the member’s first commitment is to the well-being of our youth. His/her primary responsibility is to every student in the district.”

In the Nov. 24, 2017 edition of the Courier, the article titled Anonymous Letters Claiming Malicious Acts Target Police, City Staff, Residents, sources throughout the City speculated about who sent the anonymous letters. Attorney Bradley Gage, who filed a lawsuit against the City on behalf of BHPD Captain Mark Rosen, has informed the Courier: “I do not send anonymous letters, I never have and never will.”
