Vice Chair Brian Rosenstein and commissioner Howard Fisher voted to amend the ordinance to clarify that new oil wells may not be drilled into Beverly Hills from another city if the drill site is within 500 feet of any Beverly Hills school or park. LOCATION: Commission Meeting Room 280A Beverly Hills City Hall 455 North Rexford Drive Beverly Hills, CA 90210 The Planning Commission of the City of Beverly Hills, at its REGULAR meeting on Thursday, January 10, 2013, will hold a public hearing beginning at 1:30 PM, or as soon thereafter as the matter may be heard to consider: A request for a Conditional Use Permit to allow a new, approximately 3,500 square foot exercise club (Soul Cycle) to be located at 9465 Wilshire Boulevard. Operation of an exercise club does not require issuance a Conditional Use Permit; however, an exercise club may not be located on the ground floor of any building located within the Business Triangle, nor occupy more than 25 feet of ground-floor street frontage within the Pedestrian Oriented Area without the issuance of a Conditional Use Permit. The proposed exercise club would be located within the Business Triangle and occupy a portion of the ground floor of the building, and would occupy more than 25 feet of ground-floor street frontage within the Pedestrian Oriented Area. Therefore, a Conditional Use Permit is required for the abovementioned aspects of the project. In addition to the request to allow a portion of the exercise club to be located on the ground floor of the building, the applicant requests a Conditional Use Permit to allow a shared parking arrangement between the exercise club and the office uses within the building. The Planning Commission may issue a Conditional Use Permit to allow up to 50% of the required parking for the office uses to be used by the exercise club if it can be demonstrated that sufficient parking is available and that the exercise club operates at different peak hours than those of the office uses within the building. This project has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the environmental regulations of the City. The project qualifies for a Class 1 Categorical Exemption for operational changes and minor alterations within an existing commercial building, and the project has been determined not to have a significant environmental impact and is exempt from the provisions of CEQA. Any interested person may attend the meeting and be heard or present written comments to the Commission. Beverly Hills Schools Join Forces To Feed Hungry By Laura Coleman Nearly 200 Beverly Hills students and families spent Christmas Eve making lunches for the Greater West Hollywood Food Coalition at Hawthorne School on Monday as part of the district’s yearly community service event “Feed the Hungry.”

“It’s a really special event,” Assistant Principal Christian Fuhrer told The Courier. Sponsored by Hawthorne and the PTA Council, the annual tradition is part of a community service tradition designed to engender a commitment to public service in Beverly Hills youth.

Students made over 1,300 brown bag lunches with peanut butter & jelly sandwiches, holiday cards, juice, chips, oranges and a candy cane. “It’s an amazing and energetic day,” Feed the Hungry Chair Michele Rose said.

On a lark we sent 100 greeting cards with

that photo followed. Industry folks began carrying on about what fun they are. Soon enough, telephones began ringing, everyone asking to be ‘put on the list,’ everyone curious about what our next card would be. That’s when we realized we launched a tradition.

eedless to say, the list’s now increased to 1,000 people. And although it’s a lot of work to stuff, seal and stamp the cards, we figure it’s worth it. Sometimes this is the only time of year we connect with certain hristmas cards with friends. And in this day of ‘electronic everything,’ Pete and I

feel nothing beats an ‘oldfashioned’ Christmas card.

ur friends tell us their kids especially look forward to the cards. Even though they probably don’t know the film references, they think the cards are funny. We’re happy that they are.

AN ORDINANCE OF THE CITY OF BEVERLY HILLS REVISING THE SEPARATION REQUIREMENTS BETWEEN OIL WELLS AND SENSITIVE USES, REQUIRING REGULAR INSPECTIONS OF OIL WELLS FOR SUBSIDENCE, AND REQUIRING AN ANNUAL REPORT TO THE CITY COUNCIL.

AN ORDINANCE OF THE CITY OF BEVERLY HILLS AMENDING THE MUNICIPAL CODE TO ESTABLISH A REVIEW PROCESS TO DETERMINE SUBSTANTIAL COMPLIANCE WITH CERTAIN ZONING CODE STANDARDS BASED ON SPECIFIC FINDINGS.

The proposed ordinance would clarify the Beverly Hills Municipal Code to make clear that new oil wells may not be drilled into Beverly Hills from another city if the drill site is within five hundred feet (500') of any school or park site located in the City of Beverly Hills and that the prohibition does not apply to schools or parks in other cities. In addition, the proposed ordinance requires the City Engineer to inspect for subsidence from oil wells at least once every two years and would add a provision requiring the Director of Public Works or designee to annually request documents from pertinent regulatory agencies indicating dates of inspection and notices of violation with regard to oil wells in the City, and thereafter present a report to the City Council regarding the results of the request. This Ordinance has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the environmental regulations of the City, and is categorically exempt pursuant to CEQA Guidelines Section 15301. At the public hearing, the City Council will hear and consider all comments, and may introduce the ordinance. All interested persons are invited to attend and speak on this matter. Written comments may be submitted and should be addressed to the City Clerk, c/o City Clerk, 455 N. Rexford Drive, Beverly Hills, CA 90210. The area was previously used for croquet, although Recreation Services Manager Teri Angel said the Croquet club has “kind of dissolved” after not paying dues the last two years. Zoet told the commission that an “aggressive” outreach campaign would begin to notify residents about the meeting. Outgoing Commissioner Alan Block, who is set to join the Planning Commission, advised City staff to go beyond just the nearby residents and contact as many people as possible throughout the City. “You should contact the general public, not only residents around the park, because we want to get this out to all the dog owners,” Block said.

require the City Engineer to inspect the oil wells for subsidence at least once every two years. Subsidence is a gradual caving in or sinking of an area of land that can often be found at drill sites. At the request of community member Jody Kleinman, who has been outspoken in the past about drilling in Beverly Hills, the commission added a provision requiring the Director of Public Works or a designee to annually request documents from regulatory agencies that include dates of inspection and notices of violation regarding oil wells in the City. Those results would then be presented to the City Council. Corman abstained from the vote, citing a lack of information regarding the science behind the potential hazards of oil drilling. “It’s a bit of a controversial issue in that there are views on both sides. Evidence on one hand states there could potentially be impacts, but there appear to be many experts on the other side that state there are no impacts...” Corman said. “I don’t feel I have enough information to vote one way or the other.” Commissioner Dan Yukelson recused himself from the discussion because he owns an apartment in Los Angeles that receives royalties from Breitburn, which is now Pacific Coast Energy Company (PCEC). Rosenstein also noted that he owns a commercial office

The issue came before the commission after it was learned during discussion regarding PCEC’s application to drill two new wells under Beverly Hills, that one of the drill sites (on Pico Boulevard and Doheny) was about a half block from a school in Los Angeles. Councilmember Lili Bosse expressed concern over language in the ordinance stating City Engineers would check the site “from time to time.” When pressed by Bosse, City staff admitted they had never actually visited the proposed drill site. The commission discussed how schools would be defined in the ordinance, meaning whether it extended beyond the commonly assumed four K8’s and the high school in the City. The commission ultimately decided to leave that language up to the City Attorney. Senior Planner Michele McGrath said private schools were included in the definition and told the commission it essentially covered “commonly understood idea of a school being for general educational purposes.” McGrath said the ordinance would likely come before the City Council at its Jan. 8 meeting.

Financial issues facing the City should be one of the main talking points of the evening, White said. “These choices are extremely important to our residential quality of life,” White said. “If voters have an orientation they want to see implemented in Beverly Hills in terms of general policies, they need to be proactive.” with Wisconsin taking part today. The following should be clearly marked on the outside of the package “CONFIDENTIAL PREQUALIFICATION STATEMENT FOR THE CIVIC CENTER SIGNAGE PROJECT” The prequalification packages submitted by Contractors are not public records and are not open to public inspection. All information provided will be kept confidential to the extent permitted by law. However, the contents may be disclosed to third parties for purpose of verification, or investigation of substantial allegations, or in an appeal hearing. State law requires that the names of contractors applying for prequalification status shall be public records subject to disclosure, and the first page of the questionnaire will be used for that purpose. Each questionnaire must be signed under penalty of perjury in the manner designated at the end of the form, by an individual who has the legal authority to bind the Contractor on whose behalf that person is signing. If any information provided by a Contractor becomes inaccurate, the Contractor must immediately notify the CITY and provide updated accurate information in writing, under penalty of perjury.

The CITY may also determine at any time that the prequalification process will be suspended for the Project and the Project will be bid without prequalification. Contractors may submit prequalification packages during regular working hours on any day that the offices of the CITY are open. Contractors who submit a complete prequalification package will be notified of their qualification status no later than ten business days after submission of the information. The CITY may refuse to grant prequalification where the requested information and materials are not provided by the due date indicated above. There is no appeal from a refusal for an incomplete or late application, but re-application for a later project is permitted. Neither the closing time for submitting prequalification packages for this Project will be changed in order to accommodate supplementation of incomplete submissions, or late submissions, unless requested by the CITY in its sole discretion. In addition to a contractor’s failure to be pre-qualified pursuant to the scoring system set forth in the prequalification package, a contractor may be found not pre-qualified for either omission of or falsification of, any requested information. Where a timely and completed application results in a rating below that necessary to pre-qualify, an appeal can be made by the unsuccessful Contractor. THE YEAR ‘13’ Do you avoid the 13th floor (if you can find one)? Do you note each “Friday the 13th”? Do you bet on or against #13? Well, by Tuesday morning at 12:01 a.m., we are in the year 13. This is only the third 13 we’ve experienced in annual numbering system. China and the Jewish people use a different system, but all acquiesce in noting that next year is 2013. So, will it be bad (the common fear of “13”) or good (for contrarians)? Right now, the trends are not good – in fact, they’re worse than they have been since 1980 when the Soviet Union was on the march, the U.S. economy was crushed by bureaucratic rules, taxes, restrictions, inflation, high interest rates, a decrepit military and Jimmy Carter’s “malaise.” (He had it; in general we the people did not.) We face the death of our economic system. The cause should be obvious – the government is too big and spends too much. No matter how much American government takes in, it spends massively beyond its means. It does not seem to matter to most that the government rake-off from private activity is at an all-time high. The government has never taken as much as now. We had to fight a war all over the world in 1941—1945 to spend as much, and then our very existence as a nation was threatened with military destruction. Today, we are threatened by the cancerous growth of government spending driven by massive takings from producers and transfers to nonproducers. This column wrote a few months ago that “Ayn Rand Used to Be Crazy.” What she predicted is now accelerating. Not only is government at all levels taking more every day, but that same government stifles, strips and destroys producers. What is worse is that the amount of money we as a nation owe to others is accelerating, too—beyond comprehension. Our debts expand—not because we build roads or bridges or launch space rockets—but because government gives the money to nonworkers. The most heavily-funded class, the public retirees, take more and more every day. The say, “this is the deal” city councils, state legislatures, and the Congress cut. The companion fact is that there is no possible way for this nation to pay for the accumulating benefits and obligations owed to people who are not working whether they were government workers or not. The vast majority of federal and state government spending is on its own activities and payments to people not working. Whether it is government pensions, government retiree health care, Social Security, federal disability payments (now paid to nearly nine million Americans and growing), free health care and education for millions of illegal immigrants, Medicare, SSI, food stamps or whatever, the amount taken by those recipients today vastly exceeds their contribution to the common kitty. It just does. Funding this behemoth today comes from borrowing. Did anyone notice that we ran out of lenders? Now, under President Obama’s Treasury Secretary Timothy Geithner, the U.S. Treasury just prints more money. (Well, they invent money on their computers, to be more precise, rather than simply run the printing presses.) Beyond the financial aspect is the moral one: is it moral to take forceably from one person to give that money to another? We believe it is not and never has been. That is the philosophy that

narrowly reelected President Obama in November, tragically. In 1980 former California Gov. Ronald Reagan reflected an opposite moral imperative of the American people -- an imperative to produce, create, and reap the benefits of their own labors, not someone else’s. Reagan was elected and reelected in landslides. He fully vindicated the people’s belief in themselves and in his leadership. In 2013, the majority of presidential voters opted for a president whose campaign was based almost entirely on attacking the producers, of accusing those who pay over 90 percent of American taxes of “abusing the middle class.” Talk about a diversion. Just attack the good guys—the producers, the inventors, the risk-takers, the successful—and make them look evil while you’re ripping off everyone else. It’s the burglary scam – dress up in a utility worker’s uniform, keep the residents at the front door while your partner steals everything out the back door from the rest of the house. Today, we have this “fiscal cliff” talk. What it means is that the tongue-tied Republicans are getting blamed for resisting President Obama’s latest attack on production, work and earned reward. President Obama will simply surf Hawaii or golf in Maryland until the Republicans cave (forgetting that they were reelected by a strong majority to control of the House of Representatives). We wish they would simply walk away and let the Democrats propose and pass everything. Instead, they will “compromise” just enough so they get the blame when everything really does finally collapse. It’s President Obama at the wheel with the Democrats cheering him on and he will drive us over that cliff. He and his party will blame the Republicans and the Republicans will stand there looking guilty. They always do. In the meantime, the really rich—mainly Democrats—will cut their deals and grow their wealth even more. If this were a cartoon, it would be the Road Runner vs. Wiley Coyote. And we know how that always turns out. But it is not a cartoon and we the people—the nation—will suffer, not some cartoon character. We hope and pray we are wrong. Happy 2013.

Rabbi Jacob Pressman AVE ET SALVE! Ave et salve! Hail and farewell! In five days it will be the first day of a new year: 2013. We shall have taken leave of the old year –and I must say: “good riddance!” You read and heard the news of 2012. I need not recite the litany of its disasters. It was mostly bad, from hurricanes to floods to droughts, from civil wars to mass murders, to assassinations, to gunning down children in their classrooms. In America, only a peaceful election and bit of an upturn in the economy gave us good news. But: “Ave” hail, let us look forward optimistically. Maybe Congress will act to assist the economy. Maybe the Dodgers and Lakers will come out on top. Maybe the salubrious weather pattern of Southern Cal will persist. Maybe the post-season bargains will put a few pennies back in our pockets. Maybe many of those who found temporary employment will hold on to their jobs. Maybe the Messiah will come – but that’s in another department. There is one area in particular which commands our attention. The several mass murders, especially in the public schools, have been a heartache. Beyond beefing up police protection, we have to do more in inculcating in the generation coming up a distaste for the casual snuffing out human lives. Especially here in Hollywood, we must call for their taking responsibility for in what their films and video are drowning for profit. The drift back to life as a jungle must be stemmed. Otherwise we might as well shed our civilized apparel, wriggle into our tiger pelts and go around smashing one another in the head.

A Very Special LETTER TO THE EDITOR As this year comes to a close, I am reminded of many things I wanted to accomplish and didn't get to. I am woefully aware of loved ones who are missing from the holiday table and the heartache their absence creates. It's perfectly natural, or at least I tell myself this, to feel a deep sense of melancholy at the holidays, depending on the year that you have had. Then I am reminded of Bedford Falls, or in my family's case, Bedford Drive, where our humble home (an apartment) is located near. The movie It's A Wonderful Life has been playing on TV a lot this month. I often think of its themes and how timeless and uplifting they are this time of year. More specifically, I think of how Beverly Hills to me presents a similar lesson and backdrop as it did to Jimmy Stewart's “George Bailey” in that iconic film. I walk over to the Swim Gym at Beverly Hills High School and see the actual locale of the famous dance floor scene, where former Little Rascals actor Carl Switzer (“Alfalfa”) pulls the rug out, well wood floor out, from beneath his classmates at the holiday dance. This is one of two remaining locations from the film. The main sets were at RKO Studios in Culver City and the outdoor town of Bedford Falls was actually in Encino, at RKO’s former movie lot there near where Balboa Park and adjacent homes stand today. My journey with my daughters Sofia and Olympia (now 6 and 4 years old) continues north up Roxbury Drive to the iconic Micky Fine Pharmacy, where my wife Brigitte meets us for lunch at their phenomenal and very nostalgic lunch counter. So reminiscent of the drug store scene in the film, where George averts disaster for the grief stricken pharmacist. After lunch, we take a stroll down Rodeo Drive and are bedazzled by so many things in the windows that despite their allure, I just can't afford right now. Then I am struck by the true meaning of my journey. Beverly Hills is an incredible City to live in, because of the people here, the quality of life, the outstanding public schools and city services like police and fire departments. It's not about the razzle dazzle for so many of us who live here, or the “prestige” of the zip code. It's an appreciation for a more nostalgic, small town way of life that most of the time only exists in the movies today it seems. Well, in Beverly Hills, or my own little Bedford Falls, it exists every day. I now hear the soothing sound of the beautiful fountain in our apartment building's courtyard as we walk through the gate with the girls. I see the holiday flowers our meticulous landlord brings us each year. As my wife heats up the Ovaltine for the girls and I help choose a book to read with them, (the classic Little Golden Book (Frosty The Snowman) I am overtaken with a sense of wistful simplicity and fulfillment. It’s truly A Wonderful Life for us residents here in Beverly Hills and we're all in the same movie. Hal Lifson
