Leaving an inheritance to minors

While it’s not easy to think about, estate planning to provide for your children in case of an untimely death is vital. The consideration of who will raise them is only one factor to consider. You should also delegate what happens with any money or property you leave behind and who will manage the inheritance until they become adults. If you have young children, you may not think you are old enough to worry about making end-of-life plans. However, it’s never too early to begin making plans to secure your family’s future. When planning an inheritance and custody plan, hire a professional attorney to ensure your last will and trust are legally certified and uncontestable.

PROPERTY GUARDIAN

Unless you directly appoint a guardian for your children, the process will be settled in probate. The court process occurs when there is no legal will that expresses your wishes and the state handles your estate. While in most cases, the surviving parent will manage the property or inheritance until the child reaches adult age, this isn’t always the desired result. It’s essential to document your choice for your children’s property guardian legally.

SET UP TRUSTS

Another strategic option is to set up a trust for each of your children. Within your will or living trust, appoint a trustee to oversee the minor’s inheritance until a specific age of your choosing. The trusted family member or friend is required to act in the beneficiary’s best interests while following your written instructions. Typically, a financial

inheritance can be used to cover costs such as those for the child’s health, education and living expenses. Make sure to ask your chosen trustee if they are up for it, as the role requires

regular challenges. For instance, they must file annual income tax returns for the trust. They are also limited to what’s allowed in the will, except for the section that outlines their authority.

For this reason, they may be asked to bring the physical document to banks or other facilities when they attempt to perform business on behalf of the beneficiaries.

Planning for long-term care later in life is not always a subject that seniors want to face. However, ensuring you have a strategy in place will alleviate your family members’ burden and guarantees that you are financially prepared for assisted living. Fortunately, the fiscal strain doesn’t have to fall entirely on your shoulders, as many government programs are available for assistance. Another benefit to getting ahead of long-term care planning is choosing from more options regarding where you will stay. Some assisted-living communities require long waiting lists and may have limited availability if you are suddenly forced into a situation where you need care. When possible, begin searching for a facility or neighborhood while you’re in good health to make a valuable decision.

AVAILABLE FINANCING HELP

According to the American Seniors Housing Association, the national median cost for assisted living per month is

about $4,000. For seniors who live in a private room in a nursing home, the price can increase to an average of $8,365 per month. Importance of trusts Developing a trust is another beneficial pre-planning tool to capitalize on when organizing your estate. While your lawyer or financial advisor can walk you through different policies that may benefit you, a living trust is of utmost importance for you and your family. Virtually, this type of trust guarantees your estate and belongings will be distributed under the terms you create when it is drafted. Because life happens and your beneficiaries may change due to many factors, updating your documents after major milestones is crucial. If you’re unsure of the benefits when building a legal trust, check out some of the most critical reasons it is necessary.

WHAT IS A TRUST?

A trust is an agreement between a grantor, the person who assigns control of an asset, and a beneficiary who receives the benefits upon death. The policy is managed by a trustee who ensures the policy is handled per your requests when it comes into effect. Typically, there are two different types of trusts related to estate planning. Here is

how they differ, as suggested by the Federal Deposit Insurance Corporation. • Revocable trust: This legal document can be revoked, terminated or changed at any time by the grantor. • Irrevocable trust: A grantor appoints beneficiaries to property or assets while giving up the power to cancel or modify the terms.

AVOID PROBATE

According to the American Bar Association, probate is the court-supervised legal procedure that determines the validity of your will. The legal action is necessary when appointing an executor to administer an estate and distribute assets to noted beneficiaries. A way to avoid this sometimeslengthy requirement is to create a living trust within your final wishes. While it may be an extra step during estate planning, completing this policy ensures your belongings are immediately handed to the person you chose as a representative upon death. It forgoes the need for your personal documents to be approved by the court and, in exchange, is handled in a private setting.

Avoid estate planning scams

Unscrupulous actors sometimes try to entice unaware victims into financially crippling scams. One of the most common types of scam deals relates to living trusts. Fortunately, by doing your research and ensuring you are entering a valuable contract, most scams are easy to see through and avoid. A living trust is a written legal document into which you place some or all of your assets. The belongings are managed by yourself or by someone whom you dedicate the responsibility to at the time of death or until a specific date. According to the Federal Deposit Insurance Corporation, you can choose from two types of trusts. A revocable trust is an adaptive deposit account managed by one or more people designated as a beneficiary who receives the assets upon an owner’s death. It can be revoked, terminated or changed at any time, at the discretion of the owner. An irrevocable trust is when the owner contributes deposits or properties to the trust but gives up power to cancel or change the account. When determining the right plan, keep

an eye out for common types of scams, as reported by the attorney general of Pennsylvania.

planning and something all adults must consider. It’s smart to purchase life insurance at a relatively young age because the cost can be lower. Some people put off the process because it can be overwhelming. But Forbes magazine advises that once a person does a little research and learns the terminology associated with life insurance, choosing a policy is not so difficult.

DETERMINE THE AMOUNT OF INSURANCE YOU WILL NEED

Make a list of expected expenses after you pass away. These may include any residual mortgage payments, school tuitions, automotive payments, or funeral expenses. In addition, approximate how much your family will need to live comfortably in your absence. Online calculators can help determine life insurance coverage needs. The New York Life Insurance Company says a quick way to figure out how much coverage you may need is to take your annual salary and multiply it by eight.

DECIDE ON THE TYPE OF POLICY

Life insurance policies come in two broad categories: term and whole life. Term life insurance may be less expensive upfront, as it only provides coverage for a set number

of years. It will only pay out if the policy holder dies during this “term.” Whole life insurance, also called “cash value,” usually costs more, but accumulates a cash value that can be borrowed against, and it pays out whenever a person passes away.

CHOOSE AMONG REPUTABLE COMPANIES

You want to ensure the life insurance company you pick will be around for years and has a strong reputation, so give ample consideration to each company you explore before making a final decision.

KNOW THE WAITING PERIOD

Many policies establish a period of time on policies wherein there is very little cash-out value and the company will not pay out the full death benefit. This may be a year or two after opening the policy. Discuss this information with the insurance agent.

Fall is a favorite time of year for many people because the crisp weather motivates people of all ages to enjoy the great outdoors. Shop at a local farm stand

10 fun facts for fall

Whether one is collecting leaves, picking apples, exploring corn mazes, or driving the countryside enjoying the foliage, autumn is full of fun facts that can make the season that much more enjoyable. 1. Autumn begins on the autumnal equinox, which occurs on or near September 22 in the northern hemisphere. When the equinox occurs, there are an equal number of daylight and nighttime hours. 2. Since ancient times, autumn has been an important time of year for many civilizations. Autumn is a main harvesting time in many areas, and a successful harvest was once necessary for survival. 3. Fall is a time when trees and other plants prepare for dormancy during winter. As autumn progresses and the hours of daylight gradually decrease, trees begin to close down their food production systems and reduce the amount of chlorophyll in leaves. Chlorophyll is the chemical that makes tree leaves green, and as it declines, leaves change color. 4. Some scientists believe that global climate change can impact autumn colors, such as delaying the change in trees. Also, red pigments may start to decline as trees use sugary fuel to grow new twigs.

5. Americans more readily refer to this time of year as “fall,” while the British use “autumn.” Both terms date back to around the 16th century. 6. Much of the United States bids farewell to monarch butterflies in the fall. Each autumn, monarch butterflies migrate from the United States to Mexico and some parts of Southern California. 7. A study of U.S. centenarians born between 1880 to 1895 published in the Journal of Aging Research, found that babies born during autumn months are more likely to live to age 100 than those born during the rest of the year. 8. Squash, pumpkins and other gourds are prominent in the fall. The largest squash grown on record weighed in at 1,486.6 pounds in 2011. 9. The many-colored leaves are not the only display one might see during the fall. The autumn equinox signals the aurora borealis, also called the Northern Lights. That’s because, during the fall, geomagnetic storms are about twice as frequent as the annual average. 10. Full moons are named for the month or season in which they rise. The Harvest Moon is the full moon closest to the autumnal equinox.

Recycle old clothes to dress your scarecrow

Clothing that is not worthy of donation can be transformed into a festive scarecrow just in time for Halloween hijinks. Fill out the body of the scarecrow with newspaper and then add some pieces of straw around the neck, hands and feet.

Host a football party

Watch the game on television or have a pickup game in the yard. Serve finger foods to cut down on the need for plastic or paper plates and flatware. Purchase a keg of beer from a local brewery to eliminate individual beer cans and bottles. Set out a punch bowl that the kids can enjoy too.
