After much media speculation that there would be a new Minister for the Department of Health at the last Cabinet reshuffle, Jeremy Hunt emerged with a new title of Secretary of State for Health & Social Care. As an Association that has long championed the need for change within health and social care, we welcome this latest development and will continue to promote the key role our members play in providing best value, innovation, quality and support.

Personal Health Budgets have been established and deemed successful across a range of areas and will continue to roll out further. Personal Wheelchair Budget (PWB) pilots have shown that there are lessons to be learned by NHSE and suppliers.

This is exactly why the BHTA created and continues to champion the Healthcare and Assistive Technology Society (HATS) to raise the profile of those without professional qualification who deal directly with those who need our services. With nearly 800 individual members, the BHTA Board and Council recently reaffirmed their commitment to supporting HATS as it works to achieve Accredited Register status with the Professional Standards Authority.

Through our development of a PWB working group, our engagement with NHSE at Director level and our participation and presentations at NHSE workshops, stakeholder meetings and representation on the National Wheelchair Alliance, the BHTA is making sure that our members are rightly seen as key to future success. BREXIT: Deal or no deal? And naturally, any agreement must respect the regulatory autonomy of the EU, as well as the integrity of its legal order.” It is hard, therefore, to see what academic models of negotiation describe as the ‘Scope for Potential Agreement’ and this means that there may be ‘no deal’ at all.

Scottish celebrations at Holyrood The BHTA Scotland Centenary Holyrood Reception brought a special year of events to a successful conclusion. Aileen Campbell MSP, the Scottish Government’s Minister for Public Health made her own bit of BHTA history by becoming the first Scottish Government minister to formally address a BHTA Scotland event. Also present were the Care Inspectorate, Trading Standards Scotland, NHS Scotland Procurement, Scotland Excel, the Scottish Stoma Forum Reference Group and Community Pharmacy Scotland. Several member companies exhibited their products and services in the magnificent setting of the Scottish Parliament’s Garden Lobby. Visitors included Kevin Stewart MSP, the Minister for Local Government & Planning and Maureen Watt MSP, the Minister for Mental Health. Alex Cole-Hamilton MSP, the Scottish Liberal Democrat Health spokesperson, sponsored the event. He highlighted the important role members play in the delivery of Scotland’s health and care sectors and made particular mention of the problems of incontinence and his call for a National Incontinence Strategy. Alastair Maxwell told the assembled guests that BHTA Scotland appreciates the demographic and financial

challenges the health and care sectors face. He encouraged the Scottish Government to pursue a Healthcare and Assistive Technology Sector Strategy which would grow our sector in Scotland, encourage innovation, give Scotland’s patients access to the most appropriate products and support entrepreneurship in this industry. Aileen Campbell MSP responded positively and following the event Health department officials have signalled interest in early discussions with the Association. The feedback from MSPs has been very positive and some have already followed up on initial conversations, organising constituency visits and tabling Parliamentary Questions.

Lifetime Achievement Award Kenneth Munro was re-presented with his Lifetime Achievement Award and the Centenary Paperweight by BHTA Chairman, Alastair Maxwell. Kenneth joined his family business, W Munro (Rehab) Limited, thirty years ago, but his interest in the rehab business began when he was doing summer work whilst at University. He was Chairman of the West of Scotland Branch of the Chartered Institute of Marketing (CIM) from 1994 to 1996 and was awarded the CIM’s President’s Award in 1999. He served as a Director of Glasgow Chambers of Commerce from 1996 to 1999. Kenneth became a Fellow of CIM in 2005 and a Chartered Member of the Institute of Occupational Safety and Health (IOSH) in 2010. He used his rehabilitation expertise as a Non-Executive Director of the Revive Scotland MS group, a charity that provides vital therapy, advice and support to people affected by Multiple Sclerosis (MS) in communities across the West of Scotland. Kenneth was awarded an MSc in Occupational Safety and Health in 2017.

It’s all about marketing as members share ideas and experiences The BHTA and DLF jointly hosted an all members marketing meeting in January. With marketing professionals often working in isolation and often in small departments, it was thought that a networking/ workshop style meeting could encourage members to engage more with the BHTA, DLF and each other and it proved to be a success. Almost 40 people from 30 member companies attended. The agenda was broad but it was clear following group discussions and feedback what the hot topics are, and this will help in the planning of future meetings. Andrew Gubbins from CAS marketing presented on PR, and Calvin Barnett, THIIS Magazine Editor, shared his knowledge about writing effective editorial and what editors look for.

Sally Edgington Research & Support Lead at BHTA said: “It was the first time BHTA had tried something like this and I was extremely pleased with the engagement, the interest and the feedback since.” Janet Seward Partnership, Business Development & Fundraising at the DLF added: “The DLF team were delighted to collaborate with BHTA on the launch of the marketing forum. It was a great first event and we thought there was a clear appetite for sharing ideas and experiences amongst this key peer group.” Members overwhelming agreed that the marketing meetings should continue and the next date is planned for July. BHTA steptember raises funds for Scope The BHTA Stairlifts and access section participated in BHTAsteptember, with each of the 120 participants walking 10,000 steps a day during the month - a total of 300,000 steps. That’s a combined total of over 36 million steps! As a result, a cheque for over £3600 was presented to representatives of Scope during the BHTA Awards Dinner in London. Sally Edgington, who organised BHTAsteptember said: “I am delighted with the final total which far exceeded the target and I am excited to see what can be raised in 2018 when the event is rolled out across all BHTA sections.” Craig Will from Scope said “Not only did BHTA members commit to a challenging task, walking 10,000 steps a day , but raising over £3600 too is incredible. We cannot thank everyone enough for all their support, time and effort over the last few months. It means we can be there for even more disabled people and their families in desperate need of our support.”

Disabled Children Partnership Launch 5 Step Plan The BHTA children’s equipment section has secured a place as an official supporter of the Disabled Children’s Partnership Campaign. The Disabled Children’s Partnership is a major coalition of over 50 organisations campaigning for improved health and social care for disabled children, young people and their families. The DCP recently launched a 5 step plan campaign manifesto at the House

of Commons attended by supporters, families and MP’s including Vince Cable and Tracey Brabin and Lord Chris Rennard. The manifesto references the BHTA paper ‘Failing Disabled Children Across the UK’, and the work of the campaign ties in with that already done by the children’s equipment section over the last few years.

Celebrating 45 years Harrogate-based Yorkshire Care Equipment celebrated 45 years in business in December 2017, with the family-run company growing substantially in that time. Starting life in Headingley, Leeds in 1972, the Hulbert family took over Yorkshire Care Equipment in 1995. Led by Duncan Hulbert and his two sons, Gordon and John, the company grew until it moved to Harrogate.

New dealer programme from Stiltz Lifts Stiltz Lifts has introduced a new three-tier programme for dealers. The Discount Rate – A Year of Change By David Widdick, Business Development Manager On 27th February 2017, Lord Chancellor Elizabeth Truss announced a new Ogden Discount Rate of -0.75% for personal injury awards. This new rate came into effect on 20th March 2017 and was met with enthusiasm by personal injury victims and advocates, but with sharp criticism by Insurers. In personal injury cases, the courts and insurance providers use a “discount rate” to determine the present value of the compensation that needs to be paid to an injured individual. In practice, discount rates are set to reflect small and conservative investment gains that accrue over long and low-risk investments. For example, a claimant entitled to a £1,000,000 with a 2.5% discount rate would receive a £975,000 sum because they are expected to be able to earn 2.5% interest a year on the sum. This change is drastic because it effectively requires any party paying a claim to increase – rather than discount – the sum that is provided to the claimant. The decision led to widespread criticism from the insurance industry, due to the immediate impact on claims costs and uncertainty around future insurance premiums and rates. As a result of this, in September, the government proposed new legislation, which would amend the Ogden Discount Rate again, with the new rate likely to be somewhere between 0% and 1% discount. The new measures announced by the Lord Chancellor still have to be approved by Parliament. The indications are that this change will not take place until the 3rd quarter of 2018, but this yet to be confirmed. For now the rate remains at -0.75%. This has had the effect of quite substantial increases to the level of the payment insurers have to make in order to settle their policyholder’s liabilities for injury, loss of earnings and cost of care. Since the announcement all insurers have been reviewing the level of reserve they have to hold against each relevant claim and we are now starting to see the effects and scale of the new settlement levels. Here are some recent examples that we are aware of:

Employers’ Liability claim from an employee injured at work: This involves a young man who as a result of an incident at

work was left with Tetraplegia (loss of use of all four limbs). He will require care and reimbursement of lost earnings for the remainder of his life, along with compensation for his pain & suffering. As a result of the changes to the Ogden Discount Rate the reserve for this claim moved from £8M to £16M.

Public Liability claim from a third party: This involved a 47 year old man who sustained a brain injury as a result of an incident when he visited a business premises. Following the rate change the reserve has now been reviewed and increased from £4M to £6.6M. A review of your Limits of Indemnity under Employers’ Liability and Public Liability policies should therefore be considered. With the potential claim for a single person now exceeding £10M, consideration should be made to increasing cover to a minimum of £20M. Higher limits may be required in many circumstances, for example where there is a congregation of people – remember a claim refers to the incident that causes the injury, multiple injured parties can still be considered as a single claim. Motor Insurance policies generally do not have a limit for Third Party injury claims so for the most part there is no review needed here. In view of the recent change in circumstances you may want to consider an immediate review, in which case your Account Director will be pleased to assist you. The costs of purchasing higher limits of cover can be surprisingly low. We will be reviewing cover options with you as normal at renewal, but we felt the need to draw your attention to the increased exposure straight away. Trade Days does the business In October last year, Trade Days, the only trade-only show for our industry in Europe, took place for the fourth year After the event, Show Director Matthew Butler told us: “It has been a really good show. You can definitely feel there has been a buzz and excitement in the air which is exactly what we wanted. We know that there are still improvements that can be made and changes do not happen overnight, but I really feel that this show has proven that we have learned from previous years and have made the right moves.” Launched in 2014, Trade Days remains the industry’s sole exhibition dedicated to the mobility and independent living trade, setting itself apart by offering manufacturers, retailers and distributors a space where they could talk business. Last year’s show introduced a number of new features, including catering for attendees, a dedicated arena for practical advice and even a magician. Matthew added: “I think a big tick is the ‘how-to’ arena. In the past, the seminars have often been quite theoretical and very similar to what you find at other exhibitions. This year, the content has really been focused on practical advice that attendees can implement. That change in focus is subtle but important and the reception has been positive.” The 2018 show takes place on Sunday October 7th and Monday October 8th at the NEC.
