Why Won’t Our Home Sell?

Our home is for sale through a local broker. The newspaper reports that nearly 500 homes were sold in our community in a recent month – but not ours. Our property has only been shown four times. We think the market here is improving and we live in a desirable neighborhood, so how come our house has not sold?

Answer:

Without exception, every piece of real estate is unique. There are no two homes that are exactly alike. This reality greatly impacts the marketing process. Imagine that you have two homes. Each is from the same builder and each is

the same model with the same features. They are on the same block. One will sell before the other, and the precise details of each sale will be different. Why? Because they occupy different space. Not only is there a unique quality to real estate, there is also a unique quality to buyers. Each is different. Each one has distinct personal preferences and a unique financial situation. Combine the unique nature of each piece of real estate with the unique nature of every buyer and the result is that all transactions are different – when there is a transaction. You can see this with any block that has two homes for sale. Because each home is somehow distinctive, sellers and their brokers will want to reach the largest possible pool of purchasers to find that one buyer needed to create a transaction. But even with great marketing, exposure cannot guarantee a faster home sale or more money. What marketing can

do is improve the chances of success. It can be hugely frustrating to have a home that does not sell while other properties move quickly. The best

step is to sit down with the broker, review the marketing plan and see if anything should be changed. Also, ask if there’s any way your property can be made more

Use inspections, objections, in good faith In paragraph Ten of the Colorado Contract to Buy and Sell Residential Real Estate, the buyer has the right to perform any inspection they would like at their own expense, and, at their sole and objective discretion, make an objection to the seller, or terminate the contract. The objection or termination must be done in writing and by the objection deadline agreed to in the contract. If the buyer presents an inspection objection, the buyer and seller must then come to a resolution by the inspection resolution deadline they agreed to in the contract. The objection is generally for repair items or health and safety related concerns. The buyer can ask the seller to actually make the repair, give a credit towards closing cost in lieu of actually making the repair, or write a check at closing to a third party vendor for the repair to be made. If the buyer intends to get a loan, the lender may require that the repair be made prior to closing. By Federal guidelines, the seller cannot legally write a check to the buyer at closing if the buyer is obtaining a loan to buy the home.

The seller is not obligated to make any repairs or credits, but the buyer can terminate the contract and receive their earnest money back, assuming they have acted within the contract date deadlines. In this faster paced market with multiple offers, and often with offers made quickly without a lot of thought some buyers are using the inspection clause to renegotiate the contract. They made their original offer in the heat of the negotiations for higher than list price or for more favorable terms with the full intention that they would renegotiate at the inspection. This can be extremely frustrating to the seller and ultimately the buyer can potentially lose the house if the seller has a backup contract. The degree to which there are negotiations on the

inspection notice depends a lot on the overall transaction. If the buyer negotiated hard and got a good price on the house, or if they were the winning bid above other bidders, they may be less inclined to ask for anything on the inspection. They certainly can do inspections to make sure there isn’t anything unexpected, but by and large they will make only minor objections if any. If the buyer feels that they have paid top dollar for the home they may have an expectation that they should have inspection items addressed and paid for by the seller. We are in an appreciating market and in some cases it is hard to tell if the price paid is top dollar or actually current market value. Due to their circumstances, some sellers will want to sell their home “as is”. It might be that they are out of town or moving shortly and they do not have the time, money, or inclination to get any work done. They priced the home with this in mind, put an “as is” clause in the contract, and then the buyer brings a list of handyman things through the inspection notice. This is very frus-

trating for the seller. It feels like the buyer is negotiating in bad faith. Particularly if the items that they are asking to be repaired are items that were obvious through a showing or disclosed in the seller property disclosure. No home is perfect and there are some repairs and changes that you will need to make once you own the home. Even with a brand new home there will be expenses in landscaping, sprinklers, window treatments, fencing, etc. You should expect that in a re-sale home there will also be expenses when you move in. If the buyers present an inspection notice and the seller does not respond within the contract deadlines, the contract automatically terminates 24 hours after the inspection resolution deadline. If the buyer is willing to take the home even without the repairs they asked for in the inspection notice, the buyer must withdraw their inspection notice in writing within that 24 hour period to keep the contract alive. Deferred maintenance can lower your return on investment, as can failure to raise rent prices, says Lauren Klein, a certified financial planner in Newport Beach, Calif. To avoid this, Klein says rents should be raised every single year. Property Taxes “If a client is struggling to financially pay their taxes, chances are they have too big of a home,” says Rob O’Dell of Wheaton Wealth Partners, Wheaton, Ill. In this

case, downsizing your home may be advisable. Also, homeowners in Florida may now qualify for a homestead exemption by making a home their permanent residence. Owners can deduct up to $50,000 from their property taxes under this new rule. In California, Proposition 13 limits property tax increases each year. Homeowners over the age of 55 may transfer – once in a lifetime – the old property tax basis to a new home of equal or lesser value. In addition, there are exemptions for veterans, those with disabilities and people over 65 in many states that can help to reduce housing

taxes. Educating yourself on your state’s tax laws will allow you to capitalize on all your qualified exemptions. Look to your local tax office for help in learning your state’s requirements to get correct valuations and exemptions, Diesslin says. Paying Your Mortgage When it comes to financing your home, cash flow should be the goal, Klein says. For many people, that means not paying off the entire mortgage. Don Grant, senior investment management specialist at Morgan Stanley Wealth Management says 85 percent of his clients in Wichita, Kan., prefer to be mortgage-

free because they fail to see the bottom line: They may be better off financially if they don’t pay off the loan. Klein often recommends that clients downsize their residence if paying off their home is a major concern. Homeowners can benefit from refinancing at historically low rates instead of using assets to pay off their home. Plus, this often frees up cash flow that can be applied to other areas, such as retirement savings, O’Dell says. Getting a Head Start It’s tougher to finance property once you’ve retired, Grant says. If loan rates have improved, consider refinancing your house before

you retire. Someone who is still in the workforce will show income that has the potential to increase, which will encourage lenders to give you the loan you need, Grant says. Experts agree that it’s best to begin planning your real estate management before you buy. “With income real estate, rentals, et cetera, a disposition and debt plan should be established well before the closing on the property,” Grant says. “Go into the purchase with a good idea of what conditions need to be met to sell the property.” © CTW Features
