Advice for buyers bidding on a home with multiple offers By Brendon DeSimone, Real Estate blogger for Zillow n case you missed the news, markets are starting to pick up, which means more home buyers are likely to get off the sidelines. But, given the lack of good inventory in many real estate markets, there are more buyers than properties. The result? Multiple offers are making a comeback.

The days of bidding wars, with several offers over the asking price, are probably gone in most markets. But buyers in certain markets are likely to see competing offers under the listing price. Here are three strategies for buyers to follow when the

home they want has received other offers: 1. Don’t over-analyze the other offers or the listing agent After multiple property viewings and interacting with the seller’s agent, the agent tells you there’s another offer on the property. Your reaction: “Really? Are you kidding me?� Take the listing agent’s word for it, but only use that as one data point. Don’t spend too much energy trying to figure out what’s really going on with the other offers. If you love the property, keep moving forward, but at your own pace. Make the offer you’re comfortable with, and only when you’re comfortable making it. Don’t feel

pressured to make an offer in order to compete, especially if you’re not ready to put in a bid. 2. Focus on your negotiations with the seller Sometimes, the listing agent will say that the other offer is a better price, has a larger down payment or a quicker close. Who cares? The seller will still be looking at and working with your offer when considering their circumstances. For all you know, the other offer may be a horrible “low ball� offer or from a buyer who isn’t preapproved for a loan or from an out-of-area agent who is unfamiliar with local customs and protocols. Or the buyer may have made the offer after only seeing the property

and length of escrow? If you love a home and want to make an offer, start by making yourself known to the listing agent or the seller. Visit the property on multiple occasions. Show your face to the listing agent as much as possible. If the property is on lock box, it’s OK to go back at various times of day and in the evening. You’ll get different perspectives on the home, and the sellers will surely notice your interest. Consider writing a note of introduction to the seller with your offer or ask that your agent do so. here are some basic questions to ask yourself when you are considering whether or not to utilize the services of a Realtor when purchasing a new home from a builder or building a custom home. First, it is important to make the distinction between a real estate agent and a Realtor. Realtors are members of the National Association of Realtors and their local Board of Realtors and agree to act under and adhere to a strict Code of Ethics. A professional Realtor is educated, trained, and experienced in the field of real estate. An experienced Realtor can make the difference in your transaction in a number of ways. Realtors have access to vital current information on issues and information directly related to real estate and private property rights. Additionally, local experienced Realtors know the area, may know the history of a development, and an experienced agent will probably have had other transactions with multiple builders and architects in the local market. The first group of questions to ask yourself is regarding the sale of your present home if you have one. The answers to these questions are unique to each situation. Since Realtors deal with these issues on a daily basis, their experience and expertise can be invaluable.

1. Do you need to sell your existing home first? Typically, it is difficult to time the sale of your existing home to coincide with the finish date of the new home. But sometimes there are other options. For example: It may be possible to sell your home and rent it back from the new owner until your new home is ready. In the current market conditions, this may not be a viable option because inventory of homes is low, demand is high, and buyers generally want to move right in upon closing. But it might be worth asking. Typically, unless you are very fortunate, a double move is in order. 2. Are you familiar with the market in your area? Do you know how to price your home? Do you know how to attract a buyer? Where do you advertise? How do you let other agents know that your home is available for sale? 3. What do you do when you have an interested buyer? Seven things every lease agreement should include By Kelly Zinser, real estate broker and blogger for Zillow.com ongratulations on buying your first investment property. Smart investors know the best way to safeguard their investment from potential tenant trouble is to craft a solid lease agreement that includes these key things:

1. The basic clauses. Every lease agreement must list the parties to the agreement, which would be you and the tenant, along with the property’s address. You also want to state the term of the lease, which could be month-tomonth starting on the first with a particular end date or an automatically-continuing lease that remains in full force and effect. 2. Security deposit clause. Your lease should require the tenant to put up a security deposit that matches one month’s rent or more, depending on the value of furnishings and repair costs if something goes wrong. Some states require you to place the tenant’s security deposit in a separate interestbearing account and, at the end of the lease, you must give the deposit plus interest to the tenant, less any damages. Make sure to check with your state and judicial regulations and, to save time and money over the long term, check with your real estate attorney to make sure your lease follows the law. Security deposits can be a problem if not handled correctly. 3. Maintaining the premises. The lease should tell the tenant that he is required to maintain the premises, abide by noise control rules and not change the locks without your written approval. You

will want to itemize the appliances and furniture that are part of the lease, and note their condition and any other special considerations. Don’t expect a tenant to follow oral requests, such as not parking in the driveway. All requirements must be spelled out in the lease. Also note whether the tenant or landlord will be responsible for utilities. Take the time to clearly write out the details of your agreement. 4. Warning of concealed defect. In some jurisdictions you have a duty to warn of a concealed defect known to you, or a defect that it is reasonable for you to know about. If you know the deck is crumbling and you fail to warn your tenant, then you may find yourself explaining the situation to a judge.

Better to disclose the known defect in the lease and, best of all, fix it before the tenant moves in. 5. Subleasing clause. At some point, most landlords have a tenant who wants to sublet the apartment to a friend or stranger. To avoid trouble make sure your lease includes a subletting clause that requires the tenant to obtain your written permission before turning the property over to someone else. When the tenant asks to sublet the property, you will be in a position to decline or accept their offer. But heed this caveat: If you want to agree to having the new tenant move in, then it’s best to end the original tenant’s lease and start the process from scratch with the new tenant. You should go through

the entire background check with the new tenant, including a new security deposit and lease. Do not get stuck trying to enforce your original lease against a new tenant who was not a party to the original lease. That situation is a risk you cannot afford.

After the tenant leaves. Would you ever hold a tenant’s personal property for unpaid rent? Other jurisdictions consider the property abandoned and allow the landlord to dispose of the items. Most states require a landlord to hold the tenant’s property for a short period of time and give notice to the tenant, and some allow the landlord to claim a storage fee for the hassle. The key is
