Slow Down! You’re Reading Too Fast Many borrowers don’t understand basic mortgage terms. Experts offer tips to better comprehend loan requirements Who hasn’t rushed through documents dense with legalese, like the consent forms required by many websites? Sometimes it may be no big deal to skim and click “I Accept.” But if there’s one lesson from the mortgage mess that’s affected millions of homeowners, it’s that you’d better understand the terms before signing for a mortgage, says Jessica Choplin, associate professor of psychology at DePaul University, Chicago. For the past three years, Choplin and her colleagues have been studying how well consumers comprehend existing mortgage forms and proposed new ones. All the forms tested were for “adjustable rate mortgages,” whereby the interest rate can rise under certain conditions. Many consumers were unable to remember any key features disclosed in any of the documents, like whether there’s a “prepayment penalty” for paying off the loan early, or what the annual percentage rate is. “People are often just oblivious,” she says. To better comprehend a mortgage,
Choplin offers these tips: Read the documents slowly; try to avoid distractions; and take the loan documents to a trusted financial adviser. Borrowers should receive terms for their loan in a “Good Faith Estimate,” which must be provided within three days of making a mortgage application, says Jack Guttentag, who runs the website Mtgprofessor.com. Unfortunately, “Many people may not have access to an adviser,” says Ira Rheingold, executive director of the National Association of Consumer Advocates. Fortunately, most lenders have become more conservative, only making mortgages to those who can afford them, he says. “But especially if you’re a first-time buyer or getting an adjustable rate mortgage, it would make sense to have a counselor” to help understand loan terms, Rheingold adds. Non-profit housing counseling agencies providing free advice are listed at www.hud.gov, but counselors are often busy. How to choose a neighborhood When purchasing a home you are also buying a neighborhood. So it makes sense to evaluate the neighborhood as a part of the home purchase package. The factors that are most important to you will vary depending on your needs, life style, and tastes. Most people consider the quality of the schools, property values, traffic, crime rate, future area construction, and proximity to employment, parks, bike trails, schools, hospitals, shopping, grocery, public transportation, and entertainment as important components of home buying. Even if you do not have school age children, the quality of the neighborhood school can play into the resale value and marketing time for your home in the future. If the home or condo is smaller and unlikely to attract a family with kids it may be less of an issue. What is happening with property values in the neighborhood? Is there evidence that people are improving their homes by re-landscaping, adding on, or remodeling? Do the homes look well kept? What have the recent sales been in the area? Are there a lot of

rentals in the area? Is there a lot of “for sale” signs in the area? Is there a reason for this? Is there new construction in the area? When will it be completed? Will the traffic and noise associated with the construction impact you? If so, for how long? Buyers should find the home that best meets their primary needs in the best neighborhood within their price range. Look for neighborhoods that are likely to become “hot” in the future. These neighborhoods are often on the periphery of existing popular neighborhoods. Ask your Realtor what areas are experiencing multiple offers, short marketing times or perhaps seeing increases in sales prices. This might be a tip off as to the desirability of the area. It might be that you need to look at a good neighborhood a bit farther out in order to be in
an affordable price range. Evaluate the costs of transportation (and time) to be sure that this will truly be more affordable. A smaller house, condo, or townhome might be a better choice to meet your overall housing needs and stay within budget. Visit the neighborhood at different times of the day, weekends, and week days to get an idea of any neighborhood dynamics that you might want to be aware of. Does that traffic increase through the neighborhood? Are there lots of kids or no kids playing outside? Does there seem to be a lot of neighbors out walking around the area or working on their yards and homes? You might want to talk to some of the neighbors to get their perspective on the area. It might even pay to knock on some doors if no one is out. What are you lacking in your current neighborhood that you would like to see in your future neighborhood? Do you want to be within walking distance of a coffee shop or book store? Do you want to be close to a park for your dog or kids? Do you want a more kid friendly neighbor-
hood? Are you trying to avoid kids or an area that would likely be noisy at night or on weekends? We are quite lucky in the Fort Collins/Loveland area to have tremendous access to extensive bike trails, recreation facilities, parks, hiking trails, and open spaces. If the proximity of these amenities is important to you check bike trail and parks maps. There may be more neighborhood areas for you to consider than you realize. Transportation can be a major factor in a home purchase. While we do not have extensive public transportation, families that have a spouse commuting to Denver, Longmont, Boulder, Greeley, or Cheyenne would likely want to minimize that commute by being close to the highway. We are seeing more and more people choosing to bike to work so access to bike trails or bike lanes is important. If you are going to the internet to gather information about an area, I would advise against putting much stock in national websites for smaller areas such as ours. While those websites might be more accurate for larger metropolitan areas they
often get it wrong for less populated areas like ours. The metrics they use don’t seem to translate well with the smaller pools of data that they gather locally. Review Your Own Foreclosure Question: I received a whopping $300 as part of the “foreclosure review” settlement between mortgage services and the federal government. It got me wondering if there was something wrong about our foreclosure. We have all our paperwork. We had to fax it at least a dozen times because they “didn’t receive it all” and “the fax went to one office but the people we talk to are in another” and so many other boondoggles. to see what happens, or do we assume a more proactive role and try to make something happen? Answer: Hold onto your paper-
work. And yes, be proactive. The foreclosure review process has been a huge mess. To be clear, foreclosure review stems from an agreement between major mortgage services and the federal government – it is not an agreement between mortgage servicers and borrowers who may have been wronged. It only covers foreclosure activity during 2010 and 2011 and not other periods. As the Office of the Comptroller of the Currency explains, “borrowers will not be
required to execute a waiver of any legal claims they may have against their servicer as a condition for receiving payment.” An expansive report by the Government Accountability Office released June 2012 found an astonishing number and variety of problems with foreclosure reviews. The report states that there were “severe deficiencies in three primary areas: shortcomings in the preparation of foreclosure documentation; inadequate policies, staffing, or oversight of
foreclosure processes; and insufficient oversight of third-party service providers, particularly foreclosure attorneys.” Please contact your state attorney general. Virtually all state AGs have been trying to unravel the foreclosure mess. They may have programs in place to help you now. They also may benefit from your paperwork and story.
