Short Sale Negotiation Question: We're interested in buying a local short sale because of the possible discounts. We know that we must reach an agreement with the owner and that the deal must be approved by the lender. Does the broker representing the seller negotiate with the lender to get the best deal?

Answer: It is possible that the answer to your question is no, the broker cannot negotiate with the lender. However, this issue currently is in transition and may depend on where

you live. Let me explain: In a short sale, we have an owner who wants to sell, but the market value of the property is less than the outstand-

ing mortgage balance. One solution to this problem would be for the owner to pay any shortage with cash at closing. However, most owners do not have such money and therefore must ask the lender to approve the sale. The lender, in reality, is being asked to accept a loss on the loan. Because of the recent economic downturn, there has been an emergence of scammers who claim they can negotiate with lenders to stop foreclosures and get the best possible deal for short sellers, if only the owners will pay a

fee up front. There are numerous cases of owners not receiving promised services – so many that in 2010, the Federal Trade Commission announced the Mortgage Assistance Relief Services (MARS) rule. It bans false claims and up-front charges are generally prohibited, except for attorneys. The FTC made another exception: In 2011 it said it would not enforce some parts of the MARS rule with real estate brokers. But what about state regulators? In Maryland, as an example, real estate brokers

are not allowed to negotiate with lenders unless they also comply with the state MARS rule. The bottom line is this: Brokers can readily help short sale buyers and sellers and they can transmit offers to lenders. However, negotiations with lenders may be restricted to attorneys and licensed mortgage assistance relief providers. billion set in 2005. New construction continues to increase, with sales up 42% in September, and 28.9% for the year to date. The only drag is that new home construction remains far behind the pace of ten years ago when sales were around 25% of the total, compared to 13% this year. There were a total of 1,267 active listings at the end of September, but 360 were under contract, and 138 were shown as ‘to be built’ or ‘under construction’, so the net supply was 769 homes. This compares to 764 at the end of August. The demand over the next six months will be slower, in the range of 1,600 to 1,700 homes, so the current supply is equal to a about a three month supply, less than half of what is needed for a balanced market. The days on market for September sales certainly tells the story of the demand. The resale homes that closed in September were on the

market an average of 30 days prior to going under contract and a total of 60 days to close. This compares to 55 days and 91 days for the year to date and a ‘normal’ 100 days and 139 days last year. All told, it was another record setting month on the road to a record setting year. As we enter a period of lower demand with a little better supply of homes, slowing price increases, and lower mortgage interest rates, this is a good time to get out there and buy that home. PREPARING A HOME FOR SALE CAN BE STRESSFUL, BUT BROKERS SAY THESE TOP TIPS WILL SMOOTH THE WAY FOR A QUICK TURNAROUND

Selling a home can be disruptive. Homeowners must walk a fine line between living comfortably in their own homes and making them as appealing as possible for potential buyers. Agents agree, the more amenable owners can be at the start of the process, the faster the home will sell – if priced correctly. There are numerous tips on how to make a home stand out from the crowd – keep kitchen counters clear of all clutter, wash windows and screens to amp up the amount of natural light in the room – but most real estate agents say the best advice is to stand clear, and allow access. “Without getting people in the door, we can’t get offers,” says Samer Kuraishi, senior vice president of A-K Real Estate Inc., Germantown, M.D. Kuraishi, a listing agent with 127 current listings, says buyers are most eager to see properties during the first two weeks of market time. Access is crucial. Even more important is following the rules that most real estate agents give their clients at the time they take the listing. Here are their top suggestions:

• Lighting: Switch to brighter light bulbs and turn all lights on during showing. Replace heavy drapes with sheer panels to allow natural light inside. • Cleanliness: Remove all odors so the home can smell neutral – don’t forget to clean the kitty litter and remove dog odors. • Declutter: Remove excess furniture. Buyers want to see the floors and visualize their furniture in the space. Sellers could benefit by getting a head start on moving: That means removing out-of-season clothing and packing it away, preferably off-site to make closets look bigger. • Bathroom Care: Make the bathrooms feel like a trip to the spa. Add a new shower curtain, new towels, specialty soaps. Hide your everyday toiletry items like toothbrushes and washcloths. • Home Improvement: Hardwood floors should gleam. If necessary, have them refinished before putting your property on the market. Anything that is not in tip-top shape should be repaired, unless you’re willing to give repair credit at closing. Replace torn screens, oil squeaky doors and replace broken closet doors. This will attract a higher price and streamline negotiation. • Etiquette: Leave the house at least 15 minutes before showings. A market snapshot taken on 10/3/13 shows a remarkable lack of inventory of single family homes for sale in Old Town priced under $400,000. Anne Marie Schachte There were seven & Emily Heinz FOR REAL ESTATE WEEKLY active homes for sale priced under $300,000 and four active homes for sale priced in the range of $300,000 to $400,000. We typically see a greater number of homes in these price ranges at this time of year. Sixteen homes above $400,000 are currently active on the market. There is always a greater pool of buyers in the lower price ranges than in the upper ranges, and those lower price ranges tend to sell rather quickly, and still do. There has been a decrease in showing activity this past month. Open houses are very well attended, typically by 12 to 16 groups of people, but scheduled Realtor showings are somewhat lower. This reflects back to the relatively lack of lower priced inventory. Usually the fall market in Old Town is very active so we hope to see a strong finish to the year!
