Short Sale Negotiation Question: We’re interested in buying a local short sale because of the possible discounts. We know that we must reach an agreement with the owner and that the deal must be approved by the lender. Does the broker representing the seller negotiate with the lender to get the best deal?

Answer: It is possible that the answer to your question is no, the broker cannot negotiate with the lender. However, this issue currently is in transition and may depend on where you live. Let me explain:
In a short sale, we have an owner who wants to sell, but the market value of the property is less than the outstanding mortgage balance. One solution to this problem
would be for the owner to pay any shortage with cash at closing. However, most owners do not have such money and therefore must ask the lender to approve the sale. The lender, in reality, is being asked to accept a loss on the loan. Because of the recent economic downturn, there has been an emergence of scammers who claim they can negotiate with lenders to stop foreclosures and get the best possible deal for short sellers, if only the owners will pay a fee up front. There are numerous cases of owners not receiving promised ser-
vices – so many that in 2010, the Federal Trade Commission announced the Mortgage Assistance Relief Services (MARS) rule. It bans false claims and up-front charges are generally prohibited, except for attorneys. The FTC made another exception: In 2011 it said it would not enforce some parts of the MARS rule with real estate brokers. But what about state regulators? In Maryland, as an example, real estate brokers are not allowed to negotiate with lenders unless they also comply with the state MARS rule.
The bottom line is this: Brokers can readily help short sale buyers and sellers and they can transmit offers to lenders. However, negotiations with lenders may be restricted to attorneys and licensed mortgage assistance relief providers.

So, while we are projecting a sales increase of 16% over last year and a volume increase of 22% we might still fall short of the 2004 record sales but do expect to improve on the record total volume by 6%. All told, a remarkable recovery from the last six years when sales averaged 8,400 homes with an average total volume of less than $2.0 billion. And as we have stated many times, these current sales are being recorded without the benefit of the construction activity that occurred ten years ago. In the five year period from 2001 to 2005 there were 15,662 new homes sold in this area representing 30% of all home sales. In the last five years new home sales have totaled
5,504 or 12.8% of sales. New home construction is improving with current sales of 1,233 homes up 20.4% from last year and now accounting for 14.6% of total sales. This is a nice improvement from a few years ago when new home sales bottomed out at 10% but it is still a long way from 30%. The total inventory of active listings is now 3,557 homes, down from 3,825 last month. Of these, 1,153 are under contract leaving a net of 2,404 homes for sale. This figure includes 513 new homes that are either under construction or ‘to be built’ so the standing inventory of homes available is 1,891 compared to 1,920 last month. Demand

Residential home sales in Northern Colorado (Larimer & Weld Counties) continued the upward trend as September sales totaled 893 homes, an increase of 14% from last year and the average selling price of $256,935 was up 2.4% from last year. The slower increase in selling prices is welcome news in a market that was getting super heated with price increases approaching double digits. For the year to date sales are up 18.6% from last year to a total of 8,422 and the average prices is now at $254,085, an increase of 7.5% from last year. The total volume of $2.14 billion is a 27% increase over last year. For the record, there was some erroneous information in our September 14, 2013 column when we reported previous record sales. The highest home sales on record occurred back in 2004 with 10,845 and the highest total volume of sales was in 2005 with $2.53 billion. The figures for this year to date have us on pace to close 10,750 sales with a dollar volume of perhaps $2.7 billion. This

Black and Latino Homeownership at Record Lows Recent housing recovery has not reached black and Latino families, who are less likely to own homes and more likely to face foreclosure Despite a general upswing in economic fortunes for many Americans in recent months, the economic rebound and housing recovery largely have left black and Latino households behind, according to a recent report from the National Association of Real Estate Brokers. NAREB’s report, “The State of Housing in Black America,” states that homeownership rates for black Americans have dropped from a high of just under 50 percent in 2004 to just above 43 per-
cent today. Home prices in general are on the rise, up 23 percent from the bottom in March 2012, according to RealtyTrac, a real estate data source. July data showed a 38 percent decrease of foreclosure filings year over year. However, the NAREB report shows that black Americans are still 70 percent more likely to have been foreclosed upon, even when controlling for income. And the private housing market has been “effectively closed” to people of color because of stricter credit score and down payment requirements. This negative impact was a result of “unregulated, high-cost and unsustainable
subprime loans during the bubble,” which the report’s authors say were targeted at black Americans and Latinos. Additionally, NAREB cites a lack of affordable rental homes in the U.S. as a significant problem for minority households. The report states, “While people of color will represent 7 of 10 new household formations in the coming decade, the national housing policy debate ignores economic challenges facing black and Hispanic Americans.” NAREB’s policy recommendations to combat the current situation include reforming the housing finance system to allow for afford-
able mortgage credit, ensuring an adequate supply of credit for rental housing is available and establishing a
