Sellers with FHA loans have a valuable marketing tool
Home sellers that have an FHA loan on their home have a unique financing tool that may be valuable to the buyer of their home. FHA loans are assumable at the rate and term existing on that loan. This is one of the few loan types that is assumable. The buyer would have to qualify for the loan just as they would for a new one, but they can take over the existing loan balance and interest rate on the loan. This might be very attractive to the buyer if they have a larger down payment to make up the difference between the loan balance and the agreed to purchase price. the mortgage insurance premium has gone up in recent years. By assuming the existing loan you get the benefit of the lower mortgage insurance rate. So even if the rate is higher it still might be a benefit to assume the existing loan instead of originating a new one. The buyer would need to qualify for the loan with the mortgage lender holding the loan. The lenders will qualify the buyer just as they would if you where originating a new loan. While FHA has minimum guidelines the lender’s own guidelines might be stricter.

Question: The real estate market in our area has improved and now we see a lot of cash offers. We would like to buy but cannot pay all cash. Are we at a disadvantage? Answer: Yes and no. Cash purchasers can have several advantages:
Their offers do not depend on lender approval, the seller does not have to pay any points and closing might be faster. The use of cash can create a quick and simple transaction. However, sometimes buyers who need mortgage financing can overcome the advantages
The buyer still needs to have good credit. While FHA guidelines accept credit scores as low as 500, most lenders have stricter guidelines and want to see a credit score of at least 640. They will calculate your debt to income ratio by adding up your monthly loan obligations, including credit card minimum payments, auto and student loan payments, child support and/or maintenance obligations, plus the house payment that you want to assume. They will compare this to your monthly income and come up with a ratio. They want this ratio to be 43% or less. Again individual lenders may have stricter guidelines. These loans are only assumable to owner occupied buyers. An appraisal on the home is not required. However, the buyer must have at least a 3.5% down payment. These
funds must be verifiable in the bank just as they would be if you were originating a new loan. Assuming the loan has been in place for a while and the home has gone up in value, the down payment amount could be substantially higher. If the buyer does not have the cash to bridge the gap between the loan balance and the agreed upon purchase price, the buyer might be able to get a 2nd loan from a local lender. Most lenders will require that the buyer have at least 10% down or more in order to qualify for the 2nd. The payments on this 2nd loan would also be used in the debt to income ratio. The fees to assume the loan are set by the individual banks, but they are likely to be substantially less than the cost to originate a new loan. Because the buyer is qualifying to assume the
loan, the seller is released from liability. This is an important point for the seller. There are other guidelines for older FHA loans originated prior to December 15, 1989, but those loan balances would be so low that it is unlikely that it would be practical to assume those loans. Sellers should let their agent know if they have an FHA loan in place as it could be an excellent marketing tool in the sale of their home. Fee Sotheby’s International Realty, Rye, N.Y., so it’s best to enlist the aid of a reputable home inspector who is experienced at spotting red flags and problem areas. “There can be defects in a house that aren’t immediately visible without a thorough inspection by a professional,” says Michael Watkins, real estate agent with Keller Williams, South Beach, Fla. “Signs like water marks in the ceiling and hairline cracks in the floor and walls should clue you in that more in-depth inspection by an expert is necessary.” Other red flags include slanted floors, foggy windows, cracks and water infiltration spots in the foundation or loose wires in the basement, Laporta says. “Those are all signs of
the foundation shifting and precursors to overall problems with the house in the long run.” Although new construction and energy efficiency standards are higher and building codes are more stringent than in years past, don’t assume that recently built homes are more structurally sound than older resale homes. Some properties may be updated to look modern and well appointed, but they could still have structural problems hidden underneath. “These days, nothing should be taken for granted. Even reputable contractors cut corners to bring the house in on budget,” Laporta says.
