Despite the obvious advantages, electrification has never really taken off on Britain’s railways. But this could be about to change – and not before time.

E

lectrification has long proved one of the best ways of running train services. From its first introduction on the railways more than 100 years ago, converting a line to electricity has invariably led to a reduction in operating costs, more reliable services and an increase in passengers. In Britain between the wars, for example, there was a massive rolling programme of electrification on what was then the Southern Railway which proved immensely successful in making the railways more popular. More recently, in the 1960s, there was such a rapid increase in passenger numbers when the West Coast Main Line was electrified that it was given a name: the ‘sparks effect’. Yet until recently there was no electrification programme on Britain’s railways which, at less than 40 per cent electrified, remain well below their counterparts on the Continent. The high initial cost was seen as an insuperable barrier, even though in the long term savings are made. Apart from the Heathrow Express service out of Paddington, and a few sections of infilling, there have been no new lines converted to electricity since privatisation in the mid1990s. Indeed, the 2007 White Paper on the 30-year strategy for the railways argued, remarkably, against further electrification on the grounds of cost, the likely development of fuel cell alternatives and problems with interference between electric trains and the signalling system. This was widely seen at the time as an excuse for not spending money, rather than a soundly based argument. Now all this has changed. There is a major programme of electrification on which work is just starting and Network Rail is hoping this will be expanded. The change in attitude came about three years ago when Lord Adonis, who was then the Labour Secretary of State for Transport and a great supporter of the railways, realised that electrification

was vital not only to improve the current network but also as a safeguard for the future of the railways, given that the cost of oil was likely to rise sharply in the medium term. As Network Rail’s plan for the future of the industry admits, there are widespread cost reductions: ‘The potential savings can be categorised as reductions in rolling stock operating costs (including fuel), infrastructure operating costs, increases in rolling stock availability rates, extensions to vehicle life and reduction in the capital costs of new vehicles.’ Although the railway is privatised, the initiation for any electrification scheme has to come from the Government as, ultimately, taxpayers foot the bill. Lord Adonis made a crucial decision just in time. When he was made aware that the commuter services out of Paddington would need new trains, he realised that this could be the trigger for a widespread electrification programme. Rather than buy new diesels, which are getting more expensive as fewer and fewer railways on the Continent are now using them, he decided that they should be electric trains, and consequently the lines in the Thames Valley would need to be electrified. That had a knock-on effect of making it worthwhile to electrify the Great Western Line right out to Bristol and Cardiff. With another large set of electric trains being displaced by the Thameslink modernisation due to be completed in 2017, electrifying a swathe of lines in the North West, including Manchester–Liverpool, became economic as the Thameslink trains could be transferred up there. This enabled Network Rail to begin setting up a programme of electrification. It is not easy. Electrifying sections of the railway is a more complicated business than it was in the days of British Rail when there were far fewer stakeholders. Now, there are train operators who, while benefitting in the long

run, may require compensating for disruption on the track, and there is also the issue of rolling stock, which again is a decision that has to be made by the Government. The two main concerns about electrification are the disruption that the work will cause and the cost. Peter Dearman, Network Rail’s head of electrification, is confident on both counts: ‘Most of the work can be carried out during existing routine possessions and we are working very hard to devise methods that will bring costs down,’ he says. Indeed, Network Rail is acquiring a high output train that will carry out the installation of up to 30 stanchions in a weekend possession, covering up to 2kms of track. Although much preparatory work is already being carried out, most of these schemes will not be completed until between late 2016 and 2018. But more are on the way. Already, in the Autumn Statement, George Osborne confirmed electrification of the crucial TransPennine line linking Manchester with Leeds and York, and in Scotland, Edinburgh–Glasgow is also a commitment. Dearman is convinced that more schemes will be given the go-ahead: ‘It really makes sense from every angle but the Government has to be the driving force behind it.’ The biggest scheme would see electrification of the Midland Main Line out of St Pancras, already electrified to Bedford, extended to Sheffield, greatly reducing travel times. Other possible candidates are the Cardiff Valleys commuter lines and the vital freight and commuter line around north London, between Gospel Oak and Barking. This will bring Dearman closer to his main ambition: ‘Ultimately, I would like to see my grandchildren travel on a railway like Switzerland, which is all electric’. It may be his great-grandchildren, given the wasted years of not recognising the advantages of electrification and the complexities involved. Firstco Awarded Tyne and Wear Framework Agreements

Firstco have been awarded preferred supplier status, becoming one of three contractors to undergo further competitive competition to design and build a 10G IP network linking the sixty stations of the Tyne and Wear Metro. The network will provide communications for CCTV, public address, telephony, passenger help points, SCADA and positive train identification. Ambitious Apprenticeship Drive set to Bridge Skills Gap in Rail Industry

Manchester-based Vital Skills Training has launched an ambitious programme to train 270 rail apprentices across the UK by June 2012. The firm, which is part of Vital Services Group, already trains a number of rail apprentices in Salford, London and Staffordshire and it is the success of these programmes which has prompted the company to invest further in Apprenticeships. Vital Skills Training is one of the largest suppliers of training services for the rail, energy, mechanical & electrical and construction sectors. Each of the 270 apprentices will be recruited by sister company, Vital Rail, and will complete either an Intermediate or Advanced Apprenticeship in Rail Engineering - a qualification for those with ambition to become engineers in the rail transport industry, working on permanent way, signalling/telecommunication or electrification. The qualification combines theoretical work with hands-on training in a realistic work environment, leading to a Level 2 or 3 NVQ, with content covering personal track safety, basic fire & first aid and rail specification protective equipment. Vital Skills Training is already underway with its training drive, with 24 apprentices being recruited in partnership with Transport for London to work on a project to maintain the Epping Ongar Railway heritage line and work towards providing passengers with a connection to the London Underground. Record numbers of people with disabilities are getting out and about by train, according to new figures published to coincide with the 30th anniversary of the Disabled Persons Railcard. The research published by the Association of Train Operating Companies (ATOC) shows that journeys made on the Railcard have more trebled in the last 15 years, with more than three and a half million trips now made every year.

As well as the savings offered for disabled passengers, train companies attribute the continuing rise in numbers to significant improvements in facilities and services on trains. Examples of major changes and developments include: - In 2009, ATOC launched Stations Made Easy, an interactive web guide showing access facilities and layouts of all 2,500 stations in Britain, the first such tool of its kind for a railway network. - The Disability Discrimination Act (DDA) was extended to cover the railways in 2005, leading to the removal of all trains with slam doors among other, ongoing, improvements. - The Passenger Assistance Scheme which allows disabled people to book ahead as a way of ensuring that they get the assistance they need. Facebook to Attract More Apprentices to Network Rail Network Rail is exclusively using a new Facebook campaign to recruit 200 people for its three year advanced apprenticeship scheme. The campaign has current apprentices at its heart would-be applicants can ask questions and receive a direct answer from someone who is already on the scheme. It is also using Facebook to attract more than a million women to the site with targeted advertising. Last year nearly 8,000 people registered interest in the scheme - but only 3.2% were women. The advertising - which draws on research to understand what’s important to young women, including valuable qualifications and good career prospects as well as earning whilst learning - will appear on more than a million female Facebook users’ pages aged 16-25, who have shown an interest in engineering, apprenticeships, rail, careers, or are studying for their GCSE and A-levels. At the start of national apprenticeship week, people can apply via a new Facebook page www.facebook.com/ontrack with videos, profiles and useful information about the scheme. 10

Crossrail Outlines New Approach to Refurbishing the Connaught Tunnel Crossrail have announced that it has adopted a new approach to restoring and enlarging the Connaught Tunnel which is safer and more efficient.

Connaught Tunnel in the Royal Docks was built in 1878 and was part of the North London Line until 2006. The tunnel will be extensively refurbished as part of works to construct Crossrail’s new Abbey Wood branch. Sections of the existing tunnel are in a poor structural condition. Crossrail originally planned to strengthen the central section of the tunnel by removing the existing steel linings and back filling the entire section with concrete foam. These tunnels would then have been enlarged by boring through the concrete to create tunnels that are large enough for Crossrail trains to pass. Crossrail will now place cofferdams in the Connaught Passage between the Victoria and Royal Albert Docks, pump out the water and create a dry construction site allowing workers to dig down to the tunnel to undertake the enlargement work through a ‘cut and cover’ approach.

Connaught Tunnel was hit by a bomb in 1940. Crossrail will be undertaking further repair work to the damaged section of the tunnel. Ahead of major works on the Connaught Tunnel commencing next year, Crossrail is undertaking an extensive search of the wider construction area to identify any remaining undiscovered devices that failed to detonate on landing during World War II. The geology of the Royal Docks area meant that some devices that didn’t explode on landing sunk into the first few metres of soil. Sitting above the Connaught Tunnel near Connaught Bridge is the tunnel pump house. This attractive Victorian building is too small to accommodate the larger modern pumping equipment that will be installed as part of the tunnel’s major refurbishment. Subject to structural surveys, Crossrail proposes donating the structure to the SS Robin Trust.

Tube Performance on Track for Successful Games The latest performance figures published by London Underground (LU) show that, while demand continues to rise to record levels, reliability on the network is improving - meaning that plans to boost performance for the 2012 Games and beyond are well on track. The figures for period 9, covering 13 November to 10 December, confirm that the four-week period was the third in succession that passenger demand hit new levels, with 95.8 million passenger journeys - up by 1.2 million from the record established in the previous period. Delays - as measured by the number of passenger hours lost to disruption - were reduced by 8,900 from the previous period,

and have been reduced across every line compared to the same period last year. However, more work is under way - aiming to further boost reliability and provide a lasting legacy for Londoners. Over the last six months a huge range of work has been carried out on the Jubilee line which is key to a successful Games. More trains are running, more frequently and more reliably, train maintenance has been brought under direct Transport for London (TfL) control and extensive software improvements have been made following the installation of automatic train operation software. LU is also increasing its incident response capabilities, and developing plans to

co-locate engineering and operations staff in a consolidated command and control centre to help speed up the time it takes to recover from incidents. It is also working closely with the British Transport Police (BTP) in order to establish a system where the BTP will be helping to get TfL’s Emergency Response Unit swiftly to where incidents are taking place under blue light status. Passenger information around service alterations is being improved, and staff training given an increased focus on keeping passengers informed. New radios are in place for better communication between staff, and upgraded electronic status update boards are being rolled out across the network giving more detail on services.

YOUTH T OF TODAY

he Young Railway Professionals (YRP) was formed following the meeting of the Chairmen of the Young Member groups belonging to the constituent members of the Railway Engineers Forum (REF). The REF is a multi-disciplinary body drawn from those Professional Institutions with strong railway interests. The aim of the REF is to harmonise the various strengths of the constituent Institutions in devising and implementing their programmes of activities in support of the railway community.

It was after one of these meetings, around a table at the Britannia Pub in Euston that the YRP was born. Rob Mullen (the Chairman of the Institution of Railway Operators’ (IRO) “Young Operators”), Martyn Chymera (the Chairman of The Institution of Engineering and Technology’s (IET) Railway Professional Network’s “Young Members”) , Martin Fenner (the Chairman of the Institution of Railway Signalling Engineers’ “Young Members”) and Paul Cooper (the Chairman of the Institution of Mechanical Engineers Railway Division’s “Young Members”) recognised that each one’s organisations were planning events for their young members, and sometimes even overlapping technical study trips with similar themes. It was agreed, in October 2009, that coordinating and sharing information about events and activities, and promoting these events to each other’s members would be great for young people in the railway industry to broaden their experience, and meet their peers.

The four founders felt they had benefited from meeting each other and were determined to provide an opportunity to bring together all the young member groups in one special networking event. The idea for a Black Tie Dinner to bring together young people from across the industry was conceived and plans began immediately. With corporate sponsorship and support from the institutions, the YRP organised a successful Black Tie Dinner in February 2010 for 150 people, held in the exquisite surroundings of the IMechE’s Elizabethan Library and Chris Mole MP, the then Minister for Rail, attending as guest speaker. Through 2010 the network continued to grow, with a successful summer BBQ event in London, and branching out into Europe through a drinks reception held at the biannual Innotrans Railway Expo in Berlin. The network quickly grew to over 800 members. Into 2011 and doubling in the size of the Annual Black Tie Dinner to over 280 attendees, the founding members moved on from their chairmanships at their institutions to focus more on the development of the YRP. In 2011 the network broke the 1000 mark and now has over 1300 members, who each month receive a newsletter providing the latest news, upcoming events from across the industry and information on opportunities to get involved with the organisation. Since the launch of the Linked In group numbers have rapidly risen to over 500 thus providing a good platform for expanding in the future. 14

So what does the YRP do? The recently elected new Chairman of the YRP for 2012, Paul Cooper, describes what the YRP currently does and aims to achieve, ‘The YRP provides the best opportunity for networking for young people in the railway industry. Our focus is on bringing together people from across the disciplines, building relationships between engineers, designers, operators, maintainers, drivers, managers, apprentices and graduates that will serve them, their employers and their careers for years to come.’ The YRP are also very aware of the current lack of young people looking to the railways for career paths and aim to tackle this with its resources. Late in 2010, the YRP Railway Ambassadors was formed, bringing together those in the industry who were already engaged in going into schools and colleges to promote engineering as a career, and those who were keen to promote the railway industry as a great career for young people. Paul Cooper explains, ‘With over 30 Ambassadors and an active ambassador sub-committee, the YRP has a strong focus on bringing the best of the railway into the classroom, colleges and universities, promoting development routes including both apprenticeships and graduate training by showcasing the best of the industry and providing advice, careers information and training opportunities, including utilising the YRP network to give job seekers an insight into life in the railway industry.’

Who should get involved in the YRP organisation? As interest in the YRP grows, Paul continues to encourage a broad range of people to connect with the organisation, ‘Anyone can join the YRP and it is free. Any individual or organisation that sees potential in adding value to their career or business by engaging with the Young Railway Professionals are welcome to join. The YRP networking events will always be organised with young people in the railway as the target audience. We receive enquiries from across the board, from young people looking for roles as an apprentice, graduates looking for recommendations of companies to work for, to organisations who believe they have a product or service that could benefit our members.’

Behind all of this hard work are young people who have successful careers themselves. Rob Mullen, who from the launch of the YRP has been Chairman, started out as a Senior Driver Manager for C2C and has recently joined First Great Western as a Regional Driver Manager for the Central Region. Rob steps down as Chairman this year, remaining on the Executive Committee and will be taking on the role of pioneering the YRP South West Regional activities, and lead in their relationship with the Railway Children charity. Paul Cooper, Commercial Manager with Hitachi Rail Europe, took over from Rob Mullen to become the new Chairman for the YRP heading into 2012. He has high hopes for the YRP and when asked what advice he would give to someone looking to get their career started in the rail industry, he advised, ‘Get in touch with the YRP! The YRP would be able to point people in the direction of other young people who are working in their target area, who can share the good news of working in the Railway Industry in the UK and highlight the career potentials. Paul Cooper Chairman of YRP My Railway career started with Professor Rod Smith, now President of the IMechE. He was both a lecturer and my head of department at Imperial College London and with funding from the Royal Academy of Engineering, he arranged for me to attend the Tokyo Institute of Technology for 6 weeks. Professor Rod Smith opened the door for me to join Hitachi Rail Europe, just as they had signed their first rolling stock contract in Europe, building 29 High Speed Class 395 trains for Kent commuter services. So my career started as a graduate engineer in the small European team supporting our Japanese design colleagues with the design reviews and customer and sub-supplier interfaces. I headed to Japan again only three weeks after joining Hitachi as their first European railway graduate in November 2005. I progressed onto taking my first responsibility role as project engineer for the toilet system for the Class 395 trains, involved in inspection, testing, installation and commissioning. As I grew as an engineer, in a small company with few peers, I got involved in the IMechE Railway Division’s Southeast Centre and joined their committee. I enjoyed the diversity of the committee and the new roles I was able to try my hand at and once I was aware of the Railway Division’s Young Member committee, I joined that too. The following year I took the position of Vice Chairman on that committee, followed by Chairman the following year, which afforded me the privilege of attending the senior board’s normal and executive meetings, where the running of an organisation, budget and vision were key areas of discussion on each occasion. It was not long after this that the YRP was founded, and now as Chairman, all the experiences above are proving extremely useful. In my current role at Hitachi Rail Europe as a commercial manager, I am now responsible for the Class 395 and 465 contracts, and have been involved in IEP negotiations with the DfT, getting deeper into what keeps the Railway going and how all the big projects are brought together and made a success. There’s no doubt that the experience and relationships I have been able to build through my role in the YRP are of real value to both myself and my employer, and will, I’m sure continue to prepare me for my career ahead.

Where are you now in your career? I still work at London Underground but have moved up to the position of Senior Track Engineer. I am applying to be a chartered engineer with the Institution of Mechanical Engineers at the moment and have become a member of the Permanent Way Institution.

Do you still find YRP a useful organisation? How did you hear about the YRP? I was introduced to the YRP by one of it’s founding members Paul Cooper. When the YRP was set up I was volunteering on the young members committee of the Institution of Mechanical Engineers Railway Division and Paul was the Chairman of the committee. He asked me to join as he was looking for extra members on the YRP so that they had enough members to start organising events and spreading the word.

Where were you in your career and what were your aspirations? I was working for London Underground in the Asset Performance Directorate as a Track Engineer. I had been in the role for about 2 years after completing the graduate scheme. My ambitions were really to become a technical expert in the field of track. I enjoy the technical aspects of my job most and so I wanted to gain more knowledge and experience in both maintenance and renewal of track.

What advice did you want to get from the YRP? The reason I decided to get involved was to get more contacts. I felt that in the Railway Division of the IMechE I had built up some good contacts but realised it was only a small part of the rail industry. I felt that the YRP would allow me to make contact with my peers and even senior managers in other companies and parts of the rail industry.

How did the YRP help? By putting on events that are open to all young people in the railway industry I have been able to meet more people than I could by just being a member of one institute. The events that have been organised have had great attendance and I have also had the chance to meet people involved in the National Skills Academy for Railway Engineering.

Absolutely. I have been involved on the committee for a number of years and still enjoy the extra responsibility that it gives me. My manager is very supportive of the work that I do for the YRP and I believe that it gives a good impression to be organising events etc. outside of work that are related to the industry you are working in. At every black tie dinner I expect to meet new people who may in the future be useful to know.

Who would you recommend the YRP to? I think that anyone who is starting out in a career in the railway industry should be recommended the YRP. The group has the backing from the major railway institutions and many parts of the industry as a source of talent for the future. If you want to meet senior managers and make an impression then I would struggle to think of a better way of doing it. It’s a great way to socialise with your peers at the events they organise and make contacts from a different part of the railway industry.

What advice would you give a young person looking to start a career in the rail industry? Firstly I think you’ve made a good choice – there are lots of opportunities! My advice would be to decide what you want to do, whether it be engineering, operations, customer service and then get some work experience or relevant qualification. Work experience is also a really good way of getting a foot in the door. Joining the relevant institution and becoming active within it is a great way to get noticed. It’s not enough to just pay your subscription and hope for the best.

Civil servants have a heavy workload ahead as an unprecedented number of franchises come up for allocation. Their task is an unenviable one.

T

his year is going to be the busiest ever for the Department for Transport’s franchise team. Temporary extensions granted to various franchises, together with First Great Western not taking up its option for the final three years of its contract, mean that there is an unprecedented logjam of contracts to be let. First, the Invitation to Tender for the West Coast franchise has, after a delay, finally been published and for this there are four shortlisted bidders: Virgin, the incumbent in which Stagecoach has a 49 per cent stake, will compete against Abellio, the Dutch state railway, a coalition of Keolis and SNCF, the French state railway and FirstGroup for the franchise which was originally intended to start in April but has now been delayed to December. The Invitation to Tender documents were issued in January by the DfT and bids have to be submitted in April. At least that franchise is under way, but the others are still at the earlier stage of seeking bidders to pre-qualify. The heavy workload for the civil servants who have to assess the bids and make recommendations over franchise allocation was well demonstrated by the unprecedented

Image: http://www.alveyandtowers.com was making a loss and therefore got out at the first opportunity, though will continue on running the service until April 2013 when the new franchisee takes over. To complicate matters further, there are three major issues. First, there is the £800 million redevelopment of Reading station currently under way – to be highlighted in the next issue of RailConnect – which, while of course bringing about major improvements to that bottleneck, will in the short term cause disruption. Then there’s the Crossrail scheme, which will radically affect services at Paddington, requiring a recasting of the timetable. While for the moment Crossrail services, which will start running in 2018, are planned to terminate at Maidenhead, there is a lot of pressure to extend them to Reading, a far busier location.

publication of three Official Journal of the European Union notices by the department on the same day just before Christmas. These cover a pretty straightforward contract for Essex Thameside, the new name for what was once London, Tilbury & Southend, and became known by the present incumbent, National Express, as the rather incomprehensible C2C. The second one is the very complex Thameslink franchise, which covers not only the current services operated by First Capital Connect, but also some parts of the SouthEastern franchise and, eventually, the whole of the Southern franchise. This is full of what Donald Rumsfeld famously termed ‘unknown unknowns’, since the date at which the Southern routes will be incorporated is not stated and the Thameslink core route is the subject of a major improvement programme which is not due to be completed until the end of the decade. There will also be, during the seven-year period of the franchise, the introduction of the new Siemens trains and therefore it will be very difficult for bidders to assess the risk of these various developments. Complicated as the Thameslink deal will be, it will be superseded in complexity by the proposed 15-year deal for the Great Western franchise, which has an even greater range of uncertainties and has been described by one railway writer as ‘the Franchise of Death’. And so it is. To start with the franchise is already complicated. Unlike the West and East Coasts, which are solely for long-distance services, it is the child of Richard Bowker’s time as boss of the Strategic Rail Authority when the idea was that commuter and Intercity services out of the same London terminus would be combined into one franchise. Therefore, it is already a complex franchise involving both suburban or regional services to the Thames Valley and services out to Plymouth, Penzance, Bristol, Cardiff and the rest of South Wales. Nothing illustrates the problems better than the hordes of passengers who at Reading get off trains that then run on for several more hours often half empty. Moreover, the current franchisee, First, not surprisingly, did not take up the final optional three years of its contract because it

Finally, there’s the plan to electrify services, which will require two separate types of new rolling stock. The new IEP trains to be supplied by Hitachi have been earmarked for long-distance services while initially at least, suburban services may use some electric trains cascaded from Thameslink as well as, of course, some being replaced by Crossrail. Just to add to the uncertainties, there will, too, be new signalling associated with the introduction of Crossrail and electrification. The chances of some of this work impacting on passenger services is about as certain as the outcome of a one-horse race. Bear in mind that hardly any new trains are ever introduced without teething problems. One bidder confided to me: ‘We really don’t know where to start. It is going to be very difficult pricing these various risks.’ When all this is over and these franchises are safely let, the DfT will then have the job of offloading the East Coast franchise, which has been state run since National Express threw in the towel two years ago. That ill-fated franchise, which has had two failures – Sea Containers and National Express – in its history, is due to be re-privatised by December 2013. However, with the department so occupied this year in letting the current batch of franchises, this could well be further delayed. Indeed, the heavy burden on the department, together with the wide range of uncertainties, raises questions about the purpose of the franchising programme. These doubts will only intensify if any of these highly complex deals are substantially delayed or, like previous East Coast contracts, go badly wrong. HS2 has been given the go-ahead but there is a long way to go and it could still all end in tears.

I

n January, the Secretary of State for Transport, Justine Greening, gave the go-ahead for what will become Britain’s largest-ever engineering scheme, the £32 billion high speed line linking London with Birmingham and, later, Leeds and Manchester.

Britain has so far lagged behind major European countries in the high speed stakes with only the 67-mile line between St Pancras and the Channel Tunnel, but this scheme, if it goes ahead, will make up for lost time. First proposed by the then Shadow Transport Secretary Theresa Villiers at the Tory Party conference in 2008, the idea is now supported by all the main political parties, though, interestingly, not the Greens, who initially were in favour but now feel there is no environmental case for the scheme. The line will be built in two stages, probably involving separate parliamentary phases, though that has not yet been finally decided. The first 113-mile section will be between London and Birmingham, with a station at Old Oak Common in Willesden to connect with Crossrail and another near Birmingham airport, with a short line to the old Curzon Street station near the city centre. This is due to be completed by 2026, followed by Spurs to Manchester in the west and Leeds in the east, which have an expected completion date of 2033.

While public debate has focused on the speed, which will see, for example, journey times between the capital and Birmingham cut to 49 minutes, the key argument put forward by the Government is that the line is necessary to enhance the rail capacity on the overcrowded West Coast route. Currently, there are about 45,000 people travelling on the southern section of the West Coast Line daily, and according to government predictions this will more than double over the next 25 years. The Government emphasises the positive business case for the plan. Ms Greening said: ‘A new high speed rail network will provide Britain with the additional train seats, connections and speed to stay ahead of the congestion challenge and help create jobs, growth and prosperity for the entire country.’ She dismissed notions that improving the existing lines would be sufficient to provide the extra capacity needed. As expected with such a massive project, it has generated considerable controversy. Much of the opposition has centred around the Chilterns through which the route passes. In order to allay fears about environmental damage, in her announcement Ms Greening agreed to extend tunnels and embankments through the crucial Chiltern Hills. This, however, was not enough for locals, who are vowing to continue fighting to stop the scheme.


Feature Jerry Marshall, the spokesman for the main opposition group, made the point that: ‘Justine Greening has said that she would make a rational decision on HS2 and she clearly has not. If she had taken a cold hard look at HS2 she would see that it is a disaster waiting to happen. The construction will wreak untold environmental damage and exacerbate rather than close the north-south divide. Opposition is not confined solely to the Chilterns. Writing in The Guardian, Simon Jenkins, a former editor of the Evening Standard and once a member of the British Railways Board, argued it was the greatest waste of money since the decision to build aircraft carriers and wrote damningly that this had little to do with the loss of beautiful countryside: ‘The fact is that a vast sum of money is going on a single upmarket project whose chief feature is its extravagant glamour. HS2 is gesture spending dressed up as growth. It is Concorde for slow learners.’ Interestingly, there is, too, a split in the business community. While the CBI and, not surprisingly, most companies involved in the rail industry support the scheme, others are not so sure. John Cridland, director-general of the CBI, said: ‘Without new capacity, by the 2020s the main West Coast Line would be gummed up, and rail freight would be likely to be squeezed out. We are right to plan for the infrastructure which the next generation will need, and the biggest prize will come from phase two – the link with the North.’ However, the former head of the CBI and a minister in the Labour government, Lord Digby Jones, has now come out against the plan, saying: ‘Anyone in Birmingham who says that HS2 will do anything other than make Birmingham a dormitory town for London needs to get real.’

There are, too technical objections. Opponents say that the projected capacity of 18 trains an hour is unrealistic, as no high speed line in the world operates with more than 14 an hour. Moreover, they dispute the projected growth of 2.4 per cent annually until 2037, which is the figure used as the basis of the business case and which they say is far too optimistic. Supporters, on the other hand, point to the near doubling of numbers since 2004, when the line was upgraded, new trains introduced and frequencies greatly increased. They also argue that any attempt to increase capacity by adding new carriages and further increasing frequencies would not ultimately meet demand. The next 12 months are crucial for the scheme. The Government will now start work on the more detailed design of the project, promising widespread consultation and engagement with local communities. Moreover, work will also start in earnest on determining the route for the second part of the line, to Manchester and Leeds. The details of the compensation scheme, too, will be set out. The project will be taken forward with a hybrid Bill (a parliamentary bill that encompasses both private and public interests), which will be published late in 2013, after which a committee of MPs will hear objections and decide on the final details of the project. It is during this process that both the depth of opposition to the Bill and the strength of support will become clear but in the meantime, there will be no shortage of sabre-rattling from both sides. This could turn out to be either Britain’s greatest engineering project for all time or a damp squib if ministers lose their nerve or the money proves not to be available. In the heart of London a £1bn engineering project is under way: the rebuilding of

Tottenham Court Road station which, as a site visit confirms, is an amazingly impressive undertaking.

H

ow do you spend £1 billion on revamping just one station? That’s what it is costing to rebuild Tottenham Court Road Station in central London, at the same time as building a whole new adjoining station for the Crossrail scheme. Many people in the North complain that London is getting more than a lion’s share of investment money available for rail projects and they cite such schemes as an example. It does seem an awful lot of money but a site visit soon makes one aware of just how tricky it is to rebuild a station such as this. It has long been one of London’s most inadequate Tube stations. Situated at a key junction, linking Charing Cross Road with Oxford Street and Tottenham Court Road, it is one of the main ways to access the shopping experience that is Oxford Street, albeit at the unfashionable end. It’s a key point on the London Tube map, too, as two of the busiest Tube lines, the Northern and the Central, connect here, and the need for improvement has been obvious to anyone who has used this cramped station in recent years. The tiny concourse, with lots of inconveniently placed pillars, the low ceiling and the bustling stairways were clearly inadequate for the near 150,000 people travelling through the station on a typical day. By the time Crossrail is running, that number is expected to reach 200,000 – or over 70 million a year: more than, say, Heathrow Airport.

The station had not been expanded since the completion of the Northern line over a century ago and the decision to go ahead with Crossrail meant that the scheme was given priority. From 2018, it will be one of the principal central-London stations for this new line. Therefore it is in effect two projects combined into one, both costing about £500 million, and that is how the £1 billion figure is reached. Moreover, rather than just producing a mundane station, the site demands good architecture to help improve the rather shabby image of that end of Oxford Street, and the design incorporates an impressive glass roof which will give the station a pleasantly open feel. Despite being undertaken simultaneously, the two Tottenham Court Road stations are different projects. London Underground is so far charged only with creating the space for the Crossrail station, which will then be fitted out by the Crossrail contractors in the run-up to the opening of the line in 2018. However, designing the two stations together obviously made sense, and all the relevant cross passages and escalator areas have been laid out. Begun at the end of 2009, the scheme is due to be finished in August 2016 and already key parts of the work have been completed, such as the digging of a major new pedestrian tunnel that will link Crossrail with the Tube lines. The sheer complexity of the working environment is neatly demonstrated by another important aspect that has now been finished: the widening of the access to the existing Northern line platforms. To achieve this, the cast-iron rings installed when the station was built had to be removed, and while the platforms had to be closed for eight months, the trains continued running throughout, barely inches away on the

open, splitting the work into three sites. That proved too hard to manage and posed a risk to the public, so now traffic is diverted about 100 yards to the east and runs under Centre Point, which marks the end of Oxford Street.

other side of a temporary wall, from the 100 engineers who were working day and night. That is why, on closer examination, the cost seems reasonable value for money. It is easy to see how spending can mount up on a scheme such as this, given its location and the difficulties of working in such a tight environment without interrupting the daily running of Tube trains on two lines and the fact that it is one of central London’s key road junctions. Looking at the site from above – Centre Point next to it provides a fabulous view – it seems inconceivable that so much work could be carried out safely and quickly in such a small space. A quick walk through the site – hard hats are essential – demonstrates why even the dumping of a single extra skip requires planning and organisation. There is no room for lorries to hang about, so any deliveries are held at a site in nearby Holborn until the precise scheduled time of arrival, all of which adds greatly to the expense.

The project is being overseen by London Underground, whose programme manager Les Hamilton is a chirpy Scotsman with previous experience on the Athens Metro. On the other side is the contractor’s project director, Jez Haskins, but both men are at pains to point out that the traditionally confrontational relationship between contractor and client is not for them: ‘If the contractor incurs extra costs for something, then we look at it and agree an arrangement. We have an arbitration scheme but we do not expect to have to use it,’ says Hamilton.

Land was another major cost. Just to acquire the site set Transport for London back £70 million. While most of the properties were non-descript office blocks dating back a century or more, the Astoria, venue of hundreds of famous rock concerts, sadly also had to go. For a time during the early part of the project, Charing Cross Road, which crosses Oxford Street and then becomes Tottenham Court Road, was kept

Hamilton makes no excuses for the cost of the project. ‘People don’t realise just how much digging is involved in a scheme like this and how difficult it is,’ he says. ‘We’ve had to move sewers that stretch back to the days when Bazalgette built them in the mid-19th century.’ Despite the difficulties of working in such a cramped environment, Hamilton points proudly to a poster showing more than a million hours have been worked since the last reportable accident – and that includes relatively minor injuries such as a cut finger. In the end, passengers will benefit from a ticket hall six times the present size, stepfree access from street to platform, still a rarity on the London Underground, and a whole new ticket hall for Crossrail at the other end of the site underneath Soho’s Dean Street. n January 2012, BAA formally put Edinburgh Airport up for sale. A fierce bidding war is expected for a profitable and sought after asset. Issued a week later, the Invitation to Tender for the Intercity West Coast Franchise highlighting the need for the new operator to invest in some poor, unprofitable railway stations. The disconnect is jarring. Airports and stations provide the same service – they allow passengers to board a mode of transport. But while one asset is highly coveted by the private sector, the other requires public subsidy, fails to deliver the requisite customer service and is not leveraging strong commercial opportunities. Previous reports such as the 2009 “Better Rail Stations” review suggest failure to spread best practice is costing the industry over £45m per annum, whilst external benchmarking against airports suggests the missed opportunity might be higher. This was not lost on Sir Roy McNulty, who concluded in his Value for Money study that “The complexity of the contractual matrix in which stations operate can lead to sub-optimal investment…Split responsibilities for station development can lead to delays, avoidable cost increases, and potentially missed opportunities.” The present system, by which stations are owned by Network Rail, operated by TOCs and funded by a long term charge reflecting capital expenditure needs reform. The charge does not necessarily reflect station usage [see Figure 1] or the quality of the service offered.

In addition, the current structure: • Creates a sub-optimal process for planning and delivering investment in stations • Lacks specialist expertise in promoting an integrated commercial offer • Does not provide suitable incentive structures for ensuring quality and cost effective operation • Is regulated under a model which is insufficiently granular and not fit for purpose

A new approach is required, in a model which empowers TOCs (and local communities) to specify service levels, reshapes the payment incentive and legislative structure to reward service quality, investment and innovation and leverages specialist skills to deliver upgrades and develop commercial facilities. We propose that Dedicated Station Management Companies (SMCs) would offer one such solution. In our model: • The SMC would take ownership of all stations, with long term responsibility for investment, maintenance and management of all stations. The SMC (backed by infrastructure grade finance) would deliver improvements more effectively and take long term investment decisions; • The TOC would be a customer of the SMC, procuring a service for its passengers in the same way that an airline does from the airport. Payment would be made on a usage basis (in the same way that airlines pay aeronautical fees to airports) establishing a clear financial link to service quality; • The SMC would receive all ticket retail commission and have the right to develop commercial retail and car parking at each station; • It is possible that at many stations, this revenue would exceed the cost of running the station, and the SMC would therefore pay the TOC for these rights. [See Figure 2, the new station delivery model].

Combining this model with some changes to the regulatory strategy would address all of the weaknesses in the current system:

Planning and Delivering Investment Longer franchises and clearer asset transfer are intended to encourage TOCs to invest. However, even assuming that this is achieved, it is not clear that TOCs would have the incentives or the skill set to deliver station upgrades. However, a specialist Station Management Company - which would continue to manage stations across multiple franchises - would. Moreover, it could probably do it more cheaply - a recent study for New York University identified an average weighted cost of capital for Railroad operators of 8.88%, more than four percentage points higher than the 4.78% for banks.

Incentive Structures TOCs and SMCs can establish new incentive structures to reward quality of service and investment. For example: • Commission on ticket sales could become variable and linked to service quality. For example SMCs at a well-run station could, for example, receive 12% commission on regular ticket sales, whilst sales made at a poorly run station with no facilities would only receive 5%. • Similarly, usage charges could be linked to output achieved and not the value of the asset base. This would encourage a true partnership between TOCs and the SMCs, specifying which services TOCs are prepared to pay for at which station.

In the 2009 Review “Better Railway Stations”, Green and Hall noted that “The importance of retail and catering is often underestimated within the industry.” At airports such revenue is key: At BAA’s airports in 2010 average retail spend per passenger was £5.11. Passengers will spend longer at an airport than a railway station. However if rail could achieve 10% of this, it would translate to £544m of retail spend, and with a 10% revenue share arrangement – similar to airports - £54m of new profit. An SMC would be suitably incentivised and qualified to develop such retail facilities, and by so doing could develop the funding mechanism for new investment.

Categorisation Structures With a new approach to station ownership must come better categorisation and regulation of stations. The current model is insufficiently granular. Each station will require its own retail and commercial plan reflecting its service profile, usage pattern and location which an SMC would develop. As McNulty noted “passenger security is not necessarily enhanced by the presence of a person in a ticket office.” Passenger security and investment across the network could be improved though the investment in remote station control rooms instead of ticket offices, with staff reduction plans contingent on a certain percentage of passengers using TVMs / Internet ticketing or successful transferring of ticket retail to local shops or Community Interest Companies.

Delivering this model The forthcoming tender for the Great Western franchise is the ideal test bed for a new station delivery model. As lead operator of over 200 stations (many of which require significant upgrade) the benefits of a new model would be significant. In the consultation document on that franchise, the DfT has stated that: “Bidders will be expected to have considered how best to enhance the quality of the station portfolio in their proposals”. In doing so, prospective bidders would be well advised to consider a Station Management Company.

The future of rail regulation in

he rail sector in Great Britain is undergoing a structural transformation. Network Rail, the owner and operator of the national rail network, is in the process of devolving key functions to its rail regions across Britain, while at the same time working towards a stronger alignment with train operators through joint alliances. Additionally, the Government is proposing changes to future rail franchises giving more responsibility for rail services to the operators who run the trains.

These changes are taking place on one of the busiest railways in Europe. Great Britain has 20% more train services operating than France, 60% more than Italy, and more than Portugal, Norway, Spain, Switzerland and the Netherlands combined. Last year on Britain’s rail network passengers took more than 1.3 billion journeys, over 19 billion tonnes of freight was moved, while upwards of £5 billion was invested in maintenance and modernisation. While these figures demonstrate the recent success of the rail industry, it is clear that costs are too high with a large amount of public subsidy going in, but a lack of clarity of where the money goes and what exactly it buys.

This is highlighted in Sir Roy McNulty’s Rail Value for Money study, published in May 2011, that found costs could be reduced across the whole industry by between £700m and £1bn annually by 2019. With a complex industry structure, it is essential the rail industry has a regulator which remains able to rigorously monitor safety, punctuality and economic performance. Key to this is the need to ensure that rail regulation helps Network Rail and train operators to work closer together, developing partnerships that put customers’ needs first and at the same time achieve significant efficiency savings. The Office of Rail Regulation (ORR) is the independent safety and economic regulator for Britain’s railways. It has a wide ranging role overseeing a sector with an annual turnover of £18bn, while at the same time ensuring Britain’s railways remain one of the safest in Europe. It works hard to make sure the industry delivers a safe, high performing and efficient railway for passengers and funders. The combined role provides ORR with a unique and in-depth understanding of the activities taking place on the railways, making sure that changes on the network, and the drive for better use of taxpayer and fare-payers’ money, do not compromise safety or the delivery of improvements.

Feature Consultation on the future role of the regulator In December 2011, an important consultation was jointly published by ORR and the Department for Transport (DfT). The document, ‘A greater role for ORR regulating passenger franchisees in England and Wales’, consults on the potential for an expanded role for ORR that will put passengers at the heart of regulation. Currently, responsibility for the regulation of the railways in England and Wales is divided between the DfT and ORR. The proposals would see the Government step back from some parts of rail regulation, with ORR given more powers to protect passengers’ interests while at the same time helping make the railways more efficient, cost effective and transparent. New licence conditions would allow the independent rail regulator to ensure passenger complaints are handled properly as well as to take on responsibility for monitoring train performance and service standards. The proposals will not increase the overall regulatory burden on train operators or other private sector participants in the industry, but will help simplify current regulatory responsibilities to the benefit of customers. The suggested changes build on the findings from the McNulty study, which concluded that significant changes are needed for the rail industry to achieve its full potential. These include a move towards an integrated regulator for the whole rail industry to support closer working between different parts of the sector.

The immediate package of reforms includes proposals that: n ORR should take on additional responsibilities for complaints procedures and Disabled Peoples’ Protection Policies (DPPPs). n ORR will be responsible for all aspects of approving, monitoring, and enforcing compliance with complaints procedures and with DPPPs through station and passenger train licences.

Long-term proposals included in the consultation are: n Responsibility for monitoring and the enforcement of train punctuality and reliability could be transferred to ORR. n That the monitoring and enforcement of service quality standards and compensation agreed in the franchise, or committed to in the franchise bidding process, could be implemented by ORR via a licence rather than by the Government through a contractual mechanism. Enlarging the role of ORR could potentially deliver significant benefits to users, taxpayers and the rail industry. ORR welcomes the proposals for an expanded role with greater powers to protect passengers’ interests. Strong, proportionate regulation is essential for passengers and funders to get the service they deserve. The joint consultation closed on 2 March 2012, but this is just the beginning of the debate. In view of the proposed changes, by 2014 - the start of the next control period - Britain could have a very different railway.

What is your greatest career achievement to date?

What brought you into the industry/your position? Rail is a really big deal for people because it’s a direct part of their daily experience. It is also a really complex sector– a huge amount of public subsidy goes into the system, and it’s not at all clear that we get what we ought to for it. We all have the opportunity now to change the industry – its structures, mindsets, culture – to make sure we are all focused on the customer and value for money. That is the kind of challenge I like. I’m also really enjoying being closer to the action than in many policy jobs in government.

What developments do you expect to see in the next 5 years at ORR? As the railways’ independent regulator, ORR has a unique role in the next few years as the industry changes. Our biggest focus will be on improving value for money, the customer experience, and keeping the railway safe. The railway needs investment to meet customer demands and to support economic growth, through both passenger and freight services. But to justify high levels of public investment, it needs to make a step-change in its efficiency and be more transparent. ORR needs to make sure the industry achieves that so that the industry has the confidence and legitimacy to justify what is spent on it. Our Periodic Review of Network Rail’s spending is a big step towards that. ORR will be much better connected with customers and will focus on how well they are served locally; there will be more collaboration with the industry. We will get across what we do and why it matters in plain English. And ORR will be even more respected as a group of professional, committed people who regulate in the public interest but know when to step back and let the industry take the initiative.

Persuading different agencies to work together across the criminal justice system to cut crime and the harm it does to people was a big challenge, and I think it’s made things genuinely better. I helped to change the way government and businesses address climate change too – though the jury is out on whether that will deliver enough as we recover from recession.

What do you enjoy most about your job? Making a difference for people who use the railway, with the big opportunities we have to make it better. And the people – week in week out I meet people across the industry who apply their skills and ingenuity in a complex system to deliver a great service.

If you could change anything about the industry what would it be and why? I’d like to see the industry much more selfmotivated, with better collaboration and confidence in its own judgement to do the right things for its customers, for safety and efficiency. I think the railway should be less dependent on government and the regulator to make things happen. And much greater transparency – people need to feel the industry is delivering efficiently, and to be able to see it for themselves. Too much secrecy around how public money is used just makes it look like there is something to hide.

What is the best advice you’ve been given? First and foremost - it’s the people. Call them staff, customers, suppliers, workforce, passengers, the industry, regulators, government – they are all people who deserve to be listened to: often supported, sometimes disagreed with and challenged too, but always treated with respect. Second - follow the money. It may sounds sleuth-like, but if you understand how the money flows, in any industry. it tells you a lot about how you can improve performance and who can help.

What advice would you give to someone starting out in the industry? Whichever job you are in, always think about how your decisions affect your customers. Develop your skills and judgement so you can do the right thing by customers, and use your resources wisely. Challenge anything which is unsafe or blatantly inefficient – a better railway will come from your integrity and ingenuity helping to change the way things are done. Learn from the people around you, and spot the innovators and see what can be achieved. Try to see as much of the railway as you can, so you really understand how the system works and see it from different perspectives. And think of a stint at ORR or in another part of the industry as part of your career development.

What inspires you? Family and friends. They achieve amazing things, and keep me sane!

What law/legislation would you like to see introduced? I believe in people being able to see where their money goes and what they get for it. So measures which make the public sector and public spending more transparent are good with me – rail included.

Where do you see the UK Rail industry in 10 years? I’d like the rail industry to be achieving a lot more for a lot less. I want value for money to have stopped being an issue because people are really confident that the system is efficient and driving hard to be at the cutting edge. I want it to be responsive to its customers, and safe. And it must be at the heart of Britain’s economic recovery. The next decade is crucial for making that happen – and decisions taken now will determine how we get there.

A Test of Skill E

stablished only a year ago, the National Skills Academy for Railway Engineering has already had a major impact.

From January this year it has taken on responsibility for providing quality assurance for all Network Rail’s Sentinel-related training and assessment programmes, delivered by 100 independent providers. This means the previous programme of audits is now being replaced by a series of Ofsted-style inspections, managed by NSARE, so that by the end of June this year each training provider will be graded in one of four categories — outstanding, good, satisfactory or inadequate — with the results being posted on the NSARE web site this summer. The Academy is now working to develop a Directory of courses delivered by its accredited providers, who will have the opportunity to have a listing in the Directory together with an introductory profile and their contact details. NSARE is also developing a national competence database that will be capable of holding records of training and competence for all workers in the railway engineering industry, using the latest information technology. NSARE is part of a network of National Skills Academies. Funding for its establishment was confirmed in November 2010, as part of the Government’s skills strategy. The Academy was launched on 1 December 2010 at the House of Commons, with more than 150 industry representatives present, and in January 2011 NSARE was incorporated as a ‘not for profit’ Company Limited by Guarantee, whollyowned by its Members. By its first annual general meeting last December, NSARE had exceeded its target of recruiting 100 members. NSARE will continue to receive some government funding for another two years to help support its development, but it is expected the Academy’s own products and services will generate income and NSARE Limited has to be totally selffinancing by the end of 2013. The Academy doesn’t deliver training but works with employers to understand their skills needs, with training providers to ensure they are delivering what the industry needs, and with other stakeholders, such as sector skills

This leaves around a further 60,000 people employed by a large diversity of suppliers, contractors and sub-contractors to the rail industry. It has also left a major problem of how to assure common training and skills standards across the diversified industry — hence the proposed national competency database.

bodies and government, to make sure that the industry has people with the right qualifications. The aim is to support the rail industry vision that ‘by 2015, the engineering workforce will have the necessary skills to support the maintenance, development and expansion of a first-class, cost effective 21st Century railway.’ Formation of the Academy followed a threeyear campaign led by Gil Howarth (pictured above) now NSARE’s Chief Executive and Company Secretary — and Pete Waterman who, although well known as a pop music impresario, is better known in the rail industry for owning and operating a railway engineering business at the Crewe Heritage Centre where he also trains apprentices. The need for the Academy was backed right across the railway industry, which matched the initial government funding to get the project started. Today’s rail industry is vastly different to that which preceded the privatisation of British Rail between 1994-97. There are now around 100,000 people engaged in railway engineering activities, of whom approximately 10,000 work on rolling stock engineering and maintenance — mostly employed by the train operating companies, while the remainder work in new build activities, such as at Bombardier Transportation, at present Britain’s only remaining significant train builder.

An additional factor is the age profile of many engineers in the rail industry and the need to attract young people to choose railways for their future careers as the older and more experienced engineers leave for retirement. The railway engineering industry offers some great career opportunities — but it needs to get this message out to school leavers and graduates. To this end, NSARE is now working closely with The Smallpeice Trust to raise awareness and interest in railway engineering career opportunities. Although the industry has not always enjoyed the most positive image among the public at large, the need for an improving and growing rail industry is being recognised increasingly by the business community and government.

This massive scheme, which is heralded as Europe’s largest construction project, has highlighted the shortage of skilled tunnelling engineering skills in Britain and led Crossrail to set up Europe’s first Tunnelling and Underground Construction Academy (TUCA) — in Ilford — to ensure there are sufficient skilled people for the project to go ahead. These skills will also be essential for the construction of HS2 as at least a quarter of stage one will be in tunnels. It is perhaps no surprise, then, that Terry Morgan, the Chairman of Crossrail, is also Chairman of NSARE Limited. And at the Academy’s first AGM last December, Terry Morgan announced that Pete Waterman had been invited to become NSARE’s first patron: “Pete’s real passion is helping young people, particularly those who come from a less privileged background, to get a start in life,” he said. “He has campaigned tirelessly for Government funding for traditional apprenticeships, long before they were championed by this government and indeed the previous government.”

The government has continued to approve substantial modernisation and enhancements of the existing railway network, including electrification between London, Bristol and Cardiff and of the Trans-Pennine route between Manchester, Leeds and York, and a start on re-opening the rail route between Oxford, Bedford and Cambridge. NSARE is planning to undertake a detailed survey with the Office of Rail Regulation to identify engineering skills needed for the future in what is becoming a significant growth industry. The biggest railway engineering project currently under way is Crossrail, costing £15 billion — with tunnelling of a new 21km twin-bore route between Paddington and East London about to start. It will enable up to 24 commuter trains an hour to operate from Berkshire and Heathrow Airport in the west to Shenfield, in Essex, and Abbey Wood, on the borders of Greenwich and Bexley.

F

ollowing the Office of Rail Regulation’s (ORR) market study on rail freight sites last year, the rail industry’s regulator is continuing to consider changes to the regulatory framework. These are aimed at making legislation fit for purpose in response to an ever increasing amount of rail freight activity. Currently, ORR is engaging with the industry on a voluntary code of practice governing arrangements around the leasing of and access to freight sites. When negotiations break down, how can freight customers and operators obtain access to the sites they want to use? In this article, we examine the legal regimes available and discuss how these will become more and more important in the next decade. The significant factor here is the huge rise in rail freight traffic that organisations such as Network Rail are forecasting.

Legal regimes on access There are currently two legal regimes under which a company can apply to be granted access to a rail freight facility. The applicant could be granted access under either one of these regimes. Under the first, set out in the Railways Act 1993, ORR has the power to direct the owner of any rail facility to enter into an access contract with a railway undertaking. If an application is successful, ORR will specify both the terms of the access contract and when it must be entered into. A large number of rail facilities are expressly exempted from this part of the 1993 Act; for example, a number of port terminals are exempt. It is also possible for the owner of a rail facility to apply to the Department of Transport for an exemption to be granted in

The second is set out in the Railways Infrastructure (Access and Management) Regulations 2005, which implement a European Directive for open access to community rail facilities. The 2005 Regulations state that a railway undertaking is entitled to track access to (and the supply of services in) terminals which are linked to the rail network and serve, or potentially serve, more than one customer. If such an undertaking is denied access, it may appeal to ORR. In turn, ORR may give a direction to the owner of the facility to grant access. The 2005 Regulations do not contain any broad exemptions for terminals which are connected to the Network Rail network. Under either regime, ORR will follow the same basic process: considering representations from the applicant and the facility owner, and consulting any other key stakeholders before coming to a conclusion. It is unsurprising that, if an owner of a rail facility is required to provide access following an application; it will also be subject to contractual obligations to maintain its facility. But, in fact, the legal toolkit extends much further than this. In certain circumstances, ORR can direct the owner of a rail facility to carry out improvement works (although ORR would be unlikely to do so unless the owner is adequately remunerated for carrying out the work).

A fair balance For owners of rail freight facilities, these legal regimes can have a big impact on the way they choose to operate their facilities. The courts have previously recognised that the action of ORR directing a facility owner to grant access constitutes an interference with the facility owner’s right to peaceful enjoyment of its possessions (as enshrined in law under the Human Rights Act 1998). However, this interference will not necessarily be unlawful, so long as ORR strikes a fair balance between protection of the right of property and the requirements of public interest. This public interest will often be to have a rail network which realistically has the greatest possible use and consequently relieves congestion on other transport networks and reduces carbon emissions. This interest is recognised in both ORR’s statutory duties and in the European Directive.

Making the most of it Most applications to ORR are for access rights to the mainline network. However, some recent applications for access to rail freight facilities include DB Schenker’s applications for access to the Port of Immingham (determined in 2009) and the Port of Felixstowe (determined in 2010). The uptake of such applications has not been great. ORR’s market study suggests the main reason for this is that while most larger freight operating companies understand current legal regimes, knowledge is less advanced among smaller operating companies and other parties involved which have infrequent contact with the railways. Perhaps understandably, companies are also wary of applying to a regulator to determine the terms of their contractual relationships. As a result they tend to view applications as a last resort. ORR also noted that, despite the current system, companies are cautious about entering into contracts for access where the site owner is a competitor. As consumer rail freight traffic increases, there will be increased demand for rail freight facilities. The legal regimes in place may provide the strategic solution to obtaining access, and applications to ORR are likely to rise. Such applications could lead ORR to determine the allocation of capacity, level of charges and even whether an unused rail freight facility should come back into use. The current work by ORR and the industry on a voluntary Code of Practice gives a valuable opportunity to facilitate these applications, causing as little uncertainty or delay as possible for all parties.

F

or many years the Rail industry has audited its suppliers in accordance to a supplier’s potential for risk. And, of course, this is an essential process for every buyer and ensures that the important safety requirements are met. However, the way the industry approaches supplier audits is fragmented and in need of change. Firstly, there is a significant level of confusion in the industry over the boundaries between the three key tiers of auditing that exist. On one level, there is the qualification of a supplier to certified standards, such as the ISO standards for health & safety, quality and environment. On another tier, there are technical and buyer/contract specific audits, such as RISAS, and ontrack plant that relate to specific risks. But in the middle, there is a critical tier which concerns the pre-qualification and auditing of a supplier’s management processes and systems relating to the way a supplier deals with health & safety,

quality and other important policies within the organisation. This audit is offered through the Link-up scheme run by Achilles. Unfortunately, a number of industry members wrongly assume that the Link-up audit is a technical one, evaluating the technical and contract specific capabilities of an organisation. This is just one aspect of the rail industry’s auditing structure that needs to be made clearer. There are further areas that can be improved and upgraded to provide greater value. Link-up, the industry’s supplier qualification scheme, is a collaborative community of 3500 suppliers of which some 1300 undergo a pre-qualification audit on an annual basis. The assessments are undertaken by a team of highly skilled and fully qualified auditors who are conducting the in-depth analysis of management processes and systems at an organisational level. At present, this is an exercise which determines whether

a supplier is compliant to the defined minimum standards or not, hence, if a supplier has passed or failed the audit. There is no grading of a supplier in terms of its maturity and approach to its management processes – offering little visibility to buyers of a supplier’s continuous improvement efforts and longterm performance in this regard. For many suppliers this is doing them a disservice, as top performing companies are seen in a similar light to those merely attaining a pass. What is more, the auditing process, at present, offers little advice, guidance or feedback to suppliers on how that organisation might improve its processes. Clearly, there is a great opportunity to change for the better and this is exactly what Link-up is in the process of doing. Under the new Steering Group for Link-up, a Working Group on auditing has been established to find a more ‘value adding’ means of conducting supplier audits.

In addition, suppliers will receive valuable feedback on ways of improving their systems. This will promote ‘best practice’ and raise standards across the industry. After all, if you only ask for minimum requirements, what is the incentive to go the extra mile? These proposals are similar in many respects to auditing schemes run by Achilles in the Utilities and Construction industries, where they have been successfully proven to deliver significant benefits for both suppliers and buyers. If the proposals are accepted Link-up will follow suit, delivering a more graded approach to auditing and, in the process, will offer more value added advice in return. It is also proposed that Link-up will offer a central repository for information relating to the various audit schemes. Users of

Link-up will be able to access the results of supplier audits undertaken by other schemes making compliance far more visible to buyers. Ultimately, the aim is to further align the pre-qualification audit programmes across the industry and to closer integrate the requirements of London Underground/ TfL. This would bring huge advantages for many suppliers, reducing the burden of duplicate audits, taking out complexity and reducing costs for the industry. Link-up has embarked on a process of change that will deliver far greater levels of efficiency to the rail industry, making procurement and its vital auditing methods easier to engage with, more responsive and, above all else, more integrated, visible and intelligible.
