Development
Despite far fewer developments in the current climate, we maintain our position in this sector advising key retail clients such as Marks & Spencer and Next. Where developments are happening, we’re more than likely to be involved. At Land Securities’ new Atlas development in Buchanan Street, Glasgow we have so far represented major tenants.
Value Retailers
We act for a number of value retail occupiers who are expanding across the UK in the current market. Examples include supporting Card Factory and B&M Retail in their acquisition of units all over Scotland. We continue to assist both with their continuing Scottish expansion.
Re-gears
A number of clients have been re-gearing some of their leases by agreeing new terms or reconfiguring stores in order to better position themselves to maximise returns when conditions improve. We have completed re-gearing deals for a number of our clients, including Halfords and other high profile clients.
Restaurants
We remain active in the restaurant and fast food sector, acting for established brands such as McDonald’s, Starbucks, YO! Sushi and Nando’s on both acquisitions and estate management.
Retail Investment
The retail team has acted for clients acquiring significant retail investments over the past few years, including Silverburn Shopping Centre, The Brandon Centre, Motherwell and Clyde Retail Park. We have also advised on the acquisition and management of a number of secondary shopping parades and retail units around the country.
Asset Management & Commercialisation
The effective asset management of existing schemes and investments is now more important than ever. We advise on the asset management of a number of schemes such as Silverburn, Rivergate (Irvine) and Motherwell Town Centre. We act for landlord clients such as Hammerson and CBRE Global Investments on mall commercialisation contracts, ranging from car valet agreements to ATM’s and video screen arrangements. We advise on all forms of temporary and short term trading arrangements in mall space and vacant units and have also completed a number of agreements with car park operators.
Dispute Management
With wide ranging expertise including dilapidations and lease interpretation / enforcement our Property Dispute Management team represents clients in the Court of Session, Sheriff Court and the Lands Tribunal. Focusing on delivering speedy & cost effective resolutions through negotiated settlement, arbitration, adjudication or mediation, the team has recently represented Arcadia and Marks & Spencer in separate disputes over redevelopment and refurbishment costs.
Across the UK
Due to our outstanding service reputation, we now have an increasing number of retailers using our services across the UK including Swarovski, Trespass and WH Smith. We have also assisted a number of other UK retailers, including Debenhams, BHS and Monsoon Accessorize with deals in Northern Ireland.
Employment
Our employment team has a strong track record in advising and representing retail clients such as Next, Benetton and Sterling Furniture. We have acted in tribunal cases covering a wide range of retail issues such as Boxing Day absenteeism, cash handling irregularities, breach of staff purchasing policies and absence management.
Corporate and Commercial
Our corporate team have handled acquisitions for clients including B&M Retail, Debenhams and Sterling Furniture. We also advise on commercial contracts and distribution agreements for Greaves Sports. We act on trading standards and statutory compliance matters, and have advised on numerous insolvency and corporate recovery situations for clients such as JJB Sports including advice on their two CVAs.
