Planning Appeals

We represent clients in major wind farm inquiries, many examining the potential for environmental impacts on a variety of natural heritage features. In recent years we have handled over 20 wind farm inquiries, including 4 applications seeking Ministerial Consent under the Electricity Act 1989 with separate planning permission. We represented Infinergy on its contested applications for more than 200MW of installed capacity in just over 12 months.


Wind Energy

Off-Shore: The scale and complexity of off-shore wind developments will require developers to work together on a large scale. We have the experience necessary to advise parties in relation to corporate structures and joint venture arrangements for off-shore wind projects as well as the challenges presented by engineering works in the marine environment. On-Shore: We advise market-leading wind farm developers on their Scottish leases and option agreements and on project risks and contractual structures.


Turbine Supply and Maintenance Contracts

Mobilising the supply chain will be critical in ensuring that the renewables industry in Scotland consolidates and strengthens its position as a global leader. We can advise you on how best to structure your contractual relationships. We have recently provided advice on the terms of turbine supply and maintenance contracts.


PPAs and Grid Connection

Power Purchase Agreements (PPAs) provide generators with revenues from the sale of electricity and other environmental benefits. We have advised developers, funders and utilities on PPAs for renewables projects with a capacity in excess of 500MW. With one of the largest commercial property practices in Scotland, we frequently advise developers and utilities in relation to grid connection issues.


Market Incentives

The expansion of the renewables sector has been driven by statutory incentives including the Renewables Obligation, Feed-in Tariff and Renewable Heat Incentive. We have advised on the Renewables Obligation framework in relation to several wind farm developments, the trading of Renewables Obligation Certificates and the operation of the Feed-in Tariff.


Regulation

Energy efficiency and emissions reduction legislation affects organisations of different types in different ways. We have helped clients comply with all of these regimes including the EU Emissions Trading Scheme, the CRC Energy Efficiency Scheme and the Carbon Emissions Reduction Target (CERT). We advised ScottishPower on its groundbreaking outsourcing partnership with Carillion Energy Services worth in excess of £200m in relation to ScottishPower’s CERT obligations.


Marine Renewables Supply Chain

We have experience of Crown Estate lease issues, port development and port services contract arrangements and so are well placed to support marine renewables deployment, operation and maintenance.


Microrenewables and Consumer Incentives

We advised a leading UK energy company on the Scottish Government’s Energy Assistance Package and on the Scottish aspects of the Community Energy Savings Programme. We are advising on the roll out in Scotland of a pilot scheme for installing photovoltaic cells on the roofs of homeowners, bringing micro-renewables to the mass market.


Solar Farm Development

The Green Company is one of the UK’s most successful solar farm developers. We have secured options to lease and taken leases for this company on a large number of photovoltaic array sites across England.


CHP, Biomass and Waste to Energy

We are at the forefront of regulatory issues for energy derived from biomass products, particularly recycled waste materials, having acted for a major electricity generator in a groundbreaking situation. We have advised on a variety of Combined Heat and Power projects across the UK including a 60MW plant for Sappi UK Limited (in Blackburn) and plants for DuPont in Dumfries, Pilkington Glass LLC in St Helens and for the London Borough of Barnet.
