PROTECTING Agent’s Interest
S
pring in Iowa is always busy. This year is no exception. The weather has been favorable, field work has started, new life is spouting up around us and people are planning their summer activities. However, it is with a heavy heart that I write my spring article. The insurance business and our Association lost a good friend and colleague Jamie Krist on March 31, 2015. Jamie served on the IIAI Board of Directors since September 2012. Jamie always brought new ideas, wisdom and humor to our meetings. He will be missed by many. My thoughts and prayers go out to his family. By the time you read this article the IIAI board will have been to Washington DC to discuss insurance issues with our legislators. This is always an essential trip with a jammed-packed schedule. We will have discussed Insurance Regulatory Reform, Flood Insurance and Natural Disasters, Crop Insurance, Healthcare, Department of Labor Fiduciary Standard and Risk Retention Act Expansion. We hope to report positive results. Washington DC is an exhilarating place. The excitement builds

as we witness presidential candidates throwing their hats in the ring for the presidential race. On the State of Iowa legislative side, IIAI has been monitoring and discussing some volatile issues. They include; a workers’ compensation bill, an electronic notice issue, an affiliate transfer issue and an auto insurance verification issue. These concerns have kept Bob Skow, Larry Blixt and Wes Bissett very busy this legislative session. They do an excellent job of protecting agent’s interests. All of these items could have a negative effect on agents if we don’t monitor them closely. As they say if you don’t have a place at the table, you are on the menu. This is a good reason to contribute to your state and national PACs. We need to support insurance friendly legislators. To all the members who have volunteered to serve on IIAI committees, I thank you. Your work is greatly appreciated. The IIAI needs your input. Trade Association It does not lack for challenge or opportunity
M
uch is going on at the National Association level, which really is to be expected. IIABA is the country’s leading agents’ trade association; as such, it does not lack for challenge or opportunity. To paraphrase an old expression, “the challenges for independent agents have never been bigger, and the opportunities have never been greater”. Prudent financial management is a critical priority for our Association, as it should be for any trade association. The message from the Finance Committee is a bit mixed: IIABA currently is a financially strong association, but we need to stay on our game and pay attention to what is going on around us to ensure long-term financial strength. Probably the best news for members is the ratio of dues revenue to non-dues (program) revenues. For fiscal year (FY) 2015, dues account for only 27.7% of total operating revenue. In other words, for-profit programs offered by Big “I” generate 72.3% of the operating revenue for FY 2015. This high percentage of non-dues revenue has allowed us to forgo dues increases for several years, and the Board voted to keep the dues formula unchanged into FY 2016. In the context of prudent financial management and ensuring appropriate

to seek out some level of information about insurance, and agents need to be present in that market. Google’s entry into the insurance market is just one more example of what could be a marketing game changer. More directs are starting to sell commercial line and new groups continue to enter the personal lines market seemingly daily. Big “I” and TrustedChoice. com are taking a hard look at this. The need for independent agents to co-brand with Trusted Choice®, and use the tools provided by Trusted Choice® and TrustedChoice.com has never been more important. TrustedChoice. com launched commercial lines on the agency portal in late 2014 and it seems to be finding success already. AgencyNation.com, which provides agent education resources in conjunction with TrustedChoice.com, also is another valuable marketing resource available to members. The passage of TRIA and NARAB II in January were major legislative victo-
ries for the Big “I” and the Government Affairs Committee and staff. We were very close to a marketplace disruption by having terrorism coverage either dropped from policies or offered only at highly inflated prices. Fortunately, this was averted. Although NARAB has finally passed, there is a lot of work yet to be done with implementation, and more information will be coming from IIABA on this. InsurPac experienced another successful year, exceeding the $1 million mark in 2014 for the second year in a row. The challenge now is to grow the PAC in 2015. Please remember to make both your state and national PAC contributions right away if you haven’t already done so. Advocacy efforts of the Big “I” extend beyond legislative work to include advocacy by many other programs, such as the Technical Affairs Committee and our company advocacy, which often go unnoticed. IIABA leadership meets with many compa-
nies throughout the year, advocating for independent agents. The Big “I” Office of General Counsel continues to review and advise on agency-company contracts, and to work to protect agents’ interests in contractual issues, such as ownership of expirations. The Technical Affairs Committee’s success working with ISO to resolve the “Where You Reside” issue in the Homeowners policy affects the entire insurance industry by eliminating a potentially catastrophic, and virtually hidden, coverage deficiency found in the definition of “Residence premises” in the HO policy. Creating Achievable Goals & Objectives by Al Diamond
E
very year Agency Consulting Group, Inc. helps agents create and implement their Tactical (Annual) and Strategic (Long Term) Plans for progressing their agencies’ growth and profitability. And, until an agency has planned for several years, the problems always involve ‘disconnects’ between long range goals, next year’s goals (the agency’s Objectives) and the activities that agency staff does every day to achieve those goals (Action Plans). Like magic, once the participants see the light and understand what they do on a daily basis impacts the agency’s annual performance as well as their own compensation, Long Term Goals seem to mesh with Annual Objectives and the staff clearly sees the difference between Objectives and Action Plans. Until that moment is reached, agency staff tends to lean toward activities instead of objectives and this muddies, rather than clears, the path to success. Strategic Goals for a business define where it wants to be after several years of development. Annual Objectives define what the business must do in a single, significant area of performance by the end of the year in question in order to progress toward its long term strategic goals. Action Plans are activities, the conduct of which will likely permit the achievement of the objective.
Benchmarks are the monthly measuring stick that estimates a measurable point at which the results should be each month if the action plan has been implemented and is working properly for the stated Objective.
THE TWO GREATEST PROBLEMS WITH MOST BEGINNER PLANNERS IS 1) Creating action plans without knowing the objective, and 2) Assuming that they have to create their own action plans without help when they have spent years not achieving goals through those same activities. Action Planning without first creating ROAM (Realistic, Objective (rather than subjective), Achievable and Measurable) Objectives are like shooting arrows with a bow one after another without having a target at which to shoot. Yes, you may be fast on the draw, but you may lose all your arrows and you have no idea where they are going to land. A really stupid game we used to play at camp when the counselors weren’t looking was shooting an arrow as close to straight up as we could and then scurrying about trying to avoid being hit by the descending projectile. The best I can say about that practice in my youth is that the surviving members of our little band of idiots are

now quite successful at each of their trades. But the reality exists that launching an arrow without knowing where it is going to land is both foolhardy and a wasted task. And so is creating and implementing action plans without having solid Objectives at which to “shoot” the action plans. The second thing that takes many individuals and groups years to comprehend is that they form a much greater mindpool combined than any one of them do individually. Every Objective gets an “owner.” That owner is not expected to complete the Plan or Action Plans on their own – they are just expected to manage the process to the end that every Objective is clearly stated and carries achievable Action Plans and reasonable Monthly Benchmarks. Yet for the first several years, each participant or each group feels that it is a personal failure if they can’t create workable Action Plans or Benchmarks without outside help. In fact, without asking others within their organizations whether it be the owners, managers, other staff members or asking outside the organization the consultants and other advisors for their input and feedback, they are doomed to repeat the same results achieved previously with only slight variations in ideas that they believed were viable in prior years. So if the results were not exactly what they desired, the new results were just as likely to fall short of desired levels.
The answer is to form the Objectives and validate them with as many people outside of the work circle as possible. Once you are comfortable that all involved buy into the Objective as reasonable (qualifying for all the ROAM criteria), then create whatever Action Plans you or your team can establish as likely to achieve the objective. Whether you can innovate to new action plans or not, test them with managers, owners and other staff members and counselors long before proposing them in the Strategic Planning meeting. Change and polish them until everyone you ask feels that the Action Plans a) can be done, b) will likely achieve the results in the Objective, and c) are properly cost-justified (how much with it cost vs. the benefit). This creative effort using ALL available resources give the Objective owner confidence in the reasonability of the Objective, Action Plan and Benchmarks and creates a feeling of synergy in an organization that has previously thrived on individual performance and blame. We are ALL involved in the success of the agency and we all drown if there is a hole in the ship – even if the hole is not in our compartment. Most agencies don’t foster synergy and sharing. Mature strategic and tactical planning fosters that and eliminates the defensiveness encountered in most small, closely held businesses.

“Our agency has a divorced couple living in two separate households. Both are insured by the same insurer on separate policies. The parents have joint custody of a 16-year-old son who is listed as a driver on the mother’s policy. The father recently purchased a vehicle for the use of his 16 year old son and we added the son to the father’s policy and attempted to remove him from the mother’s policy. The insurer will not delete him as a driver from the mother’s policy since he lives part time with her also. We do not feel this is correct that both parents have to be charged for a youthful driver. What do you think?”
A:
Your question begins with a rating issue but the real issue is coverage. First, let’s address the rating issue. This is from ISO’s personal vehicle manual: Rule 5 - Safe Driver Insurance Plan (SDIP) B. Procedural Rules 2. Drives subject to SDIP Classification The driving record of all drivers who customarily operate the autos being insured shall be used for the purpose of determining SDIP rating factors. The following exceptions apply: No surcharges are assigned for the convictions, accidents or years licensed of: a. A driver demonstrated to be a named insured or a principal operator of an auto insured under a separate policy.
b. A driver specifically excluded under a named driver exclusion.
Whether the insurer in question follows ISO rules to the letter is unknown. I’d provide this information to the underwriter and ask for the rating rule(s) they are relying on with regard to “customary operation” of an insured auto under the mother’s policy, along with any surcharges. However, rating is the least of your insureds’ worries based on the scenario you describe. Under the ISO PAP, the mother’s policy will not cover the kid while driving the car his father bought…it would only cover him while driving his mom’s car or possibly a nonowned auto not owned by him or furnished or available for his regular use. He would only have coverage under his dad’s PAP. However, the potential big problem for mom is this exclusion in her ISO policy: B. We do not provide Liability Coverage for the ownership, maintenance or use of: 3. Any vehicle, other than “your covered auto”, which is: a. Owned by any “family member”; or b. Furnished or available for the regular use of any “family member”. However, this Exclusion (B.3.) does not apply to you while you are maintaining or “occupying” any vehicle which is: a. Owned by a “family member”; or b. Furnished or available for the regular use of a “family member”. If mom is sued when junior kills somebody in the auto insured under his father’s PAP, mom’s own policy would not

cover HER because of this exclusion…she is only covered for such claims by her own policy if she is maintaining or using the auto. To further illustrate this point, let’s say the kid is staying with mom and has an accident that kills two people in another vehicle. Mom is sued based on parental liability, vicarious liability, or several other possible grounds. Read the exclusion above. Unless mom is maintaining or occupying the son’s car, HER own auto policy will not cover HER for the lawsuit. She would only be covered under the policy on which the son’s car is added (again, assuming ISO policy language). So she’d better make sure her son’s (i.e., dad’s) policy has high limits like (hopefully) her own. Our national Technical Affairs Committee has asked ISO to revise this exclusion and the exception so that “you” under the policy still has coverage at least for the vicarious liability of “family members.” These types of wacky situations happen far more often than you might be aware. Last year, we had a situation
similar to this involving a child living with grandma and step-grandpa where the latter had a driver exclusion endorsement on grandma’s policy. I won’t go into the complex details but the end result was that the kid negligently caused multiple fatalities in a wreck and EVERYBODY was sued. Aside from grossly inadequate limits, step-grandpa had no coverage under any policy, including his own, and had to provide his own defense. There are a number of VU articles related to this, including Joint Custody Insurance Issues and Kids’ Cars and Divorce.
