It’s called a home structure policy, which covers fire, water, storm, arson and earthquake damage and then of course there’s Third Party Liability. Q. How do we go about insuring our possessions? A. We send an assessor to your home. An assessor will catalog all your possessions including: jewelry, furniture, paintings, clothing etc. He then issues a detailed English-language report that becomes the basis of the insurance contract. Q. Is it possible to only insure high-end, expensive items? A. I’m afraid not, the insurance policy requires you to insure both high-risk and low-risk items.

It wasn’t 100% clear but it was enough to get an initial payment of 92,000 shekels! (We are still attempting to collect this amount). Moral: Don’t ever despair – not in insurance and not in life! 2. Q. Who deals with the claim? A. Our office of course! We will take you through all the necessary steps including: arranging a claims assessor, a police report, and negotiating with the insurance company—we ensure that you receive payment promptly. FAQS
Q. Can we insure jewelry, when we travel overseas? A. Sure, but you must let us know beforehand. The jewelry will be covered under the same conditions under which they are protected in Israel. Q. Our dog bit a visitor (ouch!) and he’s suing us. Is this covered? A. This is covered under your Third Party Liability Insurance (unless the dog is regarded as a dangerous breed, e.g., a Rottweiler!)
CLAIMS TO REMEMBER 1. A CLASSIC CASE TO RULE THEM ALL
Our client owned a large amount of jewelry. The insurance company required that the client secured said jewelry inside a safe and they needed an alarm system connected to two cellphones. The jewelry was in the safe, but the alarm was not working! One day, when the family had all left for school or work, burglars broke into the house and simply removed the entire 65 kg safe! The insurance company’s assessor checked out the circumstances and finally came to the conclusion that the protection requirements had not been met (which was true!). The company turned down the 180,000-shekel claim. We, as the agents, tried to find any way to prove that the insurance company should at least pay some of the money. Our clients did have a heavy safe, even though their alarm was not working. We searched insurance claims and found a classic case (Slutzky vs. Chatamei Lloyds). This case, which went to the Supreme Court, laid down the following rule: If the insurance company had insured other clients in the same
Our client insured an expensive pair of tefillin (+/- $4,000) for All Risks cover (i.e. both inside and outside the house). He called us frantically one day to report that the tefillin were missing from his yeshiva. A week of posted notices and calls to the yeshiva administration did not bear fruit. Reluctantly, our client reported the case to the police and we filed a claim. The claims check was issued and our client bought a new pair of tefillin. (This time, however, he kept them at home). One day, during the silent amida, our client’s concentration was broken by someone behind him placing—you guessed it—his old tefillin on his shtender! By the time he turned around, only davening yeshiva men could be seen. Obviously, these tefillin no longer belonged to him. He hurried to our office to return them. I, in turn, took them to the insurance company and told the whole strange story. Results: 1) A huge Kiddush Hashem. 2) The manager promptly asked me to offer the “old” tefillin back to our client at a greatly reduced rate. When I had called our client, he had just celebrated his first son’s brit milah, and he was more than happy to buy the baby’s bar mitzvah tefillin a few years early! 3. ACCIDENTS AT WORK, AT HOME
Mrs. S., an ozeret, a cleaning woman, had worked for the Lowy family for five years. In 2010, before Pesach, she climbed a ladder to take the curtains down for cleaning. Unfortunately, she fell and broke her ankle badly. After medical treatment, Bituach Leumi classified her as having a 27% lifetime disability. She put in a claim against the Lowy family. Unfortunately (again), the Lowys did not have insurance and took the case to court claiming that Mrs. S. had been negligent in climbing up and slipping. Upon closer investigation, the ladder itself was found to have been unstable—a fact which was known to both Mrs. S. and the Lowy family. The judge found the Lowys liable for 65% of the claim and Mrs. S. for the balance. LESSONS TO LEARN
1) Make sure you have home insurance which usually includes coverage for an ozeret. Ask your broker for details if you’re uncertain whether you have this cover or not. (Don’t forget, you must pay towards Bituach Leumi and a pension for your ozeret.) 2) If you ask your ozeret to do something out of the ordinary, make sure all the appliances and tools she will use are in working order. Reality or Castles in the Sky? There are many elements in the purchase of residential property that demand careful exploration. The most crucial and definitive question is how to secure not only enough, but also, the right kind of financing. BANK OF ISRAEL’S RESTRICTIONS AND SOARING PROPERTY PRICES – BACKGROUND OF MACRO-ENVIRONMENT In recent years the real estate market has experienced a sharp rise in property values that is disproportionate to other economic parameters. This has possibly been prompted by a delay in new building initiatives in Israel, plus a zero-interest rate environment that has encouraged the aggressive entry of investors into the Israeli real estate market. In 2009 the Bank of Israel introduced new regulations to significantly limit mortgage loans for home buyers, while previously, regulations had permitted the buyer to provide only 10% of their own capital subject to credit insurance. Higher property prices means a higher mortgage loan and more own capital, which poses an obstacle for many potential home-buyers. Today a number of steps are being taken to restrain investor demand and promote property

The New Rules of Real Estate Taxes Toward the end of 2013, significant changes were made in real estate tax laws in Israel and we entered a four-year “transition period” that has now come to an end. I suggest that you gain some familiarity with these rules—if only to ensure you seek out expert advice before committing yourself to any kind of real estate deal. PURCHASE TAX (MAS RECHISHA) Purchase tax is a tax paid by the buyer. For some time now, purchase tax has been considerably higher on the purchase of a second apartment than on the purchase of a first and only apartment. The tax on a first apartment only applies to the part of the purchase price over 1.6 million NIS, starting at 3.5% and getting progressively higher. The tax for a second apartment is 8% and is calculated from the first shekel. If you are not a resident of Israel, you will pay the higher tax rate even when buying your first apartment, since it is assumed that you own property wherever you’re living. You will receive the “first apartment” discount only with proof from your local tax authorities that you do not own property in the country in which you reside. It is difficult to acquire such proof in most countries (in the United States, it’s not possible). It should be noted that the status “resident of Israel” does not require you to be a citizen.

For example: Yossi bought an apartment on January 1, 2000, for one million NIS, and sold it May 1, 2016, for 2.2 million NIS. The capital gain, therefore, is 1.2 million NIS. The capital gains period is 16 years, plus 4 months for a total of 196 months. We divide the 1.2 million NIS capital gain by 196 months, and we get a capital gain of NIS 6,122 per month. Since you are required to pay for the increase only from January 1, 2014, in our case that’s 28 months (2 years + 4 months), we multiply 6,122 by 28 and we get NIS 171,416, which is the applicable capital gain. Yossi will pay 25% of that, NIS 42,854. Again, as we get further away from January 2014, the applicable tax will be higher.
CAPITAL GAINS TAX (MAS SHEVACH) This is the tax paid by the seller of a property, assuming the property has gone up in value since it was first purchased. This increase in value is known as capital gains. You are eligible for an exemption from this tax if you do not own more than one property (and did not own more than one in January 2014, which was the cutoff date). If you own only one property and have owned it for at least 18 months, you are eligible for the tax exemption and you may sell your property without paying capital gains tax (up to a sale price of 4.5 million NIS). If you own more than one property, you will not receive this exemption when you sell. And, as with the purchase tax, any non-resident is assumed to be an owner of property in the country in which he resides, unless he can prove otherwise (again, this is difficult to do). Therefore, almost all non-residents will have to pay capital gains tax when selling property, even if they own only one property in Israel. The capital gains tax is a whopping 25% of the capital gain, but the estimated increase in value is counted only from January 2014. So, if you bought an apartment 15 years ago and it has since doubled its value, you will only pay taxes on part of the capital gain. As time goes by, however, and we get further away from January 2014, you will be

DOUBLE ARNONA (PROPERTY TAX) Arnona is the annual property tax paid by an apartment owner to a municipal (city) government. (If the apartment is rented out, most often it’s the tenants who will be paying this tax.) The Knesset recently passed the “Double Arnona” law. As we all know, there are many empty apartments in Jerusalem and throughout Israel. Some are used occasionally during chagim or other vacation times, while others remain completely unoccupied for long stretches of time. The government believes that this is one of the reasons for the shortage (and therefore high prices) of apartments both for sale and for rent. The plan is to charge double Arnona for all apartments not occupied at least 90 days per year, thus encouraging owners to rent out their empty apartments or even sell them, if they are not using them. I’ve tried to present you with a brief overview of the current real estate laws in Israel. These laws have a tendency to change from time to time, often to our disadvantage and without much warning. Obviously, there are nuances and details which cannot be covered properly in a short article. It’s crucial to consult with a professional, well in advance of any real estate-related transactions. Do not wait until the last minute, when you have already come to a verbal agreement on a sale, purchase or even rental.

Got Mortgage? Do you have questions or need help financing a home in Israel? If your answer is yes, it’s best to start by estimating what mortgage amount you will qualify for. WHAT THAT MEANS DEPENDS IF: A. YOU ARE BUYING A HOME (regardless if you own one now or not) B. YOU ARE REFINANCING A PROPERTY you already own to pull out cash, to get a better interest rate, or to lower your payment BUYING A HOME – CASH DOWN PAYMENT The two key factors, which are ratios, expressed as a percentage of the property value: Loan to Value (LTV) and the down payment, need to total 100%. The LTV you qualify for will dictate your minimum down payment. We will discuss the LTV in detail below. The first step is to consider how much money you have access to for a down payment. In most cases, a down payment of 30% of the purchase price is the minimum you need to get a mortgage (25% is possible for financially strong borrowers who are Israeli citizens and have the income to qualify; 50% is the Minimum Down payment for non-citizens). A 30% down payment can come from your own funds, a parental gift or the proceeds of a mortgage on a property you own (assuming sufficient equity to qualify). CREDIT HISTORY The bank checks if you make payments on time and how much your total monthly payments are. A bounced check in Israel is a major issue; a few recently bounced checks can prevent someone from qualifying for a mortgage. A returned horat keva is also problematic (but not as much). Banks will often ask new olim to see their credit report and credit score from their country of origin. INCOME In the majority of cases, your monthly payment should be less than a third of your documentable, net, post-tax income. The banks will check your income from the last 24 months at least; income needs to be consistent, with certain exceptions, e.g., an attorney who recently finished their internship or a doctor who recently finished their residency. If your income is not quite enough in some cases a co-borrower or guarantor can help get you qualified. Guarantors are usually parents who have Israeli citizenship. Co-borrowers are spouses or parents—siblings qualify in certain situations. Co-borrowers and guarantors both need to meet the income guidelines. 20 I YourHome I 2018-2019 I www.YourHomeGuide.biz
PROPERTY VALUE The Loan to Value or LTV is the ratio of the loan amount divided by the property value, expressed as a percent. Government regulation determines maximum ratios and value. In general, Israeli citizens who have only one property are allowed up to 75% LTV, while 50% LTV is the maximum for Israelis with multiple properties and foreign citizens. The value is defined by a bank approved appraiser or purchase price, whichever is lower. Appraisers are required to deduct illegally built rooms from value.

REFINANCING A HOME – EQUITY All of the above apply, however, it’s the equity in your property expressed as a percentage that matters, not the cash you have available. The equity is calculated by dividing the current amount you owe on your mortgage by the property’s current value. A refinance that only replaces the existing mortgage i.e., you’re not getting any cash out of the property, is eligible for the maximum LTVs mentioned above. If you are getting cash out of the refinance, then you add the current amount you owe on your mortgage to the amount you want to borrow, and divide that by the property’s current value. In that case your maximum LTV is 50%. The value as defined above is established by an appraiser. So, remember your, cash or equity, credit history, income and property all have a significant effect on your mortgage qualification. The next stage is understanding which of the many possible combinations of mortgage terms in a multi-term mortgage is best suited for you. In other words: once you know what the banks will give, you need to understand how to decide what to take. Local projects include: Shorashim and Beit Ha-Baal Shem Tov event centers in Jerusalem; complete stripping and redesign of interiors of various properties in Jerusalem including an old house in the German Colony and apartments in Rechavia; planning of layout and interior design for an apartment still under construction in the Antenna Hill project in Jerusalem’s Beit Vegan neighborhood; multi-family housing in Nachal Uriya in Ramat Beit Shemesh Alef; store design for Gifts Are Us; and various construction projects in Ramat Beit Shemesh Bet. Accessible home design gives Anna a special sense of satisfaction. This unique niche entails the modification of interiors to enable independent living for persons with disabilities. Accessibility is achieved
through architectural design, and by integrating features such as wheelchair accessibility, handrails and grab bars, as well as providing for mechanical or electronic devices used by disabled persons for easy use of appliances, sinks, bathtub, etc. “One such project was for a disabled woman in Yokne’am, in the North. Another client in Israel’s central region worked with me to adapt an entire floor of their home for their special-needs child. The family wanted to have a comfortable place to raise their child that would take into account both the family and their child’s specific needs. A central part of the project was the design of a unique room for the child with specialized facilities. It’s a field that’s both challenging and meaningful.” Anna offers clients comprehensive planning services. Clients present a plan of the building and Anna reviews the area, location and structure and goes over their wish list. “The initial meeting is spent getting to know the client. I make notes of their preferences and tastes, and of course, their specific practical needs. Next I draft a digital sketch of all the options so that my clients can understand everything and use the information to make decisions.” After a client has decided to work with Anna, she prepares a work plan for each element of the renovation or addition, and submits them to the relevant professionals, such as building contractor, engineer, electrician, plumber or installers for air-conditioning. “I provide all contractors with a comprehensive plan but I am still responsible for supervising and monitoring the quality of their work and their progress.” Anna works largely with the religious and charedi sectors of Israel’s population. Large families often live in small apartments and require a living space that can accommodate everything they need, including a kitchen with meat and milk sections (and often storage for Pesach utensils), children’s rooms that allow privacy for each child, and ample storage space. “Designing the kitchen layout in frum homes is a like doing a large puzzle with very small pieces,” Anna admits. “It requires double of almost everything for meat and milk, which means more food preparation surfaces, two of some appliances, and more storage space.” Living rooms are usually dominated by a dining room table which is usually disproportionally large to the space it occupies (and would literally push the room’s boundaries when extended for large gatherings and yom tov meals!). A place of honor is also designated for a bookshelf, to hold sifrei kodesh, siddurim and machzorim as well as various silver crafted items such as kiddush cups, havdallah sets, candlesticks and other ritual objects. Sometimes there is very little room for a family sitting area or other “luxuries.” Anna sees space constraints as an inspiration for particularly creative solutions. “Clever and appropriate utilization of space is complex when space is limited but is sometimes even more challenging when the area is particularly large, such as a split-level home where the separation between the living and private areas interferes with natural interaction between family members. We can avoid wasted space and remedy these issues through proper planning.” Anna plans her projects with an initial emphasis on functionality, and then incorporates aesthetics at a later stage. However, she believes that these two elements must work in tandem, even for clients in frum communities who have a budget to stick to and whose ideals mean maintaining a modest home. Her approach is one that places an importance on aesthetics without being ostentatious. There’s great value in creating a beautiful and gracious living space, that imbues a home with a unique and warm atmosphere, and can be enjoyed by all family members, especially the women who manage the house and spend a good deal of time there. Anna smiles: “I’ve seen the joy clients feel when they move into their renovated home. WHILE IT’S A LOT OF FUN TO LOSE YOURSELF ON PINTEREST FOR HOURS LOOKING AT PICTURES OF SPECTACULAR KITCHENS, daydreaming alone won’t get you the kitchen of your dreams; that takes careful planning, designing, budgeting and professional implementation. Your very first step is to go to a reputable kitchen center where you will be assigned to one of their experts or designers. Most kitchen centers are more than just a place to buy counters and sinks. Some offer everything from design and construction, to help with procuring permits and financing for your project. Your designer will be the one to guide you through your project from start to finish. What follows are just some of the things the team at your kitchen center can do for you. WHAT ARE YOUR NEEDS? What will function best for your family in terms of cooking and dining? Are you looking to just upgrade your appliances, floors or counters? Or do you hope to gain more storage space? Do you need to gut the whole thing and start from scratch? Identifying exactly what you want to achieve is the most crucial step in any project, especially one as major as a kitchen renovation. A good kitchen designer will not rush you in this vital stage. Even if it takes a few weeks to map out a plan it’s time well spent; as it will save you from embarking on aspects of the project you may not need or can’t afford. Later, they can also help you choose everything from practical finishes and functional fixtures to furniture and appliances. Communicate any specific appliance needs you have; this will make sure that there’s room for size or door openings in the plans. The design team might ask you to visit the appliance store first if you’re unsure what’s on offer. If you dream of a display piece appliance, you need to tell your designer at this stage. THE BUDGET Once you have thoroughly identified your needs, it’s time to meet with your designer again to figure out the project’s cost. Come to the meeting well-prepared by figuring out exactly what you are willing to spend. Keep in mind that with big projects like this, costs can sometimes escalate. Unexpected things can come up; you may need to reroute pipes, there may be a necessity for more extensive electrical work than was originally quoted, and then certain cheaper materials may now be unavailable. Budget to cover for the unexpected. Your designer should be able help you put together a design that is both functional and within your budget. For bigger projects, your kitchen center will help you decide if you also need an architect, a contractor or even an interior designer. Your kitchen designer is a source of information as to who needs to be brought in to carry out the work, and can recommend professionals that have a proven track record. One big mistake people make is attempting to save money by not hiring professionals. They enlist friends, or acquaintances, because they are “good with their hands” or “in their first year of design school.” This will often backfire, and will eventually end up costing more to fix. faults in your own home’s various systems – such as your plumbing – you are still at the mercy of the shared infrastructure that brings these utilities into your and your neighbors’ homes. This is particularly relevant to communal water pipes in an apartment block or townhouse, and the question of determining who is required by law to pay for maintenance or repairs. Ariel Baror, CEO of Master Plumbing and an experienced plumbing contractor and consultant, tells us how it works. THE PROS AND CONS OF COMMON PROPERTY “Certain types of plumbing problems occur in buildings that have been around for twenty years or more due to wear-and-tear from long-term use, or corrosion,” says Ariel. “But in recent years, the high-volume growth and popularity of residential towers in Israel has led to a series of new challenges.” While newer buildings should comply with the most stringent standards in plumbing and water systems, there is an increased likelihood of plumbing problems. This is either due to residents’ flushing various hygiene items down the toilet, structural settling or building residue. The problem is further exacerbated by the complexity of more advanced systems and the introduction of water pumps, as well as extensive use of the system by a large number of residents in each building.

STILL WATERS RUN DEEP Most plumbing problems don’t develop overnight. Usually they begin with a slow and continuous leak, which silently and gradually corrodes the infrastructure, leading to its deterioration. One fine day, a pipe bursts or a drain is blocked and the damage to your property and your pocket can run pretty deep. So what should you do if you begin to notice the tell-tale damp stain on your ceiling or suddenly find yourself mopping up a flooded bathroom? “The first thing to do is contain the damage. Close the water mains and clean up what you can. Then contact the relevant party (vaad bayit or neighbor) as soon as possible.” But how exactly can one diagnose the source of the problem and determine who is responsible for repairing and paying for the damage? VAAD BAYIT AND OTHER PROFANITIES The vaad bayit is a superintendent committee usually voted in by a building’s residents which manages all common ownership aspects of a property (although most vaad bayit members would claim they were held at gunpoint until they acceded to the position). By law, the vaad bayit is obligated to repair any problem in communal property. Communal property in plumbing terms is defined as all pipelines between the municipal infrastructure (contracted water and sewage companies), the building, and each apartment’s private water meter. The law states that this includes all areas of a building – the stairwell, roof, miklat, external walls and water facilities designated for the building as a whole – but not the apartments themselves. Regular wear-and-tear, poor maintenance or negligence can lead to
problems in a building’s plumbing infrastructure. “Everything that is flushed from one individual apartment could at some point block the entire building’s sewage system,” Ariel says. “The best remedy for any problem is prevention. Periodic maintenance, comprehensive insurance and sufficient levy funds can help to alleviate the high costs involved in repairing unexpected problems,” is his advice. A good, onthe-ball vaad bayit will make sure to have a plan of action for events that can’t be predicted in advance or prevented altogether, such as a burst pipe or sewage blockage. In Israel, often a number of buildings on a block were built at the same time and by the same contractor and marketed as a “building project.” Creating an alliance with other vaad bayit committees on the same block can be valuable. “You can even examine the option of jointly paying for a sewage truck to do maintenance work every few years on the pipelines shared by the buildings on the block, to intercept and prevent future problems.”
UNDER PRESSURE One of the most frustrating problems is low or no water pressure. It’s one thing to wash your hands under a trickling faucet, but it’s another to be covered in soapy suds with only a thin stream of water to rinse yourself off. “It’s worth checking first if all the apartments in your building are experiencing the same problem, even though this is uncommon today since most local authorities have already replaced the central plumbing in most buildings and water pressure is much better,” says Ariel. “If after investigation it turns out to be a shared problem, there are efficient and affordable ways to fix water pressure, and all residents share the cost.”
