Federal Court Extends Block on 3D-printed Gun Blueprints By German Lopez

A

federal judge in Seattle on Monday recently extended a previous block on the publication of controversial 3D-printed gun blueprints, imposing a preliminary injunction in the case. US District Judge Robert Lasnik’s order blocks the federal government from allowing the publication of 3D-printed blueprints that detail, among other things, how to make a fully 3D-printed firearm — which experts and advocates worry would open the door to a new wave of easily accessible, untraceable guns. After the federal government agreed to allow the publication of the blueprints, several state governments sued to reimpose the federal block. In his new order, Lasnik wrote that “the States will likely suffer irreparable injury if the technical data for designing and producing undetectable weapons using a commercially-available 3D printer are published on the internet.” The court had already issued a restraining order last month, which this preliminary injunction effectively extends. Since making a 3D-printed gun only requires a 3D printer, the right materials, and a blueprint, the concern is that 3D-printed guns will make it easy to bypass a host of state and federal laws. Printing a gun doesn’t require a background check or any documentation, offering a workaround for people who are legally prohibited from

microfabricator.com buying a gun now due to, say, a criminal record or a history of mental illness. A 3D-printed gun can also be made without a serial number or anything that would make these firearms easily traceable if they’re used in a crime. The wide release of the 3D-printed gun blueprints, however, has only become an issue now in large part due to President Donald Trump’s administration. The previous administration, under President Barack Obama, had forced libertarian Cody Wilson to stop publishing these blueprints on his website, Defcad.com. Wilson sued the administration in hopes of republishing his schematics. The case seemed like an easy win for the government, with multiple courts initially ruling in the government’s favor. But once the Trump administration came in with its gun-friendly politics, the Justice Department abruptly agreed to a settlement — giving Wilson and

his nonprofit, Defense Distributed, “essentially everything they wanted,” Andy Greenberg reported for Wired. The deal allowed Wilson to publish his blueprints starting in August and paid him $40,000 for his legal costs. The federal court, however, put Wilson’s plans on hold. The court argued that the burdens placed on Wilson’s First Amendment rights by not allowing him to publish the blueprints weren’t sufficient enough to overcome the public interests in the case — at least until the litigation proceeds. “The Court finds that the irreparable burdens on the private defendants’ First Amendment rights are dwarfed by the irreparable harms the States are likely to suffer if the existing restrictions are withdrawn,” Lasnik wrote, “and that, overall, the public interest strongly supports maintaining the status quo through the pendency of this litigation.” It remains unclear what happens

next. Will the district court’s order survive appeals? And even if the court’s order holds up, how long can the government really stop 3D-printed guns from becoming mainstream — given that the internet has, from piracy to blueprints for other kinds of

weapons, always found a way to quickly spread information? In fact, there already are websites hosting 3D printer designs for guns, and sites dedicated to hosting Wilson’s files, even as Wilson’s own ability to republish the documents is held up in court.

resident Donald J. Trump welcomed President Uhuru Kenyatta of Kenya to the White House today. In marking 55 years of diplomatic relations between the United States and Kenya, and in recognition of the growing scope and depth of the engagements between the two countries,

the leaders resolved to elevate the relationship to a Strategic Partnership, affirming it as a cornerstone of peace, stability and good governance in Africa and the Indian Ocean region. This United States–Kenya Strategic Partnership will include an annual dialogue to advance mutual prosperity.

President Trump commended the Kenya Defence Forces for their service and sacrifice in combatting al-Shabaab and ISIS in Somalia. President Trump also lauded Kenya for taking a leading role in the East African fight against terrorism and for its sustained dedication to this effort. The leaders reaffirmed and strengthened their commitment to continued counterterrorism cooperation against violent extremists who seek to take innocent lives and deny fundamental human rights. To further enhance this counterterrorism collaboration, President Trump welcomed Kenya’s decision to join the Global Coalition to Defeat ISIS. President Trump also thanked President Kenyatta for his diplomatic efforts to bring peace to South Sudan and to the region more widely. The leaders pledged to deepen defense and security cooperation, building on the recent acquisition of military equipment made in the United States and committed to further enhance Kenya Defence Forces capabilities. Further, the United States pledged to strengthen Kenya’s national disaster and crisis response capacity. President Kenyatta thanked President Trump for the United States’ continued support of the Kenyatta administration’s efforts towards greater accountability, transparency, and institution building. As democracies committed to a rules-based international order, the United States and Kenya share a common vision for free and open societies. The leaders committed to expand their economic cooperation aimed at making their nations stronger and their citizens more prosperous. In this regard, President Trump thanked President Kenyatta for hosting the United States delegation of the Advisory Council on Doing Business in Africa. To further enhance the economic partnership, the two leaders agreed to establish a United States–Kenya Trade and Investment Working Group to explore ways to deepen ties between the two countries. Further, the Presidents are pleased to announce that their governments established direct flights between Nairobi and New York City, a move that will expand the economic and cultural ties between the two great countries. Andrew Gillum Wins Major Upset in Florida Democratic Governor Primary From Max Greenwood

allahassee Mayor Andrew Gillum, a progressive aligned with Sen. Bernie Sanders (I-Vt.), pulled off a stunning win in Florida's Democratic gubernatorial primary on Tuesday, edging out former Rep. Gwen Graham (D-Fla.). Gillum won the primary with 34% of the vote, the Associated Press projected with 87% of precincts reporting. Graham, the daughter of former Sen. Bob Graham (D-Fla.), won 32% of the vote. The come-from-behind win defied expectations and is bound to invite comparisons to the win by progressive star Alexandria Ocasio-Cortez, who stunned the political world in June by defeating established Rep. Joe Crowley in a New York Democratic primary. Most recent public polls showed Gillum in third place, trailing Graham and former Miami Beach Mayor Philip Levine for the Democratic nod to replace Florida Gov. Rick Scott (R). Gillum lagged in fundraising and was slow to launch television ads in a state where such spots have traditionally been highly valued by political campaigns. But in the final weeks before Tuesday's primary, Gillum won the endorsement of Sanders, who campaigned alongside the Tallahassee mayor in Tampa and Orlando. Gillum also brought in other highprofile surrogates, including Khizr Khan, the Gold Star father who rose to fame during the 2016 Democratic

And he earned a number of highprofile celebrity endorsements, ranging from actor Alec Baldwin to Jane Fonda, while receiving financial backing from Democratic mega-donors Tom Steyer and George Soros. Gillum and his aides and advisers touted the mayor's campaign as a grassroots movement that would energize progressive Democrats in November. For too long, his campaign argued, Democrats had run middleof-the-road candidates that failed to excite the base, effectively locking the party out of the governor's mansion for two decades. Like Ocasio-Cortez, Gillum run as an unabashed progressive. The 39-year-old mayor fashioned

himself as a progressive in the vein of Sanders, preaching the virtues of "Medicare for All" and a $15-perhour minimum wage on the campaign trail. Gillum, however, endorsed Hillary Clinton weeks ahead of the state's 2016 presidential primary. Clinton went on to win the state handily over Sanders. Gillum will face off against Rep. Ben Jealous wins Maryland Democratic Primary Race for Governor By Erin Cox and Luke Broadwater

ormer NAACP chief Ben Jealous won Maryland’s Democratic primary for governor, promising to deliver a progressive agenda that makes college free, legalizes marijuana and raises the state’s minimum wage to $15 an hour. Bolstered by support in the Baltimore region, spending from outside groups and an aggressive union-backed turnout machine, Jealous emerged from the six-way primary as Democrats’ bet to take on popular Republican Gov. Larry Hogan in November. “Our goal is to not just win an election but to build a movement, which will allow us to lead into law the new agenda that this state so desperately needs,” Jealous told supporters at his Baltimore victory party. Maryland has never elected an African-American governor, and Jealous’ victory is just the second time the state has nominated a black man for the job. In his victory speech, Jealous spoke of a young Baltimore boy who said he’s seen too many people die, a teenage girl from the Eastern Shore who said she’s buried three classmates from the opioid epidemic, immigrants whose children wake up in a cold sweat and workers with multiple jobs who fear economic insecurity.

“This campaign is about seizing the moment to build a movement to make sure that everyone moves forward, no matter what happens in Donald Trump’s Washington,” he said. Jealous and his running mate, former Democratic Party chairwoman Susie Turnbull, cast themselves as community organizers and promised to aggressively turn out voters in November. A decade ago, Jealous, at 35, became the youngest person to lead the national NAACP, reviving he organization and reestablishing it as a national political force. During his tenure, Jealous became a leading force behind referendums to uphold same-sex marriage and in-state college tuition for students who are in the country illegally. He helped persuade former Gov. Martin O’Malley to push to repeal Maryland’s death penalty. Jealous, now 45, is a Rhodes scholar and, for the past several years, has worked as a venture capitalist at Kapor Capital. He wants to make Maryland the first state to adopt its own single-payer health care system. He wants to reduce the state’s prison population by 30%, and wants tuition-free education at its public colleges and universities. He proposed a 29% pay increase for Maryland teachers — whose union endorsed him — plus legalizing marijuana and dramatically increasing spending on K-12 education. Jealous, at his victory party, told supporters gathered at The Reginald F. Lewis Museum of Maryland African-American History & Culture that his win was a referendum on GOP leadership. Ayanna Pressley Could Become the First Black Woman Massachusetts Sends to Congress By Steve LeBlanc / AP

yanna Pressley is all but assured of becoming the first black woman elected to Congress from Massachusetts, the latest example of the Democratic Party’s embrace of diversity and progressive politics as the recipe for success in the Trump era. The 44-year-old’s upset victory against longtime Democratic Rep. Michael Capuano in Tuesday’s primary sets the stage for Pressley to represent an area once served by Tip O’Neill and John F. Kennedy. Greeting voters at a Boston polling station, Pressley spoke of “the ground shifting beneath our feet and the wind at our backs.” “This is a fight for the soul of our party and the future of our democracy,” she told reporters. “This is a disruptive candidacy, a grassroots coalition. It is broad and diverse and deep. People of every walk of life.” For Pressley, as with many other ascendant candidates of color, unabashedly progressive

Pressley backs Medicare-forall, the single-payer healthcare proposal, which helped her garner backing from Our Revolution, the offshoot of Vermont Sen. Bernie Sanders’ 2016 presidential campaign. Pressley called for defunding the federal Immigration and Customs Enforcement agency, known as ICE. “We have to be disruptive in our democracy and our policymaking and how we run and win elections,” she said in an interview this summer with The Associated Press, adding that Ocasio-Cortez’s victory challenged “narratives about who has a right to run and when, and who can win” in American politics. “My mother did not raise me to ask for permission to lead,” she added. Pressley tapped into growing cries within the Democratic Party for newer, more diverse leadership. She and Ocasio-Cortez both defeated older, white congressmen who were reliable liberal votes, but who didn’t look like many voters in their districts. The district she’s competing in includes a wide swath of Boston

and about half of Cambridge as well as portions of neighboring Chelsea, Everett, Randolph, Somerville and Milton. It includes both Cambridge’s Kendall Square — development there is booming — and the neighborhood of Roxbury, the center of Boston’s traditionally black community. Pressley has bristled at the notion that race was a defining issue in her campaign. “I have been really furious about the constant charges being lobbed against me about identity politics that, by the way, are only lobbed against women and candidates of color,” she said in one debate. “I happen to be black and a woman and unapologetically proud to be both, but that is not the totality of my identity.” In nearby Connecticut, Jahana Hayes is on track to become that state’s first black woman to win a congressional seat if she prevails in November. California Becomes First State To End Cash Bail After 40-Year Fight By Vanessa Romo

alifornia will become the first state in the nation to abolish bail for suspects awaiting trial under a sweeping reform bill signed by Gov. Jerry Brown. An overhaul of the state's bail system has been in the works for years, and became an inevitability earlier this year when a California appellate court declared the state's cash bail system unconstitutional. The new law goes into effect in October 2019. "Today, California reforms its bail system so that rich and poor alike are treated fairly," Brown said in a statement, moments after signing the California Money Bail Reform Act. The governor has waited nearly four decades to revamp the state's cash bail system. In his 1979 State of the State Address, Brown argued the existing process was biased, favoring the wealthy who can afford to pay for their freedom, and penalizing the poor, who often are forced to remain in custody. "Our path to a more just criminal justice system is not complete, but today it made a transformational shift away from valuing private wealth and toward protecting public safety," Sen. Robert Herzberg, a co-author of the bill, said in a statement. "California will continue to lead the way toward a safer and more equitable system." Washington, D.C., already has a cashless bail system. Other states, including New Jersey, have passed laws that reduce their reliance

on money bail. And other states are considering making similar changes. Under the California law those arrested and charged with a crime won't be putting up money or borrowing it from a bail bond agent to obtain their release. Instead, local courts will decide who to keep in custody and whom to release while they await trial. Those decisions will be based on an algorithm created by the courts in each jurisdiction. In most nonviolent misdemeanor cases, defendants would be released within 12 hours. In other instances, defendants will be scored on how likely they are to show up for their court date, the seriousness of their crime, and the likelihood of recidivism. Some people could be released on other conditions, including monitoring by GPS or regular check-ins with an officer. The goal of the legislation is to eliminate human bias in court proceedings, but critics argue the new system that will be created by the courts runs the risk of perpetuating discrimination. Meanwhile, the American Civil Liberties Union of California, an original co-sponsor of the bill, pulled its support, arguing that last-minute changes give judges too much discretion in determining under what circumstances people will be released or kept in custody. "We are concerned that the system that's being put into place by this bill is too heavily weighted

toward detention and does not have sufficient safeguards to ensure that racial justice is provided in the new system," the ACLU's Natasha Minsker told NPR, Raj Jayadev, co-founder of advocacy organization Silicon Valley De-Bug, said like the ACLU, his group is a former supporter of the bill. Ultimately, as it is written, he told the Sacramento Bee, the law discriminates against the poor. "They took our rallying cry of ending money bail and used it against us to further threaten and criminalize and jail our loved ones." And there's the end to the state's bail bond industry. "We're gone. We're done. As of today the bail industry will start shuttering their doors," Topo Padilla, President of the Golden State Bail Agents Association told NPR. The Wall Street Journal reports that that could affect 7,000 jobs, though Jeff Clayton, president of the American Bail Coalition, told NPR station KQED that it's likely that the bail industry will sue, putting the law on hold. Padilla contended the law is bad for the people of California. When you are just getting started: You are going to get a lot of advice from different people. Many times that advice will be conflicting. You know your business best and you can't take every person's opinion into account. • Underpromise, overdeliver. • Build something that's a painkiller, not a vitamin. The most important aspect is to get started working on something and to listen to customer feedback. • Talk to your customers as early as possible and listen to them. • Release MVPs (minimum viable product) fast and iterate. • Focus on a single metric if you are looking to fundraise (seed round), no need to optimize for all metrics in the first round. One metric that is "killing it" is enough, for us that was shipping volume. • Make founder friends, they can relate and you can learn from each other.

When you are scaling: • There's no need to reinvent the wheel. Sometimes, there are playbooks for things. You can gain experience by working with people who have done it before and made their mistakes. Don't be scared to work with people a lot more experienced than you, they are key to building and scaling a company. Hire people who are smarter than you. • Your role will change from a doer to a manager. That is really hard for most founders. To empower other people to be able to do their jobs, you'll need to let go and trust them. • Trust your team members. Everyone comes in with a "trust battery" that's fully charged and it can go down and up again depending on how people perform. But don't hire people and make them prove themselves. • "Culture" is not a fluffy word. My co-founder thinks culture > strategy. Culture helps people make decisions when there is no one watching over their shoulders. Verbalize and formalize your values as early as possible. • Investors work for you. They are your team members that you can't fire. Choose to work with investors that you have vetted and then don't be scared to ask them for help. • Learn how to communicate. That is the most important skill of a manager. ormer presidents and preachers joined a parade of singers in a hip-swaying, pianopounding farewell to Aretha Franklin, remembering the Queen of Soul as a powerful force for musical and political change and a steadfast friend and family member. "Aretha's singing challenged the dangling discords of hate and lies and racism and injustice," the pastor William J. Barber II said. "Her singing was revelation and was revolution." In a send-off both grand and personal, a celebrity lineup of mourners filled the same Detroit church that hosted Rosa Parks' funeral and offered prayers, songs and dozens of tributes. Guests included former President Bill Clinton, former first lady Hillary Clinton, the Rev. Jesse Jackson, Stevie Wonder and Smokey Robinson. Robinson, the Motown great, remembered first hearing Franklin play piano when he was just 8, and he remained close to her for the rest of her life. They talked for hours at a time. "You're so special," he said, before crooning a few lines from his song "Really Gonna Miss You," with the line "really gonna be different without you." Late Friday, Franklin was laid to rest in a mausoleum at Woodlawn Cemetery, the final resting place of her father and two of her sisters. The epic funeral unfolded on the same day as services for Arizona Sen. John McCain in the nation's capital, creating a challenge for some news networks trying to show both ceremonies. The McCain memorial, with its reverential silence and ramrod-straight honor guard, contrasted sharply with the joyous remembrance in Detroit. Bill Clinton described himself as an Aretha Franklin "groupie," saying he had loved her since college. He traced her life's journey and praised her as someone who "lived with courage, not without fear, but overcoming her fears." He remembered attending her last public performance, at Elton John's AIDS Foundation benefit in November in New York. She looked "desperately ill" but managed to greet him by standing and saying, "How you doing, baby?"

Her career, Clinton noted, spanned from vinyl records to cellphones. He held the microphone near his iPhone and played a snippet of Franklin's classic "Think," the audience clapping along. "It's the key to freedom!" Clinton said. Lasting just over eight hours, the service at Greater Grace Temple encompassed many of the same elements and emotions that were hallmarks of Franklin's more than six decades on sacred and secular stages. She was remembered as the pride of Detroit and a citizen of the world. Actress Cicely Tyson reworked the Paul Laurence Dunbar poem "When Malindy Sings" to "When Aretha Sings." Jennifer Holliday ended the funeral with "Climbing Higher Mountains," an uptempo gospel original by Franklin herself. A statement from former President George W. Bush that was read to the crowd said Franklin would "continue to bring joy to millions for generations to come." The Rev. Al Sharpton read a statement from former President Barack Obama, who wrote that Franklin's "work reflected the very best of the American story." Sharpton received loud cheers when he denounced President Donald Trump for saying that the singer "worked for" him as he responded to her death. "She performed for you," Sharpton said of Franklin, who had sung at Trump-owned venues. "She worked for us." "She gave us pride. She gave us a regal bar to reach. She represented the best in our community," Sharpton said. Many noted her longtime commitment to civil rights and lasting concern for the poor. The Rev. Jesse Jackson recalled Franklin raising money for the Rev. Martin Luther King Jr. and urged attendees to honor her memory by registering to vote. Her friend Greg Mathis, the reality show host and retired Michigan judge, recalled his last conversation with her. They talked about the tainted water supply in Flint. "You go up there and sock it to 'em," she urged Mathis, paraphrasing the "sock it to me" refrain from "Respect." Franklin died Aug. 16 at age 76. Her body arrived in a 1940 Cadillac LaSalle hearse. She wore a shimmering gold dress, with sequined heels — the fourth outfit Franklin was clothed in during a week of events leading up to her funeral. The casket was carried to the church that also sent Franklin's father, the renowned minister C.L. Franklin, to his and Parks' final resting place at Woodlawn Cemetery, where the singer will join them. Ain't but one Aretha Franklin," Dyson says, remembering the day that he saw the icon perform for the pontiff in Philadelphia back in 2015. Jammber is Making the Music Industry Sing By Jonathan Shieber

T

he music business is littered with stories about songwriters or studio contributors and session musicians who never get the credit — or money — they’re often due for their work on hit songs. And for every storied session musician in “The Wrecking Crew” there are perhaps hundreds of other contributors who aren’t getting their just desserts. That’s where Jammber (www.jammber.com) comes in. The five-year-old company co-founded by serial entrepreneur Marcus Cobb has developed a suite of tools to manage everything from songwriting credits and rights management to ticketing and touring all from a group of apps on a mobile phone. And has just raised $2.4 million in funding to take those tools to a broader market. Jammber “Muse” gives collaborators a single platform to exchange lyrics and song ideas, while the company’s “Splits” app tracks ownership and credits of any eventual product from a collaboration. The company’s nStudio tracks songwriting credits to assist with chart and Grammy submission — through a partnership with Nielsen Music — and its “PinPoint” helps organize touring. The recording applications even have a presence feature so session musicians, songwriters and artists can actually be tagged in the studio while they’re working. “I think we need to get attribution and monetization closer to the creators,” Cobb has said. “Why aren’t we doing that? The industry is growing and thriving. Are we making sure that performers and creators of all different tiers are being equally compensated?” The answer, sadly, for many in the music industry is no. In fact, while Cobb had originally set out to make a networking tool for creatives with Jammber he wound up shifting the service to the management toolkit after visiting the offices of a music label.

Jammber chief executive Marcus Cobb “I saw stacks and stacks of payroll checks that were returned to sender,” Cobb, told Crain’s Chicago Business. “These checks were taking three months to two years to print, and they were wrong addresses, or there were stage names instead of legal names.” That experience convinced Cobb of the demand, but it was Nashville that gave the serial entrepreneur the crucible within which to develop the full suite of tools that now make up Jammber’s soup-to-nuts platform. Cobb likes to say that Jammber was conceived in Chicago (where the company spun up from the city’s massively influential 1871 entrepreneurship center https://1871.com) and born in Nashville — the home of the multi-billion-dollar American country music industry. All of the tools in Jammber, Cobb says, were created with input from a local musician, producer, artist and repertoire person or a label executive. In 2015, the company came down to Nashville as part of the first batch of companies in Project Music (www. ec.co/projectmusic), a joint venture between the Country Music Association and the Nashville Entrepreneur Center meant to encourage the development of technology for the music industry. For the 41-year-old Cobb, programming and entrepreneurship has literally been a life saver. Growing up in Texas and Nevada with an abusive, drug-addicted stepfather took a toll on Cobb and programming became an outlet — thanks to a particularly wellequipped computer lab at his high school. “I had moved 24 times,” Cobb said in an interview. “My stepfather

was a full-blown crack addict. He would disappear with money; we got evicted a lot.” But the experience with computers led to an early job out of high school, which l a u n c h e d Cobb’s tech career. He sold his first company, Eido Software in 2007 a year after launching it and has used that money to pursue other endeavors. And while Cobb is a gifted programmer, that’s not his only interest. His next big foray into business was as the owner and lead designer of Marc Wayne Intimates (www.youtube.com/watch?v=MuQEorSQYJE), a boutique lingerie company that also provided the business-savvy Cobb with his first window into the music business — outfitting dancers in music videos for artists like Pitbull. Cobb has invested $300,000 of his own money into Jammber and raised roughly $400,000 in early seed funding. kype has dropped a feature similar to Snapchat and Instagram's "Story" highlight reels, in a back-to-basics redesign prioritizing "simplicity." The Microsoft-owned messaging and video-calling service said it was shaping up the Skype mobile and desktop apps to make it easier for users to navigate and find contacts — and that includes ditching its "Highlights" feature.

"This past year we explored some design changes and heard from customers that we overcomplicated some of our core scenarios," Peter Skillman, director of design for Skype and Outlook, said in a blog post. "Calling became harder to execute and 'Highlights' didn't resonate with a majority of users." The mobile version of the app will include three buttons at the bottom, to open up chats, calls and contacts. The desktop version moves those buttons, in addition to notifications, to the top left corner. A Skype redesign in June last year — when the "Highlights" feature was introduced — was mostly unpopular with users. Skype said that most people use the platform purely for calls, video chat and instant messaging. "Highlights" was very similar to "Story" features offered by competitors Snapchat, Instagram and Facebook Messenger, where users can document their day with photos and videos that stay up for 24 hours before being taken down automatically. Skype said users will still be able to download their "Highlights" posts until September 30. The firm said its latest revamp was "only the beginning" and that more updates over the next few months were expected. The platform has struggled to retain dominance in the market with the rapid rise of competitors like Apple's FaceTime, Facebook's WhatsApp and Messenger, and Tencent's WeChat. Amazon's Jeff Bezos Launches a $2 Billion 'Day One Fund' By Sara Salinas

eff Bezos has launched a $2 billion "Day One Fund" to help homeless families and create preschools, the Amazon CEO announced Thursday. "MacKenzie and I share a belief in the potential for hard work from anyone to serve others," Bezos said in a tweet, referring to his wife MacKenzie Bezos. The fund will launch with a $2 billion commitment, split between the Day 1 Families Fund — helping homeless families — and the Day 1 Academies Fund — creating a "network of new, non-profit, tier-one preschools in low-income communities," Bezos said. As CEO of Amazon, founder of rocket company Blue Origin and owner of The Washington Post, Bezos is the wealthiest man in modern history, with a net worth of at least $150 billion. In June, Bezos teased that he had identified two areas of focus for future charitable endeavors.

Here's His Full Statement: I talk often about the importance of maintaining a Day 1 mentality. It's always Day 1, and I work hard to apply that mindset to everything I do. It was a Day 1 outlook that made me reach out to ask for suggestions on approaches to philanthropy last year. By so many important measures the world keeps getting better, and it's one of the fantastic aspects of human nature that we humans never stop looking for (and finding!) ways to improve things. Our lives are better than our great grandparents' lives, and their lives were better than their great grandparents' lives before them. How the Department of Defense Is Using Open Source: Contractors Welcome By Sean Michael Kerner

T

he U.S. Department of Department of Defense has been incrementally adopting open-source software and methodologies to improve efficiency and reduce costs. In a session at the Open Source Summit on Aug. 31, Jordan Kasper of the Defense Digital Service (DDS) outlined the steps the DoD has taken thus far and some of the lessons learned. The DDS is part of the U.S. Digital Service (USDS), which embeds developers inside of U.S. government agencies as part of an effort to advance the state of technology development and usage. The USDS got started in 2014 under the Obama administration and has been continuing its work ever since. "The U.S. Digital Service is a SWAT team of nerds," Kasper said. The USDS has been working to improve technology development within the government, with a particular focus on the use and development of open-source technology across multiple agencies, including the DoD, he said. Kasper outlined multiple reasons why open source is a model that has value for the DoD and other government agencies.

Reusability at the DoD isn't just about reusing publicly available code; it’s also about making use of code already available within the DoD. Additionally, opensource reusability helps to reduce the overall cost of ownership for software operated by the DoD. "Open source enables us at the DoD to reuse our own things extremely easily," he said. "The fact is the U.S. government spends hordes of money on tech and specifically on software development. Being able to reuse that is absolutely essential."

Collaboration and Contribution

One of the greatest benefits of open source is the ability to easily reuse code, Kasper said. With opensource language frameworks in particular, developers can rapidly become productive by reusing code elements, he added. "You don't have to reinvent the wheel. You can just find something someone else has done and you can get up to speed very quickly," he said. At the DoD, finding solutions to complex problems rapidly is essential, according to Kasper. For example, there are times when the DoD has to come up with technology in a very short period of time to prevent loss of life. Building everything from scratch using custom code takes significantly longer than reusing existing open-source code elements.

Open source also enables collaboration and contribution, both with the general public and within the DoD. Kasper said that collaboration for the DoD is about bringing in a diversity of opinion and views on software development issues. "Having a diverse group of individuals will help solve problems much faster," he said.

Security Security can also benefit from the open-source model. "Vulnerabilities are much easier to find in open source code and are much easier to patch," he said. "Patches can come in at a speed that is much faster than with proprietary code." By open sourcing more of its code, the DoD can be

more secure, Kasper said, though he noted that one of the things that he commonly hears from people is that open source is in fact insecure. The argument is that if the code is open source, then anyone will be able to see it and know how to hack it. "The Defense Media Agency [DFA] runs approximately 800 web properties across the DoD, and in the first quarter of this year they were on the receiving end of 280 million malicious attacks," he said. "Foreign actors know how to hack us. That is not the problem. The problem is we're not fixing problems." DDS runs a bug bounty program along with HackerOne called Hack the Pentagon, which rewards security researchers for responsibly disclosing vulnerabilities to the DoD. Kasper said that vulnerabilities exist whether code is open source or not. "It is critical that vulnerabilities are identified and patched quickly, and that is why it's important to open-source code," he said.

Code Ownership When it comes to open-sourcing code that has been developed by the DoD or its contractors, Kasper said that one question that comes up is about ownership. Some people will tell him that since the DoD paid for software development it belongs to the DoD and it is illegal to make it open-source. Kasper noted there is lots of case law that indicates that it is not illegal for the U.S. government to opensource software. Additionally, he said the government has taken steps to adjust its contractual language with third-party developers to make it clear that the government prefers code that can be open-sourced. The effort to make more government code available as open-source was first required in August 2016 under the Federal Source Code Policy. For the DoD, the effort to open-source code is tracked under the code.mil website, which includes guidelines, policies and project tracking features. Among the tools that the DoD has open-sourced is a malware detection tool for executable binaries. Across the U.S. government, the code.gov site also has a help wanted open listing of areas where help is needed to advance certain projects and add various features. "The U.S. Digital Service is always looking for people that want to help make the situation better," Kasper said. But even though word of mouth has such a major impact on consumer buying behavior, Convince and Convert reports that less than one percent of companies actually have a word-of-mouth strategy. As such, they leave the benefits of getting positive word of mouth promotion up to chance. No bueno. With all the time, money, and effort that goes into creating products, services, and experiences and bringing them to market, it makes sense to do

everything in your power to help ensure that word of mouth happens, and that it happens in your favor. And the by far, the best word of mouth strategy comes down to two simple words: Be remarkable.

Give your customers something worth talking about. Deliver products, services, and experiences that are

not only memorable and meaningful, but ones they will be compelled to talk about to their family, friends, and

anyone who will listen. Producing the remarkable should be priority number one in your business. When you focus on delivering experiences that delight, your customers will gladly do the work to spread the word about you on your behalf. Being remarkable doesn't have to mean exploding your budget to deliver over-the-top experiences. Sometimes simple gestures are all it takes to make a lasting impression. Daniel Lemin, co-author of Chatter Matters: The 2018 Word of Mouth Report, told me that something as small as a fresh-baked cookie was a major part of what made their stay at a DoubleTree Hotel remarkable. In our research, about a third of people will talk about that cookie without being asked. Like, "Hey, how was your trip?" "It was great. I stayed at a hotel, they gave me a cookie when I checked in. It was so good." And when people say things like that, it is inherently trustworthy. It's like, "That sounds like a reasonable experience." You know, they didn't deliver you a steak to your room unprompted. It was a cookie, it's a fairly reasonable gesture, but it's remarkable. It's something you talk about. On your journey to creating better customer experiences, you should, of course, focus on important elements, such as your products and services. But don't forget that you can induce a ton of smiles and delight, and lots of word of mouth with tiny gestures that shock

your customers out of the norm, and showcase that you see them, and you get them.

Engage in public conversations happening about you. These days many customers take to social media to talk about their experiences good or bad with a brand. And now, it's pretty easy for companies to monitor when they are being mentioned on the platform. Instead of just lurking and reading what people are saying about you, join the conversation. Airbnb did this masterfully when a copywriter Ash Ambirge tweeted about how much she was enjoying the moment while staying at an Airbnb during her travels in Europe. Rather than simply ignoring, liking, or retweeting the message shouting them out, Airbnb took the extra step to delight Ambirge by sending her a gift with a lovely

note. Naturally, Ambirge tweeted their note and chronicled the unboxing of her Airbnb goodies on her Instagram Stories. By proactively working to do something remarkable by delighting a customer that mentioned them on social media, the company extended the conversation and turned it even more so in their favor. You can do the same. Like with most things, you increase your chances of getting the results you want through careful planning and execution. Thus if you want more people to share positive experiences with your brand, start by building a strategy that makes it a no-brainer for them to do so.

Engage with your customers on social media. Look for other ways to delight them within various parts of your customer journey. And if your customers aren't talking about you now, that's a good signal that you've got work to do to make your products and services more remarkable. At the Toronto International Film Festival, Netflix unveiled "Quincy," a new documentary that will begin streaming on September 21, 2018, written and directed by his actress daughter, Rashida Jones and documentarian Alan Hicks. The feature film, which runs for two hours, mirrors the life of Mr. Jones who turned 85 earlier this year. The feature provides an

overview of the 70-year career of Mr. Jones, telling the story from his humble origins in city of Chicago’s South Side during the Depression Era. When his family later relocated to Seattle, Washington, it was during this period Mr. Jones started as a trumpet player and became a best friend of Ray Charles. LDF Continues to Challenge Alabama’s Racially Discriminatory Photo ID Law From NAACP Legal Defense and Educational Fund, Inc. (LDF)

T

he NAACP Legal Defense and Educational Fund, Inc. (LDF) will appear before a federal appeals court on Friday to challenge Alabama’s voter photo ID law and ask the court to send this case back to the District Court for a trial. In January, LDF, Covington & Burling, LLP, and local counsel Mitch McGuire filed an appeal after the U.S. District Court dismissed a lawsuit brought on behalf of Greater Birmingham Ministries, the Alabama NAACP, and three individual voters challenging Alabama’s photo ID law. The District Court dismissed the lawsuit without a trial, despite evidence that the Legislature had intentionally passed the law to discriminate against and burden Black and Latino voters. The chief sponsors of Alabama’s photo ID law openly stated that its purpose was to undermine the “black power structure” and, just months prior to the passage of the law, were recorded plotting to suppress Black voter turnout in the upcoming election. Voters of color in Alabama are about two times more likely than white voters to lack acceptable ID, are over four times more likely to have their provisional ballots rejected because of the law and are almost three times more likely to neither have a car nor live within five miles of ID-issuing offices. “Black and Latino Alabamians face multiple hurdles to obtaining photo ID to vote,” said Deuel Ross, LDF Assistant Counsel. “The testimony from our clients, elected officials, and experts clearly showed that over 118,000 people lack acceptable ID and that this law has prevented thousands of people from voting. Our clients deserve their day in court to present this evidence at trial.” After years of opposition from Black legislators, Alabama passed a photo ID law in 2011 that went into effect in 2014. In late 2015, however, Alabama closed the driver’s license-issuing offices in nearly

every majority-Black county. The offices remained partially closed for the 2016 elections until a civil rights settlement with the federal government required the offices to be fully reopened. LDF’s lawsuit, filed in December 2015, alleges that Alabama’s photo ID law discriminated against Black and Latino voters in violation of the U.S. Constitution and the Voting Rights Act. “Alabama legislators passed this photo ID law to suppress the growing influence of Black and Latino

voters,” said Natasha Merle, LDF Senior Counsel. “Every eligible voter has the right to cast a ballot and make their voice heard. Policeman in Texas who Killed Unarmed Black Teen Guilty of Murder By Lindsay Schnell

oy Oliver, the former Dallas-area police officer who shot and killed 15-yearold Jordan Edwards in April 2017, has been found guilty of murder. Oliver, who is white, was fired from the Balch Springs Police Department just days after the death of Edwards, a black teenager who was leaving a local house party with friends when Oliver opened fire on their vehicle. Edwards, who was unarmed, was in the passenger seat. Oliver, 38, testified last week that he had no choice other than

to fire his weapon after seeing the car move toward his partner, Tyler Gross. Oliver said he believed Gross to be in danger, but Gross told jurors he never felt threatened and did not feel the need to open fire. “I was not in fear at that point,” Gross told jurors. A video released by local authorities at the time of the shooting showed the vehicle moving away from officers. Oliver fired five shots from his AK-15 rifle, striking Edwards in the back of the head and killing him instantly. He

was fired shortly after the shooting. Jury deliberations took 13 hours. Oliver was also found not guilty of two counts of aggravated assault. It is the first time since 1973 that a Dallas County police officer has been found guilty of murder. 3.7-mile stretch of road in the heart of Los Angeles' Baldwin Hills/Crenshaw neighborhood is getting a new name in honor of the country's first African-American president, and local leaders say the symbolism is important. Democratic Assemblywoman Sydney Kamlager-Dove, who represents the area, said she loved that former President Barack Obama would have a permanent presence there. "It's the merging of a historic president (and) street with an iconic black community," she said.

The Los Angeles City Council voted Tuesday to rename Rodeo Road, a main east-west artery in the city, as Obama Boulevard. The newly minted thoroughfare runs from Jefferson Boulevard near Ballona Creek, at the edge of the city's boundary with Culver City, to Gramercy Place, just short of Exposition Boulevard. Obama Boulevard will slice through a mix of residential streets and strip malls at the northern border of Baldwin Hills and Leimert Park and will pass by Dorsey High School, Baldwin Hills Elementary School and the Rancho Cienega

Recreation Center. In 2007, then-presidential candidate Obama held a rally at the Rancho Cienega recreation center near the beginning of his historic presidential campaign. City Council President Herb Wesson first proposed the street's name change in June 2017, citing Obama's rally there as reason for the change. The area already has streets named after presidents, such as George Washington and Thomas Jefferson. The name change sparked some debate in 2017, with some residents saying that Obama deserved to have his name on a more prominent street in Los Angeles. But Wesson defended the choice of Rodeo Road. oogle is rolling out a feature that allows users to hear positive news stories on command, an effort developed in conjunction with a journalism group focusing on combating negative news fatigue. The feature will exist on Google Assistant devices and will play a randomly selected positive news story focusing on an individual or a group solving a problem when prompted with the voice command "tell me something good." The feature, Google notes, is an "experiment worth trying" because

it is directly designed to improve users' experiences. It "isn't meant to be a magic solution," the blog post continues. "But it's an experiment worth trying because it's good info about good work that may bring some good to your day." The feature follows an announcement earlier in the year from Google concerning the company's efforts to battle fake news on its various platforms and search engine. The company launched a

ormer First Lady Michelle Obama is wading into the mid-terms wars with a new organization, When We All Vote. The non-profit, nonpartisan effort will focus on voter registration via public service announcements, events, rallies and trainings leading into Get-Out-The-Vote (GOTV) days of action closer to the election. One of history's most popular presidential spouses, the former executive, attorney, public servant and mother has enlisted a host of celebrities to help her get the vote out for this November's critical elections. Notable names include actor Tom Hanks, "Hamilton" creator Lin-Manuel Miranda, Houston Rockets star Chris Paul, country stars Faith Hill and Tim McGraw,and singer Janelle Monae. Voter participation in mid-term elections is traditionally low. In 2014 just a third of eligbile Americans voted and over 21% of eligible citizens were not registered. Particular emphasis will

be placed on the youth vote, with organizational partner RockTheVote concentrating on registering the "four million americans who turn 18 this year." When We All Vote is incorporated separately from the Obama Foundation, Barack and Michelle Obama's personal offices, and the former President's political arm, Citizen 44. and Michelle's appearances limited to a few focused on women's empowerment and paid speeches. The decision to utilize her for a non-partisan effort is of frustration to some party players who had hoped to see Michelle as a surrogate and advocate for Democratic candidates. Michelle Obama’s 10-City Book Tour will take her to Major Arenas By Emily Heil

ichelle Obama’s book tour to promote her memoir, “Becoming,” won’t be taking her to the usual cramped bookstore signings — the former first lady will instead be doing appearances at major arena venues across the country in a tour produced by Live Nation (www. livenation.com), the event company known for concerts by the likes of Rihanna and Katy Perry. The 10-city jaunt kicks off in Chicago and will “feature intimate and honest conversations between Mrs. Obama and a selection of to-beannounced moderators, reflective of the extraordinary stories shared in the wide-ranging chapters of her deeply personal book,” according to an announcement Wednesday by Live Nation and Penguin Random House’s Crown Publishing Group. The timing — the tour stretches from Nov. 13 to Dec. 17, including a Nov. 17 event at Capital One Arena in Washington — is interestingly apolitical: Obama will be barnstorming across the country just after the midterm elections, so it looks as if her book tour won’t function as a de facto campaign to get out the vote, an issue she has recently focused on. Instead, the format of massive venues and probably high-profile moderators calls to mind an Oprah-

Trailblazing Black Ballet Dancer Arthur Mitchell Dies By Samara Lynn

his beautiful and enigmatic orchid, Brachycorythis conica, was first recorded in 1918; it was last seen in the Gauteng Province in 1956, until its rediscovery in 2007. This species has until now had no recorded common names, as a result the name Albertina Sisulu Orchid

In 1955, Ma Sisulu joined the ANC Womens League and took part in the launch of the Freedom Charter, the same year the orchid was named by the Kew botanist and orchid scientist, V.S. Summerheyes. Britain's Prime Minister Pledges $5.1 Billion In Investment In Africa By Shannon Van Sant

ritish Prime Minister Theresa May said she will make major investments in Africa. While on a three-day tour of the continent, May pledged 4 billion pounds ($5.1 billion) of support for African markets. May's goal of deepening trade ties with Africa, the world's second most populous continent, comes ahead of Britain's departure from the European Union next year. Britain's post-Brexit goal is to "strengthen its global partnerships," May said in a statement. "This week I am looking forward to discussing how we can do that alongside Africa to help deliver important investment and jobs as well as continue to work together to maintain stability and security." Britain's direct investment in Africa will mark a fundamental shift in focus from short-term poverty

May says the U.K. will carry over the EU's existing trading arrangements with the Southern African Customs Union, which includes the countries of South Africa, Botswana, Lesotho, Namibia, Swaziland and Mozambique. The union allows these countries easy access to British and European markets. During her trip to Africa, May has tried to downplay fears of the economic damage Brexit might cause the U.K. On Tuesday morning, May told reporters a no-deal Brexit is better than a bad deal, and no deal "wouldn't be the end of the world." While May said the U.K. could not match the "economic might" of some investors, she vowed that by 2022 the U.K. will overtake the U.S. as the biggest investor of the G-7 countries in Africa. But some critics say the U.K. is late to the party when it comes to support of African economies. Lord Boateng,

chair of the Africa Enterprise Challenge Fund, which awards grants to private sector companies to support new and innovative business models in Africa, told BBC Radio 4 Britain has a lot of catching up to do: "The reality is that the Chinese, the French, the Indians, indeed Korea, Japan, Germany even, tend to have had a much more proactive response to business in Africa than we traditionally have had. "We have a lot of catching up to do if we are to make the most of what is an historic opportunity to recast the relationship between Africa and the U.K. away from it being seen solely as a philanthropic exercise, a basket case suitable only for [overseas aid], to an opportunity that requires investment, that requires risk taking and support by government for British companies." Later this week May plans to visit Nigeria and Kenya. Both countries are former British colonies. Instead, the aforementioned countries are grouped with the Bureau of Near Eastern Affairs, together with Iran, Iraq, Israel and others. This artificial distinction between North Africa and the rest of Africa

negatively impacts US foreign policy relations throughout the entire continent of Africa. We unequivocally reject the argument that North African countries are outside the scope of African affairs. North Africa is geographically and historically part of the African continent, and all fifty-three (53) independent African states, including North African countries, are represented in the African Union (AU). It would be far more productive for the State Department to engage with the entire continent of Africa, including North Africa, under its Bureau of African Affairs. We are one Africa, from the Cape to Cairo, indivisible and bound together! Therefore, no square inch of African

land should be excluded from African affairs.
