ow that the Foot bridges have reopened, just in time for Homecoming photo sessions, and the dogs from Waterside and the Lakes are enjoying the new East Dog Park, Harmony is ready to start another round of projects. There are a few major maintenance projects that will be starting in the next 2-3 months:

originally served only the Community Garden and a small staging area for the developer, the demands on it have increased over the years. Between 2014 and 2017, a landscape staging area and a small vehicle storage lot were added. Then in 2019/2020 the CDD added a much larger Vehicle Storage Lot and the Field Services Staff trailer. This was when the road was upgraded from a dirt road to the present shell road.

SWIMMING POOLS Swim Club: The pool at the Swim Club (located next to the Tavern) is in need of a major makeover. In 2018, the CDD had the Swim Club pool retiled and resurfaced. Unfortunately, the contractor did not have experience doing this type of work and the tile work was not done properly and needed to be replaced. The CDD withheld $20,000 for this failure, and then, to make matters worse, in June of 2019 the pool’s new surface began separating from the bottom of the pool. At that time, the CDD decided not to undertake another complete resurfacing and instead chose to repair these bubbles as they appeared. But it is now time to correct the root problems and have our Swim Club pool resurfaced properly. We waited until the summer swimming season has passed and will be doing the work this winter. It will require that the pool be closed for a couple of weeks. We look forward to having a newly rejuvenated pool to enjoy this coming Spring.

Unfortunately, these additional uses were not allowed uses under Harmony’s Planned Development approval and Harmony did not have permission from Florida Gas Transmission (FGT) to use the pipeline easement as a road. Both of these issues have prevented the CDD from maintaining, upgrading or improving this roadway. Those issues have now been resolved and the CDD has approval to move forward with improving the road from where it intersects Five Oaks Drive to the gate for the Vehicle Storage lot.

Ashley Park Pool: The pool in Ashley Park was constructed in 2007, almost 15 years ago. The expected life of a pool surface is from 10 to 12 years, so we are overdue on resurfacing this pool also. We have received bids and are finalizing negotiations so that work can be done during the winter. We are trying to arrange for the pools to be done one after the other so that you will always have access to a pool, but our goal is to have both completed by Spring of 2022 so that there is swimming room for everyone.

Our new roadway will be about 14 feet wide and include 3 pull off areas that are at least 50’ long that will allow RVs/towing vehicles to pull off so other vehicles can pass. Since it will be constructed using a 15-inch-deep layer of concrete fines that are recessed into the ground, it will eliminate the potholes and rutting that are currently occurring. The 3-foot-high border fence required by FGT will provide a natural finished look and prevent vehicles from leaving the roadway which would damage the roadbed edges. The CDD is currently seeking bids from contractors to complete this work.

ROADS AND ALLEYS Garden Road: This road is located east of Harmony’s Town Center and just west of the Golf Maintenance Road. Although the Garden Road

Harmony’s District Engineer has designed a new roadway that meets FGT’s requirements that the road remain a single lane, not be paved, and be bordered by low fencing to keep vehicles on the roadway, the County’s requirement that it meet the load ratings of a typical residential street, and the Water Management District requirement that it not increase the impervious nature past that of the existing road; not an easy feat.

real challenge for everyone but repairing/improving it without proper approvals from the County and FGT may have caused these entities to close the road altogether. It was important to get the proper approvals before moving forward. The CDD is continuing through the Site Plan approval process to bring the Field Services complex, the landscape staging area, and the Vehicle Storage lot into compliance. Once we have site plan approval, we will be able to make further improvements to each of these facilities. Milling and Repaving of Alleyways in Neighborhoods C-1 and C-2: Our District Engineer has completed Instruction to Bidders, Proposal, Construction Contract, and Special Provisions for the repaving of the alleyways in the area bounded by Schoolhouse Road, the Gas Pipeline easement, and Cat Brier Trail. This portion of Harmony was constructed in 2004 and these alleyways have never been repaved. With a projected lifespan for these alleyways of 15 years, we are 2 years overdue. When the alleyways in Ashley Park and other neighborhoods were repaved a few years ago, the CDD had problems with the contractors and was unable to get them to comply with the requirement to mill the surface before repaving. With our current District Engineer, who has extensive experience is roadway resurfacing, and a properly designed bid package we can expect to have a more successful project this go round. COUNTY PROJECT IN THE WORKS FOR HARMONY Milling and Repaving of Five Oaks Drive from Schoolhouse Road to Cat Briar Trail: Osceola County has listed this section of Five Oaks Drive for milling and resurfacing sometime between October 1, 2021 and September 30, 2022. We will be coordinating with Osceola County on this project and hope to let everyone know an approximate date when this gets closer. Our District Engineer will be looking in to possibly piggy backing our milling and paving onto their project which might provide a savings in mobilization cost. We hope this can be worked out. n

ID YOU KNOW that Harmony was designed to promote the peaceful coexistence of human and animal residents within the community while striking a balance between the preservation, use and enjoyment of Harmony’s natural areas? Underlying these objectives are the values of fostering a respect for the land, the protection of wildlife and the sensible use and enjoyment of Harmony’s abundant natural and manmade amenities by its residents. Harmony incorporates natural and human-built environments that blend in ways designed to enhance the relationships between humans and animals and maximize the benefits of their peaceful coexistence. While retaining natural areas, Harmony is part of a human-dominated landscape where our actions profoundly affect the welfare of wild animals. The welfare of wild animals is why cats and dogs are not permitted outside untethered, and why dogs are allowed off-leash only in the dog parks. But we love our pets in Harmony, and we look out for their welfare, too. Whether it is wild raccoons, possums, armadillos, cranes, turkey or deer, or stray cats or escaped — or even on-leash — dogs, animals will find their way onto our properties, so the use of poisons and highly toxic pesticides (for everything from fire ants and mole crickets to rats and beyond) and herbicides (like weed killers or preventatives) should only very rarely be used, and used only when other, less dangerous, methods have been tried first (and maybe second and third). It’s very likely that I’m not the only pet owner who has had near-panic moments when my dogs have, in a flash, grabbed some granules or powders from my neighbors’ lawns or sidewalks as we pass by on our way to the dog park. This has led to some very worried minutes of hurriedly attempting to find out how toxic the product was and measures to take to avoid poisoning. That’s why it’s so important when using fertilizers that contain weed-killers and preventatives, use caution to prevent spread of or remove the product from remaining on sidewalks, as the toxins can be absorbed through the toe pads of dogs walking on those surfaces, or by dogs licking their feet afterwards. Keeping trash cans secure when they have hazardous waste inside, refraining from intentionally or inadvertently feeding wildlife, and keeping garage doors closed at night are some methods to reduce the attraction of unwanted wildlife. Using more native Florida plants which are already adapted for our conditions, as well as our pests, and selecting plants appropriate for the moisture and sun level of the planting area will result in less need for pesticides and herbicides. If you feel you must use toxic products, please be considerate of your neighbors and their pets, and do put markers out to indicate the use of such products so other residents can exercise caution to keep their kids and their pets away from those areas. Let’s continue to keep Harmony green! n

CDD, HROA, HOA, The Lakes, The Estates??? By Steve Berube HROA President, CDD Board Member

A

t a recent Community gathering, several people asked me to further explain what the various agencies around Harmony do and how they affect your residency in Harmony. So, though you might have read some of this before, it is important to remember that new residents arrive here daily—and, perhaps, I’ve missed something previously. First, the name Harmony applies only to the original 1020 acres originally established as the Harmony Community Development District. You’ve likely noticed Harmony West and very soon you’ll see Harmony Central. At some point there likely will be other suffixes added to “Harmony.” It is important to remember that each is separate and has nothing to do with the other except for sharing the name. So, the “blanket” organization here is the Community Development District (CDD). In the late 1990’s a developer submitted a plan to build Harmony to the various governmental authorities; that plan was approved and gave said Developer the authority to sell tax-free bonds—essentially municipal bonds. There were two bond sales which resulted in the Developer garnering a fistful of money to begin construction. This bond debt must be paid back and said debt follows the land; so, when you buy land here, it is debted land and you pay that debt as long as you own your property OR until you pay it off in a lump sum. That debt is paid on your County Tax Bill and, in addition to the debt, you also must pay a roughly equal amount for Operation and Maintenance (O&M). O&M costs include costs to maintain all the public infrastructure here: alleys, ponds, grass, trees, sidewalks, pools, Buck Lake docks and boats, playgrounds, trash, doggi-potties, signs, fences, benches and on and on and on. And though the golf course pays its share, residents in no way subsidize the golf course. By 2036, the debt will be paid off—BUT your fees are not likely to drop. Why? Well quite simply, as Harmony ages, things will wear out and the CDD is obligated by law to maintain infrastructure. So, as debt drops, O&M increases; the CDD is just now implementing a Reserve Study which is likely going to suggest additional funding for maintenance/replace8 Harmony Life Magazine l November 2021

ments; yes, even more than we’ve been stashing for years now. As you might surmise, things might get very expensive very quickly and is one reason that you should stay close to how the Board decides to fund Reserves and more important than funding them, how they SPEND those funds. Things can race out of control very quickly. Beyond that, the CDD has nothing to do with your private property; instead, it focuses on the public areas around Harmony. Since I mentioned private property, let’s explore that. To date, there is the Harmony Residential Owners Association which covers all single family homes as well as the Condos & Townhomes in Ashley Park. The Ashley Park Condos & Townhomes also are governed by their own individual associations largely due to the unique needs of those types of homes. However, while the CDD does cover The Lakes and now The Enclave communities, the HROA does not cover those areas. Instead, each of them has their own individual association which is needed due to the unique needs of over-55 and gated communities. It is also noteworthy that while residents of these over55/gated communities CAN use CDD facilities, residents outside these over-55/gated areas CANNOT use their facilities. This is because non-over-55 residents don’t pay into those closed Associations so therefore their facilities/amenities are not open to all.

However, in some of the newer neighborhoods, in general the ones without alleys and/or with the later style streetlights which have an arm shaped like an inverted “U”, the sidewalks were deeded to the county by the developer. This means that those sidewalks are maintained/cleaned by the county. Town Square comes to mind at this point: the center grassy area is owned and maintained by the CDD. All of the other buildings around the Town Square are privately owned and operated EXCEPT the Swim Club which is CDD owned. And like the golf course ponds, the ponds along US192 are privately owned; while the CDD holds an easement on all ponds to maintain their flood control capabilities, the CDD does no other maintenance on these privately-owned ponds. Hopefully, this has clarified any questions about these agencies—all of which is your money—you might have had. If not, feel free to contact me at spberube@earthlink.net. It is important to note that the only areas “behind the gates” that the CDD maintains is/are the ponds. In general, the ponds are maintained to ensure easy ingress/egress of water, to maintain about a 4-foot-wide “buffer” on the shorelines, and cutting the grass to the edge of the CDD easement around the ponds which is usually less than 20 feet from the water’s edge. Additionally, though street trees and sidewalks are CDD-maintained throughout much of Harmony, these maintenance items are not provided behind the gates as the streets and sidewalks are privately owned by the HOAs there.
