TEPP Explained –
TEPP has existed since 2001, following recognition by the England players of the need for collective representation in employment and commercial negotiations with the ECB. This continues to be the primary focus of TEPP, which manages all of the contractual, financial and commercial negotiations with the ECB on behalf of the England players.
Any player who signs any type of contract with the ECB, for their selection for England, becomes a member of TEPP for the time in which they hold that contract. The terms of your membership of TEPP are set out in the Partnership Deed. You will be asked to sign a Deed of Adherence to confirm your agreement to those terms which include the basis on which you will receive win bonuses and commercial monies, and the use of your image rights as an England player for commercial purposes. If you have an Image Rights Company, then your rights will need to be granted to TEPP via some additional documents, which we will discuss with you. TEPP is overseen by a Management Board, with much of the day to day operation managed on the players’ behalf by the PCA. CONTACT DETAILS TO BE FOUND HERE
WHAT DOES TEPP DO? There are four main areas of the service provided to players by TEPP: • EMPLOYMENT CONTRACTS & REMUNERATION • FINANCIAL DISTRIBUTIONS • COMMERCIAL RIGHTS • SUPPORT SERVICES & PLAYER BENEFITS /4

Employment Contracts & Remuneration –
TEPP negotiates all employment and retainer contracts with the ECB, including all employment terms and conditions as well as the principles on how players’ remuneration is calculated. CENTRAL CONTRACTS At the beginning of October in each year the ECB may award Central Contracts to players expected to play a major role for England across any or all formats of the international game. The duration of the Central Contracts may be for either one, two or three years. Up to 27 Central Contracts can be in place at any time. For centrally contracted players, an England retainer payment (and pension contribution) replaces the County salary, but the relevant County retains each player’s registration. Central Contracts are awarded on a performance ratings points system; each player will be awarded rating points based on the likelihood of him featuring in the squads and teams for each format in which a player is expected to participate. In determining the number of ratings points a player will be awarded, performance data and information provided by ECB performance staff will be utilised. Further details of this system for the awarding of Central Contracts are set out in the Conditions of Employment.
will pay the Player a reduced salary and the ECB will pay the player an additional monthly increment that more than offsets the reduction in the player’s County salary.
MATCH, SERIES AND TOUR FEES All players who are selected for England (including those on Central and Development Contracts) for a match, series, tour or ICC Event will be paid an additional fee based on the number and type of matches to be played in the series, tour or ICC Event.
DEVELOPMENT CONTRACTS Development Contracts have been introduced with a view to enhancing the number of international cricketers that will be available to England. The award of a Development Contract is based on a player having been identified as having exceptional potential. The player’s County /7
OTHER PAYMENTS In addition to the retainers paid in relation to the contracts referred to on the previous page, players selected to play for England in international matches will, irrespective of their contract status, receive: • Match fees (home Test matches only) • Match and series win bonuses (with the series bonus being determined by who the opposition is, and the number of matches in the series) • Prize money (ICC events only)
WHO PAYS YOU WHAT? You are paid salaries and match fees via your employer – this will be the ECB if you are on an Annual Central Contract, or your County if you are on any other type of England Contract. Win bonuses and prize money are paid by TEPP, who makes appropriate PAYE deductions before making the payment to each player.
INSURANCES TEPP has ensured that the ECB will maintain the following insurance throughout the England contract period for each player: Life Assurance and Critical Illness; Permanent Total Disablement (from any and every gainful employment and from playing professional cricket); Temporary Total Disablement; and Personal Accident and Sickness. INSURANCE POLICY DETAILS
INDIVIDUAL TOP UPS Players may increase their total disablement cover with individual top-ups. Cost and cover is dependent on age.
HEALTHCARE All injuries or medical conditions, regardless of whether they occur in a cricket environment, are covered by the ECB Healthtrust. All members of TEPP have medical cover provided under the ECB Healthtrust programme, overseen by the PCA. All claims will be processed by the ECB Chief Medical Officer and the Trust’s administrator, Health Partners. Players’ partners or children can also be covered by the Health trust upon request.
HOW TO MAKE A CLAIM If you or your registered dependants need to make a claim or want to ask any questions about your cover you can contact Health Partners directly. You can reach them on 0870 224 7774 or claims@cricket-med.com and their experienced team will provide the best and most immediate response. Please note the different levels of cover for player/dependant and cricket/non-cricket related claims as stated in the Handbook; Health Partners will be able to advise on eligibility and the appropriate pathway for any issue, so please do contact them with any enquiry. Financial Distribution –
TEPP oversees and distributes additional payments that are made to players for playing for England including prize money from ICC events and bonuses for winning England matches and series. This does not include salaries, tour fees or match fees, which are paid by the ECB or via your county. The distribution of commercial monies (including fees for appearances for sponsors and the ECB) and Partnership profits is also managed by TEPP. TEPP WILL DISTRIBUTE THE FOLLOWING IN ACCORDANCE WITH THE PROVISIONS OF THE TEPP PARTNERSHIP DEED
• Type of contract held with ECB • Playing appearances for England • Commercial activity undertaken
• Team Bonuses for winning matches and series are distributed by TEPP between players in the relevant winning teams and squads on a pro rata basis, dependent on the number of games played and won; and • Commercial revenue, from the Commercial MOU, licensing income and other generated revenues.
Commercial monies can be paid either directly to a player, or to an IRC if your commercial rights have been assigned to the IRC and the required paperwork has been completed alongside the TEPP Partnership Deed or Deed of Adherence.
ADMINISTRATION & ACCOUNTS All financial administrative functions of the partnership are undertaken by Dyke Yaxley Limited, TEPP’s accountants. Annual Accounts will be prepared following the end of the Partnership accounting year (being 5 April) and will show the total monies received by the Partnership from the various sources and the various costs incurred. The difference is the total profit which is distributed to the partners based on:
TAX Where commercial revenues are paid directly to a player, you must be aware of the tax position as members of the TEPP, including: • Tax is due on an England player’s share of the profits • TEPP will hold back the estimated higher rate of tax on your share of the profits • At the appropriate time the Partnership will release to you the appropriate sum to cover your tax obligation

Commercial –
TEPP holds the rights to you all as ‘England players,’ which allows you to be collectively represented and marketed as a team. All commercial use of England players by the ECB and commercial partners must be approved by the PCA, on behalf of TEPP. The commercial rights of England players are managed by TEPP and the PCA, who have agreed a multi year Commercial MOU agreement with the ECB to grant player rights for use by both the ECB and their commercial partners, allowing them to use player imagery and player appearances to promote the game and activate their partnerships. TEPP and the PCA represent the players in securing a fair share of sponsorship income, as well as managing the delivery of team and individual appearances.
COMMERCIAL PARTNERS ECB have a range of commercial partners, and the PCA, on behalf of TEPP, manage the delivery of all contracted England player rights to them. The investment from ECB’s commercial partners is vital to the success of the game, and so we ask that you support these partners by making yourself available for any requested appearances where possible.
/ 12
FEES AND PAYMENTS Players are paid fees for completing appearances and, in limited circumstances, for use of their image, which will be communicated prior to committing to any activity. Fees vary depending on factors including time commitment, required activity and how the output is being used. A framework for these fees has been approved by the TEPP Management Board to ensure consistency and fairness. Fees will be paid directly to players who do not have an IRC, or via an IRC for those players who have informed TEPP that they have one in place.
PLAYER APPEARANCES Player appearances are a major element of the ECB’s commercial partners’ packages and so you may be asked from time to time to attend events or feature in content as a representative of the England team. TEPP aims to share requests around players, although contracted England players will typically feature more often. TEPP encourages appearances to feature 3 or more players as this gives a truer representation of the team, and so commercial partners then have greater freedom around how and where the output can be used. However single player appearances are still permitted when focused on the partner’s cricket or charity initiatives and the output channels are limited. The process for all appearance requests are as follows: APPROVAL
APPLICATION Appearance request form submitted by Partner to ECB
ECB approval - submit to PCA
PCA approve appearance, based on TEPP criteria
PCA discuss with Player(s) and confirm to ECB
APPEARANCE ECB confirm with Partner and co-ordinate logistics with Player
If requested Player(s) not available, ECB will discuss other options with Partner
IMAGE USE ECB commercial partners have the exclusive right to use imagery of players in an England capacity i.e. in England kit and clothing. The channels in which they can use this imagery will depend on the details of their ECB contract but, for example, may include their social media channels, website, point of sale and in-ground advertising. In the majority of instances, 3 or more players must feature in any imagery to ensure that it is representative of the team, allows for player rotation, and does not imply that the commercial partner has an association with an individual / 14
player. As with the appearance process the PCA will ensure all necessary guidelines are adhered to and in the vast majority of cases we will approve image use on the players’ behalf. In most cases (unless a photoshoot is required for which an appearance fee will be paid) no fees are paid for images being used. However in some instances such as TV, cinema or outdoor use, additional fees may be paid if deemed appropriate by the TEPP Management Board.

INDIVIDUAL SPONSORSHIPS As well as representing and promoting the team as a collective, it is also a key role of the PCA to ensure players’ individual rights are protected so that players and agents are able to exploit any personal commercial opportunities that may arise. We are therefore constantly working to ensure that team partners do not carry out any activity that may encroach on individual rights. Players are free to enter into personal commercial arrangements assuming these have been approved by both the PCA and ECB in advance. An Individual Sponsorship Approval Form must be submitted before a deal is entered into with the details of the term and what rights are being granted such as appearances, image use or social media posts, which the PCA and ECB will review. You/your agent must ensure this process is completed. / 16
There are restrictions in ECB employment contracts (including match, series and tour contracts) and ICC event contracts regarding any commercial deals you’re able to enter into as an individual. For example, you are not permitted to enter into any agreements that conflict with certain ECB partners. This is detailed in the Commercial Partners Restrictions Grid... COMMERCIAL PARTNERS RESTRICTIONS GRID
You and your agent are encouraged to speak to us if you have any questions or concerns in this area.
INDIVIDUAL SPONSORSHIP GUIDELINES • No appearances or activations, including social posts or press articles, should take place during England on-duty time by the player or the sponsor. On duty is defined, for commercial purposes, as from the moment the player arrives at the ground on the first practice day that is no sooner than two days before the first match day of each match until 7.00pm or one hour after the end of actual play on the last match day of each match whichever is the later • No activations should feature 3 or more players (both England Men and England Women combined) as this implies an association with the team.
• England kit/clothing should not be worn for any engagements or feature in any imagery, except in the case of bat manufacturers where imagery taken from the field of play can be used. • No England Cricket or ECB intellectual property (IP) should be used. • There should be no use of ‘England Cricket Team’ or ‘Team England’ or words ‘England’, ‘Team’ and ‘Cricket’ consecutively (in any order) • ECB and ICC carve out clauses should be included to ensure you are not inadvertently in breach of contract where there is a conflict of sponsorships.
LICENSING / SIGNED MERCHANDISE The PCA run a licensing programme in partnership with the ECB, utilising the player rights held by the TEPP (player images, likenesses, signatures etc) alongside the ECB’s IP to create products such as calendars, posters, clothing and video games. This is important both as a revenue stream and a marketing strategy, and a proportion of every product sold is distributed to TEPP. The split amongst players will depend on whether the items are team focused or associated with a particular individual. All products featuring players are approved at each stage of development by the PCA. Should you and your agent wish to explore the area of individual merchandise or signed items, please do discuss this with us early in the process and we can advise of any necessary guidelines or restrictions. / 17
SOCIAL MEDIA Whilst you own your social media channels and they are therefore your personal responsibility, the PCA encourages you to manage these in a responsible fashion and so has created a short guide regarding social media advertising for influencers. This covers questions such as why the rules around advertising exist, when you should declare an advert on your social channels and how you should label your posts. Please be aware that the information here acts as a basic guide on the topic only and the information is not exhaustive, so it’s important you keep yourself up to date on the official rules and guidelines in this area. SOCIAL MEDIA GUIDELINES
The PCA has also developed a document which focusses on how you can activate your personal sponsorships on your social channels. It details the restrictions that are in place to protect you from breaching your England contract and the terms of the Commercial MOU, for example when you can/can’t post, the rules around England clothing, etc. We encourage you to familiarise yourself with this document before sharing any commercial content on your social media. ACTIVATING YOUR PERSONAL SPONSORSHIPS
Should you require help with any social media issues, from receiving abuse to being hacked, please do contact the PCA who will be happy to assist and offer advice. / 18

TEPP PHONE PROVISION
FAMILY PROVISION With a lot of time being spent away from home we understand how important it is to have family/friends around where possible. At home, transport is provided to and from grounds/hotels as well as weekend hospitality boxes and a crèche service. An overseas family provision is accessible to players who have been abroad for at least 60 days.
