Commercial –
TEPP holds the rights to you all as ‘England players,’ which allows you to be collectively represented and marketed as a team. All commercial use of England players by the ECB and commercial partners must be approved by the PCA, on behalf of TEPP.
The commercial rights of England players are managed by TEPP and the PCA, who have agreed a multi year Commercial MOU agreement with the ECB to grant player rights for use by both the ECB and their commercial partners, allowing them to use player imagery and player appearances to promote the game and activate their partnerships. TEPP and the PCA represent the players in securing a fair share of sponsorship income, as well as managing the delivery of team and individual appearances.
COMMERCIAL PARTNERS
ECB have a range of commercial partners, and the PCA, on behalf of TEPP, manage the delivery of all contracted England player rights to them.
The investment from ECB’s commercial partners is vital to the success of the game, and so we ask that you support these partners by making yourself available for any requested appearances where possible.
FEES AND PAYMENTS
Players are paid fees for completing appearances and, in limited circumstances, for use of their image, which will be communicated prior to committing to any activity. Fees vary depending on factors including time commitment, required activity and how the output is being used. A framework for these fees has been approved by the TEPP Management Board to ensure consistency and fairness. Fees will be paid directly to players who do not have an IRC, or via an IRC for those players who have informed TEPP that they have one in place.

PLAYER APPEARANCES
Player appearances are a major element of the ECB’s commercial partners’ packages and so you may be asked from time to time to attend events or feature in content as a representative of the England team. TEPP aims to share requests around players, although contracted England players will typically feature more often.
TEPP encourages appearances to feature 3 or more players as this gives a truer representation of the team, and so commercial partners then have greater freedom around how and where the output can be used. However single player appearances are still permitted when focused on the partner’s cricket or charity initiatives and the output channels are limited.
The process for all appearance requests are as follows:

IMAGE USE
ECB commercial partners have the exclusive right to use imagery of players in an England capacity i.e. in England kit and clothing. The channels in which they can use this imagery will depend on the details of their ECB contract but, for example, may include their social media channels, website, point of sale and in-ground advertising.
In the majority of instances, 3 or more players must feature in any imagery to ensure that it is representative of the team, allows for player rotation, and does not imply that the commercial partner has an association with an individual player. As with the appearance process the PCA will ensure all necessary guidelines are adhered to and in the vast majority of cases we will approve image use on the players’ behalf.
In most cases (unless a photoshoot is required for which an appearance fee will be paid) no fees are paid for images being used. However in some instances such as TV, cinema or outdoor use, additional fees may be paid if deemed appropriate by the TEPP Management Board. We believe that investing is about trusting your judgement, not trying your luck. That’s why we give you the platform to follow your own strategy, and the support to find your own edge.
INDIVIDUAL SPONSORSHIPS
As well as representing and promoting the team as a collective, it is also a key role of the PCA to ensure players’ individual rights are protected so that players and agents are able to exploit any personal commercial opportunities that may arise. We are therefore constantly working to ensure that team partners do not carry out any activity that may encroach on individual rights.
Players are free to enter into personal commercial arrangements assuming these have been approved by both the PCA and ECB in advance. An Individual Sponsorship Approval Form must be submitted before a deal is entered into with the details of the term and what rights are being granted such as appearances, image use or social media posts, which the PCA and ECB will review. You/your agent must ensure this process is completed. There are restrictions in ECB employment contracts (including match, series and tour contracts) and ICC event contracts regarding any commercial deals you’re able to enter into as an individual. For example, you are not permitted to enter into any agreements that conflict with certain ECB partners. This is detailed in the Commercial Partners Restrictions Grid...

COMMERCIAL PARTNERS RESTRICTIONS GRID INDIVIDUAL SPONSORSHIP GUIDELINES
• No appearances or activations, including social posts or press articles, should take place during England on-duty time by the player or the sponsor. On duty is defined, for commercial purposes, as from the moment the player arrives at the ground on the first practice day that is no sooner than two days before the first match day of each match until 7.00pm or one hour after the end of actual play on the last match day of each match whichever is the later • No activations should feature 3 or more players (both England Men and
England Women combined) as this implies an association with the team. • England kit/clothing should not be worn for any engagements or feature in any imagery, except in the case of bat manufacturers where imagery taken from the field of play can be used. • No England Cricket or ECB intellectual property (IP) should be used. • There should be no use of ‘England
Cricket Team’ or ‘Team England’ or words ‘England’, ‘Team’ and ‘Cricket’ consecutively (in any order) • ECB and ICC carve out clauses should be included to ensure you are not inadvertently in breach of contract where there is a conflict of sponsorships.
LICENSING / SIGNED MERCHANDISE
The PCA run a licensing programme in partnership with the ECB, utilising the player rights held by the TEPP (player images, likenesses, signatures etc) alongside the ECB’s IP to create products such as calendars, posters, clothing and video games. This is important both as a revenue stream and a marketing strategy, and a proportion of every product sold is distributed to TEPP. The split amongst players will depend on whether the items are team focused or associated with a particular individual. All products featuring players are approved at each stage of development by the PCA.

SOCIAL MEDIA
Whilst you own your social media channels and they are therefore your personal responsibility, the PCA encourages you to manage these in a responsible fashion and so has created a short guide regarding social media advertising for influencers.
This covers questions such as why the rules around advertising exist, when you should declare an advert on your social channels and how you should label your posts. Please be aware that the information here acts as a basic guide on the topic only and the information is not exhaustive, so it’s important you keep yourself up to date on the official rules and guidelines in this area.
The PCA has also developed a document which focusses on how you can activate your personal sponsorships on your social channels.
It details the restrictions that are in place to protect you from breaching your England contract and the terms of the Commercial MOU, for example when you can/can’t post, the rules around England clothing, etc. We encourage you to familiarise yourself with this document before sharing any commercial content on your social media.
