Is the Club a timeshare? No! Timesharing is not permitted within Vail Village. Members actually receive a fee simple deed to a particular condominium with the right to stay in any of the condominiums of a similar size. How often can a member stay at the Club? Each member can reserve 5 weeks planned vacation time throughout the year in addition to reserving lodging on a space available basis. There is no limit to the amount of time used subject to the Club’s reservation policies. Why was the Club Concept created? Austria Haus Club members and their guests will enjoy a full complement of features and amenities including: Valet Parking Upon your arrival, a valet will park your vehicle in the Club’s underground heated parking garage. Ski Valet Your skis, boots and accessories will be waiting for you in the Club’s locker room upon your arrival. The Club ski attendant will have your skis ready to go at the Club entrance each morning. If you desire, your skis will be tuned overnight and ready the next morning for a nominal fee. During your stay, you may wish to leave your skis and boots overnight at ski storage located at the base of the Gondola One. Ski Clothing and Equipment Storage There is no need to carry bulky skis or clothing through airports when you can leave your recreational equipment at the Club in a secured long term storage area. What is the Austria Haus Club? The Austria Haus Club is a private, memberowned club comprising spacious two, three and three bedroom penthouses residences and an elegant clubhouse. The Club has a streamside location in the heart of Vail Village, next to the Covered Bridge. Club amenities include a reception lobby, members’ lounge, ski locker room, fully equipped health club, heated outdoor swimming pool, underground parking and long term clothing/equipment storage for each membership. How is ownership of the Club evidenced? Title is evidenced by a real estate deed which is recorded and is guaranteed by a title insurance policy. Each member owns a debt-free undivided deeded interest in one of the Club’s elegantly furnished private residences. Each member also owns an undivided deeded interest in the clubhouse and common areas. Are there any Private Residence clubs at other ski resorts? Yes. The Deer Valley Club at Deer Valley Resort in Park City, Utah and the Franz Klammer Lodge in Telluride are Private Residence clubs. How many Memberships are sold? Austria Haus Club is offering a total of nine memberships for each Club residence. The total number of memberships will never exceed nine per residence or 162 members.
Why Buy Fractional Ownership? At the Austria Haus Club you are buying the amount of time you actually use not the entire year. It is more affordable than purchasing a whole vacation home with more services and in a better location. Fractional ownership offers: fee simple title, general warranty deed, rental opportunity, estate of inheritance, interest and real estate deductions, investment closely related to usage, minimum capital risk, expenditure only for practical usage, and most importantly - no maintenance and no housekeeping responsibilities. It is hassle- free! Is the Austria Haus Club a timeshare development? No. Timeshare is not permitted use in Vail Village. As a private resort club, Austria Haus Club gives member’s access to all Club-residences of their membership type and all Club facilities with the right to use them anytime, subject to reservation policies. Austria Haus Club membership is very similar to membership in a prestigious equity golf country club, except members reserve lodging rather than tee times. Why was the Private Residence club concept developed? The Private Residence club is designed to: 1) Provide more convenience, services, and amenities than are provided by an equally luxurious condominium development; 2) Provide member with as much vacation use as typical vacation homeowner uses his or her vacation home; and 3) Match the purchase price with this owner usage.
Will I always stay in the same Club residence? No. Members have equal access to all Club residences of their membership type. Members may request a specific residence and this request will be granted, when possible, according to the Lodging Reservations Policies and Procedures. What if the number of members wishing to stay at the Club exceeds the number of residences available? The Austria Haus Club has been designed to equitably allocate peak period reservations when demand for lodging may exceed supply. A computerized rotating priority reservation system insures all members will have equal access to peak-period lodging over the years. (The Lodging Reservation Policies and Procedures section provides a detailed explanation of member use privileges.) Do members pay housekeeping charges when they stay at the Club? Yes. A housekeeping fee will be charged for each visit. These fees cover daily bed-making, fresh towels and trash removal in addition to end-ofoccupancy cleaning. Members and guests may request daily maid service for an additional charge. Please see the Financial Information sheet for housekeeping and daily maid service charges. Which family members have Club privileges? Spouse and dependent children under the age of 25 have full membership’s privileges. What are the guest privileges? Members may invite unaccompanied Guests to use their confirmed planned vacation periods. Only members can use space available reservations.
How often can owners/members use the Club? As often as they wish, subject to the Club’s reservation policies. Each membership can reserve up to 14 days of Planned Winter Vacations, 14 days of Planned Summer Vacations and up to 7 days of Optional Planned Winter or Summer Vacations. After all the Planned Vacations are reserved, members can reserve additional lodging and a “space available” basis. There is no limit to the amount of use. If some members us the Club less than their available time, other members will be able to use it more. (The Lodging Reservations Policies and Procedures sections provide a detailed explanation of members use privileges.) Can Members rent their confirmed reserved Vacations? Yes. Members may rent their winter seasons Planned or Optional Planned Vacations with the exception of high demand periods such as Christmas and New Year’s. Members may rent any of their summer seasons Planned or Optional Planned Vacations. Space Available Vacations may not be rented. What happens to the revenues collected from Club rentals? Net revenues collected from rented weeks will be paid to respective Club member whose week(s) was rented. Rental commission rates will be published each year by the Board of Directors. Club members will be restricted from renting high demand weeks such as Christmas and New Year’s.
Can members use the Club facilities if they are not staying overnight at the Club? Yes. Members can use the Club facilities and common areas when not staying overnight. (The Lodging Reservation Policies and Procedures section provides a detailed explanation of member use privileges.) What is the quality of Club construction, furniture and accessories? Club construction is of the highest quality. Each residence is completely and elegantly furnished and features top of the line kitchen appliances. The accessory package includes kitchen utensils, cookware, dishware, and silverware. The living room has a large, stone, gas-fireplace. There is a LCD television, DVD and VCR in the living room and master bedroom and cable television in the other bedrooms.
Can an Austria Club Membership be resold? Yes. Like any other form of real estate, the member’s undivided deeded interest can be sold or transferred by the member, or sold by a licensed real estate through the multiple listing services, subject to the Club declaration and Bylaws. Who establishes the membership dues and controls the affairs of the Club? A member-elected Board of Directors establishes budgets and dues on an annual basis. Can families, individual, or companies share a membership? Yes. Austria Haus Club memberships allow two individuals and their families to have Club privileges. In addition, partnerships, corporations, and trusts can also become members. Do owners/members pay annual membership fees? Yes. The annual membership fees pay for the professional management and operation of all Club facilities and amenities. Included in these annual fees are funds for staff salaries, supplies, maintenance, insurance, trash removal, legal/ accounting, fuel, utilities, property taxes, transportation and refurbishing reserves of Club facilities.
OVERVIEW The Austria Haus Club Lodging Reservations Policies and Procedures have been designed to ensure that all members have equal access to the residence category they have purchased. Lodging categories include "Planned Vacations," "Optional Planned Vacations" and “Space Available Vacations." These usage options are described below. The Lodging Reservations Policies and Procedures have been carefully formulated in an attempt to be fair and equitable to all members. The Austria Haus Club Board of Directors reserves, as permitted in the Club's Declaration/Bylaws, the right to alter these Lodging Reservations Policies and Procedures from time to time as conditions warrant. Changes which intentionally discriminate against any category of membership are not permitted. In the event there is a conflict between the Declaration/Bylaws and the Lodging Reservations Policies and Procedures, the Declaration/Bylaws will control. Although the deed you receive to your membership will show a specific condominium number, members are purchasing the right to use a class of condominium residences and mayor may not stay in the condominium listed on the deed you receive.
TERMS AND DEFINITIONS Because the following policies and procedures are somewhat complex, certain terms and phrases have been defined below to clarify their intended meaning and usage. Throughout the following policies and procedures, these terms and phrases can be identified because they begin with capital letters. "Membership" - A Membership includes membership privileges for a particular residence category for the Member, his or her spouse and dependent children under the age of 25. "Member" - The owner of a Membership or the person or entity designated by the Owner to have Membership privileges ("the Designated Owner"), as defined by the Charter of the Austria Haus Club.
"Accompanied Guest" – This is any guest who lodges with a Member in the Member's reserved Club residence. The total number of persons lodged in a residence cannot exceed the Sleeping Capacity of that residence. No lodging fees are charged for Accompanied Guests. "Unaccompanied Guest" - Any guest who lodges at the Club without a Member during a Member's Planned and Optional Planned Vacation Period. A Member requesting lodging for an Unaccompanied Guest must specify the Unaccompanied Guest's name, address and telephone number in writing at least 14 days prior to arrival so that the Club Reservations Office can send a confirmation notice to that Unaccompanied Guest. Unaccompanied Guests are required to pay all housekeeping fees, gratuity fees, and incidental charges upon checkout unless payment has been arranged in advance by the sponsoring Member. The sponsoring Member is responsible for any outstanding charges made by their Unaccompanied Guests and/or damages to Club facilities caused by their Unaccompanied Guests. The number of persons lodged with an Unaccompanied Guest in a Club residence cannot exceed the Sleeping Capacity of that residence. Unaccompanied Guests may not occupy Space Available Reservations.
“Day Use Guest" – This is a guest of a Member who utilizes the Club's nonlodging facilities on a daily basis. The Member must accompany the Day Use Guest and Day Use Guests pay a daily fee for such usage. The Club Management may limit the number of Day Use Guests permitted on the premises during peak times.
"Day Use" - Members, and Guests Accompanied by a Member have unlimited use of the Club's amenities and
services (Club lounge, swimming pool, locker room and health club). Day Use is subject to availability and priority usage rights are assigned to Members and/or Guests lodging at the Club. Members should contact the Club prior to the intended day of use to assess availability of services and amenities. Members and their Guests must check-in daily with the Club Membership Office to register for Day Use. The Club has the right to limit Day Use by Members and the number of Guests accompanying a Member for Day Use. "Club Year" - The Club Year runs from November 1 through October 31 each year. "Sleeping Capacity" - This is the maximum number 'of persons permitted to occupy an Austria Haus Club residence. The Sleeping Capacity of a Club residence is the number of bedrooms times two, plus the number of sleeper sofas times two. "Planned Vacations" - These are the pre-reserved days when a Member can use the residences of his or her particular category or send Unaccompanied Guests to use the residences at no additional charge, except for the published housekeeping fees, gratuity fees and incidental charges. Memberships are given the opportunity to reserve up to 28 days (14 days in the winter and 14 days in the summer) of Planned Vacations each Club Year.
“Planned Vacation Reservation Periods" -
The Winter Planned Vacation Reservation Period is the 3D-day period from July 1 to August 1 of each year during which Members can reserve their Planned Vacation days for the upcoming Winter Season. The Summer Planned Vacation Reservation Period is the 3D-day period from February 1 to March 1 of each year during which Members can reserve their Planned Vacation days for the upcoming Summer Season. In the event a Member wishes to cancel a Planned Vacation period, that request for cancellation must be received by the Club, in writing, at least 14 days prior to the scheduled arrival, in order for the Member to retain the usage rights associated with the canceled Planned Vacation days. If the notice of cancellation is not received in writing at least 14 days prior to the scheduled arrival, the Club will deem all of the Planned Vacation days for which proper notification was not received to have been used. Members' right to re-book a canceled Planned Vacation is subject to availability.
"Optional Planned Vacations" - In addition to the 28 days of Planned Vacation per year, each Membership
will have one 7day Optional Planned Vacation per year. After all first and second Planned Vacation periods have been confirmed, Members will have the opportunity to pre-reserve their Optional Vacation Period of up to 7 days for either the Winter season or Summer season but not both. (If Membership uses the optional 7 days during the winter period, they have used their optional period for that year and will not be eligible for a summer optional.) "Optional Planned Vacation Reservation Periods" - Optional Planned Vacation Reservation Periods are available after the Planned Vacation Reservations have been confirmed and notices sent. The Winter Optional Planned Vacation Reservation Period is the 15 day period from August 15 to September 1 of each year during which Members can reserve their Optional Planned Vacation for the upcoming Winter Season. The Summer Optional Planned Vacation Reservation Period is the 15 day period from March 15 to April 1 of each year during which Members can reserve their Optional Planned Vacation for the up coming Summer Season. After these Reservation Periods, Optional Planned Vacations may be made subject to space availability. (There is one Optional Vacation available per year; if used during the winter, it is not available for the summer.) .
"Space Available Vacations" - Each Membership has unlimited access to and usage of its particular
residence category on a space available basis. Members can occupy a Club residence during Space Available Vacations for periods up to seven days per reservation. Each Membership can have only one Space Available Vacation reservation on the Club reservation books at a time (except as detailed below). Beginning October 1, members may make Winter Season Space Available Reservations during the remainder of the Winter Season. Beginning April 15, members may make Summer Season Space Available Reservations during the remainder of the Summer Season. Each Membership can request one additional Space Available Vacation reservation within five days of the desired arrival date. All Space Available Vacation reservation requests received between April 15-2D and October 1-5 will be processed by the Club reservations office based on the Membership's Reservation Priority Number for the respective season. Thereafter, Space Available Vacation requests will be processed on a first-come, first-served basis. If a Member fails to check-in at the Club on the reserved date without notice to the Club Management at least ten (1 D) days prior to scheduled check-in, the Member will be responsible to pay for one day of occupancy at the prevailing published rental (ate.).
"Winter Season" - The Winter Season begins no later than the published winter opening date of Vail Resort. The Winter Season ends no earlier than the published winter closing date of Vail Resort. The Board of Directors will determine and publish annually the Club's exact opening dates and closing dates for each Winter Season. "Summer Season" - The Summer Season begins in early May of each year and ends in late October of each year. The Board of Directors will determine and publish annually the Club's exact opening and closing dates for each Summer Season. "Rotating Priority Reservations System" - A Rotating Priority Reservations System has been established to
ensure that use of the Austria Haus Club by its Members is equitable. The Rotating Priority Reservations System is used to determine reservation confirmations when the number of reservation requests for a certain time period exceeds the number of Club residences available during that time period. "Reservation Priority Number" - The Reservation Priority Number is assigned to each Membership prior to confirmation of the Winter Planned Vacation periods. This number is used by the Club reservations office to allocate Planned and Optional Planned Vacation periods when demand exceeds lodging supply. This Reservation Priority Number rotates ach year, based on the original Membership number assigned at closing and included on the General Warranty Deed to equitably allocate Planned Vacation periods over the years. "Full Occupancy Option" - When a specific set of occupancy conditions are met, a Member may occupy a residence that differs in category from the residence type purchased. The Board of Directors, from time to time, will review and set the occupancy conditions under which members may use this Full Occupancy Option. A Member may occupy a residence that differs in category from the residence category which was purchased if: • All residences in the member's category are reserved. • The Member's reservation is made less than 15 days from the scheduled arrival. •At least one residence of the alternative residence type requested remains available to Members in that category after the Full Occupancy Option is exercised; provided, however, that within 48 hours of scheduled arrival, the Full occupancy Option may be exercised to take the last available alternative residence type. Rental of Planned Vacation Periods - Members may rent any of their winter season Planned or Optional Planned Vacations with the exception of high demand periods such as Christmas and New Year’s Week. Members may rent any of their summer season Planned or Optional Planned Vacations. Space Available Vacations may not be rented.
Internal Exchanging of Planned Vacation Periods - Members may exchange their confirmed Planned Vacations or Optional Planned Vacations with other Members. Members will be provided a reservations calendar after Planned Vacations have been confirmed for the Winter and Summer seasons, respectively. Exchanges should be arranged directly between Members. Written notice of an exchange must be provided to the Club reservation office at least 14 days prior to the arrival date of the Member using the earliest Planned Vacation involved in the exchange. Club Management encourages and will make all reasonable efforts to facilitate such exchanges between Members. Maintenance Periods - The Club may be closed from time to time for Maintenance Periods to allow for performance of maintenance projects that are otherwise disruptive to normal Member services, minimize cost of operations during marginal weather times and provide the Club staff an opportunity for vacations between seasons. The Board of Directors will set the actual dates of the Maintenance Periods, if any, for each Club Year.
WINTER SEASON Planned Vacations and Optional Planned Vacations
By June 1, of each year, Members are mailed a Planned Vacation reservation form which requests Members to select their Planned Vacation dates for their residence
type for the upcoming Winter Season. The Reservation Priority Number for each Membership will be noted on the Planned Vacation reservation form by the Club reservations office. If the Planned Vacation reservation form is not received by the Member by June 14, the member should immediately notify the Club reservations office. Each Membership is allowed two Planned Vacation Periods and one Optional Planned Vacation within their respective residence category (see Winter option below). Each Planned Vacation Period can be a maximum of seven days with arrivals and departures planned between or on Saturdays. I.e. each seven-day period begins and ends on Saturday. Exceptions to the arrival and departure times may be made, at times, by the Club's management. By July 1, of each year, the completed Planned Vacation reservation forms are returned by Members to the Club reservations office. It is the Member's responsibility to complete and return the Planned Vacation reservation form by July 1 to preserve priority rights for the upcoming Winter Season. Planned Vacation reservation forms received after July 1, will be considered on a first-come, first-served basis after the Planned Vacation reservation forms which were received in a timely manner have been processed. After July I, the Club reservations office allocates the Planned Vacation Periods in the following manner: First Planned Vacation Period - Memberships are confirmed for a maximum of seven days based on their requests and their Reservation Priority Numbers. When demand for certain dates exceeds lodging supply, the memberships with the lowest Reservation Priority Number will be confirmed. Second Planned Vacation Period - After the First Planned Vacation Periods are confirmed for Members, reservations are confirmed for up to seven additional days. When demand for certain dates exceeds lodging supply, the Memberships with the highest Reservation Priority Number will be confirmed. By July 15, written confirmation of the Winter Planned Vacation Periods is sent to each Membership along with an Optional Winter Planned Vacation reservation form. Additionally, a reservations calendar will be sent indicating which dates have been reserved by Members and those that are available for Optional reservations.
Optional Planned Vacation Period - By August I, of each year the completed .. Optional Planned Vacation" reservation forms are returned by Members to the Club reservations office. Members' reservations for Optional Planned Vacations are confirmed for up to seven additional days. When demand for certain dates exceeds lodging supply, the Memberships with the lowest Reservation Priority Number will be confirmed. By September 1, written confirmation of the Optional Winter Planned Vacation reservation is sent to those Members who requested these reservations. On September 1, Members may make "Space Available" reservations during the remainder of the Winter Season.
On September 1, Members may make Space Available reservations within their respective residence category during the remainder of the Winter Season. All Space Available Vacation requests received by the Club between September 1 and September 5 will be processed based on the Membership's Reservation Priority Number. After September 5, requests will be processed on a first-come, first-served basis.
SUMMER SEASON Planned Vacations and Optional Planned Vacations By February 1 of each year Members are mailed a Planned Vacation reservation form which requests Planned Vacation dates for the upcoming Summer Season. Each Membership retains the Reservation Priority Number assigned the previous July. If the Planned Vacation reservation form is not received by the Member by February 14, the Member should immediately notify the Club Reservations Office. Each Membership is allowed two Planned Vacation Periods and one Optional within their respective residence category (if the Optional was not used for winter reservations) during the Summer Season. Each Planned Vacation Period can be a maximum of seven days with arrivals and departures planned between or on Saturdays I.e. each seven-day period begins and ends on Saturday. Exceptions to the arrival and departure times may be made, at times, by the Club's management. By March 1 of each year, the completed Planned Vacation reservation forms are returned by the Members to the Club reservations office. It is the Member's responsibility to complete and return the Planned Vacation reservation form by March 1 to preserve priority rights for the upcoming Summer Season. Planned Vacation reservation forms received after March 1 will be considered on a first-come, first served basis after the Planned Vacation reservation forms which were received in a timely manner have been processed. After March I, the Club Reservations Office allocates the Planned Vacation Periods in the following manner: First Planned Vacation Period - Memberships are confirmed for a maximum of seven days based on their requests and their Reservation Priority Numbers. When demand for certain dates exceeds lodging supply, the Memberships with the highest Reservation Priority Number will be confirmed. Second Planned Vacation Period - After the First Planned Vacation Period is confirmed for Memberships, reservations are confirmed for up to seven additional days. By March 15, confirmation of the Summer Planned Vacation Periods is sent to each Membership along with an Optional Summer Planned Vacation reservation form. Additionally, a reservations calendar will be sent indicating which dates have been reserved by Members and those that are available for Optional reservations.
Optional Planned Vacation Period - By April 1 of each year the completed Optional Planned Vacation reservation forms are returned to the Club reservations office. Members reservations for Optional Planned Vacations are confirmed for up to seven additional days. When demand for certain dates exceeds lodging supply, the Memberships with the lowest Reservation Priority Number will be confirmed. By April 15, written confirmation of the Optional Summer Planned Vacation reservation is sent to those Members who have requested these reservations. Space Available Vacations On April 15, Members may make Space Available Vacation reservations within their respective residence category during the remainder of the Summer Season. All Space Available Vacation requests received by the Club reservation office between April 15 and April 20 will be processed based on the Membership's Reservation Priority Number. After April 20, requests will be processed on a first-come, first-served basis.
For those rare weeks in which there are more reservation requests than accommodations available, a Rotating Priority Reservations System has been established to insure that use of the Club by Members is fair and equitable. Rotating Priority Reservation System - Members will be assigned a Reservation Number in their category (two-bedroom, three-bedroom, and three-bedroom penthouse) based on the order in which they purchase. Members are included in a particular Reservation Group (A through I) based on their Reservation Number. Member Reservation Numbers, and consequently Member Reservation Groups, will not change from year to year. The order of selection for the first week in Year 1 will start with the first number of Reservation Group A and end with the last number of Reservation Group 1. For the second week in Year 1, the order of selection shall be the reverse of that of the first week, i.e., starting with the last number of Reservation Group I and ending with the first number of Reservation Group A. In Year 2 and each subsequent year thereafter, each Reservation Group in the first week (both summer and winter) shall move up one position in the order of selection with Reservation Group A (or whichever Reservation Group was in order of selection position 1), moving down in order of selection to position 9. The order of selection for Reservation Groups in the second week (both summer and winter) will always be in reverse order of the first week for that year.
