Christmas 2015 Introduction Dear Valued Customer, Thank you for your business in 2014, we had another great year with Christmas growth of 8.0%, in fact since we formulated our new strategy and presentation in 2012 we have grown sales at Christmas by 28.5%. We believe that by continuing to grow, giving consumers what they want, and working in partnership, we will help to make your business more profit this Christmas. In 2015 we intend to improve all aspects of our Christmas offer, accordingly, we have tweaked the 2015 strategy to reflect current customer and consumer trends. Across the retail industry the theme is ‘less is more’ with retailers seeking increased sales from selling smarter by stocking a tighter range. This year, our ‘smarter’ range has a strong focus on Innovation and Value along with a very strong Continental Christmas Confection theme. The Christmas 2015 catalogue contains 799 lines and features: 287 new products; 417 exclusive skus; 379 British lines; 7 new brands; 342 price freezes; along with 351 products that can be sold for under £5 and 707 for under £10. The basic formula will remain the same Genuine Innovation, Traditional Fayre at Fair Prices and Great Promotional Offers. Our insight is that at Christmas our customers and consumers want something new, but need a range that is different and better than that on offer elsewhere. Thank you also for the positive feedback about our brochure, which you will see has been slightly changed this year to reflect a request from customers to see all of a brands products in one section, for example complete ranges of Fosters, Lindt, Anthon Berg etc. We mentioned our Continental Christmas Confection theme so join us on our Grand European tour, where we have chosen for you a fabulous range of traditional treats. We bring you, Chocolates from Belgium, Switzerland and Poland, Liqueur Confectionery and Marzipan from Denmark, Nougat from Holland and France, Stollen from Germany, Biscuits from Austria, Amaretti and Panettone from Italy and Turkish Delight from the land of Eastern promise. The Fosters brand of 136 premium lines features new ranges of Cakes (including our stunning Christmas Chocolate Yule Log and luxury topped fruit cakes), Retro Gifts and Hampers. The extensive Personalised section compliments our recently launched comprehensive ranges of individually designed products with high definition, full colour front-of-pack labeling on all products. Check out the new Gift Boxes and Hamper selections. Through Genuine Innovation we have improved our Hamper, Gifting Tin, Biscuit, Cake, Liqueur Confectionery and Marzipan ranges. Look out for our Tunnocks and Festive themed Tins, and there is a rumour that there is a Gnome hidden in one of our Hampers! We think the Kuchenmeister ‘Liqueur Cakes’ will continue to be a great success and we expect the Amaretti Virginia range to go from strength to strength. In bringing to you Traditional Fayre at Fair prices we are delighted to introduce our new Scottish shortbread ranges from Dean's and House of Edinburgh. Our Great Promotional Offers include a repeat of the volume related discount structure, and a series of price matches on key lines, so once again you can be sure that we will be competitive on price. Terms & Conditions of Sales Prices

All prices shown are strictly net and are subject to change without prior notification. Every effort will be made to maintain prices, but exchange rate fluctuations, tax changes and variations on raw material costs may necessitate immediate price changes, and all orders are accepted on this basis.

New Accounts

Two satisfactory trade references must be received before a credit account may be opened. All initial orders must be pro-forma and paid for by cheque, credit card or by credit transfer into our bank account (please ask for further details).

Credit Terms

Our terms are payment within 30 days from the date of invoice, unless otherwise agreed. If payment is not made within the agreed terms, we reserve the right to charge interest at 2.5% above the prevailing base rate to the invoice value, excluding any interest or other costs should court proceedings become necessary. However if the debt is paid within the agreed terms no interest shall be payable. Re-presented cheques are all charged £10 for each re-presentation.

Orders

You can place orders directly with your sales contact/Territory Manager or by email, telephone, faxing or writing to our Customer Service department in Market Harborough. Please state clearly your account number, product code, product description and quantities of items required. Please be aware that our product and price list is constantly changing and some items you order may not be currently stocked. If in doubt please call Customer Services on 01858 438000.

Deliveries:

Carriage paid orders are subject to a minimum order value, please contact Customer Services or your Territory Manager regarding delivery charges. Timed deliveries are subject to charges, please contact the Customer Services team for further details. Although every effort will be made to deliver goods as ordered, the group cannot accept responsibility for any delay for circumstances beyond its control and accepts no liability whatsoever for any loss arising from any failure to supply under any circumstances.

Cancellation of Orders:

All orders placed form a contractual agreement between both parties. We reserve the right to apply a cancellation fee for all cancelled orders: 28 days or less prior to requested delivery date – 40% of order value 14 days or less prior to requested delivery date – 100% or order value

Delivery Discrepancies Claims

Claims should be made to the Group’s Credit Administration Department telephone 01858 438018. All goods must be counted upon receipt and any shortage noted on the delivery note at the time of delivery. If customers are unable to check on receipt, the POD must be signed “UNCHECKED”. All goods must also be checked for damages upon receipt and any damage must be indicated on the delivery note at the time of delivery. If customers are unable to check on receipt, the POD must be signed “UNCHECKED”. Photographic evidence of the damage will be required to validate the claim. Any claim in respect of the above should be made by telephone (01858 438018), facsimile (01858 433606) or email (marian.ward@fosters-foods.co.uk) to the Group’s Credit Administration Department within 2 working days of the delivery. Claims submitted after this time will automatically be rejected. Goods which have been in your possession for longer than 21 DAYS cannot be refunded for credit. Credit cannot be given for goods that are already price marked. Product quality issues can be discussed with the Customer Services Manager on 01858 438065. In the interests of food safety, the Group cannot accept the return of opened or part packs of products unless by prior agreement with the above Manager. Please note: Goods cannot be returned without an uplift note.

Title

Until payment in full of the purchase price, together with payment of all other sums due from the customer to the Blueberry Group Limited for the property in the product (The Goods), the Goods shall remain the property of the Blueberry Group Limited, but the risk therein and all liability to third parties in respect thereof shall pass to the Purchaser on delivery. The Purchaser shall keep the Goods in such a manner that they shall be identifiable by the Blueberry Group Limited. The Purchaser may sell the Goods in the normal course of its business but in a fiduciary capacity as bailee of the Goods and shall hold and pursue all claims to proceeds of their sale equal to the price of the Goods for and on behalf of the Blueberry Group Limited. In the event of non-payment by the Purchaser by the due date, the Blueberry Group Limited shall be entitled, in addition to all other rights, to enter any premises where the Goods may be, and recover possession of them. Unless specifically agreed in writing by a director of Blueberry Group Limited, this retention of title clause supersedes any other third party terms regarding retention of title.
