This summer has been intolerably hot and unreasonably dry. Usually records are something to brag about, but if they’re in the meteorological category nobody wins. As a result of the extreme conditions I gave up one of my favorite stations, the Weather Channel. Too much anticipation trumped by dissipation, a process that clobbered any cloud that peeked over our state borders. And brother, did I miss good old-fashioned thunder storms. There’s nothing like the air after one roars through; crisp, clean and ready to take on whatever the thermometer throws its way. There are signs as we go to press that matters are improving, so here’s to a benign fall forecast. Of course Indiana farmers have borne the brunt of this calamity. I played golf with an agriculturist (that’s what she called herself) and she seemed remarkably sanguine. “Oh, it’s “88 all over again; we’ll be back to rights next year.” And judging by the bounty at Carmel’s Farmers Market, farms have managed to produce this season. The corn was delicious as were the tomatoes, and booths seemed to be humming with activity. Each and every visit to the new market location yields fresh discoveries and conversations with old friends (see adjacent photo). Don’t miss “Harvest Feast” for a guide of what’s available there through October 6th, along with winning recipes for delectable dishes. If you want to indulge your sweet side, see “Captivating Cupcakes.” That had to be our best photo shoot ever but also the most caloric. Bet you won’t be able to resist a trip to one of Carmel’s many bakeries after you look these goodies over. While you digest all the above, sit down for inside perspectives from local attorneys in “Law & Order,” or read “The State of Real Estate” as executives dish about our housing market. A little food for thought, you might say, as you browse through this issue of the Carmel City Magazine.” Finally, don’t miss the BMW Championship at Crooked Stick Golf Club from Sept 3 – 9. pon graduating from law school in 1983, I joined Campbell Kyle Proffitt as an associate attorney. The firm had a long and storied history, which began in 1915 above the Crane Cigar Store on the east side of the public square in Noblesville. Yale educated Cassius M. Gentry and Michigan graduate Frank S. Campbell initially opened as Gentry & Campbell. When Ernest E. Cloe joined in 1921, the firm experienced the first of what was to be several name changes, this one to Gentry, Cloe & Campbell. It wasn’t until 1975 that CKP acquired the name that it bears today. In the 1930’s and in deference to their clients, many of whom were farmers whose boots were caked with mud, Cloe & Campbell refused to carpet their floors. As such, Frank Campbell spent his first morning as an attorney sweeping the firm’s wooden stairs and mopping the linoleum floor, just as he had done as a boy under his father’s tutelage. There were four desks shoved together in the front room with bookshelves on two walls. A middle room had a single desk and file cabinets, the next room housed a secretary, and the last was used as a combination bathroom/storeroom. When my practice began in 1983, documents were drafted in long hand on yellow legal pads and letters were dictated to secretaries who then transcribed them. There weren’t computers, there were “word processors” manned only by support staff. There was an electric typewriter that I liked to use, and I recall Frank Campbell sitting down to explain that lawyers simply did not type, secretaries typed. There was no fax machine, no e-mail and there were no mobile phones. Everything was sent by “snail mail” and the pace of work and life was much slower. Our firm did well to keep up with the times. I can remember when we added voice mail to our phone
system. Then the fax machine arrived with that strange paper and the fading ink. Color copiers were a fun innovation. First a few of the lawyers and eventually all of them got computers on their desks. E-mail proved to be both a blessing and a curse, and soon the desktops were replaced by laptops and wireless network access that allows us all to work virtually anywhere. Of course, smart phones have only added to the degree to which we depend on technology. The practice of law has also changed dramatically since then. My specialty is family law and in the ‘80’s there were no statewide child support guidelines and only a few counties had “visitation” guidelines. Most men worked and most women stayed home. In a majority of divorce cases, the mother had primary custody and the father got to visit. Couples had rarely been in counseling before seeing a lawyer and mediation didn’t exist. Now, before divorcing many couples have done research about the impact of divorce on families, have sought counseling and are knowledgeable about mediation and willing to participate. As a result, cases have tended to move away from the middle ground that characterized my earlier cases, to those that are either fairly uncomplicated or those that become the colloquial “war of the roses.” Our lawyers at CKP have personal interests as varied as their areas of practice. During its history, two of the firm’s past partners (Campbell and Proffitt) have served as President of the Indiana State Bar Association, quite an accomplishment for a firm our size. Both William E. Wendling and I have served as President of the Indiana Bar Association, while Scott Wyatt is an actor at the Belfry Theatre and board member for the Noblesville Cultural Arts Commission. ou’ve seen the ads before, maybe on the side of a bus or perhaps in a magazine. “Hire Us…Before Your Spouse Does.” Very catchy, easy to remember and featuring a group of attorneys just as easy on the eye. A memorable ad campaign, however, doesn’t guarantee success. Throw in expertise, personality and boundless energy and you’ve got a winning formula. Meet Kena Hollingsworth and Christina Zivitz, the founding partners of Hollingsworth & Zivitz, who personify the firm’s dynamic philosophy. After graduating from Indiana University School of Law, Kena and Chrissy began their legal careers with a “small, wonderful family firm” in Indianapolis. Following three plus years of experience there, they ventured out on their own in search of flexibility and a chance to be in charge. “It was a risky start-up with three attorneys,” says Kena. “Our business plan at that point was to cover the bills. We also timed our opening with the publication of the Yellow Pages because we had no idea what else would make the phone ring.” They hit the ground running at Michigan and 96th and moved after five years to the present location at Meridian and 116th in 2009. Neither Kena nor Chrissy anticipated the growth they experienced or the joy they’ve had running their firm. “Our approach with the lawyers at Hollingsworth & Zivitz is flexibility with expectation,” says Kena. “Each attorney has his or her own schedule. We have a large break room, an on-site Trek-Desk and a small workout room, which enable our employees to take time out and reenergize. Family law cases can be stressful and we do everything to foster balance for those who work

here.” In 2012 this emphasis on workplace harmony garnered the “Best Employer Award” in the state of Indiana for a company with fewer than 250 people. That’s well deserved recognition for Kena’s and Chrissy’s nurturing management. Kena and Chrissy treat their clientele equally as well. According to Kena, “We personally interview all potential clients so that we can recommend the best fit with one of our attorneys. Since our practice is dedicated to divorce and other issues affecting families, we frequently handle cases with emotionally charged circumstances. Our goal is to eliminate as much drama and contention as possible for our clients, and get them to the next best stage in life. We find that the process is more efficient and productive if the client and lawyer can comfortably relate. We focus on resolving conflict rather than prolonging litigation, which involve counseling, compromise and common sense solutions. We save the ‘bulldog’ approach for the courtroom, and encourage resolution of issues through mediation, settlement conferences and collaborative law philosophies rather than litigation.” The roster of attorneys at Hollingsworth & Zivitz continues to grow. “We have a naturalistic way of finding new people,” states Kena. “There are no help wanted signs. If we encounter someone we like through personal or business contacts, we try to make a spot. Grades are not as important to us as compatibility with our firm and empathy with our clients.” Elizabeth Eichholtz typifies this approach. She began clerking while she was in law school and liked the hands-on environment so much that she never looked elsewhere after graduating, though her outstanding academic record gave her plenty of options. Outside the offices, almost every member of the HZ team is passionately involved with charities. The firm, for instance, just recently spent a day working with Habitat of Humanity. Kena serves on the board of “Girls’ Nite In” (started by Jimmelyn Rice, an Indianapolis school teacher) which has monthly meetings to help young girls deal with issues such as body image, toxic relationships, eating disorders and divorce. “Chrissy and I have dealt with divorce in our personal lives, so we relish the opportunity to talk with these kids. It’s one way to help others through what we’ve learned in our professional and personal experiences, both at work and at home.” 17

ocated in an attractive office across from Carmel City Center, Knowles & Associates P.C. continues the tradition of providing legal services that began in 1934. Mr. Knowles initiated his career by working his way through Indiana University School of Law as a Trust Officer at Indiana National Bank. After graduating in 1969, he joined what was then Baker & Orbison, the firm that represented his family. “I received a phone call soon after from the former Indiana Court of Appeals Judge Stanley Miller, then United States Attorney for the Southern District of Indiana, who offered a position to me as an Assistant U.S. Attorney. I accepted and gained valuable experience trying cases for the United States Department of Justice.” When he returned to private practice on Main Street in Carmel in 1970, Mr. Knowles recalls that “very little was going on downtown. There was a movie theater around the corner where I took my wife on our first date. Tickets then were only 50 cents but the investment was priceless.” Settled in with a growing family, Mr. Knowles added more experience to his legal resume as Marion County Deputy Prosecutor and as the first Carmel City Attorney. In 1973 the firm became Baker Orbison Bales & Knowles and eventually moved to East Carmel Drive. Subsequently Mr. Knowles was able to purchase property on S. Range Line Road where his offices have been located ever since. “I’ve always loved estate planning,” Mr. Knowles says. “Although my primary focus is Central Indiana, I have the opportunity to talk to people from all over the state of Indiana and help them deal with real, everyday problems. Even lawyers are not immune to procrastination. According to the American Bar Association, only 30% of them have wills. If professionals ignore the need
to plan ahead, just think of those in the general population who haven’t made arrangements. That’s why our primary goal is to take care of people while they’re still alive and able to make their own decisions. Many fail to realize that if they do not make a plan, the state provides one through laws of interstate succession. I can almost guarantee the state’s plan may not provide for the care or the distribution of assets as they would prefer. Once we’ve assisted individuals or families with their trust arrangements, the documents are valid wherever they might be.” Mr. Knowles still manages to find time outside the office for his hobbies, which include boating on Lake Michigan, photography, hunting and fishing. Framed prints with wolves that hang on the office walls illustrate his interest in the outdoors as well as his career. “These pictures actually portray the different phases of litigation,” Mr. Knowles explains. “If you look closely, each print is labeled with a phrase, such as ’Strategy,’ ‘Tactics,’ Summary Judgment,’ ‘Verdict’ and ‘Settlement.’ It’s an expressive way of looking at the art employed by attorneys in the courtroom.” Even more impressive is his volunteer resume. Mr. Knowles is a life member of Sertoma Inc. and began his association in 1964. He was the first president of Carmel Sertoma and continues to actively participate in Broadripple Sertoma. He is particularly proud of its fund raising efforts, which include Casino Night parties for up to 500 people. Broadripple Sertoma’s main beneficiaries are Noble of Indiana, serving the developmentally disabled, and the Craniofacial Unit at Riley Children’s Hospital. It’s been a rough couple of years for insurance carriers if you’re talking about Homeowners Insurance. The cost of a Homeowners Policy is on the rise across the country. We’re here to help you understand why those rates are going up and what you can do to avoid or offset those costs. We’ll start off with WHY. The answer is that we’ve had a sustained rough patch when it comes to natural disasters and weather. Losses exceeded $15 billion from April to June of 2011 alone. These are the highest losses on record for the second quarter. Let’s refresh your memory on what occurred: n Hurricane Irene ran up the east coast. n Wind and hail caused over 20,000 severe weather reports in the first half of 2011. 23
n Tornadoes tore across Missouri and Alabama. n Wildfires blazed all summer in Arizona, Texas and New Mexico with losses expected to exceed $250 million. n States from Texas to New England weathered ice and snow. n There were multiple earthquakes with Virginia experiencing the most significant damage. These losses have also put a strain on the construction and materials industries, driving up repair costs. This in turn has led to costs exceeding the market value of some homes.
So what’s the plan? First, we have to recommend that you place your insurance with an independent insurance agent. Independent insurance agents represent a variety of carriers (a carrier would be Travelers, Hartford, Erie, Central, etc.) and can get you multiple quotes to find the best fit for you. There are also a couple of ways to offset a cost increase if you get hit with one: n Increasing your deductibles exposes you to a little bit more cost if you have a loss, but can lower your premiums. n Policy bundling is a great way to lower your insurance costs if you don’t already have your homeowners and auto insurance with the same carrier. n Some carriers give loyalty and/or experience credits. Stay with the same carrier for multiple years and these credits can be added. n Loss prevention can also get you some bonus credits. Call your agent and see if adding a burglar and/or fire alarm to your home would qualify you for additional savings.

All of its schools receive an “A” rating from the state, real estate taxes are comparatively low, the community values family and culture and it has a vibrant downtown Arts and Design District. Stability……. David Caveness Carmel has not been immune to ills in the housing sector. Home values have softened over the past five years, first with the decline in new construction beginning in 2007 and continuing today, and then with the resale sector beginning in 2008. Values began a steady rebound in the late spring of 2011 and continue to improve in 2012. What was a substantial surplus in housing inventory over the past four years has rapidly shifted to a more balanced environment. We are seeing a definite seller’s market emerging in the $250,000 to $350,000 price range.

Jimmy Dulin While prices dropped from 2007 through 2009, they have recovered nicely in Carmel. The median sold price went from $274,000 in December 2007 to $261,000 in 2008, dropping further to $245,000 in 2009, but rebounding to $270,000 on 2010 and $275,000 in December 2011. The average sold per asking price stayed steady as well, going from an average of 97.06% in 2007 to 96% in 2011. Even days on the market have stayed fairly consistent, from 57 days in 2007 to 64 in 2011. Tracy Hutton In these tough economic times, we are pleased to report growth in our real estate market. Although in small increments, the stock market and job rates are seeing an upswing. Interest rates
are at an all time low. Residents who rent are seeing a shifting dynamic towards the value of property ownership. Conditions are right for a sustained housing recovery and there has never been a better time to invest in a home. John Snavley Home sales are yet to return to pre-recession levels, but activity is picking up thanks to an increase in the employment rate and buoyed consumer confidence. Currently the market is bustling with first-time homebuyers as well as trade-up buyers, who are benefitting from competitive pricing. In 2010, 707 houses priced less than $300,000 and 348 houses priced between $300,000 $499,999, sold in Carmel. Last year, we saw an increase in sales of 770 houses and 391 homes in the same price categories.

For forty years there has been plenty of development potential inside the city. That expansion is coming to an end. Carmel is entering another phase of its evolution and becoming a “mature” community. I believe we are already seeing this in the redevelopment of the Rangeline Road corridor and areas like the old downtown district. Carmel clay veterans memorial The plaza was established by the Carmel Clay Memorial Corporation to create a place to honor veterans. It proudly displays a beautiful bronze military sculpture by Indiana artist William H. Wolfe. Prepare asparagus for cooking by snapping off lower part of asparagus stalks. Place asparagus in large skillet and cover with cold water. Stir in sugar and salt. Bring to a full boil and cook for 1-3 minutes, depending on freshness and size of stalks. Remove from heat and let stand, uncovered, at least 30 minutes. Asparagus may remain in water for hours. When ready to serve, reheat just to a boil; drain and serve.

Cut broccoli flowerets and tender stalks into bite-size pieces. Discard woody stems. Place broccoli, bacon, onion, nuts, raisins and mushrooms in large bowl. Mix together mayonnaise, sugar and vinegar. Pour over broccoli mixture. Toss gently. Chill for 2-4 hours before serving.

• • • • • • Preheat oven to 350°. Grease an 8-inch square baking dish. Place carrots in medium-size saucepan and cover with salted water. Bring to a boil; reduce heat and simmer, uncovered, for 20 minutes or until carrots are tender. Drain. Place margarine, eggs, sugar, flour, baking powder and vanilla in blender. Add carrots a little at a time and puree the mixture. Pour into prepared baking dish. Bake at 350° for 45 minutes or until firm. Let stand for 5 minutes before serving. Note: this may be made a day ahead and refrigerated. Bring to room temperature before cooking.

even winter tomatoes are good when cooked this way 2 tablespoons butter 2 large onions, thinly sliced 12 slices bacon, divided 2 cups fresh soft bread crumbs, divided 3-4 fresh ripe tomatoes, thinly sliced 2 cups grated sharp Cheddar cheese 3 eggs ½ teaspoon salt ⅛ teaspoon freshly ground pepper chopped fresh parsley
• • • • • • Preheat oven to 350°. Butter a 9-inch pie plate. Melt butter in medium-size skillet over medium heat. Saute onions for 3-5 minutes. Set aside. Cook 9 slices of the bacon. Drain and crumble. Reserve remaining 3 slices. Place 1 cup bread crumbs in prepared pie plate. Place ingredients in layers as follows: tomatoes, onions, cheese and bacon. Repeat layers until all ingredients are used. The pie will be mounded but cooks down.

• • • • • • Preheat oven to 350°. Trim ends from zucchini; cut in half lengthwise. Place in large saucepan. Cover with water. Add 1 teaspoon salt and bring to a boil. Boil for 5 minutes. Drain. Hollow out inside of each zucchini half and discard pulp. Beat egg in medium-size mixing bowl. Stir in feta, garlic, pepper, nutmeg and spinach. Fill zucchini halves with mixture. Place in shallow baking dish. Sprinkle with Parmesan. Cover with foil. Bake at 350° for 20 minutes. Remove foil and bake another 1015 minutes.

ith award-winning schools, thriving businesses and family-oriented neighborhoods, it’s no surprise that in the last five years Carmel has been voted one of the top places to live and raise a family by the likes of Forbes, CNNMoney and Yahoo! Voices. This year, Carmel is adding two more notable milestones. During 2012, Carmel is commemorating its 175th year as a community. In September, the city is welcoming some of the biggest names in golf to Crooked Stick Golf Club for the 2012 BMW Championship, the penultimate event in the PGA TOUR Playoffs for the FedExCup. Crooked Stick is no stranger to hosting large events. In 1991, John Daly came out of nowhere to capture the PGA Championship, Lauri Merten shocked the golf world by finishing the 1993 U.S. Women’s Open with three straight birdies to win her only major title, and the U.S. reclaimed the Solheim Cup in 2005 with a then record crowd of 103,500 in attendance. The BMW Championship is the largest golf event to come to Indiana since Daly’s magical run. It will feature the top 70 PGA TOUR players competing for an $8 million

purse and the final 30 spots in the Playoff finale, The TOUR Championship. The overall winner of the FedExCup will receive $10 million in prize money. Patrons can expect to see many of golf’s biggest names, including Masters champion Bubba Watson, three-time Masters winner Phil Mickelson, and Tiger Woods, owner of 14 major championships. Patrons can also mingle with local celebrities and dignitaries at special events during tournament week, including the Pro-Celebrity Shootout and the Gardner Heidrick Pro-Am. All proceeds from the BMW Championship, expected to total more than $2 million, will benefit the Evans Scholars Foundation, which provides caddies from modest backgrounds with full college tuition and housing scholarships. The Western Golf Association has administered the Chick Evans Scholarship through the Evans Scholars Foundation since its founding by famed Chicago amateur golfer Charles “Chick” Evans, Jr., in 1930. Recently the WGA awarded nine Hoosier caddies with scholarships, which include two local high school seniors: Jackson Schuette, Carmel (Carmel High

School), and Cory Jones, Indianapolis (Pike High School). The scholarship, valued at an estimated $17,500 annually, is renewable for up to four years. Currently, 825 caddies are enrolled in colleges across the U.S. as Evans Scholars. For the city of Carmel and Crooked Stick, hosting this event means more than a weekend of golf. The tournament will also generate an estimated $30 million for Central Indiana and draw more than 125,000 spectators, making it one of the biggest spectator sports in the state this year. Additionally, more than 2,600 volunteers are expected for the tournament, including 168 Crooked Stick members, which surpassed organizers’ expectations. Corporate hospitality sales are also approaching record numbers, clearly demonstrating that Hoosier Hospitality is on full display. I’ve been a trainer for three plus years and have been an advocate of stretching for just as long. Confession time; I don’t always make the time to stretch. In fact, like everyone else, sometimes I will find any excuse to avoid it. But here’s the thing; focusing a little energy towards stretching prevents injuries and allows me to run 12 hour team races, lift heavy weights and not feel awful after any given workout. According to a study done at the University of Arkansas, there has been a 35% increase in the number of gym injuries in the past few years. The two primary reasons are insufficient stretching and incorrect form. Incorrect form leads to muscle imbalances, which always increase tension, and that increases our chances of injury. Here are a couple of tips to prevent some common injuries.
The problem: ankle pain. Unfortunately, the problem doesn’t usu-

ally stem from the foot. Rather, it starts at the top of the body. Everything from cars to computers causes us to hunch forward and that throws off our center of gravity. Without getting into too much science, the ankle becomes overloaded.
The fix: a professional trainer. This is where a center such as “The Next Step” can help. We repair the cause of the problem and undo muscle imbalances, which in this case results from rounded shoulders. The best way to put you back into a neutral position is to do exercises that will strengthen the back and shoulders and stretches that will release the tightness in the chest.
The problem: knee pain. Knee problems arise from a few different
causes. A lot of the time it’s due to one muscle being tighter than another, or once again, the problem could arise from a desk job. Muscles in the hips become 101

weak from not moving, so if you sit all day and then decide to go for a run, your knees are in for an unpleasant surprise. Imagine building a race car that’s strong in the front and back but not so sturdy on the sides. Now send that car into a 500 lap race and you’ll quickly see that stress will cause the frame to twist and torque. All that painful twisting in a human gets directed right into your knees.
The fix: start with lunges. Bending at the
hips and ankles will strengthen and stabilize the knee. This combined with other lower body exercises and improvement in posture will alleviate unwanted knee pain.

In summary, the best methods to keep your body injury free are stretching and correct form. Though often avoided, the stretch does not have to be time consuming or painful. Using proper technique will allow your muscles to lengthen and become more flexible, which in turn improves range of motion AND helps prevent injuries. Balance your stretching by using all sides of your legs, torso and arms. This will ensure that no muscle is pulling more on the skeletal system than another. A good session shouldn’t take longer than 12 minutes. By doing this and other exercises correctly, you can enjoy pain-free fitness.
