Letter from the Editor
“Summer in the City” has finally arrived, and heaven knows we deserve a little sunshine. With a calendar chock full of things to do, it’s time to get up and at ‘em. Our feature just scratches the surface of activities in Carmel, so when you’re on the computer check out the Community Calendar at www. CarmelCityMagazine.com where events are added daily. Subscribe to receive Weekend 101 for weekly updates and you’ll be only one or two clicks away from all that Carmel has to offer. Since it’s a priority to spend time outdoors this time of year, it was disheartening to see how badly our yard fared after last winter. Some of the bushes simply curled up and died. Oh well, we can replace those. The patio, however, has an alarming list to one side, like it froze in place and can’t get up. That’s definitely more complicated in terms of $$$ and effort. I thought it was a great idea to interview one of the area experts in “Outdoor Spaces,” but now I’m not so sure. My husband has visions of installing a fire pit, pergola and handy kitchen conveniences. Ha! I don’t like to cook inside much less out.
Which leads us to an introduction to Annessa Chumbley, our new food and drink writer. She’s a registered dietician, creates her own recipes and loves everything about food. Starting in this issue, Annessa will be interviewing area chefs to nosh about their culinary inspirations and cooking secrets. Meet her and Josh Brownell with Grille 39 in “Great Chefs.” Finally, add some sparkle to summer fun by shopping at the vendors profiled in “Artisan Gems.” I had no idea so many gifted craftsmen were working in Carmel, and it was a pleasure to discover them in this article. It’s even possible that I picked up a few pieces for my own jewelry collection. Hmm, maybe Steve can have a new grill. Happy hunting this season! One of the best-of-the-fests
anywhere rocks our city in the summertime. That would be CarmelFest of course, which continues its 25 year tradition of celebrating America’s birthday. The 2014 Silver Jubilee event, called “The Spirit of America,” kicks off Thursday, July 3rd from 4 - 10:30 p.m. with live bands, kid rides and food, food, food. IU Health North Hospital Artomobilia Classic, collectible and oneof-a-kind cars line the streets of the Carmel Arts & Design District as a celebration of the art and artistry of the automobile. Our galleries and artists actively participate in the festival as well and in 2014 will feature the work of Czech artist Tom Havlasek. Tom has been commissioned to design distinctive sets of paintings to highlight both the Featured Marque for 2014 and the signature CA&D District arches. Streets are packed with those who want to see their dream cars and interact with their owners. For some it’s a trip down memory lane, while for others it’s a chance to see their fantasy cars up close. For the cars’ exhibitors, it is the opportunity to share their passion with others. f you’ve never thought about pulling into a upscale hotel to satisfy those taste buds, Grille 39 at The Renaissance Indianapolis North Hotel will change your mind. It has a relaxing, casual, fine-dining ambiance, perfect for dinner but upbeat enough to sit and eat mid-day while you’re plugging away at work. Their new Sous Chef, Josh Brownell, has as many layers as the food he inventively creates in addition to an impressive culinary background. Even more intriguing is his degree in psychology, which one could say he uses to tantalize the taste bud’s signals to the brain. Get to know this chef and his food: 37

Define your food for us. Well, it’s Contemporary American Cuisine. I believe in old-style recipe techniques and putting a contemporary spin on them. I like to stay close to culinary traditions, while breaking some rules while at it. You seem to have a “can-do-anything” attitude. How do you think this translates to your food? In addition to executing our staple A la Carte menu, I am in charge of creating the weekly special. I like to experiment, see how I can push food past its limits, and add to the diner’s culinary experience.
What’s your favorite thing to cook, and is that your favorite thing to eat? My favorite way to cook is by aging things. I like to recreate Asian dishes by fermenting soy and also anything that involves slow-braising. I like the challenge of building a big flavor profile without using butter, MSG, etc. As far as favorite vegetable to work with, it would have to be fennel. I love what you can do with it...it’s crisp acidity and anise flavor.

When creating each week’s feature dish, how do you decide if it’s a winner? We play in the kitchen! I like to demonstrate teamwork by brainstorming with the other cooks. Our passion for local ingredients drives our imagination and creativity, so by the time the plate gets to you, we present the best combination of flavors possible on a plate. So what inspires your cooking? The history and culture around food. Food is the most important element in understanding our history and culture, as well as the most important component defining our future.

If there was one word you’d want to come to people’s mind when they try your food, what would it be? Intimate. Dining is intimate, and personal. Food that you choose to eat should slowly lure you and transport you somewhere else. When you find the right combination of ingredients, that’s how it should feel... personalized and intimate. How do you chill out after a long day at Grille 39? I like to hang out at home, do construction on the side. Oh, I also collect old world wines. And yes, I do cook at home often! Okay, so tell us what each type of diner should try: The First-Timer: Jumbo Lump Crab Cakes. I know every restaurant probably says that, but ours are truly out of this world. The Adventurer: Order the Special. It is guaranteed to challenge the taste buds.

People always want to know where chefs choose to eat. Where would you choose to eat in Carmel? (other than Renaissance, of course): Hmmmm....The Local Eatery & Pub. While sitting there, I noshed on Southwest Clam Fritters with Jalapeño Cream Sauce (light, crispy, and I could have eaten 25. I made myself stop at 3). My advice? Head to Grille 39, relax, and order the special. And be prepared to challenge your palate. Grille 39 will cater to food allergies and specific food needs. Carmel clay veterans memorial The plaza was established by the Carmel Clay Memorial Corporation to create a place to honor veterans. It proudly displays a beautiful bronze military sculpture by Indiana artist William H. Wolfe. Funds for the sculpture were raised through private donations from local businesses and individuals who purchased engraved bricks to honor loved ones. ho hasn’t looked out their window and imagined a backyard oasis? Instead you see a concrete patio that just doesn’t cut it anymore and a grill that looks sad and rusted. Your kids take friends anywhere but out and even the dog begs to come inside. Oh the tragedy of all that wasted living space…but where to get started? That’s where professionals like BPI Outdoor Living come in. According to President J.D. Durst, landscape design is one business the sluggish economy hasn’t hurt. “People haven’t moved as often so they’re apt to reinvest in the home they own. By improving the function and aesthetics
of any size property – from zero lot line to several acres – owners can significantly enhance its value and enjoyment.” After years of experience, J.D. has worked with many different clients. Some know exactly what they want while others are less sure. “Our initial meeting is a process of discovery where we take a look at the property and evaluate the client’s wish list. Is their vision feasible in relation to the site? And how much do they want to invest? From there we develop a plan that creates a unique solution to meet that client’s needs, desires and budget.” Design is the operative word in this equation. J.D. graduated from Purdue with a degree in landscape architecture, so BPI’s projects entail much more than just landscaping. “Each project has a different scale. Elements should fit the home as well as the contours of the land. You can have great ideas but if they are out of proportion or awkwardly situated then the entire project is compromised.” We’ve all been witness to backyard renovations that look like theme parks; not exactly what most of us envision… So what tops today’s wish list? J.D. feels that the majority of clients he sees want to enjoy “inside conveniences outside. Outdoor kitchens are very important with refrigerators, trash compactors, stoves, blenders and bars– you name it and we’ve installed it. I’d say that requests for living spaces like this have gone from two out of ten clients to eight out of ten, just over the last decade. “ Then of course there are water and fire features. Do they continue to be as popular? “A water element such as a brook or fountain is not just pretty and easy to enjoy; it also acts as a screen for noise. Whether you’re in a zero lot line community or next to a busy road, moving water can make you feel like you’re in the country. Fire, on the other hand, creates a dramatic gathering and focal point and actually increases the amount of time you’re able to spend outdoors. I can’t even say that fire pits and fireplaces qualify as trends; these are structures that have become classics.”

J.D. notes another critical element that should not be overlooked is lighting. “It extends the yard’s usability and is hugely important for security

too. To create ambience we take a multi-faceted approach with uplighting, moonlighting and path lights, all of which add to outdoor comfort and safety.” What about materials today; how have they changed? “Pavers are the fastest growing trend for patios and driveways. Individual pieces are better able to move with freezing and thawing cycles, so you don’t get the cracks you see in old concrete surfaces. This last winter is a case in point; look at our roads. Pavers are made to move and they’re available in all kinds of sizes and shades. The results can be stunning.” After imagining the possibilities, I’m ready to get my own backyard going. How long does the process take? After the initial on-site consultation, J.D. says to expect about three weeks to come up with a design and another week to choose materials based on budget and aesthetics. Ordering and installation can range from one week to one month depending on the project’s scale. And the calendar is a factor too. There can be an 8 to 12 week backlog if you wait until the busy spring and summer season. All the more reason to jump start patio plans now; warm weather is too nice to waste indoors. J.D. Options to Resolve Your Case Prior to Trial In family law, a majority of cases settle outside of the courtroom. There are many reasons to attempt to reach a settlement, including uncertainty as to the judge’s decision, anxiety about testifying in court, the potential to increase animosity between the parties, and the attorney’s fees associated with attending a hearing. It is common for a party to never step foot inside of a courtroom because the parties reach an Agreement on all terms without the requiring the court’s intervention. There are two primary methods to reach an out-of-court agreement: informal negotiations and mediation. Informal negotiations involve communication between the parties and/or their counsel concerning the terms of a final agreement. This process involves communication as to the terms of a final agreement without the assistance of a third party (a mediator or judge). In some instances, the parties may be able to reach an agreement on the general terms of an agreement and engage counsel to assist with the finaliza-
tion of those terms to ensure approval by the court. In other cases, counsel for the parties will exchange proposals and draft agreements in an attempt to reach a resolution. In the event parties are unable to reach an Agreement through informal negotiations, mediation is a common next step. Mediation may be agreed upon by the parties or ordered by the court. At mediation, the parties are typically placed in separate rooms with their counsel and the Mediator serves as the neutral third party who exchanges proposals between the parties in intensive and focused settlement negotiations. The Mediator’s role is to assist the parties in their attempt to reach common ground by addressing certain considerations as to an anticipated reasonable outcome in court as well as other realistic and pragmatic concerns with any proposed settlement. There are instances where parties do not reach an agreement during mediation. In that case, a final hearing 97

is the next step as the mediator does not have the authority to order the parties to comply with certain terms or reach a final agreement. A recent trend in family law is for parties to engage in a collaborative divorce process. In such instances, parties are focused on reaching a collaborative agreement and hire respective counsel trained to do so. The process is similar in many respects to informal negotiations and mediation, with the ultimate goal of reaching an agreeable settlement. One different aspect of the collaborative law process is that in the event parties are unable to reach a settlement, they must hire new counsel and begin the process anew. ATTRACTIVE NUISANCE Is Your Backyard a Liability?

After a long harsh winter many of our children are ready for the weather to warm up so that they can get outside to play. While the warmer months might be the best time for the children to play outside, it is also the time of year there tends to be an increase in the amount of injuries children sustain. Participation in organized sports results in a number of injuries each spring. The most common injury to children during these warm weather months seems to be related to the use of trampolines and swimming pools. It is important that as adults, we ensure our children’s safety by supervising them while they engage in these types of activities. However, no amount of supervision will prevent all injuries. Children are curious by nature. They like to explore, test boundaries, and try new things. This leaves open the possibility that a child can be injured in your own back yard, even if that child does not belong to you or was not invited to your property. As the homeowner, you could be responsible for injuries sustained by a child even if you did not give the child permission to be on your property. This legal theory is known as the doctrine of “attractive nuisance” and it most commonly applies in situations involving recreational items like swimming pools and 103

trampolines. As a homeowner you can be liable for injuries to a child if the structure causing the injury is maintained or permitted on your property; the structure is particularly dangerous to children, and children are unlikely to see it as a danger. Structures like swimming pools, trampolines, swing sets, etc. are attractive to children. As the homeowner you legally are presumed to know the structure or object is on your property and that there is a likelihood that trespassing children could be injured by it. If the child sustained a natural and foreseeable injury that could result from using the structure or object, you may be liable for the injury.
