Advocacy. All members benefit from IIABSC’s advocacy efforts, whether you actively participate in the program or not. In our communications with industry leaders, their understanding of the importance of the independent agency system means that they reach out to us for our viewpoint on important issues. Most recently, our federal governmental affairs team accomplished a major achievement for agents in the reauthorization of the federal Terrorism Risk Insurance Program and the creation of the National Association of Registered Agents & Brokers. A Word Of Praise For The Big “I” Governmental Affairs Program TRIA & NARAB II signed into law; InsurPac hits $1 million mark again
n the biggest legislative win for the Big “I” in well over a decade, a legislative package including both a six-year extension of the federal terrorism insurance program and streamlined nonresident licensing was signed into law in mid-January. This news, combined with the announcement that InsurPac has once again broken the $1 million mark in 2014 contributions, reaffirms in my mind the quality of our governmental affairs program and the value of Big “I” membership. This is a monumental win for the Big “I” as TRIA (Terrorism Risk Insurance Act) and NARAB II (National Association of Registered Agents & Brokers) have been our legislative priorities for the past several Congresses. We’ve been pushing for the enactment of NARAB II since 2007. While we have worked with industry partners on these efforts, the Big “I” has led the way on NARAB II at every stage of the process since its inception with much collaboration with our state associations. Updates to the terrorism insurance program include raising necessary trigger amount in total losses before the TRIA program kicks in from $100 million to $200 million and the increase of mandatory recoupment from $27.5 billion to $37.5 billion. Both changes would increase incrementally over five years’ time starting in 2016. Private industry total recoupment increases from 133 percent of covered losses to 140 percent. In the matter of certifying an act of terrorism, the Secretary of State has been removed from the process and requires that the Treasury Secretary consult with the Secretary of Homeland Security. Implementation of NARAB II will begin almost immediately; however, it is likely we will not see it “go live” for at least two years. The basic mechanism is simple. Once an agent or broker is licensed in good standing in their home state, they could apply to NARAB for membership in the association for non-resident agent and agency

licensing. By meeting NARAB membership criteria, they could operate in any other state. While the agent/broker would still have to pay fees in each state, NARAB would seamlessly and efficiently reduce the administrative burden on agents and brokers operating in multiple states. This news was followed shortly by the announcement that InsurPac, our national political action committee, once again raised more than $1 million during the 2014 calendar year. This achievement sets a new record for receipts in a calendar year, and it’s also the first time InsurPac has surpassed the $2 million mark within an election cycle. InsurPac distributed more than $1.8 million in the 2013-14 campaign cycle in support of more Senate and House campaigns than ever before resulting in a 93 percent congressional victory rate. In disbursing contributions, InsurPac does not look at party affiliation but supports representatives, senators and candidates for federal office that have been advocates and supportive of the independent agency system. In addition to an overall goal, there were also goals for South Carolina members to meet. We surpassed both our overall and young-agent-contribution state goals in 2014. Together our contributions totaled $47,342, earning our 10th consecutive Eagle Award, which is presented to state associations that raise an average of more than $100 per agency. Congratulations to you all on this huge victory for Big “I” members and insurance consumers. Special thanks to everyone that contacted their U.S. Senators about TRIA and/or contributed to InsurPac. Agent of the Year Paul W. Steadman, CIC, AAI, ARM, AU, of The Steadman Agency in Charleston has been named the 2014 Hayne P. Glover, Jr. Agent of the Year in recognition for outstanding community service and contributing to the betterment of the industry. Since joining his family agency in 1986, Paul has been an actively involved member and leader of the Big “I.” He’s served on and chaired the Young Agents Committee. He’s also served on the junior golf committee, convention committee and the Board of Directors. Currently, he’s the Greater Charleston local chapter president. As an alum of the College of Charleston, Paul has done much to advance risk management training there. He created the Steadman Scholarship for aspiring insurance students, serves on the Board of Governors for the School of Business and is a guest professor of risk management. His community service reaches beyond
the industry as well. He serves as Vice-Chair of the MUSC Children’s Hospital Board and is Co-founder and Chairman of one of their major fundraising events. He is a multiple Paul Harris Fellow for Rotary International and participates in leadership roles with the Episcopal Diocese of SC. The Agent of the Year is named for Hayne P. Glover, Jr. who is the only South Carolinian so far to serve as the national association president. Glover was an outstanding example of service to his community as well as the industry, which are the criteria used to evaluate nominees for this award. Young Agent of the Year Curtis M. Bull, CIC, AIP, of Turner Insurance Agency in Greenville has been named the 2014 Young Agent of the Year. Curtis has been with The Turner Agency for nearly 13 years. He’s served on the Young Agents Committee and was recently selected as a Greater Greenville Chamber of Commerce Leadership Greenville Class of 40. He’s involved with his church and has been a little league coach, Meals-on-Wheels volunteer and Director of the Greenville Clemson Club. His agency peers declare that he embodies the spirit of the Young Agent and the Trusted Choice agent. The Young Agent of the Year award is given to an independent agent age 40 or younger for outstanding service to his or her community outside the eld of insurance and has contributed to the betterment of the industry. agents who have contributed greatly to the insurance industry in South Carolina. Under the leadership of Director Farmer for the past two years, the Department of Insurance has continued its focus on consumers, recognizing that they are served best by a competitive, vibrant and open insurance market. He has been an advocate for market-driven regulation and has earned tremendous respect in the General Assembly among legislators who rely on his expertise and integrity to be clear and honest with them in regard to key insurance issues. All these characteristics also mean that he has been a tremendous supporter of independent insurance agents. As always, there was an InsurPAC fundraiser going on at convention. Those who made onsite contributions were entered in a drawing to win a Big Green Egg, one chance for every $100 contributed. There was an Early-Bird drawing of a $100 gift certicate to Omaha Steaks for those who pledged on or before Oct. 3. The winner of the Big Green Egg was Kathy McKay of McKay Insurance in Charleston. e have a long-held belief in our firm that a bad account is a bad account is a bad account. Exactly what do we mean by that? Simply that if you have a client that has a lot of claims activity, is chronically late making payments and receives multiple non-payment cancellations (or threats thereof), eventually that customer is going to hurt you in other ways. A case in point: An insurance agency was involved in an E&O claim with a customer whose Homeowners policy was non-renewed by the insurance carrier due to numerous (seven) damage claims. Six days after their policy terminated, the insured suffered a fire loss for which no coverage was in force. The E&O claim against the agent was based on an alleged conversation that took place between the agent and the insured when the notice of non-renewal was originally sent, to wit, that the client was not to worry and the agency would find replacement insurance. The agency’s defense was that the conversation never took place because they would not have even considered seeking replacement coverage for this client due to

their loss history and the 18 (yes, you read that right) different instances where the insured had failed to make timely payments to the insurance company. Let’s examine this situation from a procedural perspective. What could the agency have done differently to possibly avoid the E&O situation? • Stop the insanity! The most obvious loss-control measure would have been to terminate the relationship with the customer when the pattern of late payments first appeared. It doesn’t take 18 notices of intent to cancel to figure out that the client is financially irresponsible. Agents have wasted too much time and money chasing after chronic, late-pay direct-bill clients and in fact, have enabled that behavior. • Seek closure! Taking the agency at its word that no replacement coverage would have been considered for this client, a letter should have been sent immediately upon receipt of the non-renewal notice advising the

customer that coverage would need to be replaced with another agency and that no coverage would be in force after the renewal date. Procedures trump “he said, she said.” To substantiate the agency’s position that no such conversation ever took place with this customer, the agency would produce its procedures manual that indicates any such call would be documented in the client’s file. Because there was no documentation in this instance, obviously the call never happened, or at least not the conversation that the insured says they had with the agency’s representative.

It’s no wonder the client suffered an eighth loss very shortly after their coverage expired. Even if the agency had replaced the coverage with another carrier, it’s equally likely the loss would not have been covered due to non-payment of the new policy, in which case we’re sure the basis of the E&O claim would have been that the agency had notified the client the other 18 times their policy was in a state of cancellation so the insured would only expect they would do the same in this case. The agency prevailed in this action, but it is clear that had proper procedures been in place and followed, the E&O claim might never have gone to trial. It’s time to put the responsibility for sound loss control and timely payment back where it belongs: on the client, not the agency. The Independent Insurance Agents of South Carolina Foundation was established in 1984 as a means of supporting charitable, scientific, public safety or educational endeavors. With tax-deductible contributions and the guidance of our trustees, the Foundation’s long-term goal is to underwrite endeavors that will enhance the lives of all South Carolinians. In its more than 30 years, IIABSC Foundation has: • donated almost $500,000 (a half million dollars) in scholarships, contributions, rewards and other support. • sponsored scholarships at USC, Clemson, College of Charleston, Appalachian State and UNC-Charlotte. • provided scholarships for CIC candidates and other support for IIABSC’s Education programs. • supported the SC Arson Hotline, Clemson 4-H, SC Safety Council, SC Fire Marshall and several other community service organizations.
