PRESIDENT’S MESSAGE

s President of the MPMCA, it is an honor to report on the activities of the MPMCA as reported on at our Annual Meeting. A number of the accomplishments reported on included: First and foremost was our EXPO. This year’s EXPO was a huge success. We sold out all the booths, and had a record number of individuals who were pre-registered. Our Expo is one of the biggest expositions of plumbing-heating-cooling products in Michigan. Over 3,000 products from more than 400 manufactures were on display at the Soaring Eagle & Resort in Mt. Pleasant. Free of charge, contractors, installers, reps, inspectors, wholesalers, architects, and engineers were in attendance. This is our opportunity to show the professionalism of our industry and the great service our contractors provide for the protection of the citizens of our state. A program we can all point to with great pride; Our Backflow Training programs continue to be an important and successful Association educational program, selling out the majority of our classes during the year. Our Legislative endeavors are a central focus of our staff’s efforts, both state and nationally. Our relationships with other organizations protecting the construction

and mechanical industries is outstanding as we jointly work to represent the needs of our contractors. Scott Johnson of Macomb Mechanical, Sterling Heights, Michigan was named the MPMCA’s 2016 Contractor of the Year. The Greater MI Plumbing & Mechanical Contractor’s Association was named Local Association of the year. Honored for their efforts in career development, education and the tremendous amount of community service work they do each and every year. Our MPMCA Magazine is unrivaled in the Industry as it continues to inform not only our membership but also the number of professionals who are on our mailing list. All of this comes from a commitment by the board, members, local association executives, and most importantly our staff. Executive Director Cynthia Maher and Assistant Sharon work day in and day out for you, our contractors. They make our lives so much easier and we are so blessed to have them. Mid-Michigan MCA MASCI 2015 APPRENTICE OF THE YEAR AWARDS The Flint/Genesee Job Corps Center located at 2400 North Saginaw Street in Flint, MI hosted the Michigan Apprenticeship Steering Committee, Inc. (MASCI) 2015 Apprentice of the Year Awards on Thursday, December 17, 2015. The luncheon was also sponsored by the Job Corps Center. The awards are presented to the best of our Michigan apprentices in the manufacturing and construction categories based on factors ranging from attitude and attendance to community service activities. Congratulations to this year’s winners: Krystle Kosbar (Middleville, MI), from Operating Engineers Local 324/ Barton Marlow was awarded for the construction trades category (pictured left, second photo, center). “Krystle sets a great example for the next generation of builders,” said Pat Zinser, the instructor who nominated her. “Energetic, sharp and always on top of her game, she’s been a valuable asset to our team.” Rachel Harbin (Royal Oak, MI) from UAW Local 160 for the automotive manufacturing was awarded for the industrial trades category (pictured left, third photo, center). GM Design Fabrication Supervisor Robert Pense nominated Rachel, stating that she challenges the journeymen and is an outstanding apprentice. The Michigan Apprenticeship Steering Committee (MASCI), founded in 1977, is a multi-sector advocacy group promoting the benefits of Registered Apprenticeship programs. MASCI’s mission is to advocate registered apprenticeships as a proven model for career education and workforce development.

ACA WORKSHOP CONDUCTED The WMMCA hosted an ACA presentation on the Employer Mandate and reporting required. The two hour workshop was conducted by Local 174’s fund attorney’s Novara Paul Catenacci and Michael Novara, on Wednesday, February 10 from 10 am – 12 noon, in the WMMCA offices. MICHIGAN SERVICE & MAINTENANCE OVERSIGHT COMMITTEE The Michigan Service & Maintenance Oversight Committee met at Local 636’s Training Center on Thursday February 4, 2016. Russ Borst, Hurst Mechanical and Cindy Morse, WMMCA, participated in this meeting with contractors and Pipes Trades representatives from across the state. A tour of 636’s Training center was conducted after the committee meeting. NCPWB AUDIT & WORKSHOP NCPWB Chapter is audited every five (5) years. During the February 2, 2016 audit, Walter Sperko conducted a four hour Qualification of Welders under ASME Section IX Workshop for West Michigan contractors. Chapter 18 passed the audit and participants of the welding workshop gave favorable comments! WMMCA ANNUAL CHRISTMAS PARTY A SUCCESS The WMMCA Christmas Party was held Wed., December 9, at The B.O.B., downtown Grand Rapids, with contractors, spouses and special guests including UA174 Management- Mark Mangione, Ryan and Danielle Bennett, Bob and Amy Derby, Sean McCormack and Nate Phillips, and MPMCA Executive Director Cindy and Mitch Maher. This event is a great opportunity for contractors, spouses and UA174 management to network. A special thanks to Ruth Ekkens for selecting the Christmas gifts! TIME OFF DENIAL – LEGAL OR NOT? QUESTION: Our company has recently instituted a new policy for requesting time off when another employee is already scheduled off and/or an employee who covers for the new requester’s time off will be covering someone else and/ or on vacation themselves consecutively with the new request. We have limited employees and only a few employees that cover for other employees. We have implemented that no two employees may be off at the same time and that all employees must review the vacation calendar prior to submitting a request for time off. All employees have access to the vacation calendar and it is updated each time a request has been approved. If an employee needs to request time off during either of those situations, we have requested that the employee provide a reason that they need off so that we can make a determination whether or not to approve the request. We have one employee who refuses to provide a reason and is requesting time off when another employee is already scheduled to be off. The person who covers for the newly requesting employee is off on the day after she would be required to cover for the newly requesting employee if she was granted time off. She refuses to give a reason, just states, “it’s personal,” and therefore we have stated we could not approve the time off. We do not normally request a reason when employees request time off, only in this special circumstance do we ask a reason. We have been having many issues arise when we give two or more employees off at the same time in the past and have instituted this new policy as a way to avoid this issue in the future. All employees were notified of the change in December, prior to the institution of the change. Can we deny her request for a personal day if she does not provide a reason?

RESPONSE: We are not aware of any law prohibiting the employer from denying a vacation request under the circumstances you describe. You advise that the employer asks employees to disclose the reason for time off requests only when there would be a resultant lack of coverage if the request is granted, which is something the employer is willing to allow only in emergent or other legitimate cases (and we trust this includes cases where the time off may be required by law, such as to accommodate a disability or sincerely held religious belief, or for jury, witness or military service, etc.). To the extent the employer’s policy is clear on this issue (and you indicate that it is), and an employee is refusing to disclose the reason for her request, we are not aware of any law that requires the employer to grant it based only her assertion that “it’s personal.” Indeed the employer cannot ascertain from such a vague explanation whether the request for time off is protected by law, and where it is not (and the employee would need to let you know if it was), the employer is not required to grant the time off as requested pursuant to your company’s policy (which you advise grants the employer some discretion here).
