A

s the summer comes to a close – and what a summer it was for our industry – I hope you are enjoying a wonderful autumn. Nothing beats the colors of fall in Ohio and there is no place I would rather be. We are able to take the time to relax and reflect and prepare for the year to come.

ACCO’s “16 in 16” Membership Drive continues. I really want to encourage all non-members of ACCO to consider belonging to our organization. Joining ACCO benefits your business, your employees, the industry and especially the consumer (your customer). Membership even helps in your personal growth, helping you to become a better boss, colleague and mentor to others. An investment in ACCO is an investment in your future. Membership in ACCO helps you create a culture within your company of striving to improve your business and the industry and not being satisfied with the status quo. Mike Weil, of National Comfort Institute, published an article in The NEWS. The article addressed this very topic and was titled, “Membership Matters: Why Trade Organizations Rock”. I don’t want to repeat the whole article, but I do want to point out a few reasons Mike listed that I find beneficial for myself and my business.

1). Having access to an unofficial advisory board. We are small business owners without a staff of experts. We may be really good at one thing but struggle in other areas. By having a group of similar business owners, we can rely on each other’s strengths to make all of our businesses better. 2). Building relationships with manufacturer and distributor partners. These people may be trying to sell to us most of the time. However, they are the people we need to turn to when we need help with a product and/or order. Being able to meet them in non-selling situations and getting to know them better helps them help us when we need them. 3). Representation with government agencies. ACCO is our voice in Ohio. They make their voices heard in Columbus. More importantly, state agencies contact ACCO for comment before new legislation and regulations are developed. You and ACCO together are more persuasive than you trying to change regulations all on your own. Belonging to ACCO is not as expensive as you may think. For just over two hundred dollars a year, the benefits far outweigh the costs. My company actually makes money on our membership. The savings we receive on our Speedway invoice alone pays for our membership several times over. As an additional incentive, join before December 31st and save five dollars. ACCO is not the only HVAC trade organization; however, it is the right one for my company. I hope you decide that it is the right one for your company.

s I sit here writing, I can’t believe this is the third of four letters I have to submit during my year as president. It seems like yesterday I was sweating over having to give my speech at Great Wolf Lodge during the annual convention. Time sure is flying by, but that could also be to how busy this industry is right now.

Speaking of how busy this industry seems to be, the Board has been searching for ideas on how to get the youth of today interested in our profession. Somehow we need the younger generation involved or the labor shortage that seems to be here will only get worse. If anyone has ideas on this please feel free to let a member of the Board know. As I’ve stated in previous writings, an organization is only as good as its membership. This hasn’t changed! Anything you could do to help recruit new members will only strengthen our organization. Bring a non-member to a meeting and explain the 6

As my presidency comes to a close in the coming months, I am looking forward to representing the state at the national convention in San Antonio, Texas this October. I’m also looking forward to seeing Bruce Stebbins, as he is sworn in as National Zone 1 Director for Ohio, Pennsylvania and West Virginia, as well as participating in some educational classes and networking with other members from around the country. If you can make it, please join us. OSHA’S NEW POST-ACCIDENT DRUG TESTING RESTRICTIONS

There are major developments regarding the Revised Recording and Reporting of Occupational Injuries and Illnesses Regulations which incorporate highly controversial drug testing and safety incentive program restrictions.

REVISED REGULATION In May 2016 OSHA issued a final rule which revised the Recording/Reporting regulations. This final rule, generally effective January 1, 2017, requires certain employers to electronically submit to OSHA the injury and illness information that they are already required to maintain. But most significantly, the final rule also includes much more -- provisions that prohibit employers from retaliating against workers for making accident reports which OSHA somehow now interprets as restricting automatic post-accident drug testing and safety incentive programs. The anti-retaliation provisions were to become effective on August 10, 2016 but now have been postponed until November 1, 2016. There is some question as to the legality of these anti-retaliation provisions. Until the new rule becomes effective, the only redress an employee has to advance an OSHA discrimination claim is the filing of a complaint alleging discrimination under OSHA regulation Section 11(c). After the new provisions become effective, OSHA will be able to cite an employer under its traditional citation and penalty scheme. This may require rehiring the discharged employee with back pay and limit or curtail post-accident drug testing along with paying a citation penalty.

drug testing policies should limit post-accident testing to situations in which employee drug use is likely to have caused or contributed to the accident, and for which the drug test can accurately identify impairment caused by drug use. OSHA thinks there should be a reasonable possibility that drug use by the reporting employee was a contributing factor to the reported injury. This case-by-case determination for testing could expose an employer to an unrelated civil rights claim of discrimination for unequal treatment before the EEOC. OSHA also addressed employer concerns that the final rule could potentially prevent an employer from complying with the drug testing requirements contained in workers’ compensation laws. In response, OSHA explicitly stated “if an employer conducts drug testing to comply with the requirements of a state or federal law or regulation, the employer’s motive would not be retaliatory and testing would be permissible.” But, most states, including Ohio, do not require automatic drug testing unless the employer is “voluntarily” participating in a state drug free workplace program. Therefore, it appears that automatic post-accident drug testing in Ohio would be contrary to OSHA’s announced policy because the Ohio statute (ORC 4123.54) only requires drug testing for three reasons – automatic drug testing without reasonable suspicion is not addressed.

OSHA’S COMMENTARY REGARDING POST-ACCIDENT DRUG TESTING While the anti-retaliation provisions require educating employees on their rights to report on-the-job injuries and illnesses without fear of retaliation by the employer, the commentary that accompanied the final rule is alarming employers. OSHA explained that to obtain the appropriate balance,

SUMMARY The OSHA commentary is just that – a commentary. Whether you revise your current post-accident drug testing program now is a business decision not a compliance decision. Obviously OSHA is concerned that mandatory postaccident drug testing will stifle an employee’s freedom to report an on-the-job injury. But, what does the employee have to fear – unless he/she was under the influence at the

time of the accident. When the OSHA commentary is weighed against the greater need of getting drugs out of the workplace, it comes up second. Most employers have established mandatory programs to take the guess work out of determining who needs to be tested and to avoid claims of discriminatory treatment. A mandatory policy strives to treat all employees equally – to remove any possible subjectivity from the process. OSHA seems to have lost sight of this purpose. ADVICE Maintain any automatic post-accident drug testing policy as long as you can demonstrate that you are not discouraging employees from reporting on-the-job injuries and illnesses and that you are not in any way discriminating against any employee who makes a report – stay the course for now! Watch for further clarification by OSHA before the new implementation date of November 1, 2016, including the interrelationship to state drug free workplace programs. Also, watch for the outcome of the current Texas court case attacking OSHA’s authority to make these regulations. BUDGETING A

s I write this issue’s column, the page on the calendar is flipping to months that end in “ber”…as in Brrrrrrr it is getting Michael Bohinc. CPA cold out there! That’s an indicator of two things. One, this columnist is starting to get cranky because summer is over. Two, it’s time to start thinking about next year (2017); more specifically, next year’s budget. What’s a budget, you ask? A budget is a detailed plan that includes dollar amounts specified for each item listed in the budget. There are many types of budgets. They include: • Operating Budget – This covers all aspects of a company’s operation. It often times is a summary of the other budgets listed below. I call it the Master Budget because all the other budgets are components of this budget. • Sales Budget – This is a projection of sales for the company for the next period. In this case, next year. It is often more than just sales dollar amounts. It often includes number of units (water heaters, A/Cs, furnaces, etc.) sold and number of hours to be sold (for services). • Production (Labor) Budget – Since the primary “product” we sell is our time & knowledge, this focuses on projected labor hours and costs expected for next year as well as staffing levels required to meet the production demands. • Marketing Budget – This is a projection of the cost for promoting the company to meet the expected sales for next year. This includes all the ways you advertise your company (web site, social media, yellow pages, newspaper, TV, radio, etc.) It also includes the quantity & cost of promotional items (magnets, water bottles, grocery pad lists, etc.) as well as all costs associated with public relations for the company. • Cash Flow Budget – This is a projection of the cash receipts and expenditures expected during the budget period (month, quarter or, in this case, year). A cash flow budget is very helpful in determining when during the budget period cash flow will be strong (cash in > cash out) and when it may be weak (cash in < cash out). With this information, you’ll know when you may need to access the company’s line of credit with the bank. It’s kind of an early warning system for potential financial issues. In my opinion, the Cash Flow Budget is one of the most important budgets that can be done. That’s because cash flow management is critical to the success of any business. • Capital Budget – This relates to the company’s investments (most often equipment, vehicles, buildings, etc.). 10

How much will be required next year to pay for repairing, upgrading or replacing those assets? For those of you that have participated in a break even or understanding overhead seminar with me, the capital budget is related to “Depreciation Expense” on the income statement. Depreciation expense is an accounting method to account for the “using up” of the company’s assets’ values or useful lives. The capital budget accounts for how the company’s assets will be replaced or additional assets purchased. Creating, monitoring and modifying a budget are important components of a successful business. In my experience, companies that incorporate budgeting in their businesses are much more successful and financially stable than those that don’t. Unfortunately, only about 1 in 10 of the contractors I know actually goes through the budgeting process. Most owners avoid budgeting because they don’t understand it and they’re afraid of it (think there’s too much work involved). I think more contractors would get on board with budgeting if they understood the direct link between budgeting and successful (financially) contractors. In my experience, you can’t have one without the other. Budgeting has been made easier by the development of various software programs available on the market in recent years that does the “numbers crunching” for you. That alone, should reduce the fear contractors have about budgeting. In fact, the PHCC Educational Foundation developed an Excelbased software program (Overhead & Profit Calculator) that has a Cash Flow & Budgeting section. It’s very well done and would be a good starting point for a contractor who hasn’t gone through the budgeting process before. You can find more information on it at www.phccweb.org. If you’ve never created a budget for your company, I challenge you to make this the year that you give it a try. Most business advisors recommend that you start budgeting for the next year about 3 months out. Translation: It’s time to get working on your budget for 2017. Membership Matters and Why Trade Organizations Rock Contractors can learn a lot from their peers and industry experts By Mike Weil

B

enjamin Franklin once stated that an investment in knowledge pays the best interest. Yet it seems to me, in the contracting world, the idea of investing is unpopular. OK, that is a broad, sweeping statement that by itself isn’t true. I make it because of something called the 80/20 rule — also known as the Pareto, the law of the vital few, and the principle of factor sparsity, which states that, for many events, roughly 80 percent of the effects come from 20 percent of the causes. It’s a common rule of thumb in business. For example: 80 percent of sales typically come from 20 percent of your clients. In this case, I’m talking about 80 percent of trade association memberships come from only 20 percent of the industry’s contracting population. In fact, some insist that ratio may be more like 95/5.

And why is that? Some common excuses I’ve heard over the years include: • Trade organization membership is too expensive; • I already know everything I need to know about my business and customers; • I can’t afford the time away from my business; • I don’t see the value; • I don’t want to share my successes with competitors; and • Why pay to go to classes that are only sales pitches? And, yet, a lot of smaller companies find themselves fighting for their lives in marketplaces rife with


competitors who seem to either do it better or far-worse. They find themselves trapped by regulations, ordinances, and laws that seem to suck dollars right out of their wallets. Many get so bitter and tired that they close up shop and elect to do something else with their lives. The fact is, no one knows everything, and contractors can learn so much from their peers and industry experts. By joining a trade organization, they gain access to a vast knowledge base of information and tools created to help them overcome problems and become more successful. Trade organizations can give contracting firms leverage, affording them access to innovative business practices and winning strategies. These industry-specific groups also grant independent operations more political clout, which may be helpful when harmful local, state, or federal legislation is proposed. TOP 25 Do you want to rock your marketplace by investing in your business? Well, here are 25 reasons joining and participating in trade organizations can boost your business: 1. Access to an unofficial advisory board — Attending trade organization meetings helps you build a network of people you can call upon for advice when issues arise, regardless if they are technical or business-related. Some say this is worth more than anything else you can gain from trade organization membership. 2. Access to industry experts — Trade organizations help contractors gain face time with some of the most knowledgeable people in and out of the industry. These experts range from consultants to inspiring and motivating speakers from across all industries and societies who can inspire, motivate, or just get your mindset on track. 3. Access to licensing and certification programs — In the HVAC industry, this area is becoming more important each year. Organizations that train and certify you make it easier for you to obtain local and state licensing, which differentiates you from your competitors. 4. Build relationships with manufacturer and distributor partners — Relationships are always very important. How well do you know your company’s vendors? Trade organization meetings are the perfect place to meet and get to know them better. 5. Broaden your knowledge — Trade organization memberships offer technical, marketing, sales, and business management educational opportunities. No matter how much you know, you should never underestimate the value of learning. The most successful people will tell you they never stop learning. 6. Create a competitive advantage in your marketplace — Membership provides contractors access to resources they might not be able to otherwise afford. These resources

can help you earn and maintain an edge over non-member competitors, thanks to access to inside information and advanced training opportunities. 7. Credibility with customers and peers — Membership organizations are often the faces and voices of an industry. Because of that, members are viewed as credible companies that are important to the industry as a whole. Become a member of HVAC’s most critical associations if you want to be viewed as a leader in the industry. 8. Cost savings on products and services — Trade organizations often provide members with discounts or special access to conferences, trade shows, and events. Some organizations, like National Comfort Institute (NCI), offer marketing services, answering services, and more. 9. Enhance and build your network of professional relationships — Odds are that someone somewhere in the industry has already discovered the solution to a troublesome problem that another company is struggling with. Getting together during membership organization meetings gives you a chance to learn from those who came before you. Additionally, by networking, HVAC business owners may spot emerging trends, which could impact their bottom lines. 10. Enhance the company’s reputation — Professional organizations often award credentials and certifications, which can help build consumer confidence in your products or services. 11. Enhance your leadership skills — Often called professional development, member organizations provide opportunities via workshops, seminars, and classes. They also provide access to peer-to-peer learning and potential mentorship opportunities. 12. Exclusive services and benefits — This can include access to research and analysis of product shipments, industry trends, new markets, and future technologies. It also includes subscriptions to industry trade magazines, newsletters, discussion forums, and social media. And let us not forget, available unified marketing materials and messaging can help boost your sales and public relations efforts. 13. Fun — As the Jack Nicholson character said in the “The Shining,” “All work and no play make Jack a dull boy.” Networking events and industry meetings need to have an element of fun to them. Many trade organizations design their events to be both fun and educational at the same time. So, membership is also an invitation to have some fun. 14. Give back to the industry and community — You can use your membership to share your knowledge with other member businesses and promote a stronger sense of community and cooperation. Many associations donate to charity events and provide member volunteer support and participation as a group. Find out what an organization does to give back and ask how management can get involved.

15. Increase the company’s purchasing power — Trade associations often arrange for members to receive discounts on certain products and services. These perks may include the option to enroll in group health insurance, equipment purchases, or even uniforms. NCI calls its vender program “Member Rewards.” 16. Learn from your peers’ success — All industries have best practices specific to their lines of work. If you’re new in the game and lack experience, ignorance of best practices can pose a serious business and reputational risk. Trade member organizations usually provide a forum for spreading the word on industry-wide best practices. Becoming a member gives you access to a resource for HVAC best practices. It can also give you a head start on compliance if best practices are amended or changed. 17. Learning about and staying on top of industry standards — Some trade organizations focus on developing and maintaining industry standards that benefit their members. In the HVAC world, ASHRAE, NCI, and others set the ground rules that enable contractors to do their jobs consistently and ensure the safety, health, and comfort of their customers. 18. Mentoring opportunities — Many trade organizations help facilitate peer mentoring, where new members are paired with more established members who help them succeed with advice and flat out help when it comes to managing the business or running a program. Such organizations also provide opportunities for experienced members to give back by becoming mentors to younger or newer members. Mentoring, by the way, is an essential leadership skill for motivating and managing personnel as well as helping them learn, grow, and become more effective in their jobs. 19. More representation in local, state, and federal government — Trade organizations often provide a unified, public voice that is far more persuasive than just a single company trying to be heard. 20. Resource availability — According to the U.S. Chamber of Commerce: “Individual and small business members say that access to the most up-to-date information and professional development or educational offerings were the most important benefits when deciding to join a membership organization. Access to career information and employment opportunities also ranked highly.” Studies, online training materials, certifications, access to government entities, and discounts are all resources readily available to small businesses that belong to trade organizations.

21. Stay on top of events and the issues impacting your business — Becoming a member of industry trade organizations provides you quick access to any noteworthy industry news or developments. Not only do trade organization members talk to each other, the organization itself often provides newsfeeds or informative resources to members as a way of adding value to the membership. Staying updated on industry news allows members to take advantage of changes or developments that might otherwise have passed them by. 22. Stay on top of the latest technologies — Sure, anyone can keep tabs on new products and technological breakthroughs, but nothing beats being able to see, touch, and even buy products at member discounts during membership events. This really is an important way contractors can stay abreast of changing technologies and yet another way they can stay ahead of the competition. 23. Stay inspired and motivated — Peer support, meetings, and seminars all contribute to boosting morale, inspiring creativity, and solving problems. Trade organizations often use interesting keynote speakers to motivate member attendees during events and afterwards as they return to their businesses. 24. Training opportunities — Membership organizations often dedicate substantial resources to helping their members improve their management and technical skills through training and educational programming both live and online. 25. Visibility within the industry — Again, the U.S. Chamber of Commerce says consumers tend to trust businesses that are affiliated with and active in organizations. Membership is considered a great indicator of good business practices, strong reputations, and an investment back into the business. It shows leadership and makes a company stand out from competitors in any given marketplace. Every industry has professional associations and organizations, and the HVAC and PHC industry has its fair share. Whether it’s ACCO, PHCC, MCA, SMACNA or any of the many others, if you want to take your professional life to the next level, joining a professional organization related to your field is a great way to start. While every organization is unique, most offer a variety of membership types and benefits to members. Remember, Ben Franklin said investing in your knowledge pays the best interest. Also remember that what you get out of that membership is equal to what you put in. There are no silver bullets.
