A
s the end of the year approaches many of you may be putting together your budget for the coming year and hopefully projecting for growth! ACCO will be doing the same thing and will be looking to all of our members to help with our growth. Now that the de-affiliation of ACCA is complete and we are now our own State heating and cooling organization, it is time to promote even more who we are and what we stand for. I think our mission statement says it all about our purpose, “To pursue the highest business standards and practices for our members through education, legislation, and regulation for the benefit of those we serve”. We are not just a bunch of contractors who get together at monthly meetings to get CEU credits! ACCO is a group
of contractors who work together to better the industry in multiple ways “through education, legislation and regulation”. By promoting these facts to our fellow contractors and showing them how ACCO and the local chapters are a benefit to their business every day, we can grow a stronger State association and have greater impact in the future of our industry. Open membership now makes it that much easier to grow our association. You can choose what you want to take part in. If you only want to be part of your local or the State, you can do that! No more paying dues to something that you are not taking full advantage of. A
s I write this article, it’s hard to believe that summer is coming to a close. Although the temperatures are in the 90’s this week, I welcome the cooler weather. As we turn our attention from summer to fall and inevitably to winter, our focus changes to boiler repair, furnace tune-ups and preparing our customers for winter. With that in mind, I had the opportunity to participate in the Annual Heat and Plumb the County with the Northeast Ohio Master PHCC and Air Conditioning Contractors of Greater Cleveland. I rode along with Bill who works for Haberek Plumbing and Heating. Bill was a gracious host as he pointed out the sights in Cleveland as we went to our first call in East Cleveland. Our first call involved a lady and her elderly mother who had suffered a stroke. As we went through our inspection list, we saw she had pans under every sink catching leaks. We were able to repair all the leaks for her and she was ecstatic that she no longer needed the pans! This was typical of most calls. Cleaning a drain, repairing a minor leak and conducting whole house inspections. Any 6

major repair is referred back to the appropriate agency. On the heating side, they conducted safety inspections on the equipment and again took care of minor problems referring major repairs back to appropriate agencies. For the folks receiving the help, it felt like Christmas to them. If not for this service, they could not afford to have the work done. All the technicians who were there that day volunteered their time and the owners allowed the use of their service vehicles. The commitment our members make to give up a Saturday to help the less fortunate truly shows the strength of their character and embodies the spirt of these organizations. I would ask the owners to convey my heartfelt thanks to your employees who participated. I would conclude by asking any association that is not offering a program such as this to please consider starting one. Just a reminder to keep working on your membership drives, refer to your membership chairperson for information. And finally, the PHCC Ohio website has a new look so take a moment and check it out. Legislative and Regulatory Update

I
t’s easy to forget that while you and your workers are busy serving your customers, Congress and the Federal government are busy as well — on issues that could affect your business and livelihood. That’s why PHCC—National Association watches what goes on in Washington closely, and represents contractors’ interests day in and day out. I recently joined with PHCC’s Vice President of Code and Technical Services, Chuck White, to present a webinar updating members on current legislative/regulatory issues. Here’s a recap of our discussion. LEGISLATIVE NEWS As I’m writing this (in mid-September), it’s not clear whether Congress will pass a budget for FY 2016, or rely on a Continuing Resolution that freezes spending at 2015 levels. We’re continuing to work with Congress to urge funding for workforce development — specifically, reauthorization of the Perkins Act (career and technical training). Other relevant issues have passed the House and are moving into the Senate, including Regulatory Accountability and 179D tax expensing. PHCC— National will be sending out Legislative Alerts on these issues and others that arise. REGULATORY UPDATES Furnace, Air Conditioner, and Heat Pump Rule DOE is working on changes to the Furnace, Air Conditioner, and Heat Pump Rule that established regional standards for nonweatherized furnace and split-system central air conditioners. DOE is proposing to modify the furnace portion of the regulation to establish a nationwide minimum residential gas furnace efficiency of 92%. PHCC and other stakeholders have pointed out problems this could cause, and DOE is working on
a compromise position. Industry will have an opportunity to comment on the final proposal. PHCC and other stakeholders are also working on a regional enforcement strategy for the air conditioner portion of the rule. Work on this issue concluded in the fall of 2014, and DOE should have already informed the public and asked for comment. To date, however, no information has been released. AIR CONDITIONER AND HEAT PUMP STANDARDS DOE is also considering returning to a single national efficiency standard that would simplify enforcement, but could also result in the minimum SEER rating rising to 15 or 16. They might also change test procedures to allow the test to more accurately reflect installed conditions. We’re not sure how this will pan out, but most likely, efficiency ratings will be made more stringent. CONFINED SPACE The U.S. Dept. of Labor has created a rule clarifying confined space requirements in construction, with enforcement beginning Oct. 1. Contractors need to be prepared to evaluate situations on a case-by-case basis, have compliance plans in place, communicate with others on jobsites, and implement safe practices. OVERTIME PAY DOL has also released new guidance on who is exempt from overtime pay. Generally, businesses under $500,000 in annual revenue are already exempt. Under previous rules, exempt workers had to be in professional, managerial, or executive positions, or earn more than roughly $455 per week. The new rule may raise that threshold to a $970 in 2016. YOUR CREDIT CARD LIABILITY INCREASES OCTOBER 1 – Paul Routh Dunlevey, Mahan & Furry
ARE YOU READY?
O
n October 1 credit card fraud liability shifts from the credit card companies to the businesses accepting fraudulent card transactions – the biggest change in U.S. credit card processing ever! If your company does credit card transactions and wishes to avoid legal and financial liability, it must change the type of charge card equipment it uses to “EMV” enabled equipment and change the policies and practices related to your processing – all by October 1. The preferred method of card acceptance will move from “swipe” to chip/signature or chip/PIN pointof-sale activities. The chip authenticates the card and the PIN authenticates the user. The new “chip” technology dubbed EMV, short for EuropayMastercard-Visa, the global standard for card transactions which has been in place in Europe and elsewhere for several years, will significantly reduce credit card fraud in the U.S. The EMV payment standards will improve security by, among other things, abandoning the credit card magnetic stripe technology in favor of the embedded computer chip. Financial institutions are currently issuing these new credit cards to users and most businesses will need to purchase new point-of-sale and handheld card terminals. In addition, businesses are adopting new procedures for allowing the cardholder to personally insert the card into the processor and type in the secret PIN number. No longer will the credit card leave the customer’s sight. As the credit card companies seek to impose liability on merchants who accept fraudulent card transactions, these businesses will be forced to pay better attention to the credit card processing contracts they enter into. The charge back terms customarily incorporate by reference the credit card company’s operating procedures, including procedures for creating and preserving the card transaction record for an extended period of time. If the credit card company imposes an unwanted charge back, the merchant must perfect a claim in accordance with fairly onerous contractual procedures. Moreover, claim resolution customarily occurs through arbitration instead of a civil suit. So, if your business accepts credit cards, take action now: • Assess your current credit card processing equipment for EMV compliance with the help of your credit card processing company – your equipment is probably not compliant. • Assess how your company handles customer credit card data – is it secure? Are you PCI compliant? [Payment Card Industry Data Security Standard] • Undergo a PCI compliance audit with the help of a qualified credit card processing company – this audit is mandated by credit card companies to ensure your company

is doing all that is possible to protect the integrity of the process by storing processing and transmitting customer credit card data properly. There are six main requirements for PCI compliance – build and maintain a secure network; protect cardholder stored data; maintain a vulnerability management program; implement strong access control measures; regularly monitor and test networks and access to the networks; and maintain a policy that addresses information security. • Immediately purchase EMV compliant point-of-sale and handheld remote processing devices in a quantity necessary to transact customer present transactions simultaneously. • Transition from transactions where the card is not present but you accept the card number information orally – “cardnot-present” transactions impose a more costly transaction fee than for card present transactions and are fraught with fraud potential. Because the October 1 changes are inapplicable to card-not-present transactions anticipate a greater number of these fraudulent transactions and avoid card-not-present transactions where possible. • Review first (maybe even attempt to find) your credit card processing contract with the help of an attorney who understands the credit card processing industry. • Adopt procedures on how your employees will perform EMV in-person card present transactions and train your employees. • Be prepared to contest a charge back by the credit card company in a timely manner with the help of competent counsel – gather complete documentation and fully understand the claim procedures for that particular card company. Even though the EMV compliance deadline was set almost three years ago, one-third of small to medium sized businesses are unaware of the EMV requirements. Compounding the problem, in excess of $580 million in fraudulent transactions occur annually in the U.S. Don’t assume unwanted, unnecessary and unacceptable liabilities for credit card transactions – act now! Balance Statement KPIs
I
n the last issue, we defined the term “benchmarking” and discussed the importance of monitoring key performance indicators (KPIs) in your business. In order to calculate and monitor KPIs, you first have to keep score! That’s not a gratuitous reference to my company’s name either. At a minimum, you should be receiving the basic financial statements (balance sheet, income statement and statement of cash flows) for your company on a monthly basis. With the advancements in technology and software, many contractors have access to these financial statements with the click of a mouse at any time (instantaneously). Similar to comparing your golf score to other performances, you do the same thing with your company’s financial statements. How do this year’s sales totals compare to last year’s? To the budget? To other members of your association or group (if you’re involved in one of the best practices groups our industry has)? Here are some basic KPIs from financial statements that you should know and understand in order to make better business decisions. First, here are KPIs that come from the balance sheet. CURRENT RATIO = Current assets divided by current liabilities Current assets include cash and any other asset that can be turned into cash within one year of the date of the balance sheet. They include accounts like company bank accounts, accounts receivable, notes receivable, inventory and prepaid expenses. Current liabilities include those obligations and accounts that are due or payable within one year of the date of the balance sheet. They include accounts like accounts payable, principal payments on loans due within one year, bank line of credit account, accrued expenses like payroll, payroll taxes and interest. The current ratio shows how many dollars of current assets you have to cover (pay) the dollars of current liabilities due. The higher the ratio the stronger the company is financially. I’d like to see current ratios of 1.5 to 1 or higher. A current ratio of 1 to 1 or lower signals financial problems for the company. The acid test (or quick) ratio is a more stringent current ratio. The equation is as follows: ACID-TEST RATIO = (Cash + investments + accounts receivable) divided by current liabilities

Again, the higher the ratio, the stronger the company is financially. A ratio of 1 to 1 or lower is especially disconcerting and indicative of financial problems. The debt-to-equity ratio calculates the proportion of the company’s assets supplied by the creditors versus the amount supplied by the owners. The higher the ratio here, the more the company is leveraged i.e. the more the company is financed by creditors. So a ratio of 2 to 1 or 1.5 to 1 signals financial problems for the company as compared to a ratio of 1 to 1. DEBT-TO-EQUITY RATIO = Total liabilities divided by total owners or stockholders’ equity Accounts receivable turnover is the number of times per period that the accounts receivables turn over. This is an average figure because both sales and accounts receivable fluctuate throughout the year. The formula is as follows: ACCOUNTS RECEIVABLE TURNOVER = Net credit sales for the period (month, quarter, year) divided by the average accounts receivable for the period. NOTE: The average is derived by adding the beginning and ending accounts receivable balances together and dividing by two. Average collection period can be determined by dividing 365 by the accounts receivable turnover figure. For example, if the accounts receivable turns over 10 times during the year, the average number of days to collect accounts receivable will be 36.5 days. Inventory turnover is the number of times per period that the inventory turns over. Again, this is an average figure because both sales and inventory fluctuate throughout the year. The formula is as follows: INVENTORY TURNOVER = Cost of goods sold for the period (month, quarter, year) divided by the average inventory for the period. NOTE: The average is derived by adding the beginning and ending inventory balances together and dividing by two. Average number of days to sell inventory can be determined by dividing 365 by the inventory turnover figure. For example, if the inventory turns over 10 times during the year, the average number of days to sell inventory would be 36.5 days. Accounts Payable turnover is the number of times per period that the accounts payable turns over. This is an average figure
because both cost of goods sold and accounts payable fluctuate throughout the year. The formula is as follows: ACCOUNTS PAYABLE TURNOVER = Cost of goods sold for the period (month, quarter, year) divided by the average accounts payable for the period. NOTE: The average is derived by adding beginning and ending accounts payable balances together and dividing by two. Average payment period can be determined by dividing 365 by the Accounts Payable turnover figure. For example, if the accounts payable turns over 10 times during the year, the average payment period would be 36.5 days. In the next issue, we’ll take a look at KPIs from the income statement. Michael Copp Named PHCC’s New EVP
T
he Plumbing-Heating-Cooling Contractors—National Association (PHCC) announced that Michael R. Copp has been selected as its new Executive Vice President. Copp will become PHCC’s chief staff officer on Oct. 5, 2015. Copp most recently was the Chief Operating Officer of the American Retirement Association. Prior to that position, he was Senior Vice President of Education at the National Association of Home Builders and Managing Director with the Professional Practice division of The American Institute of Architects. “Michael’s proven expertise in association management, particularly in guiding strategic growth, is a great fit for our organization,” said PHCC President, Kevin Tindall. “We look forward to having him on our team as we continue to build a better future for PHCC and the industry.” Copp has a strong background with trade associations, as well as experience in the construction industry. Among his accomplishments are leading strategic initiatives for long-term growth and sustainability, overseeing the effective and efficient use of resources and enhancing overall organizational capacity and performance. He earned a graduate degree with a double major in
Management and Human Resource Development from Webster University, an undergraduate degree in Industrial Science from Truman State University and an associate’s degree in General Studies (with an emphasis in drafting and design) from Cochise College. While earning his degrees, Copp was a mechanical and architectural draftsman/ designer working with several design/ build and architectural firms. He also served as a construction draftsman in the U.S. Army between 1980 and 1984. “We’re seeing a great year ahead for PHCC,” said PHCC President-elect, Chip Greene. “With Michael on board, we’ll be furthering PHCC’s mission with education, training, workforce development and public awareness initiatives that will help support the needs of our contractor members and the customers they serve. PHCC Northeast Ohio and Greater Cleveland ACCO Give Back to Veterans
P
HCC Northeast Ohio and Greater Cleveland ACCO members and technicians participated in the 11th Annual Heat and Plumb the County on September 12 helping nearly 50 veterans, senior and disabled residents who do not have the physical or financial means to pay for home repairs. A group of 100 volunteer contractors from both associations traveled throughout Cuyahoga County to provide free furnace tune-ups, water audits and plumbing repairs. Each plumbing contractor partnered with a heating and cooling contractor to visit two homes during the day. During each safety check, the contractors made sure the furnace was running safely and that the home’s plumbing system was working efficiently. In past years, technicians have found and fixed problems that could have been life-threatening to the customer. A Tale of TWO MANAGERS By Steve Coscia
L
ast year, two clients shared a customer service management issue. Both managers were long term employees with lots of technical knowledge which made them appear indispensable to the company owners. As the consultant, I had assessed that both customer service managers were a corporate liability. In varying degrees, they lacked the people skills, flexibility and operational management acumen to run customer service. Perhaps the asset which was most deficient was the desire to learn and apply something new. Both managers resisted change. The company owners seemed either in denial or they were naïve to what was really happening. After consultation and training I concluded that both managers should be replaced. Neither company owner were happy with my conclusion. They both urged me to find a way to make things work out. I reaffirmed to both company owners that management changes are necessary sometimes, and this was one of those times. Company ‘A’ terminated their customer service manager and Company ‘B’ did not. Months later, the owner at Company A enthusiastically shared with me that their customer service department was

much more productive, teamwork and cooperation was the best it had been in years, and customer retention was up. The service department was infused with vigor, vitality and a renewed sense of service excellence. He confessed that he had no idea one person could be stifling so many latent assets. In addition, he also learned that the front line service reps didn’t like the customer service manager, but were too afraid to say anything. The owner learned about this afterwards when employees thanked him for making the change. Company owner A also confessed that his fear about the old manager’s indispensability was groundless. The news about Company B was less positive. The company owner shared that business was stagnant and he blamed it on the economy. I listened empathetically, but I knew what was really going on. Company Owner B was still in denial about his customer service manager’s indispensability. There was an attrition factor at work in Company B. The attrition factor validates the belief that things can go either forward or backward, but they never stay the same. Therefore, Company B’s false belief that doing nothing would result in unchanged service was incorrect. Terminating employees, especially managers, requires lots of grit along with the help of HR personnel to avert legal issues, but when it’s necessary - it’s necessary. An errant employee with a bad attitude, who negatively affects other employees, becomes a cancer which spreads
throughout the organization. An errant manager makes things worse and must be removed. The fear that company owners face when making personnel changes is expected. How PHCC Is Addressing the Workforce Development Challenge

F
or owners of p-h-c companies, finding and keeping qualified workers is becoming a larger and higher-stakes challenge every day. Here’s why: •
U.S. Census data shows the need for 21% more plumbing and HVACR technicians by 2022, in addition to replacing workers who retire.
•
Between 2010 and 2025, 95 million baby boomers will leave the workforce, and only 40 million Gen X’ers and Y’ers will be available to replace them.
•
4:1: For every 4 skilled workers who leave the construction industry, only 1 is entering the field.
To address this problem, I’m pleased to report that a special Workforce Development Task Force that includes representatives of PHCC—National Association and the PHCC Educational Foundation has recommended a variety of strategic initiatives and resources that are being implemented to help PHCC contractors. In August, we unveiled a new workforce development section of our website with resources for members including statistics, best practices and success stories. We’re adding helpful contractor and chapter tools to our site all the time. 26

Next up is a Career Center, which will include a job board to help our members find the workers they need today. In addition, in the coming months, we plan to make available: •
An outreach “toolkit” to help contractors work with local secondary and post-secondary school programs

A variety of workforce development templates and resources that members can customize
•
A video targeting high school students that will be available on the websites of PHCC national, state and local organizations, as well as Industry Partners’ websites and YouTube
We’re also planning to establish new partnerships with other organizations to communicate about workforce concerns with broader audiences. Last but not least, we’re serving as a clearinghouse to help members and chapters share innovative ideas for workforce development with each other. At the same time, we’re reminding members of all of the great training resources available to them through their membership in PHCC. These include the PHCC Educational Foundation apprentice programs, online eLearning programs and plumbing assessment tests.
And, we continue to offer a variety of programs to help rebuild the plumbing and HVACR workforce our nation needs. The Foundation’s spring 2015 Foreman Workshop and the Construction Contractors’ Alliance’s summer 2015 meeting for HR/Recruiting Managers are two great examples. The PHCC Educational Foundation also was pleased to sponsor the plumbing and HVACR contests at SkillsUSA this June and will offer apprentice contests at PHCC’s CONNECT 2015 later this month. Both events help develop and recognize the next generation of skilled workers. HOW YOU CAN HELP All of these programs are promising, and will continue to make a difference as we move forward. But for real impact, the energy needs to come from individual contractors as well. That’s why I take every opportunity to urge our members to get involved themselves, and become part of the solution. There are many ways you can help. You can work with local high schools, talk with career counselors and PTA groups, or participate in career days or fairs. Or you can reach out to veteran groups, where a huge amount of talent and experience is waiting to be tapped. The industry has given me and my family a good life — and I hope that the same is true for you. If so, I hope you’ll join in our effort to tell this story everywhere you go, inspiring young people to consider our trade as a lucrative and satisfying career path. Working together, we can build a better future for our industry.

T
he readership of this magazine consists of several hundred members of the Plumbing-Heating-Cooling Contractors of Ohio and the Air Conditioning Contractors of Ohio, Industry Partners and Associates from across the state and over 6,000 licensed Contractors in Ohio. This means the majority of our readership does not belong to either association. With over 6,000 licensed contractors in Ohio, it begs the question, why doesn’t everyone belong to ACCO or PHCC? When speaking to potential members about joining either association, we are asked one question, every time. How much does it cost to belong? We’ll answer the question with a question, what will it cost you if you DON’T belong? Within PHCC, I am a member of the Association Executives Council, and the cost of dues has never had a bearing on my membership. I consider it a contribution to my industry, and an insurance policy; should I or a new executive need the resources provided, they are available. When I was new to PHCC, I needed experts that I could turn to. They are my friends - and the relationships I’ve formed over the last seven years are priceless. I can’t assign a monetary value to this, however, the dues paid keep the organization in business, and provide events for me to attend, speakers for me to learn from and keep ‘the table laden’ to which I return again and again. You are invited to the ACCO/PHCC table. At our table is a wealth of information, at the local, state and national level. There are a number of ‘courses’ for you to choose from, but the most important opportunity is joining ‘your people’ at the table. To ask questions and get answers from those who have been in business longer, addressed specific challenges so you don’t have repeat them, or learn from the innovators. One of my particular joys is to watch current members look out for one another… referring work to each other, helping each other out in times of want or need, sharing resources and being there for each other…in good times and bad. Have you been in business a long time? This is your opportunity to join a group and share your wisdom, give of your
