I
t took a long time to get here, but summer finally arrived. I hope you are enjoying and profiting from our industries’ favorite time of the year. Soak up the sun while you can; winter will be here again before we know it. As I get older, it seems each year goes by faster.
ACCO’s “16 in 16” Membership Drive is here! I want to encourage anyone who does not belong to ACCO or their local association or maybe have let their membership lapse, to take a look at what they are missing by not belonging. The Speedway Fuel Program alone can pay for your annual dues. ACCO members receive a 5 cent rebate for each gallon of gasoline purchased. Contractors who participate in the Speedway Fuel Program save on average $600 per year. This more than pays for your annual dues of $225. Membership in ACCO also offers savings through the License Bond Program and Workers Comp Group Rating Program. The ACCO bond program permits members to purchase bonds needed for municipal registrations at a discounted price. ow, how time flies when you’re having fun and busy at work! Summer is here and it’s time for family vacations and spending time outdoors. Hopefully, everyone is or will get a chance to enjoy the weather.
Since our last PHC issue, I hosted the PHCC Board of Directors at my first meeting in Cincinnati. I would like to thank all who attended. A special thank you to Past Presidents Greg Faustina, Dennis Schlekie and Bruce Stebbins for attending, even though it was not required. Residential licensing and air-testing have been key issues that we have been monitoring as a Board lately. The residential licensing (bill) is slowly progressing behind the scenes towards being introduced. The BBS, OAPI, and PHCC seem to be happy with the air-testing resolution and should be releasing the results soon. 6

The greatest benefit of belonging to ACCO is not monetary. I believe that membership in ACCO can and will make you a better contractor and employer. Weekly Safety Lessons assist you in implementing a quality safety program for your employees. In addition, membership will aid you in improving your general business practices. Last year, ACCO launched the Forum Network. This is a group of contractors from around the state who do not compete in the same market. They meet on a regular basis to discuss common successes and problems. The Forum Network is patterned after the popular ACCA Mix Group format and is a cost saving alternative for small contractors. After one year, our pilot group is still going strong. If you would like to be on the ground floor in the formation of our next group, please contact the Association office. Behind the scenes, ACCO is our advocate with the State of Ohio, the Ohio Legislature, and various regulatory agencies. We are constantly reviewing, attending, and submitting opinions to ensure the most advantageous climate and policies for our members. We continue to advance the quality of our businesses and services. Medical Marijuana Is Here – Bob Dunlevey Dunlevey, Mahan & Furry
NOW WHAT?
Ohio has just become the 25th state to legalize medical marijuana and, most importantly, this probably ends any ballot initiative to amend Ohio’s Constitution this Fall to allow recreational marijuana – just what the Statehouse hoped. Governor Kasich signed the legislation on June 8 and it becomes effective in early September, but various state agencies must now create the framework for the “seed-to-sale” system for growing, testing and dispensing marijuana derivatives for 20 medical conditions, including chronic pain – anticipate at least one year. Users will not be allowed to smoke or grow their own marijuana but may use vaping products, patches, oils and edibles. What are employers to do now that medicinal marijuana is becoming lawful and employees believe that they can “smoke dope” before, during and after work without fear of discipline or discharge? The simple answer is that employers should “stay the course” and administer their substance abuse policies the same as before the legislation was enacted. The reason for this is that Ohio’s new law permits such and also because marijuana in any form continues to be a Schedule One illegal drug unless and until the Feds de-schedule it. Even if the marijuana is prescribed by a physician to treat a disability recognized under the American with Disabilities Act and even if the marijuana is used during off-work time, these employees still can be terminated for testing positive. It is not a violation of the ADA for an employer to refuse to accommodate the medicinal use of marijuana, but most employees will probably think that now that the law has been passed, they may use marijuana without reprisal by their employer. This expectation will cause additional challenges for employers as employees report to work under the influence. So, here are some recommendations: • Continue to enforce your lawful drug-free workplace substance abuse program. • Reaffirm your policy to your employees. • Don’t race to soften your policy to allow use under some circumstances. • Address the use of prescription drugs in your policy to insure authorized and prescribed use. 8

Consider incorporating “reasonable suspicion” criteria for drug testing and train supervisors on the signs of being impaired. If an injury covered by Workers’ Compensation occurs, insure that you have reasonable suspicion for testing. If your policy mandates automatic testing for each employee injured, consider whether to modify this to testing only for reasonable suspicion in light of OSHA’s May 12 commentary that effective August 10, 2016, mandatory testing will be considered in violation of OSHA’s Workplace Accident Reporting Procedure – 29 CFR 1904.35b(1)(i). Federal contractors and Department of Transportation employers must remain strict in the application of the substance abuse mandates previously employed. Closely monitor whether the federal government deschedules marijuana and thereby permits state laws to override the previous federal prohibitions. Determine the local laws in any state in which you operate before creating a substance abuse policy or discharging or disciplining for violation of that policy. Contest unemployment compensation claims of employees terminated for marijuana use because testing positive will constitute just cause for termination. Monitor developments related to Ohio’s new marijuana law as the program develops over the next year.
While Ohio’s new law probably will not change how employers address substance abuse issues in the workplace, OSHA’s May 12 pronouncements and future state and federal regulations may very well do so. This is a rapidly developing area of the law that requires you to consult with your employment law counsel to avoid potential liabilities. Summer 2016 Summer School W
hile school is out for summer, it’s not out Michael Bohinc. CPA forever despite Alice Cooper’s declaration that it is. Recently, thanks to interacting with and working with contractors across the country, I’ve noticed that my reading list has grown significantly. I’ve also noticed an increase in Amazon-labeled boxes accumulating in my basement over the last year or so. Every one of the recommended books that I’ve read so far has been informative and enjoyable. I thought others might find these books helpful as well so I’m passing along some of these recommended books to you. The first recommended book I read is also the one that has had the most impact on me professionally since reading Michael Gerber’s “The E-Myth.” I would put it in that same category as “The E-Myth.” It is that good. The book is “Traction: Get a Grip on Your Business,” by Gino Wickman. The book is based on real-world experience not on theory. It methodically details the process of establishing what Wickman terms the “Entrepreneurial Operating System” (EOS). He maintains, and I agree, that it takes more than just a product or service to take your business to the “next level.” “You need a system to optimize your people, processes, execution, management and communication.” Wickman’s “EOS”, properly implemented, will help you get where you want to go. The book, as well as Wickman’s web site www.eosworldwide.com, offers many tools and sample forms to help you develop your own Entrepreneurial Operating System. He has two follow-up books to “Traction.” They are: “Get A Grip: An Entrepreneurial Fable . . . Your Journey to Get Real, Get Simple, and Get Results” and “Rocket Fuel: The One Essential Combination That Will Get You More of What You Want from Your Business.” These are not books that you’ll read once and then put on a shelf (for those of us who still read actual books) or bury on your e-reader. You’ll refer to them often as you develop and then review your EOS system. My only disappointment is that I wasn’t introduced to “Traction” sooner! It was published in 2007. The next book is “Un-Marketing: Stop Marketing. Start Engaging” by Scott Stratten. This book turns the traditional marketing methods on its’ head. Scott defines “UnMarketing” as the ability to engage with your market. Scott contends “If you believe business is built on relationships, make building them your business.” You can learn more about Scott (and his other books) at www.unmarketing.com. I was introduced to John Jantsch and his book “Duct Tape 10

Marketing” through an industry conference where he was the key note speaker. In reading the book, I discovered that John started his company Duct Tape Marketing after spending many years working for E-Myth Worldwide. E-Myth? Yep. John worked as a consultant for Michael Gerber, the “E-Myth” author. Michael compares the book to its namesake (duct tape). “It’s good, incredibly smart, amazingly practical, and immensely sticky stuff. You can begin to put it to use immediately.” I agree. It’s also why I signed up for John’s weekly e-newsletter after reading the book. John’s e-newsletters provide timely, practical marketing guidance as well as links to other consultants’ blogs that share innovative ideas as well as new applications (“apps” for smart phones) for business people. Here are a few other books you should add to your reading list: Chip Bell – “Sprinkles: Creating Awesome Experiences through Innovative Service” Chip talks about delivering service with pleasant surprises in customer experiences…like sprinkles on an ice cream cone. It makes a great thing even better. T. Scott Gross – “Millennial Rules: How to Connect with the first Digitally Savvy Generation of Consumers and Employees” A great book that helps the reader understand how to address Millennials’ expectations. Greg Crabtree – “Simple Numbers, Straight Talk, Big Profits! 4 Keys to Unlock Your Business Potential” Greg’s book discusses KPIs in easy-to-understand terms to help you improve the profitability of your business. So, whether you’re headed to a cabin in the woods or the beach for the summer, grab a book or your e-reader and do a little reading. For, as most of us have learned, while school may be out for the summer, it isn’t over forever. Sorry Alice. Michael A. Bohinc is a certified public accountant in Cleveland, OH. oe Schlueter started working in the plumbing industry (part-time) for his family’s business in 1972. In 1974, after graduating from Princeton High School, he started working full-time. He started in the CMPA Apprenticeship Program in 1975 and upon completing his apprenticeship, he worked with his brothers in the business. He eventually took over Schlueter Plumbing and became very involved in CMPA/PHCC. Joe was very active and sat on several committees, held the position as a director on the board and eventually became President of the CMPA. Joe played a very active part in the building purchase and renovations. He also served as President of PHCC Ohio (2002-2003) and PHCC National Zone 1 Director. He and his brother Dan volunteered several years for PWC’s repair affair and prepare affair.

I
personally believe people have become numb to the claims of great service and high quality. Whenever I’m coaching a business I will regularly ask various employees in that business why a customer should select them over anyone else. I always hear the same things; we do quality work, great service, we care about the customer, honesty and integrity or great value. I’m sure you’ve seen these types of slogans in ads. “Quality Service”, “Great Value”, “Caring People”, “Integrity Matters to us”, Best Service Around” or this awesome statement; Value, Integrity, Quality and our Caring Staff is What Makes Our Service Great”. So read these again and tell me if these words will make you want to do business with that company, versus the other fifty companies in your town who say the exact same thing. These five words, and other ones like “Honest” or “Best” really are useless too. If you live in most any large city, you’ve probably seen signs that say “Best Corned Beef Sandwich” or “World’s Best Coffee” . . . Is it? . . . Really? How could it be possible to have so many places rated the best? I put on business workshops across the country and sometimes I’ll ask the group; “Who provides honest, high quality service, has caring employees and provide a great value?” Everyone in the room raises their hand. Is there anyone out there who will admit their service and quality sucks? Imagine seeing an ad that says “We might suck at what we do, but, at least we are cheap!” In fact when someone asks me why they should invest in one of my workshops, I tell them “Because I’m going to change your life, you will change the way you do business forever, and if you don’t believe you have gained valuable information and received a payback on your investment during the first hour of being there, I will refund your money, and you will be free to leave”. I have yet to have anyone leave. Want to get a customer’s attention? Tell them why you are different than everyone else. Let them know why you stand

out from the rest. Tell them things like “Best warranty in the state”, “Guaranteed on time arrival or it’s free” or list a bunch of comments from real customers. Tell them your job is to make them happy! So happy that they will never go anywhere else and they will also tell all of their friends how awesome you are! Talk about why you are different and stop wasting time and money telling folks you are going to do what you are supposed to be doing anyway. What’s special about doing the job you were paid to do? I know, I can hear you now. . . “But Frank, there are a lot of my competitors who do a bad job, are not honest, have bad quality and don’t care” Of course, but I would bet money they say the same things in their ads that you do. So who will the customer believe is telling the truth? I recently had dinner at the Chop House in Lexington, KY. When I sat down I asked the waitress what she recommends. She said everything is really good and if I wasn’t happy, they would do whatever it takes to make sure that had a great experience and would come back. I ordered a 9 ounce filet mignon and requested it be medium rare. Also had a salad, baked potato and
a few cocktails. When the filet arrived, I immediately sliced it in two to check doneness and it was cooked completely through, well done. Just as I looked up, the waitress was there and asked how it was, I showed her and said “this is not medium rare”. She asked if she could try it again, took the plate and later returned with a perfectly prepared filet mignon. When I went to pay the bill, she said, “don’t worry, everything is on us”. I was surprised, I said “really? Everything?” She said “Yes, you’re all set. I told you that we would make sure you were happy no matter what, didn’t I? So are you happy?” Of course, I was thrilled and will definitely be back, I left her an incredible tip and left very happy and satisfied! Imagine telling your customer that if everything doesn’t go well, it’s free, and that all you care about is that they have a great experience and no matter what, you’ll make it right. No matter what it takes! That is what you need to be telling your customers! One more thing, stop selling on price. Statements like: “We’ll Beat any Competitors Quote. Low Price Guarantee. Quality Service at the Best Price” do nothing but attract price shoppers who are looking for someone to work cheap. Focus on customers who don’t mind spending money for a great experience with a great business. Stop trolling the bottom of the barrel. You’re much better than that. Contractor Listening Skills By Steve Coscia
I
t has happened to me and to you too. And it happens at the most awkward moments.
A customer or coworker is speaking to you and your mind drifts off to la la land. After a few seconds, you regain consciousness and realize that you have no idea what was said during the last few seconds. This mind-drift experience can happen to almost anyone. Mind drifting (or mental wandering, wandering mind, daydreaming, la-la land, etc.) is a cognitive phenomenon in the brain wherein one’s attention becomes distracted from the task at hand and strays into unrelated thoughts. Busy service professionals engaged in multitasking activities will experience numerous daily mind-drift moments. The average person experiences mind-drift about 30 percent of their waking day. Much of this includes the typical daydreaming that might occur while driving a vehicle or taking a walk through a park. Mind-drift becomes a problem when it interferes with a service professional’s listening skills. Five or 10 seconds of mind-drift, while a customer is speaking, can result in a loss of valuable information for a service professional. The best remedy is fearless and courageous listening behavior to ensure the message is heard, qualified, and understood. When people think about listening, they assume it is similar to hearing. This is a precarious misconception because it leads people to believe listening is passive. Hearing a message is a passive exercise; but listening to a message requires mental energy, and this makes listening skills more active. To fully understand a spoken message, a listener must hear, qualify, and understand what is being spoken. Technicians and office employees may get bombarded with multiple messages simultaneously, and this makes it almost impossible to listen effectively. In the midst of a multitasking and busy environment, service professionals must be fearless qualifiers.
Some adults are cowardly qualifiers, because they lack the courage to go the extra step to fully understand what is being spoken. Two of the most common cowardly listening behaviors: • When someone is too embarrassed to admit mind-drift so they continue the hoax and hope for the best. •
When someone is too timid to ask a person with a heavy foreign accent to repeat themselves and thereby fail to qualify.
Both of the above cowardly behaviors can result in miscommunication, lost data and tense relationships. Biases and assumptions also play a role in listening skills. A person’s tendency to make assumptions is based on their own listening filter, which is a culmination of beliefs, experiences, and lessons learned. It is this personal filter that adds complexity to the listening process. Because everyone filters words through their own personal bias, no two people have exactly the same meaning for words or expressions. For example, the dictionary contains thousands of words; however, the average adult uses about 500 of these words most often, and each word can have multiple meanings. Biases will cause different people to interpret words differently— it is a subjective exercise. Listening skills are diminished when a service professional’s bias results in a preconceived notion about others. Ask a female plumber if she has ever been the victim of gender bias, and she will answer in the affirmative. Biases can be about gender, age, ethnicity, attire, where a person lives, the type of car a person drives, the way a person speaks, and so on. In conclusion, listening skill obstacles such as mind drift, cowardice and biases can diminish a contractor’s communication effectiveness. Volume 2016, Issue 2 • OHIO PHC CONTRACTOR

Currently, owner Bruce Stebbins focuses on industrial pipefitting and leaves the plumbing and heating details to his well skilled team. Third generation owner, Bruce Stebbins served as PHCC Ohio President in 2009-2010 and has been an active member in PHCC since 2000. He began working for his father (and uncles) in 1976. By the summer of 1978 he joined Stebbins Plumbing and Heating

as a full-time plumber and became a Journeyman in 1982. Bruce became a Master Plumber in 1984 and held Master Plumber status in over a half dozen cities and counties throughout Ohio. Bruce is looking forward to the next phase of his PHCC involvement as PHCC National Zone 1 Director and doing what it takes to help grow membership and make the organization successful and productive.

f you’ve ever seen the TV show “Holmes on Homes,” featuring Canadian contractor Mike Holmes, you know that there is a lot of shoddy construction and contracting work out there. If you’re called in to correct another contractor’s poor work, there are potential complications you might not have considered. If handled incorrectly, you or your company could potentially be on the hook legally and financially. However, your first consideration should be whether fault for the customer’s dissatisfaction actually rests with the former contractor, according to Richard Trimber, lead attorney for the business law and advisory practice of General Counsel, P.C., located in McLean, Virginia. Trimber also served as Chief Operating Officer for two home-improvement contractors in the Washington, D.C. area. “Is the job botched or is the customer just not happy? Do you have a customer that has expectations that can’t be met? Make sure the contractor was the issue and not the customer,” Trimber said.

IF THE PREVIOUS CONTRACTOR DID SHODDY WORK If in fact the contractor’s work was not up to par, you must determine what must be done to make things right. That includes presenting the customer with a realistic assessment of what must be done, how long the work will take and how much it will cost, according to Trimber. “This sort of professionalism will take you a long way,” Trimber said. If the work done by the previous contractor was truly sub-par or not performed to code, you may be faced with what is essentially a do-over. That may mean performing extensive work at substantial additional expense to the customer. While it’s necessary to explain the extent of the necessary scope of work to the customer, trashing the previous contractor is counterproductive, according to Trimber. “The more you’re focused on that (trashing the former contractor), the less you’re focused on getting the work done,” Trimber said. Whenever you take on another contractor’s botched job, your general liability insurance and workman’s compensation coverage should protect you against potential adverse legal action for shortfalls related to the work done by the previous contractor, provided that you’ve properly documented everything before you start work. Nonetheless, it’s essential to document every step of your work with the customer to minimize the possibility of future misunderstandings, according to Trimber. “Show them (the customer) that you’re doing it (correcting the previous contractor’s poor work) on a daily basis. That way you lower their anxiety level. I don’t think it’s possible to over communicate what is wrong and how to fix it,” Trimber said.
IF THE CUSTOMER IS SIMPLY UNHAPPY In some cases, a customer’s complaint of shoddy work is simply a result of unrealistic expectations that the former contractor failed to meet. For instance, a customer may not like the way the grain flows on a countertop, but the workmanship by previous 26

contractor is just fine. If you take on a job with such a contractor, you may find yourself in the same situation – with the customer complaining about you, Trimber warned. “Look at the other parts of their house. If the rest always looks absolutely perfect, make sure that you can meet their expectations. Construct the contract so that you can meet them (the customer’s expectations) profitably,” Trimber advised.
BEST PRACTICES It’s essential to remember the three major reasons why people are wary of contractors: they think the work will take too much time and cost too much. They also don’t want to get ripped off. To ease those fears, the contractor must ensure that the customer thoroughly understands what the job will entail. While this sort of transparency won’t get the job done faster or make it cost less, it will help alleviate the customer’s sense of being ripped off, according to Trimber. A common quip associated with essay writing advises writers to “Tell them (readers) what you’re going to say, say it, and then tell them what you said.” A similar approach should be applied when dealing with a customer. Outline the job, do the job and review the job, Trimber advised. “Tell the customer here’s what can be done. Here’s how much it will cost. Here’s how long it will take. The better you can calm the customer the better your chances of getting work done. Remember that you’re walking into a volatile situation,” Trimber said. In fact, effectively dealing with a demanding customer unhappy with a previous contractor’s work involves utilizing strategies that represent good practices for any job, according to Trimber. “This approach is not just for a bad job site. It should be standard operating procedure,” Trimber said. O
ne of the most frequently asked questions with regard to trade association membership is: “What can the association do for me?” And, since association membership usually involves money, it is a perfectly logical question to ask. The answer, quite frankly, however, is “Nothing.” Your association can do things with you, but not for you. The reason is simple and it involves the same principles that apply to a man and his business. A businessman invests money and he also invests his time and energy to make his business succeed. The same holds true for the dues dollar, which represents a similar investment in one’s business. There are certain functions and services of the association which require the physical support and involvement of its members. It needs the collective thinking of all concerned to formulate plans, and it requires the physical effort of its members to put those plans into operation. A survey indicates that 85% of all economic failures were firms or business not connected with a trade association.

Also it seems that the businessman who rebels against paying associations dues is always the first to criticize and to say that an association does him no good. However, he is always in front of the line to take the benefits that come his way as a result of the efforts of the association and its dues paying members. Those benefits don’t just happen. They are the result of a lot of hard work and effort by a great number of individuals who devote time and energy to get the job done. Free enterprise in America did not achieve its present position by passive acceptance. Our association owes its position and stability to a long line of doers. What YOU do for it today determines how useful it will be for you tomorrow. No one would want to be in an industry without a trade association. Just as a church sets the moral environment in which to live and raise a family, trade associations set the ethical and economic environment in which to operate a business. When a group of citizens is faced with problems of mutual concern affecting their neighborhoods, they form a civic association. When the workers of America were faced with substandard working conditions, low pay, and abusive treatment by management, they formed trade unions. The problems which face our industry today affect every contractor no matter how large or how small. And, since no one individual could possibly begin to solve any of these problems alone, it remains that each should join a collective effort to protect his business investment.
