Batmasian Family Defamed and Damaged
This past week various media outlets chose to print a salacious, one-sided story about three frivolous lawsuits which defame and damage James and Marta Batmasian, two of Palm Beach County’s most respected civic, community and business leaders. Each of the complaints are replete with lies, false statements and half truths. “We believe that Karla Sotomayor and James Morgan Baker, who are living together, and Joe Falso, who is their close friend, conspired together to create false, purely manufactured claims against us born only after my wife and I refused to succumb to their respective demands that we give each of them large sums of money to solve their personal financial problems,” stated Mr. Batmasian. Upon learning of the Sotomayor and Baker lawsuit prior to the recent press coverage, the family’s primary concern was preventing harm to people who were not sued, but were nevertheless named in the lawsuits. Proceeding swiftly under the law, the Batmasian’s were successful in obtaining the sealing of the records. “We were shocked that the media would report these false claims without seeking prior approval from the Court. The public has been ill served and misled by publication of the allegations, and innocent people have suffered,” said Mr. Batmasian. Continue on page 3

John Legend Wows Sold Out Boca Raton Crowd It might not have been one of the biggest venues John Legend, a nine-time GRAMMY award winner, has preformed at, but on Sunday, July 27 Mizner Park Amphitheater was sold out and over 4,000 fans witnessed the “All of Me” star preform some of his greatest songs. “Boca,” said Legend to the crowd. “I don’t want to brag, but tonight I’ll be the best you ever had.”
As the lights went out, Legend walked onto the stage and began by preforming his hit “Ordinary People” on the piano. Legend continued with a mix of originals, which included “Maxine,” “Good Morning,” “Who Do You Think You Are,” and other popular hits. The 35-year-old from Springfield, Ohio then began talking about his early days in the music industry and the many hooks that
he had done for artists such as Jay-Z and Alicia Keys. Legend’s “All of Me Tour,” which was named after his hit single, has been described as being stripped down in order to make it acoustic and intimate and on Sunday, Mizner Park offered a modest venue to foster this intimate performance and highlight the live instrumentals.
Batmasian Family Defamed and Damaged By Erroneous Lawsuit Featured in One-Sided Article Continue from page 1
According to The Florida Bar website, a formal complaint was filed by The Florida Bar against Chris Kleppin in 2010, the attorney for Baker and Sotomayor, based upon a referral from a Federal Court Judge, who had previously issued a sanction order against the attorney and his client in another matter. The Supreme Court of Florida approved the uncontested referee’s report, and admonished Baker and Sotomayor’s attorney for professional misconduct in that matter. In direct contrast to Sotomayor’s recent claims, the Batmasian’s have numerous cards Sotomayor has written to the family over the years expressing her appreciation and thanks for the opportunities that they
provided her. Sotomayor initially began working with the Batmasian’s as an office worker and then more recently, returned after obtaining a real estate license, as a leasing agent. “I have been with the Batmasian’s company for more than ten years and I have never seen conduct described in the claim,” said Scott Lawson, Regional Property Manager. The Batmasian family is acutely aware that its prior legal misfortune coupled with its business stature may lead some to believe they can be a target for abhorrent, miscreant tactics. That is believed to be the case with Baker, who was hired as a contractor to work as the Batmasian’s company Chief Financial Officer to be in charge of overseeing financial operations, however, he
also self-appointed himself as head of IT during his time with the company. Baker’s false assertions regarding the company’s tax returns and financial statements are in direct contrast with a Batmasian financial professional who contends that the family has been very conservative in their tax filings and reporting, and are confident that all are correct. Additionally, the documents outlined in this claim have all been sent to a third-party accountant to ensure accuracy. “Although we preferred for these matters to be handled as they should be, through the judicial system, we can no longer rely on the judicial system as so many innocent people are hurt by the lies,” said Mrs. Batmasian. “We are vigorously defending against each of the actions, taking legal action against
each of these three individuals.” The Batmasian’s benefited the community substantially through job creation, work and other economic stimuli over its 43-year business duration. Moreover, the generosity of the Batmasian family has spanned decades of devotion to helping countless charities, individuals in need and community involvement. “We have been fortunate to have been able to contribute thousands of hours of our time and millions of dollars to charities and organizations. These false claims will not deter us from doing what is right – continuing to conduct our lives, our business and our charitable commitments,” said Mrs. Batmasian.

With all the top stories that have saturated the news in recent days, many of you may not recognize the name Eric Garner or are aware of the 43-year old man who died after a recent, violent altercation with New York City police officers. The officers were evidently investigating one of New York’s most egregious crimes — face-to-face cigarette sales on the sidewalk. Merchants had complained that Garner was selling untaxed cigarettes or loose cigarettes for 50 cents apiece, to people in Staten Island, police said. The packs of smokes cost as much as $12 to $14 each. Police said Garner died from a heart attack while they were trying to arrest him for his crime last Thursday. He had been cited several times previously for selling the loose cigarettes and police said they suspected he was doing it again. I received a video of the arrest and I saw where, as about four officers were attempting to take Garner into custody one officer grabbed him from behind and placed him in an illegal chokehold. I watched the video several times and I heard him saying as the officers pushed him
to the ground and handcuffed him, “I can’t breathe, I can’t breathe.” I have spoken to several officers from our local law enforcement agencies and they all say police officers are instructed not to perform this move, as it is prohibited by their agencies. It is also against policy on the New York Police Department. After a while, Garner goes silent, laying on the pavement, motionless, handcuffed for some time until paramedics arrive. He was pronounced dead at a hospital about an hour later. While it is not confirmed that the chokehold caused his demise, it certainly led up to his death. The community bond between police officers and citizens have been strained, and this case certainly drives that tension up. The Staten Island District Attorney’s Office has launched a criminal investigation into Garner’s death along with an internal police investigation by the Internal Affairs Bureau. The NYPD’s Civilian Complaints Review Board has received more than 1,000 allegations of chokeholds over the past five years, 462 of which were fully investigated. Of
those instances, evidence points to chokeholds being used in nine occasions. What I saw on the cellphone video was very disturbing. What’s even more disturbing is the fact that the plain clothes officer, Daniel Pantaleo, accused of placing Gardner in the illegal chokehold was banned from the NYPD decades ago. During his eight-year tenure, Pantaleo has been sued twice for alleged civil rights violations. In the first suit, two men—Darren Collins and Tommy Rice—claimed that Pantaleo and other officers stopped and strip-searched them in a broad daylight while they were driving in the city. The officers allegedly handcuffed the men before pulling down their pants and underwear and searching their genital areas, according to the 2013 lawsuit. The suit was settled out of court with Collins and Rice each receiving $15,000 settlements from the city, their lawyer says. The second case filed by in February this year. Rylawn Walker accused Pantaleo and another officer of “falsely” arresting and imprisoning Walker. The charges were dismissed. That lawsuit is still pending.

While I am disappointed by xx I am not surprised. Let me preface, I caution you against making any quick decisions. Mr. Garner is not a Saint. He has a long list of prior arrests, and his height and weight - 6-foot-3-inch, 350 – would certainly cause most officers to think twice about what how they would approach him. Here’s my take on this: Even if Garner had sold single cigarettes previously and was selling them then, he did not have to be treated that way. He did not have to die. When officers approach and state a resident is doing something that breaks the law, that resident can demand a supervisor on the scene. Upon reading this, some of you will ask, why should we care about an incident in New York? Police actions like these happen every day in communities across this country and yes, right here in Palm Beach County. On July 17, the crime scene was Staten Island, let’s hope the next time won’t be in Palm Beach County.

INTEGRETY MOMENTS By Rick Boxx
Rude and Disruptive...or Respectful? There seems to be an epidemic of callous, disrespectful behavior in today’s workplace. Yet, strangely enough, such demonstrations many times are not penalized. Sometimes they are even rewarded! According to a study mentioned in an article in the prestigious Wall Street Journal, employers often pay more for rude and disagreeable employees. The study discovered employees difficult to work with actually earn, on average, 18 percent more than their more agreeable peers. Imagine investing payroll, taxes, benefits, training, and considerable time in employees, only to have them become disruptive by shouting at you in a staff meeting and slamming the door as they depart. Despite this potentially divisive impact within an organization, some executives allow themselves to be manipulated by intimidating, overbearing staff members. But
at what sacrifice? Disagreeable employees, according to another study, can exact an even greater cost to the organization. Uncivil behavior often the results in increased employee turnover. This could be because workers become upset by continual conflict; others might lose respect for superiors that fail to discipline acceptable behavior. "Don't bite the hand that feeds you" is an old saying that needs to be revisited. Employers have every right to emphasize the fact that working for their company is a privilege, not a right, and self-centered, disruptive speech and behavior will not be tolerated. If you are an employer, hiring people that respect others and are agreeable is a better path. Employers need to make themselves aware of the temptation to become bullied into paying more than they should for rude behavior, even when valued talents and
skills have contributed to the company’s success are at stake. Appeasing employees that disrupt the organization and show no respect for others – especially those for whom they work – eventually proves destructive for everyone involved. Therefore, in hiring new staff – as well as conducting periodic performance reviews – stressing the importance of respect and cooperation should be an important part of the process. A wise supervisor looks for and promotes those who respect others and demonstrate humility in interacting with others. Here are some principles the apostle Peter offers in the Bible’s New Testament: Respect should be expected at all times. Demonstrating consideration and understanding to others should be a universal practice, regardless of a person’s position in an organization or their perceived “worthiness” of being respected."Show proper
respect to everyone: Love the brotherhood of believers, fear God, honor the king" (1 Peter 2:17). Respect for authority should not be optional. Some people would say, “I will show respect only to people that earn my respect.” From a biblical perspective, however, respect should be shown regardless of what the other person does. "Slaves, submit yourselves to your masters with all respect, not only to those who are good and considerate, but also to those who are harsh. For it is commendable if a man bears up under the pain of unjust suffering because he is conscious of God" (1 Peter 2:18-19). The word "slaves" may sound out of place for the 21st century workplace, but the relationship Peter was referring to applies to that of employer and employee.

POSITIVE LIVING By Dr. Synesio Lyra, Jr.
What Edition of Your Life are You Living? Although you have only one life to live, I firmly believe that every human being goes through several editions in the construction of that life in the world. The home environment, the training received, the personal interactions leading to new acquaintances and to long-term friendships, are all significant factors in making who you are becoming. Find your passion and develop it! And here is the key: humans are in the process of perpetual becoming. The fast pace at which life is lived today, and the manifold, varied experiences one faces all the time, are contributing factors in making you who you are at any given moment. Sometimes personal preferences will lead you in a certain posture for quite some
time. Your unique presentation of self to friends and acquaintances will also elicit varied responses from people you trust and whose opinions you respect. All this, besides other factors, will cause you to choose one of the many editions of your life as the preferred one for an event, a new encounter, and the enormous variety of appearances you have to make before different segments of society. I never forget a phrase from T.S. Eliot in one of his poems, where he assures, “There will be time, there will be time to prepare a face to meet the faces we shall meet.” Although each individual remains the same internally, one’s exteriority can vary depending on the circumstances of the moment,
how one feels at a particular situation, and what is expected of you in terms of appearance, action, reaction and additional factors in a variety of settings and occasions! That’s what I mean by an “edition” of your life which you may choose to project, be that for a moment, for a day, a week, or a much lengthier period of time. You always remain the same but you project that which may make you feel better, as well as fit the particular situation you are in! As a pre-Socratic philosopher from Greece suggested so very long ago, people never step into the same river twice, because each time one goes into a river, the waters are not the same since they are constantly moving, and other conditions of the river have
equally been altered. In the same fashion, one never meets the same person twice because all the experiences acquired since the previous encounter, all the new thoughts permeating one’s mind, and one’s frame of mind has greatly changed. The key elements for all to consider are that, as life goes on, we should not merely allow it to happen to us; there’s much that we can do to improve our lot continually, making us better each new day than we were the day before. Seeking wisdom from God and with personal determination, this is a good path to follow, a meaningful and necessary adventure throughout your earthly trajectory!

Bomb Threat at John Legend’s Concert
During John Legend’s concert in Boca Raton’s Mizner Park Amphitheater a man was arrested for making a false report concerning the placement of an explosive. Matthew Klotz approached a security officer, Don McMillian, on July 27 and asked the officer which bus was Legend’s. When the McMillian replied that he did
not know, Klotz said “that’s ok, I put a bomb on all the buses,” according to the police report. McMillian maintained visual contact with Klotz and called for Boca Raton Police Department backup. An officer approached Klotz and arrested him and spoke with Klotz after reading him his Miranda Rights. Klotz admitted to making the statement and claimed he was “just joking,” assuming the guard would take it as a joke. Klotz admitted to knowing the seriousness of making a bomb report but stated that he found it funny. According to the police report: “there were a total of 11 vehicles that needed to be swept in the area of the bomb threat: 3 large U-Haul type trucks, 2 tour buses, 2 vans, 2 motor vehicles, 1 tractor trailer/18-wheeler, and 1 trailer.” Klotz was placed under arrest for knowingly filing a false police report about an explosive, disorderly conduct, and reasonably knowing that the person he was making the false report to was an officer.
Two Men Attempt to Rob Victim of Cell Phone On Sunday, July 27, at about 11:40 p.m., Boca Raton Police officers responded to a report of an attempted robbery that occurred in the area of 2000 North Federal Highway. Arriving officers met with the victim, who said he was riding north on his bicycle on the west sidewalk near 1400 North Federal Highway, when he entered the Bank United parking lot in an effort to avoid the sprinklers. Once in the parking lot, he was approached by two suspects, one of whom asked to use his cell phone. When he told them no, they began to
chase him. The victim jumped off his bike and entered the grass median at about 2000 North Federal Highway in an effort to elude the suspects. One suspect tried to grab the victim’s phone then punched him in the face as they struggled. The suspects ran off towards the rear of the Boca Inn, without the phone. The victim sustained minor injuries, but refused medical treatment. If anyone has information about this crime, they are asked to call Detective Tim Kurdys at (561) 338-1377 or Palm Beach County Crime Stoppers at (800) 458-TIPS.

Pigs Do Fly Productions’ Fifty Plus – A Celebration of Life... As We Know It sold out almost every performance when it played at Empire Stage in May. The good ‘word of mouth’ and positive reviews intrigued Showtime Performing Arts Theatre’s Marilyn Perry; she attended a performance and liked what she saw - so much so that she issued an invitation to Pigs Do Fly producer Ellen Wacher to reprise the production at Perry’s Showtime Performing Arts Theatre in Boca Raton. Wacher quickly contacted directors Beverly Blanchette and Marjorie Butler-O’Neill, as well as actors Todd Caster, Mark Kroczynski, Kitt Marsh, Troy J. Stanley, Carol Sussman, and Janet Weakly, along with the

technical crew associated with the Empire Stage production, all of whom came on board immediately. The ‘encore’ edition of Fifty Plus – A Celebration of Life... As We Know It! will run from August 14th through August 24th at Showtime Performing Arts Theatre in Boca Raton. “This is a wonderful opportunity to reach a brand new audience - people who would otherwise not have an opportunity to see what we’re doing,” says Wacher. “And we now know for sure, from the reaction to our May production, that there is definitely an audience ‘out there’ looking for exactly the type of theatre we want to produce.” Fifty Plus – A Celebration of Life... As We
Know It! consists of seven short plays reflecting Pigs Do Fly Productions’ mission to produce plays that highlight the actor over 50 as a viable, fully involved, full of life character. The scripts were selected from over 350 submissions. And Wacher was extremely specific in her search for just the right plays: “We looked for scripts that resonated with us; for situations that strike a chord with our audiences; and of course, for humor,” she explains. “I’m really excited that this concept is flying (pun intended!). It’s definitely an idea whose time has come. These plays appeal to everyone no matter how old they are! They’re funny, and witty, and touching, and resonate with anyone who sees them.”

I am very honored and excited to be joining the boca tribune news team. I have lived in boca raton for 16 years and seen many changes to our fabulous town. I was introduced into boca society by my friend yvonne boice who invited my husband bob and i to the opening of the mizner park amphitheater where we sat in the box with the countess dehoernle and flossy keesley and we all became friends. These great ladies even attended my daughter’s wedding a few years ago, joined my red and black hat society groups and it
is indeed an honor to know them. I have learned much wisdom from the two of them. Yvonne invited us to many of the society charity balls, luncheons with celebrity speakers, cowboy ball, ymca, red cross madhatters lunch and i got to know many of boca raton’s movers and shakers.Thank you Yvonne for this great honor. I look forward to the coming society season in the fall and telling you all the great happenings in our beautiful city of boca raton.

Chadwick Bosema Amazes as James Brown
The genius of soul singer James Brown was subtle. Take the two-letter word “up,” Brown gave it two syllables: “Up-Ah,” as in “Get On Up-Ah.” “Get On Up” is the title of a James Brown biography starring Chadwick Boseman in a truly amazing performance. It isn’t the first time Boseman has portrayed a ground-breaking African-American man. In 2013 Boseman was superb as baseball star Jackie Robinson in “42.” Although he is taller and thinner than short, stocky Brown, Boseman embodies his spirit. Both Jackie Robinson and James Brown were trail-blazers. Robinson broke the color barrier in professional baseball. James Brown brought real, primal, flamboyant black music to the American masses. James Brown was one of a kind. His dancing was as important as his singing. It is obvious Boseman rehearsed a lot to duplicate Brown’s gymnastic dance moves, including his sideways, feet only shuffle and his leaping splits. Director Tate Taylor (“The Help”) explores the down side of James Brown as well as his charismatic stage presence. Brown had a volatile temper and a dictatorial attitude
toward his band members and handlers. British screenwriters Jez and John-Henry Butterworth do not whitewash Brown’s less admirable traits. Nelsan Ellis represents Brown’s abused associates as his loyal second-in-command, Bobby Byrd. Dan Aykroyd plays Ben Bart, the Caucasian Jewish manager who helped expose Brown to a white audience (and profited greatly in the process). Brown grew up dirt-poor in Augusta, Georgia. His father left early and his mother (Vila Davis) was largely absent. The closest thing to a mother figure was his Aunt Honey, played by Octavia Spencer. Playing Brown’s longsuffering wife DeeDee is Jill Scott. Little Richard (Brandon Smith) had a small but key role in advancing Brown’s career, as did Mick Jagger of the Rolling Stones. Jagger is in fact a co-producer of this film. James Brown was an enigmatic, contradictory man. I had the honor of meeting him at a press conference at the Boca Raton Airport in the early 1990s. I humbled myself by sitting cross-legged on the floor at Brown’s feet. I was rewarded with eye contact and a smile from a man who obviously was not fond of meeting the press. No one can deny James Brown was a pro and a show business force of nature who channeled his energies in electrifying, unforgettable performances and best-selling recordings. Rating: stars

“Better heart, brain, and joint benefits WITHOUT the fishy after taste!”
Say Goodbye to Bad Cholesterol, Joint Pain, Mood Swings, & Brain Fog in 30 Days or Less!
Say the ‘MaGiC WorD’ & reCeive a Box oF thiS CLiniCaLLy teSteD ForMuLa - Free! ‘Super Human’ Fish Oil! Ivy league physicians affiliated with Yale University believe their patented 4:1 ratio of EPA/DHA omega-3s are the future of fatty-acid therapy and deliver almost ‘super human’ results. Prevention Pharmaceuticals, the makers of Omax3® Ultra PureTM, have decided to giveaway 1,000 boxes in a massive initiative to get consumers to try it. “We believe one dose of this high performance 1.5g of omega-3 will change your opinion of fish oil with the dramatic results,” says Terry Tormey, CEO of Prevention Pharmaceuticals. Ultra Pure Formula Equals Safety Some supplements may contain more than just omega-3. And some of that "extra" content you could do without, such as saturated fats, including unwanted omega-6 fatty acids, and toxins like mercury, lead, and PCBs commonly found in fish. Freezer Test Proves Purity Omax3® was shown in lab tests to be 91% pure, free of bad fats and toxins. You can prove this by freezing your own fish oil. Put a pill of your store bought brand of omega-3 in the freezer overnight. Then put Omax3® Ultra PureTM in the freezer overnight. The difference is clear. The store bought brand will be cloudy, even a solid white. This is caused by the bad fats and toxins solidifying, which your body doesn’t need. Omax3® will remain clear, which equals safety and effectiveness. Fewer Pills Better Results The patented delivery system gives you 1.5g per serving in just two easy to swallow liquid gel capsules, compared to the 6-12 you would need to take of a store bought formula. This means fewer pills equals greater results, you can feel. Unique Blister-Pack StopsFish Burps The color of the Omax3® oil shows you its purity. The individually blister packed capsules protect against rancidity so there’s no fishy taste or stomach upset. Clinical Study Shows it Works Better than Your Fish Oil Yale University Study Results Omax3® Ultra PureTM, in the clinical study, was shown to improve cholesterol in 30 days. Patients showed: 78% lowered cholesterol* 73% reduced triglycerides* 71% reduced LDL * Lower Cholesterol Shelly T., confirms the clinical results of Omax3®. William Shakespeare’s Classic Tale of Mistaken Identity, Adventure, And Romance Evening Star Productions’ August production has just about everything any theatregoer would want to see on stage: comedy, romance, suspense, adventure, several cases of mistaken identity, and a happy ending. William Shakespeare’s The Comedy of Errors might have been written in 1594, but it’s as funny and witty and sharp in 2014 as it was 420 years ago. The play’s characters include two sets of identical twins, Antipholus of Ephesus and Antipholus of Syracuse and their similarly identical servants, Dromio of Ephesus and Dromio of Syracuse. Antipholus of Ephesus is unaware that he has a twin brother, Antipholus of Syracuse. And Dromio of Ephesus is unaware that he also has a twin brother, Dromio of Syracuse. A major part of the play’s humor comes from slapstick and mistaken identity, puns, word play, and a myriad of comedic situations – and even 400 years after its first production, audiences will still delight in the mix-ups that occur when all the twins converge in Ephesus. Evening Star Productions will present this clever and still original classic fromAugust 22nd to August 31st at Sol Theatre in Boca Raton. Evening Star Productions’ artistic director Rosalie Grant, and director Laura Ruchala have assembled a talented group of actors to populate Shakespeare’s Ephesus. Joanna Mandel, Seth Trucks, and Samantha Streich all recently appeared in Entr’Acte Theatrix’ production of Avenue Q. Also cast are Jim Gibbons, Greg Ward, Elaine Levin, Luis

Herrera, Michael Mena, Lito Becerra, and Sofia Manolesco. Says director Ruchala: “When Rosalie (Grant) asked me to direct a Shakespeare play this summer, it seemed like the stars had aligned. The Comedy Of Errors Is one of my favorite Shakespeare comedies. Pure silly fun, this play is a romping good time for the whole family. Twins, Shipwrecks, mistaken identity times two, chases, and shootouts; I know our modern twist on this classic will keep everyone entertained. I am doing this as an homage to the late artistic director and star of Palm Beach Shakespeare Festival, Kevin Crawford,” Ruchala continues. “Before he passed away unexpectedly last winter we had discussed him helping me cut the script. Luckily, His brother Todd was able to recover this version - which we will be performing.” Evening Star Productions’ The Comedy of Errors will run from August 22nd through August 21st at Sol Theatre in Boca Raton. Tickets are $15 or $10 for juniors. Group rates are also available. Tickets are on sale now, and can be purchased at the Sol Theatre box office at 561-447-8829 or on line at www.eveningstarproductions.org. Do As I Say, As I Do As I Say Did you ever work for someone that had the disconcerting tendency of instructing you to do something one way, and then proceeding to act in a manner contrary to what you were told? I remember an oft-repeated saying, "Do as I say, not as I do." This applied to work practices, personal habits, even values. The problem is, when people say one thing and then do the opposite, something gets lost in translation. Perhaps it might be better to be able to tell others, "Do as I say, as I do as I say." In their book, Leadership Lessons of Jesus, Bob Briner and Ray Pritchard state, "Leaders are always teachers...you must teach with authority. You must be prepared. You must know what you are talking about." But then they add, "A leader's words, as vitally important as they are, will only go so far and impact so many unless they truly represent the reality of his or her life.... Effective, enduring leadership calls for both precept and example." The intersection of teaching and action also was the subject of a poem by English-born poet Edgar Guest. Here's a portion of "I'd Rather See a Sermon:" I'd rather see a sermon than hear one any day: I'd rather one would walk with me than merely tell the way. The eye's a better pupil, and more willing than the ear, Fine counsel is confusing, but example's always clear.... And the lecture you deliver may be very wise and true, But I'd rather get my lesson by observing what you do. For I may misunderstand you in the high
Home School
advice you give, But there is no misunderstanding how you act and how you live.... And all travelers can witness that the best of guides today, Is not the one that tells them, but the one that shows the way. Aligning belief and action is a recurring theme in the Bible, which some regard as the greatest book ever compiled for the business and professional world. Here are some passages about this: Living out what we believe. Expressing high-minded principles and values without practicing them ourselves is hypocritical."What good is it, my brothers, if a man claims to have faith but has no deeds?... Suppose a brother or sister is without clothes and daily food. If one of you says to him, 'Go, I wish you well; keep warm and well fed,' but does nothing about his physical needs, what good is it? In the same way, faith by itself, if it is not accompanied by action, is dead" (James 2:14-18). Applying the principles. We not only teach and demonstrate, but also expect those who follow us as leaders to put what they learn into use themselves. "Whatever you have learned or received or heard from me, or seen in me - put it into practice"(Philippians 4:9). Passing on truths of value. We should not only back up what we say by our actions, but also pass them along for others to apply in their lives. "And the things you have heard me say in the presence of many witnesses entrust to reliable men who will also be qualified to teach others" (2 Timothy 2:2).

Q:
We have twin girls. We lived in another state until the girls were in second grade. We then moved to Boca Raton, so that I could take a job offer, a significant advancement in my career. My, wife, who had been teaching elementary school in our old home state, looked into public elementary school education in our neighborhood. She was not happy about what she found. We cannot afford a private school. She suggested home schooling the children. I am against it, and told her so. I didn’t want the girls to grow up and be educated without having the benefit of having to deal with other children of the same age, and teachers who were not their parents. We compromised. We agreed that the girls could be home schooled, through fifth grade, but would go to a public middle school, and high school when the time came. Our agreement was not written. Our daughters have completed fifth grade for the 2012-2013 school year. My wife and I are going through a divorce, in which I filed the petition. She has, conveniently forgotten our verbal agreement, and insists that she be allowed to continue home schooling, at least through middle school, and, perhaps, high school, which I do not want her to do. Can the judge in our divorce case address this issue?
A:
Your children’s best interests must be taken into consideration by the judge. That consideration will, if properly raised by the pleadings, include the school issues. If your petition for dissolution of your marriage does not specifically raise this issue, your lawyer should file an amended petition. If your petition did not raise the issue but your wife’s counter-petition did, that would be sufficient once you denied her request in your answer to her counter-petition.

Since your daughters are half way through fifth grade, the judge will have time to decide what happens next, before your girls are ready to enter middle school, next fall. Your attorney and your wife’s counsel will have to be prepared to put on a case that addresses either of the judge’s choices. The judge can either make a choice between the public middle school and home schooling based upon an evaluation of the success of the home schooling verses the quality of the middle school available in your neighborhood. The State of Florida grades the schools through the FCAT process. Testing is available for children being home schooled. If the judge goes in that direction he, or she, may want the decision to cover high school as well, unless you and your wife can agree on that issue in advance. The judge is going to look for a way to end the case that will not bring it back into court after three years, for a high school determination. The second alternative available to the judge would be to delegate to one of you, total control over all educational matters, even though you will have shared parental responsibility on other matters. You or your wife would, under such a final judgment, not be required to consult or agree with the other on any further school decisions. There is no way to accurately predict which method the judge will use. Your wife may have an edge, as a schoolteacher. However, if progress tests show that your children under perform public school children in progress tests, you may be the parent selected to make the decisions. It would be wise to have private and/or public testing, or both given to you daughters, as soon as possible, so that this issue can be intelligently litigated and discussed when you sit down with your attorneys and a mediator.

Real Estate The Boca Raton Tribune
Homes Inside and Out By Joshua Carlson
What’s the Deal with Mortgage Consultants How are Mortgage Consultants different from Mortgage brokers or bankers? As a Real Estate Broker, I get asked certain questions about other real estate professionals. Many people are confused when it comes to Mortgage Brokers, Bankers, Consultants, etc. The following are some of the top questions I receive when it comes to Mortgage Consultants.
1.
What is a mortgage consultant? A mortgage consultant helps people find and apply for the right mortgage and make sure people are fully informed about what's available. Not all mortgage consultants are the same. What kind of advice you receive depends highly upon whom they work for. There are 2 main types of mortgage consultants you come across, Mortgage Brokers and Mortgage Bankers. Mortgage Bankers recommend products and services in which ONLY there company sells. Mortgage Brokers offer a range of products from a variety of Different companies. I have always preferred Mortgage Brokers as they
have more options for my family, friends and clients.
2.
Are mortgage consultants necessary? No they are not necessary but I highly recommend one to help you gather and review all your documents so you can obtain the best mortgage plan that suits your lifestyle and needs.
3.
When should I hire a mortgage consultant? As soon as you get done reading this column you should call one. The sooner, the better. Whether you are renting or looking to buy a home or in the midst of selling one, you should know where you stand financially. Meeting with a Mortgage Consultant will let you know a number of things such as what type of documents you need in order to qualify and what you need to do to start preparing so you can receive the lowest payment plan options for you. It is important to hire a mortgage consultant and keep in contact with him or her every 6 to 12 months. You should even contact them when your financial situation changes.
For example, if you obtain a new job or pay increase you may be able to qualify to buy a home instead of continuing to rent.
4.
How much does a Mortgage Consultant cost and do I need to pay upfront? A good mortgage consultant is going to guide you through the process and not charge an upfront fee. They get paid in different ways depending on what type of loan you qualify for. Sometimes you will be charged something called points which are either charged outside of the loan or added into the interest rate. Or they may also charge a flat fee and you pay them at the time you obtain your keys at closing. No matter which way a Mortgage Consultant gets paid it should be disclosed to you upfront. If they don’t, don’t be afraid to ask.
5.
What should I look for when hiring a Mortgage Consultant? Do not ask just anyone as you will be handing them your personal information. Always ask a qualified source and get there licensing information. GREAT Mortgage Consultants will be open
and honest with you as you should be with them. Remember, they are trying to help get you a loan so you need to disclose everything. For a list of questions to ask when interviewing a consultant shoot me over an email at CarlsonRealtor@gmail.com. I always recommend 2 to 3 people whom can get the job done. Most go with my #1 choice which is Rick Salerno. He is straightforward, honest and gets the job done with some of the lowest rates in town. Rick focus’s and cares about your bottom line, not his, which is a tough quality to find. If you are interested in a FREE Mortgage Consult you can reach him at 954-993-4500. If you are looking for someone whom will be honest with you and let you know if you are ready to purchase or if you need to wait another year because you are not financially capable yet, then Rick Salerno is your man. Stay tuned for more tips and important information regarding your Home: Inside and Out…

Boca Mall’s ‘Shrimp House’ Restaurant Chain Adds Two New Dining Locations
Carlo Barbieri, president of Shrimp House LLC and CEO of the Oxford Group, the largest Brazilian consulting firm in the United States.
The Shrimp House restaurant chain, which operates a combination food court and dining room location in the Town Center at Boca Raton mall, continues to open new and exciting dining sites in Florida. The fourth spot to bear the Shrimp House name was launched Friday, July 18, 2014, at the International Mall, 1455 NW 107th Ave., Doral, Florida. The fifth will open August 1, 2014 at the Melbourne Square Mall,
1700 W. New Haven Ave., Melbourne, Florida. Another is planned at the Sawgrass Mills Mall in Sunrise. The Oxford Group, whose offices are located in Boca Raton, and its partner, Vivenda do Camarão, parent company of Shrimp House, plan to create more than 30 Shrimp House dining spots at different malls throughout the state of Florida by the end of 2015. The first Shrimp House to invite customers to enjoy exquisite meals opened in December 2013 at Coral Square Mall in Coral Springs. The second kicked off March 2014 at Dadeland Mall in Miami and the third began operations June 9, 2014 at the Town Center at Boca Raton mall. “Our USA restaurants consistently offer food with the best taste you can get in a shrimp plate,” said Carlo Barbieri, president of Shrimp House LLC and CEO of the Oxford Group, the largest Brazilian consulting firm in the United States. The success of the first three locations is testa-
ment to that, he said. “Our chefs have developed this special flavor by using a variety of exotic and exclusive ingredients imported from Europe, Asia and Latin American,” he noted. Shrimp House customers can select items from a menu that features nearly 30 dishes offering shrimp, salmon, trout and fried fish dishes accompanied by pasta, rice, French fries or potato sticks. Coca Cola beverages are served along with natural juices and waters. A chocolate brownie, Key lime pie, dulce de leche cheesecake and apple pie are part of the delectable dessert menu. New daily dining specials available for $4.99 each have recently been added to the menu. A fish sandwich with fries can also be purchased. Vivenda do Camarão is a popular Latin American shrimp, seafood and pasta restaurant chain which has grown to more than 150 locations at malls throughout Brazil and Paraguay since it opened in 1984. Barbieri said the company has invested
approximately $1.7 million for the existing locations and will spend an additional $20 million to expand its dining sites throughout Florida. “These resources are needed not only to ensure the expansion of restaurants, but also to maintain the quality of food and the development and strengthening of the brand.” The Melbourne and Doral malls are both owned by Simon Properties, a global leader in retail real estate ownership, management and development, and is an S&P 100 company. Simon Properties also owns Dadeland mall and those in Boca Raton and Coral Springs where Shrimp House is located. The Dadeland, Doral and Melbourne locations offer food counter service only. The restaurants in Boca Raton and Coral Springs have a food court serving area as well as an attached restaurant for sit-down dining. The five Shrimp House restaurants are located in the food courts of each mall.

Ray Berger Named New Olympic Heights Head Coach For the third time in the last six months, Olympic Heights High School has a new head football coach. With the resignation of Dale Williams, for a lucrative sales position at a national sporting goods company on Monday according to Ken LaVicka of ESPN Palm Beach, and with only one week before the start of fall practices, Olympic Heights were in a hurry to find a head coach. The Lions didn't hesitate as they named Ray Berger the program's third head coach in six months early on Tuesday. According to Palm Beach Post's Anthony Chiang, Williams, who did not coach a regular-season game at Olympic Heights as he
was hired in March to replace Kevin Fleury who left for John I. Leonard in late January, would not have been able to guarantee that he would be at the school everyday and so he decided it was best to resign before even starting. “With the job that I took, I couldn’t guarantee that I would be there every day,” Williams told PB Gametime. “I had to turn in my resignation.” Berger is no stranger to Olympic Heights, in fact, the 51 year old had interviewed for the open position earlier this year but took his name out of the race due to "attachment" reasons to Spanish River High School. However, when opportunity comes
back and knocks for a second time, it's hard to say no. Berger has a career record of 79-58 as a head coach. He had was 75-32 in two stints at Santaluces (1994-2003, 2007), and 4-26 in three seasons at Spanish River (2009-11). During his 10 years at the helm of the Santaluces Chiefs, Berger saw a great amount of success, winning three district titles, making eight playoff appearances and sending 40 players on to Division I college football, including New England Patriots defensive tackle and former Miami Hurricane Vince Wilfork.
Two Men’s Golfers Achieve GCAA All-America Scholar
By Chad Beattie
Cleveland Golf/Srixon All-America Scholars were announced by the Golf Coaches Association and Lynn University’s Paul McPhee and Ernesto Vitienes were among the honorees. This marks the third consecutive year and ninth time in 10 years the Fighting Knights have had at least one Scholar All-America selection. There were a total of 75 student-athletes in Division II honored, including 16 student-athletes from the Sunshine State Conference. To be eligible for Cleveland Golf/Srixon All-America Scholar status an individual must be a junior or senior academically, compete in at least three full years at the
collegiate level, participate in 50-percent of his team’s competitive rounds, have a stroke-average under 76.0 in Division I, 78.0 in Division II, 77.0 in NAIA and 79.0 in Division III, and maintain a minimum cumulative grade-point average of 3.2. A recipi¬ent must also be of high moral character and be in good standing at his college or university. A senior from Perth, Scotland, McPhee posted a 74.96 stroke average in 27 rounds played while earning one top-10 finish. Additionally, he helped the Blue & White advance to the NCAA National Championship for the third time in his career. Vitienes recorded his best season in his last
hurrah. He logged a 73.85 stroke average with four top-10 finishes in a team-best 39 rounds played. The senior out of Santo Domingo, Dominican Republic, tied a school record with a round of 64 at the Titan Winter Invite and set a new program mark by shooting eight-under par. The Fighting Knights advanced to the NCAA Division II National Championship

Bidding on Babe Ruth Ball Stops Short
By Kathryn Wohlpart
Bidding on the first homerun ball Babe Ruth hit in Yankee Stadium fell short in an auction and will stay in a Boca Raton museum exhibit. Pre-bidding reached $95,000 but no bids were placed once the auction moved to the floor, stopping the item from reaching its
$99,000 reserve. Within 126-item collection, the homerun ball is ranked as the number one item. “You never know in an auction. Really, I'm shocked that it didn't meet the reserve," said Joel Platt, the collection’s owner. "We still believe it's a seven-figure value ball because it's so unique and one-of-a-kind historically." The first home run Ruth officially hit was sold for $126,500 in 1998. The ball Platt had up for auction was hit at an unofficial practice before the stadium’s opening and was retrieved from the stands by a construction worker. "It's my honest opinion that somebody out there will be contacting us and wanting this ball because this is, to me, one of the historical balls, a real treasure," Platt said. For now, Platt’s ball will remain in the Sports Immortals Museum in Boca Raton among other Ruth items and a 1 million piece, revolving exhibit of sports memorabilia.
