End Of The Year Special FAU to be Smoke-Free with new Tobacco ban, Policy Takes Effect January 1
By CRA News Service No ifs, ands and cigarette butts about it, Florida Atlantic University will implement a campus-wide tobacco ban beginning January 2015. The last phase of the five-year plan aims to cultivate a smoke-free environment on campus. University officials say that second-hand smoke, health concerns, campus cleanliness and public opinion are all reasons for the new policy. The smoke-free policy prohibits cigarettes, e-cigarettes, cigars, chewing tobacco, pipes, and all types of smokeless tobacco from being used anywhere within campus boundaries. This includes all outside areas, currently designated smoking areas, inside buildings and parked cars, and traveling on and across campus. Visitors, vendors, employees—including faculty—are subject to this policy as well. see page 3

Boca Raton City Council unanimously approved St. Joan of Arc’s planned Mercy Center II and other improvements on their Catholic school and church campus on Third Avenue. The approval gives St. Joan of Arc the go-ahead for the first of three phases of construction. A 20,200-square-foot Mercy Center II will be built on existing playing fields, and have a 360-seat auditorium and art classrooms on the first floor and meeting rooms on the second floor. Florida Power & Light stuck it to air conditioning manufacturers and AC companies. The giant utility make its surprise announcement that in two weeks its energy efficient program rebate for air conditioning equipment will be slashed by 65%. According to the Palm Beach Post a 5 ton Trane air conditioner that received a $1500 rebate will now see it drop to $516. This year, FP & L is on track to pocket and estimated $1.6 billion in profits. South Florida’s airlines are picking up a huge break in the plunging oil prices. Jet fuel has plummeted .37 a gallon from $2.24 in the past 30 days and is now $1.92 and heading lower according to experts. The lower prices mean billions to the industry’s bottom line and there’s little chance fares will be lower due to the windfall. 30% of an airline’s operating cost is fuel and carriers flying from PBIA to New York Metro will save around $4,000 one way in fuel costs. Embattled state owned insurer of last resort, Citizens Property Insurance revealed it has dumped 335,000 policy holders this year, 27% decrease in customers, but it still has over 700,000 customers on the books and will unload thousands more next year in an effort to reduce risk. Taking over the policies are insurance companies with dubious records, handling any storm claims and suspected reserves to survive any major hurricane, say Citizen’s critics.

Community FAU to be Smoke-Free with new Tobacco ban, Policy Takes Effect Jan. 1 2015

The last phase of the five-year plan aims to cultivate a smoke-free environment on campus. University officials say that second-hand smoke, health concerns, campus cleanliness and public opinion are all reasons for the new policy. The smoke-free policy prohibits cigarettes, e-cigarettes, cigars, chewing tobacco, pipes, and all types of smokeless tobacco from being used anywhere within campus boundaries. This includes all outside areas, currently designated smoking areas, inside buildings and parked cars, and traveling on and across campus. Visitors, vendors, employees—including faculty—are subject to this policy as well. “Violations of this policy by faculty, staff and students may be grounds for disciplinary action up to and including termination or expulsion…and violations of
this policy by visitors, contractors, guests and other third parties may be grounds for terminating or suspending their access to and/or use of university property,” according to the policy. There are 1,477 smoke-free campuses in the U.S., according to an Oct. 1 report from the American Nonsmokers’ Rights Foundation. Of those colleges and universities, 975 are 100 percent tobacco-free. FAU will be the 24th university in Florida to transition to a smoke free campus. For those students who opt to quit smoking, there is a cessation program offered through the Wellness Center, located above the Breezeway. The free six-week course provides group support, coaching, and strategies to quit. Any students interested in participating may contact the Wellness Center at wellness@fau. edu or by calling 561-297-1048. Off-campus services are listed under Tobacco Free Quit Resources under Health and Wellness Education on the main FAU website.
Retired Police K-9 Dies After Surgery
By CRA News Service Members of the Delray Beach Police Department are mourning the loss of retired K9 Officer Karo. The 8-year old Shepherd died unexpectedly Dec. 9 from complications after a surgery, officials said. Karo joined the force in Feb. 2006 and retired after seven years. He is credited with hundreds of apprehensions and drug seizures. Karo was also critical in recovering evidence that solved many cases, police said. “Those who had the opportunity to see him work, you know how special he was,” K-9 Officer Adam Margolis said of his colleague. “Out of all of his accomplishments (and there were many), one that I will always remember is the Piccasso’s Pizza shooting back in 2007.” After an extensive nine hour manhunt in a tropical storm, which involved 15 K-9 teams, Karo found the two suspects, their hand guns, rifle, masks and gloves.

Both suspects, Oneil Pedley, then 19, of Miami, and Kendrick Silver, then 18, of Delray Beach, were arrested on several charges, including attempted homicide and armed robbery at the restaurant in the 2200 block of South Federal Highway. Following the arrest of the suspects in Palm Beach County, Miami-Dade police charged them in fatal shooting of Jose MarcheseBerrios, 39, who was shot in MiamiDade County on May 24 while he was jogging. Pedley worked as a nurse’s assistant at a Miami hospital. The suspects are currently serving four life sentences, police said. “This is just a brief snapshot of all Karo accomplished during his years of service to our agency,” Margolis said on a Facebook posting. “K-9 Karo was a valuable member of our organization and always came to work ready to protect and serve his partner, Officer Tom Tolbert, our officers and community and did so honorably for seven years.”

You Can’t hit a Home Run Unless you Swing for the Fences I enjoy baseball for many reasons: the discipline it instills in one, the opportunity to stay physically fit and foremost the life lessons I garner from its many analogies. One such analogy, “You can’t hit a home run unless you swing for the fences,” proved true and relevant recently during the 2nd Annual South Florida Youth Oratorical Academy’s speak out, sponsored by CRA Media Group, the parent company of the Delray Beach Tribune newspaper, and other local companies. Little things like speech contests and other academic achievements are often overlooked, even in small tightly-knit community like these in Palm Beach County. With all the recent negative news involving young people, it was so important to highlight four area teens — J.C. Mitchell Elementary’s second-grader Cameron Marshall, Atlantic High sophomore Geovanni Martinez, and Village Academy’s Zykra Carter and Antwan Bowleg. All four spoke clearly and concisely on this year’s chosen topic — which, appropriately on the 50th anniversary, was “Dr. Martin Luther King’s I Have a Dream Speech
through the eyes of today’s youth. Everyone in attendance would have agreed that all the candidates were very motivated, intelligent young people. As they delivered their 3-5 minute speeches, all sounded like the aspiring youth leaders they are. I am sure they will do a greater job in January when they speak at Dr. MLK observances in Delray Beach and Boynton Beach. As each student spoke, judges scored them on content, being on subject, how they presented the material and whether or not they stayed within the allotted time frame. All the contestants were winners. Each was awarded a cash prize, a backpack filled with school supplies for the school year, speaking opportunities around the county next year and passes to the Spady Cultural Heritage Museum in Delray Beach and the Norton Museum of Art in West Palm Beach. The ‘wow’ factor was regardless of where they finished, each earned a three-day all-expense paid trip to a crime prevention conference for youth in Jacksonville at the end of the school year. Competing for cash and all the other prizes may be nice. But the experience we all
got listening to this group of intelligent, passionate youngsters whom we think will achieve all of their goals will last a lot longer and mean a lot more than the money ever could. In the days after the contest, I spoke with Ms. Carter who said the experience helped her discover a passion for public speaking. “It helped me to face my fear of stage freight,” the second-year competitor and last year’s winner said. “Now being up in front of people is my forte.” Mr. Martinez said it prepared him “for the real work, because it’s taught me to have a growing knowledge of citizenship, leadership and many other life skills that can be used in all aspects of life — communication being a huge one.” These children are all over-achievers and they pushed themselves very hard during the competition and the days leading up to it. Just when I thought they could not get any better, they amazed me. As I listened to each student, I kept asking why there were only four competitors. I soon learned that the process of writing the one-page speech and a fear of public speak-
ing kept many from participating. In the days immediately following the contest, several students after learning what the prizes were, said they regret not competing. And there were a few adults who suggested that we should have ‘bribed’ the students by telling them the prizes. While I am all in favor of using incentives to get results, there is a limit where I draw the line. Notices were sent to area schools, churches and appeared in the newspaper informing of dates for the informational and practice/ coaching sessions. Only a handful took advantage. What the students who failed to show up for these sessions failed to learn was that one cannot get an earned run average unless he or she takes a swing. We must urgently find a solution so our youth will develop a love for reading, writing and public speaking. As I have said repeatedly, our greatest resource is the youth in our community. Therefore, the more opportunities we can give them to develop leadership skills, grow professionally and learn about the world around them, the brighter our future looks.

Preparing for New Beginnings! There are certain things that never end, but such is never the case with days, weeks, months and years. One year is about to end while another year is already dawning. Much of the good and evil experienced in the old year may be repeated in the new, just like experiences and occurrences unique to the coming year shall also inevitably appear! As in countless years throughout human civilization, there are many factors that cannot be avoided when a new year arrives and unfolds. Varied happenings shall emerge everywhere, many old ones shall be repeated in the same fashion or in a different way, happy and unpleasant surprises shall also become visible!
The only preparation humans can make for all this is to become aware of these possibilities, along with others which no one can actually anticipate, though they shall assuredly occur! As it has been throughout human history, good and evil inevitably appear, bringing pleasant experiences in one case and possible ruin and devastation in the other. The human task is to continue sowing good will everywhere, to live alert and active where reasonable voices can be heard and their positive impact felt, especially because there are many who shall be doing the exact opposite. Against the latter, courageous voices must be raised even if some
may consider such efforts as “crying in the wilderness.” Even then, it remains a necessary effort, for evil can only be displaced by the good that is sown, by positive voices raised, by legitimate efforts displayed which offer fellow humans a better alternative to the negative attitudes which abundantly surround them! I’m not merely suggesting the formulation of New Year’s Resolutions, though that can also be prepared and gradually implemented. The problem is that traditionally this has been more an exercise in futility, with good intentions, but devoid of the firm determination to execute them. A solid preparation not just for the start of
a new year but for the beginning of each new day, can entail a list of potential good deeds toward others, responsible actions in a variety of situations, and pre-planned achievable ways for the handling of any conflict that comes along. Much that is bad can be avoided by a proactive positive strategy outlined for every single day. Thinking more of others and doing what you can, helps avoid too much concentration on self and the indignities that life shall continue hurling at you, no matter what. Plan for better things and engage your decisive efforts in making that happen!

The residential landscape of Boca West Country Club is expected to change soon as renowned real estate developer Siemens Group plans to break ground on a new luxury condominium in the fall of 2015, the Boca Raton Tribune has learned. Kelsey Janser, a Boca Raton resident and freshman at Vanderbilt University, was recently crowned 2013-2014 Miss Teen National Winner at their pageant in Orlando, Florida. She competed with 62 young women from across the United States and won on the basis of a personal interview plus poise and stage presence in casual wear and formal wear. A new Walmart is opened Wednesday, Sept. 10, following a brief ribbon-cutting ceremony at 7:30 a.m. The new store is conveniently located at State Road 7 and Palmetto Park Road and is open 7 a.m. to 10 p.m., seven days a week.

Under the lights in Boca Raton, FL, Marshall defeated Northern Illinois in the inaugural Boca Raton Bowl on Tuesday evening, 52 - 23. The game’s MVP, senior quarterback Rakeem Cato, finished the Herd’s 13th win of the season with 281 yards and three passing touchdowns. Cato also scored two rushing touchdowns. Wide receiver Tommy Shuler caught Cato’s first seven passes and finished with 18 catches for 185 yards, one touchdown and the C-USA record for most career receptions with 321. The game drew a crowd of less than 15,000 in Florida Atlantic’s 30,000-seat stadium, but Marshall’s head coach, Doc Holliday praised the inaugural event. “This will be a huge bowl,” Holliday said. “The community has embraced this bowl, and when all is said and done, it’s going to be one of the best bowls in America.”

Reese Witherspoon rules! Who knew this tiny, pretty, girly-girl was such a warrior woman? I sure didn’t until I saw “Wild,” which Witherspoon produced and stars in as Cheryl Strayed. Strayed was a troubled woman who dropped out of everyday life and embarked on a 1,100-mile hike, which she chronicled in her memoir “Wild: From Lost to Found on the Pacific Coast Trail.” British novelist Nick Hornby (“About a Boy”) adapted the book for a screenplay directed by FrenchCanadian Jean-Marc Vallee (“Dallas Buyers Club”). Cheryl Strayed’s dropout was trigged by two events: the breakup of her marriage and the death of her beloved mother Bobbi, played by Laura Dern. Oh, there were a couple of other things too. Cheryl got into alcohol and drugs and “graduated” to shooting heroin. She became sexually promiscuous as well. In short Cheryl was a mess at the outset of her ill-prepared journey. “Wild” is a visually gorgeous film, and Reese Witherspoon is not bad to look at either. Reese is only 61 inches tall, and she probably doesn’t weight more than a large sack of flour. It is pretty funny watching her struggling with a ridiculously huge backpack (she calls it “Monster”) that is just about as big as she is. Reese cheerfully swears like a sailor, bares her body and reveals a bit of her soul in her scenes with Laura Dern, whom I have always loved. It’s

nice to see her get a decent role, and it does not get much more tragic when a battered, ever-sunny woman suffers and dies of lung cancer at the young age of 45. Dern is only nine years older than 38-year-old Witherspoon, but she has the sacrificing mom thing down beautifully. Cheryl Strayed is an avowed feminist, which does not mean she hates men. However, all but a handful of the male characters in “Wild” come off as rotters. The worst of the lot is Cheryl’s alcoholic, abusive stepfather. On the other hand is her endlessly patient, tolerant ex-husband Paul (Thomas Sadoski). In the end “Wild” is a joyful journey from the depths of depression and self-destruction to the highs of amazing physical endurance and triumph. Rating: 1/2

DIVORCE FLORIDA STYLE

When The Difficult Way Is The Easiest Something about the human psyche prefers the path of least resistance, the easy way, the course that requires the smallest investment of blood, sweat and tears. But history teaches that “quick and simple” is rarely the avenue for achieving lasting success and significance. In the realms of entertainment and art, we often hear about the “overnight success,” the person that was a virtual unknown one day whose name was on the lips of everyone the next: the breakout star of a major motion picture; a singer soaring to the top of the music charts; an author whose book gains widespread public acclaim, turning her into an instant celebrity. But we all know that even though a person may go from being unnoticed to stardom in the blink of an eye, much effort, struggle and preparation were invested to make that “overnight success” possible. My friend, Gary Highfield, is a great example. In his book, When “Want To” Becomes “Have To!”, Gary details a very difficult childhood, including some heart-wrenching experiences. As a young adult with a wife and three children, he had a dead-end, hourly wage job, barely scraping by. He wanted a better life for his family, and then his “want to” became “have to,” starting an ambitious self-improvement program. Gary’s book not only tells his personal story, but also presents many of the principles and wisdom he gained over the years through hard work, determination, a refusal to quit – and the grace and timely provision of God. His path was difficult, but he refused to accept failure and the seemingly easier alternative of resigning himself to being a “victim” of his circumstances. In the process, Gary’s career transformed
from frustrating, unfulfilling manual labor to great success in sales and entrepreneurship. Today many disadvantaged people are being promised “entitlements,” but he understood his true entitlement was to utilize the talents and abilities God had built into him to realize his personal and professional goals and dreams. Today he seeks to help others in similar circumstances. The Bible speaks a lot about this, both in workplace and spiritual terms. Here are some examples: Sufferings serve to strengthen us. Hardships can build endurance, just as years of training equip top athletes to perform at championship levels, far beyond their peers. “…but we also rejoice in our sufferings, because we know that suffering produces perseverance; perseverance, character; and character, hope. And hope does not disappoint us …” (Romans 5:3-4). No such thing as a “quick fix.” Many people want instant success, rewards without the struggle. But often formulating a plan, even if it takes time and overcoming challenges to carry out, can serve as a reward in itself. “Steady plodding brings prosperity; hasty speculation brings poverty” (Proverbs 21:5). Struggles shape and refine us. A caterpillar faces great difficulty escaping the cocoon after turning into a butterfly, but its struggle is rewarded as it flies majestically through the air. Similarly, hard work refines us into who and what we are to become. “Consider it pure joy, my brothers, whenever you face trials of many kinds, because you know that the testing of your faith develops perseverance. Perseverance must finish its work so that you may be mature and complete, not lacking anything” (James 1:3-4).

What’s a Changing Lien? Q.
I have been on the middle of litigating a divorce case against my husband for about a year. It seems that every day we invent a new issue to argue about. We argue about what assets are marital or not, appreciation of those assets, alimony, child support and legal fees. While I like my attorney I began to think that she was nowhere as sharp as my husband’s attorney. I hired a new attorney a couple of weeks ago and dismissed the other. A few days ago my new counsel received a “Notice of Charging Lien” from my past counsel which asked for about $60,000.00 in fees and costs, such as accounting costs. My new attorney and I went over my first retainer agreement and charging liens are explained as a lien for a lawyer’s fees on what I ultimately win in the divorce case. My new attorney does not think that my old attorney will be successful in claiming a charging lien but says I will probably have to work out a settlement with the old attorney sooner or later. I don’t understand. What do you think?
A.
Your old attorney has two avenues to use to sue you for her fees and costs. Even if there was no right to a charging lien against the proceeds of the divorce case in the retainer agreement your old attorney could file a breach of contract law suit for your refusing to pay the fees and costs contracted.
Depending upon the terms of the retainer agreement you old lawyer might be able to recover his legal fees and costs. Under you contract however you old attorney would not have a lien on your property until she sues you for contract damagers and a judgment is rendered in her favor. Contract cases in circuit civil court take much longer to process than to charging lien cases. Charging lien motions are tried in family court, in front of the judge who heard, or remains hearing your divorce case. Your old attorney would have to prove that his retainer agreement properly allowed a charging lien, and, more importantly, that her work on the case in whole or in part won assets subject to a lien. The property subject to a charging lien can be marital property that you retained, or property that you were given from marital assets which were titled in the name of your husband. Alimony and child support are not subject to charging liens. As a victory in child issues are not monetary and no lien can exist on these rights. Your old lawyer’s problem in a case like yours is to prove that she substantially contributed to a result which was not attained until long after her termination. She would have to wait until your main case is completed which she would not have to do if she sued in the civil division of the court. It might be best to try to negotiate a discount of the fee, especially if you have the funds to make a reasonably substantial payment immediately.

Bruce’s of Great Neck is Restaurateur To The Stars in West Boca
Bruce’s of Great Neck was founded in 1976 on the “Gold Coast” of Merrick, Long Island. After several years of operation, Bruce’s expanded to Roosevelt Field, Long Island. In 1983, Bruce decided that Great Neck, NY, would be the perfect place to sell the high-quality line of baked goods. Expanding the concept to a full service restaurant, Bruce’s became a “one-of-a-kind” operation. It had something for everyone from cinnamon raisin bobka french toast, nova platters, to gourmet panini’s. Over the years, a complimentary, basket of fresh baked goods had become their trademark and tradition. President Bruce Zipes believed in the “word of mouth” advertising and that satisfied customers would spread the “word” around town. He only uses the highest quality ingredients and standards to meet the high expectations of his customers at his famous restaurant and bakery. sports Rakeem Cato ties TD mark as Marshall wins Boca Raton Bowl
BOCA RATON, Fla. -Quarterback Rakeem Cato and receiver Tommy Shuler have played together since high school, so they were able to communicate without a lot of conversation Tuesday in their final game for Marshall. "We don't need to talk," Shuler said. "Just a head nod." What does a head nod mean? "I'm open." He was, time and time again. Shuler and Cato capped their careers with record-setting performances in the inaugural Boca Raton Bowl to help Marshall beat Northern Illinois 52-23. Cato tied an NCAA mark for touchdown passes, threw for three scores and was voted the most
valuable player. Shuler had 18 receptions for 185 yards and broke the Conference USA record for career catches with 322. Cato and Shuler were high school teammates in nearby Miami, and they gave a large throng of family and friends plenty to cheer about. "To do that playing your final game in your backyard is special," Marshall coach Doc Holliday said. "They're just tremendous players, and they're great friends." Marshall finished 13-1, with its lone loss to Western Kentucky, 6766 in overtime. Northern Illinois finished 11-3. "Give credit to Marshall; they made a ton of plays," Huskies coach Rod Carey said. "I didn't think we
played real well, and that's too bad because we've had an unbelievable season." Cato extended his streak of throwing at least one touchdown pass to 46 consecutive games. That tied the NCAA all-division record set by Central Washington's Mike Reilly. As usual, Cato's favorite target was Shuler. "Anybody who knows Shuler, against a man-to-man matchup, he's going to hurt you," Cato said. "I'm going to continue to go at him until they show me something different, and they didn't show me anything different." Cato finished the season with a school-record 40 touchdown passes. He threw for scores of 6 yards to Shuler, 11 yards to Angelo Jean-Louis and 27 yards to Deon-Tay McManus. All of those touchdowns came in the second half. Cato completed 25 of 37 passes for 281 yards and ran 5 yards for a score. "Cato made the plays when he needed to," Huskies safety Dechane Durante said. The game drew a crowd of less than 15,000 in Florida Atlantic's 30,000-seat stadium, but both coaches praised the inaugural event. "This will be a huge bowl," Holliday said. "The community has embraced this bowl, and when all is said and done, it's going to be one of the best bowls in America." Marshall tried a bit of trickery early in the game, when Shuler
took the ball and lobbed it into the end zone to Cato for an 11-yard touchdown. But the play was negated by a penalty. "If Tommy wouldn't have made such a bad pass, we would've had it," Holliday said with a grin. The tandem did better with Cato throwing. All seven of his completions in the first half went to Shuler. "He made tough catches and easy catches and made people miss," Carey said. Cato wore No. 31 instead of his familiar No. 12 to honor teammate Evan McKelvey, who sustained a season-ending knee injury in October. Deandre Reaves scored Marshall's first touchdown on a 93-yard kickoff return. Devon Johnson ran for 131 yards and a score for the Thundering Herd, who totaled 505 yards The Huskies' Drew Hare threw for 225 yards and a score, and they added 200 on the ground. They outgained Marshall in the first half but trailed 24-13 because they settled for field goal tries three times and missed one. Northern Illinois pulled off a successful onside kick to start the second half but lost the ball four plays later when Arnold Blackmon stopped Cameron Stingily for no gain on fourth and 1 at midfield. The Thundering Herd mounted touchdown drives of 56, 68 and 70 yards on consecutive possessions in the second half to lead 38-20. The win gave the Thundering Herd bowl victories in consecutive seasons for the first time since 200102.
