OWNER COMMUNICATIONS REPORT FALL 2020
BOMA Georgia’s Impact
Advocacy Prior to the global pandemic, 2020 was already shaping up to be a busy year on the advocacy front. When COVID-19 began dominating the news cycle and calls to flatten the curve were made by our elected officials, large parts of the industry observed tenant populations leaving buildings to work from home. There was much concern in the early days of the pandemic about the ability of property management teams to continue to operate and maintain the essential assets in their charge. BOMA went to work on the advocacy front immediately. COVID-19 Beginning with Georgia Governor’s March 14 declaration of a public health state of emergency, BOMA began work right away to ensure that the Governor’s first executive orders ensured that commercial real estate professionals to be deemed essential workers to protect Georgia’s built environment—your assets. The association also worked alongside the tort reform coalition to advocate for liability protections to support a strong economic recovery for Georgia. The legal safeguards found in Georgia’s Senate Bill 359 helped provide certain immunities from liability claims regarding COVID-19. One of the main features of the “Georgia COVID-19 Pandemic Business Safety Act” is a rebuttable presumption of assumption of the risk by a claimant that exists if signage containing certain language is posted at a point of entry on the premises.
The emergence of COVID-19 onto the world stage has had a significant impact on the commercial real estate industry. The pandemic has changed the way commercial real estate assets are operated and maintained. Through it all, BOMA Georgia and the BOMA Georgia Foundation have been at the forefront helping real estate industry professionals navigate both the challenges related to the COVID-19 pandemic, as well as other emerging trends. Since the pandemic began, we have produced nearly 100 free webinars, videos, articles, foundation reports, and more to help real estate professionals respond to and lead through this challenging time. Despite these challenges, BOMA remains essential to success in the real estate industry. In this report, we will highlight the variety of work that BOMA has been doing to support the advocacy, COVID-19, and the professional needs of your employees and assets.
of Senate Bill 451 that clarified that the statue of repose does not limit the constitutional freedom to contract beyond eight years. Until the bill’s passage, this freedom had been jeopardized by a recent ruling of the state Supreme Court in Southern State Chemical, Inc. v. Tampa Tank Welding Inc. Staying Engaged The association remains engaged on many other important issues that impact the commercial real estate industry. BOMA Georgia remains committed to supporting business friendly policy and will remain engaged in the ongoing conversations around tort reform, private property rights, parking enforcement, transportation, codes, and tax reform.
