Highroad Can’t America do better than today’s ripoff health care system?

ather than a health care system, our country’s leaders have kept us shackled to a “corporate care” system, allowing insurance giants, drug company gougers, hospital chains and other profiteers to ration our care based on whether a family can pay whatever outrageous price the corporations demand to maintain their exorbitant profits.

While the guiding ethic of physicians, nurses and other caregivers is “First, do no harm,” the corporate owners of the system impose a contrary ethic: “First, maximize our profits.”

Thus, despite Americans spending some $3.2 trillion a year on health care, more than any other country in the world, 28 million of our people have no health coverage; tens of millions are so underinsured they can’t use the policy they’re paying for;

one out of five adults can’t afford prescription drugs they need; our people are less healthy than other advanced nations (for example, the U.S. ranks 42nd in life expectancy); and CEOs and top shareholders of the system are hauling off multiplemillions of dollars each.

Can’t we do better than that? Of course we can — if we start treating health care as a human right, rather than a corporate profit center.

And doing this doesn’t require a whole new complex system. Congress can just extend America’s successful Medicare program to every man, woman and child in our country. This egalitarian “Medicare for All” idea would deliver comprehensive care, be much easier for patients to navigate, and be far cheaper than today’s rip-off system. At last, a hospital stay would not bankrupt a family, people wouldn’t avoid going to the doctor because they can’t afford it, prescription drugs would be affordable and workers wouldn’t be stuck in bad jobs just to get basic health coverage.

It’s sort of a confusing concept because right and wrong can be very different depending on how you see the world. Patriotic people in other places who support their countries doing things that we in the U.S. find abhorrent — like cutting the hand off a hungry child who steals a piece of bread — are still patriots so long as they believe what their country is doing is good and correct and offer their vigorous support. It really all boils down to one’s definition of “country.”

Obviously the term “country” within the context of this definition isn’t describing geographic location. We don’t fly flags, proclaim our love for, or our willingness to die for, our country because of where it is located on a map.

In the United States of America, any patriot worth his or her salt will tell you that all the things they vigorously support about our country were breathed into existence by our beloved Constitution.

Unfortunately, many, if not most, of those now shouting the loudest about their support for our flag and national anthem have more in common with the hand choppers and stone throwers than with our country and its ideals of freedom and equality.

Let me put it another way: There is actually nothing less patriotic, in this country, than putting the importance of the flag — a piece of cloth created to be a powerful symbol representing all of the individual rights and freedom granted to us by our Constitution — above the importance of the actual rights and freedom it stands for. I can’t think of anything more disrespectful to our veterans than to claim that they fought and died for a piece of cloth rather than for the freedom it symbolizes.

Let me put it in the vernacular of today’s hyper-patriots: If you believe that the First Amendment rights of all Americans does not include the right to say what they want about the flag or protest the behavior of the president or law enforcement practices in any peaceful manner they choose, including during the playing of the national anthem, then you have become the enemy within, the very thing you claim to be standing vigilant guard against.

Those who applaud President Trump as he uses racism, classism and a brand of patriotism that is disconnected from our Constitution to divide our country are the true offense to the values and freedom our flag and national anthem stand for. All who back Trump in his calls for the punishment of U.S. citizens who have done nothing more than exercise their Constitutional rights in a peaceful manner may be patriotic, but their vigorous support is aimed at a “country” that has nothing to do with this country or its Constitution.

We have become a nation with 100 million Archie Bunkers on the prowl, one of whom now occupies the White House. While Trump may have turned our government into a sitcom, unfortunately, this time around it’s not a comedy.

I wish I could persuade even one Boulder Weekly

person who thinks that professional athletes, particularly black athletes, should lose their jobs for exercising their First Amendment rights that such a belief is an incredibly unAmerican idea, but I don’t think I can. Thanks to our increasingly dysfunctional political system, wherein party politics has made getting reelected more important than gover-

nance, and a media landscape where sensational tweets and telling us what we want to hear based on our political persuasions has replaced a true commitment to making sure we are a well-informed citizenry, our understanding of what “country” means has become lost. Too many people now confuse our “vigorous support” for Democrats, Republicans, flags,

anthems, race, Fox news, MSNBC or the President with that of support for our country and the Constitution that guides its principles of freedom and equality for all. What is being practiced today may still be patriotism by definition, but it is definitely not the good kind.

The first sighting occurred in February, when a band of them known as Crestone Peak Resources filed a Comprehensive Drilling Plan (CDP) application with the Colorado Oil & Gas Conservation Commission (COGCC to its friends) for a drilling campaign in Boulder County.

The plan called for drilling 216 wells on a 12 square-mile parcel of land east of U.S. 287 between Quail and Oxford roads extending to the BoulderWeld County line, most of which is Boulder County-owned open space.

A miasma of icy dread gripped the County Courthouse. Ashen-faced, the County Commissioners announced that they would “monitor the situation closely.”

Then, on Sept. 11, word of a second Roughneck sighting at COGCC reached Boulder County — a band called the “8 North LLC, a Subsidiary of Extraction Oil and Gas, LLC.” It applied for a “drilling and spacing unit order” on two parcels, 1,280 acres along the Boulder-Weld County Line between Arapahoe and Baseline Roads, and 2,720 acres along the BoulderWeld line between Quail and Oxford Roads. (The latter parcel appears to overlay the eastern part of the land in Crestone Peak Resources CDP application, suggesting the two Roughneck bands are cooperating.)

Yikes squared.

This new proposal prompted the Commissioners to raise the threat level from “Closely Monitoring” to “Chicken Little-ing.”

They swiftly issued a statement averring that they 1) were “gravely concerned,” 2) had “reached out” to the mayors, councils and staff of Lafayette, Longmont and Erie, 3) were keeping “our website up to date” regarding oily and gassy stuff, and 4) would oppose the drilling and spacing applications when they come up for a hearing before the COGCC, and urged concerned residents to do the same.

Wow. Grave concern... reaching out... up-dating the county website... opposing the applications at the hearing... this is pretty heady stuff. It’s practically inevitable that someone is going to fire off a sharply worded note or

issue an angry press release, and then who knows where it will all end. But hey, extreme situations call for extreme measures.

Chicken Little mode is an apt metaphor for what’s going on here. That’s because what’s happening is the chickens are coming home to roost.

In 2015, the Colorado Supreme Court ruled that serial moratoriums on oil and gas drilling like the ones the Commissioners imposed in the County were illegal, but the Commissioners did buy the county five years to prepare for the coming of the Roughnecks.

Which it wasted.

The only substantive thing they did was rewrite the County’s oil and gas regulations, whose reach is sharply limited by state law.

Under Colorado law, almost all of the power to regulate oil and gas production — and fracking — rests with the state. A county government’s regulatory say is pretty minimal.

The local anti-frackers have been shrilly demanding that the Commissioners ban oil and gas production in the County. Well, they can’t. The demand is dishonest and made in bad faith and the anti-frackers know it.

But that doesn’t mean the Commissioners were without options.

Here are a few of the things the Commissioners could have done during the five wasted years: 1) The Commissioners could have used existing County open space revenues to buy mineral rights near the subdivision and natural areas most likely to be most impacted by drilling. Or they could have used the revenues to incentivize oil companies to locate well pads further away from those areas.

2) The Commissioners could have proposed an “underground open space program” modeled along the lines of the existing open space program and asked voters to approve a new tax to pay for it. That would have allowed the County to have substantially reduced the impact of new oil and gas development before it began in earnest. (A tax vote would also reveal just how deep anti-fracking sentiment runs in the County.)

I saw the new Al Gore movie An Inconvenient Sequel: Truth to Power and was moved to write. Mr. Gore’s movie was very well done and I am glad he showed the politics involved. We do need to strive for 100 percent renewable energies. I’m disappointed that he did not spend any time on the many simple things we can do right now as conscious consumers.

Eco-Cycle says 42 percent of our greenhouse gases come from how products are made, transported, used and gotten rid of. They go on to say striving for zero waste is one of the quickest and easiest ways to fight climate change.

I attended Mr. Gore’s Climate Reality Project training this past March.

I left there with so much optimism as he assured us coal is not coming back and renewable energies and efficient cars are becoming more and more affordable. But consider each of our personal carbon footprints.

I read a recent article that shared some statistics released by the Yale Program on Climate Communication on public views of global warming gathered in 2016 showing 70 percent of Americans believe global warming is happening, but only 40 percent of Americans believe climate change will affect them personally.

If it’s not affecting me does that mean I can just sit back and do nothing?

we are leaving the next generations. Eat local food, bank local, turn lights off, hang-dry clothes, use less plastic bags, bottled water and single use plastic in general. Use a real coffee cup; take Tupperware for leftovers. We are so used to being a “disposable society” we don’t realize what we are doing!

Recycle and compost are good but reduce and reuse are so much more important.

The White Supremacist element within Donald Trump’s “America First” catchphrase gained impetus with the election of Barrack Obama and the appearance of numerous brown-skinned faces in high positions of government. This augmented as well the growing, primarily white, libertarian, anti-government movement. On Conservative talk radio, all things Obama became evil incarnate. The acquittal of George Zimmerman in the confrontation and killing of Travon Martin as well as that of the armed occupiers of the Malheur Wildlife Refuge further emboldened the sense of white male superiority that propelled Trump, in a brazen show of power, into the presidency.

amount of its open space. Oil companies currently produce oil from wells on existing leases that they hold on this land and the County receives royalties on the production. (The County didn’t issue the leases; it inherited them when it bought the land.) The Commissioners could have used the royalties from these leases to buy mineral rights under land on which it doesn’t want to see drilling. And those revenues could have been several times larger than they actually were if the County hadn’t blocked companies from drilling new horizontal wells on their existing leases.

4) The Commissioners could have taken the next step and cut some deals with the oil companies granting new leases on county open space in return for a much greater say in where and how production takes place.

5) The Commissioners could have come up with some creative proposals for curbing one of the most disliked impacts of oil production, the flaring of natural gas. They could have put some public dollars toward installing gathering lines that would allow the gas to be used for a public purpose instead of flared, like heating CU’s new hospital on East County Line Road, maybe, or alternatively, toward installing fuel cells on the drilling pads to turn the waste gas into electricity.

In other words, there is a lot the Commissioners could have done, and still could do, to reduce the impact of oil and gas production on both the environment and those living near it, if they had the wit and the will to do it.

Which, self-evidently, they don’t.

LAST SUMMER, Bill Davis, a 35-year-old father of three and Google employee, was riding his bike with a friend near the intersection of Jay Road and 30th Street in Boulder. A drunk driver swerved into the bike lane and struck Davis. He died of his injuries.

Bill Rigler, chairman of Boulder’s Transportation Advisory Board (TAB), was Davis’s friend, and he says the accident not only caused ripples in the cycling community, but also among those in the City and County who help shape transportation safety laws.

“Our community was really rocked by the tragic hit-and-run of Bill Davis by a drunk driver,” Rigler says. “The woman who hit and killed him had multiple driving infractions for impaired driving. Ever since July 2016, the [TAB], for reasons that were symbolic and practical, put safety at the top of our agenda.”

Dave Kemp, City of Boulder senior transportation planner, says the Davis incident, plus another incident at Arapahoe and 28th Street where a tractor-trailer hit and killed a cyclist riding in his blindspot during a turn, were hard to avoid.

Education can help some in such instances, but neither better infrastructure nor enforcement can prevent those types of accidents, Kemp says, which he stopped short of calling “anomalies.”

Yet, doesn’t it seem like these kinds of accidents pop up all the time in local

headlines? Search online and you’ll get a stream of accident reports between cyclists and vehicles from Sunshine Canyon to Longmont to way east Arapahoe, all with datelines in 2017. An 82-year-old cyclist was struck on Jay Road this month. Last month, a cyclist skidded into a stopped car on Lee Hill Road. In May, a cyclist was killed on Nelson Road, west of Longmont.

The list goes on and on.

“It’s really good that the Daily Camera has begun to pick up on and put out information that these crashes are occurring. ...

I think that’s kind of a change,” Kemp says. “They hadn’t paid much attention to that in the past. And I think from a public notification standpoint, it’s good to note that this stuff is happening, ... but the downside to that is that we don’t want to make it look like our community is unsafe, because it really isn’t unsafe.”

Talk to City or County officials, and to cyclists, and no doubt you’ll hear about the perception that bicycle and car collisions have increased in Boulder County. But what’s really happening out there — and who’s to blame?

The conversation comes at an appro-

priate time. Boulder City Council reviewed plans for changes to regional transportation this week, and TAB, in conjunction with RTD and Boulder County, will hold a public hearing on Oct. 9 about ways to improve dangerous cycling areas such as U.S. 36 north of Boulder and Diagonal Highway. As these city, county and state transportation officials prepare to upgrade key bike and road corridors, local officials are using hard data regarding such accidents (and the psychology of why these crashes occur) to determine the future of Boulder County’s cycling infrastructure.

WHAT COLLISIONS ARE HAPPENING?

T

he City of Boulder, with information from the Boulder Police Department (BPD), issued a report last year, “Safe Streets Boulder,” which identified key statistics about the rate at which cyclists and pedestrians collide with cars.

Between 2009 and 2014, there were approximately 3,275 collisions involving cars, pedestrians or cyclists reported to BPD. Although only 8 percent of those crashes involved a cyclist or pedestrian, they comprised 60 percent of all serious injuries and deaths. Last year alone, there See CRASH Page 12

were more cyclist and pedestrian deaths than in the previous four years combined. And most of those collisions, the data found, occurred in crosswalks.

“What that indicates to me is that for all of our talk about being this Mecca for cycling and promoting alternate modes of transportation, the reality is if people don’t feel safe riding their bike, they’re going to drive,” Rigler says.

Kemp says death and serious injury is “overrepresented” in the data; that is, the 60 percent rate of injury needs to come down, but that the overall number of accidents is consistent with previous years. Given that the majority of accidents occur in crosswalks, which are designed to protect those traveling outside cars, Kemp says preventing serious incidents comes down to people paying attention.

“Pedestrians are responsible for making sure they push the flashing yellow buttons. Bicyclists, when they can travel fast through the intersection, a lot of times they’ll look at the crosswalk as, ‘This is my safe zone’ and run blatantly through the crosswalk. ...

Then the other piece is on the motorist, which is [to yield] to cyclists or pedestrians in the crosswalk,” Kemp says.

Some of the more treacherous intersections, the study found, are near the CU campus. Baseline, between Broadway and 30th Street, for instance, had 34 collisions between 2012 and 2014. Other dangerous stretches included east campus (30th Street from Colorado to Arapahoe) and downtown (Broadway between Canyon and Spruce).

Last year, there were 203 collisions between cyclists and cars, with 28 serious injuries reported in the City of Boulder. That’s an eight-year high for the city, although the totals in previous years are no less than 166 collisions.

But many cyclists say dangerous stretches — perhaps the most dangerous stretches — exist outside city limits. Alex Hyde-Wright, Boulder County transportation planner, says when it comes to collision rates, they’ve seen a trend similar to Boulder throughout the county.

“It’s good that [collision rates are] not rising substantially, but it’s also bad that we haven’t really started to drive [them] down in a significant fashion,” Hyde-Wright says.

The state highway system through Boulder County is the most plagued by cyclist-car collisions, Hyde-Wright says, from U.S. 287 to the Diagonal Highway to U.S. 36, as well as Boulder Canyon and Lookout Road.

Rigler says he’s experienced the treachery of U.S. 36 between Boulder and Lyons first-hand.

“I was on U.S. 36 three weeks ago, and we were biking past an accident scene that had happened maybe 20 minutes earlier and the cops and road crews were trying to brush out the blood that was on the street,” Rigler says, explaining that the Colorado Department of Transportation (CDOT), which owns the road, should turn an eye toward improving safety there. “[Upgrades] could be improved signage encouraging people to 12 September 28, 2017

Rights of nature lawsuit seeks personhood for the Colorado River

ow to govern water resources in the West has been a contentious issue since Europeans first started settling the land, and the Colorado River has been at the forefront of the debate for more than a century. As more and more people populated the arid regions of the American Southwest, the idea of “first in time, first in right” emerged as the ruling principle for allocating who could take water from streams and rivers, and when. In Colorado, these water rights were tied to property rights, but by the 1890s many stream and river systems in Colorado were over-appropriated and a complex legal system for settling water disputes emerged.

Now, the very premise of this system is being challenged in court. A new lawsuit filed in U.S. District Court in Denver on Sept. 25 is asking a judge to treat the Colorado River as a person rather than property, therefore recognizing its right “to exist, flourish, regenerate, and naturally evolve.” It makes the argument that if corporations in the U.S. can be granted the same rights as people, shouldn’t rivers be allowed that status as well?

The Colorado River as an ecosystem is the plaintiff in the case, with members of Deep Green Resistance, an environmental activist group, listed as guardians or next friends, acting on the river’s behalf. And it sets the State of Colorado as the defendant, seeking to set precedence for future lawsuits that could hold the government responsible for certain actions, or inactions, that have caused the river harm.

“Normally in environmental law you have to show how some sort of action, be it state action or a corporate action, injures a human being,” says Denver attorney Jason FloresWilliams, who filed the case on the river’s behalf. “Even though we know at this point scientifically that injuries to the environment are injuries to human beings, the law hasn’t caught up to it yet.”

The suit is based on the rights of nature philosophy, a growing movement in environmental law that hopes to establish the inherent rights of the natural world to exist and flourish independent of human ownership or use. Although the idea has been around for decades, it has gained momentum in recent years as climate change and other human factors increasingly threaten entire ecosystems.

“There’s a growing understanding that environmental frameworks that exist today under environmental laws are not adequate to protect the environment,” says Mari Margil, with the Community Environmental Legal Defense Fund (CELDF), which is acting as legal advisor in the case. “They begin from the wrong place, the wrong premise, that nature is treated as right-less, as property, and therefore we can’t even protect its basic right to exist let alone to flourish.”

By authorizing the use of the natural environment, Margil says, existing environmental laws, such as the Clean Water Act, actually are “legalizing environmental harm.” Therefore, these laws are lacking in their attempt to actually protect and preserve the natural world, she argues.

“We’re seeing ecosystems collapse, species extinction, and the acceleration of climate change,” she says. “We’re seeing environmental decline around the world even in the face of all these environmental laws that are purported to protect the environment.”

the country and the world to establish rights of nature laws over the past decade, many of which are cited in the The Colorado River Colorado River case. Other cases in Colombia, New Zealand and three dozen municipalities in the U.S. have implemented some sort of rights of nature policy, including the City of Lafayette, which passed its Climate Bill of Rights in April. Earlier this year a court in India declared that the Ganges and Yamuna Rivers are legal, living persons.

Rights of nature advocates acknowledge giving the Colorado River personhood would be a paradigm shift for water law in Colorado, but a necessary one.

“If you look at the Colorado River today, we’ve over-promised,” Margil says. “There isn’t enough water to fill the property rights that people, that governments have to that water.”

While the Colorado River used to flow for 1,450 miles starting in the Rocky Mountains, it rarely reaches the Pacific Ocean near Sonora, Mexico, anymore. Although the 1922 Colorado River Compact, which allocates water to seven Southwestern states, requires a minimum flow of 15 million acre-feet, the annual average is now below that.

Plus, new research out of the University of Arizona and Colorado State University estimates there will be an additional 30 percent further decline in the river’s volume by 2050 due to climate-change-induced drought. Not only does this threaten multiple animal and plant species that depend on the river for survival, it threatens the nearly 40 million people and 4 million acres of American and Mexican cropland that also depend on the river’s water.

“We need to change how we govern our own behavior towards the natural world,” Margil says. “It’s really about codifying into law, therefore into practice, the steps we must take to live sustainably with the natural world upon which we depend.”

And part of doing that is equaling the playing field, Flores-Williams says.

Establishing the river as a person, an entity with rights, would put it on par with corporations, which have long controlled the legal system with their vast financial resources, he argues, and which have in many ways added to the river’s degradation, with little legal recourse, he argues.

“This is simply a pragmatic solution. If you believe in science and take a rational, reasonable look at what’s happening in the environment in this world, it’s hard for me to imagine that law would simply want to be silent and have nothing to say about it,” Flores-Williams says.

Granting the river the same rights as a person “gives the courts a tool to be able to address [environmental] injuries,” he adds.

The State of Colorado declined to comment on the lawsuit, but water-rights owners and critics of the rights of nature approach argue that taking the current system and turning it on its head would unravel more than 150 years of water law without a clear path forward.

“The basic fundamental [premise], that an individual, a person or a city or a municipality can have a property right to use the water for beneficial use is key to our water law in the state of Colorado,” says Don Shawcroft, president of the Colorado Farm Bureau. In Colorado, agriculture accounts for 90 percent of the state’s water use, and farmers own a majority of water rights. “The biggest danger is that if you establish that a river has a right, then who is going to determine Boulder Weekly

what that right is?”

The net result would be more lawsuits, says Doug Kemper, executive director of the Colorado Water Congress, a Denver nonprofit representing water users throughout the state. “The practical effect would be, someone’s going to have to make decisions on water projects [and] what you’re going to end up doing, in my opinion, is you’re going to end up having the courts just making all the decisions, which is not very effective.”

Establishing that the river has rights in and of itself, while also holding the State accountable for its harm, leaves too many questions unanswered, Kemper says.

“I don’t know as though we’re really clear as to what the true outcome of that means.

Does that mean water quality standards are going to change? Is permitting going to change?”

Critics of the lawsuit also argue it could also undermine the reliability of our water system and cause uncertainty for water providers and users throughout the state. Plus, it has the possibility of violating the state constitution, if water-rights owners aren’t properly compensated.

“A lot of it quite frankly does in fact go back to this concept of reliability. It’s been since even before 1876 when the state was established that individuals filed for a water right to use water in a specific way from a specific stream,” Shawcroft says. “That reliability has value to it. Any change that would come back would diminish that value, would certainly be a taking of value and at least the guarantee of the constitution that even public entities can’t take something away from you without compensating you for that loss in value.”

Furthermore, Shawcroft adds, the rights of nature concept has little legal standing and has been rejected by courts in various forms already. He doesn’t expect this latest case to go any differently.

He does acknowledge, however, that water scarcity issues are a concern in the West, especially for farmers and ranchers who see water and land resources as integral to an entire way of life. He remains optimistic that humankind can figure out how to meet our demand for water within the current legal system, pointing to the use of desalination technology in other arid climates like the Middle East. But methods such as this aren’t without challenges either, as examined in the first installment of this series (“The new gold rush, Part 1,” Sept. 14 ). The use of water markets is another approach, Shawcroft says. Although this approach is still based on the fundamental premise that water is a commodity that can be bought and sold, not an entity that has rights in and of itself.

“Whether or not our legal system recognizes that nature has rights, it does,” says Grant Wilson of Earth Law Center, and also a member of Boulder Rights of Nature (BRON), a citizens group advocating for rights of nature laws in jurisdictions throughout Boulder County. He is not involved in the current lawsuit, but works on similar campaigns throughout the world.

The rights of nature approach to water is not advocating for rivers to go untouched and water unused, or for nature to “revert back to something that’s already gone, which is a natural state of the world,” he says. And it’s not about prioritizing the health and well-being of the river ecosystem over that of humans. Rather, it’s a rebalancing of resources so that both the basic needs of humans and ecosystems are met. The two aren’t mutually exclusive, Wilson argues.

“I think if you look at any environmental area where it’s been majorly degraded, it’s impossible to separate the health of nature with the health of humans,” he says.

“Pollution in water is harming people’s health in communities. Lack of water because it’s used irresponsibly means some communities don’t have it. If we manage it responsibly and have adequate supplies of clean water through the rights of nature approach, it will benefit human health.”

If the Colorado River were granted personhood through this lawsuit, humans would still need to be involved in its management. In other countries like India and New Zealand where rivers have been given these rights, the courts have appointed a permanent legal guardian to protect the river’s interests, and one could expect a similar approach in the U.S. Wilson for one, would advocate for Native Americans to hold this role, as the rights of nature approach is based on indigenous people’s relationship to the natural world and they have traditionally relied on the Colorado River long before Europeans settled the West.

Although the environmental laws of the 1970s had their time and place, it’s time for our legal system to evolve as our understanding of ecological health and environmental crises grows, he says. If the U.S. District Court rules in favor of the Colorado River in this case, it would be a major step toward establishing rights of nature throughout the U.S. But it would also guarantee the continued existence of the river and its ecosystem on which humans depend, he argues.

“It isn’t what some people fear, which is that rivers will be untouchable, pristine, off limits areas and that humans are going to suffer. I think it will be a rebalancing and a period of adaptation,” Wilson says. “And people will find that their needs are still being met and the well-being of rivers will be improved and they’ll be happy about that for themselves, and their children and future generations.”

s the sky really falling this time? It has fallen before — after the Holocaust and Hiroshima, the assassination of JFK, RFK and MLK, the war in Vietnam, Kent State, Watergate, Black Monday, Enron, 9/11, Shock and Awe, Bernie Madoff, the Great Recession. Now in the second decade of the 21st century, climate change, terrorism, widening wealth inequality and fake news are clamping down on our consciousness. We need to discover new ways to bend entropy, befuddlement, and violence toward beauty, health and peace.”

So writes Woody Tasch, founder and chairman of Slow Money, a nonprofit formed in 2008 to catalyze the flow of investment capital to small food systems through low-interest loans (i.e., investments).

He’s likely written these words in his forthcoming book, SOIL, from his home on two acres in the foothills of Boulder. From his window he can see a meadow, several rock outcroppings and swaths of pine trees, his bucolic slice of life standing in stark contrast to the maelstrom he describes.

But it’s precisely this space between big system problems and the earth beneath our feet that Tasch insists on inhabiting, not yet convinced that there is nothing we can do about the litany of problems we face.

SOIL, Tasch says, is a humble attempt to put Wendell Berry’s poetic spirit into an economic framework.

break out of our old, broken ways of thinking and start prioritizing the local food system, soil fertility, all the things we want to support until numbers get in the way because they just aren’t capable of garnering the same degree of return on investment.”

With SOIL, Tasch seeks to attract a greater number of investors; individuals can become a member with a tax deductible donation of $100 or more. Then, members meet to make 0 percent loans to local farmers and food entrepreneurs, by majority vote — one member, one vote, no matter what the size of the donation. When loans are repaid, funds are recycled into new loans.

“We are trying to redefine what it means to have a successful enterprise,” says Michael Bartner, vice president of the Slow Money Institute. “Instead of asking about rates of return like you would with angel investing or low-interest loans, this philanthropic model will allow us to start asking questions about the values of the enterprises we invest in, how it will contribute to carbon restoration in the soil, and how it might bolster a local food economy.”

Slow Money launched a similar model two years ago in the Roaring Fork Valley where 33 individuals have contributed a total of $206,000 in amounts ranging from $100 to $80,000. Seven loans have been made to date, with more in the pipeline, funding projects like buying a refrigerated truck for an organic flower farm or building a hoop house to extend the

On Oct. 16 and 17 hundreds of people — investors, farmers, scientists and concerned citizens — will gather in Boulder to launch a philanthropic venture, Slow Opportunities for Investing Locally (SOIL), which coincides with the release of Tasch’s book.

SOIL’s model is a simple tweak on the low-interest one Slow Money already uses, which Tasch describes as a boundary activity between investing and philanthropy — consider it either a traditional investment with a unique social return, or a kind of philanthropy with an uncommonly high financial return.

growing season for a small-scale vegetable grower.

Now the model is moving to Boulder as a pilot program of sorts. Here on the Front Range, SOIL is starting off with $75,000 from a dozen founding members and advisors, including Brian Coppom, executive director of the Boulder County Farmer’s Market. Given the population and geographical factors on the Front Range, Tasch believes SOIL will be able to achieve more scale than its sister group in the mountains with the potential to grow into a significant resource for funding local food systems.

You’d think Boulder County would be the perfect place to try out a new philanthropic investment model in local food, supported as it is by venture capital, tech start-ups and natural food Kirsten Boyer companies. You’d think that the county’s penchant for farmers markets and farm-to-table dinners would translate to an inclination to invest in these food economies.

And yes, local food is becoming a powerful economic development strategy for towns like Boulder, but, as Michael Bartner puts it, “the arithmetic is tricky; the bottom line may simply be too low for some businesses and investors to get traditional investments. That’s why we need something totally new.”

The problem is that we may not have the luxury of time, says geomorphologist and MacArthur Fellow David Montgomery, keynote speaker at the upcoming SOIL gathering. For the last 10 years, Montgomery has been studying the relationship Eric Skokan of between the health of soils and civilizations. In his first Black Cat Farm, book on the topic, Dirt: the Erosion of Civilizations, he a recipient of a Slow Money came to the rather unsavory conclusion that, based on loan. our soil health, our society is on the brink of demise.

“You look at how we have treated soil through history and if we do it again we are doomed,” he says. “But over the last 10 years I have become an optimist, I actually think we can solve the problem and in relatively quick order. It all revolves around changing our farming practices.

“I’ve interviewed farmers all around the world who were forced to withdraw from high-input farming practices (using fertilizers, patented seeds, fossil fuels, etc.) because they could no longer afford to participate. So these guys went no-till, they started diversifying their rotations and using cover crops in the off-season because they had to.”

Not only did these changes lower the cost of farming and raise the price farmers could charge for their produce, it also restored the fertility of the soil.

“I am not in the investment world or the farming world, but to me it seems that if you can invest in a farm to make it profitable in the short-term through practices that restore soil fertility, you increase the value of the farm in the long run.”

Montgomery doesn’t see large-scale investment in soil fertility being driven by investors, but by the farmers themselves who have a relationship with the land and care about the health of the land their children will inherit.

“Soil health degrades bit-by-bit, slowly enough to be ignored in a single lifetime, but fast enough over centuries to limit the lifespan of civilizations.

Farmers are in a unique position to hold both perspectives... and to do something about it.”

The legacy that drives Boulder’s Adventure Film Festival

I In 2009, an avalanche in the Himalayas took the lives of three Boulder mountaineers, including Jonny Copp, the 35-year-old Adventure Film Festival founder.

n July of 2009, Boulder Theater plotted its marquee letters to read: LONG LIVE JONNY COPP. Weeks earlier, three Boulder climbers — Jonny Copp, Micah Dash and Wayde Johnson — were killed in an avalanche while approaching a new route they’d scouted on the face of Mount Edgar, a sheer, jagged, fin-like 6,000-meter peak in the Chinese Himalayas.

Jonny was 35, Dash 32, and Johnson 24.

Jonny and Dash were “alpinists of the highest level,” Alpinist magazine wrote the week following their death. “Displaying the combination of technical difficulty, alpine style and remote location became [ Jonny and Dash’s] trademark.”

Johnson, a filmmaker, hadn’t planned on summiting with the duo.

He was on the expedition as a producer for Sender Films to document the pair’s first ascent.

Back in Colorado, it hadn’t taken long for Jonny, a SouthernCalifornia kid, to make his mark on the climbing community, and for people around to notice. After moving to Boulder in the early ’90s, he see JONNY Page 24

It was during a different, earlier trip to the Himalayas that Jonny had “The Idea.”

“You know how it is — when you’re out in the backcountry, good ideas come to you,” Abbey Smith, Jonny’s close friend and climbing partner, recalls. It was in a tent that he first “scratched down ideas for a community-oriented and community-built film festival. He wanted to showcase the stories and experiences that we have out in the world.”

Jonny had built his life standing at the intersection of adventure and storytelling, thumb out, ready to catch a ride in either direction. “We’d said farewell to girlfriends, been dumped by girlfriends, passed on career jobs, and cobbled together a living based on a mix of photography, writing, and weird one-off jobs to supplement the odd (and well-below poverty line) sponsorship check,” Pete Takeda, another close friend and climbing partner, wrote in a memorial essay for Patagonia.

Takeda was part of the recovery team that sifted through the avalanche debris on Mount Edgar following the accident.

In 2004, Jonny set in motion what would become one of the widest-reaching adventure film festivals in the world. Rather than prioritizing how much adrenaline a film could pump — a common practice in the adventure industry — Jonny envisioned a collection of adventure films that dug into the core of the people undertaking adventures and the essence of the places into which they traveled. “He saw a void in terms of the depth in [adventure] storytelling,” says his sister Aimee.

Thus, the Boulder Adventure Film Festival was born.

“When he walked into the room, everyone lit up,” says Smith, who now manages the festival’s PR. “When he had a good idea it wasn’t hard to get everyone behind it.”

Jonny’s energy was contagious. Early on, he coined the festival’s slogan “Make your own legend,” meaning “follow your dreams, do something you’ve never done before, explore, reach past what you could do in your own life,” Aimee explains.

When Jonny died a few months prior to the festival’s fifth anniversary, the team was faced with a decision: to continue or to pause the operation? “When people experience tragic loss they have moments of clarity,” says Aimee, “and I definitely knew that I wanted to create a foundation for my brother and have that foundation continue the festival, in his honor and to continue his legacy.”

In the near-decade since, the tight-knit festival team — comprised of family, friends and a fleet of volunteers Jonny Copp with — has wholeheartedly dedicated itself to building upon his sister Aimee.

Jonny’s mission. They’ve grown the festival around the globe and deepened its commitment to telling stories laced with adventure, but focused on social and environmental messages.

In keeping the festival alive, they’re not only keeping alive Jonny’s spirit, they are still growing his influence.

The magnitude of people that report being affected by the festival still shocks Aimee. Their mom, Phyllis, shares that they’re actually planning to create a film about how the festival has impacted attendees. Aimee says her family is now close with a man who credits the inspiration he found at the Adventure Film Festival with helping relieve suicidal thoughts.

“Sharing stories really has the power to inspire and spawn real change. That was basically the platform [on which] he started,” says Smith. “We’re trying to go through the power of storytelling to open people’s eyes.”

While many of the films at the festival profile expeditions or athletes, some dig straight into socio-political ON THE BILL: 2017 Adventure issues. One of the most powerful aspects of a film festival, according to Smith, lies in its ability to make people think beyond their experiences.

“When you bring people together to experience a film, it starts a conversation and [you can experience a] shared reaction.”

Aimee agrees, “Film has a way of showing people a place, culture, cause or issue that they might not have experienced first person. ... Through storytelling, they’re able to actually experience and understand the complexities, and honestly start to care.”

This year the team focused on “finding and curating a playlist of films and programming … that feature people of color, women adventurers, and those minority groups that are not fairly represented at these types of festivals,” says Aimee.

During the three-day festival, more than two-dozen films — some with bigname characters like Hazel Findlay, Hans Florine and Brad Gobright — will play at the Boulder Theater. The concurrent Adventure Street Fair, which takes place along 14th Street, will feature live performances by musicians Jeff & Paige and artist Jeremy Collins. On Sunday, Outdoor Afro leader Kriste Peoples will guide a hike and tell stories about Boulder’s black history. Expedition chef Kieran Creevy will teach a gourmet backcountry cooking class. An adventure film workshop, taught by industry leaders like Shelma Jun, Jason Houston and Juliana Broste, will impart storytelling and community-connecting techniques.

The seminal Scottish-born, English-bred songwriter on statuettes, ‘The News from Spain,’ grammar fails, the sad comedian, the endless ‘Year’ and the only song ever written about a javelin salesman

April of this year, Al Stewart was awarded A Lifetime Achievement Award at the BBC2 Radio Folk Awards ceremony. These events are usually bittersweet moments for working artists, as they can be as much a congratulatory pat on the back for staying a few paces ahead of mortality as they are a salute to a body of work. But Stewart hasn’t got an impolite fiber in his frame, and coming up on stage, uncharacteristically fumbling for words, he was embraced by the emcee of the evening, English broadcaster Tony Blackburn, coincidentally a bandmate of Stewart’s from the mid-1960s when both were drifting in and out of skiffle bands in Bournemouth.

Blackburn took obvious delight in presenting Stewart with a little statuette. “ ... which I dropped,” Stewart recalls, cracking us both up.

“I’m looking at it,“ he continues, “it’s right here on the piano.”

“It’s... they’ve given that award to everyone I grew up with. Ralph McTell, Roy Harper, Bert Jansch, Martin Carthy all have it, so I think (they thought) they had to give it to me. Eventually they had to get around to it.”

informed songs, drawing substance from the entanglement of characters real and imagined as they are ground through the wheels of history grand and trivial. This is Stewart’s stock-in-trade — a product and a voice derived from his own obsession with history and literature, paired with a gift for detail and a staggering command of language. The Spanish revolution, the Russian revolution, World War I and II — invasions and turmoil and societal upheaval, overlaid upon the frayed imperfections of mortal men.

He is, also, the Year of the Cat guy, and a good chunk of his road schedule over the last few months is one of those “plays the whole album for your enjoyment” things. Stewart’s success with that album and the eponymous single, which blew up on European and American radio in 1976, suddenly made the dedicated folkie a pop star, a sudden transformation that Stewart found a little disorienting and, in ensuing years, both a blessing and a minor albatross, as much of the pop-stuff fans had little relationship to his deeper catalog.

But 40 years on, Stewart is out with a Chicago-based band called The Empty Pockets, playing Year of the Cat end to end — to everyone’s enjoyment, and even his own.

“Well,” he says, picking his words carefully, “it’s certainly a trend, this thing of doing ‘classic albums.’ A lot of people are doing it... Sparks took it to new heights a year or so ago, when they took over at Shephard’s Bush Empire... and not only did they play the whole of one of their albums, they played the whole of all of their albums.

“The shift is the economics of the thing; people keep nagging me to play Year of the Cat with a band. I found this band out of Chicago, which was recommended to me, called The Empty Pockets, and they’re all young and enthusiastic. It wasn’t a possibility until then; to bring over the band that I had at the Royal Albert Hall would be so expensive you’d be losing 10 grand a night, even if you were sold out.

“We’ve played three or four (shows) so far. And I think they just added 16 more.”

Is he enjoying it?

“We’ve got 16 more to go, but so far, yeah, it’s been fun. I think you’d have to ask me after all those are done, but so far, yeah it’s been fun.

“And it’s something people want. I think people forget that this is a job, you need bookings. I’ve been working steadily for the past 15 years in kind of a folkie way, and it never occurred to me that at this age (72), I’d be going out and playing with a rock band, and so far people seem to like it. It’s something different, something new.”

Stewart once said that standing up in front of a full band represented something of a discomfort for him, as if he were getting in the way of the players who were doing all the work.

He laughs. “It’s sort of what Bette Midler once said of Helen Reddy, that she should be arrested for loitering in front of an audience. Which was very unfair, but still kind of funny.

“Back in the day, I was a resolute folkie. I made Past, Present and Future, which was all about lyrics. Bob Dylan has this line on one of his songs, ‘I was so much older then, I’m younger than that now.’ And it sort of feels that way to me. Now, I don’t care. I think I got a little too serious for my own good at some point in my career. It’s not that I don’t love Past, Present and Future, but you can’t live off a solid diet of Russian history, which, for awhile, I did.”

From those days, of course, came Stewart’s epic “Roads to Moscow,” his lyrical masterpiece “Nostradamus,” and, even earlier, the touching “The News from Spain.” As coincidence had it, I chatted last month with Rick Wakeman, who prior to his enormo-dome days with Yes, was a session player in London. He contributed a now-legendary piano outro to the track “The News From Spain,” a sleeper track from the Orange album that Stewart admits was an early personal favorite but had fallen off his set list, until it got surprisingly resurrected while on tour with guitarist Dave Nachmanoff not long ago, with Nachmanoff actually sort-of reproducing Wakeman’s bit of Rachmaninoff comping.

“It was very odd... we hadn’t played it for 30 years, and we were in Seattle and someone yelled out ‘The News from Spain’, and I thought, I don’t think I remember it. But I took a crack at it and someone recorded it (for the Uncorked release). I think it was my least-selling single when it came out. It came out around Christmas, and it sold something like 162 copies. It sold even less than my first single, which is really saying something.”

Of course, when Year of the Cat was released to blanket airplay and Stewart was signed to Arista records as a now-certified pop star, the inevitable pressure to make more hits came to bear. It’s something that Stewart, who was not doctrinally opposed to having a hit but was generally unaccustomed to cranking them out on demand, thought he’d have a bit of fun with his chart-obsessed handlers.

“’Song on the Radio,’ I get asked for that all the time, but I actually end the sentence with a preposition and I know better than that. “ We’re both cracking up again.

“I mean, I’m not strict about it, but I don’t tend to make these mistakes.

Worse, I used the same word twice in the same sentence. [“I was making my way through the wasteland/The road into town passes through.”] I mean, this is terrible writing.

“There’s no justification for it, but the record company asked for a midtempo ballad with a saxophone on it, and I was kind of making fun of Arista Records. They wanted a song that could be played on the radio, and very tongue-in-cheek I wrote a song called ‘Song on the Radio.’ I thought they’d be smart enough to see I was actually joking, but of course they didn’t, and they put it out as a single and it made the Top 30, and the joke was on me because I screwed up a preposition.”

And as far as the Big Hit, the title track itself actually started as a song about Tony Hancock. When my wife and I were in England a couple of months ago, the BBC ran a story about an enthusiast who had stumbled across a couple of lost recordings by Hancock, a significant find evidently. We of course had no idea who Hancock was, but we learned subsequently of the connection to the song “Year of the Cat.” “Tony Hancock was the most famous comedian in England,” Stewart explains, “…and what happened over the years, after his heyday, he made a couple of movies, but his comedy didn’t translate, and he became somewhat depressed (and quite drunk, it should be said).

“He came to Bournemouth when I was about 18, 19, just before I left for London. And he came out onstage and said, ‘I’m really miserable,’ and of course everyone laughed, because that was the character he usually played.

And he said, ‘No, I mean it,” and they laughed even more. There were 2,000 people in the audience, all laughing, but I felt I knew, he really means this.

And no one else in the audience seemed to be getting it. And I think it was just a few months after that he committed suicide.

“And I wrote this song called ‘The Foot of the Stage,’ it was the ‘Year of the Cat’ tune, with different words. The chorus was, ‘His tears fell down like rain/At the foot of the stage’, and it was all about Tony Hancock. And that would have been it, but for the American record company who said that no one in America would have any idea who Tony Hancock was, and could I rewrite it. And so I did.

The recesses of unconscious Sam Amidon finds the art of folk

am Amidon wears headphones a lot, although a lot less than he used to.

Think of them like a stethoscope and Amidon the physician, listening for musical heartbeats and signs of sonic life. Although maybe it’s best not to dispart them, and better to say the wire is like an umbilical cord connecting Amidon to his musical source.

“If I was told that tomorrow I was never gonna play music again, I would be bummed, sure, but if I was told that I was never gonna listen to music again, I would be devastated,” he says. “For me, listening to music is one of the deepest and more important activities in my life — playing music is about listening and so exploring other people’s musical worlds.”

Whether Amidon is listening to a Sonny

Rollins album from the 1960s, conceptual electronic creations or a field recording of an Irish pub session, you can be sure he’s listening closely, picking up on all of its technical nuances. But more impressive than his savantlike command of odd musical niches and deep cuts is how he listens.

He listens to music as a record of an event, of artists in a room together, “like really being together,” he says, “responding to each other in a musical conversation.” He says he can hear the look of ecstasy on their faces in a moment of co-created genius just like he can hear the annoyance in a saxophonist’s pitch as the pianist departs on a self-indulgent tangent.

Amidon knows music like Paula Deen knows butter: He loves it, but more importantly he knows how to use it. His discography could be likened to a Thanksgiving feast — a bounty that rewards those willing to savor every dish.

His first two albums are weird and spontaneous, wearing all the trademarks of a young musician playing with the freedom he’d just discovered at the tips of his fiddling fingertips.

And then, as he got older, he released five albums of increasingly refined reinterpretations of folk songs that would come to define his musical niche.

Perhaps owing to his penchant for free jazz and the oral traditions of folk, Amidon may have found a niche, but it was never rote. Each time he would go to make a record, he would ask himself what elements of his expression hadn’t made it onto an album yet. For years that meant showcasing Boulder Weekly

Oct The Revolutionists is a brutal comedic quartet about four women who lived boldly in France during the French Revolution’s Reign of Terror.

Dixon, Higgins changes gears later in the play by conveying Corday’s very tangible fear and fragility. As Antoinette, Adrian Egolf arguably has the easiest job. Her character is written as the comic relief and is given many of the best lines like, “I’m here for a rewrite,” and “Hold the throne,” as well as a deliciously oblique Thomas Jefferson-as-slave-diddler reference. It takes an actress of Egolf ’s substantial talent, however, to turn the jester aristocrat in a play about social equality into a likeable, even sympathetic character.

It’s been quite a few years since I last saw BETC co-founder Rebecca Remaly on stage. During that time, I’ve enjoyed numerous productions she’s directed, produced or both, but it was a real and rare pleasure to see her in front of the lights once again. Remaly’s take on de Gouges makes her at once the most modern and seemingly timeless of The Revolutionists’ sisterhood. De Gouges is obviously a proxy for Gunderson, and Remaly bounces effortlessly between that meta element and the more traditional dramatic requirements of the part.

The Revolutionists is not only another win by BETC, but establishes for me the inarguable artistic dominance of Lauren Gunderson. When the women of The Revolutionists make fun of the idea of a play within a play from their position in a play about a play within a play, one just can’t help but smile.

Join contemporary circus arts performance group Acrobatic Conundrum for its debut show in Boulder on Thursday, Sept. 28 at the Dairy Arts Center. The Seattle group will be performing its hit show, Love and Gravity, which follows a circus ensemble whose spirit and physical strength cannot prepare them for the trials of love and heartbreak. Their performance features real life stories about unconventional love and the uncharted territory of relationships, all from a bar 20 feet in the air.

The show combines heart-rending emotional accounts with amazing acrobatic stunts, juggling acts, aerial displays and more, all in an attempt to challenge the audience’s notions of love and gravity.

Founded in 2012, Acrobatic Conundrum has produced five shows and performed nationally and internationally at venues such as the Smithsonian American Art Museum, the Backstreet Festival in Alexandria, Egypt, and more. This six-person company presents itself on a minimal stage, with little more than human connection and talent. Critics have praised the group for representing the essence of modern circus with its strong artistic voice. Italian guitarist Beppe Gambetta is back in Colorado for the release tour of his 13th album, Short Stories. While growing up in Genova, Italy, Beppe was fascinated by the American acoustic guitarists of the 1960s and 1970s. This obsession led to the cultivation of his unique style that blends American and European roots with passionate melodies and energetic rhythms. This cultural fusion combined with Beppe’s life on the road inspired his most recent album, which represents his explorations in the different landscapes throughout various countries. Short Stories also mixes Beppe’s varied musical passions and interests. The album includes three original compositions, four songs featuring arrangements in four languages (English, German, Italian, Genovese), two melodies adapted for flatpicking guitar and one live performance from Beppe’s international music production, The Acoustic Nights.

‘Kingsman’ misfires by Ryan Syrek

W

hen done well, a movie that simultaneously exists as a certain thing while satirizing that same thing resembles a Mobius strip, a tantalizing narrative pretzel that obscures where the entertainment ends and the commentary begins. When done half-assed, Elton John kicks an evil henchman in the face while Julianne Moore cries with her eyes behind her signature smile. Of all the things it set out to be, Kingsman: The Golden Circle should have started with “good.” Mediocre and weird, the film is regressive at the precise spots when it thinks itself progressive, dumb exactly when it thinks itself clever, and blissfully entertaining when it forgets itself entirely.

For a would-be franchise aspiring for free-spirited adventures, The Golden Circle is mind-bogglingly dependent on the events of the first film. Without any reintroduction, Eggsy (Taron Egerton), the British-street-tough-turned-millennial-007, immediately gets roughed up by a somewhat minor character from the first film, Charlie (Edward Holcroft), who had previously appeared to be super dead. Notdead Charlie is working for Poppy (Moore), an international drug kingpin who has somehow poisoned the entirety of the world’s illegal narcotic supply and threatens to kill the millions infected.

To facilitate her nefarious nefariousizing, Poppy kills all the Kingsman spies, including the only woman from the first movie that Eggsy didn’t have anal sex with. The survivors of the purge, Merlin (Mark Strong) and Eggsy, head to the U.S. and call upon the Statesman group, which is the American version of the Kingsman spy operation. The Statesman spies stealthily hide by being mostly comprised of cameos. Head honcho, Champ ( Jeff Bridges); head bad-ass, Tequila This spy-heavy sequel sees the (Channing Tatum); and head tech person, surviving members of the Kingsman travel to America, to fight a Ginger Ale (Halle Berry), appear exactly drug kingpin, which sounds more as long as contractually obligated. Also, fun than it actually is.

Harry Hart (Colin Firth), who was Eggsy’s mentor in the first movie, is resurrected for no good reason, there’s a weird Burt Reynolds cosplayer named Whiskey (Pedro Pascal) and tons of other convoluted impediments to enjoyment.

The Golden Circle can be fun, but only when writer/director Matthew Vaughn and co-writer Jane Goldman stop barfing plot complications and borking their alleged skewering of James Bond. Every action set-piece is hella purty, as the camera slips and slides over, around and through the combatants. And you’d think watching Colin Firth kick ass would be old hat by now, but watching him pride the prejudice out of thugs is still giddy goodness.

What derails things is the film’s treatment of women, which furiously vacillates between stunningly dismissive and “ew, gross.” Roxy (Sophie Cookson), Eggy’s platonic buddy from the first film, is killed off so flippantly, she’s more “mini-fridged” than “fridged.” Princess Tilde (Hanna Alström), who was seemingly returned only to absolve the filmmakers for making her a one-note butt sex joke last time, is fleshed out into a more complete character, only to be returned to comedy prop.

Worst of all, the camera work on a sequence where Eggsy simply must place a tracking device in a villainess’s vagina is so heinous, Martin Shkreli complained that it made him uncomfortable.

Shifting tones and abject weirdness is often the formula for fresh, invigorating franchise filmmaking. Sadly, The Golden Circle proves that’s merely a suggestion, not a golden rule.

Top picks from the Flatirons Food Film Festival by Michael J. Casey

I

t would be low-hanging fruit to open this column with a declaration along the lines of: “The Flatirons Food Film Festival returns for a fifth course!” But who are we to eschew the tastiness of low-hanging fruit? It’s probably sagging with all that extra flavor anyway.

Yes, the Flatirons Food Film Festival (FFFF) is back and this year’s lineup of movies, meals and chefs (Frank Bonanno anyone?) looks to be a symphony for the senses. (For the full FFFF schedule, read Nibbles, page 49.)

Whipped up by founder and director, Julia Joun, FFFF runs Sept. 27–Oct. 1 and screens nine cinematic gems, each one capturing the beauty of food, the pleasure of the process and the time-altering, memory-charged effect of a dish made so perfectly it can bend time and space.

That may sound highfalutin, but isn’t that the goal of every work of art?

That quest for perfection forms the heart of Pixar’s Ratatouille (Canyon Theater, Sept. 30 10:30 a.m.), an animated film about a Parisian rat, Remy (voiced impeccably by comic Patton Oswalt), who dreams of being the world’s greatest chef. Standing in his way, Anton Ego (voiced by the great Peter O’Toole), a food critic who wields his column the way a samurai master wields his sword.

As it is with all great Pixar movies, and this is one of their best, Ratatouille speaks to audiences of all ages, showing young children that there is more to a plate of food than macaroni and cheese with cut-up hot dogs while reminding adults that food is much more than simple sustenance and cheap cravings. It may be hard to say exactly what food is, but as Remy and Ego know, the best things in life cannot be described, only experienced. To borrow a line from another movie obsessed with cuisine: “To eat good food is to be close to God.” Those words come from Big Night (Muenzinger Auditorium, Oct. 1 1:30 p.m.), the story of two immigrant brothers, Primo (Tony Shalhoub) and Secondo (Stanley Tucci, who also writes and directs), trying to keep their failing restaurant afloat. Crass consumerism, picky eaters and an uneducated clientele are winning the battle, but Primo knows that if he holds fast to his values, he may yet win the war ­— if only spiritually.

In some alternate universe, Primo and Remy would be fast friends and open the world’s greatest French/Italian restaurant. And if we can loop in Taiwanese Master Chef Chu’s (Sihung Lung) Sunday banquets from Ang Lee’s Eat Drink Man Woman (Muenzinger, Oct. 1 4 p.m.), we’ll never need to go out for dinner again.

All of the movies screening at this year’s Flatirons Food Film Festival are strong offerings, but Ratatouille, Big Night and Eat Drink Man Woman express food not merely as a consumable but as a culture, as a language. Here, the right dish acts as an ambassador, extending the olive branch from one to another and explaining in the most accessible way possible who they are and where they came from.

ooler weather begs to be paired with certain foods — your stews, your soups, your curries, etc. Warm, rich, creamy and slightly sweet, chicken en mole fits the bill, and there are few better places to get it than Louisville’s Casa Alegre. Their take on the Mexican staple is well-refined and balanced. The thick, brown mole sauce — typically made from dozens of spices, vegetables, broths and other ingredients — is kind of fruity, kind of spicy, kind of savory, kind of chocolaty... the point is, a lot’s going on, but it all coalesces in a singular soul-pleasing experience. The best part is you don’t have to think about what all is in there, you can just enjoy it for its alchemical greatness. The chicken, by the way, is ridiculously tender. Regardless, the few places that do sell fish and chips are Boulder County treasures.

Reelfish dedicates itself to the craft, offering a variety of a salt- and freshwater fried (and grilled) goodies. A recent special of walleye was too tempting to resist. The freshwater fish is a staple of Midwestern fish fries and Reelfish does a good job replicating the experience. Two thin strips of walleye are crusted, lightly fried and served with lemon, a citrusy and thick dipping sauce, and crispy fries. $15.50.

Remarkably, it’s not always easy to find a satisfying bowl — the greens are off, it’s not big enough, it’s too bland, whatever the case may be, the pitfalls in the salad game are many. Naked Lunch, though, seems to have nailed a few unique salad varieties that have, at least for us, always delivered. Their Mediterranean rice salad balances a variety of flavors and textures that leaves you feeling full despite the absence of animal-based protein. Mixed greens are tossed with rice, lentils, artichokes, kalamata olives, cucumbers, red onions and tomatoes. It’s all dressed in a simple olive oil and balsamic vinaigrette. It’s truly Mediterranean — a little Greek, a little Lebanese, a little Italian. It’s both punchy and acidic from the olives, vinegar and onions, and earthy with the lentils, artichokes and rice. $9.50.

Much to take in and out of the kitchen at Flatirons Food Film Festival

T

here is a scene in my favorite food movie, Big Night, set in a failing Italian eatery in New Jersey. The brothers who own it deliver a timpano to a table crowded with a big family. A timpano is an elaborate macaroni-crusted Calabrian deep-dish pie layered with meatballs, salumi, eggs and tomato sauce. The brothers — played by Stanley Tucci and Tony Shalhoub — deliver the masterpiece, serve it and watch as one of the diners looks ready to assault them: “This is so fucking good I should kill you!” he says. The table erupts in cheers and wine.

Big Night is an emotional opera (without the arias) that embraces family, love and the struggle between art and business. As a half-Sicilian, Big Night rings my bells and it never fails to make me hungry for a meal that really matters. (By the way, it’s hard to type when you’re talking with your hands.)

never just about eating. Big Night joins a slew of other food classics, and new documentaries and dramas as part of the fifth annual Flatirons Food Film Festival Sept. 27-Oct. 1. Most films and events will take place at the Canyon Theater of the Boulder Public Library as well as CU’s Muenzinger Auditorium.

The showings include tasting and learning opportunities for foodies, plus notable guests who will talk about the films before and afterwards.

These include a special appearance by America’s original celebrity chef, Jeremiah Tower. The Flatirons Food Film Festival has also become a unique magnet bringing together the diverse strands of Colorado’s culinary community.

• Look and See: A Portrait of Wendell Berry. 7:30 p.m. Boulder Public Library (BPL): This documentary goes to Henry County, Kentucky, for an intimate look at Wendell Berry, one of America’s greatest writers and poets, and a powerful voice

for the land and the people who farm it. Dave Carter, executive director of the Colorado-based National Bison Association, will introduce the film.

How (and why) Kim and Jake’s have made gluten-free perfection their goal

H

ow Kim and Jake’s gluten-free cakes and baked goods came to be in Boulder starts on a date in a Colombian restaurant and bakery in Georgia.

Jake Rosenbarger was out with his now-wife, Kim, when the allure of the rotating pastry display was too great to ignore.

“I said, ‘I gotta try a slice of cake,’” Jake recalls. “And it was so delicious that I kept ordering another slice and another slice. What was fun was you could just point and go, ‘I want that one,’ because I didn’t know the names.”

There was something unique about that cake that Jake, who had grown up baking and cooking with his family in Indiana, couldn’t quite put his finger on. After a few months of regular cake-ordering, Kim, who was between jobs, took a position at the bakery at Jake’s “insistence.”— “Learn how to decorate, do whatever you can to get a job,” Jake says he told Kim. It was a good match. Jake, a professional cyclist at the time, took Kim’s employment as an opportunity to “get in the back door” and learn from the pastry chef about how she created that cake and other baked goods. It was also an opportunity for free cake.

“I’d come back from big rides and I’d be able to just mow down cake,” Jake says. “So the trick with cake baking, you bake the cake, you take it out of the pan and it’s domed so you can’t stack cakes like that, so every cake you Boulder Weekly

have to cut the top off. … They would just throw out all the tops, and I would go mine that trash can like you wouldn’t believe. I mean, it was a trash bin and they would fill it up every day.

“The bakers would just laugh, like, ‘Are you kidding me? We’ve got cake up front.’”

Flash-forward a few years and the Rosenbargers are in Boulder. When they opened Kim and Jake’s Cakes in 2010, they opened as a traSome of Kim and ditional bakery — taking recipes from the Jake’s recipes have Colombian restaurant and modifying them to gone through more than three dozen fit their needs (taking the lard out of cake iterations. frosting, for instance). There were increasing requests for gluten-free and vegan options, but the bakery was by all means full-dairy, all-flour.

Then, Jake was diagnosed with celiac disease in 2012. Seeing that he still had an appetite for bakery breads and sweets, the Rosenbargers used it as an opportunity to transition to a gluten-free bakery that accommodates all dietary restrictions. frustration that goes along with figuring out how to replace basics like wheat flour and eggs.

“There wasn’t a point [when I wanted to quit] because I really wanted to eat the frickin’ pancakes, and I wanted them to be good. So I’d get frustrated but just highly incentivized to do right by our customers. I want the trial and error to happen on me rather than settle on something that’s 90 percent

good or give up entirely and say, ‘Forget this.’ Because I want to eat pancakes, I want to eat waffles, I want to eat cookies, I want to eat cake. If you’re into what you’re doing, you’re going to put the time in.”

Indeed, there has been a good amount of trial and error — and it’s ongoing. In the kitchen of Kim and Jake’s small bakery, there’s a bulletin board with paper sheets denoting the

recipes for the latest iterations of sandwich bread, baguettes and more. The sandwich bread, for instance, has taken on 40 iterations. That comes from variations in types of flour (teff, amaranth, coconut, tapioca, etc.) to how finely milled it is, to how the flours interact together, to how it works with different gums, and much more.

And yet, Kim and Jake’s made the switch to gluten-free without really tell-

ing its clients. Some patrons would come in after a year and not even realize the recipes of the foods they’d been eating had changed­— nothing had gluten and much was friendly to those with food allergies.

Being able to buy alternative grains, gums and everything in between in bulk has allowed for constant tweaking and the continued search for quality goods. No doubt, the Rosenbargers and their team have learned a thing or two about gluten-free cooking.

“There’s not one flour that will do everything, so you need to be comfortable with trying and mixing and matching,” Jake says. “I can tell you our [blend] for our cookies and our cakes is oat flour, brown rice flour and tapioca flour, and it’s equal parts brown rice to oat, predominantly, with 20 percent tapioca relative to those flours.”

That’s a good tip, but Jake cautions that everything is different for every product. The flour mix is different for different items, and the amount (and type) of gum — Kim and Jake’s uses xanthan — is different for each flour mix and recipe.

Nonetheless, Jake is eager to offer more tips to home bakers: Use less gum for things that are denser like cookies; Add baking soda or baking powder to increase lift in gluten-free products (but keep an eye on it); Take 15 percent out of both leavening and sugar in recipes that work at sea level; and bake at a low temperature to prevent immense growth, which can lead to flattening.

And that cake in the Colombian restaurant that hooked Jake in the first place? Use oil, which has a high fat concentration, more than butter, and use a lot of eggs to create a solid protein structure, which enables fat to work better.

But the Rosenbargers took more than just a cake recipe from their former employers, mother and son Cecilia and Enrique Villaveces. They also took a willingness to share happiness in the form of education: by teaching folks to bake and cook the things they like, they’re serving their community just as if they were selling them a loaf of bread.

“Sometimes you don’t know why but you just come across people who extend their hand,” Jake says of the bakers. “So we kind of emulated both their style of cake and some of the things that they did. If someone wants to ask questions, if they want to see it, please let us show you. If you can take something home and make your life better, by all means, I am happy to do whatever I can for you.”

Tour de brew: Boulder Beer Redux The first one now will later be last

t’s been a little over a year since we started this tour of Boulder County breweries. Back then, 51 breweries and brewpubs dotted the landscape; now, we are up to 56 — expanding by six, shrinking by one. That one, Walnut Brewery, took down its name on June 4, 2017, but the location still produces beer. The brewpub is now owned and operated by the Boulder Beer Company, Colorado’s first craft brewery.

Boulder Beer’s Wilderness Place location was the first brewery we visited all those beers ago, so it seems only fitting we should tie up this package, close up shop and bid adieu to this tour from this matching bookend of brew.

Opened 27 years ago, the Walnut Brewery was Boulder’s original brewpub and thanks to its downtown location, was a favorite of locals and ON TAP: Boulder students alike.

Not much has changed since Boulder Beer took over the reins. They blew out the cobwebs — and some of the charm — knocked out a few booths and installed more tables, expanded the beer list, updated the menu and added a couple Skee-Ball machines in the back. For the most part, it’s still the same old haunt.

That’s partly because Boulder Beer kept Walnut’s head brewer, Rodney Taylor, and a couple of Walnut’s signature brews — Old Elk Brown Ale and St. James Irish Red — to play alongside Boulder Beer’s signature Mojo IPA, Shake Porter and Hazed Hoppy Session Ale. But the fun doesn’t stop there, Boulder Beer is turning their Walnut location into an research and development facility, one that will offer drinkers a chance to quaff many a rotator. From Black Axe, a dark lager with lovely roasted malts and just enough carbon dioxide to keep the palate lively, to Dr. Evil, a Belgian IPA with a deep golden color, a pillowy head of suds and full mouth of hops. There’s even the requisite New England IPA, Due East (7.1 percent alcohol by volume), which can be drunk either from a CO2 tap or

the cask. Both offerings exhibit hops and juice without too much bitterness, with the cask version clearing up the IPA’s signature haze considerably.

There is something oddly poetic about Boulder Beer’s New England IPA from the cask; it’s the perfect

only one recipe survives — the one whose brewer’s name is on the door.

You can still drink Buffalo Gold all day long on Walnut, but if it tastes slightly different, then just remember: you can’t step in the same river twice.

I had a blast hosting Savage Lovecast Live at San Francisco’s Palace of Fine Arts. Audience members submitted questions before the show, and I consumed a large pot edible right after the curtain went up and then raced to give as much decent sex advice as I could before it took effect. Here are some of the questions I didn’t get to before my judgment became too impaired to operate a sex-and-relationship-advice podcast.

Q: I’ve been on the dating apps a while. What’s up with serial first daters?

A: Back when people primarily met at parties, bars, clubs, etc., we established baseline physical/chemical attraction before learning someone’s name and long before a first date. (We eyeballed ’em, we said hello, we made a moment’s small talk.) With apps, however, we can’t establish baseline physical/ chemical attraction until our first faceto-face meeting — until after that “first date,” which itself comes after we’ve swapped flirty messages, sent additional pics and made a plan to meet. Since apps mean more “first dates,” it feels like we’re meeting a lot more “serial first daters” these days. We aren’t — it’s just that now we have to meet up with people to eyeball ’em, say hello, and make small talk. Don’t think of that first meeting with someone you met via an app as a “first date,” think of it as the preinterview before the first date.

Q: What is the appropriate amount of side boob?

A: This is outside my area of expertise/giving a shit. So I’m going to pass this question on to Tim Gunn. I’ll let you know what Tim has to say should he respond.

Q: My best friend is in a relationship with a really jealous, controlling guy. He guilt-trips her constantly and gets passive-aggressively mad whenever she tries to hang out with people besides him. When she complains about him, I want to say, “Fuck him, he’s a dick,” except... she’s having a fullon affair with another guy and seems not to feel bad about it! I don’t know what advice to give or how to make sense of the situation. What’s my responsibility to her? To her boyfriend?

A: Maybe your best friend’s boyfriend is jealous and controlling because he senses — or because he knows — his girlfriend is cheating on him. Q: I feel like all my friends resent me for getting married. How do I make them feel less insecure about my new relationship?

A: Ask yourself which is likelier: All of your friends — every single one of them — are so petty and insecure that they resent you for getting married or you were a megalomaniacal bride-orgroom-or-nonbinary-zilla and behaved so atrociously that you managed to piss off all your friends? If it’s the (less likely) former, make better friends. If it’s the (more likely) latter, make amends.

Q: My brother’s fiancée told my mom that she doesn’t like my mom’s usual lipstick color and asked my mom to wear a shade she picked out for the wedding. My mom is 75 and wears cute pink lipstick. Is it wrong if both my mom and I wear the pink in solidarity?

A: You should absolutely wear your mom’s shade in solidarity — and send me a pic of you two at the wedding, please! (Hey, person who asked the previous question, did you pull this kind of shit? Did you order your friends around the way this woman’s future DIL is ordering her around?)

Q: Since my man and I got engaged, we’ve been fighting about wedding planning. We never fought until now. How can we move forward with the wedding without ruining our relationship? his is a picture of me, stopped at a red light, with two marijuana plants in the back of my truck. They needed to be moved from house sold to house bought, and it wasn’t until I started carrying them out to the truck that I was hit with the symbolic weight of the move.

Instinctually, I hid them from the street with my body as I carried them from house to car and car back to house, so sneaky-like that I could hear Fred Flintstone’s tinkle sound effect as I tiptoed across the lawn. I couldn’t help but feel the heightened sense of doing something that, whether barely legal or illegal in Colorado, was so overtly a federal offense.

Again, I was moving, then from New York City back to Colorado, and all of my worldly possessions were stuffed into the back of my slick and golden Mazda 3, replete with Colorado plates.

A Westerner, I’d never driven through the Northeast so I made a road trip out of it, winding up through Maine, dipping into Montreal, crossing over the Great Lakes and stopping to visit family in Sarah Haas

That one time in Nebraska There’s nothing like carrying a full-grown pot plant in full bloom across a suburban lawn to remind you that it’s not like this everywhere. According to Leland Rucker of Sensi Magazine, in 2015, police made 643,121 arrests for marijuana offenses in the U.S., the vast majority (about nine out of 10) for possession. With this number ruminating in my head, I only made it down the street before covering the plants with a blanket; whether out of fear or respect, I’m not sure.

Needless to say, the plants and I made it safely to our destination, but as I drove I thought back to “that one time in Nebraska” — in quotation marks because I’ve talked to more than a handful of people over the years who have a “that one time in Nebraska” story themselves. These are stories of what could be called “marijuana profiling,” incidents when law enforcers in other states stop vehicles and perform marijuanarelated searches because they are outfitted with Colorado license plates.

My story begins in the summer of 2011, just months before Amendment 64 would go to vote and pass, legalizing recreational marijuana in Colorado.

Wisconsin. It was there that a friend convinced me to take an extended layover in St. Paul, Minnesota, to work for 10 days selling tiny fried donuts at the state fair.

With 3.5 million visitors a year, the biggest state fair in the country lies in Texas, a distant second place going to Minnesota’s fair, which draws 1.8 million visitors. But the title of “biggest” and its accompanying bragging rights are hotly contested because in Texas they have 24 days of festivities to draw in those crowds, while in Minnesota they do it all in 10.

I’ll leave it at that, except to say that with a hot bag of donuts in your hand and Garrison Keillor’s voice piping out of the arena, it’s hard to argue that Minnesota’s fair isn’t the best.

For 10 hours a day, on all 10 days, I hung out with carnies, sweating it out next to friers while we listened to Kid Rock and coated greasy pastries with

sugar. At midnight I’d go home to a rented fifthwheel trailer to drink some Hamm’s and play cribbage. It was a temporary routine but a memorable one.

At the end of the gig, the donut crew loaded up for the next fair and paid me and my friend in cash.

We hit the highway, stopped at the outlet stores and blew a cool hundred on new Nike gear. Tags still on the clothes we’d bought, we got back in the car, still stuffed to the brim with all my worldly possessions, and headed to Colorado. It was the middle of the day and we had the headlights on.

About half way through Nebraska we got pulled over. It turns out one of the headlights was flickering on and off, apparently off just enough to warrant not just a stop but a ticket. “A nit-picky bummer but no biggie,” I thought.

Two hours later I was sitting on the side of the highway with my hands on my head. Having found mounds full of cash in the pockets of my new jacket with the tags still on, the cop had been bombarding me with questions about weed for hours.

Sometimes he was nice about it, like “Where’s the weed again?” And sometimes he was a bit more direct, ordering me to stand up and look him in the eye and tell him who I bought the drugs from.

Meanwhile, my friend was in the backseat of the cop car, having undergone his own rounds of interrogation. The officer had gone through each and every bag in my car, all of my things now strewn carelessly on the side of I-80.

Another hour later and he finally let us go. He didn’t find any drugs because we really (really) didn’t have any. He drove away and I started maniacally laughing. To this day I have never seen anyone as pissed off as my friend was then. We crammed the stuff back in the car and got back on our way home to Colorado, beckoning then like it never had before.

Some topical pot puns make a hash of political correctness: “I call my weed ‘The Quran,’ because that shit will get you stoned.”

Some events are destined to be an infinite source of marijuana puns, like Super Bowl XLVIII, played on Feb. 2, 2014, which gave a new dimension of meaning to the phrase “Super Bowl.” The game was played between the Denver Broncos and the Seattle Seahawks, teams representing the first two states to legalize recreational marijuana.

“Footballs aren’t the only things these teams will be passing around,” was tweeted early. (A cheep hit, if you ask me).

“This game has the potential to be pretty interesting, but weed better not get a head of ourselves,” someone added.

Seattle won 43-8. “The Broncos are really getting smoked,” was tweeted as the blow-out began.

“You’re bong about the Broncos,” came the reply. “They’re a top shelf team.”

Why so many pot puns? Probably because marijuana was illegal, and still is in a lot of places. The outlaw status guarantees that any pun about pot is edgy and a little dangerous. And chances are that even with the coming of legalization, pot punsters will be tripping the light fantastic for a long time to come.
