TransLink is proposing an increase to its DCC. The proposed increase reflects an annual inflationary adjustment to TransLink’s DCC rates. Municipal Hall closures for Emergency Operations Centre training Wednesday, November 8 Wednesday, December 6 During a major emergency or disaster, a local emergency operations centre (EOC) is activated to provide overall jurisdictional direction and control, coordination and resource support to provide services and to protect the health and safety of Bowen Island residents. Municipal Hall will be closed on three separate days to allow for EOC training and a full-day disaster simulation. The last time BIM activated an EOC was in 2021 during an atmospheric river when the island experienced flooded roads, washouts and damaged culverts. Settlement appeal dismissed in case of destroyed boat
JUDGE RULES $5,000 WAS ENOUGH FOR MUNICIPALITY TO PAY IN DAMAGES AFTER SALVAGING ERROR ALEX KURIAL Editor The BC Court of Appeals has upheld a provincial Supreme Court decision in the case of an unlawful boat destruction. The June 14 Appeals Court decision came just over two years after a June 4, 2021 BC Supreme Court judge awarded Bowen resident Joel Lepage $5,000 in damages from Bowen Island Municipality (BIM). Justice Peter Edelmann determined BIM improperly destroyed Lepage’s boat, a 32-foot sailboat named Celeste, in January 2016. Lepage appealed this amount to the provincial Appeals Court, claiming several points of error by the Supreme Court judge. Lepage had sought $200,000 in damages in the original case. The dispute dates back to Jan. 19, 2016 when the Celeste broke free from her mooring in Mannion Bay (Deep Bay) and ran
aground, later sinking. Lepage was living aboard another boat at the time, Zen State, which was also moored in Mannion Bay. The BIM bylaw officer at the time, Bonnie Brokenshire, investigated the wreck and notified Transport Canada, expressing concern about environmental damage to eelgrass in Mannion Bay as well as potential damage to a nearby resident’s dock. A search returned no records indicating an owner of the boat. As a result Transport Canada authorized BIM to salvage what remained of the Celeste, which was carried out on Jan. 20. The next day the boat was fully destroyed and all its parts and contents shipped off-island to be disposed. Justice Edelmann found that while the salvaging was legal, and approved by Transport Canada, the subsequent destruction and disposal of the entire boat was not. BIM conceded this was an error on their part, and the case moved on to determining damages. While Lepage did not have official doc-

uments proving he was owner of the boat, Justice Edelmann found “Mr. Lepage had physical possession of the sailboat from 2004–2016 and that he personally occupied it for many of those years,” adding that Lepage never abandoned it. Lepage said he paid $40,000 for the boat, but couldn’t prove this. The fact the boat had already sunk factored into the judge’s decision. An expert testified that a similar sailboat in good condition could be worth up to $10,000. But for a sunken version, “the market value would diminish to virtually zero”. Edelmann concluded the Celeste therefore “had no realistic market value after it was salvaged.” The judge also considered claims from Lepage seeking sentimental damages and compensation for work he’d performed on the boat over the years. Edelmann dismissed the sentimental value argument, and concluded that since the boat had already sunk prior to salvaging, BIM was not responsible for any damages to that point. He found $5,000 “would adequately compensate Mr. Lepage for the loss he proved at trial that was directly attributable to the wrongful conduct of Bowen Island.” In his appeal of the Supreme Court finding, Lepage argued that the judge erred by finding the sailboat had already sunk, that he wasn’t the legal owner of the boat, and that sentimental value was not considered. Justice Joyce DeWitt-Van Oosten of the BC Appeals Court heard the case and rendered her decision this summer. On the matter of whether the boat was sunk or not prior to salvaging, photographs were provided that showed Celeste underwater
with only part of a mast protruding on Jan. 19, 2016. Lepage acknowledged the pictures were of his boat but claimed the salvage company “dragged it… over the rocks and sunk it and then barged it.” Since Transport Canada had approved the salvaging based in part on the same photos provided, DeWitt-Van Oosten concluded the boat was already sunk prior to the salvage company’s involvement with the matter. Regarding ownership of the boat, the judge found that even if Lepage could prove ownership it wouldn’t have affected damages because the boat had already sunk when BIM became involved. She added that regardless, the original settlement already factored in the destruction of both the boat and its contents. Finally, dealing with claimed sentimental value, DeWitt-Van Oosten said “Mr. Lepage asserted a sentimental attachment in his testimony, but it is unclear to me how that could have been measured with any degree of certainty on this evidentiary record… Mr. Lepage cites no authority in support of his position that the failure to account for sentimental value in an action for conversion constitutes a clear error in principle.” Justice DeWitt-Van Oosten ultimately determined “This was not a complicated trial. The judge (Edelmann) was alive to the issues raised by Mr. Lepage, including his position on ownership of the sailboat and whether the evidence established that the sailboat sank before salvaging.” “Mr. Lepage has not established a proper appellate basis on which to interfere with the damages award. Accordingly, I would dismiss the appeal,” concluded DeWitt-Van Oosten.

Halloween Fun
Well what another wonderful October wrap-up it was on Tuesday! I was quite blown away during my first Bowen Halloween last year at the lengths both Trick or Treaters and hosting houses go to with regard to costumes, decorating, and just overall enthusiasm for the evening. That effort was equalled this year in a party that has quickly, and easily, become my favourite event night on Bowen. The fun concluded with a colourful fireworks show (with hot chocolate) by the Bowen Island Fire Department, part of which was captured by Chris Wilson below (don’t miss his Witch Paddle photos on the next page either). A special shout-out goes to the Pub for their awesome Scary-oke party on Saturday. The many entertaining singers accompanied by the steady sound of the Naturals made for a party that will hopefully become a new Bowen tradition. I noticed on Bowen Island Everything Else that there was a general concern about birds dying from impact with glass railings. The solution is to stick post-it notes on the inside of the glass, away from the wind. I cut off the bottom of the post-its leaving just the small sticky rectangle which I then position in the middle of each glass pane on the patio. Costs next to nothing, is practically invisible, lasts all year until the next glass cleaning

and no more tiny lifeless, feathered bodies on the patio. It works! Best to clean the glass before sticking on the post-its and you must apply them in dry weather. New Family Physician joins Health Centre PAUL WELSH Bowen Island Health Centre Dr. Stephanie Shorter, Bowen Island resident and former family physician at Docs on the Bay in Horseshoe Bay, has joined the primary care team at the Bowen Island Community Health Centre, effective January, 2024. Dr. Shorter grew up in Oakville, Ontario. She did her undergraduate training at Queen’s University where she met her now husband, Bryn, who grew up on Bowen Island. After following her to Ottawa University for Medical School, and back to Queen’s University for her Family Medicine residency, Bryn finally convinced Dr. Shorter to move to the West Coast. After living 2 years in North Vancouver, they moved
to Bowen Island in 2020. Dr. Shorter began working as a Family Physician at Docs on the Bay at the end of 2018. She loved working there but had always dreamed of ultimately becoming a part of the health care team on Bowen Island. While she is sad to say goodbye to her practice and colleagues at Docs on the Bay, she is looking forward to joining the team at the Bowen CHC. Dr. Shorter’s passion for Family Medicine lies in the ability to build longitudinal relationships with her patients. She values the importance of working with her patients to achieve their best health by allowing and encouraging them to be active members in their care. Within Family Medicine, Dr. Shorter has special interests in mental health and Dermoscopy for skin cancer screening.
Outside the office, Dr. Shorter enjoys spending time with her husband, 2-year old son Alec, and 3-legged greyhound, Ziggy. She loves exploring the outdoors through hiking and downhill skiing. Since moving to Bowen Island, she has developed a passion for gardening and has become connected to the amazing gardening community on Bowen. When not outside, she enjoys crocheting and hopes to one day be a part of the BICS Holiday Market.

ESS & NERP Volunteers joining forces WILMA PRETORIUS Bowen Island NERP With wildfires and flooding becoming an increasing threat to BC communities, Bowen Island Emergency Response is kicking into high gear. On Oct. 18 Bowen Island Emergency Support Services (ESS) and the Neighbourhood Emergency Response Program (NERP) volunteers gathered at Fire Hall #1, the site of the Bowen Island Emergency Operations Centre (EOC). In the event of an emergency on Bowen, the EOC would be the communications and response hub for emergency services deployed during the event. For those not aware, ESS is funded and equipped by the Provincial government. The province provides sponsored training and funds to provide basics to residents that are displaced from their homes due to an emergency event. In addition, grants are available through Union of BC Municipalities for equipment
and further training. Bowen Island’s ESS volunteers will deploy in the event of an evacuation. For large scale evacuations ESS will set up a Reception Centre to register and assist evacuees. ESS services range from setting up temporary sleeping shelters, family reunification, and care for pets and other animals on Bowen, as well as registering and providing impacted islanders with the goods and services they may need (i.e. temporary housing, food, clothing). On the other hand, NERP Volunteers consist of a group of more than 90 Bowen Islanders, representing all Bowen neighbourhoods, and have a mandate to help neighbourhoods get prepared for any type of emergency that may strike us. ESS is therefore deployed during an emergency, whilst NERP is a proactive program to help prepare for an emergency before it happens (i.e. by having adequate home supplies, grab-and-go bags, knowledge of evacuation routes). While ESS and NERP activities do not
directly overlap, ESS and NERP Leadership have recently committed to aligning resources and volunteers more closely to strengthen the island’s capacity for responding to catastrophes. At the invitation of ESS, NERP volunteers participated in an orientation session to learn more about how they could help in the event of an evacuation on Bowen. During the orientation sessions, NERP volunteers learnt how Reception Centers would be set up as needed on the island, what equipment ESS has available, and how NERP volunteers could undergo training to provide further assistance to ESS once an evacuation has been ordered. The NERPS were also provided a tour of Fire Hall #1 to gain insight into the procedures and resources that might be used in an emergency. As Bowen’s arts council, The Hearth supports all forms of artistic expression by Bowen or visiting professional artists, aspiring youth and community groups either at The Hearth Gallery’s beautiful, purpose-built space in the Cove Commons in Snug Cove or elsewhere on the island. When the new Community Centre is built, The Hearth will also be supporting artistic use of the performance space.

HAPPY It was another night of Halloween fun at the Lenora Loop as hundreds of Trick or Treaters descended on Bowen Island’s official All Hallows’ Eve candy circuit. Younger kids got a head start on their Trick or Treating during a Friday morning tour of Artisan Square storefronts. Overall both kids and adults came away with a good haul from this year’s Halloween activities, all while boasting some incredibly creative, and often hand-crafted, costumes. You can see many of them here in our gallery, and we have lots more pictures online from the big evening. Happy Halloween!

MIKAIL, Misha May 24, 1961 - October 23, 2023 Dear Misha has left the stage. Danced her last dance. Performed her last act. During the 90s Misha touched many of us with her infectious joie de vivre and laughter. She taught dance to so many Bowen kids and would create venues so they could experience performing. And of course we saw her act on stage in the lead roles in Robin Hood, Waiting For Godot and other memorable plays of that time. In recent years she pushed through pain of health concerns to dance once each week. She was one who was always clear about life and death - and knew (and wrote) that when her time came she would fly on, unencumbered. Her daughter Maihanna (and infant grand-daughter Sage), former husband Kirk, mother and father Micky and Gerald and brother wish her a safe flight. She supported tprf.org. You can too, in her memory.
