On January 2nd NewFilmmakers NY begins our new season with WinterFest 2014 and will screen more than 100 new films over nine days. Then on January 15th NewFilmmakers begins its regular Winter Season and will screen new films every week. All our screenings are at Anthology Film Archives at Second Avenue and 2nd Street on the Lower East Side. In addition to new documentaries, short films, features, and works in progress, admission includes free receptions and networking events with filmmakers. Admission for the whole night is still only $6.

Micro Budget Film
…So I get a phone call from a Director, whom my company, Fliktrax, had worked with a few times in the past. He had directed mostly Documentaries up until now and was completing his first feature film. After filling me in on some production details he tells me that he has a scene that “need’s Springsteen’s “Thunder Road” in it”, then says “what do I have to do, pay a few hundreds bucks for license clearance to Harry Fox?” I pulled the phone away from my ear and looked at it in disbelief. This was an experienced industry director who had no clue how music licensing for film, whatever the size, worked. I explained that the cost of licensing the Springsteen track (if he could even get permission to use it) would probably take up a quarter of his budget alone. This information was greeted with some choice expletives in return. This is by no means a rant to belittle new filmmakers on their lack of knowledge on music licenses but an opportunity to educate and shed some light on an industry that I work in daily. There is no single, cut and dry way to clear music for film. As a matter of fact, there are a number of inexpensive ways to get great music into your production. Being knowledgable on these choices will prevent you from future headaches and production delays, not to mention lawsuits.
First let’s look at who normally handles this job of placing music in film. When a production has a budget to allow, a ‘Music Supervisor’ is one who works with the Director and Producers of a film to select and clear music which is included in it. They “spot” the film with the Director, dissecting what scenes need what kind of music. Often, much of this music is composed by a hired “composer” and is referred to as the “score”. However there are usually numerous spots that use actual songs (more often short pieces of songs). A Music Supervisor goes to their resources (this may be list of artists they work with, music libraries, publishing companies, etc) and starts to assemble a list of tracks for the director to listen to against picture. Many times a director will “temp” music into a rough cut of the film to give examples of the emotion he or she wants to convey. The Music Supervisor and/or Composer will then use that as a blueprint for their jobs of composing and selecting music to replace the temp tracks and making sure they have legal clearance to do so. For many new filmmakers the position of “Music Supervisor” is one of the many hats they have to wear due to budget restrictions. The filmmaker is usually the one with the artistic vision, so this can be a good thing! Let’s examine what options are available when you are filling that position. I’m not going to spend much time on the possibility of an unknown filmmaker having the budget or connections to get a track by a well known band, signed to a major record label and publishing company. To use a track by such an artist, you would contact either the artist’s management and or publishing company. If the track was available for license in film, they would tell you how much it would cost and what (if any) restrictions there are. Be careful here though, there are stories I’ve heard of Publishing Companies giving an independent film a cheap “film festival” license (meaning its allowed to be used in the film for Film Festival screenings) with the stipulation that if the film gets bought a “feature film” license would need to be obtained. The “Feature Film” license has been as much as $100,000 more than the initial license. Needless to

say this could be a deal breaker for a buyer. Point to take away here, any piece of music that is used in a public performance needs an appropriate license, if you use it without one you are liable of copyright infringement. Don’t put yourself in this position, it involves lots of lawyers and money!
Sometimes the cover is an attempt at an exact copy, other times its a creative interpretation (‘The Flaming Lip’s’ cover of Madonna’s “Borderline comes to mind). Personally I think this adds further creativity to a film, especially when it was commissioned directly for it and the director has some artistic input.
Let’s say you have a rough edit of your film, you’ve selected tracks or other films scores for “temp” music and are now seeking permanent music to replace it. Its rare for any new filmmaker to have much of an upfront budget for music, so the first option is to go to friends who may be musicians. Whether they are in bands or are composers, you can discuss the possibility of working in a “Low-NoDeferred” payment situation. To a composer with credits, who doesn’t know the director or their work, this is kryptonite. However if you have friends that might be looking to get their independent music heard or a composer who needs the practice and/or credit for their “reel”, this may be a great option for them as well.
What you would first need when recording a cover is a “Mechanical License” which gives you clearance to record the song, and release it in limited quantities (up to 2,500 units, if sold). First place to start is the ‘Harry Fox Agency’ (www.harryfox.com) who represents thousands of popular artists/songs, you locate the song, pay a very modest fee and off to the studio your musicians go. If the track isn’t listed at Harry Fox, you are best to contact the original publisher. Most publishing companies allow this but I would urge any filmmaker to get clearance before spending valuable time. I know some will say that you can skip the “mechanical license” if you don’t plan on releasing the cover track for sale. However I’d advise, that for the small price you pay for a mechanical license and because of the copyright “grey areas” that are associated with promotion and eventual physical sales of the film, it’s far better to be safe than sorry. Not to mention allowing the band or musicians to possibly monetize their cover track in either physical or digital release.
“Low-No-Deferred” get used a lot so let’s look at each. Low payment- “I’ll give you what I can”, No Payment - “This is strictly for experience or for “art’s sake” and Deferred- “I’ll give you payment, points or percentage of sale of the film should it get picked up or broadcast”. Classified industry sites are littered with ads for this type of arrangement. Most filmmakers will find that dozens of composers and bands will bombard them with their services. From the music side, the industry is in a horrendous state and many musicians are willing to sell their soul for even slightest exposure. The music industry’s struggle may be a filmmakers gain. Many filmmakers with compassion for the musicians they are working with give them some kind of guarantee of payment if the film is to become profitable down the line. The next option for a filmmaker, and the one that my company is most involved in, is a library site and/or production company (we are both in Fliktrax’s case) grants up and coming filmmakers an incredibly inexpensive “blanket film festival” license. What this does is allow the filmmaker to use as much from our library as needed, for one very low price. This license then allows the film to be aired publicly at film festivals and private screenings or promotions. However there is usually a stipulation (there always is right?), that if the film gets bought and distributed, then a feature film license for the included tracks/cues, must be purchased. This isn’t a bait and switch, unless your independent production is Star Wars 7, you will be paying a normal and reasonable price to clear those tracks for public display if and when that time comes. Many boutique companies like ours are willing to do this and truly want to develop a relationship with the up and coming filmmaker. It allows the filmmaker access to a huge library of music and it gives the library the opportunity to work with tomorrow’s professionals. Now let’s go back to that track you really wanted to use. That song that you feel is simply integral to your film. You’ve already attempted to contact the publisher, artist or record company (the one who owns the master recording) to appeal to their compassionate side and well… they weren’t that compassionate. All is not lost! There is the much less expensive option of getting permission to record a cover version of the track and using that as second best scenario to the original. I’ve personally played on dozens of “covers” for Films/TV and Advertising.

The master recording of a track is usually owned by a larger entity (normally the record company). Since these recordings have become a commodity they can charge huge licensing fees. However obtaining a “synchronization license” and clearance to use the “covered” version of the song in your film is nowhere near as costly. I would advise going directly to the track’s publisher, explaining that you’ve obtained a “mechanical license” and recorded a cover version of the song, which you wish to use in a scene of your film. They may ask how big the film is, does it have distribution, where will it be seen, if you sell copies of it how many do you plan to make/sell. Because every film is different and many of these licenses are allowed and priced on a subjective basis, its best to be totally upfront with the publisher. Ask any questions you have then, its better to cover all your basis before your film is released! I’m sure both you, the filmmaker, and I, the composer share the opinion that music is a vital character in every movie. A well composed score can elevate a film and convey needed emotion, urgency, and impact. When in harmony with picture, music can allow a plot to unfold without unnecessary dialog or explanation. For this reason, I find it so important to educate any new filmmaker to take the necessary steps to not only make sure the music they are using is cleared and legal but that’s its great and never a compromise because of budget. Don’t let the somewhat arduous process of music licenses lead to short cuts which could degrade the time, money and passion you put into your film! Ron Harpelle HARD TIME Hard Time is a film about Robert Hillary King, the only freed member of the Angola 3. King was a political prisoner who spent 29 years in solitary confinement in the infamous Louisiana State Penitentiary at Angola. The film focuses on racism and human rights in the U.S. penal system, and draws attention to the plight of Herman Wallace and Albert Woodfox, the other members of the Angola 3, who have been held in solitary confinement for more than 40 years. Together they formed they created a prison chapter of the Black Panther Party to fight for better conditions, security for inmates and justice behind bars.

Micro Budget Film Why do I need this is the most important question you hear young filmmakers ask me on a daily basis? Insurance is a transfer of risk from your company to the carrier should an accident occure. This is not only protecting you as a film maker but your investors, crew and cast should an accident occure.
Insurance for the film and television productions comes in many various ways and different options depending on the project type and carrier we use. Each carrier has their own appetite for what kind of coverages they like to offer and what limits they are willing to go to. We treat each client and project in a different way. After we do a full review of the project, stunt exposure, and advise the client on the proper limits of coverage necessary. We can insure any type of budget starting from 1k to 100M. Again it all depends on the project type and the exposure we are looking at. Most typically young independent film makers we advise on the following coverage General Liability, Workers’ Compensation, Equipment Coverage for rental houses, Auto Coverage for auto rental, Props, sets and wardrobe. The most important coverage we tend to focus on is Workers’ Compensation a lot of young filmmakers make the mistake of not taking this coverage. This coverage protects your cast and crew members should they get hurt on set and need to go to the hospital. By United States Law you are required to provide workers’ compensation coverage to your employees. Anyone who you tell what
to do and where to be is your employee unless they provide you with their own certificate of workers’ compensation insurance. So if something happens to them while they are on your production paid or deffered pay you are responsible for their medical bills. We see this happen often on indie projects where they refuse to get workers’ compensation coverage. Then the calls begin we had a bad accident can we get the coverage now. Coverages can vary by requirements of locations, film permitting offices, equipment rentals, and etc. If you are using SAG and AFTRA actors in your project General Liability and Workers’ Compensation are a must for them to sign off on your film. Most city permitting offices will require these two coverages as well some will need auto if you have auto exposure. We can always find the right coverages for you with in your budget bracket as we work with multiple carriers that offer various options. The most important thing film makers always need is equipment. When you go to a rental house they will ask for certificate of insurance and minimum General Liability of 1M and Rental Equipment coverage of whatever the replacement cost value of the equipment is. These are easy coverages for us to put together and most filmmakers forget to get them until they are at the equipment rental facility and realize that they need them. The reason rental houses as for this is should something happen to the equipment they are renting you it gets replaced or fixed to continue their business. They will require wording of additional insured and loss payee on the

certificate which is pretty typical for every rental house to make sure that they made whole if the equipment is damaged. There is always a deductible associated with this coverage and every carrier has their own deductible requirements. What that is the control of the risk on the carriers behalf.

Young and on the rise: Chris Bellant
Chris Bellant was born in Detroit, Michigan on February 6, 1991. His father was a union employee, his mother was a performer and city worker. Chris’s interest in acting started when he was 8 years old. But it wasn’t until several years later at the Detroit Waldorf School that Chris’s interest in acting became his passion.
When he was 14 years old he decided that he actually wanted to pursue acting as a career after appearing in a school production of Shakespeare’s Twelfth Night. He began to spend his summers in Los Angeles, California in order to pursue this career and acting in film the summer before he started high school, when he was still 14 years old. That summer he also signed his first contract with an agent. At the age of 16 he acted in Learning How To Speak and signed with HRI in L.A. He traveled frequently between Detroit and L.A. to audition while finishing high school at Renaissance High School.
Chris enrolled at NYU’s Tisch School of the Arts where he studied acting at the Stella Adler Studio. He spent two and a half years training at NYU when he was offered the role of Evan Shelmerdine in Annie Baker’s The Aliens. Chris decided to take time off of school to work, and has been working since. He recently completed a leading role in the indie feature The Backseat, co-starring Andre de Shields. He then worked in the Warner Bros. thriller Into The Storm, which stars Richard Armitage and Sarah Wayne Callies. NFQ: What made you leave NYU? Chris: I was offered a part in a play, and it was a few months of work. I decided it was more important to start working than to stay in school. Originally I intended to go back and finish but work kept coming in. This coming year, I’m working on a play called “Extraordinary Things” here in New York, as well as two films in January. This spring I’m working on a play in Los Angeles as well as a new series. We will also be starting pre-production and rehearsal for a film that I’m producing and starring in.

Chris: It’s called “Loserville”. I read the script when I was 16 and fell in love with it. It captured the reality of high school in a way that I hadn’t seen before. I got in touch with the person who owned it, and used some of my savings to buy the rights. I was too young to sign the contract myself, so my parents had to sign for me. I had no idea how to produce a film at this point, so I started reaching out to more experienced producers and worked on attaching stars. After some years of development, we’re going into production this coming summer. The Facebook page for Loserville is now up and running.

NFQ: You currently are in Backseat, which will screen at WinterFest 2014. Tell us about the film.

Chris: “The Backseat” was one of the first feature films I ever worked on. We spent about five weeks shooting, and it ended up shooting at the exact same time as another film I was working on called “Into the Storm”. So there ended up being a lot of hopping back and forth between the two sets. It was definitely a life changing experience, and I made some great friends who I’ve been working with ever since. The film also stars Andre De Shields, who starred in The Wiz on Broadway and many other projects. I think it’ll do well on the film festival circuit and I’m excited to see it in theaters.

NFQ: This is just one of a number of feature films that you have coming out. Chris: Yes, I just wrapped Fairfield, about a group of high school students trapped in their school during the zombie apocalypse. We really had a blast shooting this. We’d work our butts off all day, then as soon as we were off set we would jump in the pool or hot tub. It was an amazing group of people. The director of Fair-
field, Mattheau O’Brien, is directing one of the films I’m working on next month. I got to work with a few good friends on this film, including Chris Riggi (“Gossip Girl”), Grant Rosenmeyer (“The Royal Tenenbaums”) and Juliet Landau (“Buffy” and “Angel”). It’ll be out this spring. I worked on a film this fall called Living With The Dead. I co-starred in this with Selenis Leyva (“Orange is the New Black”), Robert Clohessy (“Boardwalk Empire”), and Marc Coppola. I just got to see some of the footage and it looks beautiful. I can’t wait to see the final product. I’m also in a found footage tornado film that Warner Bros. is producing called “Into The Storm”. The film stars Richard Armitage (“The Hobbit”) and Jeremy Sumpter. It was pretty amazing because this shot in my home state of Michigan, so I got to visit family for a while during production. There are going to be crazy special effects. I remember my first day on set, they were talking about one of the effects that they were doing that day. I thought “There’s no way they’re ACTUALLY doing that. It must be green screen.” No, they were really doing it! I think people will be really amazed by the film. That’ll be in theaters next summer. NFQ: What is next for you? Basically going through all the offers and auditioning. But my main focus really is Loserville, since that’s a project I’ve been really passionate about for a long time and I’m now the right age to play the lead. There are a lot of teen dramas out there, but this is really unlike anything I’ve seen before. I think it will resonate with anyone who has ever had their dreams crushed by reality yet somehow survived. I think it’s a modern John Hughes film.
