Family awarded judgment in vehicle-strike case

Three years after 12-year-old Burgess Hu was struck and killed by an SUV on his way to Excelsior Middle School in Bryon, the California State Superior Court has awarded his family a $1.25 million judgment.

The ruling, which was entered on May 16, was made against Brandy Woolman, the driver of the vehicle. The judgment also stipulates that Burgess was without fault in his own death.

“We can’t bring people back, but this is a step toward closure for

the dad, and that’s an important one,” said Scott Sumner, Hu’s attorney. “It’s closer to justice and (the judgment) certainly backs up what was important to the father.

In particular, that Burgess didn’t cause his own death and that the driver was responsible. Those things were important.”

No criminal charges were ever filed against Woolman in the incident, and her automobile insurance company paid the judgment.

O

ver the past several weeks, you may have seen progress on the Verizon cell tower adjacent to Main Street, just north of Empire Avenue. Instead of adding another faux tree, the city constructed a traditional-looking water tower. Staff inspected the faux water tank portion of the tower before it was hoisted into place. The artist did a great job of capturing the antique look that was specifically requested by the city council. Soon, the water tank will be in place, with two new versions of the Oakley logo facing due north and due south.

Jack Roddy to receive memorial award “ His character is built on the

Not everyone thinks of ranchers and cowboys when they think of California, but we have some of the Wild West’s most renowned, steer-wrangling horseback riders in the rodeo industry.

Jack Roddy is one such rider, and his dedication to the rodeo community is what has earned him the honor of the Ben Johnson Memorial Award, which will be presented at The National Cowboy & Western Heritage Museum in Oklahoma City, during its annual Rodeo Hall of Fame weekend, from Sept. 30 to Oct. 1.

Born on Oct. 3, 1937, and raised on his family ranch in Colma, California, Roddy grew up riding horses and roping cattle. At the age of 14, he competed in his first RCA rodeo and won $90 in the wild horse race. His love of the sport only grew from there, sending him across the country for competitions as he won championships and broke records along the way.

He attended college at California Polytechnic State University, where he competed with the rodeo team and became the 1959 Steer Wrestling Champion and All Around Cowboy. By 1962, Roddy was on his way to the National Finals Rodeo for the first time, and by 1966, he won the world championship for steer wrestling, setting a record for total earnings in the event. He followed it up with another championship in 1968, and by 1997, Roddy was inducted into the National Cowboy Hall of Fame.

The sport brought Roddy all over the continent for competitions, but it’s the people who made it something special to him.

“Rodeo is a tight-knit community,” he said. “The main things I relish are the many friends and business acquaintances I’ve made along the way.”

“Ben Johnson was a good friend of mine,” said Roddy, who shared that only 14 other people have ever been honored with the award. “They told me about a month ago that I was going to receive it, and (my wife and I)

plan to leave for Oklahoma City on Sept. 29.”

Also attending the event in support of Roddy will be longtime friend and cowboy Chris Cox of “Chris Cox Horsemanship,” a television program on RFD-TV. Cox’s father went to Cal Poly with Roddy, and Cox fondly recalls the many vacations their families took together, celebrating birthdays and visiting family ranches.

“His character is built on the model of the American cowboy, which includes respect, hard work and keeping his word,” said Cox of Roddy.

Roddy and his wife, Donna, ranch in Brentwood, where they built Roddy Ranch Golf Course on their land and hosted the first and only Rodeo Historical Society Golf Tournament. Not only is he a leader of the cattle industry in California and a member of the Rancheros Visitadores, but he’s also involved in many charitable events across the U.S. When asked how he felt about the vast growth of the Brentwood area over his lifetime, Roddy gave a chuckle.

“I’ve seen a lot of changes,” Roddy said. “But, I’ve enjoyed living out here. We have a beautiful ranch, and I feel fortunate to live in this area.”

BUSD takes tours of district schools

In a new approach to support the district’s many schools, the Brentwood Union School District’s Board of Education members have begun walking tours on the school campuses.

The first school to host a tour was Edna Hill Middle School.

“It went great!” said Edna Hill Principal Kirsten Jobb. “It was an excellent opportunity for the board to experience what’s going on in the classrooms. We have a very supportive school board, and we’re very fortunate to have them as our partners.”

This feet-on-the-street method is exactly what the district was going for. Superintendent Dana Eaton was excited by the board’s commitment to enhancing the students’ environments.

“The board of education will be able to tour each and every campus to see the goals that have been laid out,” said Eaton.

“They’re committed to seeing the impact of the budget they’ve enacted and to gain a sense of each school’s strengths, in addition to seeing where they need more support.”

These walking tours take place while children are present, giving the board a more organic exposure to daily life in the classrooms. The members look at everything

This up close and personal look at what’s going on in the district will give the members a better idea of how to tend to the growing school-aged community in Brentwood.

The next school on the tour list is Bristow Middle School, to be conducted on Sept.

22 and led by Principal Jon Ovick.

Sowing the safflower The safflower fields on Balfour Road were harvested last week, which made for a dusty route out of town for drivers.

These bustling machines can handle about 145 bushels before needing to be emptied, and they were busy making laps around the hills by Balfour and Deer Valley Road. The approximately 2,800 acres take about a month to harvest, according to farmer Glen McCauley.

“It goes pretty quick … when we have all three machines working,” said McCauley. “It looks like a good crop, but we had a down year, because we ran out of water. If we had more rain in April, it might have been all right.”

Safflower has many uses. It goes into coloring and flavoring of foods, as well as medicines. It’s also used for making red and yellow dyes, but primarily, it is cultivated for the vegetable oil extracted from its seeds.

The flower itself, sometimes called “Bastard Saffron,” can be a cheap substitute for the very expensive saffron.

Water-conserving plumbing fixtures have been required in new-home construction for several years. So, if you bought your home recently, you can ignore this article. But, if your home was built prior to 1994, there is a new requirement you need to be aware of, whether you are selling your home or not.

Effective. Jan 1, owners of single-family homes in California that were built prior to 1994 will be required to install waterconserving plumbing fixtures. Please note that this is NOT a function of selling a home (what we call a “point-of-sale requirement”).

Here are the fixtures in question that will need to be replaced: Toilets that use more than 1.6 gallons per flush, urinals that use more than 1 gallon per flush, showerheads that have flow capacity more than 2.5 gallons per minute and any interior faucet that emits more than 2.2 gallons per minute.

You are not allowed to just put a brick in your toilet or otherwise adjust your existing toilet, even if the end result saves the same amount of water.

If you are selling or buying a home, this is something to be aware of, although as I said above, it’s not technically required to be done when you sell a home. But, the seller now has a duty to disclose if their plumbing fixtures comply with this law, and the buyer may very well ask the seller to correct the situation during their investigation of the property, as a requirement before they will remove their contingency.

This will be very similar to the carbon monoxide detector requirement that passed a few years ago, meaning it’s required to do, but most people won’t be aware of it until they sell their home or apply for a permit to do some work on their home.

Earn online diploma Register to vote The Contra Costa County Library is offering qualified community members the opportunity to earn an accredited high school diploma and credentialed career certificate through the Career Online High School.

The program is specifically designed to reimmerse adults into the education system and prepare them for entry into post-secondary career education or the workforce.

“Earning a high school diploma is a lifechanging achievement,” said County Librarian Terry Speiker. “By offering Career Online High School, we’re empowering our residents to seek new opportunities and transform their lives.”

Career Online High School is a program brought to public libraries by Gale, a part of Cengage Learning, and is part of the world’s first accredited, private, online school district.

“We’re delighted to partner with the Contra Costa County Library to offer Career Online High School and give residents access to education and the potential to change their lives,” said Paul Gazzolo, senior vice president and general manager for Gale.

Beginning Monday, Sept. 26, the Alameda County Public Works Agency will be repairing a sinkhole in the southbound lane of Vasco Road, near mile marker 3.74.

During this repair work, south-

bound traffic may be reduced to one lane and speed limits will be reduced through the work zone. There will be no impacts on the northbound travel lanes. Motorists should expect delays and are encouraged to adhere to the reduced speed and use caution around personnel and equipment.

Estate Planning Considerations For Seniors: Adding Your Child As A Co-Trustee To Your Trust

Do you have a trust and are you thinking about adding one of your children as a cotrustee? Recently, we have met with several seniors who have had questions about adding one of their children as a co-trustee.

First, when should you consider adding a child as a co-trustee?

We generally find it is not necessary to add a child as co-trustee if you and your spouse are still active and able to handle all of your personal and financial affairs. However, if your significant other passes, or if you would like additional assistance, then this might be a good time to consider adding a child co-trustee. By adding a child co-trustee, they will be able to help manage your personal and financial affairs.

For example, my mother-in-law, who lived in Rossmoor, told my husband when she turned 85 that she wanted some help sending out her bills every month. We were more than happy to help. To facilitate this change, we added my husband as her co-trustee, which allowed him to pay all of her bills from her accounts.

Another benefit of adding your child as a co-trustee is that it allows your child to monitor all of your bank and retirement accounts.

Sadly, we have seen several seniors who have been wrongly taken advantage of and have lost substantial amounts of money as a result of fraudulent transactions. By allowing your child to monitor all your accounts, you can help protect yourself against these fraudulent transactions.

If I add my child as a co-trustee, what will their responsibilities be?

This answer will vary depending on your

personal situation and needs. The benefit of adding a child as a co-trustee is that your child’s role can evolve to meet your needs, as you get older. In the beginning, your child co-trustee can simply help pay your bills from your accounts.

However, if you later decide that you would like additional assistance, your child will also be able to manage your entire estate. For example, if you need additional help at your home, but don’t have sufficient funds, your child could sell, manage or move assets to pay for this additional support.

How do I add my child as a co-trustee?

Adding a co-trustee is a very simple process. We draft two documents for you and your child to sign. The first is a document appointing your child as a co-trustee and the second is an oath that your child takes promising to fulfill their fiduciary duties (i.e. promising to always act in the best interest of the trust).

While adding your child as a co-trustee can have some great benefits, it is important for both you and your child to first understand the responsibilities involved. Rio Vista 69th Bass Derby and Festival promises a good time for all

While there are a lot of fun things to do in the immediate area, there is always a little something for those who wish to venture out, like visiting the longest-running fishing derby on the West Coast.

The Rio Vista Chamber of Commerce is sponsoring the 69th-annual Bass Derby and Festival, on Oct. 7, 8 and 9, at 33 N. Second St., in Rio Vista. The three-day event includes a bass-fishing derby and a festival with car shows, live music, vendors, food, music, booths, a parade and fireworks. The festivities begin with a fish fry and barbecue on Oct. 6, at the corner of Front and Main streets, from 6 to 9:30 p.m.

“This is one of the only free festivals in the area,” said Cindy Green, an Oakley resident and Rio Vista Chamber of Commerce board member. “Parking and admittance is free, and we usually see about 10,000 people at this festival.

Also, anyone of any age can participate in the derby, during which, participants can fish any of the waters connected to the Delta.”

The festival takes place from 4 to 11 p.m. on Oct. 7; 7 a.m. to midnight on Oct. 8; and 9 a.m. to 5 p.m. on Oct. 9, at Front and Main streets. The beer garden stage will light up with sounds from all genres, including rock, R&B, soul, pop and country. There will also be a soap box derby for ages 7 through 15, sponsored by Stewart Industrial Supply, McPherson Crane & Rigging, J.C. Engineering, Paul Graham Drilling and Coughran Mechanical.

The derby runs from 6 a.m. on Oct. 7, until 3 p.m. on Oct. 9. Fish weigh-ins will take place after the official end of the derby. This year, anglers are able to choose between two

fishing contests on the same ticket. Adult first-, second- and third-place prizes will be awarded for striped bass, sturgeon and salmon. Kids’ prizes of cash and bikes will be awarded for striped bass and catfish.

“It’ll be good for everyone to come out and see what Rio Vista has to offer and get to know their neighbors,” said Green. “It’s nice down by the water, and there’s nothing quite like the small-town charm of a great festival and parade.”

Antioch resident Adriana Solorio enjoyed her family getaway at Tower Park with her two kids.

“We stayed in a deluxe cabin and had a great time,” said Solorio. “My kids were upset when it was time to leave, and we are looking forward to going back.”

Part of what makes camper’s experiences so enjoyable is the resort’s facilities. If guests forget something, they can head to the camp store and pick up last-minute items, camping supplies, cold drinks, snacks, live bait and more. If someone under packed, there are laundry facilities throughout the campgrounds. For birthday celebrations, family reunions and special events, the campground has a pavilion, with an optional kitchen area and grill.

Weekend events draw record crowds

ast County residents know how to have a good time, and that was never more evident than with last weekend’s myriad events held in communities throughout the Delta. In Antioch, crowds packed the popular and prestigious Delta Blues Festival, while in Oakley, the Heart of Oakley Festival drew hundreds to the annual street event.

Bethel Island had their 50s bash, and in Brentwood, the beer was flowing at the Craft Beer Festival, held in the community center downtown.

As the days begin to get shorter and we head into the last part of the year, now is the time to think about flu prevention and ways you can stay healthy.

Colds and influenza, or “the flu,” which has more severe cold-like symptoms, may be unavoidable, but you can still minimize the seriousness of an illness or how often you catch a bug with a few simple germ-fighting strategies.

Wash your hands. Washing your hands is the top doctor recommendation for staying healthy. Whether using a sanitizing gel or water and soap, make sure to clean your hands frequently. Viruses live on phones, doorknobs, money and basically everything else. So, when we touch surfaces and then rub our eyes or nose, we are exposing ourselves. If you sneeze and cough into your hands, wash them immediately, so you don’t spread germs.

Get an influenza vaccine. Influenza is the most serious viral illness every winter, and it affects millions of people.

The flu vaccine is the safest, most effective defense against it. The biggest misconception about the shot is the belief that it can give you a full-fledged case of the flu. It is simply not possible to get seriously sick from the flu shot, because it contains just a piece of the germ. It may cause your arm to be sore, and that can lead to general achiness, but that’s it.

It’s possible to catch a cold at the same time you get the flu shot, but that’s just a coincidence. The flu vaccine only wards off influenza, not other winter viruses, and it takes two weeks to build up protection. So, plan ahead and get your vaccination.

Limit exposure. One way to avoid sickness is to avoid sick people, because illness-causing germs are spread through touching contaminated surfaces or through the air. If you have a fever, wait at least 24 hours after your

fever is gone without the use of a fever-reducing medicine before returning to work, church or other places where people gather.

Live healthy. A healthy lifestyle of eating fruits and vegetables daily, exercising several times a week and regularly getting a good night’s sleep will keep your immune system strong and better your chances of keeping winter illnesses at bay. Many fruits and vegetables are rich in immune-boosting beta-carotene, vitamin C and vitamin E. If you do get sick, the best thing you can do is drink plenty of liquids and rest. That’s what the doctor orders.

The Art and Science of Budgeting When Newly Single Divorce has an uncanny ability to turn almost anyone’s personal financial situation on its head. 2. Avoid large purchases. For the short term, try not to rock your own financial boat with any large, unessential purchases, especially if they add to your debt. The last thing you need right now is an additional financial burden.

3. Evaluate and (re)build your credit. If you’ve carried joint credit with your ex-spouse for many years, you’ll want to establish good credit in your own name. Start by obtaining a copy of your credit report (you can do this once a year for free at AnnualCreditReport. com), and report any inaccuracies you find there.

4. Plan for the future. Once your shortterm budget is stabilized, it’s time to make a long-term plan for your new life as a single adult. Talk with a financial advisor about ways to build wealth, especially where assets from the divorce settlement are concerned. Assisted living nourishes fulfilling lives Her name was Frances “Francy” Fastner, and she was one of the most remarkable women I’d ever known.

She never married, but spent her life and hard-earned income on us kids.

She took me to Broadway shows and the then-famous Automat Senior in New York City for orner a fun meal, where you looked in a little window, made your selection, put your nickels in a slot and opened the door for your food.

As a kid, she was an inspiration, and I Marla was so happy when it Luckhardt was my turn to go on an adventure with her. At the age of 79, she met the love of her life - a handsome, dapper, 81-year-old gentleman named Jack. They both lived at an assisted-living lodge in the Bronx, and every night, he went to her studio apartment and cooked her dinner. Her favorites were his crab cakes and spaghetti.

Francy was my great aunt, and her apartment was my first exposure to an assisted-living community. Both she and Jack lived on the 14th floor of an enormous brownstone, and visiting her there was bittersweet. I knew she was well taken care of and safe, but I was also concerned that she would be lonely. I was very happy when

she and Jack became friends.

Sept. 11 through Sept. 17 was National Assisted Living Week. Now, places in our area are a far cry from that brownstone in the Bronx, and there are good reasons for their successes.

As in my aunt’s case, socialization is very important to us humans. When a spouse passes or a couple can no longer remain safe in their homes, they and their families will research options for senior living. The old connotation of putting mom or dad in a ‘home’ is replaced with deciding which senior-living lodge has the best amenities, activities and level of care needed. They remind me of a cruise ship without the water!

Some provide no caregiving, just a safe and friendly environment for seniors, like Quail Lodge. Some have nonmedical assistance, such as Cortona Park, while others have a full program, including memory-care options, like Westmont, Cypress Meadows and The Commons at Dallas Ranch. It can be a little overwhelming at first, but in the past nine years, I have come to know the best facilities in this area. It all falls in the lap of the people who work there and how they treat their residents.

Unfortunately, senior lodges are not covered by regular insurance, but some take long-term care insurance as a subsidy. These and other financial concerns should be part of your in-depth investigation.

Talk to others who have moved into each place and decide what level of care

you or your loved one will need. Revisit without an appointment and take a look around. Chat with some of the residents and see how they like their home, the care and, oh yes, the food! Most provide three meals a day and unlimited snacks. Some have full efficiency or kitchens. I guess all that is missing is that midnight buffet!

“Bringing light to a subject that used to be scary and taboo is now more of a natural process for seniors,” said Dowell.

Friends are made and loneliness is not an issue for most. Living there does not mean there is no need for family participation and advocacy. Visits are not only encouraged, they are welcomed, and families are urged to enjoy the facilities and activities with their loved one. My grandchildren love swimming in mom’s pool and eating ice cream with her.

Years ago, it was either that brownstone in the Bronx or living with adult children, like my great grandfather did with my maternal grandparents. We would visit weekly, but I always thought Poppa needed his own friends or even a gal pal. If he were with us today, I would bet he would have enjoyed some beanbag toss, bingo or karaoke! Aunt Francy, too!

Water news for East Bay residents The Diablo Water District (DWD) purchases imported wholesale water from Contra Costa Water District.

Recently, the wholesale temporary drought surcharge was eliminated and DWD passed the savings on to its customers, lowering water rates by $.19 per 785 gallons, which roughly converts to a savings of $2.77 for the average customer.

As of June 1, the restrictions on outdoor irrigation were eliminated as well.

While the drought surcharge and the restrictions have been lifted, the district still strongly advocates wise water usage, noting that there is plenty of water to use, but never enough to waste. For example, do not use water to clean hard surfaces, unless there is a health or safety concern.

Don’t water outdoors during and up to 48 hours after measurable precipitation.

Oakley Code Celebrating seniors enforcement update Over the last 30 days, Oakley’s Code Enforcement opened 195 cases and closed 310 cases.

Citizen use of Oakley’s web-and smartphone-based OnDemand program for reporting possible violations is increasing each week and has become an additional resource for the department.

Additionally, recent changes in the

municipal code has resulted in proactive collection of abandoned shopping carts, numbering more than 50 in three weeks.

he City of Oakley, along with local officials and residents, formally marked the opening of Catamaran Park, on Tuesday, Sept. 13. The new park is located within the Summer Lakes Development, at 2695 Manresa Shore Lane, along the lake. Misstatement 3: City council and the East Contra Costa Fire Protection District (ECCFPD) board members have not taken action to support reallocation efforts of ECV, other than to send a meaningless letter to the state legislature, of course.

Misstatement 4: A utility-user tax is not the only way to fund the fire district.

Young and the rest of the political appointments to ECCFPD Board of Directors have not addressed the structural-funding issue that plagues the district. Proposing a tax does not fix the problem; neither does transferring onetime Brentwood funds to the district fix the problem.

Young, an ECCFPD director, along with most entrenched government and political players, sees only one solution to any government problem: ask the taxpayers for more money.

But, voters have twice voted down fire district tax measures. Online surveys and public opinion polling, all paid for with public funds, tell the same story – that few people support more taxes. Taxpayers repeatedly say, “No new taxes.”

It is unfair to ask ECCFPD taxpayers to pay extra for a service that should be paid for with our current property taxes. We pay the same 1 percent as all other county property owners, and it is not our fault that lawmakers have failed to adjust allocation rates to reflect current needs.

It is unfortunate that Young expects an unfunded, volunteer, citizens-action committee (East County Voters for Equal Protection) to do his job.

Editor: Name calling? Really?

Ms. Huerta has decided that name calling and insults are the way to get her point across? “Debased minded” and “reprobate mind”? I have been called a lot worse in my 66 years, and by a lot smarter people.

Ms. Huerta, your narrow-minded, hateful bigotry is showing through your poorly formed arguments. To paraphrase what we all learned in childhood – sticks and stones may break my bones, but words will never hurt me.

Lets start with a little knowledge.

LGBT stands for lesbian, gay, bisexual and transgender. Lesbianism, gayness and bisexuality are all genetic traits. Decided by a person’s genetic makeup, they are like eye color, foot size and the shape of your nose. People have no control of their genetic makeup.

Transgender is a little more complicated. Recognized by the medical

community as a disorder, or condition, whereby a person feels that their physical gender identification is in opposition to their mental gender awareness. Recognized by the medical profession, and defined in the DSM as gender dysphoria.

There is nothing secretive or hidden about any of the conditions described and documented in the DSM. It is a medical textbook written by experts in the mental-health field. The same DSM used to define all mental illness diagnoses, such as schizophrenia, bipolar disorder and many, many more.

Being transgender does NOT make a person a bad person, any more than cancer, heart disease or any other medical condition does.

The need to teach our children about all human rights should be obvious to anyone with half a brain. Race, religion, gender, sexual identity and many other factors are what make people who they are. Children need knowledge so they can learn how bad hatred and bigotry are and how they tear apart the fabric of our society. People who hate blacks raise their children to be racial bigots. People who hate Muslims, Catholics or Jews – or any other religion – raise children who hate them, as well.

The poorly written and obviously unconstitutional Prop. 8 that Ms. Huerta refers to was not “overthrown” because those nasty LGBT people “went behind” people’s backs to four activist judges.

Prop. 8 was ruled unconstitutional by the U.S. Supreme Court because it was, simply put, unconstitutional. The fact that it had been written by hateful bigots and paid for by the Church of Jesus Christ Latter Day Saints meant nothing to the Supreme Court. It rules on law, not on hate.

Get real, Ms. Huerta. Boys and girls will not be showering together after PE class, and your boy is safe getting dressed.

Your statements notwithstanding, your argument is just so much horse-puckey.

You are not standing up for discretion, virtue, purity or decency. You are standing up for hate, bigotry and narrowminded idiocy.

The mention of pedophiles is hate mongering at it’s worst. Pedophilia is and should be a crime. It is dealt with by law enforcement the same way they deal with theft, assault and murder. And, as a person who was raised in Colorado, I can tell you that the Northern Colorado Gazette is a rag that is best used for cleanup in an old-fashioned outhouse.

We need to teach all our children about all kinds of cultures, races, religions, creeds, sexual orientations et al.

Then they can lead their lives knowing that they might choose to dislike someone for who they are, not for what they are.

Big plays push Freedom to 4-0 season

Freedom didn’t play its best football game last Friday against San Leandro, but it made plenty of big plays to notch a 48-20 homecoming victory and move the Falcons to 4-0.

Five of Freedom’s seven touchdowns came on big plays. Senior Ronnie Rivers returned a kickoff 89 yards for a score; senior linebacker Kyle Harmon had a 60-yard interception return for a touchdown; and senior quarterback Jonathan Pierce connected with junior receiver Baylei Coston on touchdown passes of 59, 39 and 38 yards. Rivers’ return evened the score immediately after San Leandro opened the scoring in the first quarter.

The Falcons never trailed again.

“I saw a lot of open field,” Rivers said. The blockers did a good job. I just made one cut and had to run. It was a good feeling, considering we didn’t play that great, defensively, on the first drive.

It woke us up.”

Harmon and the defense then stepped up big. The pick-six followed, giving Freedom its first lead.

When the Falcons’ offense finally returned to the field, it was struggling again, facing a third-and-19. That’s when senior quarterback Jonathan Pierce connected with Coston for his first touchdown of the night, a 59-yard strike the receiver caught perfectly in stride and sprinted in for the score.

“I saw that I had a little bit of space to go,” Coston said. “I burst, and I saw the ball coming out. I caught it and outran him.”

Despite that, Freedom could not put San Leandro away. A 1-yard score from Rivers was sandwiched between two Pirates’ touchdowns, leaving the Falcons with a 28-20 lead in the fourth quarter.

Nursing that lead, Pierce appeared to make a big mistake. He threw a short pass to the outside that was read perfectly

Goodall. Goodall broke on the ball and was en route to a certain touchdown, but dropped the ball. Four plays later, Pierce found senior fullback Kevin Longeran for an 8-yard touchdown, giving Freedom some breathing room.

The Falcons took advantage of a turnover on downs and a fumble on the Pirates next two possessions. Pierce and Coston connected on two more long touchdowns, capping off huge nights for both players. Pierce was only 11-for-18, but threw for 312 yards and four touch-

downs. Coston, meanwhile, caught seven passes for 255 yards and three scores.

With the win, Freedom maintained a perfect 4-0 record. The Falcons have outscored their opponents 186-48, but coach Kevin Hartwig wants to see more improvement before Bay Valley Athletic League play gets underway.

“We just have to keep getting better; it doesn’t get easier after this,” He said. “San Leandro is a great team. Bishop O’Dowd is a great team. Then, here we go.”

Heritage water polo teams sink Deer Valley Heritage boys’ water polo team continued its blistering start to the season this week with a 9-4 win over Deer Valley.

The Patriots (7-0 and 3-0 in Bay Valley Athletic League play) picked up two goals from Riley Pathe, along with one each

“We lost some of our forward momentum, but we were able to regroup and stay composed enough to pull out the win,” said head coach Nick Araujo.

Heritage jumped out to a 4-1 lead on Kirk’s goal with 27 seconds left in the second period, but Deer Valley charged back with two unanswered scores to pull within 4-3. Heritage struck back with three unanswered goals to pull comfortably ahead at 7-3 near the end of the third period.

“We went on a run there for a bit, and then we let them back in,” Araujo said.

Hawkins and Pathe each scored in the fourth period to close out the victory.

Dominique Oteri was sensational with five goals, while Shaylee Hanson added three and Emma Lapum and Sage Inderbitzen put in two. Sophia Mapalo, Emma Johnson, Brooke Santos, Meghan Troy, Alysiana Halter and Maddie Bursch each chipped in with one apiece. Isabella Strimling finished with eight saves to preserve the victory.

The Patriots (10-1, 3-0 in league play) cruised to a 7-0 lead after the first period and never looked back, scoring three goals in the second and four each in the third and fourth periods.

The Patriots’ girls’ squad is sinking most of its opponents, winning by an average of 12.5 goals. The team’s lone blemish on the season is a 9-4 loss to Marin Catholic at the Chuck McCollum Sierra Shootout on Sept. 16, which broke a seven game winning streak.

With a father who played six seasons in the NFL, it is no exaggeration to say that Ronnie Rivers has football in his blood. Big things are expected of Rivers in his senior year at Freedom High School, and if his first game is any indication, he is primed to deliver. Rivers ran for 183 yards and scored three touchdowns in the season opener against Turlock. His goals for the season include rushing for 2,000 yards and winning the Bell Game for the second consecutive year. Rivers also runs track and field and earned a 4.0 GPA last semester. Rivers enjoys playing video games and fishing in his free time.

River’s dream has always been to follow in his father’s footsteps to the NFL. For now, he’s concentrating on visiting colleges and choosing a school. Given his athletic and academic abilities, it is not surprising that he has already received offers from a number of schools, including the prestigious West Point Military Academy. Patriots’ cross country Patriot distance runners are off to a great start after competing successfully in the Monte Vista Invitational at Oak Hill Park, in Danville, which is home to the infamous Eliminator Hill, on the 2.1-mile course.

Jett Charvet became the first-ever Heritage winner at Monte Vista, when he took first place in the junior class race with a personalbest, cross-country time of 11:06:71. Juniors Dane Winding and Marcus Dawal also medaled in sixth (11:37:09) and 13th (12:04:02) place, out of 173 junior competitors.

Max Waechter took third place, out of 196 sophomores, with a race time of 11:25:41.

Logan Schaefer led his fellow Patriots in the senior division with a time of 11:36:83, and newcomer Alejandro Barros earned an eighth-place medal, out of 190 freshmen.

On the girls’ side, freshman sisters Abigail and Avery Rickli brought home medals in sixth and ninth place, out of 140 in their class, with times of 14:47:11 and 15:06:14, respectively. Sophomore Cori Flores ran a time of 14:29:80, completing the grueling course in twelfth place out of 137. Katherine Cook led the Heritage junior girls with a time of 15:34:54.

Senior Madeline Vanderheid ran a 14:19:35 leading girls’ team time and brought home a sixth-place medal in her division of 93 racers.

“I am so jazzed about the outstanding performances (yesterday),” said Heritage XC coach Jennifer Derego. “There were so many huge improvements that I can’t list them all.”

Benjamin Michael Needham

Nov. 14, 1996 – Sept. 10, 2016 Ben attended Krey, Adams and Heritage High, where he excelled at crosscountry, track, mock trials and many AP classes.

Ben loved reading, music and art, and he had a wonderful sense of humor.

Ben loved being outdoors, camping and hiking, and he passed away in a backpacking accident.

Ben is survived by his parents Matthew and Stephanie Needham; his siblings, Amanda, Jared and Julia; and grandparents Joyce and Michael Needham, Tina and Merle Hymas and Steve McKay. A funeral is planned for Saturday, Sept. 24, at 10 a.m., at the LDS Chapel, 1101 McClarren Road, in Brentwood.

Doris Mae Falck

July 7, 1926 – Sept. 15, 2016 Doris Falck passed away peacefully in her home of natural causes, at the age of 90.

She touched many lives with her positive outlook on life.

She is survived by her children, Carol Dutcher (Bill) of Livermore, Barbara Henderson (Hugh) of Brentwood and Janet Valdes (Vic) of Livermore; six grandchildren; and one great grandchild. She is also survived by her sister-in-law Avis Pangerl (Rubert) of Pine City, Minnesota. Her spirit will be missed by all who knew her.

She is preceded in death by her hus-

band, Robert, and her son, Steve.

She and her husband both grew up in Minnesota before moving to Northern California in 1957 to raise their family.

She was a registered nurse while living in Minnesota. She taught nursing at MTD Business College in Hayward, and then was a nurse at the Veterans Hospital in Livermore.

In her leisure, she enjoyed golfing, painting, playing poker and reading a good book.

Thanks to Hospice of the East Bay for their assistance in Doris’ final days.

The family requests that donations be made in her name to Hospice of the East Bay, 3470 Buskirk Ave., in Pleasant Hill.

Sept. 6, 6:15 p.m. A person was arrested for shoplifting on Balfour Road.

Sept. 6, 7:07 p.m. Two people forced entry into a location on Cornsilk Court. Both had restraining orders for the location and fled the scene prior to police arrival. One person was later located and arrested.

Sept. 6, 7:34 p.m. Two men attempted to use two counterfeit $100 bills to purchase beer at a business on Lone Tree Way. Both fled prior to police arrival.

Sept. 6, 10:34 p.m. Police arrested a person for possession of suspected methamphetamine on Sand Creek Road.

Sept. 6, 10:21 p.m. A patrol arrested a person found under the influence of a stimulant on Balfour Road.

Sept. 9, 4:04 p.m. Two people were involved in a physical altercation on Balfour Road. Both signed citizen’s arrest forms against the other and were later released on promises to appear.

Judgment from page 1 On Sept. 23, 2013, Burgess, a seventh grader at Excelsior Middle School, was hit

by Woolman’s SUV around 8 a.m. According to the CHP report, Woolman, who had a child at the school, was coming out of the northbound exit of the school, paused to look left for traffic before preceding to make a right turn out of the school. As she accelerated, she said she felt a ‘bump.’

After going 50 or 60 feet, according to the report, she stopped the car, got out and realized she had hit Burgess, who had been dragged under the chassis of the vehicle. He was pronounced dead at the scene.

However, according to Sumner, and based on witness reports and subsequent depositions, Burgess was riding on the shoulder of the roadway, not the road itself prior to being hit, and was likely still alive at the time he was initially struck. Witnesses reported that after Woolman hit Burgess, she stopped for approximately 40 seconds, but did not get out of her car before she began to move again. According to a witness deposition, she didn’t get out of her car to see what had happened, and she only stopped when an individual forced her.

“Burgess’ body was, at that time, wrapped up over a wheel of the SUV, jammed into the wheel well,” wrote Sumner in an email to The Press. “Burgess died, not from anything like head trauma, but from

being dragged and crushed under the vehicle.”

Despite the civil ruling, Mengke Hu, Burgess’ father, continues to dedicate himself to pursuing criminal action against Woolman.

According to Sumner, he likely faces an uphill battle.

“Charges would have to be brought to the district attorney (DA), and absent a referral from the CHP to the DA, nothing is likely to happen,” said Sumner, adding that charges would have had to been referred to the DA by the CHP following the initial incident.

For the Hu family, the tragedy has been their undoing. The strain of their son’s death led the couple to divorce, and today, Hu describes himself as homeless – dividing his time between staying locally at a friend’s home and sleeping by his son’s grave in El Cerrito.

“I knew I was living in the darkness, I just didn’t know how dark it was,” said Hu. “But, I want to thank this community and the people who have given so much help and support. It means a lot.”

As for the judgment money, Hu says those funds are not for him, but for getting justice for his son.

“That is to use for my son, not me; to get justice,” said Hu. “I can’t stop. I can’t stop fighting. I am the father.”
