The Brentwood City Council this week inched forward in the mandated process to alter how its future members are selected. The plan would replace the current at-large election process with a system in which council members are elected by a district that each would represent. The mayor would still be elected at-large. The move comes amid Walnut Creek attorney Scott Rafferty’s lawsuit threats alleging that Brentwood’s current voting system violates the California Voting Rights Act (CVRA) by fostering an arrangement that dilutes the Latino vote. The CVRA, signed into law in 2002, bans at-large election methods that impair a protected class’ ability to elect its selected candidates or influence an election outcome. see Voting page 18A

Over the last several months, a significant number of downtown businesses have closed their doors, but a group of property owners, business owners and city officials are attempting to take advantage of the opportunity to reinvigorate this critical part of the city. “Businesses will come and go,” said Brentwood City Manager Gus Vina. “I think a good sign of what we’re seeing is yes, we have vacancies. But immediately we have others coming in to plug the hole, which is very different than if we see things remain vacant for too long. I think those are two important pieces to the criteria. One is the turnover and the other is how long before they get filled.” Among the businesses that

This means new faces and new businesses to compliment the downtown community of businesses.” According to Berglund, the owner of Boards ‘N More recently purchased the Sun ‘N Stuff building at 320 Oak Street, and is moving into that space. A new owner now has possession of the space that Boards ‘N More vacated at

The owners of Rubiano’s, an Italian restaurant, are preparing their new location at 235 Oak Street, the former site of The Game Sports Pub N Pizza. They are targeting a March opening. Sip-n-Scoop is slated to move into Blue Saigon’s space at 234 Oak Street Suite B. The space previously occupied by J. James Bridal is still available. “We are very interested in working very hard on the downtown because downtowns are special,” said Vina. “I think that it’s only a matter of time before we see some big changes to accommodate the demand from the public for fun things to do. Taking care of your eyes I’m a night owl. No, I am not out tripping the light fantastic every evening. I am on the couch enjoying some of my favorite shows long after Grandpa has gone to bed. It is a quiet time for me to enjoy programs like Senior “Grey’s Anatomy” orner and “NCIS Los Angeles,” which are not on his list of shows that he enjoys or that we enjoy together. I record them and binge a bit until I can’t keep my eyes open any Marla longer and go to Luckhardt bed. Lately, I have noticed that my eyes get even more tired than the rest of me, and it almost feels like sand or something else is making them feel gritty. It also feels like there is something in my eyes causing slight blurriness. The light from the television is annoying when the brightness goes up and I find myself closing one eye at a time as the evening wears on. I had heard of dry eyes and the related symptoms, so, of course, it piqued my interest. I started my internet research to see what causes this and what can be done to correct it. After reading the symptoms,

I realized that I probably had some level of dry eyes. There are several reasons for this condition including our natural aging process, and for women it can be stirred up during or after menopause. Yes ladies, yet another charming addition to the already annoying menopausal process. Certain medications like the antihistamines can cause issues along with some diseases that affect your ability to make tears. These include, but are not limited to rheumatoid arthritis and certain vascular conditions. The heater and air conditioner in your home can be also be factors in the drying your tear flow. Reflex tearing is another condition created when there is an overabundance of tears. Confusing as this is, it happens when the lack of moisture irritates your eye and a distress signal is sent via your nervous system for more eye lubrication. Your body reacts by sending a flood of tears to compensate for the dryness. Mostly water, they don’t act like normal tears, which consist of water for moisture, oils for lubrication, mucus for even spreading, antibodies and protein to help deter infection. The lack of these ingredients can spark some eye infections and create discomfort. One of my kids sleeps with his

eyes partially open. It is kind of interesting to watch because he is sound asleep, but he is also looking right at you. Although it seems a bit funny to see, the inability to fully close your eyes while sleeping can contribute to dry eyes. There are a number of options. Ask your eye doctor what is right for you. It could be as simple as over-thecounter eye drops or ointments that help create your natural tears. This is most common. No product works for everyone, so you might have to try a few to find the one that’s right for you if that is what your ophthalmologist suggests. Be sure to also ask your

pharmacist whom, as my readers all know, I rely on for a second opinion in a lot of cases. If this becomes a chronic problem, you need to use the drops even when your eyes feel fine or they won’t stay wet enough. If your eyes tend to get very dry while you sleep and you wake up with that gritty feeling, you may try the thicker ointments at night coupled with some kind of eye goggles or sleep mask to keep the moisture in. If the symptoms are more severe or do not improve with drops, be sure to consult your eye doctor again and see if a more aggressive treatment is needed. Sometimes the ducts are clogged and will need to be opened. Don’t try this yourself. Let the doctor do it for you. Your eyes are very important and their health is imperative. I take a lot of vitamins and one of them is specifically for good eye health. It is not the answer to dry eyes, but I can only hope it helps in some small way. I plan on contacting my ophthalmologist to have him check to make sure I am keeping them healthy and lubricated correctly. Grandpa knows I don’t want to miss out on any of my favorite shows. Drag Queen Storytime an upbeat event by Tony Kukulich Staff Writer

More than 30 minutes before the start of Drag Queen Storytime at the Brentwood Community Center a crowd of adults, teens and parents with small children began to line up waiting for the doors to open. The event was hosted by the Brentwood Library and sponsored by the Friends of the Brentwood Library, and by the time drag queen Bella Aldama kicked off the evening with an upbeat song, the crowd had grown to more than 350 people according to an estimate from a library official. “I was thrilled with the community support of the event,” said Liz Fuller, senior community library manager. “The folks who attended were absolutely wonderful. They participated in the program and activities, cheered Bella on throughout, and the room was filled with great vibes. I was so proud of this community for coming together like this.” When the event was initially announced, not all embraced the idea. Detractors quickly showed up on the social media pages of news organizations sharing the library’s press release. A group of approximately 30 protestors did show up in City Park and gathered a short distance from the crowd waiting to enter. Standing in a circle they held hands and they prayed, but had little interaction with those attending the event. The attendees were

Doug Silva of the Brentwood Police Department referred to the protestors as “civil” and there were no reported confrontations. “I heard there were 30 or so people in prayer outside,” said Fuller. “I really appreciated that they came out as well and expressed themselves peacefully and respectfully.”

Aldama, who also read at the El Cerrito Library in September, gave a brief introduction and discussed what it meant to be transgender. She then read three stories – “I am Jazz” by Jessica Herthel, “Julian is a Mermaid” by Jessica Love and “The Family Book” by Todd Parr – that, according the library’s press release, focused on love and inclusiveness. Fuller noted that all three books are available at all Contra Costa County libraries. At the conclusion of storytime, Aldama received an enthusiastic response from the crowd and a long line of children and adults waited to thank her, give her flowers and have their photo taken with her. With the success of Drag Queen Storytime, Fuller is looking ahead to the library’s upcoming programs. “Some of the special kids programs coming up include African Dancing and a Dinosaurs Rock! event, a spring break movie, a Junkology recycling program in April and a Free Comic Book Day in May,” said Fuller. “For adults we’ll host three AARP Tax Help sessions over the next two months. In March we’re celebrating Women’s History Month with a visit from docents from the Rosie the Riveter Museum. Los Medanos College (LMC) is preparing to host its annual César Chávez Celebration Friday, March 29, from 6 to 8:30 p.m. A reception starts at 6 p.m., and the awards and recognition ceremony at begins at 7 p.m. The college hosts this event each year to honor the life of César Chávez and to recognize East Contra Costa County community leaders who continue his great tradition of service and social activism. One killed in Bethel Island blaze

Most real estate contracts come with several contingencies (inspection, loan, appraisal, etc.) which give the buyer the right to cancel the contract. There will be a certain number of days the buyer has to remove those contingencies. But what happens when the deadline passes? Is the buyer deemed to have removed their contingency(ies) or do they have to remove them in writing? That depends on the language in the contract. The standard purchase contract that most agents use is called the “RPA-CA” written by the California Association of Realtors. That contract uses what’s called the “active method” of contingency removal. The means that the buyer retains their contingency(ies) until they are removed, even if they go past the contractually agreedupon deadline. The seller can then send the buyer a “Notice to Perform” and if the buyer still does not remove their contingency(ies) within a certain amount of time, the seller may be able to cancel the contract, but the buyer will likely get their deposit back.

WHEN ARE CONTINGENICES LIFTED?

by Tony Kukulich A fire that broke out just before 1 a.m. Thursday, Feb. 7, claimed the life of one woman and displaced four other occupants of a mobile home on Bethel Island. “There were three adult females, an adult male and a child of an unknown age (in the home). Four of them were able to exit the structure and one was unable to,” said East Contra Costa Fire Protection District (ECCFPD) Battalion Chief Craig Auzenne. The Contra Costa County Coroner’s Division has identified the victim as Kira Marchington-Moon, a 62-yearold resident of Bethel Island. Two pets were also confirmed dead, and three other pets were missing and presumed dead. In addition to the fatality, two residents were transported from the scene by ambulance for treatment of unspecified illnesses and one firefighter reported suffering a shoulder injury while on scene. The incident remains under investigation, but ECCFPD Battalion Chief Ross Macumber told The Press that an electrical issue was suspected. The

The public is invited to Youth Expressed, an art show, panel presentation and reception for One Day At a Time’s Youth Expression Project (YEP) at the Delta Art Gallery. Over the last few months, students from Brentwood, Antioch and Oakley high schools have participated in writing or art workshops, gaining practical instruction on how to express what’s on their minds. The writers’ work has been published in a series of articles in both English and Spanish in the Brentwood Press, and they have produced a special YEP Journal that will be distributed with the paper, as well as at the Youth Expressed event. The Liberty boys’ basketball team ended its magical season Tuesday night, falling by a narrow 55-53 margin to Amador Valley in the first round of the North Coast Section playoffs. But no one who saw the end sequence will likely forget it. Senior guard Yoshi Aryen missed a jumper that would have tied the game. Fortunately, senior forward Skyler Newman was well positioned to not only grab the rebound but also tie the game with a putback layup, with only seconds remaining. Unfortunately, before the ball reached Newman, it hit a sagging overhanging wire that connected the basket to the rafters. This forced an automatic turnover. The Dons did miss a subsequent free throw to give the Lions a chance. But they could only muster a desperation three, which sailed wide as the time expired. “The ball has hit the wire so many times this year,” Liberty coach Jon Heinz said. “And we have the rebound at the basket, with Skyler going to put the ball in. That’s going to tie it with, what, 7 seconds left?” Offensively, the Lions struggled with

Amador Valley’s zone defense throughout the game. The Dons lineup frequently featured at least three players standing at 6 foot 5 inches or taller. That made Liberty the smaller team, something that hadn’t happened much during the season. The zone and length of the Dons disrupted running and passing lanes and forced the Lions to stay outside. While that did lead to Liberty making six threes — far more than normal — it also prevented the Lions from moving the ball around as well as they normally do.

Senior guard Kyris McInnis led Liberty in points, scoring 15. Junior guard Zach Moll sunk a trio of three-pointers and finished the game with 14, while Newman had 13. On defense, the Lions ran their normal press, but because of Amador Valley’s size advantage, turning the ball over before it could get to the low post was even more important. More often than not, the Dons’ guards were up to the task. Two low-post players did most of the damage for the Dons. Jaden Sheppard, the 6-foot-5-inch senior forward led all scorers with 16. Meanwhile,

Bellosguardo paced Amador Valley offensively in the first half, scoring nine points, while Sheppard had 10 in the second half. “I’ve got to give the credit to their guards; we didn’t turn them over enough,” Heinz said. “Their guards handled the ball well when they had the three big guys in the game. They handled the press, for the most part, tonight, and their big guys finished.” Tuesday’s loss ended a great season for the Lions. Prior to the loss to Amador Valley, Liberty had won 16 straight games. That span included all 10 of the team’s games in league play. That gave the Lions their first league title in more than 30 years and the first-ever title as a member of the Bay Valley Athletic League. “This one definitely stings - it’s bittersweet, in a way,” Heinz said. “It will be nice on the 25th when we get that banner and put it up. That’s something that nobody can ever take from us. Freedom boys’ soccer coach Sal Acevedo left his heart on the field during his team’s 2-1 win over Heritage in the regular season finale last week. But he had plenty of excitement to keep him alive. The Falcons’ Estevan Ayala scored the game-winning goal with under two minutes to play to clinch Freedom the Bay Valley Athletic League title for the second time in three years — just moments after the Patriots’ Ruben Huerta tied the game at 1 on a penalty kick. “I think it’s still out there somewhere,” joked Acevedo, referring to his pounding heart escaping his chest. “The feeling is just indescribable. That’s what sports are about. You work really hard for moments like these, so when they happen, you appreciate it. I’m so grateful to be here.” Freedom (11-7-3, 9-1 in league play) would have still clinched the league title with a draw. But Ayala made sure the Falcons went home winners and avenged a 4-3 loss to the Patriots (10-5-5, 7-21) earlier this season, Freedom’s lone loss in the league play. Ayala sprinted to the ball on the far left side of the field and arched a shot over Patriots’ goalkeeper Marcus Espinoza and into the bottom right side of the net, securing the Falcons’ 2-1 victory. “I saw the goalie come out, and the other half was open,” Ayala, a sophomore, said. “I just swung my foot and prayed it went in.” The winning goal set off a wild celebration on Freedom’s sideline and among its home crowd. Freedom has won nine of its last 10 games, all against league opponents, after starting the season 2-6-3. “We won a league title a few years ago,” Acevedo said. “But that team was talented and experienced — and so it was expected. Bay Valley Athletic League football MVP Sione Vaki recently signed his letter of intent to attend the University of Utah. This decision ends months-long speculation as to where the prized two-way star would play his college ball. The Rivals three-star-rated recruit had at least 12 offers from Boston College, Brigham Young, Howard, Illinois, Nevada, Oklahoma State, San Jose State, Tennessee, University of Southern California, Utah State and Washington State. “After my graduation, as you all know, I will be serving a two year mission for the Church of Jesus Christ of Latter Day Saints,” Vaki said. “I will then further my education and football career at the place where I will live and start a family long after football.” Vaki was a two-time all-Bay Valley Athletic League selection, which included being named the league’s MVP in 2018. He amassed 2,203 receiving yards and scored 42 touchdowns in his junior and senior seasons alone for Liberty, while racking up 118 tackles, five interceptions, two forced fumbles and two fumble recoveries on de-

City officials contend that the at-large election system doesn’t violate the CVRA, but feel that transitioning is better than fighting the issue. The change is estimated to cost the city up to $180,000 —far less than legal fees that it could rack up by fighting, and possibly losing, a lawsuit, said City Attorney Damien Brower. One of the transition’s first steps began this week, gathering the public’s input on how the four city voting districts should be divided. “There are a lot of different ways an area can be divided up, and that affects how people are represented,” said demographer Michael Wagaman, who’s guiding the district map creation. Resident John Case, the lone community member to provide input, cautioned councilmembers to proceed carefully. He envisions a future where councilmembers protect district interests at others’ expense. “What we are seeing here in the future of California is people getting territorial with their portions of the city, protecting their

own interests,” he said. “If you don’t support your particular group with the strength and might of a tiger, you will be unelected.” Each created district must be contiguous, contain roughly equal population and comply with a number of legal standards. Although at the center of the city’s switch, race cannot be a predominant factor in how districts are drawn, according to the U.S. Constitution’s 14th amendment. Other key factors routinely evaluated during map creation include: natural and man-made geographical and topographical elements, such as freeways, rivers and railroad tracks that inadvertently separate communities; keeping communities of interest, such as neighborhoods and school district boundaries, undivided; the location of public facilities or commercial interests; and district shape or compactness. “When you start getting districts that aren’t compact, that is where the term ‘gerrymandering’ starts popping up,” Wagaman, said. “Why is the district snaking around and doing all these things?” The federal constitution mandates that the most recent U.S. Census population data — in this case, from 2010 — be used to cre-

However Rafferty, whose 2017 letter initiated the city’s anticipated change in the election process of councilmembers, said he believes the population disconnect can be worked around by trying to align the U.S. Census Bureau’s somewhat updated threeyear-old American Community Survey data to 2010 numbers, since the legal benchmark allows for a 10 percent cushion. “If you are not (off by 10 percent) and your communities make sense, maybe that is satisfying both types of equality,” he said. Mildred “Babe” Perlichek Spraggins

Todd Michael Allan Souza

Oct. 2, 1944 – Jan. 15, 2019 Mildred “Babe” Perlichek Spraggins of Stockton, age 74, passed away peacefully on Jan. 15. She was born Oct. 2, 1944, in Burlington, North Dakota, to Louis and Millie Perlichek. She is survived by her brother, Gary Perlichek; her devoted husband of 58 years, Rand Spraggins; her sons, Randy (Dusty) Spraggins of Uniontown, Ohio, and Kevin (Judy) Spraggins of Woodbridge, California; and daughter, Annette (Dan) Fettig of Highlands Ranch, Colorado. She was a loving grandmother to Kalli Spraggins, Lane and Jake Spraggins, and Chloe, Jillian, and Daphne Fettig; and auntie to many nieces and nephews. Babe was preceded in death by her son, Kennon Spraggins; sisters, Tootie, Rosie and Donna; and brothers, JR and Russell. Milly was a second mom to many while raising her own children in Morada. She was known for welcoming all with a beautiful smile, loving hugs and a warm meal no matter what time of day. Milly ran a successful insurance agency in Oakley for several years and was active in the local business community. Everyone knew

who Milly was and enjoyed her infectious laughter and smile. Classy and beautiful both inside and out, Milly will be greatly missed by all who knew her. She was happiest spending time with family and friends or pursuing her hobbies: canning, baking, sewing, crocheting, shopping, traveling in the RV and (her all-time favorite) spending time with her grandchildren. A Celebration of Life will be held in Berthold, North Dakota, in July 2019.

1961 – 2019 Well-loved Discovery Bay resident Todd Souza passed away the morning of Monday, Feb. 4, 2019. Born in 1961 to Richard Souza and Sheila Schei in Castro Valley, Todd moved to Discovery Bay two decades ago and has since been surrounded by friends and family. Todd loved his girls, his girlfriend and his many friends. He loved being on the water and riding on his Harley. He was known for his wonderful smile, for being kind and generous, for making people laugh and for his strong work ethic. Todd is survived by his three daughters, Kori Souza, Bree Welch and Madelyn Souza; grandson Kayden Martyn; brothers Troy Souza and Jason Souza; and his live-in love and partner, Merci Ferretti. In lieu of flowers, the family would like donations in his name made to Family House in San Francisco as this is a special place to them. His friends and family will be having a fundraiser at the Discovery Bay Steakhouse from 6 to 9 p.m. on Friday,

Couples tend to have lots of things to do before saying “I do,” and organizing everything so ceremonies begin on time can seem as puzzling as a brain teaser. But certain scheduling strategies can help couples ensure they look their best and make it to the altar on time. ♦♦ Start with the ceremony. Couples can establish a framework for their wedding day schedule by working back from the ceremony. Once the ceremony time is set, couples who plan to take photos before their ceremonies can then work with their photographers to determine how much time they will need for photos and where they want to take the photos. Bridal parties may need transportation to the photo session, so determining when and where to take photos before the ceremony gives couples an idea of when to arrange for pickup. ♦♦ Confirm when the wedding venue is open to the wedding party. Before booking hair and makeup appointments, couples should confirm when they will be able to access their wedding venue. Brides may want to get their hair and makeup done at the ceremony sight, but that may only be possible if the venue opens early for the wedding party. If it does not, then brides must account for transportation time to the ceremony sight when making their wedding day schedules. ♦♦ Determine how much time is needed for hair and makeup. Weddings that feature large bridal parties will require more time for hair and makeup than ceremonies with small bridal parties. Grooms and groomsmen often take care of their own hair, though some grooms might want to

schedule hot shaves for themselves and their groomsmen. Grooms should ask groomsmen if they want a hot shave and then work with their barbers to determine how much time it will take to tend to all participants. Brides with large bridal parties may need to book more than two hair and makeup artists so everyone can get done on time.
