Police officer claims assault by supervisor by Kyle Szymanski Staff Writer
A veteran Brentwood police officer has filed a lawsuit alleging that her supervisor sexually assaulted her at a work-related, out-of-state training conference in 2017, and then pressured her to lie during what she is claiming was a mishandled Brentwood Police Department investigation designed to cover up the alleged incidents. The alleged victim, a 17-year member of the force whose identity will not be revealed per the policy of this newspaper, claims that nowretired Brentwood Police Lt. Sal DiMercurio forced her to engage in sex acts in his hotel room. The accuser alleges that the attack followed an assault the previous evening that she was able to deflect.
The suit alleges that DiMercurio persuaded the accuser to lie about the events during a Brentwood Police Department review, and that a fellow senior police department official asked her a series of “yes or no” questions designed to confirm DiMercurio’s account that “there had been no sexual intercourse and any contact was consensual.” Now-retired Brentwood Police Captain Ben Tolero, conducted the review, and is mentioned in the suit as having closed the investigation without determination of any violations. While the accuser admitted she supported DiMercurio’s version of the events, the complaint asserts that she did so out of fear of retaliation.

The owner of The Streets of Brentwood, the city’s largest retail center, has submitted plans to the city to construct 320 apartments on the east side of the 57-acre property. Facing a challenging retail market rocked by online competition, Fairbourne Properties, the Chicago-based operator of the mall, is seeking to change the city’s zoning to allow development of housing at the site. The property managers filed a 48-page development with the Brentwood Planning Department in February. City officials are looking to bring it before the planning commission for a hearing June 4.

There is no demand for more retail and the addition of residential is likely to help the retail perform better.” Planning manager Erik Nolthenius noted that the project could be a little contentious with the community. Given the strong opposition to some housing development proposals in the area, Nolthenius said he wouldn’t be surprised if the proposal drew some strong reactions. The Streets freeze out ice rink After two years of operation at the Streets of Brentwood, managers there have terminated the lease for The Big Chill ice rink.

The welcome has melted for the Big Chill ice rink as Streets of Brentwood managers informed rink owner Paul Bates they are terminating his lease. Bates believes he wasn’t given a fair shake by the mall’s operators – Chicagobased Fairbourne Properties. “They said we weren’t bringing in enough money,” he said. Representatives from Fairbourne Properties did not respond to multiple requests from The Press for comment. Casey McCann, head of community development for the City of Brentwood, said he is working with Bates to explore alternative sites. Bates, however, said the city has not been very helpful, and he believes the city is favoring his ice rink competitor, Brentwood on Ice, with public fund grants. “He has a lot of specific needs, like space, power to feed the compressors and other issues,” said McCann. “Our job is to be facilitators, not regulators. We understand

Heroes banners displayed at Veterans Park “ This is the type of event

Under warm, sunny skies, Brentwood took time Wednesday, May 22, to honor its sons and daughters who have served their country in uniform. For the third year, Honoring Our Heroes put 32 banners on display at Veterans Park, “to honor and recognize active-duty military personnel or military veterans that reside in, or have immediate family living in, the City of Brentwood.” Joined by scores of residents, veterans and their families, the event featured a color guard from VFW Post 10789, and was hosted by Vice Mayor Joel Bryant and Mike Meyokovich, the post’s vice commander. Bryant noted that Mayor Bob Taylor sent his regards, but was not able to attend the event. “This is the type of event that’s less about the politicians and just about our vets,” Bryant said, addressing the crowd of residents, other city councilmembers and police officers gathered for the event. Peggy Berglund, a senior analyst with the city who coordinated the program, added that she was enthusiastic and very encouraged by the strong response from the community who turned out to support their vets. “It’s certainly important to honor the veterans for their service, but also their families who also had to make sacrifices,” Berglund said. As the color guard unfurled their flags, local performer Johnny Staton kicked off the event by singing the national anthem.

The Honoring Our Heroes banners are currently on display at Veterans Park in Brentwood. Bryant called out a number of veterans’ names to come to the front of the podium and be recognized for their service. Nearly two dozen vets — wearing roses from the city staff pinned to their lapels — stood together, shaking hands as their names were called. Honorees included both active-duty military as well as proud veterans, some led to the podium by grandchildren or supported by walkers. The banners display the official military
photo of the service member or veteran, as well as their name, rank and branch of the United States Armed Forces. They are displayed in Veterans Park from Memorial Day to Veterans Day. After they are removed from the park, the banners are presented to the vet or the vet’s family. Berglund explained that, each year, the city solicits nominations from the public for the 32 banners to be produced under the Better in
Brentwood program. “Each year we get more and more interest and nominations,” Berglund said. “There’s no shortage of support for our vets.” This year’s “Band of Brothers” banners included: Shawn C. Daisy troop supports STEM programs A Brentwood Girl Scouts Daisy troop of 13 first-graders has donated more than $300 worth of materials to the Brentwood Library to encourage STEM education. The troop, led by Keshila Shannon, earned the funds by selling cookies, candy and nuts during the 2018-19 school year. After the girls learned some of the basics of science, robotics and programming at their respective schools, Shannon said they wanted to continue learning. “They were exposed to programming concepts in school and, seeing their interest, we decided to supplement it,” Shannon said. Shannon’s troop earned programming merit badges this year and also worked on a “Think Like a Programmer” project. One of the project’s key components involved taking action and sharing what they learn with others. The troop used their funds to purchase materials like snap circuits and magna-tiles kits,
which show science in action and allow kids to experience programming, electricity and machinery firsthand. To share their knowledge with the rest of the community and allow other kids to learn, too, they turned to the Brentwood Library. Shannon and her troop met with senior
community library manager Liz Fuller and youth services librarian Lindsay DuPont to put their plan into action. The partnership seemed fortuitous, Shannon said. “Our staff had been talking about incorporating more STEM programming into our regular slate of programs, and were about to
approach our friends and foundation with some ideas,” Fuller said. “At the same time, Keshila approached us with her offer of supplying the library with STEM-related items that the Daisies would purchase. We really liked the idea that these kits would come from the community, and that they could be shared with all of our library users.” Shannon’s troop presented the kits to the Brentwood Library on May 15, and they are now displayed in the library’s community room. Fuller said the library plans to use them for future STEM programming, like their Kids Create series, which will take place every third Monday at 6:30 p.m., beginning July 15. “We were very pleased that they thought of us for their programming badge, and that they were thoughtful enough to ask what the library could use to benefit the public,” Fuller said. “We appreciate it and will continue to provide programs that meet the needs of everyone in the community.” To comment, visit www.thepress.net

Trust Administration: What Your Successor Trustee Needs to Know by Joan M.Grimes, Esq. and Jennifer L.Wallis, Esq. You have a revocable living trust (‘trust’), and it is properly funded. You did everything you were supposed to do and you are organized. But have you talked to your successor trustee about your trust? Does your successor trustee know what they will need to do once you and your spouse die? Here is a list of some things that you should discuss with your successor trustee regarding their role in administering your trust: 1) Where are your estate-planning documents stored? Your successor trustee needs to know where your original estate-planning documents are stored (copies are not sufficient). If your original documents are stored in a home safe or safety deposit box, make sure your successor trustee has access. 2) What are your trust assets? What are your non-trust assets? Talk with your successor trustee about your assets. Explain to them which assets are held in your trust and which assets are not in your trust. After you pass, your successor trustee will need to secure all of your assets and should also create a spreadsheet outlining your assets and their value. 3) Obtain a taxpayer identification number and file tax returns After you and your spouse die, your successor trustee will need to obtain a tax identification number from the IRS. This identification number can be obtained online. However, it is highly recommended that your successor trustee meet with a CPA or attorney to complete the application to ensure
it is completed correctly. After you pass, your successor trustee will also need to file your final income tax return and may need to file a fiduciary tax return. 4) Notify your beneficiaries California Probate Code Section 16061.7 requires the successor trustee send a notice to all beneficiaries and potential heirs. 5) Distribute assets Once your creditors and other liabilities have been paid, your successor trustee will be responsible for distributing your assets. If you own real property, your successor trustee must prepare additional documentation to be submitted to the recorder’s office and county assessor’s office. Your successor trustee should consult with an attorney to ensure that the documents are prepared and recorded properly. At a unique crossroads between religion and cuisine, the Jewish holiday of Shavuot celebrates the giving of the Torah at Mount Sinai over 3,300 years ago. Shavuot literally means “weeks” and marks the completion of the seven-week period between Passover and Shavuot. The holiday is observed for two days, and this year is celebrated on Sunday, June 9 and Monday, June 10, following the holy day of Shabbat. As the Torah was given and the laws of kosher dining were first received, the Jewish people were not yet capable of properly preparing beef and poultry and, as such, ate dairy. The rest is history. Exquisite cheesecakes, ravioli, lasagna, Greek salad and, of course, cheese blintzes all take center stage during this ancient celebration. Some suggest that this has contributed to the renewed popularity the holiday has seen. When thinking of Jewish holidays, Passover, Chanukah and Yom Kippur
come to mind. Nevertheless, Shavuot is considered one of Judaism’s major holidays. In fact, at one point it involved a pilgrimage, during which all of Israel would travel to Jerusalem to celebrate in the temple. “No, it isn’t all about the food,” said Rabbi Peretz Goldshmid of the Chabad Jewish Center. “What is important is that the community is joining together, hearing the Ten Commandments and celebrating the Torah. But the good food certainly helps!” The Chabad of the Delta welcomes the community to it’s annual ice cream party and dairy buffet on Sunday, June 9, at 11 a.m. The Shavuot celebration is free of charge and all are welcome to join, regardless of Jewish affiliation or background. Senior agency conducting survey Contra Costa County’s Area Agency on Aging (AAA) has announced its 2019 Needs Assessment Survey for those residents 60 years or better. The survey’s purpose is to gather valuable data on the service needs of older adults and their caregivers residing within the county’s 19 cities. AAA will use the data for the county’s fouryear area plan on aging. The AAA is encouraging all seniors and caregivers to respond to the survey so the agency can collect ‘good data’ and be able to implement services that the community wants and needs. The Needs Assessment Survey is available online at www.surveymonkey.com/r/olderadultssurvey, as well as in print. Seniors and their caregivers may take the survey from May through September 2019. The results tabulation will take place during the fall and winter months, and be presented at AAA’s public meeting in March of 2020. The AAA Needs Assessment Survey is key to the entire planning and service delivery process. It presents who, what and why as questions to help determine which services are to be established. The
survey will inform the development and implementation of the Contra Costa Four Area Plan on Aging for delivery of services based on needs the community identifies. Two principal outcomes of the needs assessment are, first, the identification of the types and extent of existing and potential needs of older adults within the county, and of the services or resources existing within the county that are available for addressing those needs. The second is an estimation of unmet needs, under-utilized services and barriers that prevent access to available services. The goal of the area plan is to provide a comprehensive view of how services will address identified local needs and demonstrate integration into the community service network. The AAA reviews the analysis of all of its surveys with its Advisory Council. The AAA expects that the Contra Costa community’s service needs correspond with how the agency and its Advisory Council allocate Older American’s Act funds, recognizing that the need in the community in all areas often exceeds available services.

Brentwood Ace Hardware, a Brentwood staple since 1998, is gearing up for its post-remodel grand reopening on May 31st, at which visitors will be welcomed to an almost entirely new store. Aaron Rogelstad, general manager at Brentwood Ace Hardware, is looking forward to revealing the recent changes to the community. “We have remodeled almost every department,” said Rogelstad. “The addition of 4,000 square feet of space brought in many new and updated assortments of products in lawn and garden, rental and repair, a totally new tool department, as well as expanding our BBQ and outdoor living sections. In all, about 90 percent of the store has been remodeled.” Observing that the store hadn’t been remodeled in over ten years, Rogelstad and the staff felt the time had come for extensive improvements. “Our customers will benefit from a more efficient check-out experience and expanded assortments of product,” said Rogelstad. In addition, the store has acquired a delivery vehicle to transport purchases of $399 or more. Visitors to Brentwood Ace Hardware’s grand reopening will have access to special giveaways, discounts, and activities. “We are giving away a Yeti cooler on
Friday, a Weber gas grill on Saturday, a Craftsman tool cabinet on Sunday, and tons of other giveaways and promotions, such as a free small bag of soil with the purchase of a flower pot,” said Rogelstad. “The first 200 customers at our grand reopening will win a free, five-gallon bucket and get 20 percent off their purchase.” The event will also feature several demonstrations, including wood sculpture chainsaw carving on Saturday, BBQ demos by Big Green Egg and Traeger, and another demo by Milwaukee Tool. Cannabis revenue report The California Department of Tax and Fee Administration (CDTFA) recently reported revenue numbers for cannabis sales for the 1st quarter of 2019. As of May 15, California’s cannabis excise tax generated $61.4 million in revenue reported on the 1st quarter 2019 returns and the cultivation tax generated $16.8 million. Sales tax from cannabis businesses totaled $38.4 million in reported revenue for the same period. Total tax revenue reported by the cannabis industry is $116.6 million for first quarter returns. This does not include tax revenue collected by each jurisdiction.
In November 2016, California voters approved Proposition 64, the Control, Regulate and Tax Adult Use of Marijuana Act. Using CBD to treat chronic pain Not too long ago, I wrote an article about cannabis. I received a lot of email and requests for information about the cannabidiol (CBD) portion of the marijuana plant, which helps with chronic pain without the side Senior affects of tetrahydroorner cannabinol (THC) – the part that makes you high. There are a lot of products out there. Some are very helpful, while some pretty much do nothing at all except Marla take your money and Luckhardt promise results. I have arthritis, osteoporosis and two degenerative discs in my lower back. For years, I have tried everything from soup to nuts as they say, but nothing really helped me get through the day or sleep through the night.

In the 60s, most of the people I knew smoked pot only to get stoned. We never thought that the day would come when we would look to some of the marijuana byproducts for pain relief, and that it would be sold in stores. Here’s to getting older! CBD will not make you high even with the tiniest amount of THC that it all has, but it can deliver the many health benefits of the cannabis plant. Nearly half of the senior population in the U.S. suffers from arthritis, and 75 to 85 percent of seniors suffer from some form of chronic pain. I am one of them, and CBD has helped me quite a bit. After trying different products, I personally found CBD oil to be the most effective and easy to use. Everyone is different, so I can only share my experiences with the ones that I tried. CBD products also include gummies, cookies, topical creams and lotions, to name just a few. They make bath bombs (minimum 30 mg for best results) as well, and it did help me relax and took the edge off the pain. The good ones cost about $9 to $12 and come in a variety of fragrances, and you use the entire ball for each bath. CBD can reduce inflammation, alleviate or reduce joint pain and the effects of multiple sclerosis (MS). Research has shown that CBD can actually help strengthen the bones and even promote the healing process if a fracture does occur. With my osteoporosis, this is a big deal in my opinion. Seniors suffering from a wide range of health conditions have been prescribed all kinds of medications. As we continue to rely on pharmaceuticals to alleviate pain, we can ultimately develop a dependency.

Studies have shown that CBD may not only minimize or even alleviate conditions that often involve harmful medication, it can also help combat the dependency from that medication. I was prescribed pain pills and relied on them for my back. Since I started using my oil, I have not had to take any of those pills at all. Several places will sell hemp oil. The reason they can sell it anywhere over the counter is that the THC level is so low it is insignificant (less than 0.3 percent). The CBD level is also on the lower side and the results are not as good. The most beneficial oil comes in three levels of potency – 300 mg, 600 mg and 1000 mg per bottle, which contains approximately 40 dosages. I began with the 300 mg and it helped, but the 600 mg worked perfectly for my level of discomfort and pain. I place half of the dropper beneath my tongue and hold it for a minute to 90 seconds before swallowing. It is recommended to be taken one hour before or after a meal for the best results. To avoid the taste of the CBD, which is not awful but not great either, I get the citrus flavored one. There are

several options on flavors. The suggested half dropper is a standard serving, but ultimately, how much CBD oil you take will depend on an array of different factors including age, sex, weight, other medications you may be using and the condition you’re looking to treat. They recommend you start out with the low strength CBD and work your way up from there, until you find the smallest dose that works against the symptoms of your ailment. It can be pricey, but most dispensaries have a point system and introductory coupons for 10 to 40 percent discounts. I get mine at legally designated dispensaries and find their products to be excellent. If you decide to investigate using CBD, please talk to your doctor before trying it. My doctor was very supportive, since it is a natural product and does not go through your organs like medication, but make sure your doctor is on the same page. Once you begin, use a log or journal to keep track your dosage. Note how much CBD you took, what time you took it, how long the effects last and whether you noticed any side effects. CBD can help you like it helped me and several of my friends and colleagues. Not everyone is the same, and just like other medications, some work better than others. For me, CBD will last about 4 to 5 hours, so I can take it twice daily and remain 80 to 90 percent pain free. It does not correct my ailments, but I can function and enjoy those grandkids and my time with Grandpa so much more. Editor: The Deer Creek ad is misleading or bad information. Builders pay fees that are for capital improvements. For example, fire stations and fire engines, but not firefighters. Solution to public safety crisis presented to Brentwood residents
Editor: This past Tuesday afternoon, more than two dozen mostly Brentwood residents learned just how bad the public safety services situation is in East Contra Costa County, and what they could do to help improve the dangerous situation. With coordination and promotional help from Mike Sloan, residents of the Summerset IV community gathered in the Lodge ballroom and heard Bryan Scott, Chair of East County Voters for Equal Protection (ECV), describe the dramatic under-funding of the local fire district, East Contra Costa Fire Protection District (ECCFPD). Because of this

under-funding, ECCFPD is unable to respond to emergency calls for significant periods of time each month. In 2018, this time totaled over one full 24-hour day each quarter. ECCFPD is unable to fight a structure fire, like a house fire, without receiving the assistance of six firefighters and two fire engines from a neighboring fire district. Response times throughout the 249-square mile jurisdiction of ECCFPD far exceed industry standards, causing increased risk to life and property of area residents. A workable solution to this government-pending problem was also presented. Scott described a grass-roots plan to increase public safety services funding by nearly $9 million in the region, with no increase in taxes, using the voter initiative process. A summary of the ‘Brentwood Emergency Response for All Initiative’ was distributed, and Scott described how

the initiative’s plan would require the cities of Brentwood and Oakley to spend $7,912,005 of the growth in sales and property-tax revenues on public safety services, as defined in California’s Fire Protection District Law of 1987. There would be no new taxes, and the plan would be a first step to correct an egregious fiscal policy. The initiative process is defined in the California constitution and has been used repeatedly since it was enacted in 1911 to cure legislative inactivity. ECCFPD has stated publically and in press releases that it is unable to provide adequate service to area residents. This under-funding problem has been documented by the county’s grand jury, the Local Agency Formation Commission, an inter-governmental task force and fire services industry consultants. Previous attempts to remedy the under-funding situation involved
various forms of new taxes – attempts which all failed. ECV is now engaged in fundraising the nearly $50,000 necessary to cover the costs of getting the two voter initiatives, in Brentwood and Oakley, on the November 2020 ballot. Take a trip back in time with the Summerset Singers as they celebrate Woodstock’s 50th anniversary at their upcoming “Journey to Woodstock” performance. The concert will feature many of the songs from Woodstock 1969, in addition to other songs from the 60s. The Summerset Singers is a nonaudition chorus made up of over 60 men and women living in Brentwood’s Summerset community. All of the members were alive in 1969 and look forward to journeying back to that time by performing songs of the era. “This is not just a concert,” said Susan Stuteville, choral director for the Summerset Singers. “It’s more like a party celebrating music of the 60s. The music is iconic and there is something for everyone.” Stuteville says Journey to Woodstock is not just any choral performance. The event will feature music that had lasting influence on American culture. “Our audience will want to clap their hands, stomp their feet and sing along as we go back in time to that historic event known as Woodstock,” said Stuteville. “The singers experienced this epic time and we look back on this era with fond memories.” Music performed at the event will be accompanied by various instruments, including piano, drums, guitar and bass.

Brentwood’s Heritage High School baseball and softball squads both fell in North Coast Section (NCS) Division 1 championship games at Diablo Valley College in Pleasant Hill, last Saturday, May 25. Softball The Heritage softball team knew it would contend with the arm of Foothill High megastar pitcher, Nicole May, in its NCS Division 1 championship game. But the Patriots also had to deal with her bat. The University of Oklahoma-bound May crushed a two-run home run in the third inning, in addition to dominating Heritage from the circle, in the top-seed Falcons’ 2-0 win, securing Foothill an undefeated 28-win season, and their second NCS title in three years. “We played well,” said Heritage head coach Ron Rivers. “We had one hiccup of an inning where we had an error, but I thought we played well and fought hard.” In addition to the homer, May shut down the Heritage offense, surrendering only one hit, a walk and a hit batter, striking out 13 in a complete game. The second-seed Patriots (25-3) entered the game riding a 17-game winning streak, and had outscored their opponents 262-54 this season, including 12 shutouts. Heritage senior pitcher Delia Scott did her part, holding Pleasanton’s Foothill to only the two runs on seven hits, and striking out three. The Falcons stranded seven runners in the contest, including two at third base. But Heritage, making its first NCS title game appearance in 12 years, was hard-pressed to find any sustained offensive momentum, going down in order in five of the seven innings. Patriots catcher Julia Barnett drew a first-inning, two-out walk, but infielder Tianna Bell grounded out one batter later to end the inning.

Mike Dias wins PBA50 event at Harvest Park Bowl Mike Dias of Lafayette, Colorado, defeated PBA Hall of Famer and fellow lefthander Parker Bohn III of Jackson, New Jersey, 227-217, to win $7,500 and the title in the PBA50 Northern California Classic at Harvest Park Bowl Tuesday, May 28, for his third career PBA50 Tour title. Dias, who was the top qualifier for the stepladder finals, had trouble with pin carry in the first half of the match, leaving four nine counts in the first five frames, but after making what he called a minor adjustment, struck on the next four shots. “I was getting to the pocket fine, but needed to make a small adjustment with my hand position,” said the 62-year-old Dias. “I started getting a little more aggressive by getting my hand around the ball more at release, and just moved one board to the left to get a better angle, and that helped solve the carry problem.” After striking on his first shot of the 10th frame, Bohn — trying for his fifth career PBA50 Tour title — had an opportunity to win the match with another strike on the sec-
ond shot of the frame, but left a solid 7 pin, giving Dias the victory. Bohn, who qualified second for the finals, beat No. 3 qualifier Skip Pavone of San Jose, 280-256, in the semifinal to advance to the title match. “You know you’re going to have your hands full trying to beat a great bowler like Parker,” said Dias, who advanced all the way from the cashers round earlier in the day to take the top qualifying spot. “Even though he was coming off a big game, I knew he was going to have to adjust to some transition. I thought it might take something like 220 or 230 to win, and it turned out to be close to that.” Dias’ last PBA50 Tour win came in the 2014 PBA50 Grants Pass Open, but he did win the USBC Super Senior Classic for players 60 and over, in 2018, for his first PBA60 title. “I always thought I could win on the PBA50 Tour again,” Dias added. “You just never know how many opportunities you’ll get, but you try to make the most of every opportunity like I was able to do today.”

outh bowlers Dani Hom, Emily Rose Iles, John Reyes and Alex Hazzard all received scholarships for their stellar performances in the 2019 PBA50 Youth Pro-Am. Hom was the first place female winner, with Iles nabbing the scratch championship. Hazzard was the first-place boys’ winner and Reyes captured the boys’ scratch title. Pittsburg’s boys relay team of sophomore Clarence Strong, senior Willie Harts III, junior Jonzi Smith, and senior Jalen Adams also qualified for state. Their time of 42.44 was good enough for 18th place.

The high school track and field season came to an end over the weekend at Buchanan High School in Clovis at the California Interscholastic Federation State Championships. Unlike other sports, California does not divide its track and field athletes into different divisions for track and field. So, the athletes who qualified were unquestionably the best that the state had to offer. For the Bay Valley Athletic League (BVAL) athletes who qualified, the top event was the boys discus. Antioch sophomore Jailen Weaver — the only BVAL athlete not from Pittsburg to qualify for state — narrowly missed the finals. His distance of 155 feet, 2 inches put him in 13th position in the prelims, one spot out of the finals. As he’s a sophomore, there’s reason to be optimistic about Weaver’s chances in the next two years. Half of the 12 finalists in the discus were seniors. One of those seniors was Pittsburg’s John Maka. He was the only BVAL athlete to qualify for the state finals in a given event. He ended up finishing in eighth place with a distance of 166-10. Both of the Pirates’ 4×100 relay teams also qualified for state. The girls team of junior Elaija Danridge, sophomore Ariane Nelson, junior Aqeelah Hasim,

Name: Matt Quesada School: Freedom High School Year: Sophomore Sport: Football About: Matt Quesada is a boy who loves sports. The 16-year-old Freedom High School sophomore grew up in a home where sports were center stage. His dad, a former New York Giant, raised Matt on football, and he’s loved the sport ever since. “My dad grew up playing football, and he (taught me), and I just started loving the sport,” Matt said. At the age of 6, Matt began playing flag football, and in seventh grade he switched to tackle. When he arrived at Freedom, he was quickly pulled up to the varsity team. His dedication to the game has carried him through two seasons, and he hopes it will take him all the way to the NFL. “Really, you just need the passion for (the game), and your speed and strength and love for the game,” he said. “I work on skills and speed work and speed training.”

The Oakley native spends most of his time playing football and baseball or training to play. He also assists his uncle with community outreach through their church, Fellowship. Future: As a sophomore, Matt hasn’t yet received any offers from schools. He hopes to play football in college, and later for the NFL. reedom track star Cullen Davis, joined here by his mother, Dr. Brown-Lucas, signed his letter of intent to attend University of Louisiana Monroe during a ceremony at the school in Oakley this week. He plans on entering the medical field as a physician’s assistant. “I’m using my talents to help get me through college and achieve the dream that I want,” Davis told The Press earlier this year.

ing a one-two pitch over the right-centerfield fence. After the game, Rivers reflected on the team’s still-successful season. “I am proud of this group,” Rivers said. “We left a really good mark. We went 10-0 in league, won two tournaments, took second in D-1. We haven’t been here in a long time. It’s a big accomplishment for the group.” Baseball The Heritage baseball team landed the first blow against De La Salle in the NCS Division 1 title game. But the Spartans’ response put the Patriots down for good. De La Salle’s five-run third inning erased a 1-0 deficit, and set the tone for what ended up being a long day for Heritage in a 10-1 loss to De La Salle. “You have to take your hat off to De La Salle,” said Heritage head coach Kevin Brannan. “They are well coached.” Ryan Jackson’s third-inning RBI triple gave Heritage a brief 1-0 lead. But then the top-seed Spartans (29-1) exploded, scoring five runs in the bottom of the third, three in the fourth and two in the sixth to spoil sixth-seed Heritage’s first NCS championship game appearance. Spartan starting pitcher Kyle Harrison made life difficult for the Patriots, holding them to the run on two hits while striking out 10 in 5 1/3 innings. De La Salle relievers Cole Silva and Dylan White finished the job, surrendering only one hit and a walk in 1 2/3 innings of relief, to help the Spartans capture their 28th straight win and fourth consecutive NCS title. “We came with the intentions of winning, and the better team won today,” said Brannan. Heritage starter Jeffrey Heinrich held the Spartans hitless through the first two innings, surrendering only two hit batsmen, who were left stranded.
But De La Salle more than made up for it in the third, scoring five runs on four hits and two walks. Chris Santiago and Harrison’s back-to-back singles — scoring Jordan Wright and Nick Fusari — got the Spartans’ run parade started, giving De La Salle a 2-1 lead it wouldn’t relinquish. Jared Amigh’s sacrifice fly, Keoni Coloma’s bases-loaded walk and a fielder’s choice increased De La Salle’s lead to 5-1. Harrison’s fourth-inning double, scoring Fusari and Blake Burke, and Coloma’s squeeze bunt later in the inning, pushed De La Salle’s lead to 8-1. Santiago’s two-run, sixth-inning homer closed the Spartans’ scoring. Heritage (21-7) had bits of offensive success in the first three innings off the 6-foot-2-inch lefty starter Harrison — collecting its run, two hits, a walk and a hit batter — but were held to just two hits the rest of the game. Heritage loaded the bases in the sixth with two walks and an error, but Silva struck out Chase Goddard to end the threat. “Our guys were ready to play,” Brannan said. “I don’t think we were intimidated. We had one inning where we made a couple of mistakes and they capitalized on them.” The Patriots’ loss ends one of the best seasons in Heritage baseball history. The squad won its second consecutive Bay Valley Athletic League title, then upset third-seed Acalanes and second-seed Amador Valley en route to its first NCS title game. “Now that it’s over, it’s easy for me to say I think this is a team that I thought could do that,” Brannan said. “There is no quit in this group. Even when we get down a bit, they keep fighting. Even today, there was no hanging their heads or anything like that. The accuser, who has been on medical leave since February 2018 and unpaid leave since July 2018, served as a negotiator on the department’s Crisis Negotiation Team, which DiMercurio commanded. DiMercurio, who retired Feb. 9, days after the suit was filed, had a previous history of workplace sexual harassment and misconduct, according to the suit. The accuser is seeking unspecified damages. “For 17 years, I was a police officer dedicated to protecting the safety of the citizens of Brentwood,” the accuser said in a statement provided by her attorney, Jayme Walker. “When I came forward about sexual harassment and assault by my supervisor, I was intimidated to keep quiet and my supervisor was not held accountable. I felt I had to file this lawsuit because I wanted to encourage other women in uniform who may be experiencing harassment by a man in power to come forward and report it.” Brentwood City Manager Gus Vina, speaking on behalf of the city and the police department, said that the allegations have been taken extremely seriously, but in an emailed statement he declined to elaborate. “This issue pertains to a confidential personnel matter, and therefore our ability to comment is very limited,” he said. “In order to make sure this matter is handled in the right way, with the appropriate seriousness and consideration, we are not going to litigate it in the press.” Attempts to contact the attorney reportedly representing DiMercurio for comment on this story were unsuccessful. The alleged incidents occurred over two nights in 2017 during a week-long California Association of Hostage Negotiators training in Reno, Nevada, attended by DiMercurio, the accuser and a Brentwood Police sergeant. On one of the nights, according to the suit, the accuser texted DiMercurio that she was unable to sleep because she forgot her sleeping medication. DiMercurio allegedly responded by offering to bring cold and flu medicine that causes drowsiness to her hotel room. After he arrived the accuser received a phone call, and DiMercurio allegedly instructed her to come to his room when the phone call was over. The accuser then went to DiMercurio’s room and found him in bed without a shirt, and later discovered he was naked, the suit

alleges. As she was standing near his bed, DiMercurio suddenly leaned forward, grabbed the victim’s wrist, and pulled her onto the bed, according to the suit. The accuser immediately pulled away from him, saying “no,” and then returned to her room after being in his room less than a minute. DiMercurio instructed the victim to erase text messages related to that evening, as he was concerned that they would be discovered by her husband, according to the suit. The following night, after the three officers had dinner together during which DiMercurio provided the accuser with alcohol he had brought from home, he called her work cell phone and again told her to come to his room. When she arrived, he opened the door, led her in and blocked the exit, according to the suit. The suit alleges that DiMercurio then forced her onto the bed with him, pressuring her into oral and vaginal sex, while grabbing her arms so tightly they were bruised. The exchange was interrupted by a phone call from the accuser’s husband via a video-calling service, causing DiMercurio to roll to the floor to hide, and ordered the victim out of the room partially clothed, the suit says. “The victim never gave any express or implied consent to the sexual acts forced upon her by DiMercurio,” the suit says. “To the contrary, she feared for her safety and was doubly concerned that DiMercurio would destroy her career if she refused.” The accuser claims in the suit that she complied with DiMercurio’s request to return to his room that night because he was her commanding officer and she wanted to discuss the first night’s events. “As DiMercurio had been respectful during dinner, she had no reason to believe that he would again attempt to sexually assault her,” the suit says. “She went in a second time to try to straighten this thing out and that is when he attacked her.” said J. Gary Gwilliam, an attorney with the accuser’s team. The accuser didn’t seek criminal charges, because she felt civil action would lead to the best resolution of her claim, Gwilliam said, noting that district attorneys and police officers are “very reluctant to go after their own.” “I don’t think she thought it was a real-

not pushing out against the urban limit line,” Griffin said. The one aspect of the project’s design that caused her concern is the proposed buildings’ three-story height. Griffin said she believed the local fire department isn’t equipped with ladders capable of reaching the roofs. But she said she would have no objections if it’s “walkable.”. Called “The Apartments at the Streets of Brentwood,” or “Anden Apartments,” the plan says the units are envisioned to create a vibrant, mixed-use district in the city of Brentwood. The shops provide retail, dining and entertainment opportunities, and the proposed apartments would help support those services by adding patrons within a short walking distance. By bringing additional customers into direct proximity of the shops, this would help to stabilize the existing tenants, support local businesses and hopefully help fill the vacant spaces within the shops, the plan theorizes. The proposed project includes 320 apartment homes in

istic option to go after him,” Gwilliam said. “He certainly did commit a crime, but once the police officers are in that situation and they are denying it, she felt her best resolution to this claim was to get serious about a civil claim against him rather than a criminal claim. In other words, she did not feel a criminal complaint against him would be successful.” The suit alleges that the Brentwood Police Department also mishandled the investigation of the incident after being alerted by the accuser’s husband, approximately two months after the alleged events. The accuser’s now ex-husband, according to the complaint, reported to Brentwood police that he believed DiMercurio and his wife were having an affair after he noticed behavior changes in his wife and subsequent text messages, which appeared to indicate that DiMercurio and the accuser were in the same room during the trip, the suit says. The accuser called DiMercurio the day after the text message discovery, telling him the text messages were found and of her plans to divulge the sexual assault to her husband, the suit says. DiMercurio directed her to remain quiet and deny sexual contact, the suit alleges. The suit alleges Tolero and Police Chief Tom Hansen made a decision to open only a supervisory inquiry — “which eliminates the possibility of discipline other than verbal admonishment or counseling and is only appropriate where there has been a training gap or minor performance issue instead of misconduct” — instead of an internal affairs investigation. DiMercurio later claimed to have accidentally dropped his cell phone in the Sacramento-San Joaquin River Delta, destroying additional evidence, the suit says. Tolero closed the investigation without finding any violations about a month after the department was alerted, the suit says. Gwilliam said DiMercurio was threatening the accuser throughout the entire investigation. “He was saying, ‘Go along with my story, this is what I am going to say, I am going to say this and I am going to say that.’ She was feeling threatened by him and continued to feel threatened by him that entire time, and Captain Tolero and Chief Hansen were both playing into that. I think what is really important about this is they did not do an investigation. They didn’t tape anybody, they didn’t talk to anybody, and
15 buildings of 10-28 units each. The plan further breaks down to 125 one-bedroom units, 131 two-bedroom and 64 three-bedroom units, to appeal to a wide variety of family sizes. The floor plans range from 646 to 1,086 square feet. The buildings are designed to have front doors off one side — the paseo side — and parking off the other side, served by drive lanes. Each unit would include a covered parking space, either a one-car garage or a carport. The proposal also includes additional, uncovered, surface parking throughout. Rent-cost projections weren’t covered in the submitted plans. After reviewing the original proposal, city staff asked the developer to make a number of changes: add a minimum-six-foot high barrier around the entire project perimeter, security gating at the entrances off the main drive aisles, license plate recognition cameras at the main entrance and Shady Willow Lane, upgrade the sewer along Highland Way, acoustical analysis and construction of a sound wall.

All this was done in order to intimidate her and keep her from making a formal complaint of the assault.” DiMercurio, who also allegedly grabbed at the accuser’s vagina through her clothes without consent during a meeting in his office about a month after the alleged incidents occurred, continued to pressure the accuser into saying that no sexual intercourse occurred, after the department’s investigation into the out-of-state events concluded, the suit says. In one instance, DiMercurio and his wife persuaded the accuser to “remain quiet about the sexual assault” in a meeting with her at their house about a month after the department investigation concluded, the suit says. “She (the accuser) never went to them, they came to her, they wanted to sit down and meet with her and see if they could talk her out of not proceeding with her claim,” Gwilliam said. “The wife was involved in it at the direction of her husband. It wasn’t like she came out on her own. She was trying to save his career.” The accuser was also contacted by a sergeant supervised by DiMercurio about her status about 13 days after she went on medical leave, the suit says. Approximately two weeks later, two officers, one supervised by DiMercurio, came to the accuser’s home to investigate an alleged 9-1-1 call that did not occur, the suit says. About a month after that, and days after the victim filed her government claim, DiMercurio’s wife allegedly came to the accuser’s home, alleging that DiMercurio was suicidal. She reported that incident to the police chief and city manager the same day, the suit says. “He was putting a lot of pressure on her and she (DiMercurio’s wife) was too,” Gwilliam said. The accuser has undergone psychological therapy, with experts advising her not to return to police work, Gwilliam said. She will seek enough monetary damages to redirect her working career in a new field, cover any necessary training and or education expenses, and adequately cover her psychological damages, Gwilliam said. “We want the City of Brentwood to pay for what she has lost,” he said.
