Leaving a legacy of service by Tony Kukulich Staff Writer Before his death last month, Korean War veteran Alfredo Garcia had more strength and stamina than many men half his age, and he spent that energy taking care of his family, veterans and his beloved community of Brentwood where he lived for the last 63 years. “At 85 he still had so much energy,” said Victoria Garcia, youngest daughter of Alfredo. “He had lots of energy, (and a) big heart.” Alfredo passed away on Oct. 24, but the story of the man referred to by friends and family as “the unofficial mayor of Brentwood” isn’t in his passing. Rather it’s in the legacy of service and selflessness that he leaves behind. Mike Clement, hall manager at Brentwood Veterans Hall, was close with Alfredo for many years and said that he worked tirelessly at the facility without complaint. According to Mike, Alfredo would often show up late at night after an event and work until 2 or 3 a.m., not leaving until it was spotless and everything was put away. “He had been retired, but he still had a purpose in work,” said Mike. “His purpose was his dedication to veterans and his dedication to this hall 100 percent along with dedication to his family at 200 percent. There was not enough Al Garcia to go around, but there was a lot of Al in one guy. And nobody ever felt cheated.” Victoria also spoke about Alfredo’s dedication to his wife and three daughters. “He loved us girls, but my mom was

“ He cared about his country. He cared about Brentwood. And he cared about people.

Victoria Garcia, daughter number one,” said Victoria. “He loved her so much. She was so lucky. He truly, truly loved her.” Alfredo was interviewed by Mike’s son, Matthew Clement, as part of Matthew’s Eagle Scout project, and that video interview was accepted by the Library of Congress for

inclusion in the Veterans History Project. Matthew said it was Alfredo’s ability to persevere that most impressed him. “Something that I learned from Al is that you can always do it,” said Matthew. “It doesn’t matter how hard or how easy it is. It matters how you can maneuver through it. I learned how to never give up on anything, even if it was the hardest thing in the world.” Alfredo’s far-reaching impact on his community was reflected in each of the nearly 400 people who showed up for his memorial service. “He cared about his country,” said Victoria. “He cared about Brentwood. Contra Costa County Public Works will repair guardrail No. 3 on Marsh Creek Road, approximately half a mile West of Morgan Territory Road. OUT OF AREA AGENTS We are seeing a big increase in the number of out of area agents that are bringing buyer clients to “affordable” East County. I welcome them and work well with those that are professional and hard-working. Sometimes they just can’t get out in person to show the property due to a true scheduling conflict and I’ll arrange to give their buyers access. However, there are a minority of these out of area agents that are really pushing the boundaries of what’s considered “normal business practice.” They are expecting the listing agent to show the homes to their buyers for EVERY showing, or contacting the seller directly to let the buyers in without the agent present (a huge no-no). Then once the home is in contract, they again ask the listing agent to let the inspector(s) in, and then again to let their buyer in for the walk-through. Many times the buyer’s agent NEVER visits the property. And I’ve heard from many other local agents that this is a very common situation right now.

I’m not suggesting that I’ve never had a scheduling conflict in my career where I couldn’t provide access to a buyer. But when that happens I’ll ask another agent in my office to help me out, knowing that I’ll do the same for them. Only in an extreme case would I contact the listing agent for access. I believe that every agent should have every opportunity to solicit the business of any client they want to pursue (assuming they are complying with all relevant legal requirements). However, it is still up to the client to decide which agent they choose to work with. So my advice to buyers is to expect at least the minimum level of service from your agent. Can someone put you in a home without your consent? Incapacity Provisions in a Trust by Joan Grimes, Esq. Recently, my mother passed away and I was reading her trust. If a trust is drafted properly, it will give the trustees and beneficiaries a window into the life of the grantor. In many cases, it is like a heart-toheart talk or a diary telling you the innermost desires and wishes of the grantor. In the case of my mother, one of her biggest concerns was her care if she should become either physically or mentally incapacitated. She wanted to be sure she could maintain her independence as long as possible and on her terms. In order to accomplish these objectives, her trust outlined what she wanted done in great detail. First, she wanted to make sure her incapacity, if she did not agree voluntarily, would be established by two licensed physicians who were not related by blood or marriage to her or her beneficiaries. Second, she wanted to make sure that her assets were used first and foremost for her health, education, support and maintenance. Third, if she was not able to care for herself, she had specific directions for the trustee to provide a standard of living and care. In her case, it was her desire to remain in her home as long as it was medically practical and that the trustee was authorized and directed to provide in-home services so long as the cost to provide such care did not exceed 200 percent of the cost to provide such services in residential care. Fourth, if it was necessary for her to be in a residential facility, she wanted a person to be hired to visit her regularly, at least once a week, unannounced, to evaluate the level of care that she was receiving. In the event that the care was determined to be deficient,

she was then to be moved. Fifth, she specifically provided that if she were to live in a residential facility, the facility chosen should be the smallest one with the fewest number of patients. Finally, my mother was very concerned that her current medical insurance company i.e., an HMO, would not pay for treatment that the trustee or doctor might determine to be desirable. Therefore, she specifically provided that the trustee was authorized and directed to secure and pay for the costs of a second opinion and to pay for said treatment if it was determined to be in her best interest. Further, she directed the trustee to employ a professional advocate to negotiate with the medical organization for the purpose of obtaining coverage for the treatment. In conclusion, if you have a trust or will, you should review its terms regarding incapacity. If the trust or will provisions are not what you want, you should consider amending the documents to correctly reflect your wishes and desires. While my mother was very fortunate to die at home after a short illness, that will not be the case for many of us. We may not be able to control our physical or mental health, but we can control how our assets are used to care for us. Heritage girls’ water polo team advances to NCS championship match by Kyle Szymanski Staff Writer The Heritage High School girls’ water polo team cracked open the history books with their first ever North Coast Section playoff win on Nov. 3, and now, the Patriots are turning the page with another historic achievement. The second-seed Patriots are headed to their first North Coast Section title match after defeating Liberty 17-10 Nov. 7 at Heritage High School. Heritage was scheduled to clash with top-seed College Park on Nov. 14, the match now postponed twice since Nov. 10, due to poor air quality stemming from the Camp fire in Butte County. “There is no way this has hit us yet, because we have never gone this far before,” said head coach Jeff Lapum, still wet from a celebratory jump in the pool after the Patriots win. “(The girls’ program) has never won two playoff games in the history of our school.” Heritage’s Ella Simone scored a match-high eight goals, Kayla Longoria had three, and Emma Lapum and Maddie Bursch each chipped in two. “It feels really great,” Simone said. “We have worked really hard for this.” The Patriots (18-8 and 8-0 in league play) never trailed in the contest and out-

scored Liberty 10-5 in the second half to secure the win. Up by only 7-5 at halftime, Heritage rocketed off with six unanswered goals, including two each from Simone and Bursch, in the third quarter to take a commanding 13-5 lead. “The girls were just really fired up to play tonight,” Lapum said. “I knew they had it in them.” Katie Schaffer kickstarted Heritage’s

grand night with a goal in the first minute of the match, and the Patriots’ lead grew to as high as 6-1 in the first half, before Liberty drew within 7-5 at halftime. Olivia Doria led the Lions with six goals in the contest. Paige Henson added two goals, and Trinity Otis added one for the Lions. Liberty ends its impressive season 18-7 and 6-2 against league opponents, all league losses coming to Heritage. Heritage didn’t play Las Lomas this season,

Los Medanos College soccer Moving on team wins conference title by Jesus Cano Correspondent Iconic princesses are often the protagonists of Disney films, but the Los Medanos College (LMC) women’s soccer team had a Cinderella story of its own this season. While it may not have happened just the way they wanted, the team achieved what seemed impossible at the beginning season – winning its first Bay Valley Conference title in at least 24 years by tying Solano College 1-1 in its last regular-season game of the year. It was a journey that began with a rough patch when LMC finished its non-conference play with a four game winless streak and was outscored 12-2. LMC, however, was far from finished. The Mustangs went 10-1-1 to finish Bay Valley Conference play, and they did not allow a goal through 10 games. Sydney Vueve’s rebound shot off a corner kick in the first half was the conference-clinching goal, but LMC’s strong defense was the key throughout the draw with Solano. Sophomores Emma Spears and Briana Olmedo were two of LMC’s most reliable players on the back

line throughout the entire season. The number of steals made a difference in the game, especially in the game’s last 15 minutes when Solano was firing on all cylinders. “Last time we played them, their forwards were really aggressive,” said Spears. “They’re physical, but I know that when we really communicate, we work together, we can hold them. It gets stressful, but we keep each other calm. It’s just making sure the whole team is defending together and not just the backline. Because if it’s just the backline, then there’s way too many players to defend.” LMC head coach Zach Sullivan said the team brought in extra players to shore up its defense. “We brought in a couple extra players to defend, because we knew they were going to try to bring in their forwards, they’re pretty fast,” he said. “We relied on playing defensive and not really trying to score, just getting players behind the ball.” With just under two minutes to play, the Mustangs’ defense committed a foul in the goal box, resulting in a penalty kick. iberty High School volleyball player Kaitlyn Sexton recently signed her letter of intent to play for the University of Pittsburgh-Bradford in Pennsylvania. Sexton, a three-year varsity player, finished her career with 295 kills, a 256 hitting percentage, 102 blocks, 77 digs and four aces, according to Maxpreps.com. The Lions finished 20-10 and 8-2 in league play her junior season and 20-9, 10-0 in her senior campaign, both records good enough for the Lions to reach the North Coast Section playoffs.
