Fine art thrives in innovative gallery by Samie Hartley Staff Writer Brentwood’s largest art gallery is probably also the best-kept secret in town. In fact, Saunie Fridley, owner of Fridley Art Gallery, said most people discover her art room by accident. “A lot of people don’t know we’re here,”Fridley said as she walked the halls of Valverde Plaza. “People will stop by Prevot’s for lunch, and they just happen to stumble onto our gallery. Then they tell their friends. People are finding out about us through word of mouth, but we still seem to be a secret from most of the community.” Fridley Art Gallery is officially a single room located on the second floor of Valverde Plaza on First Street, but the work of 46 local artists graces the walls of the entire building, covering the walls in the hallways

and stairwells. If there’s a naked surface, Fridley finds a piece to hang on it. The result is a collage of more than 150 items of art throughout the plaza. “I don’t think people realize how many talented people live in this area. I feature work from artists throughout the Bay Area, but many of the artists are from Brentwood, Discovery Bay and Antioch. People who come by ask what the theme is, but there’s no conceptual theme – the local artists are the theme.” With no set parameters, Fridley hangs art of all media, from the paintings of Marilyn Pellouchoud to the metal sculptures of Oakley resident Michael Geltz. An amateur artist herself, she also features some of her paintings in the gallery. All items in the gallery are for see Arts page 21A

A museum that packs a punch for fans of the past is ramping up for its season opener.

New plant brings power to the people PG&E’s recently opened power plant on Wilbur Avenue is big, imposing, noisy, metallic, tubular, gray and sculpturally magnificent. One thing it’s not: sexy. So when PG&E sent out a press release to Bay Area newspapers, radio and TV stations, offering a tour of the Gateway Generating Station last week before it was unveiled to local dignitaries and the public yesterday – the media yawned and stayed away in droves. But this newspaper and another local paper showed up for what became a private tour of PG&E’s first new power plant in more than 20 years in this energy-thirsty state. The powerful behemoth has been slowly rising for the past two years at 3225 Wilbur Ave., next door to the gigantic smokestack at a Mirant-owned plant. PG&E’s plant can’t compete with the stature of that smokestack, but it features an emblem of its own,

and long pants – the better for wading through the numerous water hazards puddling the grounds after recent rains – a hard hat, goggles and a fluorescent vest. “We take our safety very seriously here,” said Randy Livingston, PG&E vice president of power gen-

eration, who led the tour. A sign on one of the towers reinforced that message: “It’s Better To Lose A Second Of Your Time Being Safe Than To Lose Your Life In A Second Being Unsafe.” The $386 million plant, which began construction two years ago, went commercial on Jan. 5, producing up to 530 megawatts – enough electricity for PG&E’s nearly 400,000 northern and central California customers. The 7-acre plant site produces the same amount of energy as 4,800 acres of solar panels. The plant is state-of-the-art and efficient. It uses 97 percent less water than older plants, produces 96 percent less discharge and yields 35 percent less carbon dioxide per megawatt hour, according to PG&E. This conventional power plant might not be as sexy as solar, but when the temperature hits triple digits this summer and everyone from see Power page 21A

New chief of staff no Doogie Howser by Ruth Roberts Staff Writer

Ryan Tracy likes to plan ahead, and apparently he comes by it naturally. “I remember getting a goodie package from my folks not too long ago and in it were cookies and a T-shirt and at the bottom were their end-oflife directives,” said Tracy. “I just laughed and said, ‘That’s my parents.’” And that’s their son: Dr. Ryan Tracy, the new chief of staff at Sutter Delta Medical Center. Tracy began his two-year term just a few weeks ago, but already the fresh-faced 37-year-old pediatrician has brought his enthusiasm and skills to one of the hospital’s top administrative jobs. “Dr. Tracy is energetic, enthusiastic and comfortable in a leadership-type role,” said Sutter CEO Gary Rapaport. “Historically our chief of staffs have been older, and although Dr. Tracy is young, he is a seasoned doctor. He’s got a lot of good experience.” The role of a chief of staff is part liaison, part peacemaker and part business manager. Acting as a kind of honorary mayor who presides over his city council, one of the tricks to being a good chief of staff, according to Tracy, is learning that less is more. “I’m really a diplomat. That’s probably one of my biggest roles: being able to work with people and to listen to what people are saying,” said Tracy, who works with the Diablo Pediatric Group in Brentwood and Antioch. “You also need to have some patience and roll with the punches.” Tracy oversees more than a dozen hospital

departments and hundreds of staff, and is quick to endorse the “it takes a village” approach to health care in general and patient care in particular. “We all realize that we are not an island; that what we do affects everyone,” he said. “The nurses are critical. They are the backbone of everything. We’re all here because we want to help. We all just do what we need to, to ensure the best patient care we can.” And he’s learning that there is plenty to be done. One of the biggest eye-openers for Tracy in his role as chief of staff has been looking at the hospital from an economic perspective. “I think what I’ve really learned the most so far has been from a business standpoint,” said Tracy. “This has helped me to see, for example, how many nurses we need and how many we can afford. It’s amazing how all these pieces fit together, especially with the economics the way they are right now. There are a lot of infrastructures that all need to work together. It’s been interesting, and a lot of fun.” Still, concedes Tracy, the volunteer chief of staff job can be time-consuming. On top of an already full doctor’s schedule, Tracy figures he spends at least an additional 10 hours per week in his chief of staff capacity. “It is a lot of work and it can be challenging,” he said. “But this is actually a good time for me (to be in this position). I’m pretty young and I don’t have kids, so I do have a lot of flexibility. It’s also a relatively short time, so it’s doable. For me, this (chief of staff) is just another way to contribute, and as with all things like this, you always gain more than you give. It’s really an honor.”

Historical society prepares for opening by Samie Hartley Staff Writer

The East Contra Costa Historical Society is preparing to open the doors of the ECCHS Museum for the 2009 season, and it needs your help. The museum, which opens on Saturday, March 28, is currently recruiting volunteers to help get everything ready for opening day. Docent Joyce Decato said there are a variety of tasks to be completed before and after the opening. “The museum is run by volunteers, so we can always use new additions. We need people to help paint the inside of the museum, and we need people to host tours and work at various stations, such as Homer’s tool shed. There is always something to be done around here. Every little bit helps. Just let us know you’re interested and we’ll find a place for you.” The centerpiece of the museum is a farmhouse built in 1878. Displays include bedrooms, a kitchen, parlor, and an office stocked with items from the late 19th and early 20th centuries. There are no requirements to be a volunteer. Children as young as 5 are welcome help out on the grounds as long as they’re supervised by a parent. Decato said volunteering can be a family activity. “We want as many people to be a part of this as possible. We

“Kids love to help out at our water pump. They think it’s fun to play there. The women like to work in the house

and keep various show rooms tidy and answer guests’ questions, and the men like to host demonstrations at the shed. Everyone can be involved, and it’s a lot of fun.” The museum is open through October, but only on Saturdays and every third Sunday. Groups can book weekday tours in advance, but otherwise the museum is open only five times a month. Decato said she would like to find another volunteer to run the museum with her at least one day during the week to give the community more opportunities to explore the history of the region. Those interested in helping out at the museum this year are encouraged to attend an informational orientation on Saturday, Feb. 21 at 1 p.m. to learn about various volunteer opportunities. Another orientation will be held Sunday, March 8, for those who can’t make the first meeting. Decato said volunteers interested in hosting guided tours don’t need any previous training, as all the rooms feature descriptions to explain each display. Tracey Nobil is hoping shoppers will hit the Streets next weekend to help fund some local organizations worth supporting. The event is the Streets of Brentwood’s first Community Quarterly Sale, and it’s just the first of several planned occasions designed to bring residents and the new lifestyle center together. “Our motto is ‘Together We Are Community,’” Nobil said. “It means that, as a community, as a center, as businesses and as a city, we’re all working to better ourselves, each other and the community as a whole. In this new economy, we really need to do that.” Beginning Friday, Feb. 27 and continuing through the weekend until March 1, shoppers can raise money simply by making a $20 purchase at one of the Streets’ stores, $40 at a restaurant or $60 at the Rave 14 Movie Theater. narrow course hoist me across the warp of the Summit’s east face. The snow had deepened and the drop-off to my left into the impenetrable white was sharp. I reined back my pace. At the trail’s first switchback I caught a faceful of ice dust ricocheting off rock and tree. The foliage was straight out of sci-fi. It had rained up here before the mercury had plunged. With nowhere to run and hide, the wind-whipped moisture had been frozen, like the victims of Pompeii, in mid stride. Spreading sideways from a thousand stems of chamise glinted blades of ice like barbers’ razors. Farther up, bracketed by the Summit Trail’s sheltering chaparral, I spotted coyote track laced with blood and wondered who was doing the bleeding – the predator or some prey spirited away in the lethal sanctuary of jaws. The prints peeled off into the manzanita just below the summit of the Summit. I turned north toward the home stretch and in two minutes planted my walking stick, flaglike, in 4 inches of snow at 3,849 feet above sea level. No more up to go. I stood in a world suffused with limitation: No tourists would be motoring to the Summit today. The only track up here would be made by predators and prey, the tire tread of park rangers and cleat pattern of hikers. No sweeping panoramas would be gained – no sight of the Sierra or Farallons or Lassen. No sight of anything 40 yards away. I had caught a glimpse of our secret winter, but what secrets it had revealed to me – beyond its severe indifference to my comings and goings – I cannot say. I pulled my stick from the snow and began my descent toward the world I knew.

HOW WILL STIMULUS PLAN IMPACT REAL ESTATE? By the time you read this, President Obama will have signed the $789 Billion stimulus package. It’s a HUGE bill but let’s look at just the two key parts that may impact real estate the most – a tax credit and conforming loan limits. First-time homebuyers that buy a home between Jan. 1 and Dec. 31 of 2009 will enjoy a tax credit of $8,000, or 10% of the purchase price of the home, whichever is less. They define a first-time homebuyer as someone who hasn’t owned a principal residence during the last 3 years. The good news is that it does not need to be paid back (unless they sell within 3 years). There are income limits, so if you make more than $95,000 (single filer) or $170,000 (joint filer) you can’t take the credit at all. The conforming loan limit has been raised back up to $729,750 in some highcost areas, which effectively lowers interest rates for many homebuyers as more will

qualify for the “best” rate and terms. This also expires Dec. 31, 2009. What about all the talk about lowering interest rates to 4%, the $15,000 tax credit for ANY homebuyer, and protecting homeowners from foreclosure by forcing lenders to modify their loans? Those didn’t make it into this stimulus plan, but that doesn’t mean they can’t be revisited later. So, will these changes “solve” our real estate problems? Unfortunately, no. Personally I think the $15,000 tax credit for ALL homebuyers would have set off a buying frenzy, so I’m disappointed that it got stripped out. Black History Month a relevant reminder ents. My kids have multiracial dolls, books, and, most importantly, friends of all colors and cultures. But it apparently took only one ignorant comment to make my daughter doubt a value we’ve tried to instill by example throughout her childhood. I knew I needed to both calm any fear she was feeling and also explain how what she’d heard was a terrible lie. So I swallowed my anger and sat down for a heart-to-heart with my eldest offspring. One of the first things we talked about was Black History Month. She has been coming home from school and church over the last few weeks with art projects, stories and songs dedicated to Barack Obama, Martin Luther King, Jr. and Maya Angelou. I explained to her that one of the reasons we have Black History Month is so everyone can know about the important work done by Dr. King and others to let people know that ideas like the one she was subjected to are offensive and hurtful to all. Our conversation was a good one and my daughter now understands specifically what was wrong with what the other child told her. But I’m still angry: angry that she had to hear this ridiculous comment in the first place; angry that she’s probably not the only one to whom

There are several arguments against the need for the designation of February as Black History Month. Some people feel it’s just another way of segregating blacks from whites and that black history is simply part of American history. Others feel society has moved past division along racial lines and that BRENTWOOD Black History Month IVERSITY looks backward rather than forward. COMMITTEE I can understand the reasoning behind these arguments, and have always seen both sides of the issue regarding this separate recognition of African-American DESTY SHOEMAKER stories and achievements. But something happened today that made me choose a side regarding the celebration of Black History Month – my 7-year-old worriedly told me about something she heard an older child in the neighborhood say: “You shouldn’t talk to people who have brown skin because they’re robbers.” I was shocked, appalled and, most of all, angry. My husband and I have been committed to making sure our children grow up without the miasma of racism since the day we decided to become par-

‘Special’ bond secured Holy SAG Award, Batman! by Ruth Roberts Staff Writer Sometimes teachers are just teachers – and sometimes they’re much more. Wende Sanders falls into the second category and Jules Means will tell you why. “When my son first came to Ms. Sanders, he couldn’t talk. All he could do was point,” said Means, whose son Stephon has a form of autism called Asperberger’s Syndrome. “Now he’s 13 and has a 3.96 GPA. You tell me that’s not because of her.” Means is an outspoken advocate not only for her son, but for Sanders, a specialeducation teacher at Adams Middle School in Brentwood. What began as form of reverse discrimination by Means – who is an AfricanAmerican – has evolved over the past four years into a relationship that extends far beyond the classroom. “When I first saw Ms. Sanders, I thought – well actually I think I said – ‘No, I don’t want a blond-haired, blue-eyed white girl,’” laughed Means. “I’m an African-American woman and I did not think my son would be able to relate to her. But she told me to just give her a chance, so I did. And am I glad I did.” Sanders is quick to not claim credit for Stephon’s success, but she’s happy to hop on board the support bandwagon. “Stephon is an amazing, amazing kid,” said Sanders. “I have many success stories and he’s one of my top three. He came to me with some difficulties, but he has really thrived in my classroom because there is a lot of struc-

ture, and that’s what he needs. It’s one of those relationships where I’ll always be a part of their lives.” And that’s something Means is counting on. Recently diagnosed with breast cancer, and battling other health problems as well, Means is emotional and teary when she talks about her son’s future; a future she knows might not include her. “I’ve had a couple of strokes, I have high blood pressure and I’ve been recently diagnosed with breast cancer,” she said. “I’m fighting to live, but knowing that there are people in Stephon’s life like Ms. Sanders is comforting. I don’t even know how to describe her; she’s like Superwoman.” Adams Principal Adam Clark has known Stephon since he was a third grader at Krey Elementary, where Clark was principal, and said he understands Means’ passion for her son and his teacher: “Jules has always fought tooth and nail for Stephon, and his teacher is a huge advocate for him, and all her students. It’s been such a pleasure to watch him grow and to see his accomplishments.” Stephon will be attending Heritage High School next year, but that doesn’t mean Sanders’ involvement will end at matriculation. “We’re working on that transition (to high school) now,” said Sanders. “But I’ll always be in the picture, especially now with all Jules has going on. I’m always calling and checking on her. She says to me, ‘You make my life so much easier,’ and that’s really all I’m really going for. If you tell me that, then it’s all OK.”

Iron House Elementary School Principal Michele Gaudinier found herself in a sticky situation last week – literally. As a fundraiser for the Leukemia and Lymphoma Society, students were invited to duct tape their principal to a wall of the multi-purpose room for two bucks a pop. The response by students was loud and enthusiastic. “This is very funny,” said fourth grader Matthew Hoppe. “I’m still thinking about where to put the tape.” It seemed everyone had the same idea, clambering for their turn as Gaudinier gamely tolerated the public spectacle. Proposed cuts may threaten Marine Patrol by Ruth Roberts Staff Writer A proposal by Gov. Arnold Schwarzenegger to fold the California Department of Boating and Waterways (DBW) into the Department of Parks and Recreation is designed to slash $600,000 from the foundering state budget. But some members of the Sheriff’s Marine Patrol believe that the elimination of the designated return-to-source dollars is a recipe for disaster. “We are the only line between the water and public safety,” said Lt. Will Duke of the Marine Services Unit. “It’s frustrating to know that money that should come back for public safety is being (potentially) transferred to projects such as beach restoration. Yes, that is important, but not at the expense of public safety.” The Marine Patrol is funded in part by annual proceeds from the statewide boater gas tax; a designated return-tosource revenue which is held by the DBW. Duke believes that if the DBW is absorbed into the Department of Parks and Recreation, the gas tax may well evaporate. The Marine Patrol currently covers 240 miles of waterway with two full-time officers on one boat. “We’re at minimum staffing, and as you know, the county is expecting further cuts,” duke said. “The big question is what the impact of a the proposal would ultimately be.” In addition to law enforcement, Marine Patrol removes derelict and abandoned boats. Since 1997 the division has removed more than 300 vessels throughout the county. Imagine, said Duke, what the Delta would look like if those vessels had not been removed. “It would look like ‘Pirates of the Caribbean’ – without Johnny Depp,” he said. “What that would mean is an increased danger to boaters’ property and safety by having boats lying around.” Because there is no telling how much of a hit there could be if the budget proposal passes, the Marine Patrol is taking a wait-and-see approach. At the moment, the proposal remains just that – a proposal – and must be approved by the state legislature. “Everyone can help,” said Duke. “They can write their lawmakers and assemblymen and senators and let them know they’re concerned.”

this is no longer true, the recognition of Black History Month gives us one more tool to help children grow up knowing about the strength, integrity and achievements of our African-American forefathers. Trevor’s Weekly Mortgage Matters By Trevor Frey

Working Together Lately I’ve received many phone calls and emails pertaining to potential efforts, on all levels, to reach out and “shake” Washington into helping Main Street Americans. To the point in fact where I began digging to see just exactly what is out there in terms of helping those Californians that are in danger of losing their home. What I found, and what I was able to come up with, was three separate efforts - on three separate playing fields - that all directly relate to helping East Country Costa County to get back on its feet. And although in no way do I offer loan modification services, I believe if we’re going to make it through this…it’s going to have to be together, which is why I’m so eager to share the below information. First, as of Wednesday February 4th, California’s 10th District (which includes Antioch, Brentwood, Discovery Bay and Oakley) Representative Ellen Tauscher presented newly put together legislation in Washington that would allow the California Housing Finance Agency, or CalHFA, an estimated $10 billion from the remaining Troubled Asset Relief Program (TARP) to help refinance “underwater” families into payments they can afford. This plan would, in theory, jump start the hardest hit neighborhoods by keeping families in their homes and helping to bringing back whole communities. Best summed up by Representative Tauscher (D-Calif.) herself, “Foreclosures are decimating neighborhoods from Fairfield to Antioch and Oakley…This legislation will help families in the hardest hit areas get the additional resources they need to stay in their homes and keep these vibrant communities from

disappearing.” While Rep. Tauscher is doing her part on a national level, Governor Schwarzenegger isn’t far behind in his efforts to help Californians – in 2008, thanks mainly to efforts of Schwarzenegger and his camp, above mentioned CalHFA along with the Rural Community Assistance Corporation, or RCAC, was able to secure an $8 million grant in order to help aid California’s in danger of losing their home through multiple counseling services. According to the California Housing Finance Agency’s Executive Director, Theresa Parker, “The state of California is committed to leveraging all possible resources to help Californians weather the housing crisis…We are proud to partner with the Rural Community Assistance Corporation and their counseling partners who have the experience and commitment to work with borrowers facing possible foreclosure.” Monies handed out to California for this program were simply based on the statistics that California has been the worst hit state, period. An estimated half-a-million mortgages in California will be a struggle to pay over the next two years along. In other words, if you think you are going through this alone you’re not. The key is: don’t be afraid to ask for help. Talk to your neighbors, friends, and family. Your elected officials are doing what they can; why not aid their efforts by sending in letters that can then be used as political ammunition. Budget makers should follow locals’ lead Benjamin Franklin once wrote, “In this world nothing can be said to be certain, except death and taxes.” California officials, in a misguided effort to close the state’s budget deficit, have decided to conflate those two by ensuring that DITORIAL we are taxed to death. The last thing government officials should do when an economy is in recession is enact measures that would worsen and lengthen that recession. On the heels of the federal government enacting a record-setting stimulus measure in an attempt to get the economy moving again, California officials are intent on approving a record-setting “de-stimulus” measure that raises the sales tax, the income tax, the vehicle license fee,

the gas tax and slashes the dependent tax credit. California already ranks at or near the top of U.S. states in taxes and regulations, with an unemployment rate of 9.3 percent (two points higher than the national average) and residents and businesses fleeing the state in droves. Raising taxes would be akin to the old medical practice of bleeding an anemic patient in the hope it will cure him. State officials have made a good start by agreeing to cut some $15 billion from the budget, but they need to go further to make the painful but necessary cuts to put the budget in balance, just as local officials have done. Antioch cut nearly $5 million and still needs to slash at least another $1.2 million, Brentwood cut $2.6 million, Oakley $1.2

LETTERS Employment loyalty works both ways Editor: Just like the property market, it’s an employers market right now. An economic downturn allows companies to call most, if not all, of the shots when it comes to employee hours, benefits, pay rises and promotion prospects. Let’s face it: few employees will be kicking up a fuss with their bosses these days if they didn’t get their standard 5-percent pay raise, had to pay more for their medical benefits or were once again overlooked for that promotion. The mentality right now is “be thankful you have a job.” For most employees faced with rising mortgages and medical bills, that might well be a wise strategy, particularly in today’s downturn economy. And for employers looking to cut out “dead wood” from their operations, an atmosphere of economic gloom (broadcast almost 24/7 on CNN),

million, and the Oakley Union Elementary School District (OUESD) $2.9 million. The Antioch Unified School District might need to cut $7.1 million, and the Knightsen School District is exploring merging with the Brentwood Union School District in order to stave off bankruptcy. “Every one of these cuts is painful and everyone is hurt by this,” said OUESD Superintendent Rick Rogers. He could have been speaking for every local official faced with these difficult decisions. One other thing that these local officials share is that so far none of them is balancing their budget by seeking to raise taxes or fees. State officials need to learn from their example, as difficult and painful as it would be. Because personnel costs are always the bulk of any government budget, state

declining sales and profits and tightening of budgets across the board gives them the perfect excuse to do that. The problem is that in their knee-jerk haste to cut costs to combat today’s tough economy, they might also be cutting out the valuable Brazilian rosewood hardwood as well – i.e., the loyalty of their best people. This might not necessarily be directly in the form of layoff, but indirectly by cutting benefits, pay, hours and work flexibility. By doing so, employers might be shooting themselves in the foot in the longterm. Like elephants, people remember. And it’s how employers treat their employees now that will dictate how the latter will act when they have more flexible job options. Rest assured the economy will turn, and when it does, the tables will once again turn in favor of skilled employees that are in scarce demand. Therefore, employers shouldn’t be surprised to see loyalty go out of the window after this downturn and a mass exodus of their most valuable assets – i.e., their best people – once the economy recovers and job openings appear. Unpublicized but pertinent Editor: The Press Feb. 13 article “CSD director admits ‘I screwed up’” gives us all a vivid picture of the contrasts between some current board members. On the one hand we have Treasurer Dove, who is so concerned about doing the right thing that he will apologize even when it is not at all clear that he did anything wrong. In addition, Mr. Dove is committed to keeping the citizens of Discovery Bay fully informed about what our governing body is, or is not, doing. He was helping Mark

officials need to focus on the 238,000 employees working in state government to achieve more cost savings. Gov. Schwarzenegger has made a start by requiring unpaid furloughs of two days per month. We’d also like to see the 14 paid state holidays cut to the five or six holidays that most people receive in the private sector. When was the last time you got paid for not working on Columbus Day? You’re probably at your job on that day, and your paycheck is being taxed to help subsidize the day off for civil servants. Many state workers with two dependents receive $1,000 per month from the government toward their health care, along with a long list of other benefits, including dental, vision, a pension plan, see Budget page 19A

Doran (no relation to Robert Doran) get to the bottom of what has proven to be a serious bureaucratic mess that the status of Discovery Bay’s MAC is in, even after 10 years that the town’s leaders have known of the mess but did nothing about it. On the other hand we have Director David Piepho, who has been on the board since the CSD was formed, and is one of those responsible for the mess. Some very significant facts have not been publicized, for some reason. They are as follows: On Sept. 18, 2008, a meeting prompted by Mr. Doran’s pursuit of the MAC mess was attended by Supervisor Mary Piepho, Director David Piepho (by telephone), GM Virgil Koehne, Neumiller & Beardslee’s attorney and general counsel for CSD, John Stovall, and others. Discovery Bay resident Don Flint is also concerned about how the CSD conducts our business. He took issue with the legality of that meeting. After an exchange that included Mr. Stovall’s denials that it was a “meeting” (and contrary to his invoices, which described his services in preparation for and attendance at a “meeting”), Mr. Stovall finally admitted that what occurred on Sept. 18, 2008 was a “meeting” and it, in fact, violated the Brown Act, just as Mr. Flint said that it did. At the Jan. 21, 2009 and Feb. 4, 2009 CSD Board meetings, Mr. Stovall was compelled to apologize to the town because, in his own words, “… he believed that a committee of the board had held a meeting (the Sept. 18, 2008 meeting) that was in violation of the Brown Act.” The Sept. 18, 2008 meeting was attended by Supervisor Mary Piepho, Director David Piepho, GM Koehne and (legal) advisor to the CSD, General Counsel John Stovall. All of these people should have known better because of their experience in

such matters. Mr. Stovall apologized with his own version of the “I screwed up” mea culpa. Has anyone heard of such an apology from either of the two Piephos or from GM Koehne? Were the citizens of Discovery Bay even aware that this secret meeting, in violation of the Brown Act, had occurred? It casts a new light on Mr. Piepho’s constant refrain “we have done nothing wrong.” William R. Richardson Discovery Bay

Looks and smells like breach of trust Editor: Your last issue set off a series of small earthquakes in my household and among my neighbors, the tremors of which have obviously not yet been felt by several members of the Discovery Bay CSD. Director Dove should be ashamed of himself. After choosing to share lawyer-client privileged information with Bill Richardson – who was engaged in a lawsuit with the town at the time, no less – he had the audacity to claim he didn’t know any better. That sort of line might work when my 8-year-old uses it, but when a grown man and representative of the community uses that sort of rhetoric, it doesn’t quite fly. Additionally, perhaps CSD Board President Tetreault should have consulted the ethics codes mentioned in Mr. Richardson’s letter to the editor (also in last week’s issue). It is public record that Director Dove contributed to both his and Vice President Simon’s campaigns – allowing Director Dove to drag the reputation of the CSD Board through the mud and defending him is not exactly avoiding even the appearance of improper conduct, is it? Such is the case of Omar Bravo, a waiter at Sweeney’s Grill and Bar in downtown Brentwood. For the past seven years this young man from El Tuito, Mexico has served us cocktails and dinner with a graciousness and professional demeanor unmatched by any of his peers. This is not just a job for tips for this young man; this is his profession and the diners are his clients and you know that immediately when you meet him. He greets you with a warm smile like he is genuinely happy to see you. He calls you by name and seats you at the best table available. School district merger bad for Brentwood Editor: I would encourage all Brentwood parents and employees to take an interest in the talks of the Brentwood and Knightsen merger, as there are significant financial ramifications to Brentwood. Early in last night’s board meeting, the district announced significant budget cuts – approximately $1.5 million this year and as much as $3 million next year. Proposed cuts include the elimination of the K-3 music program and staff cuts. I understand these cuts are necessary and are no fault of the district; Sacramento is clamping down on funding and our children pay the price. However, those cuts should not be compounded by absorbing the debt of another school district. Knightsen is currently running a deficit and owes an additional $3.3 million on a construction loan. How can we need to make cuts but can afford the debt at the same time? It appeared from the tone of Dr. Grant see Letters page 19A

PG&E and other producers have been ordered by the state to provide 20 percent of

their energy from renewable resources by next year and 33 percent by 2020. Time will tell whether low-efficiency, land-intensive energy sources like solar, wind and waves will make economic sense. Until then, our energy needs will largely be met by plants like the one that has risen some metallic City of Oz on Wilbur Avenue. The wizards who made it possible are certainly happy with the results. “It came on ahead of schedule, on budget and we had no loss time injuries during the whole construction of the plant or its operation,” said Livingston. “So it’s really a tremendous accomplishment by the management team here to do that.” Power to the people – right on.

Legendary rodeo star and Brentwood resident Jack Roddy is the prominent athlete currently featured in the museum, along with two-

time Super Bowl champion Gordon Gravelle and professional bull rider and Liberty High graduate Colin McTaggart. Fridley hopes the museum will highlight the careers of some of the area’s little-known sports stars. “I think it is important that we let our local heroes know that we respect them and that we are proud of them. This is a place to celebrate their careers.” Fridley is constantly on the hunt for new artists to feature as well as athletes to showcase in the new museum. She urges all potential participants to give her a call or drop by the gallery. The rental fee for gallery wall space is $5 to $10 a month, depending on the size of the piece. Its activities include volunteering at the Brentwood CornFest, financing a holiday shopping spree for underprivileged kids, accompanying the Rotary’s high school Interact chapters on home-building trips to Louisiana and Mexico, and distributing thousands of dictionaries every year to far East County school children. The club also provides numerous scholarships to high school seniors each year, part of a total of about $40,000 in donations made last year alone. It’s that sort of community advocacy that Nobil wants to support, in addition to helping in other areas. Falcon girls squeak past Liberty by Dave Roberts Staff Writer The third time was the charm for Freedom’s girls basketball team Tuesday night against Liberty. After losing to the Lions in their previous two encounters, the Falcons hung on to win a squeaker in their home finale, 39-37. “It’s nice when you win on Senior Night, especially against your rival,” said Freedom Coach Jeff Jonas. “I’m really happy for the seniors to get this win.” But the win didn’t come easy. The teams fought hard throughout the contest, constantly swapping the lead, with the edge slightly in Liberty’s favor. The Lions led by two points at the end of the first quarter, by three points at the half and by two points at the end of the third quarter. The game’s turning point came toward the end of the third quarter when Liberty’s dominant, 6-foot center Abby Lange got into foul trouble and came out of the game. By that time she had already

scored 14 points, more than anyone else notched for the entire contest. But Lange would not score again after fouling out early in the fourth quarter, and Liberty sorely missed her offense and defensive rebounding.

Jonas, looking a bit like Daddy Warbucks with his shaved head and threepiece suit, prowled the sidelines calling out plays, encouraging and occasionally yelling at his players in an attempt to fire them up to take advantage of their opportunity. The Freedom girls responded by stepping up their defense. But it was still anybody’s game with 23 seconds to go and the Falcons clinging to a two-point lead. Freedom sealed it at the foul line as Iyana O’Neal made both of her shots and Ashley Resendez hit one of two, providing a five-point cushion with five seconds left. Liberty’s Shaunika Lee hit a three-pointer at the buzzer to

provide the final score. “We played great defense all night long,” said Jonas. “We held them in the 30s. We did a much better job tonight with our ball pressure; we forced a lot of turnovers; we made hard possessions for them. Anytime you do that, you give yourself a chance to win. We don’t have a true prolific scorer. So that means you’d better play some defense to keep the score down.” Liberty Coach Debbi Weil declined to comment after the game. Freedom ends its season tonight, Feb. 20, at Heritage, while Liberty finishes at home against the Deer Valley powerhouse. Both are 7 p.m. starts.

OBITUARY Tyler Andrew Toal Tyler Andrew Toal, 16, of Discovery Bay passed away on Feb. 4, surrounded by his loving family. Tyler was a gift to all who knew him and was proud to be an older brother to Jason, 11, and Dylan, 7. He also had many passions in life. His first love was skateboarding. He also enjoyed driving his prerunner, riding his dirt bike, snowboarding, wakeboarding and wake surfing. Tyler taught us all so much in his short 16 years. “Rallie Rue” Orcutt He was everyone’s friend. Wherever he was, his little face would light up a room. People were attracted to him like a magnet due to his little different attitudes; more than any other presence in a room. He was more than just a dog. He was, I believe, a reincarnated person. He knew when we were sad or depressed. His antics would bring about a smile on even the saddest face. Sand Creek Road is proposed to be extended to the east as part of the project and will bisect the site approximately in half. The project site is essentially vacant with the exception of a natural gas well located in the northeast portion. The purpose of the project is to establish the appropriate text in both the General Plan and the Zoning Ordinance, as well as to create functional parcels, that will in turn facilitate future development of the site. The proposed amendments and subdivision would allow for the development of a variety of uses on the site, including commercial, retail (including one “big box” as a permitted use), office, institutional (i.e. educational), single-family residential, multifamily residential, and parks. The DEIR analyzes the potential development of the site with up to 107,267 square-feet of retail uses, 87,991 square-feet of office uses, 228,690 square-feet of institutional uses, 140 single-family residential units, 468 apartments, and 5.1 acres of parkland. The DEIR analyzes potentially significant environmental impacts of the project in the following

areas: Land Use; Aesthetics; Transportation and Circulation; Air Quality and Climate Change; Noise; Biological Resources; Cultural Resources; Hazards; and Public Services and Utilities.
