CSD director to leave committee by Ruth Roberts Staff Writer

Amid continued calls for his resignation from the Discovery Bay CSD Board, embattled Vice President Brian Dawson told his colleagues this week that he would be stepping down from the board’s School District Committee. Pressure for Dawson to vacate his seat has been building since his arrest on suspicion of spousal abuse and child endangerment after Sheriff’s deputies responded to a disturbance at the Dawson home on Aug. 27. Free on $20,000 bail, Dawson will face misdemeanor charges at his arraignment on Oct. 31. At last week’s CSD meeting, resident Jeff Barber repeated his call for Dawson’s resignation, or at least his removal from the school board committee.

“I think it is completely inappropriate that you have a director out of jail on bail being charged by the district attorney for violence against his family, including child endangerment,” Barber said at the meeting. “I don’t believe that individual should be representing this board anywhere or anyplace and I think you should remove that director at your earliest convenience, tonight if possible, from any active representation on this board … I think it is completely wrong, especially anything to do with children, given the charges against the individual.” Contacted by phone on Tuesday, Dawson declined to comment on Barber’s demand. Savings lead to Bypass progress The effort to clear congestion on the Highway 4 Bypass got a boost recently, thanks to some savings on another highway project. The Contra Costa Transportation Authority (CCTA) received $25 million from the state earlier this year to convert the Sand Creek Road intersection to an entrance/exit-ramp interchange, a $33 million project. The officials were banking on savings on a segment of the Highway 4 widening project to cover the remaining cost, a notion that looks promising. Wounded warrior returns to Oakley by Rick Lemyre Staff Writer

As he stood outside a construction trailer in Afghanistan, Petty Officer 1st Class Chris Marquart knew exactly what he was hearing. “It was that unforgettable ‘whooossssh’ a rocket makes,” he said. “It was right at eye level, coming straight at me. I saw the smoke, heard the bang, and stuff started flying all over.” A member of Navy Construction Battalion 18, a Reserve unit out of Ft. Lewis, Wash., the Oakley resident was starting his second tour in the war zone in August of 2010 when the rocket attack occurred. His unit, commonly referred to as “Seabees,” was part of a joint task force assigned to oversee $250 million in construction projects. Marquart made it unscathed through his first tour in 2008-09, but not his second. As the 107mm rocket approached, he had enough time only to turn around and put his back to the incoming missile. It hit the ground 10 feet from him, showering him with shrapnel and hurling a chunk of hot steel into his back, just two inches from his spine. “I thought I’d been hit by a rock or something,” he recalled during an interview last weekend at his home. “There’s a blank spot (in his memory) after that. I remember waking up on the floor inside the trailer, but I don’t know how I got there.”

call his wife, Lynne, to tell her he’d been wounded. The result was “my most bittersweet day,” he said. The call came in to Oakley, waking Lynne up at about 1:30 a.m. “The only

thing I heard was ‘I got hit,’” said Lynne. Wanting to cheer her husband as best she could, she passed along some great news: “We’re pregnant,” she told him. Unable to do anything else for her injured spouse, Lynne began stuffing yet another care package to send him, this time with something special from their 7year-old-son, Ryan. “He snuck a Spiderman Band-Aid in there,” said Chris. “ I definitely remember getting that.” Two weeks later, however, Lynne suffered a miscarriage, adding to the stress on the entire family. A two-week visit home wasn’t enough, and after returning to Afghanistan to resume his mission, his wound and his wife’s condition proved too much of a distraction, and Chris was ordered home a few months later. But he didn’t tell Lynne. Instead, he worked his way all the way to his front door without her knowledge, and surprised the family into stunned silence. “It took me a few minutes to realize he was standing there,” Lynne said. “My brain was saying, “He’s in Afghanistan, not standing at our front door.’ It was a great surprise.” Marquart has almost fully recovered from the physical part of his injury, but he’s easily startled by loud noises, and doesn’t like crowded places. The results of an online survey asking Discovery Bay residents what they’d like to see in a community center have been tallied. And while the number of respondents was lower than anticipated, committee members still believe the exercise was worthwhile. “I think we were all hoping for a better response,” said Community Center Advisory Committee member Sean O’Toole, who presented the findings at the Sept. 21 CSD meeting. “But we did receive a lot of comments and we’re still collecting input.” Of the 412 members of the community who logged onto the survey, 359 completed it, said O’Toole. The results showed that 92.2 percent of respondents are full-time residents between the ages of 40 and 65; 81 percent are married and 43 percent have children living at home, the majority being teenagers. “One of the first questions we asked about was location,” said O’Toole. “And the number-one spot was at the corner of Willow Lake and Discovery Bay Boulevard; that got the most positive feedback.” Regarding activities residents would be interested in seeing in a community center, fitness, gardening and painting classes rated favorably, as did cooking classes. Respon-

dents also rated a kitchen and meeting rooms as important in a community center. Posted online in July, the survey was designed to solicit residents’ opinions on a community center, including location, activities, classes and funding options. CSD Director Mark Simon said he logged on and took the survey, but because a site has yet to be determined, he felt the survey was not as effective as it could have been. “To me, there is nothing tangible in that survey,” said Simon. “I think for me, not having a real location … I think what’s happened is that you have a nice survey but it’s very general and for me as a homeowner I had no inspiration to take it all.” O’Toole agreed, but added that he believed the survey is beneficial. “It’s a project plan,” said O’Toole. “And before we can get people excited about it, we have to have a vision of what it would look like … At least when we do go out and float a plan, we’ll have a better chance of not completely missing the mark. And that was really the goal of the survey.” The survey will remain online for a few more weeks, and residents can take the survey by logging onto www.discoverybaysurvey.com. Festival of Trees coming to town by Ruth Roberts

Brentwood’s inaugural Festival of Trees will feature dozens of holiday trees decorated by local individuals, businesses and organizations. Proceeds will beneﬁt Brentwood nonproﬁt and service organizations.

Staff Writer Twenty-five years ago, neighbors Mary Black and Nancy Torres attended a holiday event called the Festival of Trees and were so entranced, they vowed to one day bring that same type of sparkling affair to Brentwood. “We said that when we retired, we were going to do something like that,” said Black. “And over the years, whenever we would have wine in the glasses we got at the event, we would remind ourselves that we really needed to do this.” So when Black retired from the Brentwood Union School District last year, Torres knocked on her door and said the time had finally come. “We ran out of excuses, so here we are,” laughed Torres. On Dec. 2, the Festival of Trees will make its debut at the Shadow Lakes Event Center in Brentwood, running three days and highlighting four special events: the Gala Dinner and Silent Auction, Teddy Bear Breakfast, Sparkling Wines and Twinkling Trees open house and Brunch Among the Trees. Net proceeds from the events will benefit local nonprofit and service organizations. “The idea is to target the smaller nonprofits out here locally and give people a wonderful, beautiful place to come and visit during the holidays,” said Torres. “There’s nothing out here like this. We’re hoping it’ll be a great success.” The Festival of Trees will feature a va-

riety of trees in various sizes and themes, purchased and decorated by local individuals, organizations and businesses according to their own themes. Placed first on display, they’ll later be made available for purchase through a silent auction. Holiday wreaths, centerpieces and mantelpiece items will also be available for purchase. And throughout the three days, there will be viewing hours when the public can enjoy the trees and holiday items, plus live entertainment, food and refreshments. “This is our inaugural event, so we’re still feeling our way,” said Torres. “But we’re really excited and feel very energized by people who are already supporting us and want to come out and help.” This year’s beneficiaries of the Festival of Trees will be 80Volts, Friends of the Brentwood Library, Brentwood Regional Community Chest, Brentwood Art Society, Brent-

Bounty for food banks

Benefit garage sale nets thousands Friends and neighbors are beaming after a hugely successful effort to raise money to help a Brentwood mother of three undergoing cancer treatment. “We were able to raise a little over $2,200 from the garage sale itself and received $1,300 in cash donations from the community. How amazing is that?” said organizer Shiela Riche. The donations will be used to pay for preschool for the daughters of Karla Price, 38, whose three girls are all under 6. “We were able to raise all the money for the girls’ preschool tuition and have quite a bit left over to apply toward Kar-

la’s medical bills,” said Riche. “What a tremendous blessing!” Riche said that between 400 and 500 people stopped by the sale on Sept. 17. In addition to “a garage and a half ” of material donations from the community, the largess included a $1,000 donation from one person, and another who paid $90 for a dozen brownies at a bake sale held at the event. “We are in awe of the overwhelming support that our community has shown and are so thankful to live among some of the most caring people around,” she said. “God bless them!”

MERS IS LEGIT?

If you haven’t heard of MERS before, I don’t have room to fully explain it here (do an Internet search for more info). The short version is that many lenders used MERS to save time and money to record and sell mortgages via an electronic database rather than record the physical documents with the local county recorder’s offices. I’ve heard reports that MERS has recorded more than HALF of all mortgages in the US since 1997. There have been big questions about the legality of how MERS records mortgages and whether lenders can foreclose because of these questions. There have been many lawsuits on this issue, and as of yet, many of the cases were dismissed on technicalities, or the decisions didn’t provide a clear legal precedent on the matter. However, there was a recent case that may be the one that finally does it. I’ll spare you the details of the case, but it definitely puts some wind in the sales of the lenders that are foreclosing on properties where MERS was involved by saying that MERS is legitimate and isn’t a reason to stop or reverse a foreclosure. If this case holds, it may reduce one arrow from the quiver of the attorneys that are trying to either fight or reverse foreclosures

on behalf of their clients. However, before I could even get this article out in the paper, MERS was hit with another lawsuit in Texas on 9/21. This one takes a different tact than the other suits that question the legitimacy of MERS. This one is filed on behalf of the local counties that were denied the revenue from the recording of documents because of MERS. With MERS, the lenders didn’t have to record new documents each time the loan was sold. When you add up all the loans, and how many times they were sold, the damages could be over $1 Billion, just for the Dallas lawsuit. If they win, you can bet other counties across the US will pile on and the losses could be huge. If this happens, it won’t be so much a victory for homeowners, because it doesn’t change whether lenders can foreclose. It will be good news for cash-strapped counties, but it could also be a huge financial hit to many banks that are already struggling to stay solvent. Cruise to benefit Friends

Friends of Marsh Creek Watershed hosts a fundraiser aboard the Island Serenade on Saturday, Oct. 1. Tickets are $60. Delta Discovery Cruises, based in Pittsburg, is teaming with the Friends for a relaxing evening on the water. Proceeds benefit Freedom High School’s FRESHH Club, an environmental stewardship organization, and Friends of Marsh Creek Watershed activities such as the creek cleanup. Nearly 500 volunteers came out to clean up about 18 miles of local waterways, and as a result, more than four tons of trash were removed from the creek, trails and local parks.

“Friends of Marsh Creek Watershed works on a very small budget and is making an effort to continue our great projects by taking on various fundraising efforts,” said Executive Director Diane Burgis. The sunset dinner cruise will feature appetizers, samplings of award-winning wines from Bloomfield Vineyards and entertainment provided by Cadence Bay Studios. Homeless Animals’ Lifeline Organization (HALO) hosts its fifth annual golf tournament fundraiser on Friday, Oct. 7 at Shadow Lakes Golf Club in Brentwood. The event kicks off at 10 a.m. with a putting contest before the scramble-format golf tournament begins at 11:30. Prizes will be awarded to the top three teams. Homecoming. Winter Ball. Prom. These events are rites of passage in the life of a high school student. The word prom conjures feelings of joy, anxiety, anticipation – and in some cases, dread. Getting ready for the big dance is a lot of fun, but it can also be expensive to look the part. But help is on the way. The Antioch High School Parent Teacher Student Association (PTSA) hosts the Belle of the Ball Fashion Affair on Saturday, Oct. 15 from 11 a.m. to 3 p.m. at the Antioch High cafeteria, 700 W. 18th St. East County high school students will gain access to dozens of gently worn prom dresses and articles of formal wear. Dresses range from $10 to $40; accessories cost only $2. Since the PTSA uses the event as a fundraiser for scholarships, it’s a win-win for everyone. “With the economy being what it has been, the Antioch High School PTSA wanted to find a way to help within the community,” said PTSA President Cindy Chatham. “The idea of selling formal dresses at reduced prices seemed like a way we could help local high school girls defray the costs associated with Winter

Ball and proms, and hopefully help them be able to attend these events.” The dress sale, now in its fourth year, has been a big hit with students from all over East County. Chatham is hoping for another successful sale, with more than 200 dresses on hand and more still coming. Donations may be brought to the Antioch High School Career Center Mondays through Fridays from 8 a.m. and 3 p.m. A pickup service is also available for those unable to drop off dresses and accessories during school hours. “The girls are always surprised at how many dresses we have available,” Chatham said. “We also hold drawings throughout the event for salon or floral services. We’re currently looking for donations of event-appropriate prizes. We’re a nonprofit group and can provide a taxdeductible receipt for any donations of clothing or merchandise.” The Belle of the Ball event is open to all East County high school students. No student identification is required. Only cash will be accepted during the sale. Volunteers are also needed to work the event. Oakley to help students Read to Grow by Samie Hartley Staff Writer “The more that you read, the more things you will know. The more you learn, the more places you’ll go.” In 1978, Dr. Seuss included this line in his book “I Can Read With My Eyes Shut!” In the story, his famed Cat in the Hat explains the joys of reading as well as the importance of reading as a way to gain knowledge. His words are more than 30 years old, but the meaning is just as relevant, and the Oakley Union Elementary School District (OUESD) is reaching out to families to share a similar message that stresses the importance of reading. On Saturday, Oct. 1 from 9 a.m. to 2 p.m., the OUESD will host a Leer Para Crecer (“Read to Grow”) workshop for families with students in preschool through fifth grade. The workshop is meant to highlight the many positive outcomes that result from sharing a story, and encourage families to read with their children at home. “Our goal is to share with parents the importance of early literacy skills and how they aid in the long-term success of children as readers and proficient students,” said OUESD Early Literacy Coach Traci Tovani. “We want to provide parents tangible, cost-effective ways to support their children in the area of literacy regardless of their home language.” The workshop is the idea of Arthur Fernandez, who joined the school board in March. He wanted to find a way to reach out to the Latino families in Oakley to encourage them to promote reading in the home – a key ingredient in academic success. As soon as Fernandez joined the board, he began looking for ways to create a literacy intervention program, so he established the Leer Para Crecer committee. The committee sought funding from area nonprofits, but when the grants fell through, Oakleybased organizations jumped in to help. The committee received grants from the Friends of Oakley and the City of Oakley program You, Me, We = Oakley, a new community program designed to help disperse valuable community information to Spanish-speaking residents. The funding enabled the committee to purchase literacy kits, including flash cards, games and reading materials for families to take home. “Families will walk away with strategies for mastering sight words, letter names and sounds,” Tovani said. “Each kit will also include ideas for how to read with and to your child, as well as engaging questions parents can ask after they’ve listened to their child read aloud.” While the program targets the city’s Latino families, the importance of reading in any home should make the workshop attractive to all Oakley families. Fernandez said he’s hoping to draw at least 100 families to the event, which will take place at Gerhinger Elementary School, 100 Simoni Ranch Road. The event will also include book giveaways, information on obtaining library cards, and entertainment provided by local author Art Miramontes, who will

is called ‘La India meets La Migra,’ which is a comedy that deals with immigration. The second is called ‘Don Abuelito,’ which deals with a grandfather’s interaction with his granddaughter and her obsession with her technical gadgets. We will also have a youth ballet folklorico group performing traditional Mexican dances. The group is

under the direction of Elisa Duarte, who is also a committee member.” Local restaurants Los Charros, Chapala Restaurant, La Fuente, El Camino, Casa Del Palmar, and Rositas will work together to provide a free, traditional Mexican lunch for all participants. “What we hope to accomplish is that all students who participate will enter school prepared to read and ready to learn,” Fernandez said. “We may not see the results immediately, but they will definitely pay off in the future.” Registration for the event is free. Firefighting resident leaves mark on neighborhood by Rick Lemyre Staff Writer Residents of a Brentwood neighborhood held a barbecue last weekend to thank a multi-tasking neighbor with an alert son who snuffed out a fire that threatened a pair of houses. Rico Tolentino said that on the morning of Sept. 11, he and his 9-year-old son, Sebastian, had been watching TV coverage of the 9/11 observances, replete with video images of columns of black smoke rising from the World Trade Center. Later, as the family piled into the car for a shopping trip, Sebastian spotted more smoke, this time from a neighbor’s side yard on Diamond Springs Lane. “Hey Dad, look at that!” Rico recalled his son saying as he pointed to the growing smoke cloud a couple of houses away. As his wife, Toni, raced for a phone to report the fire, Rico dashed to the scene to find a trash can and fence between two houses ablaze. Grabbing a nearby garden hose, the San Ramon mail carrier began streaming water on the burning fence, which collapsed against one of the houses. He hosed down the stucco wall as well as the fence, then saw that flames were also licking a gas meter and a door on the other house. He alternately shot them with water as well, along with the fence and stucco wall. Kicking in the smoldering fence gate, Rico discovered a pit bull in the backyard barking at him from the other side of the fire. “I didn’t want him to come near the fire,” said Rico, “so I kept squirting him with the

While he was alternately wetting down the fence, the wall, the door, the gas meter, the dog and his increasingly warm toes, the fire department arrived.

“They said, ‘You did most of the work for us!’” said Rico. Unfortunately for him, they also noticed Rico was coughing a lot, and insisted he make a trip to the hospital to be checked for smoke inhalation. He was released a couple hours later. It’s not the first time Rico has been in the right place at the right time. A couple of years

ago, a similar thing occurred while he was on his route in Dublin. He’s also assisted accident victims and helped pull a suicidal man from a highway overpass. “Every time I go outside, it seems like things happen,” he said, adding that he’s glad to have been able to do the right thing in each instance. “I’m worried that some day I might fail.” He didn’t fail his current neighbors – that’s for sure. “I’m thankful to him for saving my house, but I feel bad for him because of him going to the hospital,” said Oscar Carillo, against whose house the burning fence had fallen. His wife, Angie, recently started a Neighborhood Watch group in the area, and it was through the group’s phone tree that Oscar, who wasn’t at home at the time, was notified of the fire within 15 minutes of its discovery. It’s the type of thing Neighborhood Watch groups do well, Angie said, adding that it also helped get the word out about last weekend’s barbecue. “I think it’s great, what Rico did,” Angie said at the event. “If it wasn’t for him, it could have been the whole neighborhood (that burned).” Instead, the effects of the fire (which firefighters said was caused by hot ashes that had been dumped in a trash cart) were limited to some scorched walls, burned fencing, a destroyed trash cart and damaged gas meter – and a scattering of latex footprints in the shape of flip-flops on the street in front of the house. Dawson should resign from CSD board As calls to step down from his seat on the CSD board continue from fellow directors and sentiment grows for a recall election if he doesn’t, it’s time for Vice President Brian Dawson to resign. In the days following his arrest on charges of spousal abuse and child endangerment resulting from an altercation with DITORIAL his wife on Aug. 27, Dawson said he was sorry for the actions that left her bruised and led to a pair of charges against him. Since then, however, he has grown defiant, insisting that he is back on the medications for bipolar disorder from which he suffers and steadfastly refusing to give up the four-year term to which he was elected last year. The August incident is not the first time Dawson has shown the potential for violence. He’s had at least two angry

confrontations that nearly led to blows and had to be broken up by bystanders following board meetings. He also passed a note to a fellow board member during a meeting, threatening to “kick your ass” over a policy disagreement. And he has accused directors Mark Simon and Ray Tetreault of political motivation in calling for his resignation, vowing that their comments meant he would not be leaving. Then, given an opportunity to address the issue at last week’s CSD meeting, Dawson said nothing. His failure to address the issue with his colleagues and before the public seem to indicate his intention might be to ignore the controversy until it goes away. But given Discovery Bay’s history of fractious politics, as well as the increasing public awareness and concern over the problem of domestic violence, this problem won’t be going away any time soon. And while Dawson insists that his per-

Crosswalk not for cars

Editor: I am a Brentwood Park resident and unfortunately my house borders the walking path that surrounds my subdivision. We are original owners and have loved living in Brentwood. However, we have been long awaiting our finished and functional walking path we were promised when we bought the house. Ten years later, it still has not been done. I cross over into Oakley to have a decent path and view while exercising. All four of my children, three of whom are too old to enjoy it now, have never been able to ride their bikes on the path because of stickers and thorns that pop their tires. Right across the path, Oakley has nice trees, green grass, flowering bushes and nice ground cover bordering its subdivision. We have some trees, dirt, thorns and weeds. My neighbors and I continue to hope this will be the year the City Parks Department will remember us. Laura Gee Brentwood

Editor: I can’t believe the audacity of some people sometimes. And when you need an officer, sometimes one isn’t around. For example, I was walking in front of Liberty High School the other day with my daughter – she isn’t even in preschool yet – and was ready to cross the street over to the Adult Education Center when before my eyes, the eyes of several people and fellow drivers, an older woman decided that she was going to make an illegal turn using the cross walk that connects from the corner where Birthright is to Liberty High School. And before you say “maybe she didn’t know,” that was why the dividers were put in! Even the driver in the back was visibly upset, so much so that she honked – and with good reason. To make matters worse, this woman decided to wait in the crosswalk while ongoing traffic passed. I was appalled. This all took about five to 10 minutes. But what stunned me most was: where were the police? I am a former Liberty HS student and remember that there was always an officer out on campus. Where was he that day? Can you imagine if this selfish woman had done this while someone was preparing to cross? I just can’t believe that there are people selfish enough to use something for pedestrians as their own personal lane. And for the woman who did this, if you are reading this: shame on you! And people have the nerve to complain about teen drivers. Well shame on you, and be glad I didn’t have a pen or paper with me, or else I would have gotten your license plate number and made sure you learned your lesson. Those dividers were built to protect pedestrians from people like you, who are too much in a rush to take other people’s safety into consideration. And to the woman driving behind this

sonal situation will not impede the district from conducting business, that has already proven not to be the case. Directors at last week’s meeting uttered not a single word about the incident, and instead attempted to conduct business as usual while ignoring the proverbial elephant in the room. With the prospect of continued paralysis on the board, plus the uncertainty concerning his earlier actions and his current state of mind, the right thing for Dawson to do is step away from the board. Continued defiance and a possibly ugly recall election that could cost the CSD thousands of dollars would have a devastating affect on the board and the community. Before his personal life is drawn further into the maw of public conjecture, Dawson should do the right thing for his community, himself and his family, and resign immediately. Skipolini’s, not Walmart Editor: As a 10-year resident of Brentwood with four young kids and a love for this community and its small-town atmosphere, I have one question: Skipolini’s Pizza – a family-owned pizza parlor with a great atmosphere – was not allowed in our town because it serves alcohol and wasn’t conducive to a small-town family environment, yet we are considering allowing a Walmart? The best that money can buy Editor: If Walmart is so bad, how come so many cities and towns allow Walmart to locate there? The answer is pretty obvious. Walmart has the best politicians that money can buy. Walmart has a horde of lawyers and lobbyists that spread megabucks all over the local power structure until Walmart gets what it wants. Witness the recent vote in Antioch regarding the expansion of Walmart on Lone Tree Way. In the community, the anti expansion outnumbered the pro expansion by about 10-1. But lo and behold, the vote to approve expansion went 4 to 1 in favor of expansion. Who says you can’t buy a vote when you have huge money and no morals? We need to put every elected and appointed official in Brentwood on notice: Don’t sell us out! Vote to allow Walmart in

Brentwood and you will find yourself looking for work come next election. Not only do Walmart’s lawyers and lobbyists pass out mega-bucks. These same lawyers and lobbyists also teach local officials what to say to make it sound like a good plan to allow Walmart into a community. “They bring in lots of jobs.” Fact: They bring in minimum-wage jobs that stop at 38 hours per week so that Walmart does not have to provide benefits. “They bring in large tax revenues to cashstrapped cities.” Fact: The problems they create more than eat up any perceived tax benefits. Keep in mind that the civic leaders who will make the decision regarding Walmart are the very same ones that paid $16,000 each for the incredibly ugly palm trees in downtown Brentwood. Lucky enough in Discovery Bay Editor: The recent Homes Tour featuring houses for sale in Discovery Bay made me realize once again what a unique and beautiful community I live in. I have traveled to six continents and not found a place with the amenities of Discovery Bay. Oh yes, there are waterfront homes in the Puget Sound of Washington State, but think of the rain. Florida, the Carolinas and other East Coast states have houses on the water, but why worry about cyclones and tropical storms? Discovery Bay has it all: access to many waterways, a well maintained golf course, a lake in the middle, good weather and many lovely homes with private docks. Wolverines’ tennis ace hitting right notes by Michael Dixon Correspondent

Deer Valley High junior Maryn Wunderly is not only the top tennis player on her team; she has a legitimate shot at bringing home an individual Bay Valley Athletic League title in 2011. That is, if she can fit it into her band schedule. Wunderly, a trombone player, has been involved with music since she was in fourth grade. Prior to this year, the only instrument she played was the flute, but this year, she has switched to the trombone, which she plays for the Wolverines’ Marching and Symphonic bands. “I grew up playing in a band,” Deer Valley head coach Brian Richardson said. “I kind of understood the whole relationship with music. So we just worked together. She has to make sure that she keeps up with her band responsibilities, as well as play tennis. I’m committed to helping her because she’s committed to doing what she needs to do.” Since the band and tennis team’s practice schedules are in direct conflict, Wunderly finds other ways to keep her tennis

game sharp. She takes private lessons on Saturday mornings and works out in the off-season. A relative newcomer to tennis – she took up the sport in her freshman year – Wunderly enjoys the accountability the sport affords. “I like that tennis is a oneon-one competitive thing,” she said. “If you do well, it’s because of your good play. If you do badly, it’s your mistakes. You can’t put it on anyone else.” At this point, Wunderly is unsure if her tennis career will extend beyond her senior season as a Wolverine. Since she’s only a junior, she doesn’t know which college she’ll attend, but expects to go to a University of California school to study genetics and/or radiology. According to Richardson, Wunderly’s commitment of time to tennis and band haven’t gotten in the way of her academic pursuits. “Her GPA since I’ve known her has been a little above 3.65 all the time,” Richardson said. “I never have grade issues with her. We have a really open and honest relationship. She knows that she can talk to me.” see Notes page 20A

Antioch beats Napa, continues hot start by Michael Dixon Correspondent

The Antioch Panthers recall 2006 fondly. Not only did Antioch’s last football win against rival Pittsburg come in 2006; it was the last time the Panthers finished above .500. That was also the last time the Panthers started the season 3-0, an achievement they matched with a 40-35 win against Napa on Friday. The game’s most important play came in the fourth quarter. Antioch led 28-21, but the Indians offense was beginning to move the ball at an alarming pace. Napa senior running back Zack Schienholz took the snap, but coughed up the ball. That’s when Antioch (3-0) junior defensive back Darrin Jones took over. He scooped up the fumble and returned it 66 yards for a touchdown. “I saw the ball on the ground and my eyes got big,” Jones said. “All I had to do was grab the ball and go. We played awesome tonight. We never gave up. All we had to do was believe.” Napa (3-2) would score two more touchdowns, but sandwiched between those was a 76-yard run from senior running back Eddie Robinson that kept Antioch’s lead at two possessions. Napa scored with 1:31 left

when senior quarterback Zack Sims hit senior receiver Taylor Martin on an 18-yard touchdown pass. But when Panthers’ senior quarterback Troy Amate recovered the ensuing onside kick, all Antioch needed to do was run out the clock. The game could not have started worse for Antioch. After a long kickoff return by senior Jeremy Bittle was nullified by a penalty, Amate suffered a miscommunication and threw his first pass right at Indians’ junior defensive back Zach Jones. Four plays later, senior running back Michael Richmond gave Napa its only lead of the night on a one-yard touchdown run. Amate settled down after that interception, completing 14 of 22 passes for 201 yards and TD strikes to Jones and junior running back Elbert Hamilton. Hamilton rushed for 58 yards on 11 carries and caught two passes for 31 yards. Robinson notched 110 yards on 10 carries. “I just put it behind me,” Amate said of his interception. “I just thought about the next play and the plays after that. It’s just one interception. I had plenty more passes to go.” Antioch is guaranteed to go into league play with a winning record. Both of the Panthers’ remaining preseason games are at home. see Antioch page 19A

The East County Lions Midget Team got a wakeup call, losing to rival Antioch 20-8. Spencer Rohrer set up the Lions’ lone touchdown on a 40-yard run sprung by blocks from Jack Smith and Chris Vanderklugt. Rohrer finished off the drive by catching a 10-yard touchdown pass from Joe Sweeney. This was the second game in a row that Sweeney and Rohrer have hooked up on a touchdown. Dominick Warren and Dominic Espino moved the ball on the ground but were unable to find the end zone. Kapono Carreira led the defense with a key interception. “Our games against Antioch are always hard fought,” said Coach Dave Smith. “We got them last year and they were ready. I’m proud of our guys; they kept playing hard all day. The East County Youth Football Scouts team slid by rival Antioch on the strength of its defense this weekend. The offense helped, too. Cody Muth took the handoff on the second play of the game and galloped for a 60-yard touchdown. That was all the Scouts defense would need. It shut out Antioch, allowing less than 50 yards of total offense. The defensive onslaught began with an interception by Cody Muth and continued with fumble recoveries by Jon Puckett, Eric Bergen and Riley McCullough. Big-time tackles for losses were recorded by Bryant Weekly, Dylan Ray, Jaden Rashada and De Niro Killian. Offensively, the scouts finished the final series with a quick pass from Mason Brandy to Glenn Borlongan for 26 yards. The Jr. Pee Wee Lions held their own in an 8-6 victory over the Antioch Bobcats, the winning extra point kicked by Cole Gregerson, who also led the Lions’ defense. Devyn Douglas, Hunter Karbowski and Justin Bergen put a stop to Antioch’s offense, holding it to only six points. The victory gave the Jr. Pee Wees a 2-1 record. The Pee Wee Lions faced their toughest opponents yet, an undefeated Antioch team that hadn’t allowed a single point this season. The Lions completely dominated Antioch on both sides of the ball, winning 24-0. The story of the game, however, was the Lions’ D, which mauled the Antioch team all game long, al-

Delta Pats, EC Lions to face off Two of East County’s biggest youth football organizations will play each other for the first time next month. The East County Youth Football Lions and the Delta Patriots have agreed to take their rivalry to the field and will face off at Liberty High on Oct. 29 at 4 p.m. The East County Midgets team (ages 12-14, up to 160 pounds) will face the Delta Patriots’ Varsity West team (ages 13-14). “In the last three years especially, there’s been a serious effort to scrimmage,” said Delta Patriots president Stan Fratus. “All the kids go to school together, all the parents live in the same town and know each other.” Players such as running back Riley Condon and linebacker Alex Einess lead the Varsity West team; the Lions’ Midgets squad fields strong talents in running backs Domonic Espino and Dominick Warren, as well as QB Joe Sweeney and offensive tackle Zac Harris. The opportunity arose when East County found it had a bye week on Oct. 29, so members asked Fratus if the Delta Patriots would be interested in filling the vacancy. “I think it’s a great opportunity for our kids to match up with kids they don’t get to play, but they all know each other,” Midgets head coach Dave Smith said. “There’s a lot of banter back and forth.”

Komen 3-Day for the Cure fundraiser in San Francisco. The event raised more than $3.9 million for breast cancer research. The team, which joined 1,900 other participants, raised more than $15,000 for the fundraiser – and Pam and Jennifer already plan to sign up for the 2012 event. As part of the walk, the ladies traveled from Daly City to Pier 41 to Berkeley to Jack London Square to Tiburon. His conduct has become the center of attention and I have an issue with that … I still maintain that he should resign from the (CSD) board.” Director Ray Tetreault, who previ-

ously called for Dawson’s resignation, also continues to believe the vice president should step down. “It’s about perception,” said Tetreault. “The whole thing is unfortunate but the town shouldn’t have to deal with any of it. I stand with my previous comment that he should do the right thing (and resign).” Dawson was arrested after the Aug. 27 incident during which his wife, Jessica, sustained bruises but did not on require hospitalization. If convicted, he could face up to one year in county jail and a $1,000 fine for each of the misdemeanor counts. State law dictates that a CSD board member is required to resign only if convicted of a felony. Dawson, who said he has a history of bipolar disorder, has previously admitted that the altercation took place, which he said was due to his being off medications he could not afford. Currently, the intersection of Sand Creek Road and the Bypass is controlled by traffic lights. After work is completed – roughly 18 months after groundbreaking – the entrance/exit at Sand Creek Road will look and function much like the Bypass junctions at Laurel Road in Oakley and Lone Tree Way in Antioch. Trevor’s Weekly Mortgage Matters The Age of the Machines… …and that’s no reference or nod - although there should be so please consider this that nod – to the Machine Age. The early 20th century and late 19th century, between World War I and World War II, saw more complex models of technology being produced (across the board) than any time before it’s time. The first computer ever invented and the invention of the transistor made way for mass production; earth moving machinery, skyscrapers, the railroad, the automobile, and aircrafts just to name a few. Fast forward a century’s worth of technology and advancements have gone too far. Too many people are trying to make too many things automated – insert here the real estate market and/or the stock market – and we’re all paying the price for it. At the time this article was being written (September 20, 2011) 70 percent of all stock trades made were made using algorithms. In one such case – Rebellion Research – a computer program analyses decade’s worth of stock market data, and, after coming up with a long term strategy, gives Rebellion’s traders a list of buy/sell orders every morning. Combine that with that fact that the “malfunctioning” of these algorithms has more than once caused the shutdown of the London Stock Exchange and you should start to wonder what’s wrong with this picture. This brilliant way of thinking – the whole more production, less person, let’s become automated – has been affecting the mortgage business for quite some time, and now it seems as if things have once again gotten worse. commercial stating “Quicken Loans, Engineered to Amaze!” Last time I checked, the mortgage business, stock business, or any other business for that matter was personally related to the people, not “Engineered to Amaze.” On that note, and to continue showcasing how bad things have gotten, all new appraisal/appraiser guidelines were put into place September 1, 2011. The thinking behind this was simple; make everyone across the country more efficient by putting them all on the same platform. By automating appraisal reports we’ve essentially cut out our local appraisers’ vocal cords. No longer will they be able to “comment” with such appraiser-discretion. They (appraisers) now have to pick certain drop downs from certain categories. No more commentary, only automation. In theory, at least in the minds of the powers that made this decision, it’ll be easier for big banks to review appraisals (because they’ll all look the same)…making quality control that much easier. However, if you follow “The Age of the Machine” theory, you wouldn’t have any issue with an Alabama appraiser appraising your delta front property. What’s the difference in the eyes of the banks…comments don’t matter. That said, please be aware; appraisals will be tighter in the months to follow. Please, please, please, make sure you review your appraisal with your lender to ensure you understand it. us in a blanket of chilled anticipation as the leaves burn yellow and red, signaling that winter won’t be far behind. It’s a time to pack away beach blankets and dust off raincoats. The energy in the earth is changing, but a few changes to your home can help channel that energy into a cozy winter environment.

Feng shui experts suggest creating a reading space in your home this winter – a cozy, relaxing area to wait out the cold weather.

Feng shui, a technique believed to increase the flow of energy called “chi” in your home to influence your life on a greater scale, has been around for centuries. Originally practiced by ancient Chinese emperors, feng shui, pronounced “fung shway,” was thought to be a guaranteed method of organization to influence energies, which would translate into the success or failure of a kingdom. Contemporary feng shui practices are personalized to the individual, but many practitioners believe that by balancing your yin and yang energies, you can lead a happier, healthier and more prosperous life. Feng shui practitioners seek to balance the energies in their homes, creating an environment

that exudes a desired ambiance. The belief is that when chi flows freely through your home, you’ll be able to generate more creativity to help you succeed in many aspects of life, from relationships to business. According to renowned feng shui expert Betsy Stang, autumn is a time to reflect nature and purge your home of dead energy to make way for new, positive energy. Basically, out with the old and in with the new – just as trees shed their leaves to make way for blossoms in the spring. Decluttering your living space is a good way to begin a feng shuiinspired lifestyle. Eradicate piles, clear pathways and toss things you don’t use or need so that chi may flow more freely in your home. You don’t need to buy new furniture or turn your house upside down. Just open up your space and become more in tune with the energies flowing within your home. According to Stang, since the rain and cold of autumn and winter drive us indoors, feng shui is especially important right now. It helps us create a relaxing and inviting space for those shortening days and lengthening nights. Stang suggests placing a comfy chair in the corner of a room and creating a cozy reading nook, complete with a blanket, a small end table for our steaming cup of coffee or tea, and a lamp that offers a warm, golden glow, much like the sun. New Law on Short Sales What you Should Know to Protect Yourself by Joan Grimes, Esq. things: 1) Did you make any money on the deal and 2) Did you borrow any money which was not repaid? If you made money on the deal, including taking out cash to buy another house, car, pay off credit card, you may have a gain. If you borrowed money which was not repaid, you will have Cancellation of Debt Income (“CODI”). CODI will be taxable to you at your current tax rate unless an exception applies. Make sure you know all the tax implications before the short sale is completed. If there is CODI, it can be discharged in bankruptcy, but only if the bankruptcy is filed prior to the short sale being completed. In conclusion, CCP 580(e) is a mixed bag for consumers. It may help reduce personal liability while increasing tax liability. There is no question that this new law is going to hurt the lenders and help the IRS and State Franchise Tax Board. This will be found money for the tax man. Borrowers will see the forgiveness of personal liability and completely disregard the tax consequences. Don’t be one of those people! If you are considering a short sale, seek legal advice prior to starting the short sale process. This is a complicated area of the law, but a bankruptcy or real estate attorney should be able to make to an analysis of your particular situation fairly quickly. Effective July 15, 2011, California Code of Civil Procedure (“CCP”) 580(e) was amended to prohibit a deficiency judgment on any loan secured solely by a deed of trust on a 1-4 unit dwelling sold in a short sale. Enough legal jargon…what exactly does this mean and how does apply to you? First, it means that if your lenders agree to a short sale, it will release you from your personal liability on loans secured solely by a deed of trust against a dwelling of 1- 4 units. If the lenders want the short sale to go through, they will have to be satisfied with the proceeds from the sale. The banks can no longer demand that borrowers sign promissory notes… AND no more tricking borrowers into believing that releasing of the lien was in fact releasing their personal liability. The lenders do not have to agree to the short sale, but if they agree, they cannot come after you once the short sale is completed. However, if you think this is too good to be true…you’re right. Keep reading! Second, there is no requirement for a release of personal liability on anything other than a consensual lien i.e. no requirement to release judgment lien or liens placed on the property such as by a homeowners association or taxing authority. These parties do not have to agree to accept the proceeds from the sale as payment in full. The forgiveness of personal liability also does not apply to borrowers who are corporations, limited liability companies, limited partnership or political subdivision of the state. In addition, it also does not prohibit the lender from obtaining a judgment for fraud with respect to the short sale or waste committed to the property. Third, CCP 580(e) does not release you from any tax liability. Remember, every short sale has tax implications. The IRS/State Franchise Tax Board wants to know two

Tom J. Benoit Sept. 30, 1944-Sept. 20, 2011 Discovery Bay resident Tom Benoit passed away on Tuesday, Sept. 20, 2011 at home after a valiant battle with cancer. He was 66. Tom was born in Concordia, Kan. to parents Adalore and Evelyn Benoit. The family moved to Concord, Calif. in 1957. Tom graduated from Mt. Diablo High School in 1962. He met his future wife, Diane Coe, in 1964 and they were married May 28, 1965 in Antioch. Their son, Aaron, was born in 1966. Tom was an avid drag racer and enjoyed many years of racing with Aaron. Many long and endearing friendships were made at the racetrack. Tom is survived by his loving wife, Diane; devoted son, Aaron; and wonderful mother, Evelyn, all of Discovery Bay. He also leaves his sisters, Jerry Herrera of Pittsburg, Erma Belcher of Discovery Bay, Anna Mitchell of Mt. Pleasant, Texas, and Cheryl Bella of Roseville. He will be missed by all who knew him. Friends and family are invited to his memorial service Saturday, Oct. 1 at 3 p.m. at the Brentwood Funeral Home. He will be laid to rest by his family on Friday, Sept. 30 at Union Cemetery in Brentwood.

Busy autumn for wishing by Marla Luckhardt As summer winds down, we look forward to a new season filled with hope, holidays, family and joy. In the past few months, An Elderly Wish Foundation (AEWF) has filled six new wishes, bringing joy to the faces of our beloved seniors here in Contra Costa County. AEWF grants wishes to seniors over 60 who reside in Contra Costa County and suffer from a life-threatening or terminal illness. Among them are two of our seniors: Orland, in his Nascar debut, waving from his car as he circles the track, and Anne, reveling in her Mickey Mouse ears as the newest official citizen of Disneyland. The organization’s annual Wish Angel Campaign runs from Nov. 1 to Dec. 31. A donation of $25 or more will assist AEWF in its mission. Excitement is in the air as AEWF plans its second major fundraiser, the 10th annual Heart to Heart Ball. This elegant dinner dance will be held at the Lone Tree Golf and Country Club in Antioch on Feb. 25, 2012. For $60 you can enjoy a gourmet dinner, dancing and a fun auction. Auction items include trips, show tickets, golfing and Napa limo excursions. Terry Fator, winner of “America’s Got Talent” three years ago, has been headlining in Las Vegas ever since.
