Special-needs playground OK’d by Ruth Roberts Staff Writer Proponents of a plan to build an allabilities playground near Veterans Park in Brentwood got the green light last week from the City Council. “It was a nice Christmas present to have that support,” said Special Kids Foundation (SPK) Founder and Executive Director Lisa McBride, whose organization spearheaded the project. “We’re thrilled that it is finally going to happen.” In a unanimous vote, the council approved and allocated $250,000 toward the development of a universal all-abilities playground. The funds are part of a $2.3 million grant Brentwood received from the East Bay Regional Park District under the provisions of Measure WW. Lobbying for the playground began in earnest last summer with the establishment of a special-needs subcommittee through Brentwood’s Parks and Recreation Department. “The committee worked all summer on this and they really did their job,” said McBride. “They saw what was lacking and they saw how to fill that need. And the fact that the council voted unanimously for this shows how committed they are. It’s going to be amazing.”
Funding for the park will include the council’s contribution, an already secured grant for $15,000 and a pledge of $34,000 from the SPK. “We have always tried to make sure that our playgrounds were ADA (Americans with Disabilities Act) compliant,” said Roger Stromgren, Brentwood’s park maintenance manager in a recent interview with the Press. “But it came to my attention in talking with residents that there is really more that we could be doing. I started thinking about how we can offer more to our community and I became very inspired by the whole thing. I think we are onto something great.” McBride thinks so too, and believes the playground’s proximity to Veterans Park, the Brentwood Aquatic Center and related picnic areas will create a destination location for special-needs families, disabled or elderly veterans, and the general public. “ADA accessible is just the tip of the iceberg,” said McBride. “It’s just what is required, not what is fun. But this playground is going to be fun. It is going to be big enough to accommodate the number of kids it needs to and will be safe enough to keep kids out of harm’s way. And it’s also going to be fenced in, which is huge for our see Playground page 13

by Samie Hartley Staff Writer The Eden Plain schoolhouse has been resting quietly at the East Contra Costa Historical Society (ECCHS) Museum for four years, but recently the schoolhouse has begun to reveal how much history it truly holds. The Breakers, the historical society’s volunteer restoration team, recently uncovered a series of blackboards hidden behind a layer of wallpaper in the schoolhouse. Messages scrawled along the walls are dated 1906 and ’07. “The volunteers were in the school house trying to decide what to do next in the restoration process, and member Mar Knittel decided to strip the wallpaper – the (school) building was later converted to a house – and this blackboard crumbled to the ground,” said ECCHS President Ginny Karlberg. “We looked at the pieces and reassembled it like a puzzle, and we were able to make out the message. There is that saying ‘if these walls could talk.’ Well, this wall is telling us all kinds of stories.” The message on the blackboard reads: “This old school house has stood here for many a year. Its windows are broken by many a hand, but thank god its roof still stands.” Karlberg said the discovery of the blackboard is remarkable, and she’s grateful to Pearl Diamond, the person who scrawled the message more than 100 years ago. East Contra Costa Historical Society President Ginny Karlberg assembles a deteriorated blackboard that was recently discovered at the historical museum. The message on the chalkboard is dated 1906. bers of the historical society are currently researching the Diamond family in hopes of learning more about the girl who left the message a century ago. “She wrote this here so that whoever took down the wallpaper would know how important this building is,” Karlberg said. “You stand in here and you can feel the history within the walls and now the walls are
talking back.” Found on another blackboard is a sketch of a woman with her hair in a bun. The woman is drawn with a cinched waist and a large bust, no doubt the artwork of a young boy, said Karlberg of the Gibson girl sketch, which she suspects might be a see Writing page 13

Makeover gifts inspire the givers by Ruth Roberts Staff Writer When Shannon Simmons arrived at Shepherd’s Gate last fall, the single mom was more concerned about making ends meet than trimming her split ends. But last week, Simmons and a dozen of her fellow housemates got a chance to pamper themselves with a beauty makeover at Bella Fortuna Salon & Spa. “It was a lovely day; just great,” said Simmons of the spa experience. “Usually my kids are my total focus, so it was really nice to be treated for an afternoon.” Brainstorming ways to make the holidays brighter for those in need, the owners of the Antioch salon – Monica Davi, Teneil Pagnini and Tina Walker – decided to offer their expertise to an afternoon of salon treatments including facials, haircuts and manicures. “We were just talking one night about what to do for Christmas and we decided we definitely wanted to keep it local,” said Walker. “There are plenty of people in need right here in our own backyards, and Shepherd’s Gate seemed like a good choice.” The day was filled with talk of nail polish, hairstyles and the mysteries of waxing – all a welcome respite from the harsh realities of everyday life. “This was just their day to be treated like princesses,” said Walker. “And to have the chance to do something just for them. It was unbelievable to see the difference in their body language and confidence. After all, everyone wants to feel pretty.” Samantha Caldwell found the experience amazing. “It was the greatest spa day ever,” said the mother of a 5-month-old.
“I got color, highlights, waxing, nails – the whole thing. But what really made the day was how we were treated. They didn’t make me feel uncomfortable or not worthy. They went above and beyond and it was wonderful. I felt like I was back in the real world.” The spa day also included childcare, lunch courtesy of Panera Bread, gift bags
for the ladies and Christmas presents under the tree. The purpose of the event was to offer relief from the women’s current situations. And for the women of Shepherds Gate whose day-to-day existence is often a struggle, the generosity and kindness of Belsee Makeover page 13

Special audience HARP II CLARIFICATION I had written an article a month or two ago about the big changes in regards to the government HARP program and I need to clarify one point. To recap the article, the government is making major changes to the HARP program and are now calling it “HARP II.” The goal is to help those borrowers who want to refinance their home into today’s super-low interest rates, but can’t because they are upside down. You can call your current lender to apply, or any other lender that can do HARP II refinances. The main qualification is that your mortgage must be owned by Fannie Mae or Freddie Mac, and that is where the confusion is coming in. I’ve had people comment that they think they can’t apply for HARP II because their loan is with Wells Fargo, or BofA. They are confusing the “servicer” of their loan with the “owner” of their loan. Your loan may have been sold time and time again to different investors, but you still make your payment to the same servicer.

Here is a snippet from the original Federal Housing Finance Agency press release: “The existing mortgage must have been sold to Fannie Mae or Freddie Mac on or before May 31, 2009. Homeowners can determine if they have a Fannie Mae or Freddie Mac loan by going to: http://www.FannieMae.com/loanlookup/ or calling 800-7FANNIE (8 am to 8 pm ET) https://ww3.FreddieMac.com/corporate/ or 800-FREDDIE (8 am to 8 pm ET).” So if you are interested in the upsidedown refi plan, your first step is to check who owns your loan as per the above. Good luck and let me know how it goes if you have any success. If you have questions on this or any other real estate topic, call me at (925) 240MOVE (6683). Makeover from page 6 la Fortuna was an awesome blessing. And the giving isn’t over. Walker said they’ve put together a number of additional gift bags filled with items from the Shepherd’s Gate online wish list. Clients of the salon have also been bringing in gifts and toys for the children, and Walker plans to drop off the items to the shelter in time for the holiday. “I just couldn’t believe what they did for us,” said Shelby Andrus. “I hadn’t gotten to do something like that in a long, long time. I can’t thank them enough.” The pleasure, said Walker, was all theirs: “You know, I have given to plenty of organizations over the years but this was by far the most satisfying. You hear their stories

Those are important issues.” The subcommittee will meet again in January and begin the work of finalizing the Memorandum of Understanding and submitting plans to the city for approval. If all goes well, ground could be broken next summer. Once underway, the playground is expected to take two to three months to complete. “This playground is about getting kids off the ground and into the air and letting them move themselves around because they are so often down at everyone’s waist level,” McBride said. “They need to be up where the fun is – with the lights and sounds and sensory features.” To comment, visit www.thepress.net.
Writing from page 5 sketch of the teacher. A few other notes have been discovered on the walls, and Karlberg is anxious to find out what other stories the schoolhouse will unveil. The Eden Plain schoolhouse, originally located in Knightsen before moving to the historical museum on Sellers Avenue, offered education to children through eighth grade. Students would travel two to three miles for school each day, arriving on horseback, in wagons or on foot. These one-room facilities were often cold in the winter, but the Eden Plain schoolhouse had a wood-burning stove to keep the students warm. The building didn’t offer indoor plumbing, however, and drinking water was kept in a bucket next to the teacher’s desk. Olive Fletcher taught at the schoolhouse, which was built in 1868, and in her memory, her son Robert has provided financial backing to help restore the schoolhouse to its glory days. The ECCHS has been raising funds for years to restore the schoolhouse and accepts donations of time, money and materials. According to local historian Kathy Leighton, it is the society’s hope that once the schoolhouse is refurbished, students will have the opportunity to spend a day in the schoolhouse, living out a typical school day at the turn of the 20th century. Delta at risk, help needed now by Mary Piepho Contra Costa County District III Supervisor Many may remember the fierce water battle days of the late 1970s and early 1980s. These battles culminated in the California State Legislature passing legislation that authorized the construction of a peripheral canal that would have had significant negative impacts on Contra Costa County, the Sacramento/San Joaquin Delta and the San Francisco Bay. Some involved in those water policy negotiations are still around, UEST like former county supervisor COMMENT Sunne Wright McPeak, retired state legislator Daniel E. Boatwright, Gov. Jerry Brown and Congressman George Miller. Unfortunately others are not around, like my dad, the late State Sen. John A. Nejedly. In 1982 a grass-roots effort ultimately defeated the peripheral canal by a statewide voter initiative. While that battle was won on behalf of the Delta and good public policy, the interest and focus of those who sought our water to begin with never went away. In 2009 the California State Legislature again took up the issue of water supply and reliability for all Californians by convening an Extraordinary Session to focus solely on water. The culmination of this legislative session was the creation of SBX7-1, a comprehensive package reforming governance of the Sacramento-San Joaquin Delta and related aspects of statewide water management.
G
It became clear the Delta and our local interests were in the crosshairs of Southern California and Valley interests. A water grab was once again in play. The five Delta County Coalition (DCC) was formed to enhance our advocacy, and we have been working feverishly ever since. Our goal is to interject local interests into the development of any policy related to our Delta. We sought and won in the SBX7-1 legislative language protections for the Delta “as a place,” reduce reliance on the Delta, establish “co-equal goals” and the Sacramento-San Joaquin Delta Conservancy, restructure the Delta Protection Commission to better represent local government and stakeholders, promote regional self-sufficiency, and designate the Delta as a National Heritage Area. “‘Co-equal goals’ means the two goals of providing a more reliable water supply for California and protecting, restoring and enhancing the Delta ecosystem” (California Water Code §85054). We did not succeed, however, in gaining meaningful representation (we sought three Delta seats) on the newly formed Delta Stewardship Council (DSC), but we did get a seat for the chair of the Delta Protection Commission (DPC). We sought legislative oversight over the newly formed Delta Stewardship Council and the Bay Delta Conservation Plan (BDCP). This request was important for us because the power behind water is money and votes. In this regard, Northern California is in a very vulnerable position. Unfortunately, this good public policy request was denied.
LETTERS Vasco construction a pain Editor: Just wanted to say something in regard to all the construction on Vasco Road. I am aware that this construction is supposed to help with all the accidents and make traveling Vasco Road safer. Well, I have lived in Brentwood now for over 10 years and I have never experienced all the traffic that I have had in the last year. It now takes me an hour or longer to get home from the Dublin BART Station. In the morning it takes me at least 45 minutes to get to Dublin BART. It seems like the construction they are doing is really making Vasco Road worse than better. I en-

Politics at its worst Editor: As an outraged Oakley taxpayer, I believe it’s high time the Oakley City Council was taken to task for its part in the attempt to bail out City Manager Bryan Montgomery’s “underwater” home loan to the tune of several hundred thousand dollars at Oakley taxpayers’ expense. A bailout written, conceived and performed by the city manager, by agreeing to meet with him behind closed doors and negotiate said half-million home loan bailout, was more than a serious lapse of judgment on the council’s part; said meeting was illegal. At the council meeting on Oct. 25, merely rescinding their generous half-million-dollar donation to the most highly paid member of their staff and saying mea culpa to the taxpayers was just not good enough. It is still so obvious that the only reason for the abject apologies was because they got caught red-handed. At a time when Oakley residents are losing their homes on a daily basis, the council had the hubris to allow Mr. Montgomery’s relief of home loan payments for 27 months on a house financed for him by the Oakley taxpayers. This saved him about
The five Delta Coalition sought oversight that had direct accountability to the public and the taxpayer. The DSC operates under a public meeting format, but the sitting members are appointed by the governor and legislature. What the DSC ultimately decides to do under their legislated authority, which includes development of a Delta Plan to “guide state and local actions in the Delta in a manner that furthers the co-equal goals of Delta restoration and water supply reliability,” is final. Whether we like it or not. This is extremely relevant, particularly since the DSC also has the authority to hear appeals with regard to determinations that the Bay Delta Conservation Plan (BDCP) has met its legal standards under Water Code Section 85320. Here is the kicker. The BDCP is the peripheral canal of the 21st century. The BDCP is project-based; i.e., canal construction, and is paid for principally by Metropolitan Water District of Southern California, Kern County Water Agency, and Westlands Water District to the tune of $240 million. A third is paid for by the federal government (which means me and you). This is only for the cost of permits and does not include any construction or mitigation expenses. The BDCP provides 50-year operating permits under the state and federal Endangered Species Acts. There is no question that our Delta is at risk and needs our help. It is time for us to work together and perform as our citizens deserve. We must first begin with identifying what the Delta and Bay need to get healthy and stay that way. Until then, the fight will continue. To comment, visit www.thepress.net.

$50,000 during that time, which he used to purchase another home, since sold by him at a profit. Why was Oakley City Attorney Derek P. Cole adamant that the meeting at which the bailout was negotiated was not illegal, yet subsequently he rescinded that statement on Nov. 9? There are many questions to be answered here, especially in light of the fact that Councilmember Carol Rios has not yet provided Oakley residents and taxpayers with an acceptable explanation of why she was AWOL for two council meetings over the course of a month during the council meetings in which this issue was primary on the agenda and, when questioned repeatedly about this by Oakley residents and the press alike, they were discourteously ignored. Her response was no response at all. This is “politics” at its very worst: the apathetic, unapologetic, lack of respect for those who pay her salary – the taxpayers of Oakley – and those whose job it is to enlighten them, the press. What is Mrs. Rios’ response to the furor over her role in Bryan Montgomery’s bailout? The same city manager who not only wrote, but also negotiated, this “special deal” with her and the other council members behind closed doors and Mrs. Rios is the only councilmember who has yet to address this issue and apologize to the taxpayers of Oakley. Ignorance of the law is no excuse. At this late stage, an apology from her
is not only unforthcoming, but would be too little, too late. I therefore suggest that councilmember Rios either resign or be recalled by the outraged taxpayers of Oakley. As elected council persons, they all not only have a responsibility to the voters and taxpayers of Oakley, but to fully understand the laws that govern their jobs as trusted keepers of the city’s coffers. Our mission is to raise Guide Dog puppies that are totally socialized and obedient, knowing 12 different commands by the time they return to the San Rafael campus between 14 to 18 months old. We couldn’t do this without the support of businesses in our area. On Dec. 14, over 20 of us made our way to Loard’s Ice Cream parlor on Brentwood Boulevard and Nancy Street for our Christmas Social. Not only were we welcomed with open arms; the ice cream and hospitality were great. Thank you, Perry and staff, for supporting our service puppies in training. Antioch soccer icon honored in acreage by Justin Lafferty Staff Writer
Roy Immekus often joked about being president of the Delta Youth Soccer League (DYSL) for so long that they’d posthumously name a field after him eventually. The DYSL family didn’t feel like waiting. A couple of weeks after Immekus stepped down from his post after 13 years, about 30 friends, coaches and board members surprised him at his home Tuesday night. They gave him a plaque commemorating his service and a sign to be installed at the Antioch Youth Sports Complex: “Roy Immekus Soccer Fields. “I was truly surprised, said Immekus, who was a driving force behind the fields’ creation. “This would’ve taken a lot of effort by a lot of people. I’m deeply moved that they would do this. Immekus served as a director on DYSL’s board for 17 years, and president for 13. He has also grabbed the coaching whistle, worked games as a referee and served as fields director. Former coworkers lauded his ability to work with younger kids within the program and keep the operation fair for all ages. “He was always concerned about all the children, especially the younger children, said former DYSL vice president

second and you think about that group of people out there, I guess it’s not so surprising. That’s a very special group of people who have done very special work over many, many years.â€? Immekus’ introduction to soccer was unceremonious. When his son received a flier about playing soccer for a DYSL team, he soon became an active parent and, despite his lack of background in the sport, a coach. He fell in love with the sport, and it became a lifelong passion. DYSL board members had long considered doing something tangible to honor Immekus’ contributions. They worked with the sports complex and the City of Antioch for naming rights to the soccer fields. The timing of the ceremony just happened to come into place shortly after Immekus’ retirement. On Tuesday night, Scott dropped by the house to say hi and tell Immekus that she had something to show him. Immekus walked into the cold, figuring Scott had purchased a new car. When he saw a large group of his DYSL family, friends and neighbors standing in his driveway applauding, he was shocked. After seeing the sign that the league will install in early summer, Immekus was speechless. “He dedicated his life to soccer – it was his joy,â€? said Roy’s wife, Susan. “(The honor) is something that will make him very proud.â€? The Power of Chapter 13 by Joan Grimes, Esq. One of the most overlooked financial tools available to individuals including small business owners today is Chapter 13 of the Bankruptcy Code. Unlike a Chapter 7 which can require liquidation of assets and has very strict eligibility requirements, a Chapter 13 has greater flexibility in eligibility and allows individuals to retain their assets while paying back something to their creditors from future income. Some of the powers of a Chapter 13 Bankruptcy include: 1. Availability of Bankruptcy to High Income Debtors- A Chapter 13 allows individuals who would otherwise not be eligible for Chapter 7 bankruptcy to repay debts to the extent of their ability through a 3-5 year plan. In most cases, Debtors repay between 5-10% of their unsecured debts. 2. Continuing Business Operation- Unlike a Chapter 7 where a trustee can close down a Debtor’s business, a Chapter 13 Debtor has the right to continue operation of the business and has the exclusive right to sell, lease or otherwise use the business assets, in the normal course of operation. 3. Chapter 13 Plan May Modify Secured Creditor RightsOne of the great advantages of a Chapter 13 bankruptcy at this time is ability to strip a lien on your principal residence that does not attach to any equity. Here is a common example: Principal residence has current fair market value of $300,000. The first mortgage has a balance of $400,000 and the second mortgage has a balance of $100,000. Because the second mortgage does not attach to any equity in the property, the lien can be avoided or “stripped” in a Chapter 13 thereby removing the balance of $100,000 at the completion of the Chapter 13 case. In addition, if you have other real property which is not your personal residence, you may reduce the secured claims to the current fair market value if you can pay the fair market value of the real property with the contract rate of interest over the terms of the Chapter 13 Plan which cannot exceed 5 years. Where this makes most sense is on the small rental property. On cars, the Debtor can reduce a loan balance to the fair market value except that a reduction is
not allowed on cars used by the Debtor for his personal use if it was obtained within 910 days of the bankruptcy filing i.e. you need to have had the car loan for 910 days prior to bankruptcy filing. 4. Curing a Default- A Chapter 13 Plan can cure a default on a loan with no interest being paid in most cases. 5. Discharge greater than Chapter 7- A Chapter 13 discharge can encompass many other types of debts which cannot be discharge in a Chapter 7 including criminal matters and taxes. However, the most frequently used provision is to eliminate debts to a spouse, former spouse or child incurred by the Debtor in the course of marriage dissolution or separation except to the extent those debts constitute “domestic support.” What this means is that “hold harmless” provisions on real estate obligations and community property settlements obligations can be discharged. The above are just some of the advantages of a Chapter 13 bankruptcy case. While it may not be as quick and easy as a Chapter 7, it may provide the debt relief which cannot be obtained with a debt consolidation or repayment plan. If you are considering a default on your home or other debts, I urge you to seek legal counsel as soon as possible to fully understand the consequences of the decision and the options available. DV’s Morales wrestles his way to the top by Michael Dixon Correspondent When Austin Morales first stepped onto Deer Valley’s campus more than two years ago, wrestling wasn’t on his mind. Now as a junior in the 138-pound class, he’s one of the top grapplers in the Bay Valley Athletic League. Before becoming a wrestler, Morales’ preference was martial arts. But when some of the athletes on Antioch’s wrestling team saw Morales working out, they encouraged him to sign up for Deer Valley’s wrestling squad. “He just introduced himself and said, ‘Hey, I’m here to wrestle,” said head coach Richard Madrigal said. “He’s a good kid; has good academics. Everything’s working well. He’s staying injury free. This should be a good year.” Excluding academics, Morales’ primary focus in life is now wrestling, and he has made up for his lack of experience by attending multiple camps. In the summer between his freshman and sophomore years, he participated in one wrestling camp; in the summer between his sophomore and junior years, he at-

of the sport. He watches a lot of wrestling DVDs and improves his moves, and also is physically growing and ma-
turing. With the exception of weight training, the only other hobby that takes up significant time in Morales’ life is duck hunting, which he’s enjoyed with his father, Sergio, since he was a young kid. “I started it when I was 9,” Morales said. “I went out with my dad. He’s been doing it since he was 18. I guess you could call it a family tradition.” On the mat, Morales describes himself as a good sport. While his efforts are always strong, he doesn’t take winning or losing personally. When he goes into a match, he doesn’t believe he’s any better or worse than any opponent or teammate. “I really try to motivate my teammates if I can,” Morales said. “I want to be a good captain. I work hard to lead them.” Morales’ goal in his final two years as a Wolverine is to earn a wrestling scholarship. He assumes that, at minimum, he needs to earn a top-eight finish at the North Coast Section meet. “I hope I can win the BVAL, then do well in NCS and go onto state, and get a scholarship then,” Morales said. “That would be even better.” To comment, visit www.thepress.net.
West Coast Jamboree comes to East County by Michael Dixon Correspondent

Sabrina Englestad of Heritage looks for her shot during last year’s West Coast Jamboree. The Patriots open the tournament against Kingsburg on Dec. 27.
The West Coast Jamboree girls basketball tournament is always an earlyseason barometer for Bay Valley Athletic League schools, which are required to play opponents from outside of North Coast Section. Some of those unfamiliar opponents are the top teams in the country. The 2011 West Coast Jamboree is held Dec. 27-30 all around the East Bay. Three BVAL schools – Deer Valley (Gold Division), Liberty (Diamond) and Freedom (Ruby) – serve as tournament hosts. “Obviously we’re expecting really good competition,” said Deer Valley head coach Mark Hurtado, citing Oak Ridge from El Dorado and Vanden from Fairfield as prime examples. “So far, we’ve played great against our better opponents, and sort of lackadaisical against others. So I’m expecting us to come out hard.” The Wolverines open play Dec. 27 with a 7 p.m. game against View Park from Los Angeles. The winner of that
takes on the winner of the contest between Buena (Ventura) and Washington (San Francisco) in the quarterfinals, while the losers square off in the consolation bracket. Some divisions are scheduled for three days of competition; others four, but all teams play every day, win or lose. Liberty hosts the Diamond Division, a four-day event. Although the bracket’s composition makes it unlikely, it’s possible that East County fans could see a BVAL preview of sorts in the later rounds, as Heritage plays in that division, along with host Liberty. As reigning champions of the Diamond Division, having beaten Jurupa Valley 56-47 in the finals a season ago, the Lions are also playing for pride. The Patriots open Dec. 27 at 5:30 p.m. against Kingsburg of San Joaquin Valley. The winner faces the winner of the game between Humboldt County’s Fortuna and Archer from Los Angeles. As in the Gold Division, the losers square off in the consolation bracket. Liberty is scheduled to open toursee Jamboree page 24

Protect your loved ones Part of getting older includes writing the necessary evil called a will. My husband and I did ours several years ago. Not the most popular of subjects, planning ahead is something we must all do so we don’t leave our loved ones scratching their heads about what we want. SENIOR A few months ago ORNER my mom and I met with local attorney Brian McDonald. It was important that everything she wanted was in writing and perfectly clear. The meeting had very little to do with money or property and more MARLA to do about what she LUCKHARDT wanted if she got sick and could not communicate her feelings. I’ve heard many people say they’d prefer not to be put on life-support machines or feeding tubes. Yet without anything in writing when that situation arises, families are confused and worried about doing the wrong thing. We’re all entitled to our unique form of dignity, and a will or living trust will help. Hospitals and nursing homes can supply a form you can fill out, but it makes sense to create your own legal document. It allows you to state your precise desires so you remain in control even if you’re unable to verbalize your thoughts. Brian also brought up the fact that in the early 2000s, a trust was a good way to avoid probate and reduce inheritance tax obligations. When a person passes away, the trust doesn’t die, so there’s no probate. The ceiling
C
about 15 years ago for tax-free bequeathals was $650,000 per person or a total of $1,250,000 for a married couple. It went to $7,000,000, and because things are constantly changing, as of this year the maximum tax free dollar amount is 10 million. I don’t know about you, but I’m not in that category – sorry, kids! Another election is just around the corner, and these tax laws are subject to change again. According to McDonald, establishing a living trust is still a good idea, but currently a simple will covers a significantly higher tax-exemption amount than before. He also warns that forgetting assets is a common oversight in the will or trust process. This can leave the inheritor subject to tax liabilities that could be avoided if included in the trust. Stay informed and aware of changes both in the tax law and your personal property. A document is great only if it’s kept current. Probate is a long and expensive process. Getting your information legally written will help prevent these costs – and make it easier on your loved ones during an already hard time. The process of making a will or setting up a trust is relatively easy and not that expensive. For more information, e-mail Brian McDonald at brian@mediator.com. He’s kind and extremely knowledgeable. I know my mom feels better knowing that she’s still in control and will be for as long as we’re lucky enough to have her with us. Marla Luckhardt is a Discovery Bay resident and member of the East Contra Costa Senior Coalition. She works with several local senior care and advocacy groups. Rarey named Brentwood’s top citizen by Justin Lafferty Staff Writer
When Brentwood’s newest Citizen of the Year got the call from the Chamber of Commerce informing her of the honor, she had no idea how to react. Karen Rarey could only manage, “Oh my God!” “I’m just blown away,” said the woman who wears many hats within the community. “There are so many deserving people out there. It was just a true honor to be selected.” Rarey, a 16-year resident of Brentwood, has lent her hands to an array of local causes. For the past three years, Rarey served as the accounting chair of the Brentwood Relay for Life. She joined the effort first as a participant, then became more involved as a dedicated volunteer. As president of the Liberty Union High School District ED Foundation, Rarey has helped raise money for local schools. Brentwood Chamber of Commerce
President Paul Kelly felt that Rarey was a logical and deserving choice for Citizen of the Year. He cited her participation in numerous organizations, her ability to orRAREY ganize events and her attention to detail as major reasons why she was chosen. Rarey has a successful history of planning big celebrations, including a craft and safety fair marking the grand opening of the Highway 4 Bypass in 2002, and taking care of décor for the Brentwood Police Officer’s Ball in 2001. The honor will be officially bestowed on
Rarey at the Chamber of Commerce Installation and Business/Citizen of the Year Dinner on Saturday, Jan. 28 at 6 p.m. in Club Los Meganos at Trilogy at The Vineyards. The Brentwood Press will be honored as the Business of the Year at the event. Tickets are $45. “Obviously, she’s got a very long history of engagement and involvement in a variety of things in the community,” Kelly said. “That set her apart from a great many others.” Rarey is also a member of the Kiwanis Club of Brentwood, serving as the group’s president in 2003 and 2007. Through her position as Outreach Specialist at REI in The Streets of Brentwood, Rarey helped facilitate bicycle donations for the Brentwood Regional Community Chest, as well as for the Friends of Oakley after their toy drive was disrupted by thieves. She has also been a member of several prominent local boards, such as the Contra Costa Transportation Authority and Brent-
wood’s Parks and Recreation Commission. Rarey currently serves as the director of the John Marsh Historic Trust, a role she embraces with pride and affection. “It’s been near and dear to my heart since I moved out here, and I finally had the opportunity to join them,” Rarey said. “It’s such a worthy cause.” Rarey feels that since East County offers many opportunities for service, it’s only natural to be involved in many causes. While she loves giving her time and talents to a variety of organizations, she especially enjoys helping out children. “Far East County is a very giving area,” Rarey said. “There’s so much to do and so many people who are out there doing it. You just want to get out there with them – it’s a feel-good type of thing.” For more information about the Brentwood Chamber of Commerce Citizen of the Year dinner, call 925-634-3344. Oakley delivers on Christmas baskets by Samie Hartley Staff Writer
The Friends of Oakley brought Christmas to hundreds of Oakley residents in an effort nothing short of a Christmas miracle. After nearly all the nonprofit organizations’ donations were stolen three weeks prior to distribution, volunteers spent last Sunday loading cars with boxes of food and bags of toys as if the theft had never occurred. “The Grinch placed a hurdle in front of us but was unable to stop Christmas,” Oakley Mayor Kevin Romick wrote in an e-mail to the Press. “The response from people, both near and far, young and old was incredible. E-mails ranging from a retired school teacher in North Carolina looking to help to school children gathering pennies to help make up for the loss made the day a total success. To everyone who contributed food, toys, money and most of all your time, thank you.” The Friends of Oakley registered 300 families to receive aid this year, but things were looking grim for the Christmas program when Friends volunteers discovered their collection of donated goods had been ransacked. As news of the theft spread throughout East County, the Bay Area and the nation – the story even made “Good Morning America” – people donated in droves to make up for the lost food and toys and keep the program on target to meet its goal. Based on the outpouring of support, the Friends were able to provide each family

Friends of Oakley volunteers Sherena Smith and Mackenzie Tovani load boxes of food during distribution on Sunday. The organization provided food and toys to 300 local families. with three boxes of canned and dried goods, assorted fruits and vegetables, a sack of potatoes and a turkey. The Friends also supplied a toy for each child, under the age of 18, registered through the program. The response for toy donations was so overwhelming that children 10 and younger received a second toy, making this the most successful Friends of Oakley Christmas Basket program since it started in 2008. Despite the approach of Christmas, Santa made time to come out to Oakley to load cars with goods and wish people Merry
Christmas. As people waited in their cars to receive their baskets, Santa strolled about, chatting with children and handing out candy canes. “I heard about what happened here in Oakley and I had to stop by,” Santa said. “I don’t understand why someone would try to take Christmas from these folks, but the Friends of Oakley came through. And I am so proud of these volunteers – especially the little ones. A lot of people in this community will be on the Nice List this year.” When asked if a lump of coal is headed
to the culprit behind the theft, Santa gave a nod and whispered, “And some jail time wouldn’t hurt.” Although no arrests have been made in the case, Friends of Oakley members are grateful that the community – including volunteers from as far as Ripon, nearly 50 miles away – came through to fulfill the promise made to more than 1,000 residents in need. “We’re so blessed,” said Friends Vice President Pat Anderson. “It’s incredible that so many people were able to look past their own needs, open their hearts and help this community. The toys and the money mean so much, but the people who donated their time to make this happen – it’s incredible.” Friends of Oakley President Jim Frazier completed the Christmas Basket giveaways Monday by delivering gift bags to seniors at the Commons at Oak Grove Apartments. Now that the program is done for the year, Frazier and the rest of the Friends and volunteers get a moment to relax and enjoy their own holiday festivities. But for Frazier, Sunday’s distribution event was a gift in itself. “That’s my Christmas,” Frazier said. “It’s wonderful to have so many volunteers come out and offer to help. I got to sit back and watch this year because there were so many people who wanted to help that I didn’t really have anything to do other than supervise. It warms your heart to see so many people come together for this selfless act. We’re very blessed.” To comment, visit www.thepress.net.
