At a special meeting this week, the Oakley City Council swore in a new member and two incumbents, and reorganized to select a new mayor and vice mayor.

Kevin Romick, Doug Hardcastle and newcomer Claire Alaura took their oaths at the council chambers, in front of a packed house filled with family, friends and colleagues. The council also selected a new mayor and vice mayor and said goodbye to an outgoing member.

Romick, who earned the nickname Mayor Everywhere while serving as mayor over the past year, expressed his gratitude for the continued opportunity to serve his community.

“I’ve really enjoyed the past year,” he said. “Among many accomplishments, we have formed our own police department, exsee Council page 26

Former employee files suit against OUESD Season Over Plaintiff under criminal investigation

A former Oakley Union Elementary School District (OUESD) employee, who is suing the district for wrongful termination, sexual harassment and defamation of character, is under criminal investigation by the Oakley Police Department and the District Attorney’s office.

Brentwood resident Jeanine Davis was the subject of two search warrants issued in May and November of this year, according to Lt. Eric Navarro of the Oakley Police Department. The first warrant was

Chris Thorsen, Oakley chief of police issued for a private internet provider address and the second, filed just a few weeks ago, is for a residence and specifies a search of electronic devices.

“There is an ongoing, criminal investigation, and as part of that investigation, we have search warrants,” said Oakley Chief of Police Chris Thorsen. “But we cannot comment further at this time.”

Davis, a former application analyst in the OUESD technology department, filed suit against the

district in Contra Costa Superior Court on Aug. 2, asking for damages and civil penalties against the district for wrongful termination.

Davis also named former assistant and interim superintendent, Anne Allen, in the suit.

According to the court documents, Davis was brought on with the district for a one-year probationary period beginning Feb. 2, 2015. In mid-2015, Davis claims her supervisor, Shane Hull, began making sexual advances toward her, ‘en-

gaged in unwanted touching’ and made her feel uncomfortable. Davis claims that when she learned a paid intern had been treated similarly by Hull, she decided to report his behavior to human resources.

According to court records, on Jan. 7, Hull asked to meet with Davis privately and intimated that the situation would go away if she did not report him to human resources. On Jan. 8, according to the court documents, the intern was let go and Davis made a complaint to Michele Gaudinier, the human resources director at that time. Gaudinier resigned from the district in the spring of 2016.

Community park New recruits upgrades underway In the next couple of months, the City of Oakley Parks and Landscape Division will be replacing many aging and damaged metal, plastic-coated, perforated picnic tables, park benches and trash receptacles in parks throughout the city with durable, precast, concrete furnishings.

The ongoing maintenance and improvements are part of the division’s commitment to providing clean, safe and well-maintained parks.

“The city continues to invest in its park system, installing the new amenities that enhance the park aesthetics, safety and functionality,” said Oakley City Councilmember Kevin Romick.

The new trash receptacles are concrete, have a graffiti-resistant sealer and cost about a third of the price of the steel containers.

“They are easier to empty and less costly to maintain,” said Jesse Dela Cruz, parks and landscape foreman.

“ The city continues to invest in its park system, by installing the new amenities that enhance the park aesthetics, safety and functionality.

”

Oakley City Councilmember Kevin Romick Dela Cruz noted that the current powdercoated steel containers are quick to rust in an environment around irrigation, and the doorlock mechanisms are continually breaking or getting damaged.

“We plan to refurbish many of the steel trash containers and slated benches and use them again in our system until they are no longer serviceable,” Dela Cruz said.

The future of farming in Brentwood

For those traveling on Vasco Road, the recent development of vineyards along the rolling hillside is a beautiful sight, but for farmers in the agricultural core, the project signals a shift in farming that may bring a rush of fresh blood to its weakening pulse.

Those vineyards are now accompanied with signs that read “Orchard & Vine A Nunn Family Farm.” The Nunns make up a farming family with deep roots in Brentwood and are commonly associated with U-pick cherries. Now, the family is branching out to embrace the craft of growing wine grapes, and the land is being used to grow a wide variety, including merlot, cabernet, petit verdot, grenache, pinot noir and more. It is also plotted to grow the popular Nunn Better cherries, in addition to pomegranates and olives. The biggest pull in all of this being the three commercial-use buildings – a winery, a wine bar and a farm market – designed to bring in more agricultural tourism.

Other longtime farming families in the area are pleased with the Nunn’s plan for the winery, as it continues to keep agriculture relevant for communities inside and outside of the Brentwood area.

“I think it’s good, (because) ag tourism connects our farms to the residents over the hills in the Bay Area,” Bloomfield said. “The more connections we can make and the more we’re able to directly market our products, the more beneficial it will be to everyone farming out here. That’s the future of farming in Brentwood.”

ricultural core in between Brentwood, Byron, Discovery Bay, Oakley and Knightsen.

During that time, the agricultural core made up about 14,500 acres. In 1990, the cities of Antioch, Oakley and Brentwood wanted to develop into the agricultural core and redefined where the ends of their city limits would be. A new county general plan was created, resulting in an agricultural core that was significantly smaller, which many farmers felt ultimately led to the reduction of their land values and private property rights.

Between 1995 and 2005, the population boomed from around 12,000 people to 45,000. During this time, houses began to surround the farmers, with traffic running right through the agricultural core.

“If the county and the city choose to surround us, it’s going to be very difficult without having direct marketing and not having that connection with people over

the hill,” Bloomfield added.

Stan Muraoka, senior planner at Contra Costa County Department of Conservation and Development, released information on the details for the Nunn development.The application that was submitted to the county was for a landuse permit to establish the Nunn’s winery, which is slated for long-term agricultural use. The land makes up about 500 acres, with five acres designated for three commercial buildings.

“As you’re traveling on Walnut (Boulevard), you’ll see the winery and it will be a nice feature,” said Muraoka, who also predicted the permit review process would be complete by next spring, with the winery possibly opening later that fall.

Officials within the City of Brentwood also see the Nunns’ winery project as a positive step for farming.

“One of the most promising and positive economic sectors in the greater Brentwood area continues to be agriculture, including crop production, ag tourism and processing distribution,” said Casey McCann, director of community development for the City of Brentwood. “The planting of the vineyards along Vasco Road is yet another indication that Brentwood agriculture is relevant and evolving. Ag tourism is another way for local farmers to create additional income and employment opportunities, and that includes U-pick orchards, farm stands, wineries, camps and so forth.

Brentwood general plan specifically calls for the continued support of regional agriculture. This is a positive thing for agriculture in the Brentwood area, and the city continues to support (agricultural) enterprises like this.”

Mushroom advisory Recent news stories have covered the issue extensively, but it can’t be emphasized enough – harvesting mushrooms in the East Bay Regional Parks is not only illegal, it’s dangerous.

With the onset of the rainy season, mushrooms are sprouting up all over the place, but mostly in wooded areas. However, the regional parks are essentially wildlife preserves, so it’s against the rules to collect any plants or animals there.

Two of the world’s most toxic mushrooms can be found in the Bay Area - ama-

nita phalloides (the Death Cap) and amanita ocreata (the Western Destroying Angel). They grow in oak and other woodlands, and they can be mistaken for other nontoxic and edible mushrooms. Eating them can cause liver and kidney damage or even death.

So, unless you really know what you are doing and are doing it legally, restrict mushroom foraging to the supermarket produce aisles and keep watch on your pets, too; eating mushrooms can be fatal to dogs.

much as possible about the new move, the new neighborhood and the new school. The more they understand about the changes happening around them, the more empowered they will feel.

3. Children may feel isolated This feeling can be especially poignant if your family and your children were well connected in your previous community. Saying goodbye to deeply rooted relationships can result in intense feelings of loneliness and emptiness during the transition.

Pursuant to the Fire Protection District Law of 1987, the district operates as an independent public agency. In late 2009, the cities of Brentwood and Oakley, the county and the ECCFPD consented to local governance of the district. The board of directors includes nine members – four from Brentwood, three from Oakley and two from the unincorporated

county area, each residing within the district. There is no compensation provided for board members. The appointee will serve until the newly elected ECCFPD board is sworn in, which was approved this election by Measure N. The application deadline is Jan. 6.

Open enrollment for transfers in LUHSD In order to balance enrollment among the comprehensive school sites in the Liberty Union High School District, attendance areas for Liberty, Freedom and Heritage High Schools were established.

Students who live within the LUHSD boundary, but prefer to attend a school that is not designated for their residential area, must apply for an intradistrict transfer. An open-enrollment period is available during February for students and parents to complete intradistrict transfer requests for the 2017 to 2018 school year. Decisions regarding these requests will be made by May 15.

Requests are generally approved if

they meet specific, board-approved criteria, as long as total numbers relatively balance enrollment for all schools. As the district continues to grow and enrollment capacities at all schools are reached, not all requests may be approved. Students will be enrolled in their home high school, based on their attendance area, until the process has been completed in May. Request forms can be picked up at the district office, located at 20 Oak St., in Brentwood, or online at http://luhsd. net, starting Feb. 1.

LIQUID FUNDS

Buyers nearly always need to bring some kind of funds to closing to cover their down payment and closing costs. The standard realestate contract says the buyer certifies their down payment and closing costs funds are LIQUID, which means the money is instantly available in a checking or savings account.

This means if buyer can’t convert them to cash in time to close the escrow, they could be deemed to be in default. Below are some of the types of funds that are NOT considered liquid.

Certificate of deposit (CD): There may be penalties for early withdrawal and it could take some time to receive the money.

401(k) (or other retirement account): These vary widely, so check with your HR department and START EARLY. The biggest problem with these is the red tape and delays (sometimes WEEKS), and then on top of that, you will likely have significant penalties and taxes due. Sometimes, you can take a loan against your retirement account, which can be fairly easy and may avoid any penalties.

Sometimes, you can withdraw and put it back within a certain amount of time without paying a penalty.

Stocks or Mutual funds: On the one hand, these are pretty “liquid,” in that you can convert these to cash quickly by making a phone call or logging into your account. The danger area is that the values fluctuate, sometimes greatly, so it’s better to convert to cash sooner rather than later.

Home Equity Line of Credit: People mistakenly think these are liquid funds, but they are not truly liquid until the money is pulled off of the line and put into a checking or savings account. We’ve seen banks turn off lines of credit before without warning.

Gift Funds: Some buyers get gift funds from a relative, but are those funds liquid?

Venturing into the great outdoors

The cold, dreaded winter weather may have set in these past few weeks, but that does not put a stop to beautiful sightseeing in the Brentwood area, as green, rolling hills and entertaining, outdoor activities are just a few miles away.

Brentwood is privileged to have access to stunning regional preserves, hiking trails and parks, and while these areas are typically frequented during the summer and spring seasons, winter is one of the best times to get out from under the cozy comforts of home and go on a local adventure.

Managing more than 65 parks spanning the Contra Costa area and beyond, the East Bay Regional Park District maintains these beautiful natural preserves and is a wonderful recourse to source out local regional parks near you.

“Out in the Brentwood area, the winter season is definitely the time to visit (trails),” said Carolyn Jones, public information supervisor at the East Bay Regional Park District. “Let’s face it – from July through September, it can be miserably hot, and not many people want to go hiking, because it is just too hot and dry. The time to visit these places is now.”

biking trails. There are parks to visit with the family as well, such as Big Break in Oakley, with its visitor center and boatlaunch area on the Delta.

Furry friends are also more than welcome at almost all of the local parks and can even be let off leash at Black Diamond Mines and Contra Loma in designated areas. Dogs are not allowed at Vasco Caves and Morgan Territory, due to the sensitive habitat at those locations, but that should not be a deterrent, as both locations have beautiful ecological backgrounds. Tours of the preserves can be made at Vasco Caves, which gives an entirely new experience to the outdoor travels.

Whether visiting or not, these parks are beautiful places, and to help maintain their beauty, there are many things that any individual can do to help out.

“We have a foundation people can donate to called The Regional Parks Foundation, and people can also volunteer; there are many volunteer opportunities on our website,” said Jones. “When you visit the parks, you can always pick up some trash when you see it on the ground, obey the rules when you are there and overall, be a good park visitor and try to leave no trace.

Top 5 Estate Planning Mistakes

“If they want to do that, I’ll fully support them,” he said. “It’s a great career.”

People often ask me what the most common Estate Planning mistakes are. There are 5 mistakes that are recurring. They are: 1. No Estate Plan. The most common mistake is no Estate Plan. No Will, no Trust to avoid probate, no provision for guardianship of minor children, no Healthcare Directive in the event of illness, no Power of Attorney which would allow for bills to be paid and banking to be done. It is so sad to see children coming into my office needing a conservatorship for a parent because there was no Trust providing what should be done in the event of incapacity.

2. The Estate Plan is not Current. Most existing Estate Plans I see are out of date and provide for AB/By-Pass Trust, which is no longer necessary for 99% of the people.

It is very important that you amend a Trust with AB/By-Pass Trust provision prior to the incapacity of a spouse. If a spouse does not have capacity to amend the Trust, it is too late to remove AB/By-Pass trust provision. Also, make sure your Estate Plan still reflects your desires. Are their new grandchildren you wish to provide for, should there be a Special Needs Trust for any of your beneficiaries?

3. Failure to put Assets into Trust. The failure to put assets into the Trust is the most common mistake for all Revocable Living Trusts. Real property must be put into the Trust through a Deed that is recorded with the county recorder. Bank accounts must be in the name of the Trust or they will be subject to Probate unless there is a beneficiary designation on the account.

4. Failure to have Beneficiary Designations on Assets. To the extent that

assets are not going into the trust, you need to make sure you have the correct beneficiary designations on your accounts. I recommend checking all of your accounts once a year. A common problem is that accounts get moved to new banks/brokerages and you have forgotten to do beneficiary designations on the new accounts.

5. Transferring real property to relatives before you die. Many people think that before they die it is a good idea to transfer real property to their relatives either outright or by sharing title with them. This is almost always a BAD idea. First, it will probably generate a taxable gift in the current year if the value of the asset is worth more than the annual gift tax exclusion amount. Second, the person receiving the property will take your basis in the property (what you paid for the property plus improvements) and will miss out on a step up in basis on your death. Third, you might need the property.

If you do not have a will or will/trust, you should make it a priority. If you need an Estate Plan or have an existing Estate Plan that needs to be reviewed, I see people for a free 30-minute consultation in Walnut Creek and Brentwood.

Agency: East Contra Costa Fire Protection District - Engine 94 Sam Somerhalder’s roots in the town of Knightsen run deep … very deep.

He attended the same schools attended by both his father and his grandfather.

His grandfather was a charter member of the Knightsen Fire Department, and his father was a paid on call firefighter for the same department, in addition to being a full time firefighter in Tracy.

Now, as a member of the East Contra Costa Fire Protection District assigned to Station 94, Somerhalder continues the family tradition of protecting lives and property in Knightsen and the surrounding area.

Becoming a firefighter was a foregone conclusion; he never seriously considered doing anything else. Somerhalder practically grew up in the Knightsen fire station.

“It always intrigued me,” he said.

“Any time I had a chance to come down here, I’d come down here with my dad.”

Somerhalder attended Liberty High School, where he was a standout water polo and volleyball player. His legacy as an athlete led to induction into the Liberty Union High School District Athletic Hall of Fame earlier this year. After high school, Somerhalder played water polo at BYU Hawaii for a year, then returned to the area to attend the fire academy at Los Medanos College. He was hired by the ECCFPD in 2008.

Keep the fur babies safe this season The holiday season is a joyous time of year for many families, but joy can turn to tragedy if pet owners don’t take precautions to ensure the safety of their pets.

This holiday season, Pet Sitters International (PSI), the world’s leading educational organization for professional pet sitters, advises pet owners to consider their pets when decorating and sharing holiday treats.

“Simple holiday traditions, such as trimming the tree and decorating the house, can pose potential problems to pets if not monitored carefully,” said PSI President Patti J. Moran.

Much like toddlers, pets are attracted to bright lights, shiny ornaments and dangling tinsel, and pet owners should be aware that many holiday decorations can be hazardous to their pets. To ensure a happy and safe holiday season for pets, PSI recommends pet owners keep these decoration safety tips in mind: • A Christmas tree’s pine-tree water can be poisonous, so it is best to use an enclosed tree stand. If that is not possible, be sure to cover open tree stand bases. Make sure that the tree is secured to the wall with strong wire or twine, because a toppling tree can cause serious injuries to dogs and cats.

• Ornaments, hooks, twinkling lights and electrical wiring pose significant danger to pets by ingestion or contact. When no one will be around to supervise, unplug lights

and any electrical decorations a pet can access. Cover or tack down electrical cords.

• Holiday plants that are poisonous to pets include the berries of the mistletoe, holly, hibiscus, Christmas roses and poinsettia. Keep these plants out of reach.

Food is another culprit for some of the most common holiday pet emergencies. PSI recommends that pet owners be cautious of the following: • Dark and baking chocolate. While milk chocolate is not poisonous, it will cause a pet to have an upset stomach. On the other hand, dark chocolate and baker’s chocolate contain high levels of theobromine and caffeine. Animals are extremely sensitive to both, and ingesting either type of chocolate could be fatal.

• Xylitol. This sugar substitute causes a dog’s blood sugar to drop quickly. This poisoning can be treated, but causes liver failure if not treated properly.

• Macadamia nuts. Dogs experience severe weakness in their back legs, appearing paralyzed, after ingesting macadamia nuts. Dogs usually recover from this condition within three days.

• Bread dough. When bread dough is ingested it continues to rise, causing an intestinal blockage.

Falcons’ football team falls in state playoff

Freedom High School’s historic 2016 football season came to an end last week, with a 49-40 loss to St. Mary’s (Stockton) in the California Interscholastic Federation NorCal Division 1-AA bowl game.

It looked like Freedom would able to keep up with the 14-1 Rams, but in the end, Dusty Frampton and St. Mary’s showed themselves slightly stronger.

Frampton carried the ball 37 times for 359 yards and five touchdowns, vaulting St. Mary’s into the state title game against San Diego’s Cathedral Catholic (14-0) next Friday night.

“Nine points away from state,” said Freedom head coach Kevin Hartwig. “Not many teams can say that.”

Frampton’s 1-yard score, at 5:13 left in the contest, put the Rams up 49-40, ended up being the dagger.

Freedom’s Ronnie Rivers was stopped a yard short of a first down on the ensuing drive, giving St. Mary’s the ball for good.

Rivers, the Bay Valley Athletic League’s MVP, scored twice in the contest, but was held to 82 yards rushing.

From Dec. 8 to 10, the girls’ and boys’ basketball teams at Liberty hosted the 33rd-annual Stonebarger Tournament.

Each tournament was a four-team showcase, with each team playing three games. The boys’ only loss was a 62-60 defeat against tournament champion College Park in the final game.

“We have a pretty balanced team, with different guys who step up each game,” said Liberty head coach Jon Heinz. “We are looking forward to defending our championship this week at the West Holiday Classic and meeting College Park again, on Dec. 20, at Liberty. The Lions’ boys started strong in the Stonebarger Tournament, notching an 87-65 victory over Enochs (Modesto). A 30-point, eight-rebound game from junior forward Ben Smith led the way.

Senior guard Carson Musgrove added 10 points and five assists.

Liberty’s second game was much different; a 42-34 win over Campolindo.

Nico Tom led the charge in that game, recording a 16-point, seven-rebound performance. Senior center Fabian Estrada added a double-double, with 12 points and 10 rebounds coming off the bench.

In the final game loss, Smith led the way with 19 points, and Junior guard Max Lawrence added 10. Smith, Tom and Lawrence earned all-tournament honors.

The girls’ team had a bumpier road, losing 49-43 to Tracy in the first game, 4533 to Livermore in the second and 48-31 in the third game to tournament-champion Granada.

Senior Ashley Appel was the Lions’ top scorer against Tracy, scoring 14 points. She added seven against Livermore and eight against Granada. Gillian Glenn chipped in 11 against Tracy.

“I feel that our young team made huge progress this weekend against competitive teams,” said head coach Josh Ellcessor. “Every game we play, I’m seeing improvement that will help us perform well in league.”

he Delta United 02 under-15 girls’ soccer team recently finished the 2016 NorCal Premier Fall League season in first place. The team, consisting of of local players from Oakley, Brentwood and Antioch, finished 8-3 with 33 goals scored. The squad’s season came to a close with a 4-2 win over the Delta International, which wrapped up the division title. Head coach Tom Larsen and assistant coach Roberto Leon lead the team. “Congratulations to these girls who have worked hard all year, and we look forward to seeing how they advance in the next state cup,” said the team’s manager.

Baseball camp and tryouts The Knights’ college development baseball club, featuring Major League instruction from former professional and college baseball players, will be hosting a mini camp for 10-andunder through 16-and-under players, along with tryouts for its for 10-and-under through 14-and-under team on Saturday, Dec. 17, at 10:30 a.m., at Delta College in Stockton.

The Heritage High School girls’ golf team has taken the Bay Valley Athletic League title for four consecutive years. For the last two years, Brentwood native Sarah Lee has been a key part of that success. Sarah found golf in an unusual way. When she was in elementary school, her parents noticed her enthusiasm for miniature golf and suggested that she try the real thing. Neither she nor her parents, who do not play golf, knew what they were getting into.

By the time she got to middle school, Sarah was getting more serious about the sport.

“I like the competition, and I just love being out here,” she said. “I’d rather be outside than inside.”

She gives credit for her success to her involvement with The First Tee, a national program that strives to teach young people integrity, respect and perseverance through the game of golf.

Sarah is a serious, goal-oriented competitor. Her goals for the upcoming year are to get straight A’s and to break 80 for 18 holes.

When not working toward her goals, Sarah likes to draw, watch TV and listen to music.

Additionally, she is a musician playing both piano and flute, though she stresses that, for now, she only plays for her own enjoyment.

Future Plans:

Academically, Sarah is interested in the sciences, which may have been cultivated by her father, a biologist. While she thinks that she will likely major in one of the sciences in college, she has not seriously started her search for a school, nor is she sure how golf will fit into those plans.

“This year, as a sophomore, Sarah gained a ton of experience, and in terms of the number of points that determine the MVP, she was number two,” said Tinder. “So, I think that in her junior and senior years, she’ll want to get that MVP. I expect her to continue to lead the team and to improve.”

The Falcons later took a 20-14 lead on Giles Jackson’s 33-yard touchdown catch, but Jake Dunniway’s 9-yard run, midway through the second quarter, gave St. Mary’s a 21-20 lead it wouldn’t relinquish. Dunniway completed 15 of 23 passes for 191 yards and also rushed for 18 yards and a touchdown. Shawn Villegas (seven carries for 45 yards) also scored in the contest.

Freedom’s offense – held to just one touchdown in its 42-7 North Coast Section (NCS) championship loss to De La Salle on Dec. 2 – was a bright spot for the Falcons in the loss.

Freedom quarterback Jonathan Pierce threw for 271 yards, and Jackson finished with 135 yards receiving and two touchdowns. Fellow wide receiver Baylei Coston accounted for 110 yards receiving and one score.

“We missed a couple of balls we thought we should have caught,” Hartwig said. “(St. Mary’s) is good; they are a great football team. We got after them tonight.”

The two squads traded scores for much of the second half to keep Freedom within striking distance, but the Falcons

failed to shift momentum.

Freedom pulled within 28-26 on Coston’s 11-yard touchdown catch to open the second half, but St. Mary’s immediately answered with a seven-play, 60-yard drive, capped by Frampton’s 5-yard touchdown run putting St. Mary’s on top 35-26. Jackson’s 27-yard catch on the Falcons’ ensuing drive brought Freedom to within 35-33 late in the third.

Dunniway coughed up the ball on the Falcons’ 7-yard line on the next drive, but Freedom went four-and-out.

St. Mary’s regained control when Frampton barreled in from 19-yards out to give the Rams a 42-33 lead early in the fourth. Rivers’ 1-yard score pulled Freedom to within 42-40 with eight minutes left, but Frampton closed out the game’s scoring with a 1-yard score, putting the Rams on top 49-40 with just five minutes to go.

Freedom’s back-to-back losses in the NCS title game and state playoff contest were the lone blemishes on the Falcons 11-2 record this season, which included first-time trips to the NCS championship game and state playoff.

NOTICE INVITING BIDS 1. Bid Acceptance. 2.2 Construction Time. The planned timeframe for beginning and completion of construction of the Project is: 40 working days.

2.3 Estimate. The City’s estimate for the cost of construction cost is: $160,000.

3. License and Registration Requirements.

3.1 License. This Project requires a valid California contractor’s license for the following classification(s): Class “B” or a combination of Class “C Specialty Contractors License(s).

3.2 DIR Registration. City will not accept a Bid Proposal from or enter into a contract with a bidder without proof that the bidder and its subcontractors are registered with the California Department of Industrial Relations (“DIR”) to perform public work under Labor Code Section 1725.5, subject to limited legal exceptions.

4. Contract Documents. Bidders must obtain an electronic copy of the Contract Documents directly from the City of Brentwood. The Contract Documents may be obtained at no charge by sending an email to: engineering@brentwoodca.gov or by calling 925-516-5460. The City may reject a bid submitted by a bidder that did not obtain the Contract Documents from the City as required.

5. Bid Proposal and Security.

Brentwood, or a bid bond executed by a surety licensed to do business in the State of California on the Bid Bond form included with the Contract Documents.

The bid security must guarantee that upon award of the bid, the bidder will execute the Contract and submit payment and performance bonds and insurance certificates as required by the Contract Documents within ten days after issuance of the notice of award.

6. Prevailing Wage Requirements.

6.1 General. This Project is subject to the prevailing wage requirements applicable to the locality in which the Work is to be performed for each craft, classification or type of worker needed to perform the Work, including employer payments for health and welfare, pension, vacation, apprenticeship and similar purposes.

6.2 Rates. These prevailing rates are available online at http://www.dir. ca.gov/DLSR. Each Contractor and Subcontractor must pay no less than the specified rates to all workers employed to work on the Project. The schedule of per diem wages is based upon a working day of eight hours. The rate for holiday and overtime work must be at least time and one-half.

6.3 Compliance. This Contract is subject to compliance monitoring and enforcement by the DIR, under Labor Code Section 1771.4.

7. Performance and Payment Bonds.

The successful bidder will be required to provide performance and payment bonds for 100% of the Contract Price.

8. Substitution of Securities. Substitution of appropriate securities in lieu of retention amounts from progress payments is permitted under Public Contract Code Section 22300.

9. Subcontractor List. Each bidder must submit the name, location of the place of business, and California contractor license number, DIR registration number, and percentage of the Work to be performed for each Subcontractor who will perform Work or service or fabricate or install Work for the prime contractor in excess of one-half of 1% of the bid price, using the Subcontractor List form included with the Contract Documents.

No more than 50% of the Work may be performed by Subcontractors.

10. Mandatory Site Visit. A bidders’ conference will be held on Tuesday, December 20, 2016 at 10:30 a.m., at the following location: 9100 Brentwood Boulevard, Brentwood, CA 94513 for the purpose of acquainting all prospective bidders with the Contract Documents and the Worksite. DUI checkpoint scheduled The Contra Costa Area office of the California Highway Patrol (CHP) will be conducting a sobriety checkpoint on Friday, Dec. 16, in an unincorporated area of Contra Costa County.
