Oakley gets new police chief Fourth new leader in six years by Tony Kukulich

Oakley interim Police Chief Paul Beard has been selected as permanent police chief.

Correspondent

OAKLEY Paul Beard, a law enforcement veteran, was sworn in this week as the city’s new chief of police, removing ‘interim’ from the title and becoming the fourth police chief in six years. “This is a very exciting time for Oakley, and we look forward to working under Paul’s leadership in law enforcement,” said City Manager Josh McMurray. “He exemplifies so many of the traits that are necessary for the success of our community, not just as a police chief, but in all aspects of public service such as integrity and accountability.” Beard was among the first officers hired as the city prepared to establish its own police force

in 2016, but he was no rookie. He brought 26 years of experience with the Contra Costa County Sheriff’s Office to his new role as a detective in the fledgling

Oakley Police Department. During his tenure as a sheriff’s deputy, his assignments include detention, patrol, investigations, SWAT and marine patrol.

OAKLEY Randy Pope was recently appointed to the position of mayor as part of an annual reorganization of the City Council. Rather than a general election, the mayor of Oakley is appointed through a rotational process among the members of the City Council that takes place during the December meeting of the council, according to Pope. Originally, the process was an informal “gentlemen’s agreement” until the council decided to add to the municipal code in 2013. “I think one of the benefits is that it makes the council more cooperative,” Pope said. Each councilmember serves one year as mayor before the role is passed on to another member of the council, which encourages the acting mayor to be a collaborator since they will be on the other side of the power dynamic in just a short time, Pope said. The role of mayor is largely ceremonial as a result, according to Pope, with the city manager running the city at the direction of the City Council. One of the main functions of the position is to lead City Council meetings, setting the tone of the meetings, which Pope describes as a “professional, business-like at-

Antioch police seek public’s help in locating murder suspect by Jake Menez Staff Writer

Antioch police are looking for Robert Matthews, a suspect in a fatal shooting last November.

Police are asking the public for any information in locating Robert Matthews, a suspect believed to have been involved in a fatal shooting at a Sinclair gas station last November. Matthews, 23, is described as a black male, 5 feet 10 inches tall, weighing 200 pounds, with black hair and brown eyes, according to a post made by the police department on social media. The post states that Matthews is considered armed and danger-

ous and should not be approached. He is wanted for suspected first-degree murder as well as attempted murder with gang enhancements, police said. The police previously arrested 24-yearold Raymond Jenkins on Dec. 8 in connection with the same shooting, according to a Jan. 13 press release. The shooting took place on Nov. 10 at the Sinclair gas station at 3720 Lone Tree Way in Antioch, just before 11 a.m., according to the initial press release by the department that afternoon. Police had received a report of shots fired, followed by a report

from a local hospital that two gunshot victims had arrived at the hospital, one in grave condition and one in critical condition. The following day, one of the victims, Johnta White, 25, of Richmond, died. The Antioch police described the incident as an “unprovoked homicide.” No further updates were provided by police regarding the other victim, an unidentified 30-year-old Antioch man. Police are asking anyone with information regarding Matthews’ whereabouts to contact Detective Whitaker at 925-7796890.

Murder charge filed in Brentwood shooting

Autopsy shows bull likely killed Brentwood man

The Contra Costa County District Attorney’s office has charged an 18-year-old Brentwood resident with murder and a gun enhancement in the shooting death of his 43-yearold estranged father. Israel Resendiz is accused of fatally shooting Jose Silvestre Resendiz-Valles at the Brentwood Park Apartments on Sycamore Avenue during a family disturbance at the Brentwood Park Apartments on Sycamore Avenue in Brentwood on Jan. 9, police said.

A man who was killed by a bull before it was shot to death by emergency responders died of “multiple blunt force chest and abdominal injuries due to alleged attack by large animal,” according to a Contra Costa County Sheriff Department statement. Authorities found the victim, Brentwood resident Gang Sun, 74, dead in a field on Jan. 6 in the 1900 block of Bixler Road in Discovery Bay

Resendiz was taken into custody at the scene, as was the suspected firearm used in the act, police said. He remains in custody on $2 million bail, police said. “Preliminary information revealed the man was shot during a family disturbance,” police said in a statement.”This was an isolated incident, and there is no threat to the public.” Residents say that the apartment complex is typically peaceful, with a lot of children who play in the area.

after responding to reports of the attack shortly after noon. A large, aggressive bull on scene initially prevented emergency responders from reaching the injured victim until they moved closer inside their vehicles, authorities said. The bull later charged emergency responders outside their vehicles, prompting authorities to shoot the animal to death, the sheriff department said.

McNerney won’t seek reelection Brentwood hires House term expiring, redistricting changes in 2023 Congressman Jerry McNerney, who has represented the district that covers Brentwood, Oakley, Bethel Island and a portion of Antioch since 2013, will not seek reelection. The decision comes amid U.S. Congressional district representation changes that will take effect in 2023, when McNerney’s term would have expired. McNerney has served East County since 2013, and he also served parts of Antioch in East County from 2006 until 2013, when he served the 11th Congressional District. Under the new district configuration – slated to take effect Jan. 23. 2023 – U.S. Congressional representation for much of East County – Brentwood, Oakley, Bethel Island and a portion of Antioch – will shift from McNerney’s District 9 to District 10, currently represented by Democrat Josh Harder. Harder’s term expires this year, and he has announced Jan. 18 that he will seek to replace McNerney. Discovery Bay will remain in District 9, which will be served by McNerney’s successor. The waterfront area of Antioch will be represented in District 8. D MEDAL OL RD

MCNERNEY “I am honored that the citizens of California’s 9th Congressional District chose me as their representative in the past five elections, and that those in California’s previous 11th Congressional District gave me the privilege of representing them for three terms,” McNerney said in a statement. “I am very proud of the many accomplishments that my staff and I have achieved in Congress, including the creation of a major veteran’s health center facility in San Joaquin County, providing outstanding help for constituents with federal agencies, and securing major investments in infrastructure and public safety, broadband, education, childcare, and health care access. I have always fought tirelessly for those in need, and I will continue to do so.” According to his website, just last year, he: • hosted several pediatric COVID-19

Before serving in Congress, McNerney, who has his Ph.D. in mathematics, was an engineering contractor to Sandia National Laboratories in New Mexico. In 1990. he moved with his family to California, accepting a senior engineering position with U.S. Windpower, Kenetech. Later, he was an energy consultant for PG&E, FloWind, the Electric Power Research Institute, and other utility companies. Before his election to Congress, he formed a start-up company to manufacture wind turbines. assistant city manager

The City of Brentwood has hired Darin Gale as its new assistant city manager, the city said in a news release on Jan. 19. Gale, who will oversee the economic development and public information office responsibilities in the city manager’s office, has 20 years of public and private sector experience in community development, economic development, and public affairs, according to the city. He begins the job on Jan. 31. Gale will assume the position of Terrence Grindall, who retired on Oct. 6. Longtime Brentwood Police Chief Tom Hansen, who has been filling the position in an interim role, will resume his police department position in February. “I’m excited to welcome Darin to the City of Brentwood, and so appreciate Police Chief Tom Hansen’s diligent efforts helping out in my office in the interim serving as the acting assistant city manager,” City Manager Tim Ogden said. Gale most recently led the city of Sacramento’s inclusive business retention and expansion programs, overseeing the implementation of a $10 million small business forgivable loan program to assist 1,400 small businesses hurt by the COVID-19 pandemic. Prior to Sacramento, Gale worked for Yuba City for 10 years as deputy city manager overseeing economic development, public affairs and key council initiatives, Brentwood officials said. In his Yuba City role, the city’s sales tax revenue grew by over 50% and the city was named as one of the “Top 10 Best-Performing Small Cities” in America, by the Milken Institute, for its economic development growth, Brentwood officials said.

Freedom High School senior Ethan Afflerbach recently won first place in the “high schools with more than 50 teams” category of the Securities Industry and Financial Markets Association Foundation Stock Market Game. The 18-year-old played the game as part of the Business and Marketing course he is taking, taught by Noureddine Lalami, a veteran teacher at Freedom. “This was something we started fairly early in the year,” Afflerbach said. “I learned how to use the stock market, but my big takeaway is that stocks can make a lot of money and it’s mostly about luck. I am ready to get in the stock market now. They are good for money. Dangerous, but good.” Prior to playing the game, Afflerbach admitted he had almost no knowledge of the stock market or how it worked. Once he was signed up, he was given a virtual $100,000 to invest at his discretion based on real-world market trends. “It’s like a real broker’s account, except it’s fake money,” Lalami said. “They compete against local high schools in the San

Lalami, who offers the competition to his students each year. “I definitely see the value of it. The students learn about business and companies. It’s not just investigating in order to choose their stocks. I have them look at revenue, net income, why they would choose one company over another, long term market trends – a lot of different things, so they learn about the business aspects of the companies before they invest.” Steve Amaro, assistant principal at Freedom High School, said this kind of opportunity is important for students. “We are always excited when our students get an opportunity to compete against each other and students from other schools in an exciting class environment,” Amaro said. “We appreciate Mr. Lalami for researching and allowing our students to participate in order to tap into real world experiences.” SIFMA is a trade association for broker-dealers, investment banks and asset managers operating in the U.S. and global capital markets. Francisco and Sacramento areas. The students invest the money, and whoever grows their money the most, gets first place. They learn about investment and investment strategies and things like that. Ethan grew his investment about 24%.” By the end of the semester-long game, Afflerbach had turned his initial $100,000 into $124,929.93. He said playing the market was fun and he got in the habit of checking the market statistics each time he walked into class. He invested in popular stocks like Apple and Tesla, but also others with a smaller following. “I chose Ford and Coca-Cola, also,” he said. “I would go into older companies and look at the past six months and try to make a pattern. Ford did do well, but it was such a low price, it didn’t really affect anything. Tesla did really well, probably because of all the electric cars coming out. I’m not sure why Apple went up; I guess people just like Apple products. The patterns I invested in, they would go down a little, then spike all the time. For the most part I was right, but I do feel like it was mostly luck due to it being the stock market.” The Stock Market Game curricula, lessons, hands-on student activities, and virtual events combine content knowledge, critical thinking, research, and analytical skills in a real-world simulation. Participating students enhance their knowledge in core curriculum subjects including math, language arts, economics, and social studies. They also develop life skills such as financial preparedness, team-

HOW TO AVOID A CONSERVATORSHIP

by Joan Grimes, Esq.

Many people believe that the purpose of a Trust (sometimes referred to as a “Revocable Trust” or “Living Trust”) is to avoid probate. While this is correct, there is another very important reason to have a Trust. A Trust, if established properly, can also avoid a conservatorship in the event of incapacity. During a conservatorship, the court will generally appoint a “conservator of the person” and a “conservator of the estate”. The conservator of the person and the estate is sometimes the same individual, but can often be two separate people depending on the circumstances. The conservator of the person is tasked with making decisions regarding your health and well-being, whereas the conservator of the estate controls and manages your financial affairs. Not only is the process of appointing a conservator overwhelming for family and loved ones, but the financial cost of appointing a conservator can be extremely burdensome. If a Trust is properly established and funded, all of an individual’s assets (or the majority of assets) will be held in the Trust and the Trust documents will contain specific incapacity provisions. These provisions will provide instructions to your Trustee as to how your affairs should be handled in the event of incapacity. To avoid a conservatorship, a Trust should include the following provisions: First, who will determine capacity? Some people want their spouse or child, along with an attending physician, to determine capacity. Other individuals wish to establish a “disability panel”, whereby chosen individuals or physicians will determine capacity. Second, how will your financial affairs be

handled during incapacity? Do you have any dependents i.e. minor or disabled children that need to be provided for during incapacity? Third, if you are not able to care for yourself, what should be the standard of your care? Do you have specific requests of where you want to live? Do you want to remain in your home and have in-home support services? If you have specific ideas regarding your care, your Trust can, and should, include this information. Fourth, if a residential facility is necessary, do you know where you want to go? If that residential facility does not have any vacancies, have you thought about any alternatives? Without any of your guidance or input, these decisions are especially difficult on family and loved ones. In conclusion, if you have a Trust, you should review the incapacity provisions. If the Trust provisions are not what you want, you can amend the Trust to correctly reflect your wishes. To avoid a potential stranger from making decisions regarding your assets and care, you should consider establishing a Trust. While we may not be able to control our physical or mental health, we can control how our assets are used to care for us. If you would like me to review your Trust, we see people Monday – Friday for a FREE 30 minute consultation in Walnut Creek and Brentwood. This article provides only general legal information, and not specific legal advice. Information contained is not a substitute for a personal consultation with an attorney. Vacant 11th Assembly District seat to be filled through special election District includes Brentwood area Gov. Gavin Newsom has announced that the 11th Assembly District seat opened up by Jim Frazier’s resignation will be filled through a special election. The primary election will be held on April 5. A candidate must receive a majority of the votes (50% plus 1) during that election; otherwise, a special election between the top two primary vote-getters will be held on June 7. Frazier, who represented more than 500,000 residents of District 11 — an area that covers parts of Contra Costa, Sacramento and Solano counties and includes Antioch, Brentwood, Byron, Discovery Bay, Knightsen and Oakley — left office on Dec. 31, citing a desire to catch up with family and friends. Candidates must meet a series of requirements, including being U.S. citizen; a registered voter; and with no convictions of a felony, involving accepting or giving, or offering to give, any bribe, the embezzlement of public money, extortion or theft of public money, perjury, or con-

FRAZIER spiracy to commit any of those crimes. Candidates must obtain and deliver their nomination papers, in addition to filing a declaration of candidacy and ballot designation worksheet, by Feb. 10. Frazier first sought elected office in 2008, when he successfully ran for a seat on the Oakley City Council. He went on to serve as mayor of the city from 2011 to 2012. Frazier was elected to the state Assembly in 2012 and easily won reelection every two years since. His current term was set to expire on Dec. 5, 2022. My last few articles have discussed both sides of the argument whether the real estate market is about to crash or continue to appreciate. This week I’ll continue the case why the market seems likely to hold up. RENTS ARE HIGH. Back in 2008, house payments were high and going higher as many people were faced with their adjustable-rate mortgages adjusting into higher and higher payments. At the same time, rents were MUCH lower than they are today. This helped some people to make the decision that they were better off renting than owning and since they owed more on their home than it was worth, it just made it that much easier to “walk away.” The current situation is much different as rents are VERY high. My point is that if prices do stop appreciating or even drop, most homeowners would opt to stay in their current homes rather than sell and move into a rental where they will pay as much or MORE in rent, and potentially lose some of their tax write-offs.

Los Medanos College to offer classes on the history of East County The Los Medanos College Lifelong Learning Center is enrolling students in courses touching on the history of eastern Contra Costa County from Native American occupation to 1900 and a course on imagining the Sacramento-San Joaquin Delta: voices across centuries. A History of Eastern Contra Costa County from Native American Occupation to 1900 The class, which begins in February, runs on Tuesdays from 2 to 4 p.m. at the Los Medanos College Brentwood Campus. The cost is $39. This survey course covers the early history, anthropology and post-Mexican era development of the area. No texts are required for the class. A reader/reference guide to local, and Sacramento and San Joaquin River Delta is provided for further reading and viewing. The class is taught by Carol Jensen. A part 2 of the course, which requires a separate sign-up, is scheduled to begin in March. Part 2 would cover the history of eastern Contra Costa County communities from 1900 to 1970 and the 20th Century history, anthropology and economic development of the area. A reader/reference guide to local, and Sacramento and San Joaquin

River Delta is provided for further reading and viewing. Imagining the Sacramento-San Joaquin Delta: Voices across Centuries The course, which begins in late February, runs on Thursdays from 2 to 4 p.m. online. The cost is $39. Journey through the Sacramento San Joaquin Delta. We begin with native voices, then travel with Spanish explorers. Next, we hear from Rancheros before from those searching for gold. As these riches dwindle, agricultural land is contested. Inventors describe machines to tame the Delta. Town folk talk of growing communities, labor tensions and ethnic enclaves. With Prohibition, visitors celebrate escape. Then World War II disturbs the Delta. After the war, marinas became the hubs of conversation. Soon, the region’s water and habitats take center stage. Looking to the future, some imagine nature forcing a new settlement pattern. Throughout, we encounter the famous and those lost to history, but each voice helps to define the Delta’s “sense of place.” The class is taught by Robert Benedetti. WORK-FROM-HOME. COVID has drastically changed where many people work, and that is driving many people out of the big cities and into the suburbs. East Contra Costa County has been an especially attractive option for these folks. We are still “affordable” compared to the Silicon Valley, our quality of life is high, but it’s close enough that someone could still pop into the office physically now and then. RENTERS WANTING TO BUY. Many renters thought the market was too high even before the recent run-up in prices and they were waiting for the next “drop” to jump in. Some of them have given up waiting and have re-entered the market as they’ve seen their rents increase the last few years and seen their homeowning friends and relatives gain equity. OBITUARIES Barbara Deanna (Lieb) Lochhead

Gladys P. Mercer

March 26, 1942 – Dec. 10, 2021 Barbara Lieb Lochhead, 79, died peacefully on Dec. 10 , 2021 at her home in Oakley, Calif. She was born on March 26, 1942 in Berkeley, Calif., the daughter of William Howard and Thelma Owens Lieb. Barbara met Neil Lochhead in 1959 in Oakland, Calif. and they married the following year. She spent most of her younger years raising their two sons and caring for their homes. She and her family lived in El Cerrito, Calif., Santa Rosa, Calif., Richmond, Calif., and Pleasant Hill, Calif. during this period. Beginning in 1977, she started working at Sears in Hayward, Calif., where she quickly moved up through the ranks and became a department manager before leaving when Sears closed that store in 1993. She then worked at Fabric Land/JoAnn Fabrics in Livermore, Calif. for a couple of years. About the same time, she moved to Brentwood, Calif. to be closer to family; both of her sons and their families lived nearby. She started up her own sewing business in the area and was widely known for her wedding and graduation dresses. Her grandchildren, born over a number of years in the late 1990s, brought a new component to her life. She loved her life as a grandmother and spent much of her subsequent years caring for them while continuing a few of her professional activities including teaching sewing at a local community college. Around this time, she became a member of the Presbyterian Church in Discovery Bay, Calif., and in 2003 began helping at the church’s school. Barbara then began taking college courses so that she could be certified in 2005 to teach preschool at the church. Always wanting to ‘do’, Barbara was never really looking forward to retirement. But having to deal with a number of medi-

cal problems, she finally stopped teaching preschool in 2015. She did continue to help with some church activities including serving as a deacon. With new free time, she began focusing on gardening and soon was producing delicious veggies and beautiful flowers. Barbara was preceded in death by her loving Aunts Loie and Vance Carew, Oakland, Calif., and a few beloved East Coast Owen cousins, and one of her best friends from her early years, Kris Wolf, Graeagle, Calif. Surviving Barbara are: her brother, James Lieb and his wife Megs Wood of Palmer, Alaska; her sons, Ronald Lochhead and his wife Raquel of Pittsburg, Calif., and Raymond Lochhead and his wife Leslie of Brentwood, Calif.; and her grandsons, Russell Lochhead and Rylan Lochhead of Pittsburg, Calif., her granddaughters, Brooke Lochhead of Lodi, Calif. and Ally Lochhead Hengst and her husband, Foster Hengst, of Woodlake, Calif. A memorial service will be held at the Delta Community Presbyterian Church, 1900 Willow Lake Road, Discovery Bay, Calif., at 11 a.m. on January 22, 2022.

April 22, 1926 - January 15, 2022 Gladys Mercer, age 95, passed away on Saturday, January 15th at her daughter, Garnetta’s, home in San Jose. Gladys’ final resting place will be Brentwood Byron Knightsen Union Cemetery with her late husband, Henry (Hank) Mercer, who passed away in 2009. They were married 68 years before his passing. Two hearts -- One Love are reunited. A date for celebration of her life has not yet been set. Gladys was an optimist. Her philosophy of life was: “If someone gives you lemons, don’t complain – make lemonade!” In 1942, Gladys and Hank left Paragould, Arkansas in the rumble seat of a 1932 Ford hugging and kissing all the way to the Bay Area to begin their life together. Gladys’ business career began during World War II working in the Kaiser Shipyards. After the war, Gladys and Hank formed a construction company building trailers and homes throughout the Bay Area. In 1955, after finding and enjoying Delta waterways, they built their home in Knightsen. In 1958, they founded and operated the hardware and redi-mix concrete business Oakley Builders Supply for 40 years. Gladys ran the store and office. Hank ran the yard and equipment. They taught many extended family and community youth skills for construction; sales, office and radio dispatch; and

truck and heavy equipment operation. When not working, Gladys was an active community member and leader serving: Girl Scouts; 4-H; PTAs; Garden Club; East Contra Historical Society; Ladies’ Out to Lunch Bunch; and training their dogs to perform tricks for entertainment at convalescent homes and elementary schools. Gladys completed her life feeling loved, respected, and with precious memories of family, extended family and friends working and enjoying life together. Gladys is survived by 3 of their 4 children: Charles (Bud) Mercer of Battle Ground, Washington; Garnetta Annable of San Jose; Barbara Evanson of Fairfield. Their oldest daughter, Patricia Bello, predeceased Gladys. Gladys is also survived by 11 grandchildren and 14 great grandchildren.

Gray wolves deserve protection

Editor: The recent news that 20 wolves from Yellowstone National Park have been killed by hunters and trappers is heartbreaking evidence of the need for the Biden administration Department of the Interior to finally act and protect these wolves as senators, congresspeople, scientists, a former director of the U.S. Fish & Wildlife Service, Tribal leaders, and activists have been imploring them to do. Hunters in Montana can sit just feet outside of Yellowstone National Park using bait and recorded calls to lure wolves out of the protected area to their deaths. In Montana, they can kill as many as 20 wolves each (10 by gun and 10 by trap). In Idaho, there is no limit. The Biden administration could have prevented this slaughter and must act before it gets worse. In August, Dan Ashe (the former director of the U.S. Fish & Wildlife Service under President Obama) wrote a Washington Post op-ed piece urging Interior Secretary Deb Haaland to act and issue emergency protections for gray wolves as permitted under the Endangered Species Act. Mr. Ashe outlined exactly why she should act and under what authority. To date, President Biden and Secretary Haaland have ignored the former USFWS director and his pleas to act. He followed up in December with a letter signed by directors of zoos and aquariums in his role as CEO of the Association of Zoos and Aquariums. This also has been ignored by Biden and Haaland. We learned last year that Secretary Haaland has twice opted out of scheduled meetings with tribal leaders seeking to speak with her in support of relisting gray wolves under the

Endangered Species Act and engaging in tribal consultations before any future policy decisions are made. Secretary Haaland and President Biden owe the country better. In her role as Secretary of the Department of the Interior, Secretary Haaland is entrusted with the caretaking of our natural spaces and the species that live in them. She is not living up to that mandate. Please join me in writing to the Department of Interior at doi.gov and ask that Secretary Haaland finally act to stop this unsustainable killing of gray wolves in the Northern Rockies before it is too late. It took our nation decades to bring these wolves back. Idaho and Montana can destroy this progress in just months if the Biden administration continues to ignore them. Maris Bennett Antioch

Hunting of gray wolves must end

Editor: When gray wolves were restored to Yellowstone National Park, our country began the process of restoring a decades-old wrong. In the years that have since passed, wolves in the Northern Rockies have begun to recover. But recent actions by Montana and Idaho that seek to kill up to 90 percent of the wolves in their states, threaten the future of this ongoing recovery. Today, hunters in Montana can sit just feet outside of Yellowstone National Park and gun down as many as 10 wolves each. In Idaho, private contractors have been hired by the state to trap and shoot nearly all of the wolves in their borders. Montana will soon allow the use of deadly and indiscriminate neck snares that strangle the animal unfortunate enough to come across them. The Biden administration has the tools to stop this slaughter. In August, the former director of the U.S. Fish & Wildlife Service under President Obama wrote a Washington Post op-ed piece imploring Interior Secretary Deb Haaland and President Biden to act and issue emergency protections for gray wolves. He outlined exactly how and why they must act. Biden and Haaland are entrusted with the caretaking of our natural spaces and the species that live on them. Their inaction to date is inexcusable. Please join me in writing to the Department of Interior at DOI.gov and ask that they finally act to protect wolves in the Northern Rockies before it is too late. Susan Worden Rio Vista

Balanced Liberty basketball team ready for BVAL play by Michael Dixon Correspondent

The Liberty High School boys basketball team is 15 games into its 20-game season and sports an 11-4 record. While Bay Valley Athletic League play has yet to begin, the Lions preseason mark is by far the best in the league, with 6-5 Heritage and 8-8 Freedom being the next two best teams in non-league play. And the record alone doesn’t necessarily tell the story about how good Liberty has been. The quality of opponents has also been strong. “If you look at MaxPreps and start doing comparisons, we have the highest strength of schedule in the league,” coach Jon Heinz said. We’ve had some really good wins and a couple really disappointing losses. We don’t blow anyone away with our athleticism. But we feel confident that we have five to six players on the team who are capable of putting up 15 points in any given game. That depth has been tested a lot throughout the season.” On Dec. 30, Liberty defeated Valley Christian 83-81, in double overtime, despite missing three players. One of the stars of that game was sophomore Gavin Cook-Whisenton, who normally plays on the junior varsity team but was called up. The bump in competition did little to faze Cook-Whisenton, who scored 17 points and grabbed 15 rebounds in Liberty’s win.

The Lions’ most recent game was against Davis on Saturday, Jan. 15 in the Simply Basketball Showcase at Sacramento’s Sheldon High School. Heinz acknowledged that he was “really worried about Davis” going into the game. Adding to those concerns, the Lions were down four players for that game, dressing only 10. Despite that, Liberty came away with a 64-51 victory. “We really controlled that game from start to finish,” Heinz said. “We haven’t had our full team together in three weeks because of injuries and COVID. But we keep fighting through it.” While many of the injuries have been temporary, one key loss has been junior forward Ethan Wassem, who’s sidelined for the remainder of the season. Depth is certainly the key for the Lions. Despite that, there have been some key leaders on the team through the year. Guard Julian Costa was all-league as a sophomore and is on his way to repeating the honor as a junior. At 6-foot-4, fellow junior Miles Lawrence gives Liberty some toughness in the paint. The victory against Davis was the team’s first game in 10 days. It’s also currently scheduled to be the team’s last game until Wednesday, Jan. 26. Flag football is coming to East County by Jesus Cano Correspondent

Next Level Sports, a Bay Area-based sports league, will be making its debut at Heritage High School in Brentwood with a nine-week flag football program. It was slated to occur during the 2020-’21 season but was sidelined due to the COVID-19 pandemic. The program is open for all children in grade levels kindergarten through sixth grade and runs every Sunday from January 16 to March 13, rain or shine, and is designed to have a two-hour model where participants practice for the first hour and play a game the following hour. The schedule is as follows: • 6th/7th Grade - 9 a.m. practice/10 a.m. game • 5th Grade - 9 a.m. practice/10 a.m. game • 4th Grade - 10 a.m. practice/11 a.m. game • 3rd Grade - 10 a.m. practice/11 a.m. game • 2nd Grade - 11 a.m. practice/noon game • Kindergarten/1st Grade - noon practice/1 p.m. game

Current Heritage assistant coach Kevin Hartwig – who served as Freedom’s head football coach for 16 seasons – will be the site director. While there is no tackling in flag football, Hartwig said that a program like this will help develop talent “I really liked the model where it brings more kids involved in football for the right reasons,” Hartwig said. Hartwig said the landscape of football has changed, with the days of kids playing contact football at 7, 8 or 9 years old faded away. “I think that’s what has killed our sport,” Hartwig said. “There’s just not enough information backing flag football. A 5-year old playing flag football, is a lot different than a 5-year-old playing tackle football.” A player doesn’t need to play football their entire life to be successful, according to Hartwig.

“It’s about development and just getting more kids to like football,’’ Hartwig said. Next Level has had strong local interest with 260 participants enrolled, surpassing Hartwig’s goal of 220. Next Level also has a unique coaching model. Local high school football players will be in charge of coaching and officiating games. Heritage running back and Fresno State commit Devon Rivers will be coaching the Fresno Bulldogs. “I think it’s important so kids understand and learn the rules of the games fast to keep kids safe and keep less kids from getting injured,” Rivers said. The cost is $275, which includes a participant’s custom jersey, shorts, use of flags, and other equipment/offerings. For more information, visit https://www.nextlevelsports.com/.

Oakley native competes in Monster Energy AMA Supercross Championship Kyle Greeson, an Oakley native, participated in the 2022 Monster Energy AMA Supercross Championship at Oakland’s Ring Central Coliseum last weekend. Greeson qualified in 40th position on his KTM 350, in the premier 450SX class. He went on to finish 20th in the seven-lap race to determine gate picks for the main event. And in the last- chance qualifier, he finished in 13th place, which put him out of position for the 22-man main event. Only the top four in the last- chance qualifier advanced.

while Heinz is trying to find at least one fill-in game, the fact that most schools are into their league schedules now does not make that any easier. “Playing one game in three weeks, you just don’t know what you’re going to get out of your team,” Heinz said. Heinz has always said that a 10-game regular season was a better way to crown a league champion than a single-elimination tournament. But this year, with a 10-game season not possible, he feels the tournament is equitable. “This year with COVID, kids in and out of the lineup,” he said. “If you’re healthy

Greeson, 21, has been racing since his early days on a mini bike at local tracks in the region. Greeson’s goal at the Oakland event was to have fun racing and gain valuable experience, especially to experience the speed of the 450SX class, he said. He plans to race more West Coast rounds to gain more experience. The top three finishers in the 450SX Class in Oakland were Jason Anderson, Aaron Plessinger and Justin Barcia.

for that one week, you have a chance.” From what he’s seen in the nonleague season against quality opponents, Heinz said he knows that his team has a real chance at not only winning a league championship but potentially going on a deep postseason run. “I’m pretty lucky to coach a great group of boys -- they’re really coachable and they listen,” Heinz said. “They’re really great kids. And really young. In a home stretch in a big game, I had two sophomores, two juniors and one senior. In my top seven, there’s only two seniors. They’re balanced and if they play hard defense, good things will happen.”

The Liberty High Lions boys basketball team was originally scheduled to open BVAL play on Tuesday, Jan 11 and the league season was going to be a customary 10-game schedule where each team would play all league opponents twice – once at home, once on the road. But due to a spike in COVID-19 numbers, league play will now be a single round-robin, beginning on Wednesday, Jan. 26. Liberty will open the BVAL schedule on Jan. 26 at home against Deer Valley. The Lions will be on the road

against Pittsburg on Friday, Jan. 28, home against Freedom on Wednesday, Feb. 2, at Antioch on Friday, Feb. 4 and will host Heritage in the regular season finale on Monday, Feb. 7. All of Liberty’s games -- home and road -- are scheduled to start at 7 p.m. Following that, a league tournament will commence, with the toptwo seeds receiving a first round bye, the No. 3 and No. 6 seeds playing in one first round game and the No. 4 and No. 5 seeds squaring off in the other.

GAMES & PUZZLES Here’s How It Works:

Sudoku puzzles are formatted as a 9x9 grid, broken down into nine 3x3 boxes. To solve a sudoku, the numbers 1 through 9 must fill each row, column and box. Each number can appear only once in each row, column and box. You can figure out the order in which the numbers will appear by using the numeric clues already provided in the boxes. The more numbers you name, the easier it gets to solve the puzzle!

SION 4687, FILED MAY 24, 1978, IN BOOK 211 OF MAPS, PAGE 5, CONTRA COSTA COUNTY RECORDS.NOTICE TO POTENTIAL BIDDERS: If you are considering bidding on this property lien, you should understand that there are risks involved in bidding at a trustee auction. You will be bidding on a lien, not on the property itself. Placing the highest bid at a trustee auction does not automatically entitle you to free and clear ownership of the property. You should also be aware that the lien being auctioned off may be a junior lien. If you are the highest bidder at the auction, you are or may be responsible for paying off all liens senior to the lien being auctioned off, before you can receive clear title to the property. You are encouraged to investigate the existence, priority, and size of outstanding liens that may exist on this property by contacting the county recorder’s office or a title insurance company, either of which may charge you a fee for this information. If you consult either of these resources, you should be aware that the same lender may hold more than one mortgage or deed of trust on the property. NOTICE TO PROPERTY OWNER: The sale date shown on this notice of sale may be postponed one or more times by the mortgagee, beneficiary, trustee, or a court, pursuant to Section 2924g of the California Civil Code. The law requires that information about trustee sale postponements be made available to you and to the public, as a courtesy to those not present at the sale. If you wish to learn whether your sale date has been postponed, and, if applicable, the rescheduled time and date for the sale of this property, you may call 800280-2832 for information regarding the trustee’s sale or visit this internet website http://www.qualityloan.com, using the file number assigned to this foreclosure by the Trustee: CA-21-893576-AB. Information about postponements that are very short in duration or that occur close in time to the scheduled sale may not immediately be reflected in the telephone information or on the internet website. The best way to verify postponement information is to attend the scheduled sale. NOTICE TO TENANT: You may have a right to purchase this property after the trustee auction pursuant to Section 2924m of the California Civil Code. If you are an “eligible tenant buyer,” you can purchase the property if you match the last and highest bid placed at the trustee auction. If you are an “eligible bidder,” you may be able to purchase the property if you exceed the last and highest bid placed at the trustee auction. There are three steps to exercising this right of purchase. First, 48 hours after the date of the trustee sale, you can call 800-280-2832, or visit this internet website http://www.qualityloan.com, using the file number assigned to this foreclosure by the Trustee: CA-21-893576AB to find the date on which the trustee’s sale was held, the amount of the last and highest bid, and the address of the trustee. Second, you must send a written notice of intent to place a bid so that the trustee receives it no more than 15 days after the trustee’s sale. Third, you must submit a bid so that the trustee receives it no more than 45 days after the trustee’s sale. If you think you may qualify as an “eligible tenant buyer” or “eligible bidder,” you should consider contacting an attorney or appropriate real estate professional immediately for advice regarding this potential right to purchase. The undersigned Trustee disclaims any liability for any incorrectness of the property address or other common designation, if any, shown herein. If no street address or other common designation is shown, directions to the location of the property may be obtained by sending a written request to the beneficiary within 10 days of the date of first publication of this Notice of Sale. If the sale is set aside for any reason, including if the Trustee is unable to convey title, the Purchaser at the sale shall be entitled only to a return of the monies paid to the Trustee. This shall be the Purchaser’s sole and exclusive remedy. The purchaser shall have no further recourse against the Trustor, the Trustee, the Beneficiary, the Beneficiary’s Agent, or the Beneficiary’s Attorney. If you have previously been discharged through bankruptcy, you may have been released of personal liability for this loan in which case this letter is intended to exercise the note holders right’s against the real property only. time of the initial publication of this Notice of Trustee’s Sale is estimated to be $599,375.14 (Estimated). However, prepayment premiums, accrued interest and advances will increase this figure prior to sale. Beneficiary’s bid at said sale may include all or part of said amount. In addition to cash, the Trustee will accept a cashier’s check drawn on a state or national bank, a check drawn by a state or federal credit union or a check drawn by a state or federal savings and loan association, savings association or savings bank specified in Section 5102 of the California Financial Code and authorized to do business in California, or other such funds as may be acceptable to the Trustee. In the event tender other than cash is accepted, the Trustee may withhold the issuance of the Trustee’s Deed Upon Sale until funds become available to the payee or endorsee as a matter of right. The property offered for sale excludes all funds held on account by the property receiver, if applicable. If the Trustee is unable to convey title for any reason, the successful bidder’s sole and exclusive remedy shall be the return of monies paid to the Trustee and the successful bidder shall have no further recourse. Notice to Potential Bidders If you are considering bidding on this property lien, you should understand that there are risks involved in bidding at a Trustee auction. Notice to Property Owner The sale date shown on this Notice of Sale may be postponed one or more times by the Mortgagee, Beneficiary, Trustee, or a court, pursuant to Section 2924g of the California Civil Code. The law requires that information about Trustee Sale postponements be made available to you and to the public, as a courtesy to those not present at the sale. If you wish to learn whether your sale date has been postponed, and, if applicable, the rescheduled time and date for the sale of this property, you may call ServiceLink Auction | Hudson and Marshall at (866) 539-4173 for information regarding the Trustee’s Sale or visit the Internet Website address https:// www.servicelinkauction.com/ for information regarding the sale of this property, using the file number assigned to this case, CA07000315-19-1. tire and go somewhere new, but it was close enough to ideal,” Beard said of his decision to join Oakley police. “I retired from the Sheriff’s Office and Oakley hired me.” The transition from a role that covered the entirety of Contra Costa County to the relatively confined borders of a small city took some time, Beard said. “It took a little while to get used to,” he said. “I’m not one bit sorry for being in Oakley, but it made me appreciate the breadth of the Sheriff’s office, and all the diversity of the assignments and expansive real estate that I had to work in.” Starting as a detective, Beard progressed to sergeant and lieutenant before becoming police chief. The move from sergeant to lieutenant also meant a transition to a role with more administrative duties that gave him the opportunity to see the inner workings of the city. It also highlighted some opportunities for im-

Union

proving how the Oakley Police interacts with the rest of the city. Beard said one of his top priorities is to explore those opportunities with the goal of creating a more efficient police force. Beard is, however, facing a significant hurdle right out of the gate. “My biggest challenge right now is COVID-19,” he said. “It’s impacting our staffing levels. … I deliver a weekly message to the OPD staff. My last message for 2021 was, ‘Guys, we did a great job with (COVID-19). We’ve been impacted minimally. Let’s keep up the good work in 2022.’ I never should have said that because we’ve had several exposures and several illnesses because of (COVID-19).” Also near the top of Beard’s objectives is growing the department’s administrative staff. “Right now, I am the sole administrator,” he said. “It’s not effective (for me) to run the administrative portion of the

tended commutes to new work locations as a result of union representation that has been ineffective in negotiations with the county. “Our members have not received adequate representation which has resulted in devastating outcomes that will drastically effect [sic] our lives and well-being,” wrote Nicole Donovan, shop steward of Local 2700, in a letter addressed to district Board President Brian Oftedal and Fire Chief Brian Helmick. The annexation of the fire district by Con Fire was approved by the boards of both organizations this past September. In this process, the fire district will be absorbed in whole by Con Fire, which will then assume responsibility for providing fire and rescue services for what is now the fire district’s service area. That service area occupies 249 square miles of East Contra Costa County. Fire district Director Joe Young said the consolidation of the districts is not a labor negotiation. “The terms of the consolidation have already been dictated,” he said. “All employees are to be moved over with parity. No one is to be impacted on a pay and benefits basis. There should be no negotiation going on. … We’ve been promised all along that this will happen. I

mosphere.” Additionally, the mayor acts as a figurehead for public events, such as ribbon cuttings. A councilmember must serve a full year on council before being considered for vice mayor and then mayor. The member with the most continuous time of service on the Council who has not previously served as Vice Mayor and is not selected Mayor will be selected as Vice Mayor,” reads the section of the Oakley municipal code on mayoral selection. “If two or more members have equal time of continuous service, the member who received the highest number of votes at his/her election shall be selected.” For his term as mayor, Pope said he is interested in a greater focus on public safety, particularly traffic safety. He cited the intersection of Laurel Road and Em-

police department. That becomes unfair to the men and women that I serve, that I lead. They need effective leadership. That’ll be something that I work with the city manager on very quickly.” Beard is the fourth chief of police in the police department’s nearly six-year history. Chief Dean Capelletti, who preceded Beard, was terminated by the city in November after a little more than a year in the role. An investigation into unspecified complaints about Capelletti led to his firing. City officials have revealed few details about the nature of the complaints or the investigation, saying only that it was a civil, not criminal, matter. Beard said he was introduced to law enforcement at a young age. His paternal grandmother was a deputy sheriff for the Maricopa County Sheriff’s Office in Arizona, and she later became the first female police officer for the Chandler Arizona Police Department. His father was also a

am hoping, in fact, I’m demanding, that by the time we get to the next LAFCO (Contra Costa County Local Agency Formation Commission) meeting, I expect to hear that this is solved.” While district firefighters are represented by Local 1230, the responsibility for leading negotiations with the county for the administrative staff fell on Dan Harper, union representative for Local 2700. Donovan specifically called out Harper in her letter, which was read into the public record during the Jan. 12 fire district board meeting. She referred to Harper as “aloof ” during meetings and said that he “repeatedly dodged” questions. “Our members are deeply troubled as we are facing significant pay cuts ranging from 15 to 26%; $20,000 per year, while members of Local 1230 stand to make significant increases, with some as much as $40,000 per year,” Donovan wrote. “Members are being relocated to new offices which will increase their cost and time to commute, while being paid less. Others are being moved into unrepresented positions and are fearful that they will not have a guarantee of employment. We feel as though we are being sacrificed, and made to accept the stipulations of employment, which are unreasonably different than what we were promised.”

pire Avenue as the most dangerous in the city in terms of traffic incidents. The East Cypress Road and Main Street intersection previously held that distinction, according to Pope. The City Council will discuss these issues as well as various others soon as they prepare to write their strategic plan. Cities write strategic plans every two years to declare what concerns and other potential community improvements they plan to focus on. A key part of discovering those concerns is often input from residents during City Council meetings — something Pope hopes to see more of during his term. “One thing we’d love more of is engagement,” he said. “Part of the council’s job is to help solve problems. But to do that, we have to know what people are looking for.”

reserve officer with that department. “I’m excited for Chief Beard,” said Lt. Walter O’Grodnick of the Brentwood Police Department. “I’ve had an opportunity to interact with him on a few occasions and he’s always demonstrated a high level of professionalism. I have no doubt his tenure, expertise and quality of leadership is an excellent fit for the organization and community.” When he is off duty, Beard enjoys spending time with his wife and four children. He’s an avid fisherman and is kept busy with his four dogs. “Here in Oakley, I have served under three chiefs, and I can honestly tell you I have received valuable lessons from all three of them,” Beard said. “Mentorship is a very key thing in all career fields, and law enforcement is no different. I’ve had some very good mentoring to assist me as I take this new role on.” To comment, visit www.thepress.net

Harper also participated in the Jan. 12 meeting. He said that claims made in Donovan’s letter were untrue and called on the fire district board of directors to put pressure on the county to resolve the contested positions. “We need you to be pushing on LAFCO (the Contra Costa County Local Agency Formation Commission),” he said. “We need you to be pushing on the county, on labor relations, on the (County Administrator’s Office) to say that this needs to be resolved before this moves forward.” Approval of the annexation rests with LAFCO. The first of two votes required for approval was supposed to have taken place Jan. 12, but technical issues forced the cancellation of that meeting. Helmick has requested that LAFCO consider taking both necessary votes in its February meeting to keep the annexation process on track to close in the second quarter. That decision is still pending. Steve Aubert of the fire district fire marshal and public information office speaking several days after the Jan. 12 meeting said that some progress on the labor issues had been made. “We are confident that at least this has opened up the lines of communication and getting the union and county labor relations to start working more collaboratively together to figure this out,” Aubert said. “Ultimately, we know we have some labor-relation issues to still work through, but we think that they’ll be successful at being able to work something out for everyone.” To comment, visit www.thepress.net
