City sets capital project plan Staff Writer

BRENTWOOD City leaders have set the municipality’s five-year infrastructure and capital planning needs. The 105-project outline, which lays out roadway, parks and trails, water, wastewater and community facilities improvements, includes 56 city projects, 18 future improvement endeavors and 31 development enhancements, totaling $253.5 million in city projects. “The preparation of the (Capital Improvement Program) plan has been a collaborative effort between staff from all the various departments. It began many months ago, resulting in the document,” said Brentwood Business Services Manager Sonia Agostini. The plan, which the city uses to identify and align capital improvement needs, financing and timing, forecasts about

BRENTWOOD The atmosphere was reverent Monday afternoon, even as a nearby delivery truck stopped to observe the ceremony taking place at the Brentwood Veterans Memorial Building to commemorate Memorial Day. The event, one of two, drew a crowd of both veterans and citizens who wished to honor and show appreciation to those who gave the ultimate sacrifice for their country. Brentwood’s veterans center serves as a post of the American

Legion, the largest association dedicated to supporting wartime veterans. The current post commander, Michael Clement, served as host of the Memorial Day event. Clement, an Army combat veteran who served in Desert Storm, reminisced about the history of the building, which has been around since before his own youth, which was quite a while ago he admitted with a chuckle. His passion for the Legion’s mission statement was evident as he addressed the gathered crowd and gave tribute to veterans he had known who were no longer with us. see Memorial Day page 19A

BRENTWOOD The Brentwood City Council put the brakes on a planned Fourth of July parade during a special meeting on Tuesday, June 1, and asked city staff to come up with a new plan for the holiday. The city put out a press release last week stating the Parks and Recreation Department would host the fourth annual Brentwood Classic Fourth of July Parade next month, but city council members expressed concern and disapproval during the special meeting on Tuesday and voted to create a different, yet-tobe-defined event in its place. Councilmember Jovita Mendoza said at the beginning of the meeting that there was one COVID-19 related death in Brentwood in the last week and there is still an average of three cases a day locally. The city’s vaccination rate is currently 50.6 percent. “I don’t know why we can’t push this off a year,” said Councilmember Karen Rarey. “We have two parades coming this year where it’s colder and more people will be vaccinated. I think we are setting ourselves up to have a spike in our community and shutting businesses down and I would hate to see that, especially since we are getting to the point where we can open up.” City staff defended the idea, see Parade page 19A

Resident burned in Brentwood house fire by Tony Kukulich Staff Writer

BRENTWOOD Fire in a Brentwood home sent one occupant to the hospital with second-degree burns Sunday morning, May 30. “Today at 9:30 a.m. we received a report of a residential fire on the 100 block of Cloverleaf Circle in Brentwood,” said Steve Aubert, fire marshal with East Contra Costa Fire Protection District (ECCFPD). “Upon arrival we had smoke showing from a two-story house. We had a report of one adult male who had suffered from some second-degree burns on his foot.” The burn victim was transported to Sutter Delta Medical Center in Antioch. No other injuries were reported. The fire was quickly knocked down and, according to Aubert, it was contained to the area of origin in the home. “Cause of the fire is right now believed to be from unattended cooking on the stove top,” he added.

State takes action on water exports from the Delta by Tony Kukulich Staff Writer

REGIONAL Construction of a temporary salinity barrier on the False River is underway after an emergency request by the Department of Water Resources (DWR) was approved by the State Water Resources Control Board (SWRCB). The barrier, necessitated by worsening drought conditions, is intended to help preserve water quality in the Sacramento-San Joaquin Delta by reducing saltwater intrusion. The declaration of a drought emergency made by Gov. Gavin Newsom on May 10 suspended the requirement that a project of this nature complete a California Environmental Quality Act (CEQA) assessment. An SWRCB report completed in response to DWR’s request states, “During drought conditions, the release of water stored in upstream reservoirs may be insufficient to repel salinity moving upstream from San Francisco Bay. According to DWR’s analyses, without the protection of the drought salinity barrier, saltwater intrusions could render Delta water unusable for agricultural needs, reduce habitat value for aquatic species and affect roughly 25 million Californians who rely on the export of this water for personal use. Installation of the temporary rock barrier at West False River would limit salinity intrusion into the Central and South Delta and would potentially conserve water for a variety of uses system wide.” Michael Brodsky, attorney for the Discovery Bay-based Save the California Delta Alliance, doesn’t take issue with the need for the salinity barsee Delta page 16

McDonald’s held up by traffic safety concerns by Kyle Szymanski Staff Writer

OAKLEY Oakley leaders have put plans for a future McDonald’s at Laurel Plaza on hold until the impacts of the facility’s drivethru on Laurel Elementary School across the street can be evaluated. McDonald’s officials appeared before the council in late May in an attempt to garner the city-required conditional use permit for the proposed project’s drive-thru service use, but the issue was tabled after city officials heard a flood of concerns about the project’s possible impacts on Laurel Elementary School students, who frequent the plaza area before and after school. “A lot of the focus has been on the safety of the kids, but past traffic studies make no mention of children,” said City Councilmember George Fuller. The proposed 4,365-square-foot quickserve restaurant with dine-in and drive-thru service would front Laurel Road, about 300 feet west of O’Hara Avenue, within Laurel Plaza, on the northwest corner of Laurel Road and O’Hara Avenue — just across the street from Laurel Elementary School at 1141 Laurel Road.

Many of the more than 15 public speakers pleaded with the council to stop the project, due to concerns that increased traffic would jeopardize the children’s safety. The area’s previously adopted regulations, however, clear the way for any restaurant without a drive-thru, meaning that the council can only halt the restaurant’s drivethru, not the restaurant itself. “A McDonald’s or a fast-food restaurant, or any restaurant that does not include a drive-thru, would be automatically permitted,” Oakley City Attorney Derek Cole said. Regardless of established regulations, many residents said the project is a bad idea. “It is too near the school, which will create multiple traffic hazards for children going to and from school,” said resident Liz Elias. “Kids cross that street and enter that shopping center to get to their pickup rides, regardless of whether or not (using the plaza for school-related parking needs) is allowed.” Oakley Union Elementary School District officials did not return requests for comment as of press time. Brad Goldblatt, a representative of the proposed restaurant’s franchisee, declined to comment during the public meeting, when given time to respond to residents’ concerns.

City staff pointed out they required project officials to submit a proposed traffic report, which found the restaurant and a proposed Quick Quack Car Wash next door would together generate fewer vehicular trips than what was anticipated for the plaza when it was approved in 2008. The plaza currently features only a gas station, convenience store and bank, but at one point it was expected to feature a Rite Aid pharmacy and possibly a Fresh & Easy grocery store, a coffee shop and other stores. “It (the traffic study) says this project today doesn’t create any new impacts that aren’t already assumed to exist out there eventually,” said Oakley Principal Planner Ken Strelo. “So when we hear comments like it’s going to be a danger to the children, those are great comments and valid concerns in my opinion, but the traffic study hasn’t found any evidence that the McDonald’s and the Quick Quack would add any impacts or dangers that weren’t already assumed to exist with the commercial center next to Laurel Road next to a school.” Vice Mayor Randy Pope, however, noted that none of those traffic studies were included in the council’s packet of information prepared before the meeting.

He also was unsure whether those studies included analysis of the project’s possible pedestrian impacts. “We are not ready to hear this item,” he said. Interim Oakley City Manager Josh McMurray said city leaders have yet to decide the full scope of the study or when that study will take place. “Selecting a firm is the next task,” he said. “We should know more in the coming weeks.” Safety concerns aside, Strelo said it appears that the drive-thru would meet key requirements to be located in the area. The parcel’s 1.7-acre size and shape are adequate for the drive-thru and restaurant; the project proposes adding 71 parking spaces — much more than are required; Laurel Road and O’Hara Avenue can both accommodate the increased traffic; the proposed project meets design and California Environmental Quality Act guidelines; and any overflow traffic would be confined to the center, not spilling out into the street. If approved, it’s expected that the project would have driveways located on the right and left sides of the parcel that comes into Laurel Plaza, and the McDonald’s would feature a double drive-thru.

CAPITAL GAINS – PART II

Last week I wrote about how some of my clients are actually running into capital gains taxes on the sale of their residence because prices have appreciated so rapidly the last few years. I wanted to clear up two myths that I often run into. The first one is the idea that if you are over 55 years old you can roll your gains into another property to defer paying the capital gains tax. That is how it used to be a long time ago, but that was changed with the Taxpayer Relief Act of 1997. If the property was held for investment purposes, it’s still possible to do something called a 1031 exchange into another investment property and delay paying capital gains taxes. But for your principal residence, there is no “roll-over” rule anymore. You can sell a principal residence every two years and you don’t have to worry about keeping track of what you buy. You can even sell and choose to rent, if you wish. The other myth I come across is that

somehow we need to keep the sales price under a certain limit to avoid paying the capital gains taxes. This would just be wrong thinking from a calculator point of view. You will still NET more money, even if you cross over into owing capital gains taxes. You will owe taxes on the amount OVER the $250K (single filer) or $500K (joint filers) exclusions. It doesn’t go back to the first dollar of gain. So even if you are in the maximum combined State and Federal tax brackets of roughly 40%, you will still get to keep the extra 60%. On May 30 at about 4:30 p.m., Martinez detectives served a search warrant in the 1500 block of Pine St. in Martinez and took Shetterly into custody. Her bail was set at $250,000. Shetterly is a high school educator in the West Contra Costa County School District. District leadership was notified of her arrest. At this time, there is only one known victim in this ongoing investigation. Martinez police arrested a 40-yearold teacher May 30 on multiple felony counts of sexual misconduct with a minor. Jane Shatterly was booked into the Martinez Detention Facility after police served a search warrant at her residence, according to a Martinez police report. The report said on May 29, the Martinez Police Department was made aware of an ongoing sexual relationship between a teacher working in a private tutor capacity and her former teenage student. Martinez detectives investigated the allegations which resulted in the issuance of an arrest warrant.

Holy Rosary celebrates 65 years of Catholic education ANTIOCH Established in 1955 by the Dominican Sisters of San Rafael, Holy Rosary continues the traditions of providing a quality education rooted in the charisms of truth, study, community and service. The Class of 2021 has the distinguished honor of graduating Holy Rosary as faithfilled students, committed academic learners and active responsible citizens. Holy Rosary had the unique opportunity to reopen the campus for in-person learning for the 2020-2021 school year. With upgraded technology infrastructure, one-toone devices for every student, small class sizes and a commitment from the families, the faculty was able to sustain learning for all students on campus and at home. The Class of 2021 completed major capstone projects that included their Proteus Research Project, Science Fair Project, and Rite of Passage Experience Presentation. Student Rocco duPont said, “The biggest challenge I have had at HRS was my Proteus presentation from this year. It was the biggest research project I had ever done, and it required a lot of perseverance, dedication and hard work to complete.” Another student, Carlee Ramos said, “My biggest challenge at HRS was doing online school and having to learn self-discipline during that time. One of my biggest accomplishments was getting first place in the science fair.” The student leadership team maintained school spirit and led school-wide community service activities. students. They responded to the challenges they were given, conjured up resiliency, and made this year a success, knowing that it was their responsibility alone to make the best out of what life offered them dur-

The American Academy of Nutrition and Dietetics echoes the sentiments of the NHS, noting that eating better is an effective way to improve levels. The AAND also recommends additional strategies for people looking to foods to provide a boost. • Eat every three to four hours. The AAND notes that eating every three to four hours helps to fuel a healthy metabolism. This approach also can prevent the between-meal hunger pangs that compel many people to reach for whatever food is readily available, even if it’s unhealthy. When eating every three to four hours, remember to prepare smaller portions than you would if you were eating three meals per day. The AAND points out that feeling comfortably full but not stuffed is a good indicator that you’ve eaten enough. • Aim for balance. A balanced plate should include foods from multiple food groups. The AAND notes that even a small amount of fat can find its way onto your plate, which should include a combination of whole grains, lean protein, fiber-rich fruits and vegetables, and fat-

free or low-fat dairy. If that’s too much for a single sitting, ensure these food groups are represented on your plate at some point during the day. • Avoid added sugars. Added sugars can adversely affect energy levels. In addition, the Centers for Disease Control and Prevention notes that consuming too many added sugars, which are found in sugar-sweetened beverages like soda and iced tea and sweet snacks like candy, increases a person’s risk for obesity, type 2 diabetes and heart disease. The AAND notes that the energy provided by foods with added sugars is typically misleading, as it wears off quickly and ultimately leads to an energy crash. If you’re looking to eat and drink for energy, then choose water or low-fat milk instead of coffee and soda and replace sweet snacks with fruit. • Choose the right snacks. The AAND recommends snacks have lean protein and fiber-rich carbohydrates. Low-fat Greek yogurt, apples, a handful of unsalted nuts, and carrots are some examples of healthy snacks that will provide an energy boost between meals. rier, but noted that DWR has been down this path before. “It’s really not an emergency in the sense that nobody’s surprised that there’s another dry year, and that this has to be done,” Brodsky said. “They should really have a long-term plan and do an environmental impact report and look at some alternatives so it’s a fully informed decision. Why is this coming as a surprise? Why can’t (DWR) plan this as a long-term project?” Construction of the barrier is expected to be complete by the end of the month. When it’s done, the barrier will be located approximately 0.4 mile east of the confluence of the San Joaquin and West False

rivers between Jersey and Bradford islands. The barrier will be about 800-feet long with a 200-foot-wide base. It’s top will be 12-feet wide. Boat navigation on the False River will be completely blocked by the barrier. With the start of the rainy season expected in the fall, the barrier will be removed by DWR no later than Nov. 30. DWR expects the construction project to cost $10 million, said Jacob McQuirk, principal engineer with DWR’s Division of Operations and Maintenance. DWR built a barrier in the same location most recently in 2015 in response to the 2012 - 2016 drought. The presence of the barrier in 2015 created problems for residents of the islands in the South Delta including

Bethel and Bradford islands. Bradford Island – located about five miles north of the city of Oakley and only accessible by ferry from Jersey Island – is bordered on its eastern side by Fishermans Cut. One Bradford Island resident and rancher, who requested that her name not be used, reported significantly increased currents through Fishermans Cut while the barrier was in place. “We lost just about complete use of our property,” she said. “We couldn’t swim for the two months that the barrier was in. We couldn’t fish, no water skiing. We could barely get into our dock. (We) bashed up the front of our boat trying to get into the dock and tore off pieces of the rubber guards that surround the boat slip. The water rushed down Fishermans Cut so fast that nothing was safe” Issues didn’t stop with the removal of the barrier in 2015. Jamie Bolt, harbormaster at Bethel Harbor located on the north shore of Bethel Island, reported that increased tidal flooding made it difficult for boaters to maneuver in and out of their berths even after the barrier was dismantled. Sediment also built up in the berths and created sandbars in Taylor and Piper sloughs, she added. “We are extremely concerned about the installation of another emergency drought barrier in False River,” Bolt said. Coincident with DWR’s request for the salinity barrier, they also filed a Temporary Urgency Change Petition (TUCP) with the SWRCB, who approved the request Tuesday, June 1. Motivated by the same conditions that created the need for the salinity barrier, the TUCP relaxes water quality standards

with regard to salinity levels in the Delta. Without enough water coming down from the reservoirs in the north, salinity levels will begin to exceed established standards. To reduce the salinity levels the state would have to release more water. Due to the drought, there isn’t enough water in the reservoirs to take that action without potentially draining them dry. Instead, the TUCP allows salinity levels to temporarily exceed those established standards. “(The TUCP) acknowledges that saltwater is going to intrude into the Delta from the bay,” Brodsky said. “Since DWR is not releasing enough water from the dams, they have to do something else to keep the saltwater from reaching the export pumps in Tracy. That’s why DWR is proposing the rock barrier at False River. That’s how they’re related.” SWRCB approved modified salinity standards for the Delta during the months of June and July. “We just didn’t get the precipitation we needed,” McQuirk said. “The project along with the Temporary Urgency Change Petition will allow DWR and (the U.S Bureau of) Reclamation to maintain control of Delta salinity with the release of fresh water from upstream reservoirs, including Oroville and Shasta. By preserving the hydraulic salinity barrier, the Central Valley Project and State Water Project export facilities will remain operational. The barrier will also allow in-Delta water uses including municipal and agricultural supplies to continue as well as preserve storage for uses including fish and wildlife later in the year.”

Astronomical rarity seen in the Super Flower Blood Moon While a full eclipse was most easily seen in northern parts of the eastern hemisphere (such as in Taiwan, South Korea, Japan, Russia and other surrounding nations), the Super Flower Blood Moon was still mostly perceivable and bright for North America in the early hours of May 26. For anyone who is disappointed that they missed such a sight, they need not worry, as there is another astronomical event that will soon take place. According to “Skywatching Highlights” from NASA, on June 20 the summer solstice will occur. During this time, the planet Mercury will begin appearing on the horizon about 30 minutes before the sunrise. Early risers can look forward to Mercury’s appearance until the beginning of July.

Multitudes of people across the globe were astonished at the magnificent site of a rare Super Flower Blood Moon on May 26. The rarity of this event was characterized by not only the presence of a “super moon” in which the moon appeared relatively closer to the Earth than usual, but also because of the lunar eclipse on a full moon. The blood moon came to happen when — through a total lunar eclipse — the Earth sat directly between the moon and the sun. Due to the nature of the Earth’s atmosphere, blue-light from the sun was minimally visible, as it was scattered in the upper atmospheric layers. However, red-light was still easily perceived, which caused a red hue to appear on the lunar surface.

The plan’s funding is derived from at least seven sources, including $75 million in federal, state or outside agency funding; $37 million in enterprise funds (derived from solid waste, water and wastewater services); $28 million in developer-paid impact fees; and $23 million from an array of other sources, including bond proceeds, voter-approved transportation sales taxes and state loans. “The city’s capital improvement program plans and provides for amenities and infrastructure that are core to this quality of life,” said Brentwood City Manager Tim Ogden.

Earmarked in the spending are several city-council-driven priority projects, including establishing downtown and Brentwood Boulevard development strategies; construction of an outdoor amphitheater and event center west of State Route 4, north of Marsh Creek Road and south of Fairview Avenue; expansion of the city’s wastewater treatment plant; and an update to the city’s General Plan Housing Element, a plan to meet the existing and projected housing needs of all economic segments of the community “In Brentwood, land use is the biggest issue for residents,” said Brentwood City Councilmember Jovita Mendoza, alluding to the housing element update. “If

we get something right, this has to be it.” A handful of other projects scheduled for completion outside of priority category include infrastructure improvements for the more than 430-acre area — surrounded by Lone Tree Way to the north, Heidorn Ranch Road to the west, Sand Creek Road to the south and Shady Willow Lane to the east — considered Brentwood’s future job-generating hub; installation of a citywide non-potable water distribution system; and replacement of Sunset Park’s playground equipment. Of the priority projects planned for completion in the next few years, the wastewater treatment plant expansion project will increase the facility’s capacity from 5

million gallons a day to 6.4 million gallons a day, an amount expected to accommodate the city’s buildout population of 92,336. The Brentwood Boulevard and downtown-specific plan updates are expected to establish economic development-driven development strategies. Crews are also expected to begin construction on the amphitheater portion of the event center and amphitheater project, west of State Route 4, north of Marsh Creek Road and south of Fairview Avenue, in the 2021-2022 fiscal year. Following Clement’s speech, Boy Scout Troop 2020 of Brentwood stepped forward to “post the colors,” meaning raise the American flag. Scout Colby McCarter played the traditional “To the Color” on his bugle as his troop saluted the flag they had unfurled, which was raised to half-mast in remembrance of the fallen. The displays of patriotism continued with the Pledge of Allegiance and a performance of the National Anthem before Clement introduced Wayne Griggs, who will take over as post commander of the Brentwood Veterans Memorial Building starting in July. Griggs is an Air Force veteran with a long family history of involvement with the American Legion and supporting veterans. Brentwood Mayor Joel Bryant was the guest of honor, delivering a speech that stressed the importance of “paying back on a daily basis the investment our heroes have given to us” by pledging to do anything in his power to make Brentwood the kind of place worthy of such sacrifice. “[The public officials] work for you,” he reminded the crowd before being presented with a Post 202 T-shirt by Griggs and Clement to signify the partnership between the city and its veterans center. A benediction was offered as the traditional wreath was displayed to honor those who gave the last full measure before the event was closed out with a rifle salute as Colby McCarter fittingly played “Taps.” All in

stating a parade in downtown Brentwood would break no state guidelines, since restrictions on all but mega events should be lifted on June 15. Mega events are defined as 10,000 or more people outside, and 5,000 or more people inside. The parade is not expected to draw enough spectators to be considered an outdoor, mega event. After asking questions about the proposed parade – and chiding city staff for not bringing the idea to the Parks and Recreation Committee before announcing it to the community – the council virtually opened the floor for public comment. Sip n’ Scoop owner Vicky Little was the first to speak. She stated she had been cautious over the past 15 months, staying within the guidelines since shelter-in-place orders were first issued, but was ready to continue to follow guidelines as they allowed for more freedom. “Why must we decide this time that we will not be following the CDC, the local, state and federal leadership?” she asked the council. “Why are we not making decisions based on the local level, or why must we now be making decisions on a local level that don’t align with our state,

sannah Meyer made a motion to have staff bring more information to a future meeting, with a vote to follow, but Recreation Supervisor Kris Farro interjected to explain time frames would significantly limit

what staff would be able to plan if the decision was put off, even to the next regular meeting on June 8. The motion was withdrawn, and discussion continued. The idea of a reverse parade, like the Hometown Halloween event, was floated, but staff informed the council it had been difficult to get businesses to participate. Council then went on to discuss ways the parade route could be extended, crowd control could be maintained, and safety guidelines could be implemented to prevent attendees from mingling. In the end, Mayor Joel Bryant’s statement on the importance of the Fourth of July holiday spurred a unanimously approved motion that the city’s Parks and Recreation Department would work with the Downtown Business Coalition to create a safe, controllable event and bring it back to the council meeting on June 8. “This is the celebration of our freedom from tyranny,” Bryant said, adding Memorial Day’s ceremonies had been affected by current restrictions. “I think this has a significance other parades may not have in that we do this to honor those that have brought these liberties to us. I think that we can find a way to do it safely.”

Deer Valley tennis teams flourish on court by Michael Dixon Correspondent

When the Bay Valley Athletic League girls tennis tournament was held, the Deer Valley duo of Kayla Autajay and Lauren Sirmons claimed first place in the doubles tournament. It was a feeling that the Wolverines would get quite used to in the spring. When the boys tournament was held later, a Deer Valley pair again finished first in the doubles tournament. This time it was Carlo Buenconsejo and Jacob Ea. Heading into their respective tournaments, both teams felt good about the victories. “My partner and I felt very confident about our ability to work together as a double pair, and we expected to go far. But winning was just the icing on the cake,” Sirmons said. “It felt liberating being able to show the rest of the high schools that they shouldn’t underestimate DV. We played our hardest, our best, and we persevered throughout the game.” “I was pretty much expecting it because there’s not a lot of great doubles players in our high school league. Carlo and I had been playing doubles together since the summer of 2019,” Ea said. “And we played because we wanted to play doubles at BVALs for the upcoming season but our season was cut short due to COVID.” In both cases, the doubles teams comprised singles players who paired up a week before the BVAL tournament. As Ea said, the boys team did have experience with each other. Autajay noted, however, that she and Sirmons began practicing together just a week before the tournament. So, while Autajay and Sirmons felt good about how they were playing, winning wasn’t necessarily the expectation. That made the victory feel all the more surprising. “It didn’t feel real at first,” Autajay said. “I was quite comfortable to be in any place. This win was one to never forget.”

Buenconsejo added that the extra attention paid to his and Ea’s championship match added to the thrill of victory. “It felt so great to win, especially when everyone was watching,” he said. “It was such a fun way to end the season with a very talented partner.” One of the challenges in this particular season was the long layoff. The most recent girls high school season occurred in the fall of 2019. For the boys, not counting the brief season in 2020 before the COVID-19 pandemic shut things down, it was the first high school season since the spring of 2019. Tennis is generally built well for social distancing. So although there were some differences, like wearing masks when not playing and everyone supplying their own tennis balls, gameplay itself was not as different as what other sports might have encountered.

Still, Sirmons noted that the return to competition included some complications. “The first match we played was a real eye-opener to me,” she said. “I knew not playing due to COVID would have some effect on me, but it really messed me up. It was as if my tennis IQ went out the window. However, as the season went on, I worked with my team and by myself to get my tennis game back. All the hard work I put into this sport really showed during the BVAL tournament.” Wolverines coach Conan Moats added that the wins were big not only for the four players but also for the overall program, as it showed the growth that’s occurred. Even better is that there’s potentially more growth to come. Beyond representing Deer Valley, the two championship doubles teams have

something else in common. Both include one senior and one player who will be back next year. Sirmons and Ea will both graduate, while junior Autajay has one year left and sophomore Buenconsejo has two. In both cases, the graduating teammate gave a special mention to their younger partner, noting how much playing with them added to their final experiences in high school tennis. “I couldn’t have wished for a better partner, and I wouldn’t have made it as far as I did without Kayla Autajay,” Sirmons said. “I wish her all the best and a big win for her senior year.” “Shout out to my doubles partner, Carlo. It was fun to play my last BVALs with you, bro,” Ea added. “I hope you have fun playing tennis the next couple years at Deer Valley.”

Sims introduced as Freedom head coach by Jesus Cano Correspondent

Growing up in Benicia, Zach Sims had plenty of battles against East County football teams. He admits there were more losses than wins, but he always respected the talent that came out of the area. Now the 31-year-old finds himself back in East County. This time, he’s walking around the campus of Freedom High School, learning about the structure of the school and checking out the football team’s facilities. Sims will be the fourth head varsity football coach for Freedom since the

school opened in 1996. He will also serve as a biology and health teacher at the Oakley campus. “It’s ironic, after all those youth battles, to be coaching in East County, but it’s really exciting,” Sims said. “I could tell just from my interview, this is a first-class district.” He takes over for Andrew Cotter, who stepped down after three seasons with Freedom. The Falcons made their second straight appearance in the North Coast Section (NCS) Division I championship game in Cotter’s first season. However, Freedom went 4-12 the next two years. Before his arrival at Freedom, Sims served as the offensive coordinator at Col-

lege Park High School in Pleasant Hill for two years, where the program went 8-8 during his tenure. Sims was also on staff at St. Patrick-St. Vincent High School in Vallejo when the team won two consecutive NCS titles, with the addition of one Northern California title and a California State Championship. When Sims coached at College Park, he did so without any skills coaches. Sims handled everything offense, and head coach Mark Spinelli took care of most of the defense. According to Spinelli, he and Sims were often the last people at St. Pat’s to leave the facility. Sims’ dedication to the

game made him stand out, and it was the reason Spinelli eventually decided to bring Sims to College Park. “His work ethic is fantastic. When he decides to do something, he’s going to do it,” Spinelli said. “He’s not gonna let stuff get in his way. He’s not going to make excuses.” “Coaching football is more than x’s and o’s,” Sims said. “The teamwork, the camaraderie of the brotherhood and all the off the field things, make the football program work.” Sims said that even during his days as see Sims page 3B

Bay Valley Athletic League competition wraps up A flurry of Bay Valley Athletic League championships were determined last week. Softball The Heritage softball team held off a determined Freedom squad 4-3 to win the Bay Valley Athletic League Tournament title and finish the season with a perfect 22-0 record. Sophomore Alexandra Cutonilli put the Patriots on top with a two-run single in the third inning, but Freedom picked up four consecutive hits in the sixth inning to go up 3-2 on Kaylynn Gray’s single. One half inning later, however, Mikayla Garrison’s single drove in Cutonilli and Essence Hernandez, putting Heritage up 4-3. Two Freedom runners reached base in the top of the seventh, but a double play ended the game, sending a host of Patriots into a frenzied celebration. “We fought hard,” said Heritage head coach Ron Rivers. “Give credit to Freedom, they fought hard today….we caught a couple of breaks, the ball hit the pitcher’s foot a few times, but I just really liked how the girls didn’t give up.” When asked about her sixth-inning at-bat that drove in the winning runs, Garrison said she was just trying to execute at the plate. “We have been working so hard all year. It just kind of led up to that moment,” she said. Freedom head coach Ken Sposito said that despite the loss, he was proud of his squad. The team finished 17-4 this season

after struggling the two previous years. “We are just getting started,” he said. “I am super-proud of this team. All they need is to get a little bit of confidence.” Baseball The Pittsburg baseball team defeated Freedom 9-2 in the tournament championship. Jaiden Louangrath had two RBI and George Thompson, Trevor Munson, Matthew Quesada, Gio Fuentes, James Murray and Angelo Luna each had one RBI, propelling the Pirates to victory. Pittsburg’s Murray pitched six innings, surrendering only two runs on three hits and striking out four. The Pirates finish the season 18-4 and 12-3 against league opponents. Freedom’s Michon Cole went 1-for-3 with an RBI in the loss for Freedom. The Falcons end the season 9-12 and 7-9 in league play. Girls basketball The Heritage girls basketball team wrapped up its sixth consecutive league title with a pair of victories over crosstown rival Liberty last week. The Patriots (10-2 and 10-0 in the Bay Valley Athletic League this season) knocked off Liberty 61-29 and 56-24 to close out the season. In the season finale, Heritage’s Amanda Muse finished with 16 points and 14 rebounds, while Julie Ramirez poured in 15 points and seven rebounds. Heritage’s lone blemishes on an oth-

erwise perfect season were a 66-64 loss to Miramonte and a 76-62 loss to Richmond’s Salesian College Preparatory. Boys basketball The Heritage boys basketball team split two games with Liberty last week, prevailing 47-27 in the second game to secure the Bay Valley Athletic League title. Isaiah Hinds (14 points), Christian Wise (eight points) and Lamar Murphy (seven points) led the Patriots in the season finale. Heritage ends its season 9-1. The Lions finish their season 11-3 and 8-2 in league play. Girls soccer The Liberty girls soccer team finished its season with a perfect 10-0 record to wrap up an eighth-straight Bay Valley Athletic League title. The Lions surrendered only three goals all season. Boys soccer The Freedom boys soccer team (5-2-2 overall) captured the league title this season. The Falcons wrapped up the year with a 3-1 win over Heritage. Justin Villegas (seven goals) was a team leader this season. Alberto Padilla finished with six goals on the season. Villegas led the squad with four assists and 18 points this year. Davian Valencia led the team with 18 steals. Boys volleyball The Deer Valley boys volleyball team finished its season 5-0. Among the team leaders were Mason Semm (57 kills, 19 serving aces, 14 total blocks), Henry Nguyen (25 digs) and Den-

nis Gavrilenko (121 assists). Girls volleyball The Heritage girls volleyball team finished its season as league champs, with a 10-1 overall record and a 10-0 mark in league play. The dominant Patriots dropped only two sets all season, according to the school. Team leaders included Sydney Williams (54 kills), Rochelle Mosley (36 aces, 24 digs, 33 assists) and Cammie Johns (seven blocks). Girls Water Polo The Liberty girls water polo team captured the league tournament title in an 11-9 win over Heritage. Senior Olivia Doria poured in four goals; Joslyn Dmitri struck for three; Genevieve Almgren two and Athena Ayers one. Avery Johnston finished with 13 saves. The Lions finish the season 10-4 and 4-1 in league play. Heritage finishes 7-4 and 5-0 in regular-season league play. Boys water polo The Liberty boys water polo team ousted crosstown rival Heritage 15-5 in the league tournament final. Kyle Young registered seven goals; Zachary Ulrich added four; Cade Venables two; and one each from Jack Doria and Ryan Lichlyter. Quentin Perry had eight saves. a youth player in Benicia, he always felt like he played a coaching role in some capacity. He’s always had a knack for teaching. After all, it’s in his blood: his mother is a longtime educator. “I was like a player coach growing up,” Sims said. “I love teaching and I like the game, so what better way to teach than through football to younger people? And I just went from there, just took my love of football and grew it, and that’s what made me really want to coach.” Sims is just 31, making him the youngest head football coach in the Bay Valley Athletic League. When applying for jobs, Sims said he was a little intimi-

dated by being such a young head coach candidate. There were even times when he felt discouraged. During the application process for another head coaching position, Sims asked an administrator what they wanted in a head coach. The administrator’s answer? According to Sims, the school wanted an adult leading the program. He never heard back from them again. Sims admits that experiences like that made him feel discouraged, but he always remembered what his dad told him. “Someday, someone is going to look at that as an asset.” Eventually, Sims’ father was proved

right. Freedom decided to take a chance on him. “Coach Sims was a standout candidate because his passion for football was evident in his interview, as well as his depth of knowledge of the game,” said Freedom Athletic Director Sandra Torres. “Ultimately it was his organization, program-wide vision, love of sport, and depth of knowledge.” With the season just three months away, Sims has already decided one of his top priorities will be to create a strong core of young players, while also incorporating a top-notch strength and conditioning program. “Just get the kids used to develop-

ing themselves as athletes, and then from there you take that and establish the system,” Sims said. “With the strength conditioning and with the fundamentals that we’re going to stress, you know you’ll get your system implemented, and hopefully they see some success on the field as well.” Spinelli predicts that Sims will have a lot of success at Freedom, but only if everyone plays their part. “His success at Freedom is going to be based on the players’ ability to be coachable,” Spinelli said. “The parents staying out of it and letting him coach, and the administration supporting him in those things. If that happens, Freedom is going to be good.”

BRENTWOOD May 8, 1:40 a.m. A female subject reportedly trespassed in the soda aisle of a business on Lone Tree Way. The reporting person said the subject had also trespassed the week before, but the trespassing subject’s name was unknown. May 8, 3:02 a.m. A suspicious vehicle was reported on Walnut Boulevard and Orchard Drive. The suspicious vehicle was described as a black SUV with its lights on, stopped in the middle of the road. May 8, 3:47 a.m. A subject riding a moped reportedly took mail from a mailbox on Medallion Drive and Lone Tree Way. May 8, 8:13 a.m. A commercial burglary was reported on Lone Tree Way. The reporting person said a safe was taken and a shred bin was unlocked. The business reported that it had changed its locks the day before. May 8, 8:20 a.m. A suspicious person was reported on Lone Tree Way. A familiar subject was reportedly believed to begin stealing items. The circumstance is a chronic issue. May 8, 10:38 a.m. A restraining order/ court order violation was reported on Cesa Avenue. The subject showed up with two bags of belongings and broke something in the driveway before he started cussing and yelling at the reporting party. The subject left, moving toward an area school. He was reportedly wearing a blue shirt and blue checkered shorts. May 8, 3:30 p.m. A suspicious person was reported on Lone Tree Way. Multiple subjects were reportedly inside a store and then at least one of the subjects walked out of the store. One subject was still in the store at the time the incident was reported. The caller reported that a community mailbox was broken into the night before. Mail was taken. May 8, 6:27 p.m. An embezzlement case was reported on Oak Street. Two skimming devices were found in two ATMs. May 8, 7:55 p.m. A noninjury hit-and-run was reported on Queen Palm Lane. The reporting person was advised by a neighbor that the reporting person’s vehicle was hit. The responsible party reportedly left. May 8, 8:22 p.m. A physical fight was reported on Riviera Court. The fight occurred during a family dispute. May 8, 9:56 p.m. A vehicle burglary was reported on Anastasia Drive. A vehicle was reportedly rifled through and sunglasses stolen.

A Discovery Bay home was damaged by fire on June 1, according to an East Contra Costa Fire Protection District incident report. Fire crews were dispatched to the home, on the 4800 block of South Point, in the afternoon of June 1. Arriving officials witnessed smoke emanating from the home’s roof. The fire was contained to the attic, with water damage throughout the residence. The damage estimate was believed to be around $425,000. The Red Cross was called to assist the residents after county officials red tagged the home. No injuries were reported. The cause of the fire remains under investigation.

Con Fire arrests one in apartment fire ANTIOCH The Contra Costa County Fire Protection District (Con Fire) announced its fire investigators made an arrest in relation to a fireworks caused fire behind apartments in the 1700 block of Hargrove Street in Antioch that destroyed eight units and displaced 40 residents. James Sossaman, 44, an Antioch resident, was arrested for unlawfully causing a fire to inhabited structures and for being a felon in possession of a firearm. He was transported by Antioch Police to Martinez Detention Facility for booking. Con Fire responded to multiple reports of a vegetation fire behind apartments in the 1700 block of Hargrove in Antioch, May 31, just after 5:30 p.m. While responding, Engine 81 reported a large column of black smoke from a half mile away. Upon arrival, the grass fire had already extended from the grass into a twostory apartment complex and a secondalarm response was ordered. An aggressive fire attack followed in an attempt to slow the spread of fire. Through witness interviews and surveillance videos, investigators located the person responsible for the grass fire and determined it was caused by Sossaman throwing an M-100 pyrotechnic device into the field behind the apartment complex. Through the investigation, Sossaman was also found to be on felony probation. During a search of his apartment, a loaded firearm was located along with several other illegal fireworks. Weather conditions at the time -- temperatures in the upper 90s with wind gusts between 15-20 miles per hour – quickly fed the fire into the neighboring apartments. Crews, including East Contra Costa Fire’s Battalion 5, were able to stop grassfire spread across the gully and protect the apartments on the west side of the incident. Additional companies worked to extinguish the structure fires and search 10 separate apartments that were either on fire or in immediate danger of catching fire.

SOSSAMAN Strong winds blew the fire across a breezeway to adjoining apartments. A coordinated fire attack resulted in the fire being extinguished at approximately 6:26 p.m. Crews were on scene for approximately three hours to overhaul and salvage as much as possible. The fire displaced 40 residents and the American Red Cross assisted with housing for those displaced. No firefighters were injured. Two civilians were transported to the hospital for smoke inhalation. Con Fire’s Fire Investigation Unit urges residents to help them fight the crime of arson across the county by calling the arson tip line at 1-866-50-ARSON. They caution residents not to hesitate on information that seems too little or unimportant to matter, adding some of the most valuable tips come from residents who were not aware what they saw was very important to the investigation of an incident. At 1-866-50-ARSON, residents can leave a recorded message about fire-related criminal activity in English or Spanish. Tips can be anonymous, but all tips are treated confidentially. Fire investigators sometimes need additional information, so inclusion of name and phone number is encouraged.

America’s goose that lays the golden eggs America’s research and development institutions have long been the envy of our competitors, flourishing at the top of global rankings. But our state-of-the-art innovation capabilities — responsible uest for bringing comment COVID-19 vaccines and countless other breakthroughs to market — haven’t flourished here by happenstance. They have been nurtured over decades of smart policies, and those policies are now at risk. Current misguided efforts are unwittingly pushing the very ecosystem that lays our golden eggs of innovation toward the brink of downfall. For the better part of the 20th century, patents on American research breakthroughs from publicly funded research at universities and research institutes belonged to the government — and mostly languished on agency shelves. By 1980, the federal government held nearly 30,000 patents, but less than 5 % had been

licensed for commercialization. That all changed when Congress passed the Bayh-Dole Act. The 1980 law provided clear intellectual property rights, encouraging the inventing institutions to license their taxpayer-funded inventions to private companies. Those companies could then translate them into viable technologies, medicines and products. Bayh-Dole transformed America’s innovation system. Between 1997 and 2017, the law has sparked over 13,000 startups, supported more than 5.9 million jobs and added over $1.7 trillion to U.S. gross domestic product from inventions at the nation’s universities. Federally funded basic research now contributes to nearly one-third of U.S. patents, providing the seeds for private companies’ applied research and venture investment. Since Bayh-Dole’s enactment, over 200 drugs and vaccines have been developed and approved. strides in research and development and innovation indicators. The country has surpassed America in advanced manufacturing, with the stated goal to dominate global sourcing. Additionally, domestic activists have been calling for the government to use BayhDole’s “march-in” provision to seize control over intellectual property rights from companies that commercialize university inventions — and impose price controls. The activists would have the government revoke patent license rights whenever they believe an end product is too expensive. Bayh-Dole’s authors made clear: March-in rights are not to be used for government price controls. March-in rights are a backstop to ensure that private sector licensees put technologies to work benefiting society. Bayh-Dole applies to all technology sectors; hence the activists’ proposal would bring government intellectual property and price intervention threats to every market sector. This would create a chilling effect on future U.S. public-private partnerships and would prove counterproductive to

Broadway is reopening

Editor: A big question many people have been asking lately is; when will things open back up and go back to normal?

The answer will always be questionable until the day the virus is over, but as time progresses, governors are becoming more lenient with what can be reopened. Now, the arts can be a different story. While places like the movies can be opened and socially distanced with a mask, putting together a Broadway musical may be a tougher deal. Broadway shows can usually take up to 10 to 12 hours a day to reherse for typically around a month or two. To estimate, it takes around 800 people to work on a Broadway show. Some people say it’s doable, that the arts should be reopened just as everything else is, but it seems too high risk. The amount of time and people put into these productions are just too big, and it would be wrong to open back up while people are still dying. It seems unethical to do so, but many still disagree. Some people think that with the mandates still up, there will be less of a risk, which may be true, but it’s still too early on to tell. Although, with these concerns, New York has decided to open up Broadway this summer, but shows won’t be happening until Sept. 14, due to rehearsals and new safety protocols. With vaccinations out, and allowing more time to pass before opening up, it’s definitely a lot safer now than before. We won’t know the outcome until it happens, but hopefully everyone ends up happy with the results. Leah Thomas Oakley
