Deputies cleared in 2018 death

OAKLEY The Contra Costa County District Attorney’s Office released the results of its investigation into the 2018 in-custody death of Michael Hernandez, then a 34-year-old resident of Oakley. The investigation concluded that there was insufficient evidence to support a criminal prosecution of Contra Costa County Sheriff’s Office Deputy Erik Vawter and Deputy Brian McDevitt. No charges will be filed against any officer involved in the incident that took place in the early-morning hours of Oct. 30. According to a social media post from the sheriff’s office, deputies from Delta Station responded to a report of a female screaming for help on the 3500 block of Wells Road in unincorporated Oakley shortly before 3:30 a.m. The DA’s report stated that Hernandez ran out of his residence naked and carrying his 3-month-old daughter. see Deputies page 18

Health officials implement measure to contain recent surge in COVID-19 cases REGIONAL It was a little more than six weeks ago when the pandemic-related restrictions spelled out in California’s Blueprint for a Safer Economy were lifted, and residents looked forward to the promise of a return to some semblance of normalcy. But surging COVID-19 infection rates driven by the Delta variant have dashed those hopes at least for the time being. Health officials are now scrambling to implement new guidelines intended to reverse the trend of rising case numbers – particularly among the unvaccinated population –
that started earlier this summer. “This moment, and most importantly the associated illness, suffering and death, could have been avoided with higher vaccination coverage in this country,” said Dr. Rochelle Walensky, director of the Centers for Disease Control and Prevention during a press briefing Tuesday during which new mask guidance was issued. The CDC’s latest guidelines urges everyone regardless of vaccination status to use a mask while indoors in public places in areas that are experiencing substantial or high disease transmission rates. Counties with 50 or more reported new COVID-19 cases over a seven-day period are classified
as having either a substantial or high transmission rate. Every Bay Area county currently exceeds that threshold. The CDC went on to advise that all school students, teachers and staff members use masks as in-person classes return this fall. This guideline also applies regardless of vaccination status. In response to the CDC’s recommendation, the California Department of Public Health (CDPH) announced Wednesday that it was aligning its mask guidance with the CDC. “The Delta variant has caused a sharp increase in hospitalizations and case rates across the state,” said Dr. Tomás J. Aragón, CDPH
director and state public health officer. “We are recommending masking in indoor public places to slow the spread while we continue efforts to get more Californians vaccinated.” The Delta variant is one of four variants of concern as identified by the CDC. While this variant is not believed to be more deadly or cause more serious illness than the original SARS-CoV-2 virus – the virus that causes COVID-19 – it is significantly more transmissible. “In a completely unmitigated environment – where no one is vaccinated or wearing masks – it’s estimated that the av-

Fire agency annexation moves closer to reality REGIONAL The Contra Costa County Board of Supervisors this week, acting as the Contra Costa County Fire Protection District Board of Directors, received an overview of the recently-completed Fire District Annexation Feasibility Study from consultant AP Triton. The presentation culminated similar presentations to the East Contra Costa Fire Protection District (ECCFPD) and Rodeo-Hercules Fire Protection District (RHFPD) governing boards earlier this month. Each fire district board now has the responsibility to consider the findings and recommendations and make their individual determinations for the correct courses of action for the communities their organization serves. Fire chiefs from the three cooperating fire agencies entered into the study in order to assess the financial and operational viability of annexations that might lead to more efficient, effective, and better-integrated fire and emergency services across the communities of Contra Costa County currently served by each district. “This is an exciting day for ECCFPD and the residents of East Contra Costa County, said Supervisor Diane Burgis. Our actions today, and the decision by the ECCFPD governing board to continue to work with Con Fire is a long-awaited opportunity to form a regional sustainable solution to providing the level of fire service that our commu-

State to require proof of COVID vaccination by Tim Epperson Staff Writer
California will require all state government workers and health care workers to show proof of vaccination for the COVID-19 virus, or agree to be tested weekly for COVID-19, if they have not been vaccinated. Governor Gavin Newsom announced this rule Monday at a press conference in Sacramento. The rule will take effect next month, according to state officials. There are at least 238,000 state employees. The vaccination rate in California stands at 62% of Californians who are fully vaccinated. The delta variant makes up 80% of infections in
California and hospitalizations are rising. Some counties are once again mandating the wearing of masks indoors. All counties in the Bay Area, including Contra Costa County are encouraging individuals to wear masks indoors. On Tuesday, the Centers for Disease Control and Prevention was expected to backpedal on current mask mandates and suggest that people wear masks indoors, whether they’re vaccinated or not. The new guidance comes after several cities and counties across the country have decided to recommend wearing masks indoors. The move comes as more people, mainly the unvaccinated, are diagnosed with the delta variant strain of COVID-19.

Delta Harvest Run seeks runners, volunteers BRENTWOOD Runners and volunteers are needed to participate in the ninth annual Delta Harvest Run (DHR) Sept. 12. All of the net proceeds go to the Delta Realtors Community Service Foundation (DRCSF). The DRCSF is a nonprofit organization run by local real estate agents and affiliates. Since its establishment in 2005, the DRCSF has offered scholarships to graduating high school seniors at each of the high schools from Pittsburg to Discovery Bay. It is estimated that the foundation has awarded over $100,000 in high school scholarships since its inception. In addition to scholarships, the foundation regularly donates money to local food banks, community chests, homeless shelters, an elderly Make a Wish Foundation and other charitable organizations in East Contra Costa County. The Delta Harvest Run offers a half marathon, 10K, 5k and a 1-mile family fun run. The DHR begins and ends at the beautiful City Park in downtown Brentwood, at the corner of Oak and 2nd streets. The flat route meanders through the tree-lined city streets and on the peaceful and scenic Marsh Creek Trail.
The run is facilitated by a professional race and timing company. All participants will receive a finisher’s medal, a custom performance shirt, a swag bag and snacks at the finish line. New this year, the runners will receive a token for a free beer, glass of champagne, ice cream or coffee. The DHR will also award age-group medals, as well as overall male and female trophies. The half marathon begins at 7:30 a.m. with a pre-race warm up led by a professional instructor prior to race time. The awards ceremony will take place at City Park immediately following the race. The shift towards work-from-home has had MAJOR impacts on how we live and on the economy. This is changing where people eat lunch (at home vs. at a downtown café), what they wear (sweats instead of Brooks Brothers), and I could give many more examples. But one of the biggest impacts is that some workers now no longer need to live within reasonable commute distance to work. This has led to a massive exodus from major cities across the United States as some people are fleeing urban centers to go to more rural settings, even several states away. Most workers prefer this situation and want it to continue. A recent survey found that only 2% of workers would PREFER to go back to work and 11% don’t care. But what about the employers? Some of them are finding that workers are more productive and even putting in MORE hours than before. The employers are often saving money on rent, utilities, insurance and all the other expenses that come with providing workspace. I know of one Silicon Valley company that used to provide a quality

A public option will destroy private insurance Several congressional Democrats just announced plans to draft a bill that would create a public health insurance option. That’s bad news, given that a public option could destroy the private insurance market -- and deprive the majority of Americans of the employeruest sponsored comment coverage they like. According to polling data, two-thirds of Americans with employer-sponsored coverage are satisfied with their current plan. Public option proponents don’t want to upset the more than 180 million people with employer-sponsored coverage. So they frame their offering as another choice. Those who like their workplace plans can hold onto them. Those who don’t, or don’t have access to insurance coverage through work, can seek out the public option through the Affordable Care Act’s exchanges. The public plan is also intended to check private insurers’ premiums. A government-run plan would have two advantages over private plans. First, a public option could offload its administrative costs onto federal taxpayers. Private insurers don’t have that luxury. So the public option would have a structural cost advantage. Second, it could dictate what it would pay healthcare providers. Most champions of a public option envision that it would pay rates similar to Medicare’s. Those rates are low. The American Hospital Association says that hospitals receive just 87 cents from Medicare for every dollar in cost they incur caring for its beneficiaries. In 2019, those underpayments amounted to nearly $76 billion. Private insurers can’t name their price. Private plans pay hospitals nearly two and
a half times what Medicare does for the same service. Because of its artificially low cost structure, the public option could permanently underprice private insurers. Private insurers would eventually leave the market. By 2033, according to one study, there’d be no private plans available on the exchanges in 14 states. Instead of enhancing competition in the individual insurance market, the public option would destroy it. A cheap public plan would also prompt some employers to drop the plans they sponsor for their employees. Doing so could save them money. An analysis of one public option plan introduced in the House in 2019 found that nearly one in four workers would lose their health coverage through work by 2023. By 2032, that figure would rise to one in three. Some defenders of the public option claim it will give private plans more leverage in their negotiations with doctors and hospitals. But only the largest employers have the kind of negotiating heft to haggle with doctors and hospitals over reimbursement rates. Further, look at our existing public options -- Medicare and Medicaid. Healthcare providers haven’t proved willing to take government-style reimbursement rates from private plans. They’ve done the opposite. The public option is back on Congress’s agenda. Seven in ten voters support it. Those folks may change their mind when they realize that a public option could spell the end of private insurance. The district kicked off the school year traditionally this week with a convocation ceremony, a welcome return of the familiar following a school year dominated by distance learning. The district’s certificated, classified and leadership team members converged on the Heritage High School lawn to officially welcome back to school each other and celebrate five, 10, 15, 20 and 25-year district employees. The biggest source of excitement: the return of full-time, in-person instruction. “Tomorrow (the first day of school) is going to be a blast,” said LHUSD Superintendent Eric Volta. “I cannot wait to welcome our students back to our campus...It’s going to be a beautiful year.” The five-district schools and Gateway program, which serves 18-22-year-old students with disabilities, anticipates an 8,411-student enrollment during the 2021-2022 school year—an increase of 109 students over last year. Several of the district’s 745 certificated, classified and leadership team members said this week they cannot wait for the school year to begin. “Last year, we had an unprecedented look at our students outside of the classroom and recognized the
immeasurable value of being in-person with them to guide them and support their learning and success,” said Liberty Education Association President Hillary Pedrotti.” We became acutely aware of how online learning can work for only a fraction of our students. The ability of students to work with each other, to have meaningful discussions and seek answers is unquestionably better in a classroom than at home. “Because of that, a return to our classrooms and in-person instruction is a welcome relief.” Volta said the district plans to implement a multi-tiered system of academic, social, emotional and behavioral support to reengage students with school after 16 months of “unique learning experiences.” Students returning to school this week should also notice several campus enhancement projects in various stages of completion, Volta added. Just a handful include a new cafeteria; administration building and classroom complex at Liberty High School; a new theater, construction classroom and auxiliary gym at Freedom; and a new culinary arts building, classroom complex and science area at Heritage. While all the programs are rolled out and construction completed, just the simple return of school is enough to excite many. “What a year it’s been and what a year to look forward to,” said CSEA President Richie Masadas. October 26, 1959 – July 20, 2021 We regretfully announce the passing of Denise Mabutas of Brentwood on July 20, 2021. She was surrounded by her family and passed away peacefully. Denise was devoted to her family. She and Don were married for 43 years and raised three daughters. She was profoundly generous and spent most of her time volunteering at her children’s school functions and taking care of others. Everyone will remember Denise for her love of Disneyland and her amazing homemade desserts and cakes that she often donated to nonprofits for their raffles. She will be deeply missed by her family, friends and community. Denise is survived by her husband (Don), three children (Alycia, Jennifer and Havana) and two grandchildren (Chris and Henry).

“Save the Earth,” a potentially harmless phrase, has been contorted into a corporate marketing scheme. Environmentalism and sustainability have been ingrained into material culture, with corporations labeling new products as “eco-friendly” and “better for the environment.” However, the deception of sustainable living products corrupts the consumer’s true environmental consciousness. Goods marketed as sustainable and zero-waste may appear a more ethical approach to consumerism. But many of these supposedly ecofriendly products are greenwashed by corporations to sell products for profit rather than heal the planet. A prime example of greenwashing, a business tactic that markets goods as sustainable, is fashion brands making their clothes from recycled materials. With little disclosed information, average consumers may be stifled by false advertisement, falling into the trap of purchasing “sustainable clothing brands” to reduce their guilt from consumerism. The business fails to account for the massive amounts of water waste, carbon emissions and unfair labor practices it used to make the “environmentally ethical” clothing. The environmental movement has a long history of catering to the wealthy elite who are able to afford manufactured goods disguised as
environmentally safe, while leaving out the people most affected: lowincome communities. With little or no governmental protection, lowincome communities are already feeling the effects of climate change, natural disasters and pollution. Disproportionate locating of industrial facilities and poorly insulated buildings have translated to an almost 10-degree disparity between low-income areas. The greenwashed items that many environmentalists encourage do nothing to aid these communities who are left vulnerable to the effects of climate change. As environmentalists continue to overlook the roots of environmental disaster, communities suffer. No amount of sustainable products will mitigate the effects of environmental disaster. What will help, however, is holding corporations accountable. A report conducted by CDP found that just 100 companies accounted for 70% of all carbon emissions. For realistic change to occur, environmental activists should focus on the corporations who are actively destroying the planet and its people. Environmentalism is not a trend that corporations should use for ulterior motives; rather, it is a movement that should be accessible and effective in the fight for a clean Earth. Sustainability is essential and necessary. An intersectional approach to environmentalism is the key to a greener future.

Summerset resident thrives on the court by Michael Dixon Correspondent
Steve Bibel remembers meeting Charlie Reed playing tennis at the courts at Summerset in Brentwood approximately eight years ago. Nearly a decade later, Reed is nearly 99, his birthday in August. Not only does Reed still play tennis — something few his age do— but Bibel and Reed’s other friends say it’s great tennis. Tennis is merely a chapter of a life that has been eventful and rich. Reed served on the Friends of the Antioch Library Board for 12 years, was the supervisor of county libraries for four years, taught special education classes for the county, along with Jim Wagner and Bill Foster, started A Place for Learning, taught global outreach classes, started a global outreach department in local churches and spent 15 Memorial Day weekends building housing for underprivileged people in Mexico. And that’s just since he retired. During his working years, he built two homes. One of which was built to live in while he attended UC Berkeley. The other was to sell to pay for the first one. He helped build Kaiser’s Richmond Shipyard and the first transport ship produced in that shipyard. Reed also served in the military for three years during World War II. Additionally, Reed has extensive experi-

ence in education. For 23 years, he served as a teacher, administrator and superintendent for California schools (in Piedmont, Oceanside, Hayward and Antioch). For 20 years, he served as a diplomat with the U.S. State Department, working in Asia and both North and South America. He later worked with the state department again, fighting against desert flying locusts in a helicopter war. Reed also worked with Mercy Corps International. During that time, Reed headed work in Africa for Pat Boone, building water wells and carrying food across borders, distributing medicine
and establishing a refugee camp for 5,000 people in Ethiopia. While in La Paz, Bolivia, Reed started an international church. To that end, he’s also taught the Bible on four different continents. Naturally, someone who does so much work internationally will have to spend time learning other languages. During his life, Reed has studied 12. This includes Spanish, Italian, Quechua and Vietnamese. The latter no doubt came in handy when Reed met Kim, a Vietnamese woman to whom he has been married for 50 years.
And while playing tennis is a small part in what’s been an eventful life, athletics has long been a part of it. In college, Reed participated in handball and wrestled. More recently, he’s taken up racket sports. In addition to tennis, he’s played racquetball. When listing his goals in life, Reed says that he wants to “Live a balanced life: mental, physical, social and spiritual,” and noted that he’s “still working on that.” He also critiqued that he “earned a low grade” in his goals of “trying to put God first, others second and himself third.”
Heritage High School basketball player helps club team win national title Heritage junior Amanda Muse played recently on the Nike Nationals 17U championship-winning CalStars basketball squad, averaging just over four points and four rebounds per game in six games at the Nike Nationals in North Augusta, South Carolina. Muse finished off the weekend with nine points and nine rebounds in the final game, helping the CalStars defeat the Texas-based CY Fair Elite 64-59 in the Nike Nationals’ top Platinum Division 17U championship game. The championship contest was televised on ESPN2 on July 25. “NATIONAL CHAMPIONS!!,” wrote Muse on Twitter. “ So grateful for my amazing team and coaches who made this possible!” The CalStars defeated six teams en route to the title, including clubs from New Jersey, Michigan, Pennsylvania, Washington and Canada. The CalStars, an Orinda-based Nike Elite Youth Basketball League-sponsored program founded in 2006, aims to improve the game of basketball from the ground up with an emphasis on

Former Deer Valley High School football star Nsimba Webster, a wide receiver, recently signed with the NFL’s San Francisco 49ers after being released by the Los Angeles Rams. The 2014 Deer Valley graduate appeared in 21 games over two seasons for the Rams, totaling 18 kick returns for 404 yards and 32 punt returns for 203 yards. Webster signed with Los Angeles as an undrafted rookie free agent in 2019 out of Eastern Washington University. At Eastern Washington University, he tallied 156 receptions for 2,233 yards and 18 touchdowns over four seasons, in addition to 48 kick returns for 1,114 yards and four punt returns for 73 yards.

Hernandez was seen gagging the child with his fingers, ostensibly to remove the devil from within her because he believed she was possessed. He repeatedly screamed that he intended to kill the child. Hernandez’s partner, the child’s mother, attempted unsuccessfully to take her screaming baby from Hernandez several times. The mother handed her to witnesses, who removed the child safely from the incident scene. Ares Adventure Crew summits Mount Shasta By Kaitlyn Gleeson Staff Writer
Even though we do not have wings, humanity will find a way to touch the sky. Ares Adventure Crew, of the Ares Brazilian Jiu-Jitsu studio, found a way to do just that when they climbed to the summit of Mount Shasta. On July 10, the seven member crew began their trek up the mountain to make base camp. On July 11, three members of Ares Adventure Crew - Seth Corvus, 17, Chance Soltero, 25, and Ryan Sanders, 17 were able to reach the 14,180 foot summit of Mount Shasta. The team would spend two days on the mountain, reaching the summit and doing a full descent on the second day. “It was daunting,” explained Soltero in relation to the preparations the crew had to go through prior to their ascent. “I’m pretty active. I train all day for the most part. I’m a professional athlete so I’m in really good shape. But it’s a completely different variable. You have to worry about the altitude, you have to worry about literally carrying your own food.” Soltero, who is currently in the process of transitioning into a professional MMA career, emphasized the importance of physical capability being built up far in advance for the trip. Before the Adventure Crew would ascend the mountain, they would spend a long time preparing themselves for the journey. “I started running every single day,” commented Corvus, a former Junior Olympian in Taekwondo, referencing the physical conditioning that the crew had to work through. Aside from physical preparation, there was significant emphasis on the need for mental strength. Soltero expanded on this, saying, “For us to plan the trip, like with all the logistics actually all together, I would say about two weeks. But we started the mental preparation last year.” This high level of preparation was more than necessary, as the steep incline of the mountain was an incredibly difficult feat. Sanders stated, “It [the grade] was 45% and it was 1000 ft. per mile.”
As the crew ascended and descended, they had a unique way of checking their progress. As Soltero statd, “We didn’t have any technical equipment for summit elevation. So every time we were ascending and descending, [Ryan] would use his snapchat filter to see elevation.” Despite the preparation done in advance of the climb, the adventure crew members each had their own challenge to face during the journey. For Sanders, who has a black belt in Karate and a blue belt in Jiu-Jitsu, he articulated “I’ve never been that high. You can stop and take a break but you’re not catching your breath.” Physical exhaustion was a difficult challenge for him, as he continued, “the entire time you’re sitting there, and your heart is still going and your legs aren’t charging back up.” Even after the ascent was finished, their journey was not finished. “The physical hardest part was actually the descent,” explained Soltero, “I would say about half way through our descent, because it was sandy gravelish terrain, what we were doing to get down a lot was we were literally sliding down or almost like galloping down to try to get down there faster.” Despite the challenges that the crew faced, they were still able to touch the sky when they summited the mountain. No matter the difficulties that they faced - mental or physical - they reached a place that would feel like the top of the world. “For me my favorite part was the accomplishment,” recalled Corvus. “At the summit being like ‘I just climbed a mountain.’’ Climbing to the summit of Mount Shasta was a long, 16 hour journey, but against difficult physical and mental challenges, the three members of the Ares Adventure Crew were able to make it. Even the other four team members who did not summit did well, making it past the 11,000-foot elevation mark. The story of the crew showcases strong characteristics in these athletes, such as determination, perseverance, and commitment. As Corvus stated when reflecting on the journey, “Whatever you got going on, as long as you can set your mind to it you can do it.”
