CA’s Missed Opportunities to Gather Important Data

When it comes to making a case for change, the numbers matter. In 2022 researchers examined hate crime data from the 2017-2019 National Crime Victimization Survey. As the first nationally representative and comprehensive criminal victimization data to include information on the sexual orientation and gender identity of respondents the findings were concerning.

The report found members of the LGBT+ community were nine times more likely than non-LGBT+ people to be victims of violent hate crimes.

And yet, this is only one of a myriad of issues impacting this community. Another important area of concern is health. Whether it is dealing with the high suicide rate among LGBTQ+ youth or other health related issues, the LGBT+ community faces issues similar to other underserved communities.

In July 2018 California enacted a new law requiring most departments, including the California Department of Public Health, to collect and report voluntarily provided selfidentification information data anytime they collect ancestry or ethnic origin information.

important by a series of studies that found consistently collecting and analyzing such data on sexual orientation and gender identity (SOGI) enables state agencies to identify groups within the lesbian, gay, bisexual, transgender, and queer or questioning (LGBTQ) communities who are disproportionately underserved. Armed with such information, agencies are better able to direct targeted outreach and other services to these populations.

This approach can only be useful if everyone complies with the law and reports the information. That, however, is not the case. A recent report by the CA State Auditor found The state’s Public Health department collects such data on only a small portion of its forms intended to gather demographic data.

Of the 129 forms reviewed by state auditors, 105 were exempt, but not prohibited, from collecting this information. Most of these forms were exempt because the data is collected by a third party, such as a local health jurisdiction. This exemption, however, “severely limits the amount of SOGI data the department is required to collect.”

USC & UCLA Split Annual Dual on the Track

Always an intense cross-town rivalry, this year’s meet at UCLA’s Drake Stadium would be no exception.

Two weeks out from the PAC 12 Track & Field Championship, UCLA and USC battled each other in every event. The Bruin Men came out decisively on top 88-70, but the Trojan Women gained a meet split by outpointing the Lady Bruins 88-75.

The final race, men’s (4x400) was marred by taunting on the final leg which resulted in both teams being disqualified and illustrating the

fact that there is no love lost between USC and UCLA, regardless of the competition.

Bruin men excelled in the 400, 800 and pole vault, also winning the triple jump, shot put and javelin. USC men swept the 100, won the 110m hurdles and high jump, but it was not enough to overtake the Bruins on Sunday.

The USC women excelled in most of the sprints and especially in the jumping events, led by the Lady Trojans super junior, Pac 12 “Athlete of the Week,” Temi Ojora who won at all three disciplines. Ojora won the long jump with a winning leap of 20-03, the triple jump with a 44-11.75 and the high jump at 5-08.75.

Both schools will now prepare for the upcoming PAC 12 Track & Field Championships to be held at Mt. SAC, the historic grounds of Hilmer Lodge on May 12-14th.

As sexual assault awareness month drew to a close last week, one local woman agreed to share her story of abuse and trauma that began in childhood. She did so in hopes of helping others find their way from victim to survivor. Her name has been changed to protect her identity.

“It's actually one of the first memories I've ever had since I was a child. I was at daycare,

and this guy who was supposed to take care of us ended up molesting me on multiple different occasions. I went home and told my parents after one time, and they ended up getting the police involved,” Marie said.

“I wasn't allowed to talk about it at home. I would try to bring it up to my dad, and my dad would just tell me to stop talking about that. If I brought it up to my mom, she was just very quiet,” Marie said. “She avoided it, and it just made me feel very unsafe.”

One in nine girls and one in twenty boys under the age of 18 experience sexual abuse or

assault, according to the Rape, Abuse & Incest National Network(RAINN).

The pattern of assault didn’t end there. Marie said she was assaulted a few years later by her brother.

”Then in fifth grade, two boys coerced her into letting them inappropriately touch her.

“I didn't feel like I could say no. I just kind of accepted that this was something that was just going to happen to me,” Marie said.

A desperate search for love

Marie went on to show how as a teenager, she was taken advantage of by older men who she thought loved her but were predators.

“I would play Play Station, and there was this one guy in particular that I met, [he] was 29, and I was only 15. We were talking on FaceTime, and it just became very sexual, very inappropriate, very fast. Immediately, I knew it was wrong.”

Marie said she attempted to block him and cut off all contact. To this day, the older man who preyed on her still watches her Instagram

stories.

At 16, Marie entered a toxic relationship with a man three years her senior.

“I was just really desperate for just love and affection. I just felt like I was neglected for so long. I just really wanted a relationship. I wanted somebody to love me unconditionally. When I met him, and things started off, I was really in love with him,” confided Marie.

At the same time, there were many things she felt pressured to partake in; because he was older and would push her to participate in harmful activities. He got her involved in smoking and drinking while she was still a minor and sexually forced himself on her.

Emotion, physical and verbal abuse

At 18 years old, she moved in with her boyfriend (at the time), his dad, and his brother. She was subjected to verbal and emotional abuse from all three.

Just over a year ago, a leaked draft opinion revealed that the U.S. Supreme Court voted to strike down Roe v. Wade, according to POLITICO, who broke the news on May 2, 2022.

The draft opinion, written by Justice Samuel Alito, argued that Roe was “egregiously wrong from the start” and the reasoning behind the landmark decision was “exceptionally weak.”

“We hold that Roe and Casey must be overruled. The Constitution makes no reference to abortion, and no such right is implicitly protected by any constitutional provision, including the one on which the defenders of Roe and Casey now chiefly rely—the Due Process Clause of the Fourteenth Amendment,” Alito wrote. The initial draft opinion was stamped with a Feb. 10, 2022 circulation date.

Planned Parenthood v. Casey, the notable 1992 decision on abortion rights, upheld the ruling in Roe v. Wade and affirmed the right to a legal abortion.

On June 24, 2022 — one month after the document was leaked — the draft opinion became reality when the Supreme Court abolished the right to an abortion and left the decision up to individual states.

Since Roe was overturned, 14 states have enacted complete bans on abortion, one state (Georgia) has a six-week ban on abortion and four states have abortion bans from 15 to 20 weeks. Several judges across Indiana, Iowa, Montana, Ohio and Wyoming have blocked attempts at enacting abortion bans.

Across the rest of the U.S., abortion services remain legal, and in states like California, new legal protections have been put in place to protect all aspects of reproductive access, including patient data, access to abortion medication and protections for people traveling from out-ofstate to seek services.

As more states threaten to restrict and ban abortion-related services and medications, California Governor Gavin Newsom and other Reproductive Freedom Alliance member states have made plans to stockpile another abortion medication, misoprostol, following a Texas federal judge’s attempt to rescind the U.S. Food and Drug Administration’s (FDA) approval

Fight Over Medication Abortion Continues

Since the U.S. Supreme Court overturned Roe vs Wade on June 24, 2022, and left the abortion issue in the hands of the states, conservative leaders in states across the country have enacted complete bans on abortion or restricted access to abortion related services and/or medications. The most recent national battle over abortion involves the attempt by a Texas federal judge to rescind the U.S. Food and Drug Administration’s (FDA) approval of mifepristone, one of the drugs used in the process of ending a pregnancy. “In a world where the FDA is forced to rescind approval of mifepristone, it means that the most commonly used protocol for medication abortion in the United States would no longer be available,” said Cat Duffy, a policy analyst for the National Health Law Program. “If we’re talking about the scenario where the FDA is forced to

take mifepristone off the market, it would really, fundamentally impact access to abortion.”

Duffy highlighted data from the Guttmacher Institute which found that medication abortion accounted for 53% of all facility-based abortions in the U.S. in 2020. If the use of mifepristone is banned or restricted, patients would be forced to seek out procedural abortions at a

According to Marie, she was called derogatory names on multiple occasions, her finger was fractured after one of the men tried to snatch an item away from her, and she was chastised for minimal things like trying to organize the kitchen cabinet.

At 20, she left that relationship and moved back home with her family.

Coming home

“When I finally [prepared to] move back home, my mom questioned [whether] she should let me move back. That hurt a lot, and at that moment, I just put it to the side that she would even [have to] consider it,” Marie said.

“Deep down, I knew that a lot of [what happened to me] was her fault,” Marie opined. She further expressed her belief that it was her mom’s responsibility to make sure Marie was safe and didn’t get hurt. “I was not safe, and that's on her. A lot of things that I did were because of [what happened to me].”

According to Marie, over the past couple of years, she and her mom have worked to repair their relationship and started the healing process together. Reading books like The Emotionally Absent Mother by Jasmin Lee Cori has helped

The Line Begins Here: A History of Redlining in Southern California’s Inland Empire

In the beginning

“[To] create a more secure, democratic, and prosperous world for the benefit of the American people and the international community,” the mission statement of the US Department of State established in 1789, resonates with the idea of the American dream, a dream lauded universally for more than three centuries. Yet, millions of Americans suffer from the impact of a history that disallows certain groups of people from experiencing prosperity.

With the abolishment of slavery in 1865, came new and inventive ways to keep African Americans at a financial deficit, existing in an oppressive state that would hinder advancement in multiple areas of life. This includes one of the top foundational channels to building sustainability and intergenerational capital, the right to own real estate when and where one chooses.

One such establishment impacting traditional American life-building was the invention of redlining in neighborhoods across the country.

The impact of redlining left unhealed economic, health, safety, and educational bruises on communities nationwide that can still be seen today.

In the year 2020, 331.4 million people were reported to live in America, yet the US Census reports that 8.25 million people were identified as living in areas that were sectioned off on maps, identified as dangerous and redlined around 80 years ago.

While many folks migrated west during the first and second waves of migration between 1900’s and 1970’s for a better life, California still held in its fabric the stench of racist practices and was not exempt from the system of redlining. Deeper still, the Inland Empire - an urban and metropolitan area

east of Los Angeles - carries its own rich history that embodied this practice. This history of segregation has contributed to ongoing racial inequalities and divides.

Redlining

So, what is redlining? The term “redlining” was coined by sociologist John McKnight in the 1960s and derives from how the federal government and lenders would literally draw a red line on a map around neighborhoods that they would not invest in based on demographics alone. The federal reserve defines redlining as “the practice of denying a creditworthy applicant a loan for housing in a certain neighborhood even though the applicant may otherwise be eligible for the loan”.

In the 1930s the federal government

began redlining real estate, marking “risky” neighborhoods for federal mortgage loans on the basis of race. This practice played a pivotal role in helping to create a segregated housing market.

In an interview with the Bridges

Thank Carried Us Project, the late Frances Grice a Civil Rights Activist who resided in the San Bernardino stated, “Every time I'd go to a real estate office, they'd send me back across the bridge....That was my first feeling that there was something wrong in this community. This beautiful valley that I'd seen, something was wrong. Then I noticed that all of the Black people lived on the other side of the freeway.”

1934 with the signing of the National Housing Act by by President Franklin D. Roosevelt through the New Deal.

The National Housing Act included ideas that were meant to help people with lower incomes. These initiatives included lower mortgages and longer payback periods allowing more individuals to buy homes. Through this, the Home Owners Loan Corporation (HOLC) came into existence to ensure that people would not default on their homes, or as it was posed, security for investors.

This organization introduced maps that would section off various areas including ones considered hazardous, which were generally populated by Blacks and other minorities. These loans were denied to those living in hazardous or redlined areas, which resulted in owners abandoning the homes they couldn’t afford, not being able to perform renovations or upkeep, and more, creating more crime-ridden and poverty-stricken neighborhoods.

White flight

Enter the term “white flight”, while neighborhood conditions were worsening in these areas, white people would be convinced to flee to newer suburban communities which excluded Black residents from buying homes. Real estate agents often encouraged the process of white flight through block busting, a practice where owners would be convinced to sell homes for cheap due to fear of another race or class moving in, then the homes would be sold at a higher rate.

“Realtors came in, scared the White people who lived there and then lured Black people into moving and they didn’t know they were part of a blockbusting campaign.” recalled the late Lois Carson, a San

Bernardino resident who resided on 16th street and who organized against blockbusting.

When the National Housing Act was passed in 1934, examples of this practice can be seen in many major cities across the nation, including the Inland Empire where unofficial redlining took place in the 1920s according to University of Redlands’ Professor Jennifer Tilton.

As time moved on, many minorities have been impacted by redlining, but in the Inland Empire, African Americans experienced the greatest impact. The decision to segregate Blacks and minorities through redlining created additional issues which have had a lasting impact such as poverty, health inequality, food apartheid, and education.

The Fair Housing Act

In the year 1968, the Fair Housing Act was passed by Congress, a policy meant to bring about equal housing opportunities. In the early 70s to 80s, the lines started to blur a little but were still visible.

Community

While the practice of redlining has disproportionately impacted Blacks, it should not be ignored that other minority groups also experienced housing discrimination. Those groups included Mexican Americans, Japanese Americans, and others, who in the Inland Empire, played a role in the area's agricultural and railroad industry growth. Yet, tools like racial covenants and others that make up the ingredients of redlining were used towards these groups as well.

In minority neighborhoods residents built and strengthened community bonds through various means, such as patronizing local businesses and enjoying recreational spaces. However, housing segregation often limited the potential for true community growth as these communities often lacked the support needed for sustainability including school quality and job opportunities. Yet, there remained

the benefits of good neighbors as described by former California Assemblymember Cheryl Brown, a resident of the Inland Empire since the 1950s.

“We had a wonderful wonderful neighborhood. Doctor Holder lived next door to us, across the street were two teachers, on the corner was a military family,” recalled Brown. While initial movement into areas that were squared off may have posed some positives for residents as shared by Brown in addition to places like the Community Settlement House on Bermuda Avenue in Riverside that provided services, housing segregation and redlining restricted many minority homeowners from permanent ownership or even being able to repair and improve their properties. This continued to result in crime and poverty, which may have impacted social interactions.

The importance of education in building community Education is one of the key spaces where community connection begins within neighborhoods thus highlighting the importance of quality schools for a positive social impact on the individual. In redlined neighborhoods, the decline in economic access created a decline in home value, which in turn meant less financial support (including property taxes) was available for schools in the neighborhood. The status of local schools would impact the value of homes and vice versa in the red-lined communities, therefore, creating a never-ending downward spiral in segregated areas, many of which became impoverished.

The Mill School, located in a neighborhood in South San Bernardino known as the Valley Truck Farms, was a thriving school in a racially mixed neighborhood, but as the Black population increased, white flight “sprouted wings” and accelerated in the 1940’s when the school hired its first Black teacher, Dorothy Inghram.

The lack of economic mobility posed a problem in general for homeowners' ability to accrue generational wealth and maintain and build the community they had moved into, a problem that persists to today. The exit of some homeowners or the nonexistence of wholesome upkeep, resulted in more people leaving or those who stayed, experiencing the decline in their neighborhood. However, even the exit of some residents would result in more issues as they looked to relocate to other neighborhoods.

For the few who successfully moved in where covenants against Blacks were in place, some experienced cross

Some would choose to stay, while others would decide that it was not worth it.

These kinds of displays along with the many other resistances that were met, began the longstanding historical impact on the Black community’s efforts to establish sustainable infrastructure and wealth.

What was done?

Many civil rights groups and activists did their best to combat the issues that arose from housing segregation as well as to work to dissolve redlining altogether. Such actions were often birthed at local Black churches as Black churches are historically the epicenter of community connection, resistance, demands for change, and growth. The church also serves as a place for solace and help, networking among Black professionals, and community building.

An example of this were the comments made by the Rev. J. H. Wilson, minister and leader of the Black community’s oldest place of worship in Riverside, the Allen Chapel African

Methodist Espicopal Church (12th and Howard) during the opening of Mercantile Hall in 1905. Speaking about the importance of securing political recognition and economic advantage through education and self reliance he said, “[S]eparation of the races on planes of equality is more valuable than a lot of sentimental platitudes resulting in actual race discrimination.”

Recognizing homeownership as pivotal to economic growth and advantage, members of the Black community fought against redlining in a number of ways including organized demonstrations.

The National Association for the Advancement of Colored People (NAACP) had chapters where leaders often pushed back against local covenants and created community networks. One such example in the Inland Empire was that of the NAACP Youth Council which was active in the 1950s and met in Johnson Hall previously on the corner of 9th and Wilson in Riverside. Protests were also organized to fight against segregation in schools, one is cited from San Bernardino’s Congress of Racial Equality group in 1963, where leaders were arrested, but many more protests would continue during this era.

Other actions were taken by residents to create community and build up the neighborhoods while also looking to create opportunities for integration into better neighborhoods down the line.

A lingering impact

The practice of redlining, which was only officially in play for the better part of 30 years, are still felt within Black communities. Many see the “Martin Luther King Blvd. streets” as the marker for these underprivileged Black neighborhoods, but these areas are simply the outcome of a practice that intentionally restricted a certain sector of people from accessing the American dream.

As we dive more deeply into the history of redlining in the Inland Empire, we will also begin to look at what solutions are being put in place almost a full century later to continue combating the practice of redlining and its consequences.

Because redlining became illegal with the signing of the Fair Housing Act, many assumed that the issues resulting from it, as well as the segregated neighborhoods, were dissolved. But, practices continued that perpetuated the existence of limited expansion beyond relined neighborhoods for several decades.

Interestingly, “The gap in homeownership rates between white and Black families is larger today than it was before the passage of the Fair Housing

Act of 1968,” the US Justice Department noted in an October 2021 press release.

In 2021, the United States Justice Department released a statement regarding a new initiative being put into place to address the existing impacts of redlining. The new initiative aims to work with the Civil Rights Division’s Housing and Civil Enforcement as well as US Attorney’s offices to create a plan that provides equal opportunities for homeownership and mortgage credit. While this may seem similar to the Fair Housing Act, the statement provides more details on how this will be implemented.

While this initiative does not provide a solution that completely and immediately dissolves the issue, this indicates that the work of many to bring awareness to its constant existence, community involvement, in addition to the interest and work of Civil Rights activists are finally being heard in spaces where real change is being made.

clinic instead of getting access to treatment via telehealth services and mail delivery, Duffy explained. Some patients would also be forced to use misoprostol instead. Misoprostol can be taken 48 hours after mifepristone, as the second medicine in the two-pill process.

According to Planned Parenthood, the use of misoprostol alone is safe and has a complication rate of less than 1%. The effectiveness of misoprostol depends on how far along a person is in their pregnancy, how the medicine is taken and how many doses are taken. Planned Parenthood noted that misoprostol-only abortions work 85-95% of the time.

For now, access to mifepristone remains unchanged following the U.S. Supreme Court’s order on April 21 which upholds the FDA’s

approval of the abortion medication, blocking lower courts from placing bans on the use of the FDA-approved medication. The 5th Circuit Court of Appeals has scheduled oral arguments in the case for May 17.

“The U.S. Supreme Court is right to take this action to protect access to medication abortion and put a hold on the extreme decisions of the Texas judge and the Fifth Circuit Court of Appeals,” said Newsom in a statement. “Mifepristone is safe, legal and has been FDAapproved for more than two decades. For now, the Court has followed science, data and the law rather than an extreme and out of touch political agenda. Medication abortion is available and

“It's a blessing, you know, to have my mom on my side and to have her in my support system. She's trying harder than she ever has,” Marie stated. “My life has really changed.”

The importance of local support

Getting involved with the nonprofit community organization based in San Bernardino, Partners Against Violence (PAV), has helped Marie by providing her with vital support to help her heal from past trauma.

“I had finally gotten out of that abusive lifestyle and realized that it was a pattern. The first step to realizing that was reaching out to the sexual abuse hotline, which is what led me to Partners Against Violence. Now, anytime anyone talks to me about any type of related issue that may have occurred in their life or their loved ones' life, I always recommend Partners Against Violence,” Marie said.

Marie is currently in a new healthy relationship with a loving partner, and they also go to couples counseling together to support each other and work on healing from past trauma.

Support Organizations

PAV provides advocacy services to victims of abuse who need help navigating the reporting process with law enforcement or going to the hospital for a forensic exam.

PAV provides weekly empowerment groups and counseling services.

PAV operates with about 40 volunteers spread out between three facilities. The number of volunteers has dwindled in the wake of the pandemic, and the organization is still trying to recruit.

PAV's prevention team travels to middle schools, high schools, and colleges, educating students on healthy relationships and recognizing and making safe decisions and the signs of an unhealthy relationship.

and consistent policies and procedures” have served to hinder the departments ability to collect the requested data.

Of the remaining 24 forms required to collect SOGI data, only 17 do so in a complete manner. Worse still, because of resource and technical limitations, Public Health apparently cannot export the data it does collect for over 100 of the 128 reportable disease conditions in its reportable disease information exchange system.

The auditor further noted that despite Public Health’s critical role in gathering this information on SOGI individuals, the department has not provided any guidelines, training or resources to local health jurisdictions or health care providers to collect this information in the field.

The auditor provided recommendations for the the legislature to step in and amend the law requiring Public Health to collect SOGI data from third-party entities, including local health jurisdictions, on any forms or electronic data systems unless prohibited by federal or state law.

Having credible demographic information is important on nearly every issue involving underserved communities as a way to direct funding to the right areas for the right reasons whether it be funding for underserved minority students in school, directing funds to communities to provide services for seniors, or providing funding and services to those identified as SOGI communities who remained underserved–data is important, numbers matter, especially for the underserved.

This is just another glaring example of how important it is to track demographic information as a way to fairly allocate public funding according to need. It is also another glaring example of how the legislature passes laws designed to make progress toward mitigating longstanding issues related to structural and systemic bias, there is never enough teeth in the legislation to repair the problem.

Of course, this is just my opinion. I’m keeping it real.
